INFORMATIONABOUTTHIS LICENCE
Definitions of Terms
. A section on the definition of terms used in this Licence can be found at the end of this Licence
. Terms used in the waste discharge licence which are defined in the Water Act(the Act) have themeaning given in that Act unless specifically indicated otherwise
Responsibilities of Licensee
. It is an offence under the Water Act, ifthe holder of a waste discharge licence contravenes orfailsto comply with the conditions of a waste discharge licence
. In addition to the conditions set out in this Licence, general responsibilities of Licensees are setout in the Waste Management and Pollution ControlAct( WMPC Act) and associated Regulationsand the Water Act
. Licensees must comply at alltimes with the requirements of these Acts and all other applicablelaws
. Except as expressly provided for in this Licence, the Licensee must
o not cause environmental harm either directly or indirectly
o waste to come into contact with water; or
o water to be polluted
. Without limiting the conditions of this Licence, in conducting the Activity, the Licensee must do allthings reasonable and practicable to
o prevent or minimise the likelihood of pollution occurring as a result of, or in connection with,the Activity;
o prevent or minimise the likelihood of environmental harm occurring as a result of, or inconnection with, the Activity;
o effective Iy respond to pollution and the risk of pollution occurring as a result of, or inconnection with, the Activity;
o effective Iy respond to environmental harm and the risk of environmental harm occurring asa result of or in connection with the Activity; and
o as faras practicable
o avoid and reduce waste produced as a result of, orin connection with theActivity;
o increase the re-use and recycling of waste;
o effectiveIy manage waste disposal; and
o apply the principles of ecologicalIy sustainable development
Duration of Licence
. This Licence will remain in force untilits expiry date, unless it is surrendered by the Licensee oruntilit is suspended or revoked by the Controller
Amendment, Modification or Revocation of Licence (section 93 of the Water Act. )
. The Controller of Water Resources may, by notice
. amend or modify the terms and conditions of a licence;
. revoke a licence; or

Supporting Guidelines and Documents
. This Licence has been developed based on the information provided by the Licensee in thefollowing documentation
. Application for Waste Discharge Licence dated 4 December 2013
Environment Protection Objectives (Part 4 of the WMPCA) and Beneficial Use Declaration (section73 of the Water Act)
. An Environment Protection Objective (EPO)is a statutory instrument to establish principles onwhich
o environmental quality is to be maintained, enhanced, managed or protected;
o pollution, or environmental harm resulting from pollution, is to be assessed, prevented,reduced, controlled, rectified or cleaned up; and
o effective water management is to be implemented or evaluated
. In accordance with section 18 of the Act a beneficial use, quality standard, criteria or objectivedeclared under section 73 of the Water Act and in force is an environment protection objective forthe purposes of the WMPCA
. Beneficial Use Declaration (BUD) is a legislated process that reduces the effects of water pollutionand assists in the protection and management of water. The community decides how a particularwater body should be used by choosing on one or more Beneficial Use categories

Environmental Interests
This section highlights sensitivity of the surrounding land use and environment associated with thelocation of the approved activity that represents an interest to the Northern Territory Government andthe community
. Site of Conservation Significance (SOCS 36) WOLLOGORANG & CHINAWALL SANDSTONERANGES
Cultural Interests
. Sites of Aboriginal significance including registered and recorded Aboriginal sacred sites areknown to exist in the immediate vicinity of and downstream from the Redbank mine site;
. It is the Licensee's responsibility to contactthe Aboriginal Areas Protection Authority and ensurethat any Authority Certificates required as a result of conducting the licenced activity are obtainedand complied with; and
. Further specific advice on any cultural requirement or implication of the licenced activity should besought from the Northern Land Council and the Aboriginal Areas Protection Authority

LICENCE CONDITIONS

The Licensee must notify the NT EPA within 24 hours ifthere are changes to the details of the24-hour emergency contact as provided on page one of this Licence
The Licensee must notify the NT EPA within 14 days ifthere are changes to the Licensee detailsshown on page one of this Licence
The Licensee must notify the NT EPA within 14 days after ceasing to conductthe activity towhich this Licence relates
The Licensee must notify the NT EPA prior to making any operational change that will cause, oris likely to cause, an increase in the potential for environmental harm, environmental nuisance,material environmental harm or serious environmental harm
The Licensee must cause a copy of this Licence to be available at alltimes
5.1. on the Licensee's Australian website;
5.2. at the Location; and
5.3. at the Registered business address

OPERATIONAL
The Licensee must, without limiting any other condition of this Licence in conducting the Activitydo allthings reasonable and practicable to ensure the Activity does not adversely affecttheDeclared Beneficial Uses and Objectives as declared from time to time, including those applyingto

The Licensee must develop a Communication and Consultation Plan (the Plan)forthe licensedactivity which includes a strategy for communicating and consulting with members of the publicwho are likely to have a realinterest in or be affected by the licensed activity. The Plan must be
9.1 developed by a suitably qualified person with demonstrated experience in
communications, consultation and cross cultural communications;
9.2 accessible, relevant and meaningful to members of the local Garawa Aboriginal
community and others;
9.3 submitted to the NT EPA by 31 October 2014, for approval, noting that the NT EPA may
require the Licensee to revise, amend and/or resubmitthe Plan;
9.4 made available on the Licensee's Australian website within 10 Business days of the Plan
being approved by the NT EPA; and

