ARTICLE 1 - INTENT AND PURPOSE

1.01 The intent and purpose of this Agreement is to promote co-operation and harmony, to recognize mutual interests, to provide a channel through which information and problems may be transmitted from one to the other, to formulate rules to govern the relationship between the Union and the Employer, to promote efficiency and service and to set forth herein, the basic Agreement controlling rates of pay, hours of work, dispute procedures and conditions of employment

ARTICLE 2- COVERAGE

2.01 The Employer recognizes the Union as the exclusive bargaining agent of all employees of the Employer at the Hemlo Project save and except foremen, and persons above the rank of foreman, students employed for the school vacation period, office and sales staff.

ARTICLE 3- RECOGNITION AND UNION SECURITY

3.01 The Employer agrees to bargain exclusively with the Union with respect to employees of the Employer covered by this Agreement

3.02 The Employer agrees that all employees of the Employer within the bargaining unit shall, as a condition of employment, secure membership in the Union within seven (7) days of hiring and maintain such membership in good standing during the term of this Agreement. And as a condition of employment, all employees with the bargaining unit who work forty (40) hours or more in a calendar month shall be deducted Regular Monthly Union Dues. The remittance shall be forwarded to the Union on forms supplied by the Union by the 15th day of the following month.

ARTICLE 4- NO STRIKES OR LOCKOUTS

4.01 The Employer agrees that there will be no lockouts during the term of this Agreement.

4.02 The Union agrees that there will be no strikes or slow-downs, either complete or partial, or other collective action, which will stop or interfere with operations during the term of this Agreement

ARTICLES - MANAGEMENT RIGHTS

5.01 Nothing in this Agreement shall be deemed to limit the Employer in any way in the exercise of the regular and customary functions of management, including the making of such rules relating to manufacturing operations, as it shall consider advisable, provided that such rules shall not be inconsistent with the terms of this Agreement

5.02 Non-working foremen shall be considered as part of management and shall supervise only. They shall not do the work normally performed by employees in the bargaining unit except to demonstrate job methods in the instruction of employees or to assist in emergency cases.

5.03 The Union acknowledges that it is the exclusive function of the Employer to maintain order, discipline and efficiency.

5.04 The Union acknowledges that it is the exclusive function of the Employer to hire, discharge, transfer, promote, demote or discipline employees, provided that a claim of discriminatory promotion, demotion or transfer, or a claim that an employee has been discharged or disciplined without reasonable cause may be the subject of a grievance and dealt with as hereinafter provided under Article 7.

6.01 A steward, or stewards, shall be an employee who is a qualified member of the Union in good standing, appointed or otherwise selected by the Union .. !! will be his duty to assist the Employer and the Union members in carrying out the provisions of this Agreement.

6.02 The steward, or stewards, shall have seniority over all employees within the department in which he maintain seniority, during his term of office, for lay-off purposes only, provided that the Employer is not prevented from maintaining an efficient working force.

6.03 The Union recognizes that stewards have regular work to perform on behalf of the Employer. The Employer agrees to give such stewards reasonable time away from their regular work when required to adjust grievance(s), provided that they obtain their foreman's permission before leaving their regular work.

6.04 The Union will inform the Employer, in writing, of the names of the stewards and of any subsequent changes. The Employer shall not be required to recognize the stewards until such notification has been received.

6.05 The Employer will grant leave of absence without pay, but without loss of seniority, to a steward or delegate to attend Union conventions and conferences, provided the Employer is requested in writing, one (1) week prior to the date of leaving for such leave of absence by the Union.

ARTICLE 7- GRIEVANCE PROCEDURE

7.01 A grievance shall be a difference, dispute or complaint arising over the interpretation, application or alleged violation of this Agreement. At Step 2 below, the grievance shall be submitted, in writing, in

· triplicate, on forms supplied by the Union and signed by the employee and shall include the article in this Agreement in dispute.

STEP 1 - By a conference between the aggrieved employee and his immediate supervisor. Such a supervisor shall give his decision within two (2) full working days. The employee may be accompanied by his steward. Failing settlement, then;

STEP 2 - Within three (3) full working days following the decision in Step 1, an official or officials of the Union shall meet with representatives of the Employer, at which time the written record of the grievance shall be presented. The decision shall be given in writing within three (3) full working days following this meeting.

