D. Council Resolution No. 5592 - Amending Division 4 - Salary Schedule ­Employee Classifications Relating to Changes to Section B - FinanceDepartment.

Recommendation: Adopt the resolution as submitted.

9. CONSIDERATION OF APPROVAL OF CITY COUNCIL RESOLUTION NO. 5593- APPROVING A MEMORANDUM OF UNDERSTANDING (MOU) FOR ANECONOMIC DEVELOPMENT AGREEMENT BETWEEN THE CITY OF LOSBANOS AND COUNTY OF MERCED TO IMPLEMENT, CARRY-OUT, ANDMANAGE ECONOMIC DEVELOPMENT ACTIONS AND INITIATIVES.

Recommendation: Receive staff report and adopt the resolution as submitted.

10. DISCUSSION REGARDING MERCED COUNTY ASSOCIATION OFGOVERNMENTS (MCAG) RESOLUTION NO. 2011/05-05-01 AND THE CITY'SPARTICIPATION IN THE REGIONAL TRANSPORTATION IMPACT FEE (RTIF)AND REMOVING RESIDENTIAL FROM RTIF AND KEEPING THE FUNDS INLOS BANOS. (CONTINUED FROM JUNE 18. 2014)

Recommendation:To accept the quarterly investment report as submitted.

Background:The City of Los Banos follows its investment policy to assure that it invests all surplusinactive monies in a manner which ensures a maximum return consistent with safety onsuch investments while maintaining the integrity of such surplus and inactive funds. Aquarterly investment report provides proof that City funds are invested in such amanner. It includes all investments except funds held by City's trustee. Funds held bytrustee include bond reserve funds, deferred compensation plans and other postretirement benefit funds.

Fiscal Impact:Informational only, no fiscal impact.

CONSIDERATION OF APPROVAL OF CITY COUNCIL RESOLUTION NO. 5574 ­ENCOURAGING SUPPORT OF CONTINUED FUNDING OF THE AGRICULTURALEDUCATION INCENTIVE GRANT PROGRAM. City Manager Carrigan presented thestaff report and asked Council Member Silveira to speak in more detail to program, whichhe did, noting how he supports the continued funding of the grant program.

Mayor Pro Tem Lewis stated that Council Member Silveira sits on the Fair Board here inLos Banos and she sits on the one in Merced and how these programs give kids anopportunity to learn what agriculture is all about, agriculture is the back bone of not justLos Banos but of the State of California and supports the continued funding of the grantfunding. Council Member Faria stated that he also supports the continued grant funding.

Motion by Silveira, seconded by Lewis to adopt City Council Resolution No. 5574 ­Encouraging Support of Continued Funding of Agricultural Education Incentive GrantProgram. The motion carried by the affirmative action of all City Council Members present.

PRESENTATION REGARDING THE LOS BANOS HOMELESS PLAN. City ManagerCarrigan presented the staff report, which included a PowerPoint presentation.

Council Member Stonegrove thanked City Manager Carrigan for shining a light on thehomeless issue, it has been a big problem in our community for a while and something weneed to be investing our time and energy into, how the construction of the courthouse hasbrought this issue to the forefront, supports permanent housing solutions, and theContinuum of Care 10 Year Plan being the most valuable resource we have to work with tosecure Federal funds to help these members of our community help themselves. CouncilMember Silveira thanked City Manager Carrigan for the very informative presentation, afterreading the article in the Merced County Times he is more educated on the homelessissue and realizes it is a problem, feels we should try to end the homelessness in LosBanos and offer them services if they want it, feels better that we are trying to do better,and how the faith-based groups are a vital part of the solution and thanked them for whatthey do. Council Member Faria expressed whole-hearted support of the Homeless Plan.Mayor Pro Tem Lewis thanked City Manager Carrigan for his efforts for bringing thehomeless issue forward, getting them to accept the help and services is the key, wecertainly can make an effort to work towards it, and services to people who need help isvery important.

City Manager Carrigan spoke to the three articles in the Merced County Times onhomelessness in Los Banos.

Mayor Villalta added that what he is most excited about is that this plan allows for localcontrol, governance from afar really doesn't get it, it is up to Los Banos to solve thisproblem, our plan is good but the local way is the way to do it, and there needs to besomebody in Los Banos running it.

