Experienced HVAC Technician required for alternative staffing assignment through the Marin City Community Development Corporation (MCCDC). Position is a temporary status. Qualifications Ideal candidate must have:

2 years verifiable experience (more is desirable) in residential HVAC installation; Solid troubleshooting skills; Experience working with homeowners providing a high level of customer service and professionalism; Experience having worked on a team as well as independently; Willingness to learn and adhere to stringent requirements regarding equipment and duct installations;

and A valid California driver’s license, a clear driving record and proof of personal vehicle insurance coverage

are required to be maintained at all times for this position. Functions and Responsibilities The HVAC Technician must possess:

Ability to pull his/her entire body weight up through an attic hatch door; Skills to be able to work in an 18" high crawl space or attic; Tolerance for working under high heat and extreme cold conditions Ability to wear a full-face respirator for several hours a day continuously; Capacity to regularly carry up to 50 pounds of equipment; Unafraid of mice, rats, spiders, bugs, etc., commonly found in HVAC work; Must model environmentally responsible behavior on the job at all times.

Additional criteria Highly desirable:

BPI Certification; Environmental literacy certification such as Roots of Success; OSHA safety certification Own truck or van; and Genuine interest in the industry and be dedicated to greening the environment.

INVESTIGATIONS

City of Newman MT111001 ($5,000) Stanislaus County While performing research online, Tucker found a Request for Proposals (RFP) issued by the City for the Yancey Building Foundation Project. The RFP specified that design build proposals would be received by the City on October 18. The scope of work included the design, furnishing and installation of a new concrete foundation under this historic building. Tucker contacted the City for more information. The design build method of construction is allowed for projects that have an aggregate value that exceeds one million dollars. The City could solicit proposals for the design but not the construction work. This work would have to be competitively bid. It is Tucker’s opinion that if the City were to proceed with this method of construction, it would be out of compliance with State law. Tucker sent a formal letter, including the applicable sections of the Public Contract Code to the City Manager for reference. The City has decided to cancel the RFP. Approximate Value: $15,000 Status: Resolved/Influenced

Hayward Unified School District MT111002 (CUCCAC-$30,000) Alameda County Tucker received a request to investigate a possible misuse of the California Uniform Construction Cost Accounting Act provisions. The complaint stemmed from alleged bid splitting amongst contracts within the District. Tucker researched the Districts website but found no specific project information. Tucker contacted the District and requested project information for the District Superintendent’s Building Project and ADA Compliance throughout the District. Tucker received documents pertaining to one project and is waiting for a response to her second request for documents. Approximate Value: $150,000 Status: On-Going

City of Modesto MT111003 (Charter City-$50,000) Stanislaus County Tucker was contacted regarding a Modesto Bee newspaper article that indicated the City of Modesto wanted to exempt the bidding process for the construction of a memorial for fallen police officers. This memorial would be located outside the police headquarters on 10th Street in Modesto. Tucker researched the project and found that it would be funded entirely through private donations. Tucker contacted the City and found that the City had already passed a resolution amending its Municipal Code to allow for a bidding exemption on this project. No further action was needed. Approximate Value: $125,000 Status: Resolved

City of Monterey MT111004 (Charter-$60,000) Monterey County Tucker was contacted regarding a sidewalk improvement project on Prescott Avenue within the city limits. The caller was concerned that the work was to be performed by city staff. Tucker contacted the city for detailed project information. Project scope was for the replacement and installation of concrete sidewalk along approximately five miles of road along Prescott Avenue. It appears that the work was completed and performed by a contractor pursuant to a job order contract (JOC). JOCs are annually bid, individually awarded contracts that may not exceed $1 million dollars in aggregate and are allowed by the cities charter for repairs, sidewalk, paving and other repetitive work. Funding was derived from transient occupancy taxes. State prevailing wages were also required. Tucker concluded that no further action was necessary.Approximate Value: $375,000 Status: Resolved

City of Coalinga MT111005 (General law-$5,000) Fresno County While reviewing the October 20 City Council agenda, Tucker noticed an item for the installation of a fence along the Los Gatos Creek that will deter off road vehicles from riding along the creek side and onto the field at the newly completed sports park. Tucker contacted the city for more information. It appears that they are currently seeking donations from contractors for material and labor to construct the fence. One proposal includes the completion of the work by force account. Tucker will continue to monitor this project to ensure compliance with State laws. Approximate value: Unknown Status: Monitor

