The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

Like holidays we get good feelings about and enjoy coming back on the calendar, it’s always a pleasure to hear from a contractor we’ve helped before. Especially when we can offer good news in response to the question. Another contractor wants to “C” about adding some class to his Inactive number, but first we dispel a mistaken notion about ‘handyman licensing’…

Q: My license is currently suspended because my Bond expired. I attempted to renew it but the bonding company wants close to $1000 to renew it for one more year! I have no complaints or claims filed on my bond so I don’t understand why the premium is so high. Can I get just a Handyman license since most of my projects have been small lately?

A: Just FYI, even when there are no claims/judgments against the bond, the cost of the bond is determined based on your credit. I have to tell you there is no such thing as a Handyman license. You mentioned that most of your projects are small; if they are under $500 (including time and materials) you can do them without a Contractor’s License.

You may also consider shopping around for a Bond. Perhaps you might find one less expensive or even one that allows you to make payments.

Q: Last year you helped us with the license holder move between two of our Qualifying individuals. Our license dates show a gap between March 15, 2013 and April 11, 2013 and one of our Prime Contractors is, we believe mistakenly, denying payment of work performed during this period. I do not recall a gap during the transition. Can you help me understand the license rules when you have a Disassociation and Reinstatement? Please advise.

A: Once a Qualifier disassociates from a license, you have 90 days to replace them. The license still remains Active and in good standing during that 90 day period. So unless there were other circumstances associated with the license you have not shared, it’s not an issue to have no Qualifying individual for that month of time. The license stands.

Q: I want to add some of the “C” classifications to my license but it’s currently Inactive. Do I need to re-activate the license first before I can add the classifications?

A: No, as long as the status of license is “Inactive” and not “Expired” you can add classifications to the license. Let us know if we can help speed up the process.

Q: I had called your company a few months ago regarding my GC license that is expired.

I am ready to get my license back now but it’s currently under my former corporation. I formed a new corporation and I want to reassign this license to my newly registered California entity. What is the process to accomplish this?

A: A license number cannot be transferred from one corporation to another. You will be required to obtain a new license number. Assuming it has not been over 5 years since your previous license expired, no exams would be required.

July 31, 2014 Reporting Deadline for Some Provisions Including Low-Mileage Work Truck and Small Fleet OptionsThe California Air Resources Board (ARB) approved amendments to the Truck & Bus Regulation in April 2014, and these changes will be finalized later this year. Fleet owners may take advantage of the April amendments now and must act by July 31, 2014 in some cases to qualify for some of the changes.

Please review ARB’s Regulatory Advisory (see attached) to see how the changes to the Truck & Bus Regulation might impact your fleet and whether or not the July 31, 2014 deadline applies to you. Amendments to the Truck and Bus Regulation include provisions for the Low Mileage Work Truck Phase-in Option, Low Use Exemption, NOx Exempt Area Extension, and Small Fleet Option among others.

CARB Announces 15-day Language on Proposed Amendments to the Regulations for In-Use On-Road Diesel-Fueled Vehicles (Truck and Bus Regulation).

The California Air Resources Board has posted the 15-day Notice of Public Availability of Modified Text for the Proposed Amendments to the Regulation to Reduce Emissions of Diesel Particulate Matter, Oxides of Nitrogen, and other Criteria Pollutants from In-Use On-Road Diesel-Fueled Vehicles (Truck and Bus Regulation).

The 15-day notice, proposed 15-Day modifications, additional documents/information, and all previously released regulatory documents are available on the ARB’s website below for this rulemaking at:

New Title 24 Standards Will Cut Residential Energy Use by 25 Percent, Save Water, and Reduce Greenhouse Gas Emissions Update Took Effect July 1

Updated building standards, designed to get more energy savings from new and existing residential and nonresidential buildings, took effect July 1 in California. The 2013 Building Energy Efficiency Standards (Title 24) will lead to 25 percent less energy consumption for residential buildings and 30 percent savings for nonresidential buildings over 2008 Energy Standards.

“These new Title 24 standards will help California buildings function beautifully and economically. The most effective way to optimize building performance is during construction,” said Commissioner Andrew McAllister who oversees the Energy Commission’s energy efficiency division. “Standards are a foundational part of California’s long-term goals for meeting our energy needs, conserving resources and protecting the environment.”