REQUEST FROM MAYOR VILLALTA FOR UPDATE AND DISCUSSION ON REVENUESHARING AGREEMENT. (CONTINUED FROM FEBRUARY 19, 2014 MEETING) MayorVillaIta spoke to the agreements signed and how they are not that good. City ManagerCarrigan gave an update on the Revenue Sharing discussions and that they are turningpercentages into numbers, with the next meeting scheduled for May 7, 2014 and he willgive an update at the May 7,2014 City Council Meeting, he is convinced that there couldbe a solution, the struggle has been that is has taken a long time, but we are in the homestretch..

REQUEST FROM MAYOR VILLALTA TO PLACE ON A FUTURE AGENDA FORDISCUSSION - MERCED COUNTY ASSOCIATION OF GOVERNMENTS (MCAG)RESOLUTION NO. 2011/05-05-01 AND THE CITY'S PARTICIPATION IN THEREGIONAL TRANSPORTATION IMPACT FEE (RATIFY). Mayor Villalta stated that hehas brought this item forward because of recent communications he has receivedregarding changing the agreement, amending it to allow other projects to have higherpriority than the Los Banos Bypass, spoke regarding the TIGER grant proposal on March20, 2014, how the April 17, 2014 MCAG agenda proves his point, because one directorhas brought forward a request to strip the agreement and approve another agreement tofund the TIGER grant, how Merced County Supervisor O'Banion voted against striping LosBanos of prior promised funding, but he Mr. O'Banion voted for the TIGER grant and that'swhat hurts so much, he added that his NO vote alone will not change the action to betaken. He is requesting to bring back RTIF to not pay any more RTIF fees.

City Manager Carrigan stated that it came up at the last MCAG meeting that the currentRTIF model fee isn't working, other counties do it differently, and we are trying to find asolution.

Council Member Stonegrove clarified that this item is to see if there is a majorityconsensus to have staff expend time on the issue and to hear it at a future meeting, addingthat the bottom line for her is that if we have not participate in the RTIF program any morefor a few years now, MCAG are smart people, how we knew this would happen, not surewhy this is surprising to anyone, how can we say we have a stake in this if we are notcontributing to the fund we want to draw out of, Merced County Supervisor O'Banion hasbeen a big if not biggest supporter of the Los Banos Bypass and to paint him in any kindof negative light is not right. Council Member Faria stated that the present RTIF programis like 20 years old, UC Merced didn't even exist and when it did it changed the game asthey are some of the most prestigious colleges, and he doesn't think the County needsRTIF money to leverage funding. Mayor Villalta encouraged all to read the ImplementationAgreement to manage and administer the RTIF, how Livingston hasn't paid a dime,Atwater just minimal funds. Council member Silveira stated that he will not be here for theMay 7, 2014 City Council Meeting and requested to continue this item to the May 21,2014City Council Meeting instead.

ADVISEMENT OF PUBLIC NOTICES. (ONE REPORT) Assistant Planner II Elmsreported that there will be a Public Hearing held by the Los Banos Planning Commission toconsider a Conditional Use Permit to allow the use of a Type 41 Alcohol License for theon-sale of beer and wine in conjunction with an eating establishment, LB Steakhouse,located at 1639 E. Pacheco Boulevard, APN 083-130-013.

CITY MANAGER REPORT. City Manager Carrigan asked Fire Chief Guintini to speakregarding Ming's Restaurant and their recent closing, which Mr. Guintini did.

Mayor Villalta inquired as to what business do if they receive a letter like Ming'sRestaurant. Council Member Lewis inquired to if they are just addressing restaurants or allbusinesses and Mr. Guintini stated that they are addressing all business for all types ofreasons, i.e. restroom, accessibilities/barriers, handicap parking spaces is a big issue.Mayor Villalta asked Assistant Planner II Elms what should someone do if they get a letterlike this and could we research if there are funds available to look at getting grants/funds toassist them to make it as painless as possible. Ms. Elms stated that we would research it,as there are strict criteria.

CITY COUNCIL MEMBER REPORTS.