Santa Cruz Harbor District MT111006 (CUCCAC-$30,000) Santa Cruz County Tucker was contacted regarding a project that was not competitively bid. The Dredge “Seabright” Through-Hull Reinforcement Project was slated to be awarded at the October 25 Harbor Commission meeting. The scope of work was for the replacement of the through-hull that was damaged due to previously dredged material that passed through the hull. Prior work was completed on this dredge by a contractor, so the District requested an estimate from the same contractor to complete this work. A dredge is a device for scraping or sucking the seabed. After further research, it was Tucker’s opinion that the scope of work does not fall under the definition of a public project within the Public Contract Code.Approximate Value: $35,000 Status: Resolved

Fresno Chaffee Zoo Corporation MT110108 (Private) Fresno County Please refer to Tucker’s previous recaps for detailed project information. Tucker has had continuous communication with the Fresno Chaffee Zoo Corporation (Zoo Corp.) regarding procurement procedures. The Zoo Corp. has developed a draft policy that was sent to Tucker for her suggestions and comments. This policy will be presented to the Zoo Corp. Board of Directors for approval at the next meeting in November. Tucker has been informed that the Zoo Corp. is currently following these procedures for procurement. At the last Fresno County Zoo Authority Board meeting, Tucker requested that the Board adopt their own procurement procedure for Measure Z funded projects. This item will be discussed at the next Authority Board meeting on November 30. Approximate Value: $70 million Status: On-Going/Influenced

OTHER

Tucker was contacted regarding the construction of a new stadium at Gregori High School in Modesto. Tucker researched the project and found that the District has approximately $3.7 million dollars worth of bond funding to finance the stadium. The District has elected to use the Lease lease-back method of construction for this project. Lease lease-back is allowed per the Education Code and does not require a

competitive bidding process be used. The same contractor that built the school will perform the construction of the stadium.

Previously, while reviewing Municipal Codes online, Tucker noticed the City of Lodi specified that public projects with a total value that exceeds $20,000 must be formally bid. The City is a general law city and must abide by a $5,000 bid threshold for public works projects. Tucker contacted the City attorney and through continued discussions, the City has amended its Municipal Code to reflect the $5,000 threshold. In addition, language was added that says that Public Contract Code procedures will be followed. The ordinance became effective on October 7, 2011.

NETWORKING

Tucker continues to maintain contact with her network and search for new bidding opportunities for the industry within her coverage area.

INVESTIGATIONS

County of Sonoma SR111001 ($30,000-CUCCAA) Sonoma County CIFAC was contacted about possible bidding violations on the installation of a portable restroom project by the County of Sonoma. The project was funded through the Sonoma County Redevelopment Commission (SCRC). The County had declared the area as a blight area eight years ago. One of the projects they wanted to have done was to install a restroom on county property in the Guerneville area.This would provide restroom access to people using the beach, tourists, and the large homeless population. There were a number of hearings held. The SCRC told the County that they would provide funding up to $350,000. The County purchasing Department advertised for a portable restroom facility. The building had to meet special requirements since its placement is 18” below 100 year flood plane. The County decided with their legal counsel that the building is a commodity and thus falls under purchasing.The County then contracted for the labor with the Sonoma County Probation Department. Sonoma County has a large Supervised Adult Crew program. Instead of jail time or fines, convicted people can sign up for the program and perform community work. The complaining party has turned over this portion of their complaint to the Foundation for Fair Contracting. The complaining party contacted the State Controller’s Office about the County being signatory to the California Uniform Construction Cost Accounting Act. The complaining party reported that they suggested he file a complaint with them. The County estimates that they contracted out less than $26,000 including engineering and design. Riley discussed the complaint with Executive Director Hilliard. It was agreed that this was not a CIFAC issue. Estimated Value: $150,000 Status: Resolved/Monitor

Eastside Union High School District SR111002 (Bid threshold-$17,500) Santa Clara County Riley was contacted regarding the possible illegal addition of a subcontractor on the bleacher portion of a project at Oak Grove High School. The larger project is for modernization of the school campus. Riley is checking on the value of the entire project and then the value of the work being done by subcontractor.The General Contractor on a project is required to list all subcontractors whose work will be in excess of ½ of 1 percent of the bid. If a subcontractor is doing a number of items, it is the aggregate value of the work being performed. A contractor certifies that he will be self-performing the work if he doesn’t list a subcontractor. He is not required to list those that will be performing less than the percentage requirement. Riley sent a letter to the District requesting information on this matter and how the District plans to proceed.Approximate Value: $143,800 Status: On-Going

