New Law to Help Identify Subcontractors Bidding on Public Works Projects Took Effect

AB 44 to help identify all parties involved in public works project bids

SACRAMENTO — The Contractors State License Board (CSLB) is reminding licensees about a new requirement for bidding on public works projects that took effect July 1, 2014.

AB 44 (Buchanan, Chapter 258, Statutes of 2013) requires a contractor to include the contractor license number of each subcontractor listed in any bid or offer for the construction of any public work.

Currently, a prime contractor must only list the name and business location of each subcontractor performing work or rendering service to the prime contractor in an amount exceeding one-half of one percent of the contractor’s total bid.

As of July 1, 2014, the prime contractor must list the subcontractor’s CSLB license number on a bid on a public work project.

Supporters of the law say the name and business location is not always sufficient information to determine the exact identity of the subcontractor. That’s especially true In large urban areas where multiple contractors may have the same or very similar names, making differentiating between them difficult or impossible.

Including the subcontractor’s CSLB license number in the bid will allow awarding bodies to quickly and efficiently identify all the parties included.

While you can ‘rent’ almost any form of construction equipment, that convenience does not extend to contractor’s licenses. A new CSLB enforcement effort is underway in determining who is ‘buying’ into qualifying licenses. Who can and can’t bid on public works is now being sorted out with a new online effort…

Q: I am an attorney and I have a client with a competitor who seems to be “renting” a Responsible Managing Officer (RMO). This individual is neither a legitimate Officer, nor is he involved with this company. This person appears to be an “independent contractor” and is also listed on another corporation’s license as an RMO (I’m going to go out on a limb and take the assumption that he is not involved with this corporation either).

As you may know, B&P Code Section 7068.1(d) requires contractors who are on multiple licenses to submit “detailed information on the qualifying individual’s duties and responsibilities for supervision and control of the applicant’s construction operations.” Can you obtain a copy of what was submitted with regards to the RMO’s claims of supervision and control of the construction operations?

A: I looked up the license in question and it was issued back in 2001. The CSLB has only recently been getting tough on RMO abuses,

so it is unlikely that anything would have been submitted to describe the individual’s duties with regards to supervision and control of the company’s operations.

However, according to the CSLB’s Summer 2014 Newsletter, there has been a significant rise in complaints against license Qualifiers “suspected of acting as paid figureheads for a company, but exercise little to no control over its operations.” The CSLB has put a Task Force in place with the specific duty of watching for new applicants that apply for a waiver who are seeking to rent their qualification for a fee.

Also explained in the newsletter, a new law took effect January 2014 that is an addition to the Code Section you mentioned (7068.1) that “now authorizes the CSLB to discipline a Qualifier, and the licensed entity they are qualifying, when the Qualifier is not actively involved in the construction activities of the license they are representing. In addition to administrative penalties, the individual falsely serving as a Qualifier on the license can be charged with a misdemeanor and be sentenced to serve up to six months in jail, and be required to pay a fine from $3000 - $5000, or both, if convicted.”

I might suggest filing a complaint with the CSLB against the licensee. Since the Enforcement Unit has established a Task Force to specifically investigate these particular

complaints, they will likely be right on top of it. You can go to the CSLB’s website at www.cslb.ca.gov for more information on the complaint process.

Attention Public Works Contractors: A new online application system is available for those that must be registered with the Department of Industrial Relations (DIR) to verify that they are eligible to bid on California public works projects. With the new online system, public works contractors can create an account and complete the required forms. The new online system also allows agencies that oversee a public works project to search a database of all qualified contractors. For more information you can visit the DIR’s website at dir.ca.gov

The Legislature’s month-long summer recess

is almost at an end. They will resume ‘the

people’s work’ on Monday, August 4th. The

remainder of August is the final month of the

two-year session, which means that the activity

level ‘around the halls’ will heat up more than

the ambient temperature around ‘the building’

this time of year!

Thankfully, many of the ‘bad’ bills have died in

previous committees this past year. The next

major step for most of the remaining ‘bad’ (and

‘good’) bills for us is the Senate Appropriations

Committee which happens to meet on the

first day back, Monday, August 4th. It is my

intention to argue in the Senate Appropriations

Committee on that day that the costs to

government, should the remaining ‘bad’ bills

be approved, will far exceed the $50,000 cost

limit that requires each of them to be placed on

‘Suspense.’