TOM FARIA: Responded to comments made at the beginning of the Council Meeting, mysupport has always been for the Airport to remain, closing it no, closing it and opening anew one yes; spoke to how he went fishing today and it reminded him how valuable theoutdoors is in Los Banos and for all to enjoy the beauty that is Los Banos, the upcomingEaster sunrise service at the forebay, how Los Banos is a very faith-based town with manychurches, spoke regarding the upcoming events being held at the Los Banos Arts Centerevent on April 19, 2014, April 25, 2014 and April 26, 2014, and wished everyone awonderful happy Easter spring break, time to rejuvenate your soul and heart.

DEBORAH LEWIS: Thanked the Los Banos Chamber of Commerce for putting on awonderful event this weekend and jokingly asked if the Rotarians could include some meatin their breakfast.

SCOTT SILVEIRA: Spoke regarding the upcoming May Day Fair in Los Banos, the Fairkick off dinner, reminded all that discount Fair admission tickets are now available to be tobe purchased and spoke to the events happening during the fair, he hopes everyone has awonderful happy Easter.

ELIZABETH STONEGROVE: Spoke regarding the recently very successful Graffiticleanup day event and thanked City staff for making it happen, she is hoping to do a thirdone this year, thanked Public Works Director/City Engineer Fachin and the employees for

MAYOR MICHAEL VILLALTA: Spoke regarding how he and City Manager Carrigan wentout to observe the Graffiti event, encouraged all to go out and see what the youth in ourcommunity are doing, choir, band - the music department is busy, Fine Arts are thriving inLos Banos, which is a credit to their teachers and their schools, had a meeting with Dr.Ash Gloaky, the new Administrator at Memorial Hospital and how the Mayor doesn't wantto see helicopters flying because that means people are leaving town for services and Dr.Gloaky is working to get more specialists in town and admit more patients, he wants thehospital to be self sufficient, how he attended the hospital luncheon where the volunteerswere recognized, spoke regarding the Street Faire and thanked Ms. Faria and theChamber of Commerce, thanked Allied and City staff for all they did for the event too, howit takes a village to have a Street faire, the Boys and Girls State representatives and howRick Toscano has been a constant supporter of these programs and thanked him for that.

Council Member Faria spoke regarding the upcoming choir concert on April 23, 2014 at St.Joseph's Church and recognized the Miss Wheelchair California, Tiffany Hendrickson.

Staff is requesting that the Accounts Payable Technician position be reclassified toAccounting Technician to sufficiently represent the range of job duties to be performedin this position. The current salary range is $3,204 - $3,894, this would remain thesame. The current position is budgeted, and will be vacant beginning July 16th

RE: Public Hearing on Draft Council District Plans of By District Methodof Election of City Council Members

Recommendation. It is recommended that the City Council receive the presentation ofDoug Johnson; open the public hearing and receive public comment on the draft plans; andrequest further modifications to any ofthe draft plans.

Background. On June 4, the Council adopted a resolution to begin the process forSubmission of By-District Election Method to the Voters on the November 4, 2014 Ballot. OnJune 18,2014 the City Council received introduction presentations by Chris Skinnell as SpecialLegal Counsel for the City and by Douglas Johnson of National Demographics Corporation(NDC) as the City's demographer concerning City Council districting. The City also receivedpublic comment and adopted "A Resolution of the City Council of the City of Los BanosSpecifying the Criteria to Guide the Preparation of Council Districts, for Submission of By­District Election Method to the Voters on the November 4,2014 Ballot." On June 25, 2014 theinitial draft council district plans were made available to the public by posting on the City'swebsite and by making copies available at City Hall. Additionally, the City published aninformational flyer for distribution to the public. On July 2,2014 the City's demographer, DougJohnson made a presentation on the initial draft plans and the City Council solicited commentfrom the public on the initial draft plans.

Discussion. In response to the public comments received at the July 2,2014 meeting andcommunications directly to Doug Johnson, he will be making a follow up presentation to updatehis presentation on the proposed district plans. Following the presentation, staff recommendsthat the City Council open the public hearing to receive public input regarding the draft plans andmay request further modifications to any of the plans. The next steps in the process are outlinedin the enclosed tentative timeline. August 8, 2014 is the last day the City may submit themeasure to the County Registrar.

That the Council adopt a resolution to enter into a Memorandum of Understanding(MOU) between the County of Merced and the Cities in Merced County to implement,carry-out, and manage economic development actions and initiatives as outlined in thegoals and objectives of the Comprehensive Economic Development Strategy (CEDS).