Mendocino County SR111003 ($30,000-CUCCAA) Mendocino County The County of Mendocino went out to bid on three roofing projects. They held a pre-bid meeting, advertised and notified the contractors on their informal bidders list. The prebid meeting was well attended. On the bid date they did not receive any bids. They contacted Riley to ask what they should do next. Riley provided the section of the Public Contract Code, 22039 (c) that allows the county to proceed by either force account or negotiated contract. Riley also spoke with area contractors about the lack of bids. She found that increasing license and insurance requirements are forcing many companies to no longer do roofing. The County stated that some contractors stated they were simply to busy to bid the work.Approximate Value: $100,000 Status: Resolved

Caltrans-District 1 SR111004 ($25,000-Bid threshold) Mendocino County Riley was contacted by members of her network regarding the new Willits Horsemen’s Association facility that is being built in Willits. There have been numerous inquiries about the funding for the facility. Concern has been expressed by members of the construction industry that Caltrans granted funds to the Association to do construction, thus circumventing the need to go out to competitive bidding on a project funded with public monies. Riley has contacted Caltrans to find out about the funding. It may be possible that Caltrans purchased right of way from the Association and they are using the funds for the project.Approximate Value: $Unknown Status: On-Going

City of Ukiah SR110704 (CUCCAA-$30,000Mendocino County The City of Ukiah decided to have redevelopment fund a project to have an outdoor dining project built for a restaurant in the City. City staff reported that the project would cost less than $12,000. Riley was asked to monitor the project. (SEE details from Riley’s earlier recaps, July 2011-September 2011). The original project was to take less than one week. The project took over 6 weeks to complete. Riley obtained documents and reviewed them. The costs currently show $27,000. Observation and photos of the project showed that the City had not included all of their costs on equipment and materials. Riley has asked for the additional information. Approximate Value: $ 31,000 Status: On-Going

Riley was asked to find out who the owner was of a section of roadway. She found that though it appeared to be part of the Caltrans system, it actually belongs to Tehama County. There are on-going discussions about Caltrans taking over the section of roadway that links I-5 with Highway 99.

A non-profit group in Mt Shasta (Siskiyou County) has received a grant from the California Department of Recreation and Parks to build seven miles of trail. Riley has been asked to investigate the funding and the apparent exemption from the work having to be competitively bid. Though the money is going to a non-profit the funding is apparently all State funds.

Riley is gathering information about counties using work release inmates to do public work projects and thus not put them out to bid. As work release prisoners are not considered force account, it makes it difficult to enforce bidding limits.

SALES AND INSTALLATION OF AFTERMARKET PARTS ON NEW AND USED GAS OR DIESEL POWERED VEHICLES AND ENGINES IN CALIFORNIA

This Advisory discusses California laws and regulations regarding the sale and installation of aftermarket parts on new and used on and off-road vehicles/engines in California, including diesel powered cars and trucks.

SUMMARY OF CALIFORNIA LAWS AND REGULATIONS

Any part, device or modification that alters or modifies the design or performance of an original motor vehicle pollution control device or system must obtain an Executive Order from the ARB exempting it from California Vehicle Code section 27156.

Only aftermarket parts with valid ARB Executive Orders may be used

on California vehicles/engines.

Aftermarket catalytic converters offered for sale or sold in California after January 1st 2009 must meet exemption requirements specified in the regulations and evaluation procedures adopted by ARB on October 25, 2007 (http://www.arb.ca.gov/regact/2007/amcat07/approvalamcat.pdf).

A new California vehicle must be sold in the original manufacturer

certified configuration with no modifications made.

It is illegal to modify a new vehicle by installing ARB exempted or non-exempted aftermarket parts before the title to the vehicle has been transferred to an ultimate purchaser.

California law prescribes penalties for illegal modifications to the

emission systems of new on-road and off-road vehicles/engines.

Devices that defeat original emissions control systems are not legal on any registered on-road or off-road vehicle/engine.

