    1. BASICPRINCIPLEtheContributionoftheNotforProfitSector

    ThefollowingstatementexpressesthesentimentandmainrationaleunderpinningtheProductivityCommissions

    Report,ContributionoftheNotforProfitSector(February2010),andtheraftofrecommendationsitdirectstothe

    Australian,StateandTerritoryGovernments:

    "Governmentstrategiesforpromotingsocialinclusion,socialinnovationandcommunitywellbeingareheavily

    dependentonavibrant,efficientandeffectiveNotforProfitsector."

    Lessthan2%oftherespondentsthatexpressedaviewdisagreedwiththisstatement.Unsurprisinglythosethathave

    workedwithinthesectorthelongesthadthehighestproportionthatagreedstronglywiththestatement(88%).

    in

    Governments

    of

    all

    shades

    have

    always

    been,

    somewhat

    pragmatically,

    dependentuponorganisationslikeournotforprofitone.It'saves'them:a)lotsofexpenditureandb)theneedtogive

    governmentalconsiderationtomanyfringegroups;andc)givesthemmanyideasfortheoccasionalphilanthropic

    statementorhandout.

    Respondentwithlongterminvolvementinsector:Absolutely.TheNFPsectorworkstirelesslyforthewholecommunity

    dealingwiththeissuesthatthemainstreamsocietywanttoforgetaboutsuchas:mentalhealth,drugandalcoholabuse

    andrehab,agedcare,carers,familyviolence,children'sabuseandfostercaresupport,parentingprograms,sexualabuse,

    gambling,eatingdisorders,selfmutilation,conflictresolutionandnegotiationforfamilydisputeresolutionETC.

    Respondentwithlongterminvolvementinsector:Governmentalonecannotsuitablyrespondtotheneedsoflocal

    communitiesandspecialistcommunities(e.g.Youth,Disabilityetc).

    Engagement'toresourceandcoordinatetheGovernmentsworkwiththesectorasawhole.TasksfortheOffice

    identifiedbytheCommissioninclude:implementingregulatoryandotherreformsandtheimplementationofthe

    GovernmentsCompactwiththenotforprofitsectorimprovingthequalityandcomprehensivenessofinformation

    aboutthesectorimprovingtheeffectivenessofcommunityservicesstreamliningfundingagreementspromoting

    socialinnovationfacilitatingstrongercommunityandbusinesscollaboration.

    Q2:ShouldtheAustralianGovernmentestablishaspecificdepartmenttoberesponsibleforNotforProfitsectorissues?

    Almost90%oftherespondentsagreedthattheGovernmentshouldestablishaspecificplacewithingovernmenttobe

    responsibleforsectorissues.Unsurprisinglythosethathaveworkedwithinthesectorthelongesthadthehighest

    proportionthat

    agreed

    strongly

    with

    the

    question

    (56%).

    Interestingly

    it

    was

    also

    this

    group

    that

    had

    the

    highest

    proportionthatdisagreed(12%).

    ThiswouldhelptofocusGovernment'sthinkingandsupportfortheSectortoachievethekindofreformsrecommendedby

    theProductivity.

    ThedevelopmentofaspecificNFPDepartmentwouldstopthedoubleoreventriplehandlingofscheduling,funding,

    managing,budgetingmonitoringandduplicatingofprograms.Itwouldexpeditethedeliveryandnetworkingofprograms.

    An"Office"issupportedratherthanadepartmentinmyexperiencethesecanworkacrossdepartmentsmoreeffectively

    thansettingupanewsilo/department.The"Office"shouldbeauspicedunderanotherdepartmentwithrelevantlinks(i.e.

    humanservicesnottransport)andhaveaseniorCabinetMinisterwiththeearofPMascriteria.

    Again,thisshouldincorporatesocialenterpriseswheretheaimisdeliveringsocialinnovationastheNFPsectorisonlya

    part(albeitalargepart)ofthesolution.