Background:

The County of Merced entered into the development of a CEDS for the Merced Countyregion, to create a roadmap for positioning Merced County as a premier location forbusiness. In the development of the CEDS, the Cities and County agreed that thisprocess should be a collaborative effort to promote all of the County's assets through acounty-wide Marketing Team consisting of the Cities and County.

The MOU is an economic development agreement between the Cities and the Countyof Merced that outlines the participating organizations' commitment to coordinating,collaborating, monitoring and reporting on marketing and lead generation activities forthe Cities and County of Merced.

Discussion:

A CEDS is a regional strategy that reflects local economic development needs andpriorities and recommends a regional approach to achieving sustainable economicdevelopment. A CEDS is required to qualify for Economic Development Administration(EDA) assistance. EDA funds can be used for planning, technical planning, and bricksand mortar construction. They help fund infrastructure needed to create business parksor move a business within the community. The goal of EDA funds is to assist with localeconomic development. A CEDS is used as a regional strategy to coordinate economicdevelopment efforts.

The intent of the MOU is to formalize a Merced County Marketing Team consisting ofeconomic development leaders from each City and the County for the purposes ofimplementing key pieces of the Economic Development Roadmap and more specificallythe marketing initiatives to attract traded sector businesses including marketing, publicrelations, business recruitment, business retention, and lead generation. The MOUdoes not commit the County or Cities to any financial commitment for the collaboration;however, the Marketing Team may at some point in time agree to collaboratively fundand leverage resources for marketing purposes to implement business attractionmarketing, at which time Los Banos City staff would bring a proposal back to theCouncil for approval.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of LosBanos does hereby approve the Memorandum of Understanding for an EconomicDevelopment Agreement between the Cities of Merced County and the County ofMerced and authorizes the City Manager to execute on behalf of the City as set forth inExhibit A, attached hereto and incorporated herein by this reference.

I. PURPOSE

IV. SCOPE OF COLLABORATION

THE INTENT OF THIS MOU is to formalize a MERCED COUNTY MARKETING TEAM

consisting of economic development leads from each City and the County for the purposes of

implementing key pieces of the Economic Development Roadmap and more specifically the

marketing initiatives to attract traded sector businesses including marketing, public relations,

business recruitment, business retention, and lead generation. This Memorandum of

Understanding does not commit the county or cities to any financial commitment for the

collaboration, however, the Marketing Team may at some point in time to implement

business attraction marketing agree to collaboratively fund and leverage resources for

marketing purposes at which time the Marketing Team would bring proposal back to all

entities for approval.

MERCED COUNTY MARKETING TEAM is committed to:

• meeting the goals and objectives of the Merced County CEDs; and

• supporting economic growth, and will encourage businesses to expand and/or

move to Merced County by providing business, workforce, financing and

location assistance to existing and new business that will generate new jobs,

goods and services to residents; and

• coordinate any project locations and expansions and will not poach projects

from one City to another within the County; and

• coordinate on addressing Merced County (Cities) competitive weaknesses;

and

• collaborate on securing state/federal funding sources for key infrastructure

and initiatives that lead to job creation; and

• each City will implement and manage their own business retention programs

and the County will coordinate with the Workforce Investment Board of

Merced County to implement and manage a county-wide business retention

program; and

• implement Merced County Marketing campaigns to address traded sector

businesses (not retail) including marketing, public relations, business

recruitment, business retention, lead generation and review/discussion of

funding such initiative; and

• collaboratively respond to prospect leads received by the County, by jointly

preparing proposals with Cities providing the County with specific site/building

information, utilities and incentives and County providing all other data as

requested by client; and

• ensure all marketing and promotional activities are efficiently and effectively

coordinated, documented, and reported.

Included as an integral part of this MEMORANDUM OF UNDERSTANDING is Exhibit A,

Leading Sharing Protocol, which outlines roles and responsibilities of each party in responding

to leads and inquiries from businesses or site selectors.

v. MEETINGS & REPORTING

The MERCED COUNTY MARKETING TEAM agrees to meet once a month to review, plan

and manage the annual work plan. The meetings will be opportunities to introduce ideas,

share resources, develop protocol and materials, report on progress and strategize on how to

increase prospect leads and/or creating competitive advantage. The MERCED COUNTY

MARKETING TEAM should report progress to all elected officials at least twice a year.