Automotive emissions account for over fifty percent of all smog forming pollutants in California. To improve air quality, the California Air Resources Board (ARB) requires vehicle manufacturers to develop engine and emission equipment systems that reduce the pollutants that cause California's severe air quality problem. These emission control systems are required to be durable and reliable, and are covered by an emissions control warranty. New vehicles/engines sold in California are required to demonstrate compliance with these requirements through rigorous testing as part of the certification process. To ensure that these systems operate as designed, California Vehicle Code Section 27156 prohibits modifications that may increase motor vehicle emissions. An exemption from Vehicle Code Section 27156 (VC 27156), California's anti-tampering law, is required before any add-on or modified part can be sold in California. Vehicle Code Section 27156 (c) states, “No person shall install, sell, offer for sale, or advertise any device, apparatus, or mechanism intended for use with, or as a part of, a required motor vehicle pollution control device or system that alters or modifies the original design or performance of the motor vehicle pollution control device or system.” An exempted aftermarket part may be installed on a vehicle/engine that has been delivered to an ultimate purchaser under the terms and conditions of the applicable Executive Order. ARB Aftermarket Part Executive Orders do not apply to any aftermarket parts advertised, offered for sale, sold with, or installed on a new motor vehicle prior to the vehicle’s transfer to an ultimate purchaser. Modification of a new vehicle through installation of aftermarket parts produces a vehicle in a different condition than it was originally certified by the original manufacturer. A new vehicle that was modified in this way would therefore be considered by the ARB as a new uncertified vehicle and would be in violation of Health and Safety Code, Sections 43150-43154. A new vehicle is defined in the Health and Safety Code, Section 39042 as, “"New motor vehicle" means a motor vehicle, the equitable or legal title to which has never been transferred to an ultimate purchaser.” Violations of H&SC 43151-43153 are subject to penalties of up to $5000 per violation under H&SC 43154. Any person, business or entity using aftermarket parts to modify a new vehicle in California or selling a new modified vehicle to anyone in California is in violation of California law. ARB exempted aftermarket catalytic converters may be installed on gasoline passenger cars and light- and medium-duty trucks (GVWR </= 14,000 lbs.) only. Diesel passenger cars and trucks, and heavy-duty gasoline vehicles must use original equipment manufacturer’s (OEM) catalytic converters. Information regarding aftermarket catalytic converters that were granted exemptions under the new regulations and evaluation procedures adopted October 25th 2007 is located in the Aftermarket Parts Program location of the ARB website at http://www.arb.ca.gov/msprog/aftermktcat/aftermktcat.htm. Drywallers put the finishing touches on our home and office interiors by installing and finishing sheetrock walls. Physical stamina is required to lift, cut, and ma-neuver heavy sheets of drywall and fix them in place. Finishing and sanding seams is also an ergonomic and physical challenge. Consider that this demanding work is often done on a construction site and at heights, and it is clear that drywallers need to think safety on the job.

Lifting and maneuvering tools and heavy, awkward sheets of drywall pose an ergonomic risk for drywallers. Maintain-ing good physical condition and using proper lifting tech-niques can reduce the chance of injury and strain. Working in pairs makes it easier to lift, position, and control sheet-rock. Seam taping and sanding tools with spring-assisted or powered systems makes overhead finishing work easier by reducing the force that workers must apply. Completing work one task at a time (hanging, taping, finishing, etc.) may be efficient, but is harder on the body; completing one area at a time allows workers to rotate tasks and give muscles a break.

Because drywallers work at heights to install tall walls and ceilings, they need to use extra caution to prevent falls. Workers can use ladders if the work can be done safely from them, but they should follow ladder safety rules. Lean-to or jack scaffolds, shore scaffolds, nailed brackets, loose tile, loose brick, loose blocks, and other unstable objects cannot be used as working platforms or for their supports. Stilts should never be used due to their instability. Sturdy scaffolds or steps that are at least 20 inches wide provide safe, stable working platforms when installed and used cor-rectly.

Dust is a hazard for drywallers at the beginning and end of every job. When sheetrock is cut, the gypsum dust that is released can be irritating to the eyes and lungs. Dust from

dry mixing joint compound can be an irritant; pre-mixed compounds can reduce worker dust exposure. Sanding finished joints can also create a lot of dust. Whenever job tasks may create dust, safety glasses and respirators or dust masks should be used to protect workers’ eyes and lungs. Proper ventilation on the jobsite can reduce dust in the air.

