NOTICE OF AGGRAVATING FACTORS

The State of Connecticut by and through its undersigned attorneys, hereby gives notice of the

aggravating factors that the State intends to prove at the penalty hearing, Connecticut General

Statutes, Section 53a-46a(i):

FOURTH COUNT (Murder of Two or More Persons)

a. The defendant committed the offense during the commission of, or during the

immediate flight from the commission of a felony and he had previously been convicted of the same

felony, to wit: Burglary in the Second Degree (Section 53a-I02 C.G.S.) which is an aggravating

factor. Section 53a-46a(i)(1).

b. The defendant committed the murders of Jennifer Hawke-Petit, Haley Petit and

Michaela Petit and each murder was committed in an especially heinous, cruel or depraved manner.

Section 53a-46a(i)(4).

FIFTH COUNT (Murder of Michaela Petit)

a. The defendant committed the offense. during the commission of, or during the

immediate flight from the commission of a felony and he had previously been convicted of the same

felony, to wit: Burglary in the Second Degree(Section 53a-I02 C.G.S.), which is an aggravating

factor. Section 53a-46(i)(l).

b. The defendant committed the offense and in such commission knowingly created a

grave risk of death to another person to. Section 53a-46a(i)(3).

c. The defendant committed the offense in an especially heinous, cruel or depraved

manner. Section 53a-46a(i)(4).

TENTH COUNT (Murder of Jennifer Hawke-Petit)

a. The defendant committed the offense during the commission of, or during the

immediate flight from the commission of a felony and he had previously been convicted of the same

felony, to wit: Burglary in the Second Degree(Section 53a-102 e.G.S.), which is an aggravating

factor. Section 53a-46a(i)( 1).

b. The defendant committed the offense in an especially heinous, cruel or depraved

manner. Section 53a-46a(i)( 4).

ELEVENTH COUNT (Murder of Haley Petit)

a. The defendant committed the offense during the commission of, or during the

immediate flight from the commission of a felony and he had previously been convicted of the same

felony, to wit: Burglary in the Second Degree(Section 53a-1 02 C.G.S.), which is an aggravating
