Act 6 is a major overhaul of the Unemployment Compensation regimes not only savingtaxpayers and businesses 10s of millions of dollars but giving incentives to unemployed toreturn to work while recognizing the need for a safety net.

The Fair Share Act eliminates joint and several liability for any defendant found to be lessthan 60 percent liable for causing an injury. Some 40 other states have made this common-sense change that will keep lawyers from forcing a defendant to pay 100 percent of monetarydamages, even if they only were found to be 1 percent at fault.

David Taylor of Pennsylvania Manufacturers Association comments:

Under the Fair Share Act, defendants less than 60 percent responsible for a harm would berequired to pay damages equal to their percentage of responsibility but not more. Any

defendant with a 60 percent or greater share of responsibility could be forced to pay up to 100percent of damages, as could any defendant who (1) committed an intentional act, (2)dumped hazardous waste, or (3) violated the Liquor Code. Today, a defendant found evenminimally responsible in any kind of civil case can be on the hook for 100 percent of damages.

That deep-pocket rule gives the lawsuit industry a powerful weapon to shake down employers,hospitals, local governments, and other large institutions, knowing that they will pay theransom of a settlement rather than risk a ruinous damage award at trial. The First Industries Loan Guarantee Program provides loan guarantees to commerciallending institutions or community development financial institutions to assist with financing of projects related to tourism or agriculture. In order to qualify for a loan guarantee from the CFAthe project has to have been awarded a First Industries Program planning grant or have atleast $1,000,000 in private funds invested in the project, or through June 30, 2011, an

investment of at least $500,000 of private funds in the project. The bill extends the sunsetdate for the $500,000 private funds investment requirement from June 30, 2011 to July 15,2015.

FISCAL IMPACT: The enactment of this legislation will only impact Commonwealth funds if large claims are made on the First Industries loan guarantees . To date, loan guarantee claimsmade by lending institutions have been/will be paid from interest earnings on CFA bondproceeds. It is assumed that any additional loan guarantee claims will be very limited and will

be able to be paid from interest earnings on CFA bond proceeds.

ANALYSIS: This legislation amends Article XVI of the Insurance Company Law concerningsurplus lines. It implements the Non-admitted and Reinsurance Reform Act of 2010 (NRRA),which is part of the federal Dodd-Frank Wall Street Reform and Consumer Protection Act with

respect to surplus lines insurance, independently procured insurance and reinsurance. In sodoing it requires that certain provisions of the Surplus Lines Law will apply when Pennsylvaniais the home state of the insured. It also replaces certain eligibility criteria and changes certainrequirements concerning surplus lines producers and exempt commercial purchasers. It alsoallows the Insurance Department to work with the National Association of InsuranceCommissioners to license non-admitted insurers.

Senate Bill 1096 provides that no state other than the home state of the insured may requirepremium taxes on non-admitted insurance. The bill also changes the taxation for multi-statesurplus lines policies and independently procured insurance placed after June 30, 2011, froman allocation method, taxing only that risk which is in the Commonwealth, to a grosspremiums method, taxing the entire premium, regardless of where the risk is located. Thislegislation also clarifies the Insurance Departments aut hority to suspend, revoke or non-renew a surplus lines licensee for failure to collect the premium tax due.

FISCAL IMPACT: Enactment of this legislation will save the Commonwealth approximately$1.4 million according to the Insurance Department . The federal NRRA would cost theCommonwealth approximately $1.9 million in lost premium taxes if no action is taken at thestate level. Enactment of this legislation along with a companion bill, Senate Bill 1097, willnarrow those estimated losses to approximately $500,000.

House Fiscal Note : The definition of drug delivery resulting in death is changed to reclassifythe crime from third degree murder to a first degree felony. However, this will not change thesentencing range for the crime, which will remain at 5 to 40 years. Under current law, a fiveyear minimum is specified for this crime and the maximum is 40 years. By changing theclassification to a first degree felony, current sentencing guidelines set the minimum at fiveyears for drug delivery resulting in death, and this legislation specifies that this may beextended to 40 years in these cases. The change is an attempt to make it easier to obtainconvictions by requiring the prosecution to prove only that the defendant acted intentionally,knowingly or recklessly, and not with malice.