7.02 Failing settlement under Step 2 of any difference between the parties arising from the interpretation, administration or alleged violation of this Agreement, such difference may be taken to arbitration as hereinafter provided, and if no written request for arbitration is received within ten (1 0) full working days after the decision in Step 2 is given, the grievance shall be deemed to have been abandoned.

7.03 No complaint or grievance may be submitted or considered under the grievance procedure unless it has been presented within five (5) workings days from the time of the incident giving rise to the grievance.

7.04 Any complaint or grievance concerning or affecting a group of employees shall be originated under Step 2.

7.05 Any complaint or grievance arising directly between the Employer and the Union shall be originated under Step 2.

7.06 The Employer shall not be responsible for the payment of time spent by an employee in the investigation and settlement of grievances.

8.01 When either party requests that a dispute be submitted to arbitration as herein before provided, it shall notify the other party in writing and at the same time nominate and arbitrator. Through the process of mutual agreement, the parties may agree upon the appointment of a sole arbitrator.

8.02 The two arbitrators so nominated shall attempt to select by agreement a chairman of the arbitration board. If they are unable to agree upon a chairman within a period of ten (1 0) full working days following the date of their appointment, they will then request the Minister of Labour for the Province of Ontario to appoint a chairman.

8.03 No person may be appointed as an arbitrator who has been involved in an attempt to negotiate or settle the grievance.

8.04 No matter may be submitted to arbitration which has not been carried through the proper steps of the grievance procedure.

8.05 The arbitration board shall not be authorized to make any decision inconsistent with the provisions of this Agreement, nor to alter, modify or amend any part of this Agreement.

8.06 The proceedings of the arbitration board shall be expedited by the parties hereto and the decision of the majority of such board will be final and binding upon the parties hereto and the employee(s) concerned, and if there is no majority, the decision of the chairman shall govern.

8.07 Each of the parties hereto will bear the expense of the arbitrator appointed by it, and the parties will jointly bear the expense of the chairman of the arbitration board.

ARTICLE 9 • INJURY ALLOWANCE

9.01 An employee who is injured at work and as a result of such injury is ordered home or elsewhere for treatment shall be paid at the regular rate for the balance of the day or shift, but is only to be paid if not paid by Workmen's Compensation or Weekly Indemnity Benefits.

ARTICLE 10 ·ADMISSION TO COMPANY PROPERTY

10.01 The Business Representative(s) of the Union shall have access to any of the Employer's yards during working hours with the consent of the Superintendent of the Employer in charge thereof, but shall in no case interfere with the progress of the work. Consent shall not be unreasonably withheld.

ARTICLE 11 ·HOURS. OF WORK AND OVERTIME

11.01 The regular hours of work shall be ten (1 0) hours per shift, Monday to Friday.

11.02 Overtime at the rate of time and one-half (1-1/2) shall be paid after ten (1 0) hours work per shift or forty-four (44) hours per week and for all hours worked on Saturday and Sunday.

11.03 The parties agree that there can be no pyramiding of overtime.

11.04 It is understood that employees will take a half hour without pay for lunch during the working period between the fourth and sixth hours. Where an employee requires an additional meal period, he may arrange for an extra half hour off without pay.

11.05 Employees shall have paid rest periods of ten (1 0) minutes duration as near as possible to the midpoint of each half shift.

12.01 An employee who reports for work at his normal time and is not provided with at least four (4) hours work shall be paid at least four (4) hours pay at his normal rate. He maybe assigned to any duties that are available for these hours, unless released by the foreman. The provisions of this article do not apply where the employee has been notified (before leaving home) not to report to work.

12.02 Two (2) hours pay shall be allowed by the Employer to each employee who reports for work and work is not available due to inclement weather.

12.03 An employee called out during other than regular hours shall receive a minimum of four (4) hours pay at the applicable rate, provided that he performs the work available for the hours concerned, unless released by the foreman.

12.04 Two (2) hours pay at straight time rates will be provided to each employee who is required to stand­by on a Sunday and who does not get called in to work.

