EX10.1 CITY OF TORONTOTo construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on , (Mimico Creek - Meadowvale Drive to Meadowcrest Road - near Islington Avenue and Bloor Street), in the City of Toronto (Etobicoke York Community Council Area), Mimico Creek Watershed as located on property owned the by City of Toronto. The purpose is to undertake immediate stabilization of Mimico Creek to protect private property and sewer infrastructure. A Fisheries and Oceans Canada (DFO) Letter of Advice will be prepared by TRCA staff for this project. 46

The purpose is to site grade and construct within the Regulated Area of the Humber River Watershed to facilitate the development of a commercial block within an approved Plan of Subdivision, which is associated with a municipal site plan application. 54

The purpose is to construct a replacement wooden deck approximately 35' x 9'10" to the rear of an existing dwelling within TRCA's Regulated Area of the Don River Watershed. 64

EX10.10 LADIES GOLF CLUB OF TORONTOTo construct, reconstruct, erect or place a building or structure and alter a watercourse on , (7859 Yonge Street), in the City of Markham, Don River Watershed as located on the property owned by Ladies Golf Club of Toronto. The purpose is to undertake works within a TRCA Regulated Area of the Don River Watershed in order to facilitate the repair of five erosion areas along the north and south banks of the East Don River and adjacent to the north limits of the 17th fairway of Ladies Golf Club of Toronto. 66

EX10.11 45 GLENBOURNE PARK DRIVETo construct, reconstruct, erect or place a building or structure and site grade on Lot 7, Plan 6037, (45 Glenbourne Park Drive), in the City of Markham, Rouge River Watershed. The purpose is to undertake works within TRCA's Regulated Area of the Rouge River Watershed in order to permit the demolition of an existing single family dwelling and construct a new two-storey single family dwelling associated with a municipal building permit. 68

The purpose is to undertake works within a TRCA Regulated Area of the Etobicoke Creek Watershed in order to facilitate the construction of a 9.04 m x 3.15 m (29.66 ft. x 10.33 ft.) one storey addition and a 5.84 m x 3.12 m (19.16 ft x 10.24 ft.) wood deck located at the rear of an existing residential dwelling associated with a municipal building permit. 70

EX10.13 BLACK MARLIN MANAGEMENT LTD.To construct, reconstruct, erect or place a building or structure and change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units on Lot 9, Plan 2467, (3277 Bloor Street West), in the City of Toronto (Etobicoke York Community Council Area), Mimico Creek Watershed as located on the property owned by Black Marlin Management Ltd.. The purpose is to construct a partial second storey addition to the rear of the existing 1 1/2 storey commercial building at 3277 Bloor Street West in the City of Toronto (Etobicoke York). 72

EX10.20 67 ROXBOROUGH DRIVETo construct, reconstruct, erect or place a building or structure and site grade on Lot J, K, Plan 928, (67 Roxborough Drive), in the City of Toronto (Toronto and East York Community Council Area), Don River Watershed. The purpose is to extend the existing cantilevered deck and reconstruct the existing stone patio, retaining wall, and stairs to the rear of the two-storey single family detached dwelling at 67 Roxborough Drive in the City of Toronto (Toronto and East York). 85

EX10.22 CONECO ENVIRONMENTAL CONSTRUCTIONTo site grade on Lot 17, Concession 8, (9500 Highway 27), in the City of Vaughan, Humber River Watershed as located on the property owned by Coneco Environmental Construction. The purpose is to conduct grading works within a Regulated Area of the Humber River watershed at 9500 Highway 27 in the City of Vaughan. 89

EX10.23 14 ARNOLD AVENUETo construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 4, Plan 65R-34217, PART 4, (14 Arnold Avenue), in the City of Vaughan, Don River Watershed. The purpose is to construct a replacement dwelling and conduct associated minor grading works within a Regulated Area of the Don River watershed at 14 Arnold Avenue in the City of Vaughan. 91