    3. ISSUENATIONALREGULATION

    TheCommissionarguesthatsoundregulationofNFPsisimportanttobuildandmaintaintrustinthesector,aswellasto

    provideorganisationswithaclearlegalframework.ItreportedthatthecurrentregulatoryframeworkforNFPsis

    uncoordinatedattheCommonwealthandstate/territorylevels,withdisparatereportingandotherrequirementsadding

    complexityandcost,especiallyfororganisationsoperatinginmorethanonejurisdiction.TheReportrecommendsa

    nationalRegistrar,actingasaonestopregulatoryshop,whowould:Registerandregulatenotforprofitcompanies

    andIndigenous

    corporations;

    decide

    which

    organisations

    can

    get

    Commonwealth

    tax

    concessions;

    provide

    asingle

    reportingportalforpublicrecordcorporateandfinancialinformation.

    Q4:ShouldtherebeanationalRegistrar(aonestopregulatoryshop)forcharities,communityorganisationsandnot

    forprofitorganisations?

    Over90%(93%)ofrespondentsstatedthatthereshouldbeanationalRegistrarforthesector.Acrossthethreetypesof

    respondenttherewereslightlydifferentviewsastothenatureofregulationwithover7outof10oftherespondentsthat

    haveworkedwithinthesectorforthelongestexpressedpreferenceforcoregulationwhilst1outof4oftheother

    stakeholderspreferredgovernmenttoregulate(whichincludedtherespondentsfromgovernment).

    Icertainlydon'tthinktheNFP'scanorshoulddoitalonebutwithajointeffortgreatthingscouldbeachieved!

    GiventhatNFPorganisationscansometimesbeseenas"doingworkthatthegovernmentshoulddo",itisimportantto

    maketheregulatoryenvironmentassimpleaspracticable.Butthegovernmentshouldnotregulateinthesenseoftaking

    overanddirectingtheactivitiesofNFPs.Primarily,theseorganisationsarosefromandthroughnongovernmentalmotives

    andsocialforces.Theycannotbeseentobeannexedbythegovernment.Suchdisempowermentofthecommunitywould

    becounterproductive.

    4. ISSUE

    BUILDINGKNOWLEDGE

    TheCommissionwasconcernedatthelackofinformationabouttheeffectivenessofcommunityservices,aswellas

    awareofthedifficultiesassociatedwithmeasuringimpact.TheideaofnationalclearinghousewhichtheCommission

    termedaCentreforCommunityServiceEffectivenessistopromotebestpracticeapproachestoevaluation,actasa

    clearinghouseforevaluation,andconductmetaanalysisofevaluationresults.TheCommissionenvisagesthat,over

    time,theCentreshouldbefundedbystate/territorygovernments,thebusinesssectorandthesectoritself.

    Q5:Shouldthegovernmentfacilitatetheestablishmentofanationalonlineresourcethatpresentsdataandinformation

    aboutorganisationsandthenotforprofitsectorasawhole?

    Nineoutoftenrespondentsagreedthatgovernmentshouldfacilitatetheestablishmentofanationalonlineresourcethat

    presentsdataandinformationaboutorganisationsandthenotforprofitsectorasawhole.Themajorityofthese

    respondents(68%)statedthatthesectoritselfneededtoleadsuchaninitiativeaviewmoststronglyheldbythesector

    oldhands(71%).Thesectornewcomers(20%)andotherstakeholders(17%)hadthestrongestpreferenceforthis

    knowledgebasetobeoperatedwithingovernment.

    Yesthisisagreatopportunityforthesector,government,businessandtertiaryeducationbodiestoworktogetherto

    establishacommonevidencebaseforbestpracticeitcouldflyneatlyunderthebanneroftheNationalCompact!

    Thecentreshouldbeindependentofgovernment(e.g.runbyanacademicinstitution)butitshouldhaveaccessto

    governmentdata,particularlythatcollectedthroughreportingandaccountabilityrequirementsunderfundingagreements

    andinternalandexternalevaluationsofprograms.

    Centralised,accessibledatathatisclearlyandcorrectlyusedisavitaltoolforanysectorandthenotforprofitsectorcould

    benefitfromitgreatlyprovideditwasuptodate,wellmanaged,reflectiveofallprivacylawsandaccessibletoallforthis

    tohappentheonlineresourceneedstobesustainablyresourcedandsupportedbygovernment.