The 2013 standards update codes for lighting, space heating and cooling, ventilation, and water heating. These standards add approximately $2,000 to the new residential building construction costs. Estimated energy savings to homeowners, however, is more than $6,000 over 30 years. In total, these standards are estimated to save 200 million gallons of water (equal to more than 6.5 million wash loads) and avoid 170,500 tons of greenhouse gas emissions a year.

The significant changes to the Building and Standards code are the first update since California’s energy agencies agreed upon a Zero-Net Energy goal: all new residential buildings by 2020 and new nonresidential buildings by 2030. The 2016 and 2019 Building

Energy Efficiency Standards will move the state even closer to the Zero-Net Energy goal.

New standards call for:

Residential

- Insulated hot water pipes to save water and energy, and cut the time it takes to get hot water

- Improved window performance to reduce heat loss during winters and heat gain during summers

- Whole house fans when appropriate, to reduce the need for air conditioning Improved wall insulation to reduce heating and cooling loads in all climate zones

- Mandatory duct sealing in all climate zones

- Mandatory solar ready zone to facilitate future installation of solar systems

- Recognizing photovoltaic compliance credit for the first time in the building standards

Nonresidential

- High performance windows that reduce heating and cooling loads in buildings year round

- Efficient process equipment in grocery stores, commercial kitchens, data centers, laboratories, and parking garages

- Advanced multi-level lighting controls and sensors to minimize the usage of electric lighting by taking advantage of available daylighting and demand response opportunities

- Occupant Controlled Smart Thermostats allow for setting and maintaining a desired temperature and voluntarily participation in a

utility’s demand response programs

- Increased solar reflectance for low-sloped roof to reduce cooling load in summer time

- Increased cooling tower energy efficiency and water savings by requiring drift eliminators and other water saving measures

Standards for all types of buildings require “solar ready roofs” to accommodate future installations of solar photovoltaic panels. This is the first time photovoltaics are included as a compliance option.

To help the industry meet the 2013 standards, the Energy Commission developed public domain software to assist with compliance. The California Building Energy Code Compliance (CBECC) software is a free, open-source program that models residential and nonresidential buildings, giving businesses a better understanding of what is required to be in compliance. The CBECC platform provides more consistent simulation results, and facilitates compliance analysis within third-party building energy design tools. In addition to CBECC, there are three additional available vendor software programs to help designers, builders, contractors and others measure and evaluate results.Following is their web address for access: http://www.energy.ca.gov/title24/2013standards/2013_computer_prog_list.html

“The development, adoption and roll out of the 2013 Title 24 standards have been a major priority for the Energy Commission,” McAllister continued. “They are a critical piece of any strategy for California to reach our emission reduction targets in 2020 and beyond.”

California’s first building energy efficiency standards went into effect in 1978. The

standards are periodically updated to allow new energy efficient technologies and construction methods for consideration and incorporation. The standards will save energy, increase electricity supply reliability, increase indoor comfort, avoid the need to construct new power plants and preserve the natural environment.

Bay Area Mandatory Commuter Benefits Program Takes Effect September 30thThanks to my ‘old’ pal Augie Venzia for this important information:

Employers with 50 or more full-time employees are required to offer a commuter benefit to their employees by September 30, 2014. Attached you will find the employer guide to the program, FAQs and the steps to

implement the program. Please be sure to review the options provided and let Armando or myself know by August 22nd if the plan you select will impact payroll (i.e. deductions etc.) in order to set up the appropriate changes. Program applies to : • Employers with 50 or more full-time employees ( an employee who normally works at least 30hours per week).• The employee counts is based on the average number of full-time employees on the payroll over the course of the most recent three month period (seasonal or temporary employees who work 120 days or less are not included.• Multi-site Employers-The program applies to employers with 50 or more FT employers at all bay area worksites combined.

Additional Program Requirements • Must be offered to employees by

September 30th.• Designate a commuter benefits

coordinator (typically an employee who already handles benefits/payroll)

• Must register on line to the Air District/MTC and update their registration on an annual basis.

• Notify employees of the commuter benefit option and make that option available.

• Maintain records to document implementation of the commuter benefit for up to 3 years and make records available to Air District upon request.

What is carpal tunnel syndrome?

Carpal tunnel syndrome (CTS) occurs when the median nerve, which runs from the forearm into the hand, becomes pressed or squeezed as it passes through the carpal tunnel in the wrist.

The result includes:

• Pain

• Tingling

• Weakness

• Numbness

• Restricted wrist movements

What causes carpal tunnel syndrome?