VI. TERM

This Agreement will remain in full force and effect for one year, at which time the

MERCED COUNTY MARKETING TEAM would review and make changes as needed to address

opportunities and/or issues after the first year's pilot period. The MERCED COUNTY

MARKETING TEAM would recommend to representative COUNTY/CITY officials continuation

of the MOU providing an annual reporting of the collaboration work efforts and a proposed

annual work for following years.

THEREFORE, MERCED COUNTY MARKETING TEAM has agreed to the following:

This Agreement will commence and be executed once signed by the Cities and County of

Merced.

A lead generation protocol document will be reviewed and adopted by all members of

the MERCED COUNTY MARKETING TEAM.

The MERCED COUNTY MARKETING TEAM will annually review marketing strategies and

goal achievement with strategies, readjust marketing campaigns as needed due to

market or target industry/business changes, or to more effectively reached targeted

audience, such changes will be documented by updating the annual marketing work

plan.

This Agreement will remain in full force and effect until and/or as altered by agreement

of all parties.

11. In the event more than one site in two or more CITIES are identified for further consideration,COUNTY could maintain status as primary contact until such time the Client narrows theirconsideration to one location.

12. With CITY's consent, COUNTY will maintain contact with the Client to facilitate the locationprocess and participating in bringing other resources to the table.

Recommendation:That the City Council receives the staff report and provides staff with direction. Thatdirection could be one of the following:

1. Take no action, which will result in the RTIF fee program continuing to beadministered per Ordinance No. 1115, which expires on March 21, 2015.

2. Request that staff present to Council an Ordinance that would temporarilysuspend the collection of All Regional Transportation Impact Fees (RTIF) fora time period as outlined in the Ordinance and for all designated land usecategories. This Ordinance, if adopted, would go into effect 30 days after itsfinal passage and adoption.

Background:The main purpose of a regional transportation impact fee is to help plan for and mitigatetransportation impacts of future growth on the regional transportation system. Localtraffic impact fees are used to fund local improvements to mitigate cumulative impactsto local roadways caused by development. In theory, regional transportation impactfees build multi-jurisdictional transportation projects that benefit two or morecommunities.

Before a new transportation impact fee can be established, the California Mitigation FeeAct (AB 1600) requires cities or counties prepare "nexus" calculations, based on projectcost estimates, land use projections, traffic modeling, and appropriate trip generationrates to make sure that the impact fee will primarily benefit new development. Based onthe project and program nexus, such fees can either fund all, but sometimes only aproportionate share of the project needed to accommodate the new development. Feescannot pay for more than the project costs, should not overlap (but can complement)existing impact fees and must provide credit for developers who actually construct all ora portion of the project for which that the fee is paid. Such fees can only be used forcapital projects and not be used for operations and maintenance. Impact fees arerequired to have a 5-year capital improvement plan indicating the purpose and use ofthe fee. Therefore, impact fee programs can be used very effectively on projectdevelopment activities (i.e. preliminary engineering, environmental studies or other earlyproject phases such as acquisition of right-of-way and/or commitment as a local matchfor other funding to fund construction activities). Although some of the smaller projectscan be entirely funded with traffic impact fees (if the project is entirely needed becauseof a new development area), regional transportation impact fees are best coordinated ina funding package with a variety of other local, regional, state and/or federal funds.

One of the main advantages of establishing the program is that most state and federaltransportation programs are very competitive, and require at least 20% of the fundingmix to come from local funding sources. Therefore, the RTIF would help make MercedCounty agencies' applications more successful, particularly for securing our share oflarger statewide interregional transportation funds and federal funds.

Background of Merced County RTIF:On July 19, 2001, the MCAG Governing Board unanimously adopted the 2001 RegionalTransportation Plan (RTP). The RTP documented the region's population, housing, andeconomic growth and the need for transportation projects to ensure safety, relievecongestion, and maintenance for Merced County's regional transportation system. Inaddition to listing and prioritizing the region's transportation projects and programs, theplan's Financial Element documented that the existing financial resources to fund theseprojects were inadequate. The RTP called for pursuing two new sources of funding, alocal % cent sales tax dedicated solely to transportation projects and a regionaltransportation impact fee to mitigate future development impacts on the regional roadsystem.

