On May 20, 2009, the Board of Education of the West Contra Costa Unified School District approved Resolution 90-0809. The resolution places the District under the Uniform Public Construction Cost Accounting Act. Under Section 22036/of the act, the District is inviting all licensed contractors to submit the name of their firm to the District for inclusion on its list of qualified bidders for the following calendar year (2015). Insurance Commissioner recommends lower pure premium rate than suggested by workers’ comp rating bureauInsurance Commissioner Dave Jones today adopted an advisory average pure premium rate of $2.74 per $100 of employer payroll for workers’ compensation rates effective January 1, 2015. The adopted amount is lower than that proposed by the Workers’ Compensation Insurance Rating Bureau of California (WCIRB). The WCIRB’s proposed advisory average rate was $2.77 per $100 of payroll. After a public hearing and careful review of the testimony and evidence submitted, the Department of Insurance recommended adoption of a pure premium rate amount lower than the WCIRB on the basis that a greater reduction in medical losses should be used in the actuarial model due to the anticipated savings from SB 863 (De León) signed in 2012. The WCIRB’s proposed advisory average pure

premium rate is 7.9 percent ($2.77 per $100 of payroll) above the industry’s average filed rates as of July 1, 2014 and the adopted pure premium rate ($2.74 per $100 of payroll) is 6.7 percent above the industry’s average filed rates as of July 1, 2014. Commissioner Jones, the WCIRB and the public members’ actuary all agree that the overall impact of SB 863 continues to result in savings for the workers’ compensation system. The California Department of Insurance continues to observe that medical and indemnity losses are outpacing wage growth and consequently, the average advisory pure premium will increase in 2015.

Local Revenue Measure Election Results

The November statewide election included over 400 local measures including 268 seeking approval for taxes or bonds. K-12 school districts and community colleges sought a total of $11.775 billion in 113 separate authorizations for bonds to construct facilities, acquire equipment, and make repairs and upgrades. There were just eight measures to increase or extend school parcel taxes. Final results show 80 percent of school bonds and 70 percent of city general taxes passed.

Among the 147 non-school local revenue measures, four measures were asking for a total of $555.5 million in bonds, including a $500 million transportation bond measure in San Francisco. There were 32 city, county and special district parcel taxes requiring two-thirds voter approval, including two library measures, three street/road improvement measures, four parks and open space measures, 16 fire, emergency medical response measures and five police/fire measures. Fifty-five proposals sought to extend or increase local sales taxes, ranging from the renewal of a 0.1 percent tax for the Fresno Zoo to a 1 percent increase proposed in 15 cities. Thirteen of the 55 sales tax measures earmark the tax proceeds for a particular purpose, making them special taxes requiring two-thirds voter approval under Proposition 13.

California’s new Legislature inexperienced but has more time to adjustThe Sacramento Bee report, like fire clearing an old growth forest, last week’s election elevated a class of freshman lawmakers who will join last cycle’s surge of first-term legislators to form one of the least experienced Legislatures in years.

later this year, a majority of lawmakers – 72 out of 120 – will arrive with at most two years of state-level experience. The critical mass of relative newcomers reflects a shift in California’s term limit rules with dual consequences: While the incoming class of lawmakers is sparse on state legislative experience, it could also remain largely intact for a decade.

“I think it’s probably the most profound change in the Legislature as an institution since term limits passed,” said David Lesher, director of government affairs at the Public Policy Institute of California.

Critics of California’s term limits have long warned of unintended consequences. Voters hoped to make the Legislature more accountable and to loosen the grip of long-serving politicians. But in the process, skeptics say, voters deprived their representatives of the experience and policy fluency that comes from years steeped in lawmaking.

“When the voters approved term limits they voted to limit the amount of experience the Legislature had,” said former Assembly Speaker John A. Pérez, D-Los Angeles. “Institutional memory is found outside of the building and the staff, which is not the best thing for democracy.”

It will take time to adjust, multiple newly elected members acknowledged in interviews with The Sacramento Bee. That process goes beyond learning the explicit mechanics of the Legislature.“It’s a combination of both the formal rules about introducing bills and referral of bills and voting and all those things, but there’s also the more informal ones about how deals

are brokered, and when you’re able to not vote with your party because of constituent concerns,” said Steve Boilard, a former Legislative Analyst’s Office staffer who is now the executive director of the Center for California Studies at California State University, Sacramento.