ARTICLE 13- PAID HOLIDAYS

13.01 The following Holidays will be granted to all employees, with pay:

New Year's Day Family Day Good Friday Victoria Day Dominion Day

Civic Holiday Labour Day Thanksgiving Day Christmas Day Boxing Day

13.02 When a Statutory Holiday falls on a Saturday or Sunday, the Friday preceding, or the Monday ·following shall be declared the Statutory Holiday.

13.03 To be eligible for pay for the above Holidays, employees must work the last scheduled shift before the Holiday and the first scheduled shift following the Holiday, unless other arrangements are made and agreed to prior to the Holiday.

13.04 Employees will be paid for Christmas Day, Boxing Day and New Year's Day if they work on or after December 15th and return to work on or before January 15th.

13.05 Pay for the above Holidays will be calculated at ten (1 0) hours per day.

13.06 For the purpose of calculating overtime, the paid Holiday shall be considered as time worked on the basis of payment as set out in Article 13.05.

ARTICLE 14- VACATION WITH PAY

14.01 Vacation Pay shall be held separate and apart to the credit of employees. Vacation Pay shall be credited bi-weekly to each employee covered by this Agreement, at the rates outlined below, and income tax will be deducted bi-weekly.

Up to three (3) years employment- 4% of gross wages earned; After three (3) years employment- 5% of gross wages earned; After five (5) years employment - 6% of gross wages earned. After twelve (12) years of employment- 8% of gross wages earned.

14.02 It is further understood that Vacation Pay credits will be paid to employees according to the Employment Standards Act, or on termination of employment.

ARTICLE 15- PAYMENT OF WAGES

15.01 Wages will be paid on a bi-weekly basis by direct deposit.

16.01 The Employer agrees to pay and the Union agrees to accept, for the duration of this Agreement, the following wage rates:

Effective October 1, 2013 - $19.94 I hour (other than Satcher) Effective October 1, 2014- $20.29 I hour (other than Satcher) Effective October 1, 2015- $20.64 I hour (other than Satcher)

Effective October 1, 2013 - $20.69 I hour (Satcher) Effective October 1, 2014- $21.29 I hour (Satcher) Effective October 1, 2015-$21.89 I hour (Satcher)

A Learner Rate for newly hired employees may be paid at One Dollar and Fifty Cents ($1.50) below the Classification rate for the first sixty (60) days worked.

ARTICLE 17 ·TRAVEL ALLOWANCE

17.01 All employees who are temporarily assigned to a work location outside of Marathon, beyond an eighty (80) kilometre radius, will be paid eight (8) hours for travel allowance every thirty (30) calendar days.

ARTICLE18 ·BENEFIT and PENSION PLAN

18.01 The Employer agrees to pay premiums to a group insurance carrier to provide the following benefits:

Group Life Insurance in the amount of Thirty-Five Thousand Dollars ($35,000.00)

Accidental Death and Dismemberment Insurance in the amount of Thirty-Five Thousand Dollars ($35,000.00)

Dependent Life Insurance in the amount of Ten Thousand Dollars ($10,000.00) for spouse and Five Thousand ($5,000.00) for each child.

18.02 Weekly Indemnity Insurance equivalent to E.l. maximum on a 1/1/8/26 basis. All premium reduction revert to the Employer to provide Benefits based on weekly Employment Insurance maximum.

18.03 Long Term Disability of a flat rate of Eight Hundred Dollars ($800.00) per month, 26 week waiting period, 2 year own occupation, 10 year maximum benefit period, not to exceed age 65.

18.04 A Major Medical Plan with benefits 100% reimbursement of costs - Lifetime maximum One Hundred and Fifty Thousand Dollars ($150,000.00/ for prescribed drugs/ambulance service with annual reinstatement of $1,000.00 each January 1'. Includes semi-private hospital care.

18.05 A Dental Plan with benefits equivalent to 100% reimbursement of costs $2000.00 per year combined maximum for basic and major restorative procedures for Basic Dental services and check-ups (Dental 1 ), perio, endo and major surgical (Dental 2), 50% orthodontics for non-cosmetic procedures ($2,500.00 lifetime maximum).