During the fall/winter of 2001-02, an amendment to the MCAG Joint Powers Agreementwas submitted and approved by each city council and board of supervisors authorizingMCAG to administer a regional transportation impact fee program adopted byordinance, resolution, or other appropriate action by each member agency.This unanimous action by each member amended the MCAG JPA to allow MCAG toreceive the fees from a locally adopted transportation fee program and implementtransportation projects. Further, as a local program, it meant that a jurisdiction retainsthe individual authority to implement, change, and/or terminate the program.

Thereafter, a regional road network was defined, growth impacts modeled, and projectswere identified that would mitigate resultant traffic congestion.

In July 2004, the MCAG Governing Board adopted the 2004 Regional TransportationPlan with a Financial Element that assumed funding resources would be available fromRegional Transportation Impact Fee program. The 2004 Regional TransportationImpact Fee Study includes a project financial plan listing the multiple sources of fundsthat will be used to pay for the identified projects, a uniform mitigation fee, and the "fair­share" fee contributions from vehicle trips beginning or ending in each respectivejurisdiction. At the January 20, 2005 MCAG Governing Board meeting, the RTIF Studywas accepted and the RTIF Model Ordinance and RTIF Implementation Agreementwere transmitted to the City of Los Banos for consideration and action.

On April 29, 2005 the Los Banos City Council considered the RTIF ImplementationAgreement and the Model RTIF Ordinance and unanimously approved both.

Approval of the RTIF Implementation Agreement. The RTIF Implementation Agreementamended the MCAG Joint Powers Agreement to permit MCAG to deliver thetransportation projects identified in the program. Approval of the RTIF ImplementationAgreement does not commit the City to adopt the fee program.

Adoption of the RTIF Ordinance. This action enacted the regional transportation impactfee. To implement the regional transportation impact fee and start to collect the fee, fivemember jurisdictions needed to adopt the program by ordinance or resolution includingthe Merced County Board of Supervisors and a majority of the cities with a majority ofthe population.

Effective August 1,2005, the cities of Atwater, Dos Palos, Los Banos, Merced, and theCounty of Merced began collecting RTIF fees through their local permitting process.The City of Gustine began collecting the fee effective August 22, 2005. The City ofLivingston has not adopted an ordinance or resolution to implement the RTIF programfee collection.

In August of 2008, the City Council adopted a Resolution approving the implementationof the updated RTIF study. On April 15, 2009, the City Council adopted Ordinance No.1086 that established new non-residential RTIF fees, per the approved updated RTIFstudy.

Discussion:At this time staff is looking to the Council for direction on the RTIF program. Twodirections that could be followed are:

1. Take no further action, which will result in the RTIF fee program continuing tobe administered per Ordinance No. 1115 which has temporarily suspendedthe collection of the RTIF fees in six categories until March 21, 2015.

2. Request that staff present to Council an Ordinance that would temporarilysuspend the collection of All Regional Transportation Impact Fees (RTIF) fora time period as outlined in the Ordinance and for all designated land usecategories. This Ordinance, if adopted, would go into effect 30 days after itsfinal passage and adoption.

Fiscal Impact:Between 2009 and 2012, the City of Los Banos has issued no single family residentialpermits. In 2013-2014, the City has issued 20 single residential permits of which twohave been finaled and have paid the RTIF. The City has collected a total of $6,230during FY 2013-14 in the RTIF residential program.

Since the development impact fees pay for planned infrastructure, the result of this feesuspension would be a decrease in the amount of planned regional transportationinfrastructure that can be funded by the Regional Transportation Impact Fee (RTIF)program. The magnitude of the impact to the RTIF would largely be dependent on thepace of development during the fee suspension period.