In the past, new members looked to their veteran colleagues to ease an initiation process that Kathy Dresslar, who was chief of staff to former Senate President Pro Tem Darrell Steinberg, D-Sacramento, likened to a “drink from the fire hose.” As term limits force those more seasoned members from the Legislature, Dresslar said, newer members are increasingly taking their cues from staff or from lobbyists.

“The new legislators today are still learning from the former members, but the former members are more likely to be lobbyists here in town,” Dresslar said. “So that perspective is passed down from the former members’ clients.”

Despite such concerns about a knowledge gap or power migrating to those who were not elected, people pointed to an upside. Elected officials, staffers and political experts expressed optimism about the time lawmakers will have to acquire expertise and shape sound policy.

Under California’s initial term limits scheme, lawmakers could serve a maximum of six years in the Assembly and eight years in the Senate. Now they can serve a total of 12 regardless of the house. That could mean less jostling for the next job and more time focusing on the issues.

“Now you have a large majority of these

lawmakers that don’t have the pressure of trying to move up to the Senate within six years and have the ability to focus on long-term work and long-term relationships,” said Rob Stutzman, a longtime Republican operative. “It allows more focus on good policy as opposed to intraparty politics.”

At a reception for new lawmakers this week, members of the incoming freshman class had a similar message. A new primary system allowing the top two vote-getters to advance regardless of party has ensured a more diverse class – “business, mod (moderate Democrats), labor,” said Republican-turned-Democrat Assemblyman-elect Bill Dodd, D-Napa – that could be largely intact for years.

“Whatever downside there is for having so many relatively new Sacramento legislators, in time you’re going to see a lot of seasoned professionals that are really knowledgeable in many, many policy areas,” Dodd said. “There’s kind of the beginning, the middle and the end, but it gets better every year.”

Committee chairmanships offer a prime opportunity to cultivate policy authority. In the pre-term-limits era, Dresslar said, “members chaired the same committee for years, and they cared deeply about it and were very personally invested in the policy portfolio of those committees.”Assembly members limited to six years “didn’t take ownership of the policies coming out of that committee because they were just passing through,” Dresslar said. Now, with members potentially having a decade on a given committee, “this will give people an opportunity to sit back, learn,” Dresslar said. “I think that’s actually a change for the better.”

In addition to longer tenures sharpening policy acumen, it could also alter the dynamics between legislators. Deals and compromises might be more likely to endure.

“The coin of the realm (before term limits) was your reputation and your integrity. If you made a commitment and you reneged on it, people would know that for however long you were going to be there,” said Bill Wong, who worked in the state Capitol for over two decades, most recently as chief of staff to Assemblyman Anthony Rendon, D-Lakewood. “With longer terms, people are going to think very long and hard before they renege on an agreement.”

On the horizon is a leadership transition that could shape policy emanating from Sacramento for a decade. Assembly Speaker Toni Atkins, D-San Diego, has only two years

before she has exhausted her allotted time. Her successor – a topic already prompting whispered speculation – could be setting the agenda of Assembly Democrats for eight to 10 years.

“The anticipation is there will be a long-term speakership after Atkins,” Stutzman said. “Personally I think that’s a good thing as well – my observation is that a strong speaker is better for the chamber and better for the Legislature.”

While new members learn the ropes and mull their next leader, they will be serving under a governor who embodies experience. Just re-elected to an unprecedented fourth term, Gov. Jerry Brown could be in a position to outmaneuver members who are state politics neophytes.“So much of politics is negotiation, it is

appealing to the public, and those kinds of things come with experience. Jerry Brown has an awful lot more experience than the average member of the Legislature,” Boilard said. “So there’s an imbalance of power there that gives an edge to the executive.”

Taking the long view, Assemblyman-elect Kevin McCarty, D-Sacramento, envisioned a different outcome.

“I think the bigger picture is members, myself, people will have more patience to focus on issues knowing you really have years to achieve something,” McCarty said. “I think you have greater opportunity to change the balance of power back to the Legislature away from the third house and the administration, with members really digging in.”