As you may remember, both the Assembly and

Senate Appropriations Committee have a cap

on the cost of bills that can be approved out of

their respective committees. If the estimated

cost to government exceeds the cap amount,

the measure is placed on ‘Suspense.’ Then,

later in the month, there is a ‘behind the scenes’

discussion by the members of the committee

which determines the fate of all of the bills on

‘Suspense.’ Typically, the bills that ultimately

pass off of ‘Suspense’ do so because there

are political favors owed, are bills authored

by the leadership or the governor, or it is

determined that the bill is important enough to

public policy that it deserves to be moved out

of committee. Of course, typically with the

Democrats in control, it means the end to most

Republican bills that have made it thus far,

regardless of how important they are.

So for the ‘bad’ bills we are focusing on, the

hope is that the pressure that my colleagues

and I put on the committee members stressing

the negative effects they will have on society

should they be approved, will hold enough

sway to stop them ‘dead in their tracks!’ Time

will tell!!

If any of these ‘bad’ bills survive the

‘Suspense’ process, the next step in my efforts

will be on the Senate Floor. This is always an

interesting time. Think of the video footage

you’ve seen of the Stock Market on Wall

Street where everyone on the floor is jumping

up and day making price bids on stocks. A

similar scene occurs at the ‘gate’ to the Senate

Chambers (as well as the Assembly Chambers).

Lobbyists cannot legally go on the floor of

either house when the legislature is in. Instead,

we can only stand at the entrance to the

Chamber’s hallway (called ‘the gate’) which

is blocked with staffers (called sergeants)

allowing only legislative members and staff to

enter. For lobbyists, we can give the sergeant

a business card with a note written on the back

and request that it be given to the legislative

member whom we are trying to convince

should vote for or against a bill that is being

heard on the floor. It is an intense time that

heats up even more as the midnight on August

31st deadline nears.

OK, so that is the ‘good government’ legislative

process. One other thing I haven’t mentioned

is the ‘famous’ ‘gut and amend’ procedure

that happens frequently in the final month of

the legislative session. Let’s say one of the

‘bad’ bills I spoke of has been stopped on

‘Suspense.’ It looks like the ‘end of the line’

for that measure for the year, right? Not! What

often happens is a bill that has moved to the

floor suddenly is amended to reflect the exact

language that was in the bill you thought had

been killed on ‘Suspense!’ Consequently,

throughout the month of August, you end up

closely watching all amendments being made

to bills to ensure that one of the ‘bad’ bills

doesn’t suddenly ‘morph’ into a benign bill that

you weren’t previously watching. How can this

be done? It’s called ‘Rule Waivers.’

And as the session draws closer to the end,

amendments can ‘morph’ into a bill that is not

even in print yet! It is truly an amazing (and

scary) process.

Oh, and if your efforts to defeat a bill on the

floor aren’t successful, but it was amended

in the opposite house, then it has to go back

to its house of origin for a vote on their floor,

which gives you another ‘bite at the apple’ at

their chamber’s gate to send business cards to

the key members you believe can help you kill

(or conversely help obtain the approval) of a

measure. Horse trading takes on a whole new

meaning!!!

Little wonder I dread the return of the

Legislature from their summer recess! Stay

tuned! Next week I will discuss specific bills

in detail.

On life support just a few months ago,

California’s bullet train has been resuscitated.

Last week, demolition began in Fresno to

clear the way for the first stretch of track.

More significantly, private investors across the

country and abroad are expressing new interest

in bankrolling part of the $68 billion project.

The lawsuits that have stymied the plan aren’t

yet resolved, but a budget agreement brokered

by Gov. Jerry Brown that guarantees the San

Francisco-to-Los Angeles rail line its first

funding stream — one that leading economists

say could reach about three-quarters of a billion

dollars annually — has emerged as a “game

changer,” high-speed rail experts say.

Inking a deal that will send the project

hundreds of millions of dollars a year in fees

collected from polluters is the signal the private

sector was waiting for, according to formal

letters of interest the state received last month.

With only a fraction of the project’s funding

in hand, the state needs private investment for

about one-third of the final price tag to have

any hope of completing the rail line.

“The new funding gives us confidence that

as political leanings and priorities change, it

won’t be easy for the government to back out of

its end of the deal,” said Stephen Polechronis,

senior vice president of Los Angeles-

based AECOM, one of the world’s largest

engineering and construction firms. “We feel

we have a partner now.”

To be sure, the bullet train project is hardly

home free. Questions about the state’s ability to

obtain more construction funding — especially

from a skeptical Congress — avoid expensive

construction delays and operate the rail line

without heavy taxpayer subsidies still linger.

