Unfortunately, a direct result of infrastructure improvements is work zone accidents, which take the lives of construction workers and motorists.

Page 3: Litigious Work Zones

According to the Bureau of Labor Statistics, there were 101 fatal occupational injuries at road construction sites in 2008 alone. In 2007, 831 workers and motorists were killed in highway work zones and more than 40,000 were injured.

The following is a brief presentation of dangerous work zones, citing common errors in utilizing traffic control devices for work zone safety

Page 5: Litigious Work Zones

Concrete Barrier placed perpendicular to traffic and hidden behind road closed sign. Extremely hazardous to the motoring public and a huge liability to the owner and contractor.

Workers are extremely exposed. Not MUTCD compliant. Workers in traveled way. Extremely hazardous to the workers and a liability to the owner and contractor.

Page 9: Litigious Work Zones

Workers, pedestrians, and vehicles can travel between the gaps when traditional delineation devices are utilized. An LCD will keep workers and equipment within the boundary of the work zone and pedestrians and vehicles out.

Page 10: Litigious Work Zones

Not MUTCD compliant, particularly with regard to new ADA rules regarding pedestrians with visual disability. Extremely hazardous to pedestrians and a huge liability to the owner and contractor.

Page 11: Litigious Work Zones

Vehicles can travel between the gaps when traditional delineation devices are utilized. These vehicles are traveling in the work zone. An LCD can keep vehicles out of the work zone.

Page 14: Litigious Work Zones

Not MUTCD compliant, particularly with regard to new ADA rules regarding pedestrians with visual disability. Extremely hazardous to pedestrians and a huge liability to the owner and contractor.

Page 15: Litigious Work Zones

Traditional delineation devices can be quite confusing. LCDs can provide a clear path of delineation.

Page 16: Litigious Work Zones

Traditional delineators are easily displaced by weather. During seasonal weather LCD's are a better choice as they are not so easily displaced. This work zone is a potential liability to the owner and contractor.

Page 17: Litigious Work Zones

This application has not allowed for the lateral deflection of the barrier and, if impacted, the barrier and the vehicle will fall into the excavation. Extremely hazardous to the motoring public and a huge liability to the owner and contractor.

concealed. Extremely hazardous to the motoring public and a huge liability to the

owner and contractor.

No end treatment applied to this concrete barrier end. Extremely hazardous to the motoring public and a huge liability to the owner and contractor.

Page 21: Litigious Work Zones

Does not meet minimum length of need to be used as a barrier. Is not an approved LCD. Not MUTCD compliant.

Snow fence is not an MUTCD compliant delineator. It is concealing the delineator, the reflective material, and partially concealing the equipment in the roadway. Very hazardous at night.
