Mission & Vision Today international business is multi-cultural. Globalization drives economic actors across national borders and obliges them to develop business solutions abroad. With direct investments, joint-ventures, franchising or distributorship agreements, as well as with many other contractual arrangements, corporations seek to expand their business horizons. Nonetheless, the legal and cultural differences that divide countries and regions represent a major challenge to international transactions. In order to effectively advise and support their clients, lawyers need to understand the legal and cultural background of their clients’ foreign partners.

With a strong emphasis on international business law, international contracts and compliance, the Fribourg Law Faculty LL.M. programs are committed to provide high level practical legal education constantly adapted to the employers’ needs thus offering students a clear advantage in their career.

Program OverviewThe Fribourg Law Faculty, in co-operation with the Law Faculties of Bern and Neuchâtel, provides you advanced education in international business law, contracts and arbitration, and compliance with the knowledge and skills essential for an international business law career.

Our world renowned professors, leaders in their field, will provide knowledge and skills that will make you more valuable in the workplace for current and future employers.

A thorough analysis performed in cooperation with the legal departments of several national and multinational companies as well international law firms allowed us to develop a curriculum adapted to the real needs of the companies and law firms, enabling you to acquire the knowledge and skills that the employers actually seek.

An education focused on enhancing lawyering skills gives you the ability to put the acquired knowledge into practice immediately after your studies.

Programs

Certificate of Advanced Studies (CAS)

The Certificate of Advanced Studies (CAS) helps those who already possess fundamental lawyering skills develop and update, in a limited time, the specific knowledge in the areas of international contract law and arbitration, and compliance.

CAS students must earn at least 10 ECTS credits, as follows:

• 8 ECTS credits (4 to 6 modules) by completing exams• 2 ECTS credits by preparing a Certificate Thesis.

Tuition fees amount to CHF 8’000.- and are payable in equal installments before each module. Tuition fees for extra modules are of CHF 1’000.- per module.

Master of Laws (LL.M.)

LL.M. programs enable you to acquire the necessary capabilities to become a successful practitioner in the fields of international business law, contracts and arbitration, and compliance. In addition to a solid theoretical basis, the programs provide you with practical insight, allowing you to practice immediately following your studies.

LL.M. students must earn at least 60 ECTS credits, out of which:

• 50 ECTS credits by completing exams and practical activity (internships, study trips etc.)

• 10 ECTS credits by preparing a Master’s Thesis

The tuition fees for the core modules of the LL.M. Programs are of CHF 18’500.-. The fees for extra modules are of CHF 1’000.- per module payable before the beginning of each module.

Contracts and Arbitration (LLM, CAS)• a comparative introduction to contracts in civil law and common law• courses on International Arbitration and Private International Law• study of essential international instruments such as the UNIDROIT Principles for International

Commercial Contracts, the Vienna Convention for the International Sales of Goods, the Principles of European Contract Law and the INCOTERMS

• courses on some of the most important international contracts such as construction contracts, agency and distributorship, joint ventures, consumer contracts, insurance contracts, contracts in sports, mergers and acquisitions, secured transactions, trusts and wealth planning etc.

• specialized courses in business law in fast growing regions of the world: Asia, Africa, Middle-East and Latin America

• legal clinics and moot courts, business negotiation, legal drafting and other skills related education

Commodity Trading (LLM, CAS)• an introductory course on comparative contract law • in depth study of the international sales contracts (physical goods and derivatives) under the Viena

Conevntion for the International Sales of Goods, the UK Sales of Goods Act and Swiss law, shipping and insurance

• thorrough examination of dispute resolution mechanisms, inlcuding conflict of laws, ICC and trade arbitration (GAFTA, FOSFA, RSA) and commercial mediation

• commodities financing, security interests and insolvency• customs and taxation • environmental, anti-corruption, trade and regulatory compliance • WTO law• legal clinics and moot courts, business negotiation, legal drafting and other skills related education

Compliance (LLM, CAS)• an introductory course on compliance and compliance systems• courses on the most important fields of compliance, such as tax, competition, labor, banking,

environmental compliance, trade compliance and customs regulations, anti-corruption and anti-money laundering compliance, risk regulations and risk management

• specialized courses in business law in fast growing regions of the world: Asia, Africa, Middle-East and Latin America

• legal clinics and moot courts, business negotiation, legal drafting and other skills related education.

International Business Law (LLM)• an in-depth study of different areas of business law, ranging from contract law, to private international

law, competition law, tax law, EU institutional law, EU internal market law, WTO law and intellectual property law

• specialized courses on law and business in the world’s fastest growing regions : Asia, Africa, Middle-East and Latin America

• cross-disciplinary courses in economics and business anthropology• legal clinics and moot courts, business negotiation, legal drafting and other skills related education

Entry Requirements

The LL.M. programs are designed for experienced lawyers and recent graduates with top grades.

The Certificate of Advanced Studies is designed for practicing lawyers as well as legal counsels of national and multinational companies, non-governmental or international organizations.

The programs also welcome graduates with university degrees other than law who have practical experience in a relevant field.

Applicants whose first language is not English and who did not receive their University education in the English language are invited to take a language proficiency test (e.g. TOEFL or IELTS). Applicants with at least two years of professional legal experience in English may request a waiver of this requirement.