Rep. Kevin McCarthy, the incoming House

majority leader from Bakersfield, said in an

interview last week that he vows to do what he

can to kill the project. “If Sacramento looks to

Washington to pay for the train, that will never

happen,” he told the New York Times.

But it’s significant that Vinci Concessions,

a French company that’s considered a world

leader in developing highly technical high-

speed rail projects, is one of the nine companies

that eagerly wrote to California about the bullet

train last month. Several other firms that wrote

letters are based in Spain, also home to a state-

of-the-art system.

Before now, there’s been virtually no interest

from private companies because there was no

ongoing government commitment to fund the

line.

It’s too soon to know what kinds of investments

the authority will seek to leverage with its

new state funding. The state could ask private

companies to give loans that must be paid back

with interest, or it may seek financial support

from companies that could design, build,

operate and maintain portions of the rail line,

like the new Burbank-to-Palmdale segment the

authority’s board is set to consider next month.

Those kinds of public-private partnerships

are typical in Europe and Japan, where bullets

trains are commonplace.

“Developing the first high-speed rail corridor

in the United States is an extremely exciting

proposition,” said Sidney Florey, Vinci

Concessions’ director of North American

business development, whose company is

now building a bullet train between Tour and

Bordeaux in France. “If California makes the

right offer, anybody in this industry would be

interested.”

The budget deal Brown struck with Democratic

legislative leaders promises to send 25 percent

of the fees collected each year from polluters

under the state’s landmark “cap and trade” law

to the bullet train.

Last week, an all-female crew demolished the

first of many structures the state must clear to

make way for a 29-mile stretch of track in and

around Fresno. By 2017, that portion of the rail

line will stretch 130 miles and connect Madera

to Bakersfield. And in September, High-Speed

Rail Authority CEO Jeff Morales expects to

invite industry leaders to Sacramento for a

public discussion about how to finance the

system with their help.

“You can draw parallels between this funding

and the job you need to qualify for a mortgage

and buy a house,” Morales said. “In both

cases, a regular income stream unlocks the

opportunity to do financing.”

It’s difficult to predict how much the new state

funding will grow as California’s cap-and-trade

program kicks into gear, but some economists

say the project will get another $4 billion

through 2020, and the Legislative Analyst’s

Office forecasts it could climb close to $2

billion annually.

The value of stable, ongoing sources of funding

for huge infrastructure projects like the bullet

train is huge, said Lou Thompson, a veteran

rail expert and consultant who chairs an

independent group created by the Legislature

to evaluate high-speed rail funding plans.

“This money is much different and much

more important than one-time contributions,

no matter how large or who they’re from,”

Thompson said.

AECOM and others are still troubled by the

number of lawsuits filed against the authority

— 13 so far — but Polechronis said it’s

common for large infrastructure projects to

face litigation.

“I can’t say I like it, but I’m not surprised,” said

Polechronis, whose company has helped design

and build other high-profile public works

projects, including New York City’s Second

Avenue subway and London’s Crossrail, a new

high-frequency, high-capacity rail line.

In November, a Sacramento judge ruled that

the state rail agency had failed to comply with

Proposition 1A, the ballot measure voters

approved in 2008 that dedicates $9 billion in

bonds to the bullet train. The decision blocked

the state from spending any of that money

and threatened to cripple the project because

several billion dollars in federal funds were at

risk, too.

At Brown’s urging, state attorneys quickly

appealed the ruling, and a panel of appellate

division judges is expected to issue a decision

in late August, said H.D. Palmer, a spokesman

for the state Department of Finance.

Other lawsuits challenge the project’s

compliance with strict state environmental

rules and argue the rail line is a poor use of the

money generated by 2006 landmark legislation

that seeks to ease the effects of climate change

by taxing the worst polluters.

The timing of the cap-and-trade spending

agreement also helped the high-speed rail

agency protect $3.2 billion in federal funds it

needs to build the rail line.

Acknowledging the project’s legal woes, the

Federal Railroad Administration allowed

the authority to spend a chunk of the federal

money up front. But by the end of last month,

California was obligated to spend some of its

own money on the rail line, too, according to a

grant agreement.

Without the $250 million the authority is

getting this year through Brown’s budget deal,

and with the state bond money still stuck in

legal limbo, it might not have been possible for

the state to comply otherwise.

Opponents of the project dismissed the idea

that steady state budget allocations and

encouraging letters would make a difference to

the federal government or result in significant

private investment.

“They still have an 80 percent funding gap,

and cap-and-trade money will only supply

a fraction of that gap at best,” said Michael

Brady, a Bay Area attorney representing

several Kings Country residents who filed suit

to stop the project. “I don’t think it will work

at all.”