EX10.24 REGIONAL MUNICIPALITY OF YORKTo construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Black Creek crossing under Highway 7 on the east side of Jane Street, in the City of Vaughan, Humber River Watershed as located on the property owned by Regional Municipality of York. The purpose is to undertake widening of Highway 7 and installation of a retaining wall at the south end of the culvert which crosses Highway 7, east of Jane Street. The works are being completed as part of the Highway 7 widening for vivaNEXT program to accommodate a dedicated bus Rapidway. A Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO) and the Ministry of Natural Resources (MNR) warm-water fisheries timing window will be applied to the works unless otherwise specified in writing by MNR. 93

The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the removal of excess sediment to rehabilitate an off-line pond at 16290 Centreville Creek Road, in the Town of Caledon. 101

EX10.30 MAIDENSTONE DEVELOPMENTS INC.To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 4, Concession 9, 12792 Regional Road 27, in the Township of King, Humber River Watershed as located on the property owned by Maidenstone Developments Inc. The purpose is to conduct site grading and alter a watercourse in order to install a culvert crossing and sanitary crossing of a tributary of the Humber River, which will facilitate the development of the Maidenstone residential subdivision, in Nobleton, Township of King. 105

EX10.31 4700 KING ROADTo temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Part Lot 6, Concession 7, Plan 65R14558, PART 1, (4700 King Road), in the Township of King, Humber River Watershed. The purpose is to allow development and the alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate driveway repairs and upgrades at 4700 King Road in the Township of King. The works were started without the approval of the TRCA. 107

The purpose is to reconstruct the intersection of Derry Road and Goreway Drive, in the City of Mississauga. A 300 mm diameter watermain will also be replaced while the area is disturbed. RATIONALEThe subject property falls within TRCA’s approved master plan for acquisition for the Duffins Creek watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of a subdivision for a proposed residential development of this site, TRCA staff established the limits of the open space lands (i.e. block 132 on draft plan) which is comprised of undisturbed forest. The subject property is also part of the Duffin Heights Community.

TAXES AND MAINTENANCEBased on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the Provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2014 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

Through the review of residential subdivision 21T-12001C, TRCA staff established the limits of the open space lands (i.e. Blocks 415, 416 and 417 on Draft Plan of Subdivision) which are situated partially within the regulated area and Regional Storm Flood Plain of a headwater tributary of the Etobicoke Creek (i.e. Block 415) as well as the main valley corridor of the Etobicoke Creek (i.e. Block 416) at this location. Upon acquisition, access to the lands to be acquired will be achieved directly through the internal road system of the subdivision (i.e. for Blocks 415 and 417) and via adjacent TRCA-owned property (i.e. for Block 416).

Correspondence via electronic mail (E-mail) was received from Mr. Brent McKee, expressing an interest in purchasing a fragment of TRCA-owned property located adjacent to 163 Thistledown Boulevard in the City of Toronto. A copy of the E-mail from Mr. McKee is included in Attachment 1; a plan indicating the area of TRCA property subject to this request is shown in Attachment 2.

Portions of the subject TRCA property are situated within the Regulated Area, Regional Storm flood plain and valley corridor of the Humber River at this location.

In accordance with TRCA policy, property staff circulated a description of the lands requested for disposal to TRCA technical staff and City of Toronto staff for review and comment. Staff reported back to the Executive Committee at Meeting #1/13, held on March 1, 2013 on the comments received as follows:

City of Toronto Staff CommentsThe TRCA property adjacent to 163 Thistle Down Boulevard is used by Parks, Recreation & Forestry (PF&R) staff for access to the Humber River valley for general maintenance and valley restoration projects. It is also the only access point to the existing trail located on the valley floor on this side of the river through this reach. Therefore, it is recommended that this property remain in public ownership.

TRCA Staff Comments TRCA staff agrees with City of Toronto staff comments, recommending that the subject TRCA-owned lands be retained in public ownership in order to provide PF&R staff access to the valley. TRCA lands are maintained by the City on behalf of TRCA under the existing management agreement.

At Executive Committee Meeting #1/13, staff recommended that the subject parcel be retained by TRCA for conservation purposes. However, due to the fact that the rear portion of 163 Thistledown Boulevard is situated within the Regional Storm flood plain and there may be an opportunity for a land exchange, the Executive Committee adopted Resolution #B4/13 as follows:

THAT item EX7.3 - Request for Disposal of Toronto and Region Conservation Authority-owned Land adjacent to 163 Thistledown Boulevard, Toronto, be referred to staff for further consideration.