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

It might have been ‘either/or’ for our

first contractor who will learn it’s really

‘neither/nor’ in his ‘General’ answer. An

aspiring contractor discovers if his degree is

experience enough for a license. We ‘renew’

the hopes of a contractor leaving the state

that his license will ‘travel’ with him…

Q: I currently have a “B” General Building

license and I just hired a new employee that

has an “A” General Engineering license. We

want to form a new entity, in which I will be the

majority owner. We specialize in concrete work,

mainly driveways. Would you suggest that we

use my “B” qualification for the new license or

his “A” qualification?

A: Actually neither. If you are only doing

driveways you would want to apply for a “C-8”

Concrete license. There are a few classifications

in which you can request a Waiver of the Trade

exam based on the current classification that you

hold, and the “C-8” is closely related to both the

General licenses, so either of you could apply to

add that to your license and once added, apply

for the new entity’s license. Let me know if

you’d like assistance with this two-step process.

Q: My son recently graduated from college with

a degree in Construction Management and he

eventually wants to take over my construction

company. He worked for me while attending

school but not full time. How much credit does

the CSLB give him for his degree?

A: The CSLB may grant up to three years of

work experience toward the four years that

are required. How much time they credit your

son will depend on the course work he took,

so he will be required to submit official sealed

transcripts.

Since his degree is in the construction field, I

would suggest that your son be prepared to show

at least two years of practical experience in

addition to his four year degree.

Q: I am moving to Nevada at the beginning

of the year and I plan on applying to get my

contractor’s license. I have been licensed in

California for over twenty years but the license

expires on November 30th. I want to use my

CA license to apply for Reciprocity but I don’t

want to pay the renewal fee since I won’t be

using it any longer. Will the couple month lapse

disqualify me for Reciprocity? Also, I noticed

that Nevada has a “B” and a “B-2” license;

what’s the difference?

A: The rule between California and Nevada

with regards to Reciprocity is that you have to

have been actively licensed for five out of the

last seven years and you have to have passed the

equivalent trade exam. So no, a couple month

lapse shouldn’t affect your ability to qualify.

Regarding your second question, the “B”

classification in Nevada is equivalent to

California’s General Building classification.

The only difference in the “B-2” is that it limits

you to structures under three stories. In order

to qualify for the full “B” you have to have

experience doing work on structures over three

stories in height.

Electrical Safety—Power Strips

A power strip combines several sockets attached to the end of a flexible cable, allowing multiple devices to be plugged in. The biggest safety concern with power strips is their potential for fire if overloaded.

Precautions for fire prevention:

• Do not plug power strips into other power strips to make what is sometimes called a “piggy back” or “daisy chain.”

• Only use power strips that have a built-in surge protector (i.e., voltage regulator) and preferably also a built-in circuit breaker to prevent circuit overload.

• Do not use power strips for appliances with heating elements, such as electric space heaters or bench-top cooking appliances.

• Assure that all power strips meet recognized testing requirements. Although Underwriters Laboratories (UL) is the most recognizable label, there are many other testing laboratories that test and label electrical equipment.

• Do not plug power strips into extension cords; plug them directly into wall sockets. Extension cords are not to be used for permanent applications.

• A heavy reliance on power strips is an indication that you have too few outlets to address your needs. Have additional outlets professionally installed.

Determining power strip capacity:

Know the capacity of the circuit and the power requirements of all electrical items plugged into the power strip and other outlets on the circuit. In order to determine this:

• Determine the capacity of your power strip (in amps or watts).

• Determine the load (i.e. power requirements) of all the electrical items plugged into the power strip in amps or watts.

• Add up the power requirements. Assure that the total does not exceed 80% of the rated capacity of your power strip. Also, determine the same for the circuit serving the power strip to assure that it is not overloaded.

Example: A power strip is rated for 15 amps/120 V. (Note that watts = amps x volts.)

15 amps x 120 volts = 1875 watts.

1875 watts x 80% = 1500 watts that may be used.

The power strip’s capacity of 1500 watts is not exceeded.

Seguridad eléctrica—Múltiples

Un múltiple combina varios enchufes adheridos a un cable flexible para permitir que se enchufen múltiples dispositivos. El mayor peligro relacionado con la seguridad es la posibilidad de provocar un incendio por sobrecarga.