FISCAL IMPACT:There is a potential fiscal impact to the Commonwealth from enactment of this legislation if convictions for drug delivery resulting in death increase when the prosecution need only provethat a defendant acted intentionally, knowingly or recklessly, and not with malice. Reliabledata do not exist to predict how many defendants this may be. At the state level, keeping anindividual incarcerated for one year costs approximately $33,000, and supervision by theBoard of Probation and Parole cost approximately $3,000.

This bill (then HB 1231) was vetoed by former Governor Ed Rendell because it was too

expensive. This is an unfunded mandate fallin g on the local taxpayers and fire companies.However, this legislation threatens public safety by raising the specter of cuts to essentialservices, or of forcing local governments to raise property taxes at the same time thatPennsylvania families are struggling economically.

Unlike most occupational injuries or diseases, HB 1231 would establish a presumption thatany cancer diagnosis would be a result of firefighting activities and the benefit provider, inthis case local government, would bear the almost impossible burden to prove otherwise. Thecurrent printer number of HB 1231 would only permit employers to rebut the presumption of

occupationally caused cancer by attempting to essentially prove a negative by requiring "proof of conduct or activities outside of firefighting duties that posed a substantial risk of causing thecancer." This legislation also drastically differs from every other state cancer-presumption law,both because of this flawed rebuttable standard and because it would create the presumptionfor virtually every form of cancer when medical science simply does not know what causesmost cancers.

While the total cost of this legislation is unknown which is a problem in itself expertspredict that it would be significant, and the burden would be felt through tax hikes, cuts to

local services, or both and, even worse, those cuts could be to firefighting activities. Municipalworkers' compensation insurance trusts predict drastic rate increases and question theirability to even underwrite coverage of occupational cancer claims under this flawed bill. If municipalities lose this coverage, it could create a catastrophic financial situation.

House Fiscal Note : This legislation: Designates cancer as an occupational disease;

Provides that the cancer must be caused by exposure to a known carcinogen recognized as a

Group 1 carcinogen by the International Agency for Research on Cancer;

Stipulates that occupational disease claims under this act can only be filed by firefighters:

1. Who have four or more years of continuous firefighting service.2. Can establish direct exposure to a Group 1 carcinogen.3. Successfully passed a physical examination prior to asserting a claim, or prior to engaging infirefighting duties, which revealed no evidence of cancer.

Provides that the presumption u nder the act may be rebutted by substantial competentevidence that shows that the firefighters cancer was not caused by the occupation of firefighting.

States that a claim made by a member of a volunteer fire company must be based on evidenceof direct exposure to a Group 1 carcinogen as documented by a report filed to thePennsylvania Fire Information Reporting System.

No fiscal impact to the Commonwealth will result from the provisions in the bill . However,local government entities, trusts, municipalities, and those volunteer fire companies which areself-insured, may experience additional costs due to increased payments for benefits and theresultant potential increases in the entities workers compensation premiums.

Grove, formerly of Fairfield, Adams County, had served as a wildlife conservation officer forabout 10 years in Franklin and Adams counties before he was killed in the line of duty inNovember.

This legislation would amend Title 65, Chapter 7 (commonly known as the Sunshine Act) toincrease the maximum penalty that may be imposed on a public official who participates in ameeting with the intent and purpose of violating the open meeting requirements and otherprovisions of the Sunshine Act.

This legislation would increase the fine of at least $100 but less than $1,000 plus the cost of prosecution for a first offense and would add a fine of at least $500 but less than $2,000 plusthe cost of prosecution for a violation of the Sunshine Act.

This legislation would also prohibit an agency from making a payment to reimburse an officialof the agency for any fine or cost resulting from a violation of the Sunshine Act .

The Game Commission believes that enactment of this legislation would reduce Game Fundrevenues by approximately $1,000 a year. The $1 agent fee per license is paid to the vendorwhere the license is purchased. Given the fact that additional vendors will be selling thelicenses, the small reduction in Game Fund revenue would be a direct result of militarypersonnel buying their hunting license from vendors other than the Game Commission.