Staff has explored the potential for an exchange of lands which would effectively bring into TRCA ownership the flood plain portion of land located at the rear of 163 Thistledown Boulevard in exchange for a fragment of TRCA-owned land situated outside the flood plain along the north side of Mr. McKee's residential lot. Staff discussed the possibility of a land exchange with City of Toronto PF&R staff, who manage these TRCA lands pursuant to the existing management agreement, and TRCA Planning and Development Division staff.

Although opposed to the original request for disposal, PF&R staff has considered the possibility of a land exchange and has reported that Parks Operations staff rarely use this access as an entrance into the valley for their service vehicles and do not object to narrowing the access route. PF&R staff also indicated that utility pipelines (i.e. oil and gas) exist on the valley floor and cautioned that narrowing the access route may be opposed by the utility companies since this may be used as an emergency access point. Staff contacted Enbridge Pipelines Inc. which manages and maintains the oil and gas utilities located within the valley. Following several discussions with Enbridge staff and a site visit, Enbridge Pipelines Inc. has indicated that it does not object to the narrowing of this valley access as other access points to the valley exist in the vicinity for emergency or routine pipeline inspection.

Similarly, TRCA Planning and Development staff is receptive to a proposed land exchange as this would bring the flood susceptible portion of 163 Thistledown Boulevard into public ownership. Only a fragment of TRCA land situated outside the Regional Storm flood plain would be exchanged as part of the proposal.

A plan illustrating the location of the subject land exchange is outlined in Attachment 3.

My wife and I live at 163 Thistle Down Blvd and side onto the emergency access to the ravine. The access‐way is no longer used as an emergency entranceway, the land use has changed to a multiuse pathway access point.  I am interested in purchasing some of the property that I side on to. I realize the TRCA is not in the business of selling property, however my wife and I are currently doing some property improvements.  We have a pinch point at the side of the house and the fence line making is difficult to access our garage (2.3M) and would be interested in purchasing 2 – 3 M along the fence line. This would allow better access to the back of the property (driveway side).  We would even consider a land swap; some of the property at the back of our property for some of the TRCA property at the side. Is this a viable option? We’d look forward to hearing from you to discuss this option.  Thank you,  Brent McKee

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Bill and Gillian Smillie to sell a small fragment of TRCA-owned land to resolve a long standing encroachment, located adjacent to 269 King Street East - Bolton, Town of Caledon, Regional Municipality of Peel;

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to complete a sale to Mr. and Mrs. Smillie in this instance;

THEREFORE LET IT BE RESOLVED THAT a small fragment of TRCA-owned land containing 0.009 hectares (0.022 acres), more or less, be sold to Mr. and Mrs. Smillie, said land being Part of Lot G, Block 1, Plan BOL-7, shown as a portion of Part 3 on Plan 43R-13764, located north of King Street East, east of Old King Road (rear of 269 King Street East - Bolton), Town of Caledon, Regional Municipality of Peel, Humber River watershed;

THAT TRCA complete the sale of the subject land on the following terms and conditions:

(a) the sale price is to be the sum of $65.00 per square metre based on the area of the property as certified by an Ontario Land Surveyor (i.e. 90 square metres x $65.00 = $5,850.00);

(b) the completion of this sale will be subject to any Planning Act approvals that may be required to sever the lands to be sold;

(c) Mr. and Mrs. Smillie are to pay all legal, survey and other costs, including any fees required for municipal approvals (such as consent to sever / minor variance applications, rezoning, Site Plan Control application, etc.) as deemed necessary by the Town of Caledon;

BACKGROUNDAt Executive Committee Meeting #8/09, held on October 9, 2009, Resolution #B136/09 was approved as follows:

THAT the potential disposal of a fragment of land located north of King Street East, east of Old King Road (269 King Street East - Bolton), Town of Caledon, Regional Municipality of Peel, be referred to Toronto and Region Conservation Authority (TRCA) staff for review and discussion in accordance with established TRCA policies;

AND FURTHER THAT a report be brought forward to the Executive Committee at a future date recommending further action.

