REPORT .

LAND OFFICE, December 1, 1876.

To the Honorable G~vernor and Council:

In compliance with the provisions of law, the undersigned, Land Agent, has the honor to make the fo1Iowing report for the year ending November 30; 1876. During that year the office was held by Hon. P. P. Burleigh from December 1, 1875, to February 23, 1876, inclusive, the present incumbent having entered upon bis duties on the nineteenth day of April following. The present report, however, embraces the business of the office for the whole year.

SALES OF LAND.

By reference to the schedules marked A, B, C, D, E and F, it will be seen that there have been conveyed of the public lands during the past year for cash, 1,418 .49 acres, for the sum of $407.95; under resolves of the Legislature, 8,292. 78 acres; to actual settlers on the surrender of outstanding Land Certificates, 22,304.38 acres; to actual settlers by conditional deeds, for road labor notes, under resolve entitled "Resolve in relation to township fourteen, range four, in Aroostook county," approved March 15, 1861, 4,084.21 acres; to Swedish immigrants, 980. 77 acres; under the Treaty of Washington, 273.19 acres. There have also been contracted to actual settlers by Land Certificates for road labor notes, 13,054.89 acres for $4,785.14, as shown by schedule G annexed to this report.

SETTLING LANDS.

By reference to the last annual report of this department, it appears that after the sale of the lots unsuitable for settlement in the several townships set apart and appropriated for that purpose, there remained about 34, 781 acres for sale under the settling acts. Besides these, there were 142,067 acres which had been taken up by settlers, to whom certificates had been granted, and who were

then at work performing the duties required to receive their deeds, the title of which still remained in the State. Of these lands there are now remaining unsold, 26, 773.39 acres, as shown by schedule K, besides 127,665.97 acres ( see schedule L) already certificated, to be conveyed when settling duties shall have been performed.

The duty of selling these lands thus left, and of giving deeds to all such as hold certificates, still remains to be performed. By the provisions of the act of 1876, chapter 14:1, the price to be paid for settling lands is thirty-five cents per acre, to be paid in road labor in one and two years, the settler to make his home upon the lot within two years, and within four years to clear fifteen acres of land and build a comfortable dwelling house on it.

ISLANDS.

Under the provisions of the statute of 1876, chapter 79, entitled "An act to auihorize the sale of islands belonging to the State," a very thorough examination was made into the title of the very many islands which skirt the coast of Maine, in order to ascertain what had been sold, as also to determine what remained to be sold, under the act. The search necessarily carried the examina­tion back to the earliest history of the State, even to the time of the Revolution and before, and involved a great amount of labor and research among the archives of Massachusetts and Maine. The investigation thus instituted, disclosed certain conveyances and grants of very many of the islands at different times, the per­petuation of which information has been thought of sufficient interest and importance to warrant their publication in connection with this report. The schedules H and I annexed contain lists of all such, with the dates of the grants and names of grantees or purchasers.

Besides those thus granted and conveyed, a list of sixty- six in number remained, the title of which appears never to have passed from the State. As many of these were more or less in the occu­pation of individuals, the Committee of the Council on Public Lands, visited the islands, so far as they are located west of the line of Washington county, and ascertained the facts respecting them. This investigation led to the conclusion that the title of all these was still in the State, and therefore subject to be sold under the act referred to. A public sale of all these was accordingly made at Rockland, on the twenty-first day of November, 1876, previous

notice having been given according to the act. Payment has since been made and deeds execute.d of the whole list, except tf1ree, which will probably be sold at an adjourned sale to be held in December, unless previously paid for by the bidders.* The aggregate amount of money already received from the sales is $1,109.15. The annexed schedule J, contains a list of all the islands thus sold, together with the names of the purchasers and sums bid. With the exception of some small unimportant islands lying in front of the county of Washington, the above disposes of all the islands belonging to the State, so far as has been possible to ascertain.

SWEDISH COLONY.

The colony of Swedish Immigrants, the care and oversight of which is with the Land Agent, continues to be a success in the truest sense of the term. Considering the disadvantages under which the colony was planted six years ago in the midst of the forests of Aroc;stook, its present prosperous condition is worthy of especial congratulation. A very general prosperity has at­tended their efforts as colonists in their various industries, such as gives promise of the happiest results in the future. That part of the colony settled in the township of N 9W Sweden, has during the past season been organized into a plantation by that name, under the general statutes of the State. Fifty-two men have been naturalized and thus become voters, and at the late election took advantage of their elective privileges. The plantation has been divided into school districts, proper school-houses have been erected and schools established. Four schools are in operation, two of them taught by young ladies of their own nationality, who have acquired a competent knowledge of our language since their immigration. Seventeen new houses have been erected during the year, not including log houses so called, and about $2,400 have been expended by them in labor upon their roads, so that nearly every part of the township can be reached by them in carriages.

The crops during the year have been very good, enough having been raised for their own use leaving a surplus in many cases for sale. The crops of grain and potatoes in some cases are estimated to reach as much as one thousand bushels. Cases of poverty or

want among them are rare, only four families having received any assistance and then only by reason of the death of the fathers in two cases, and of sickness in the others.

Nearly all of the land in the township suitable for cultivation has been taken up by the immigrants, and considerable other land also in the adjoining townships. The plantation contains a popu­lation of between 600 and 700 all of whom are of a class very industrious, temperate and intelligent, such as the State may feel proud to reckon among her inhabitants.

In addition to the colonists already mentioned in New Sweden and the adjoining townships, a large population of Swedes have also followed them into our State, and are settled in various other places, as they have had opportunity to find employment or homes. The enterprise is worthy of the continued favor of the State, and the hope is expressed that it will continue to receive its guardian care.

ARCHIVES AND RECORDS.

Attention has frequently been called in previous reports of this Department, to the records and archives now in the Land Office, including the iarge coliection recently donated, at our solicitation, to the State, by the Commonwealth of Massachusetts. The subject was particularly mentioned in the Land Agent's Re­port for the year 1873, and the Legislature of the succeeding year passed a resolve relating to the subject, making it the duty of the Land Agent to take such measures under the direction of the Governor and Council, as may be necessary for the preservation and convenient use and reference of the documents. As yet, however, little has been done _towards accomplishing the work.

The archives alluded to embrace the original field-notes and plans of surveys, together with copies of grants and deeds of nearly all lands in the State conveyed both by this State and Massachusetts since the formation of our government, so that almost every house lot, farm and timber tract in Maine finds its original title among the archives in question. A very general practice has prevailed with the Land Offices of both States, to describe the lands granted by numbers and ranges of lots, refer­ring to the plans and surveys as found in the office for greater certainty as to bounds, monuments and other particulars. It is thus in the Land Office alone that the certainty in all such cases is to be arrived at respecting the true limits and descriptions of

lands sold. The result is that very frequent calls are made upon the Land Agent for information on these subjects, in regard to lands in all parts of the State. At present all these records, plans and documents are in a very confused condition, without any order to assist in the search, and without indices or other facilities for examination. In many cases they are very badly torn and damaged and require repairing. It is earnestly recommended that such measures be taken the ensuing year as shall fully carry out the object contemplated by the resolve, which requires the Land Agent, under the direction of the Governor and Council, "to take such measures as may be necessary for the preservation and con­venient use and reference of the records, plans and documents now in the State Land Office, including those recently received from the Commonwealth of Massachusetts."