    5. ISSUETAXCONCESSIONS

    TheCommission

    found

    that

    the

    current

    system

    of

    NFP

    tax

    concessions

    is

    complex,

    inefficient

    and

    inequitable.

    As

    evidence,theReportpointsoutthat,acrossallAustraliangovernments,thereare40statuteswhichprovidetax

    concessionstocharitableorganisationsand19separateagenciesthatregularlymakedeterminationsofcharitable

    status.Nosurprise,theCommissionfoundthattheresultingadministrativeandcomplianceburdenforNFPSand

    governmentsisexpensive,confusingandonerous.

    Over95%ofrespondentsagreedthattheGovernmentshouldsimplifytheeligibilityfortaxconcessions.

    TheCommissionbelieves,havingregardtointernationalexperience,thatencouragingplannedgivingespecially

    throughpayrollgiving(aregulardeductionfromfortnightlypay)willsignificantlyincreasethelevelofgivingby

    Australians,andenablethatgivingtobemorethoughtfulandcosteffective.

    8. ISSUEFINANCING

    TheCommissionfoundthattheNotforProfitsectormakespooruseof,andhaslimitedaccessto,debtfinancing(i.e.:

    borrowingmoney).Thisis,ofcourse,avitalformoffinancefortheprivatesector.TheresultisthattheNFPsector

    makesverylimiteduseofdebttomeetcapitalneeds(e.g.:tobuyandmodifyhousesforpeoplewithadisability).The

    Commissionbelievesthatgovernmentsshouldhelp:buildbusinessplanningskillsinthesector(especiallysocial

    enterprises);improvefundingcertainty,toenableorganisationstotakeonlongtermdebts;andexploreoptionsfor

    philanthropictruststomakeloans,ratherthanjustmakegrants,asisthesituationatthemoment.

    Q7:ShouldAustraliangovernmentsfacilitatewaysforNotforProfitstoborrowmoneyfortheiractivities?

    Overthreequartersoftherespondentsstatedthatthegovernmentshouldfacilitatewaysfornotforprofitorganisations

    toborrowmoneyfortheiractivities.Thiswasmoststronglysupportedbyotherstakeholders(79%)considerablyhigher

    thanthe

    sector

    old

    hands

    (68%).

    The

    majority

    of

    these

    respondents

    felt

    that

    this

    was

    the

    responsibility

    of

    government

    (46%)butasignificantproportionthoughtthatsuchaninitiativeshouldbeledbythesector(22%).Thesectoroldhands

    expressedconcernthatthismaylimitgovernmentfundingobligations(26%)aconcernalsonotedaboveinrelationtoa

    campaigntopromoteplannedgiving.

    IndoingsotheNFPshouldalsohaveasoundfinancialbasefromwhichtonegotiate.NFPsarecontinuallytrustedwith

    people'slivesbutitseemsthattheGovernmentisnotpreparedtotrustuswiththreeyearsoffundingtoenableustobuild

    amorestablebase.NFPswithannualfundingwouldnotbeinapositiontotakeoutaloan.

    Withlotsofcautionandattentiontooverseaslearning.Again,thelackofcommunityeducation(andboardeducation)

    aboutdebtfundingforNPOsisabarriertobeovercome.

    9. ISSUESECTORWAGES

    TheProductivityCommissionReportasks:isthereaworkforcecrisisintheNFPsector?Thequestionarisesbecauseof

    thesectorsdifficultiesinattractingandretainingemployeesduetolowwages;highlevelsofemployeeturnoverwithin

    thesector;and,alackofcareerpathsandtrainingopportunities.TheReportfindsthatwagesinthecommunitysector

    arestill

    considerably

    lower

    than

    equivalent

    positions

    in

    the

    public

    sector.

    The

    Report

    recommends

    that

    Governments

    fundwagesatmarketrates,ratherthanonawardorhistoricalrates.

    Thediversityandnumbersoforganisationwithinthesectormakeitverychallengingtobeheard.Wehavegoodexamples

    ofwherelikemindedorganisationshavecometogetheroftheirownaccordtocreateastrongervoiceandadvocacy

    platform.Buildingthisforthewholesectorwouldmakeasignificantdifferenceandbenefitallorganisationsandhencethe