During a routine property inspection by staff in the spring of 2009, it appeared that Mr. and Mrs. Smillie's house was encroaching on TRCA-owned land. Staff commissioned a survey of the property boundary which confirmed that part of a two storey addition, wooden deck / platform, as well as a post and wire fence is, in fact, encroaching on TRCA property. As a result, a letter has been received from Mr. and Mrs. Smillie, indicating their interest in purchasing the subject land to resolve the encroachment. Mr. and Mrs. Smillie purchased their home at 269 King Street East on April 28, 2000. This private residential property borders on TRCA property to the north and to the west.

The subject lands form part of a larger acreage acquired from David and Elizabeth Underhill on September 16, 1986, under the Humber River Flood Plain Lands Component of the Acquisition Project.

In the years following TRCA's acquisition of the adjacent property and preceding the Smillie purchase, the dwelling at 269 King Street East, Bolton, was reconstructed and/or expanded, causing the current encroachment.

In accordance with TRCA policy, the following comments have been received from TRCA, Town of Caledon and Regional Municipality of Peel staff.

TRCA staffThe subject property is located entirely within the valley corridor of the Humber River. The existing house site is located on a raised knoll, above the valley floor and the Regional Storm flood plain; the steeper portion of the valley slope is located immediately north of the dwelling. TRCA's Valley and Stream Corridor Management Program (VSCMP) policies do not support new development within valley corridors.

However, Section 4.2 - Existing Development of the VSCMP states:

Within the Authority's jurisdiction, development has historically occurred within valley and stream corridors. This development has occurred in isolation (i.e. single structures) in low concentration (i.e. small groups of development or strip development along a valley wall), and in some instances settled communities or highly urbanized areas have been established.

This includes:- development at risk from natural hazards associated with flooding, erosion or

slope instability, including residential, industrial, commercial and recreational uses;

- resource-based/commercial enterprise(s) such as golf courses and tree nursery operations.

The Program recognizes that where development has occurred within valley and stream corridors, increased flexibility for valleyland management is required. To this end, the Authority's policies and criteria for existing development within these areas permit higher levels of risk associated with flooding, erosion and slope instability, and recognize that environmental rehabilitation is more limited. Inherent in these policies is the objective to minimize, reduce or eliminate these risks and also achieve environmental protection and rehabilitation to the fullest extent possible.

The application of these policies will also have regard to the characteristics of the adjacent corridor reach; therefore, opportunities for development and redevelopment of any site will be consistent with, and dependant upon, the extent and nature of existing development on the subject site and with development patterns within the corridor reach as a whole.

Planning and Development staff has confirmed that there are no erosion / slope stability concerns at the potential sale site. This historically developed area of Bolton reflects the VSCMP policies for existing development as noted above and it is noted that the disposal does not include any further development at this site with the exception of relocating the existing rear yard fence which also presently encroaches on TRCA land.

Therefore, it is recommended that only the minimum area of TRCA property needed to resolve the encroachment be sold so that a full backyard setback of 7.5 metres is not created behind the existing dwelling. In addition, any proposed work (e.g. fence relocation) is subject to approval pursuant to Ontario Regulation 166/06.

Town of Caledon staffTown of Caledon staff has no objections to the sale of TRCA land in order to resolve the encroachment.

Region of Peel staffStaff of the Regional Municipality of Peel have no concerns regarding the proposed sale of land to resolve the encroachment on TRCA property behind 269 King Street East, Bolton, and does not require the reservation of any easements at this location.

At Executive Committee Meeting #5/10, held on July 9, 2010, Resolution #B69/10 was approved as follows:

THAT a parcel of Toronto and Region Conservation Authority (TRCA) land consisting of 0.001 hectares (0.003 acres), more or less, being Part of Lot G, Block 1, Plan BOL-7, shown as a portion of Part 3 on Plan 43R-13764, located north of King Street East, east of Old King Road (rear of 269 King Street East - Bolton), Town of Caledon, Regional Municipality of Peel, Humber River watershed be declared surplus to the requirements of TRCA;

THAT staff enter into negotiations with Bill and Gillian Smillie, owner's of 269 King Street East, Bolton, for the sale of a parcel of TRCA land to resolve the long standing encroachment on TRCA property;

AND FURTHER THAT a report be brought forward to the Executive Committee at afuture date with the results of the negotiations.