18.06 A Vision Care plan to provide prescribed eye glasses to a maximum of Two Hundred and Fifty Dollars ($250.00) every two years.

18.07 All benefit coverage to be in effect from the first day of the month following completion of forty-five (45) worked days of employment. Should work not be available, benefit coverage will continue, at the Company's expense, for a maximum of six months.

18.08 Effective March 1, 2010, the amount of monies to be paid by the Employer in respect of the Pension Plan, shall be Three Dollars ($3.00), for each hour worked for each employee covered by this Agreement. Effective March 1, 2014, the amount of monies to be paid by the Employer in respect of the Pension Plan, shall be Three Dollars and Five Cents ($3.05), for each hour worked for each employee covered by this Agreement. Effective March 1, 2015 the amount of monies to be paid by the Employer in respect of the Pension Plan, shall be Three Dollars and Ten Cents ($3.1 0), for each hour worked for each employee covered by this Agreement. Effective March 1, 2016 the amount of mo,nies to be paid by the Employer in respect of the Pension Plan, shall be Three Dollars and Fifteen Cents ($3.15), for each hour worked for each employee covered by this Agreement.

The allocation of the contributions specified under the terms, between the I.U.O.E. Local 793 Members Pension Benefit Trust of Ontario shall be as mutually agreed by the Pension Trustees, and shall be distributed by an independent administrator by Mutual agreement of the Pension Trustees.

18.09 These monies shall be remitted in accordance with this Agreement and shall be remitted by the 15th day of the month following the month in which the hours have been worked, together with supporting information entered on a Reporting Form as designated by the Trustees of the Plan and at no time shall the monies be paid directly to the employee.

18.10 In the event the Employer fails to remit the contributions for the Pension Plan by the 15th day of the month due, the Trustees may charge interest at the rate of one percent (1 %) per month for any delinquent contributions 30 days in arrears, provided the Employer has received 5 days written notice to correct such delinquency.

With reasonable cause, the Trustees may request the Employer to submit to them within a stipulated period, a certified audited statement of payroll contributions to the Fund for a period from the effective date of this Agreement until the date the audit takes place. Such statements shall reply to the questions submitted to the Employer by the Trustees.

18.11 If the Employer does not submit the certified audited statements as per Article 18.10, the Trustees may appoint an independent chartered accountant to enter upon the Employer's premises during the regular business hours to perform an audit of the Employer's records only with respect to the Employer's contributions or deductions to the required employee Pension Plan.

18.12 Where the Trustees appoint an auditor the cost shall be borne by the Plan.

18.13 In the event such audit reveals that the Employer has failed to remit contributions in accordance with the provisions of this Agreement, the Employer shall, within 5 days of receipt of written notice from the Trustees, remit all outstanding contributions along with completed supporting contribution report forms as required by the Plan.

18.14 When the Employer fails to remit all delinquent contributions, the provisions of Article 18.10 shall apply and the Union, on instruction from the Trustees, shall immediately institute proceedings against the delinquent Employer under the Labour Relations Act of Ontario. All costs of such actions shall be borne by the appropriate plan or fund unless otherwise recoverable.

18.15 Where the Trustees deem an Employer to be a persistent delinquent in the submission of contributions, they may require the Employer to post a bond or certified cheque not to exceed $5,000.00 to be held in trust by the Trustees for a period to be determined by the Trustees.

18.16 If an Employer does not have any employees in their employ they shall submit a nil report in accordance with the provisions of Articles 18.09 through 18.12.

ARTICLE 19 ·GENERAL WORKING CONDITIONS

19.01 A hot meal will be supplied by the Employer after an employee has worked twelve (12) hours, and again every six (6) hours until the shift is completed. When it is not possible for the employee to take advantage of receiving a meal, then he/she will receive a Fifteen Dollar ($15.00) voucher.

19.02 When employees are required to remain away from home, suitable free room and board will be provided to all employees whose regular residence is beyond eighty (80) kilometres from the jobsite.