Electrical safety should be considered when drywallers are fastening sheetrock to wall frames. Workers should use caution around interior wall wiring and ensure that electric boxes have proper shielding to prevent screws and nails from penetrating them. Powered nail guns, fasteners, and drills should be properly grounded and in good working order to reduce the risk of electric shock. Other tools, es-pecially cutting tools, should be in good working order and used properly.

Because drywalling is usually one of the last tasks on a construction job, it is often done under deadline pressure. However, the need for speed is never an excuse to forget safety. Good planning and safety procedures give a dry-walling job a smooth finish.------------------------------------------------------------------------------Seguridad en la construcción de paredes de tabla de yeso

Levantar y maniobrar herramientas y tablas de yeso pesa-das presentan un riesgo ergonómico para los trabajadores de este ramo. Mantenerse en buenas condiciones físicas y usar las técnicas apropiadas para levantar objetos pesados puede reducir las lesiones y el estrés. Trabajar en parejas facilita levantar, colocar y controlar las tablas de yeso. Las herramientas para colocar la cinta en las costuras y lijar las costuras con la ayuda de resortes o sistemas motorizados hacen más fácil el trabajo por encima del nivel del cuerpo, reduciendo el esfuerzo que tiene que hacer el trabajador. Terminar todo el trabajo haciendo una tarea a la vez (fijar, nivelar costuras, acabado, etc.) puede ser eficiente, pero es más duro para el cuerpo; terminar un área a la vez le permite al trabajador rotar las tareas y dejar descansar a los músculos.

Debido a que los trabajadores de este ramo trabajan por encima del nivel de su cabeza para instalar las tabla en paredes altas o en cielos rasos, se deben tomar precau-ciones especiales para prevenir caídas. Los trabajadores pueden usar escaleras si se puede efectuar el trabajo en forma segura usándolas, pero deben observar la reglas de seguridad en el uso de las escaleras. No se deben usar andamios soportados por gatos, clavados, losas sueltas, ladrillos sueltos, bloques de concreto sueltos u otras bases inestables como plataformas de trabajo o como soportes para las mismas. Nunca se deben usar zancos debido a su inestabilidad. Andamios fuertes o escaleras con un ancho mínimo de 20 pulgadas proporcionan una plataforma de trabajo segura y estable cuando se instalan y se usan cor-rectamente.

El polvo es un peligro para los trabajadores de este ramo al comienzo y al final de cada trabajo. Cuando se cortan las tablas de yeso, el polvo de yeso que se produce puede ser un irritante para los ojos y los pulmones. El polvo que se produce al mezclar el compuesto para las costuras puede ser un irritante; los compuestos premezclados pueden re-ducir la exposición del los trabajadores al polvo. Al lijar las costuras también se puede producir mucho polvo. Siempre que las tareas puedan producir polvo, se deben usar gafas de seguridad, equipos de respiración o máscaras contra el

polvo para proteger a los ojos y los pulmones de los traba-jadores. Una buena ventilación en el sitio de trabajo puede reducir el polvo en el aire.

Se debe considerar la seguridad eléctrica cuando los tra-bajadores de este ramo están fijando las tablas de yeso a la estructura de las paredes. Los trabajadores deben tener cuidado en las cercanías del cableado interno de las pare-des y asegurar que las cajas eléctricas tengan resguardos apropiados para evitar que los tornillos y los clavos puedan penetrarlas. Las pistolas eléctricas para clavar, los elemen-tos de sujeción y los taladros deben estar conectados a tierra correctamente y en buenas condiciones de funciona-miento para reducir el riesgo de choques eléctricos. Otras herramientas, especialmente las herramientas de corte deben estar en buenas condiciones de funcionamiento y usarse correctamente.

Debido a que la instalación de tablas de yeso es una de las tareas finales en la construcción, a menudo se hace bajo la presión del tiempo. On June 3, 2009, the Board of Education of the West Contra Costa Unified School District approved Reso-lution 90-0809. The resolution places the District under the Uniform Public Construction Cost Accounting Act. Under Section 22036/of the act, the District is inviting all licensed contractors to submit the name of their firm to the District for inclusion on its list of qualified bidders for the following calendar year (2012).