As directed by Executive Committee Resolution #B69/10, staff commenced negotiations with Mr. and Mrs. Smillie. Following several discussions and a meeting with the Smillie's, a negotiated agreement was reached to sell a two metre wide strip of TRCA land across the entire width of the Smillie property in order to contain the encroaching portion of their existing home and to provide a straight, common property boundary for a new fence.

Originally, staff envisioned only selling that portion of TRCA property around the immediate perimeter of the structural encroachment (i.e. the rear side of the structure protruding into TRCA land) which would have resulted in an area of 0.001 hectares, more or less. However, during discussions and negotiations, the owner requested a wide enough area along the rear of the home to not only remove the existing encroachment, but also to allow a reasonable space for walking, provide enough room to perform any future repairs / maintenance on the rear side of the existing house and to allow for a straight lot line for a new common property boundary. Planning and Development staff were consulted regarding the sale of a slightly larger area of 0.009 hectares (i.e. a two metre wide strip), more or less, for this purpose and have agreed to this enlargement.

A map showing the location of the subject property is included in Attachment 1. Attachment 2 is a partial print of the survey showing the full extent of the encroachment on TRCA property.

FINANCIAL DETAILSIn an attempt to contain the costs to the homeowner and establish a standard rate TRCA-wide, TRCA staff has undertaken an in-depth analysis of past sales to resolve similar encroachments on TRCA lands throughout its jurisdiction and established a rate of $65.00 per square metre.

Staff feel that the subject structural encroachment in this instance is similar in nature to previous sales and are recommending that the established rate of $65.00 per square metre be utilized in this case.

It is proposed that the proceeds from this sale be used to acquire high priority lands under the Greenlands Acquisition Project For 2011-2015.

RECOMMENDATION

THAT Toronto and Region Conservation Authority (TRCA) enter into a management agreement with the Oak Ridges Moraine Land Trust (ORMLT) to operate and manage the Ken Purvis Nature Reserve, being Part of Lot 6, Concession 7, containing 6.88 hectares (17 acres), located in the Township of Uxbridge, Regional Municipality of Durham;

THAT the agreement be based substantially on the principles set out in this staff report dated September 16th, 2013;

THAT the final terms and conditions of the agreement be satisfactory to TRCA staff and solicitors;

AND FURTHER THAT the authorized TRCA officials be directed to take whatever actions may be required to give effect thereto including obtaining the needed approvals and signing and execution of documents.

BACKGROUNDThe ORMLT has secured over 3,477 acres of land throughout the 160 kilometres of the Oak Ridges Moraine (ORM), from just east of Mono Mills at the Niagara Escarpment to Castleton, northeast of Cobourg for conservation purposes. Currently, six properties are held in direct ownership of the ORMLT. ORMLT has approached TRCA to manage the Ken Purvis Nature Reserve that was donated through the Ecological Gifts Program offered by Environment Canada.

The Ken Purvis Nature Reserve is 6.88 hectares (17 acres) in size and is designated as Natural Core Area under the Oak Ridges Moraine Conservation Plan. ORMLT has agreed to enter into a management agreement with TRCA for a period of 25 years, with a 25 year extension option.

The parcel is currently improved with two wooden cabins, that are to be demolished by TRCA upon or after execution of the proposed management agreement.

The subject property falls within the criteria for acquisition under the Greenlands Acquisition Project for 2011-2015.

General Terms and Conditions of the Management Agreement The following are the key terms and conditions of the management agreement:

Development and operation of the Ken Purvis Nature Reserve will be in accordance with the 1."Purvis Nature Reserve Management Plan", prepared and approved by ORMLT, as integrated with the "East Duffins Headwaters Management Plan", prepared and approved by TRCA. The costs to develop and operate the Ken Purvis Nature Reserve will be borne by TRCA. 2.Staff feel that it is reasonable to assume these costs to achieve a trail connection. Any proposed developments on the Ken Purvis Nature Reserve must be approved by 3.ORMLT in writing. The initial term of the agreement will be 25 years, subject to a 25 year extension option.4.Either ORMLT or TRCA may terminate the management agreement upon delivery of one 5.year's written notice to the other.