CTS has many causes, though usually it is a combination of many factors, including:

• A genetic predisposition or normal aging can cause the sheath around the wrist tendons to become thick and sticky.

• Highly repetitive tasks.

• Constant exertion.

• Awkward wrist positioning.

• Repeated use of vibrating tools.

• Damage to the bones from injury or other trauma in the hand or wrist, resulting in pressure in the carpal tunnel.

There are more common disorders such as bursitis and tendonitis in the wrists that have similar symptoms as CTS and can be caused by repetitive and forceful motions of the hands.

How is carpal tunnel syndrome treated?

The diagnosis and treatment of carpal tunnel syndrome by a qualified medical provider should happen as early as possible and may include:

• Resting the affected hand and wrist for at least two weeks.

• Avoiding activities that may worsen the symptoms.

• Immobilizing the wrist in a splint to avoid further damage from twisting or bending.

How is carpal tunnel syndrome treated? (continued)

• Taking non-steroidal anti-inflammatory drugs as instructed by a medical professional, such as:

− Aspirin

− Ibuprofen

− Other non-prescription pain relievers

• Doing hand and wrist stretching and strengthening exercises can be helpful.

• Yoga has been shown to reduce pain and increase wrist and hand strength.

• Alternative methods such as chiropractic care and acupuncture may be a treatment option but have not been proven as an effective method.

• Surgery and post-operative physical therapy is often successful as a last resort.

Can carpal tunnel syndrome be prevented?

Proper work habits can reduce the chances of having CTS:

• Physical conditioning and stretching exercises.

• Taking rest breaks from repetitive activities.

• Wearing supports or splints to keep wrists straight.

• Proper adjustment of workstations to assure correct posturing and wrist positioning.

• Taking vibration dampening measures (gloves, pads, slings) when using vibrating tools.

• Rotating jobs or alternating tasks.

• Adapting workplace conditions and job demands to the capabilities of employee.

In severe cases, CTS can result in permanent nerve damage. However, if diagnosed and cared for early, CTS is very treatable and will not create long-term problems.

¿Qué es el síndrome del túnel carpiano?

El síndrome del túnel carpiano (CTS por sus siglas en inglés) se produce cuando el nervio mediano, que se extiende desde el antebrazo hasta la mano, se apreta mientras pasa a través del túnel carpiano de la muñeca.

El resultado incluye:

• Dolor

• Hormigueo

• Debilidad

• Adormecimiento

• Movimientos de la muñeca restringidos

¿Qué causa el síndrome del túnel carpiano?

El CTS tiene varias causas, aunque por lo general es una combinación de muchos factores, incluyendo:

• Una predisposición genética o el envejecimiento normal puede causar que la envoltura alrededor de los tendones de la muñeca se vuelva gruesa y pegajosa.

• Las tareas altamente repetitivas.

• El esfuerzo constante.

Changes to expect:

• • • For plan years beginning on and after January 1, 2014, employers should carefully evaluate arrangements under which they reimburse employees for premiums, or are otherwise involved in the purchase of individual health insurance policies that provide non-excepted medical coverage (i.e., coverage that is subject to health care reform’s mandates) for employees. These arrangements create significant compliance concerns under health care reform. Furthermore, these individual policies should not be paid for or reimbursed on a pre-tax basis under an employer's cafeteria plan. As described in more detail (left).

Caution for Individual Policy Reimbursement

The IRS uses a FAQ on Employer Health Care Arrangements to highlight

the potential liability for employers that, rather than establishing a group

health plan, merely reimburse employees for the cost of their individual

health plan premium.

Q1. What are the consequences to the employer if the employer does

not establish a health insurance plan for its own employees, but

reimburses those employees for premiums they pay for health

insurance (either through a qualified health plan in the Marketplace

or outside the Marketplace)?

The IRS makes it clear that the consequence is that the employer may face a

penalty.

Specifically, as explained in Notice 2013-54, employer reimbursement plans

are considered to be group health plans and therefore subject to the market

reforms, including the prohibition on annual limits for essential health

benefits and the requirement to provide certain preventive care without cost

sharing. Notice 2013-54 clarifies, however, that employer reimbursement

plans cannot be integrated with individual policies to satisfy the market

reforms.

Consequently, the employer may be subject to a $100/day excise tax per

applicable employee (which is $36,500 per year, per employee) under Code

Sec. 4980 D.

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