19.03 Special protection clothing and apparel will be provided when required.

19.04 Safety boots are a required PPE. The Employer will pay up to one hundred and sixty ($160.00) dollars per employee per year towards the purchase of Safety Boots upon submission of receipts. The Safety Boots must be CSA approved, 8 inch boots with laces. The employee must ensure the boots are fully laced up. Upon completion of their probationary period, probationary employees may submit their receipt and be reimbursed the above amount.

19.05 Any medical examination requested by the employer shall be promptly complied with by all employees, provided however that the employer shall pay for all such examinations.

The employer reserves the right to select its own medical examiner or physician and the Union may, if in their opinion they think an injustice has been done to an employee, have said employee re­examined at the Unions expense.

When a medical examination is required by the employer, the following conditions shall apply: - If an employee with seniority takes a medical examination during the normal working hours, he/she shall be paid for the time involved and thus not lose any pay as a result of his taking the medical examination. One working days notice of the medical examination shall be given. - If the medical examination is taken after working hours, the employee shall not be paid for the time involved but shall in such cases receive at least one week's notice prior to the appointment with the doctor. -The company agrees to pay for the medical examination for the AZ Divers License.

19.06 The employer will grant upon request, up to three (3) working days leave of absence with pay in the event of the death of an employee's father, mother, wife, child, brother, or sister, father-in-law, or mother-in-law, brother-in-law or sister-in-law. A "brother-in-law or sister-in-law shall mean a brother or sister of the spouse of the employee, or the spouse of a brother or sister of the employee. Such leaves of absence are not automatic and shall be granted when the circumstances require for the purpose of attending the funeral and/or making funeral arrangements. Bereavement pay is to be based on actual daily regular hours worked (normally 8 hours). The company may request a death certificate or similar announcement or form from a medical practitioner or funeral director.

ARTICLE 20- EMPLOYEES RESPONSIBILITY

20.01 It shall be the employees responsibility to advise the employer of their address or telephone number and any change which may occur.

An employee who is off work because of sickness, accident, or leave of absence shall report by 4:00 pm of the day before returning to work their intention to be at work the next day.

21.01 This Agreement shall be effective from 1'1 of October 2013, and shall remain in effect until the 301h

day of September, 2016.

21.02 Should either party hereto desire to change, add to, amend or terminate this Agreement that party agrees to give the other party written notice to that effect within ninety (90) days of the termination of this Agreement. Provided that no such written notice is given by either party, this Agreement shall remain in force from year to year.

The Employer will pay one hour's pay per day as vehicle allowance to the two (2) regularly scheduled employees on night shift for their travel to Hemlo. Any subsequent employee(s) required to travel to Hemlo on the same shift will be eligible for the vehicle allowance only if they drive their own vehicle on that shift.

All authorized use of employees' vehicles will be reimbursed at forty cents (40¢) per kilometre.

In the scheduling of shifts, the Employer will endeavour to provide at least an eight (8) hour rest period to employees upon completion of a full shift [ten (10) hours] prior to scheduling another shift.

In cases where less than an eight (8) hour rest period is provided between shifts, all hours up to eight (8) will be paid at time and one half (1-Y2) hour rates.

Further to the signing of the Collective Agreement between the Employer and the Union, the following will confirm certain understandings that have been reached between the parties:

The Union, as bargaining agent of the Employees covered under the Collective agreement, agrees that the Employees may, if required by the Company, work in excess of the daily and/or weekly limits set out in ss.17(1) of the Employment Standards Act, 2000, up to thirteen (13) hours per day and/or sixty (60) hours per week.

This Letter of Understanding, forming part of and is consistent with the Collective Agreement, and

The Company acknowledges that upon execution of this Letter of Understanding it shall be compliant with Sections 17 and 17.1 of the Employment Standards Act, 2000, as those sections read effective March 1, 2005.

All regular fulltime employees covered by this Collective Bargaining Agreement and who are Currently working may be entitled to (2) two paid days at (8 Hours x hourly rate) per calendar year.

Such days shall be paid to assist the employee in attendance at medical specialist appointments to be conducted outside of Hemlo. (I.E. Thunder Bay, Sault St. Marie).

Employees must provide the employee with a minimum of 48 hours notice and written proof of such appointment must be provided to the manager and approved by the manger.