9.5 implemented within 10 business days of the Plan being approved by the NT EPA.
The Licensee must maintain a log of each complaint, made in relation to the Activity, to anypersons involved in the Activity. The log must include details of the following:
the date and time of the complaint;10.1.
10.2. the contact details of the complainantif known, or where no details are provided anote to that effect;
the nature of the complaint;
the nature of events giving rise to the complaint;
prevailing weather conditions at the time the complaint refers to;
the action taken in relation to the complaint, including any follow-up contact withthe complainant; and
if no action was taken, why no action was taken.

This Licence authorises the discharge of waste waters from the Redbank mine site to Hanrahan'sCreek.
The Licensee must notify the NT EPA by emailing o11ution nt. ov. au whenever waste waterfrom the Sandy Flat Pit overtlows. A notification is required for each overtlow event and shouldinclude full details of the overtlow including:
12.1. an estimate of the start and stop times forthe overflow event; and
I 3.
MONITORING
The licensee must for allterrestrial sampling points required by this Licence:13.1. install, maintain and provide appropriate identification signage so that they are
easily identifiable at alltimes; and
I 3.2. maintain safe access and egress, as is reasonably practicable.
For each sample required to be collected by this Licence the following information must berecorded and retained:
14.1. the date(s) on which the sample was taken;
14.2. the time(s) at which the sample was collected;
14.3. the point(s) at which the sample was taken;
14.4. the name of the person who collected the sample;
14.5. the chain of custody forms relating to the sample(s);I 4.6. the field measurements and/or analytical results forthe sample; and
14.7. laboratory QA/QC documentation.

RECORDINGANDREPORTING
All records required to be kept by this Licence must be in a legible format.
The Licensee must keep records of all non-compliances with this Licence.
The Licensee must as soon as practicable and in any case within 24 hours notify the NT EPA ofnon-compliances with this Licence.The Licensee must immediately and in any case within 24 hours notify the NT EPA of anypotential or actual environmental harm by contacting the Pollution Hotline on telephone number1800 064567 and emailing o11ution nt. ov. au.The Licensee must comply with the requirements of section 14 of the Waste Management andPo"ution ControlAct.

21 . The Licensee must provide to the NT EPA a Periodic Report in accordance with the followingschedule:

The Periodic Report must:22. I. be prepared with regard to the requirements for a Monitoring Report identified on
pages 5.6 of the document: Guidelines for Consultants Reporting onEnvironmental Issues available from: htt 71 rite ant. ov. au/waste-
o11ution/ uidelines/ uidelines;include a tabulation offield results and analytical parameters required by condition15 of this Licence;provide a comparison between results of water monitoring data required bycondition 15 of this Licence with applicable 80% species level protection values inANZECC (2000);andbe made available on the Licensee's Australian website within 10 Business daysof providing the report to the NT EPA.
The Licensee must complete the attached Annual Audit and Compliance Report (AACR),(Appendix 3) and provide it to the NT EPA a minimum of 20 Business Days prior to theanniversary of the commencement date of this Licence, for each year of this Licence.
The Licensee must provide to the NT EPA a minimum of 20 Business Days prior to the expirydate of this Licence a Licence Report. The Licence Report must:
24.1. include an update of the conceptual site model of surface and groundwaterflows(provided with the licence application) to include the data collected during thisLicence period;include results of the surface water monitoring program together with a detailedinterpretation of the results;include a trend analysis and interpretation of all water monitoring data required bycondition 15 of this Licence; andbe made available on the Licensee's Australian website within 10 Business daysof providing the report to the NT EPA.
PERFORMANCEIMPROVEMENT
The Licensee must provide a plan that lists and details allthe reinediation measures that theLicensee will undertake to achieve, by 31 November 2014, a species level protection value of80% (as determined by ecotoxicologicaltesting in accordance with section 8.3.6 in ANZECC andARMCANZ, 2000) at the downstream monitoring points shown in Appendix I.

The Licensee must produce a sediment monitoring plan for surface waters impacted by the minesite. The Licensee must
26.1 submitthe plan to the NT EPA by 31 July 2014, for approval, noting that the NTEPA may require the Licensee to revise, amend and/orresubmitthe plan;
26.2 implement the plan approved under Condition 26.1; and
26.3 make the plan available on the Licensee's Australian website within 10 Businessdays of the report being approved by the NT EPA

27 The Licensee must, on request, provide to the NT EPA the most recent version of any surfacewater, ground water or other monitoring plan forthe premises that may be produced for orrequired by any Agency or Department of the Northern Territory Government
The Licensee must, on request, provide to the NT EPA any results of surface water, groundwateror other monitoring plans required by Condition 27, in such form, and after such analysis, if any,as required by the NT EPA