Environmental concerns conflict with pocketbooks in new survey

Californians want action to reduce air pollution

linked to global warming, but many of us just

don’t want to pay for it. Those are among the

findings of a new survey on environmental

attitudes from the Public Policy Institute of

California

Just over 60 percent of respondents said they

wanted the state to take steps “right way” to

curb greenhouse gas emissions. And more than

two-thirds back the state’s landmark law (AB-

32) that seeks to roll those emissions back to

1990 levels within the next six years.

But when asked whether oil companies should

be required to make gasoline that produces

fewer emissions — a key provision of AB-32

that takes effect next year — just 39 percent of

respondents statewide said they’d be willing to

pay more at the pump to make that happen.

COMPANIES TO MAKE GASOLINE THAT PRODUCES

FEWER GREENHOUSE GAS EMISSIONS IF THAT MEANS

HIGHER GAS PRICES?

The findings came from a telephone survey PPIC conducted with more

than 1,700 California adults from July 8 through July 15.

Another key provision in implementing AB-32 is requiring more of the

state’s electricity to come from renewable sources. In the survey, more

than three-quarters of respondents statewide supported efforts to get

one-third of the state’s power supply from renewables by 2020. But that

support falls to 46% if meeting that goal means having to pay higher

electricity bills.

The graph below shows how L.A. County compares with the Bay Area

on that question.

“Californians want to see government action to reduce greenhouse gas

emissions,” said PPIC president and CEO Mark Baldassare. “But their

strong support for clean energy policies diminishes if they have to pay

higher electricity bills or gas prices.”

Interestingly, AB-32 biggest achievement -- creation of a cap-and-trade

system to reduce emissions -- appears to have flown under the radar of

most respondents. Fifty-five percent said they’d heard “nothing at all”

about the program.

While just over half of respondents called climate change a threat to

California’s economy and quality of life, it tied for third as the most

important environmental issue facing California today.

More than a third named water supply and the drought the state’s top

environmental challenge.

West Nile Virus

West Nile Virus is a problem wherever there are mosquitos.

The disease is thought to be spread when a mosquito bites an infected bird and then a person. It can infect humans, birds, mosquitoes, horses and some other mammals.

While the West Nile Virus (WNV) is commonly found in Africa, West Asia, and the Middle East, it is currently believed to be a seasonal epidemic in North America from summer into the fall. It is also related to St. Louis encephalitis virus.

Symptoms of WNV:

• Fever • Headache • Muscle ache • Exhaustion • Skin rash • Swollen lymph glands • In severe cases, Encephalitis, which can be fatal When dealing with WNV, prevention is the best tactic.

• Avoid contact with mosquitos: ‒ Be aware of peak mosquito hours: dawn and dusk. ‒ Install or repair window and door screens. ‒ Use mosquito repellent. ‒ Wear clothing that can help reduce mosquito bites, i.e., long sleeved shirts,

socks and pants. • Prevent mosquito breeding:

− Eliminate standing water where mosquitos can lay eggs, e.g., old tires, bottles and buckets where water can collect.

‒ Clean out the mosquitos from places where you work and play. • Support community-based mosquito (vector) control programs.

West Nile Virus statistics:

• The chance of becoming ill from a single mosquito bite remains low. • The risk of severe illness and death is highest for people over 50 years old,

although people of all ages can become ill. • 80% of people infected with WNV will not show any symptoms at all. • Of the 20% who do exhibit symptoms, the chance of severe symptoms only occurs

in about one in 150 people. • Symptoms can last for weeks.

Virus del Nilo Occidental (VNO)

Virus del Nilo Occidental es un problema dondequiera que haya mosquitos.

Su propagación se cree que sucede cuando un mosquito pica a un ave infectada y luego a una persona. Puede infectar a humanos, aves, mosquitos, caballos y otros mamíferos. Mientras que el Virus del Nilo Occidental (VNO) se encuentra comúnmente en África, Asia Occidental y Medio Oriente, se cree actualmente que es una epidemia estacional en América del Norte del verano al otoño. Está relacionado con el virus de la encefalitis de San Luis. Síntomas del Virus del Nilo Occidental (VNO):

• Fiebre • Jaqueca • Dolor muscular • Fatiga extrema • Erupción cutánea • Glándulas linfáticas inflamadas • En casos severos, Encefalitis, lo que puede ser fatal.

SEEKING ESTIMATING ADMINISTRATOR

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