ORDINANCE NO. 1115

AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF LOS BANOS EXTENDING THETEMPORARY SUSPENSION OF THE COLLECTIONOF REGIONAL TRANSPORTATION IMPACT FEESESTABLISHED BY ORDINANCE NO. 1031 ASAMENDED AND CODIFIED IN TITLE 3 CHAPTER 18OF THE LOS BANOS MUNICIPAL CODE

WHEREAS, Development Impact Fees are levied on new development to coverthe cost of infrastructure or facilities necessitated by that development pursuant to theMitigation Fee Act; and

WHEREAS, on May 4, 2005, the Los Banos City Council adopted Ordinance No.1031 establishing a Regional Transportation Impact Fee - RTIF; and

WHEREAS, since the adoption of Ordinance 1031 the City of los Banos and therest of Merced County have experienced an economic recession that has impacted newdevelopment in the City of los Banos; and

WHEREAS, on February 1,2012, the los Banos City Council adopted OrdinanceNo. 1105 temporarily suspending the collection of fees charged pursuant to Title 3Chapter 18 of the Los Banos Municipal Code (Regional Transportation Impact Fee ­RTIF) for specified land use categories for a period of twelve months from the effectivedate of the Ordinance:

WHEREAS, on February 20, 2013, the Los Banos City Council adoptedOrdinance No. 1107 temporarily suspending the collection of fees charged pursuant toTitle 3 Chapter 18 of the Los Banos Municipal Code (Regional Transportation ImpactFee - RTIF) for specified land use categories for an additional period of twelve monthsfrom the effective date of the Ordinance:

WHEREAS, Ordinance No. 1107 will expire on March 22, 2014; and

WHEREAS, the City Council believes that an extension of the temporarysuspension of the Regional Transportation Impact Fee for the specified land u.secategories will have a positive impact on the community and new development; and

WHEREAS, the Ordinance is exempt from the provisions of CEQA, in that it isnot a project under CEQA pursuant to subdivision (b) (4) of section 15378 of CEQAGuidelines, Tille 14 of the California Code of Regulations.

NOW THEREFORE, the City Council of the City of Los Banos does herebyordain as follows:

1. Recitals: The above slated recitals are true and correct.

2. Temporary Suspension of Regional Transportation Impact Fee: The collection offees charged pursuant to Title 3 Chapter 18 of the Los Banos Municipal Code (RegionalTransportation Impact Fee - RTIF) for the following land use categories is temporarilysuspended for a period of twelve months from the effective date of this Ordinance:

Relationship to Prior Ordinances: This Ordinance does not repeal Ordinance No.1031 as amended by Ordinance No. 1073 and Ordinance No. 1086, amend the ratesset forth by said prior Ordinances, a~er any finding by said prior Ordinances, orotherwise affect the operation of said prior Ordinances except as specifically set forthherein.

4. Effect: No provision of this Ordinance shall entrtle any person who has alreadypaid Regional Transportation Impact Fees to receive a refund, credit or reimbursementof such payment.

5. Expiration: As of twelve months from the effective date of this Ordinance, thisOrdinance is repealed wrthout further action by the City Council, unless the Crty Councilrepeals or amends this Ordinance prior to that date.

6. CEQA: The City Council finds that the Ordinance is exempt from the provisionsof CEQA, in that it is not a project under CEQA pursuant to subdivision (b) (4) of section15378 of CEQA Guidelines, Title 14 of the California Code of Regulations, because thisOrdinance only relates to a governmental funding mechanism, or fiscal activrties, whichdo not involve any commitment to any specific project, which may result in a potentiallysignificant physical impact on the environment.

7. Severability: If any section, subsection, subdivision, paragraph, sentence, clauseor phrase added by this Ordinance, or any part thereof, is for any reason held to beunconstitutional or invalid or ineffective by any court of competent jurisdiction, suchdecision shall not affect the validity or effectiveness of the remaining portions of thisOrdinance or any part thereof.

8. Effective Date: This Ordinance shall go into effect and be in full force andoperation thirty (30) days after rts final passage and adoption. The City Clerk shallcertify to the adoption of this Ordinance and cause the same to be posted and publishedonce wrthin fifteen days after passage and adoption as may be required by law; or, inthe alternative, the City Clerk may cause to be pUblished a summary of this Ordinanceand a certified copy of the tex1 of this Ordinance shall be posted in the Office of the CrtyClerk five days prior to the date of adoption of this Ordinance; and, within fifteen daysafter adoption, the City Clerk shall cause to be published, the aforementioned summaryand shall post a certified copy of this Ordinance, together with the vote for and againstthe same, in the Office of the City Clerk.