Precauciones para evitar incendios:

• No enchufe múltiples a otro, es decir, “a cuestas” o “en cadena”.

• Use sólo los múltiples que cuentan con un protector de subida de voltaje incorporado (regulador de voltaje). El múltiple también debe tener un interruptor de corriente incorporado para evitar la sobrecarga del circuito.

• No use un múltiple con aparatos que posean elementos calefactores, tales como calefactores eléctricos o aparatos de mesa para cocinar.

• Verifique que todos los múltiples cumplan con los requisitos de prueba reconocidos. Aunque Underwriters Laboratories (UL por sus siglas en inglés) es la etiqueta más reconocida, hay muchos otros laboratorios de prueba que examinan y etiquetan los equipos eléctricos.

• No enchufe los múltiples en un alargador; debe enchufarse directamente a un tomacorriente en la pared. Los alargadores no deben utilizarse para aplicaciones permanentes.

• Un uso copioso del múltiple significa que no tiene una cantidad de tomacorrientes suficiente para sus necesidades. Recurra a un profesional para que instale tomacorrientes adicionales.

Para determinar la capacidad del múltiple:

Conozca la capacidad del circuito y los requerimientos de energía de todos los aparatos eléctricos conectados al múltiple y otros tomacorrientes en el circuito. Con el fin de determinar esto:

• Determine la capacidad de su múltiple (en amperios o vatios).

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.

Alten Construction Inc., a Bay Area based General Contractor is seeking a Project Manager for public works projects emphasis on school DSA projects in the $3 million to $50 million range.

Responsibilities for this position include the following: • Manages project cost and schedule and forecasts labor,

material & equipment on a monthly basis• Supervise all construction activities of assigned projects

from start to finish. • Develop a baseline schedule and maintaining the construc-

tion schedule throughout the project. • Administrates all aspects of the subcontracting process• Produce and submit the following documents accurately:

RFI’s, RFI Log, Change Orders • Assist in reviewing shop-drawing submittals from subcon-

tractors. • Supervise superintendents, subcontractors, and vendors to

ensure quality control and project compliance.• Resolve problems as they arise from the plans and specifica-

tions, unknown existing conditions, conflicts, with Archi-tects, Engineers, Designers, Subcontractors and/or Vendors.

• Effectively and efficiently manage the completion of all punch lists.

• Ensure that all construction work performed is of the high-est quality.

• Research materials, means, and methods for projects.• Develops business and client relationships• Provides direction, oversees, and works effectively with

Project Engineers and Project Coordinator.

Requirements:• Bachelor’s degree in Construction Management.• Minimum 10 years experience in a Project Management

role on public works construction projects. RESIDENTIAL DOES NOT QUALIFY

• Provides leadership in training Superintendents and Field Crews on Alten Construction procedures, construction and safety methods.

• Working knowledge of all phases of construction and subcontractors.

• Prepares and updates Precon and Construction Master Schedules.

• Proficient at reading plans and specifications for all trades. • Proficient in Microsoft Excel, Word, Outlook, Microsoft

Project, Primavera P3 and Expedition.• Strong organizational skills, ability to prioritize work as-

signments, and extreme attention to detail.• Excellent written and oral communication skills. • Excellent leadership and motivational skills• Must live in the Bay Area. • Valid Driver’s License

Dutra is currently looking for an Estimating Administrator. This position supports the Estimating Department. Successful applicant will be re-sponsible for distributing, organizing and maintaining bidding documents such as plans, specifications, addenda and quotes. Will also work to support the Chief Estimator and Proposal and Contracts Manager in preparing estimates, proposals, Statement of Qualifications and marketing materials. Additionally, will assist the Contract Administrator with bonds, contracts and tracking SBE participation.

ESSENTIAL DUTIES AND RESPONSIBILITIES:• Distribute, organize and maintain bidding documents including printing, copying, filing and tracking distribution.• Assist in the preparation of estimates, proposals, SOQs and marketing materials.• Assist in the preparation of contract documents, bond requests and Small Business Enterprise (SBE) requirements and goals.• Keep accurate records of SBE participation. Ensure company is compliant with SBE regulations.• Maintain detailed and organized files on future, current and past projects.• Prepare reports, maintain estimating schedule and track contract deadlines.• Identify and track bidding opportunities.