RATIONALEEntering into the management agreement would allow for a connection between TRCA's East Duffins Headwaters Trail located to the south of the subject property and a proposed Buzek Lane trail connection to the northeast of the subject property.

FINANCIAL DETAILSAs noted, TRCA will bear the cost to demolish the existing site improvements, as well as to establish and maintain a trail connection. The costs for demolition is available in the operating budget. The cost for trail construction will be provided by the Durham Trails capital account from the Region of Durham. Legal costs related to agreement negotiations are provided for in the TRCA land acquisition capital account from TRCA's municipal partners.

BACKGROUNDTRCA, in partnership with the Region of York and the Town of Richmond Hill, is implementing the ORCCR East Spine Trail Project. This trail represents a key piece of trail infrastructure in helping to achieve many of the trail planning and sustainable transportation objectives of the Regional Municipality of York, the Town of Richmond Hill, TRCA and the Oak Ridges Trail Association.

The construction of the trail is a component of the ORCCR East management plan that was approved by Resolution #A180/11 at Authority Meeting #8/11, held on September 30, 2011.

The construction of this trail is proposed to occur in two phases, with Phase 1 comprising construction of 3.1 kilometres of trail running south from Bethesda Sideroad, and Phase 2 constructing the remaining 2.4 kilometres of trail southwesterly to connect to Bayview Avenue. Construction of Phase 1 is scheduled for construction in 2013 with Phase 2 to follow in 2014.

The trail construction budget is estimated at $600,000 for Phase 1 (2013) and $750,000 for Phase 2 (2014) works.

Proposal:The City of Toronto is proposing to undertake interim stabilization works to two segments of Mimico Creek that have been actively eroded and degraded as a result of the July 8, 2013 storm event. Works are to take place at the location of two utility crossing's of the creek, one at Orchard Crescent, the second north of Van Dusen Drive. All channel reconstruction works are to be completed based on the design and construction mitigation principals completed in 2006 for the Van Dusen site. Works at the Orchard Crescent site will consist of repairs to the existing steel sanitary sewer within a deteriorated concrete encasement and repair to a broken and exposed watermain. The deteriorated concrete encasement will be re-established and the creek bed will be raised over the exposed infrastructure through the construction of two weirs. A temporary access route will be established from the eastern bank through the existing parkette to Orchard Crescent. Works at the Van Dusen site will consist of the reconstruction of the channel, immediately north of the existing pedestrian bridge, including the existing erosion protection structures. The river bed will be constructed with two weir structures opposed to the three that were previously constructed. This will allow for additional options to raise the creek bed in the future. The new weir structures are to be reinforced weirs. Access to this site will be gained through an existing informal trail from Van Dusen Drive. A potential third work site is to be located between Orchard Crescent and Meadow Crest Road. Works at this site will consist of the removal of debris and re-instatement of a low flow channel within the creek bed. Further analysis and design is to be completed by the City of Toronto to determine a long term solution to prevent continued erosion of Mimico Creek. These works are anticipated to begin in late August of 2013 and be completed before winter.

Control of Flooding:The flood risk associated with the channel reconstruction will not increase risk to flooding , conveyance or storage of floodwaters when compared to existing conditions.

Pollution:Standard erosion and sediment control measures, including [silt/sediment fencing, coffer dams and silt control filters] will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse or wetland. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction .

Dynamic Beaches:Not applicable

Erosion:This project is designed to mitigate existing in-stream erosion issues. A long term analysis and design is to be completed by the City of Toronto to address the overarching erosion issues within Mimico Creek.

Conservation of Land:There will be in-stream works associated with this project. All works will be conducted in the dry. With erosion and sedimentation plans in effect, the potential for a Harmful, Alteration Disruption or Destruction (HADD) of fish habitat will be mitigated. A Letter of Advice (LOA) will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). The Ministry of Natural Resources (warm-water fisheries timing window) will apply to this proposal unless otherwise specified in writing by MNR.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The purpose is to allow development within a Regulated Area of the Don River Watershed to facilitate grading and servicing works for a draft approved plan of subdivision (19T-03V13) within Block 12 in the City of Vaughan.

The Longyard Properties Inc. draft approved plan of subdivision is situated north of Major Mackenzie Drive and west of Bathurst Street in the City of Vaughan. There are two tributaries of the Don River in the area of the proposed development: one along the western portion of the site (Tributary A) and a second along the eastern portion of the property (McNair/Patterson Creek). There are small wetland pockets associated with these valley corridors.

This permit will facilitate grading and servicing on the property, including grading within portions of the buffers and retaining walls on specified lots abutting the open space lands. The buffer grading and retaining walls have been deemed necessary due to the topography of the site and servicing constraints.

The natural features on the property will be isolated from the grading activities by a double row of siltation control fencing. Other sediment and erosion control measures will also be employed throughout the works.

It should also be noted that only a portion of the grading and servicing activity is regulated by the TRCA. The owner requires approval from the City of Vaughan for those portions of the site not within the TRCA's Regulated Area.

Conditional Approval:TRCA staff recommends that this permit be approved with conditions, which will be listed in a separate report once they have been agreed to by the owner.

Control of Flooding:The proposed works are not located within the Regional Storm floodplain. There will be no impact on the storage or conveyance of floodwaters.

Pollution:Sediment and erosion control measures will be installed and maintained throughout construction to prevent sediment from entering the adjacent natural features.

Dynamic Beaches:Not applicable.

Erosion:TRCA staff are satisfied that there will be no geotechnical/slope stability issues associated with the proposed development as designed.

Conservation of Land:The design of the buffer grading and of the proposed retaining walls has been amended to reduce the impacts to the conservation of land and satisfy the requirements of the TRCA and the City of Vaughan.

There are no other significant natural features on or adjacent to the site that may be negatively impacted by the project.

PlantingsA planting plan has not been submitted with the current proposal, but the owner is required to provide extensive plantings to satisfy the TRCA's conditions of draft plan approval. Some of these plantings have or will be provided with TRCA permit applications on this site (e.g., final stormwater management ponds, trails).

Policy Guidelines:This proposal has met the general intent of Section 4.1 (New Development) and Section 4.3 (Infrastructure and Servicing) of the TRCA's Valley and Stream Corridor Management Program. The owner has worked with the TRCA to find an acceptable design to address the TRCA's interests and the development constraints on the site. TRCA staff is satisfied that there will be no impacts on the control of flooding, erosion, dynamic beaches, pollution or the conservation of land.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:This permit application is to allow for final grading, servicing and permanent stormwater management works associated with Phase One of the Argo Developments residential plan of subdivision, located within the Mayfield West Phase One community, east of Highway 10, north of Mayfield Road, in the Town of Caledon. A previous permit was approved by the Executive Committee on September 12, 2012 (Permit C-130621) to allow for topsoil stripping and the construction of a temporary stormwater management facility. The Plan is now moving forward to Registration, and the installation of permanent stormwater management infrastructure and final grading are required to facilitate future construction within the subdivision. The proposed permanent stormwater management pond is in the same location as the temporary pond, which was approved by TRCA under the previous permit. Additional, permanent stormwater management infrastructure will be added, and the permanent pond will be planted in accordance with TRCA's Planting Guidelines. The developer is implementing a monitoring program to ensure that any construction related and potential permanent impacts of the pond are minimized.

The Argo Developments subdivision is located between two tributaries of the Etobicoke Creek (north and main branches). Through the plan of subdivision, the TRCA is acquiring a portion of the valleylands to the south, which are presently owned by the developer, as well as the associated valleyland buffers adjacent to both corridors. As the TRCA already owns, or is in the process of accepting dedication of, the majority of the valleylands within this reach, this dedication will help to complete TRCA's contiguous ownership of this section of the valley corridor.

Control of Flooding:The proposed development is located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of flood waters is anticipated.

Pollution:Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction.

Dynamic Beaches:Not applicable

Erosion:A geotechnical analysis has been provided, which has addressed the interests of TRCA staff. There are no geotechnical and/or slope stability concerns anticipated with this permit application.

Conservation of Land:No significant vegetation will be removed as a result of construction. As a component of the plan of subdivision, the developer has committed to fund valleyland enhancement plantings, which will be designed and implemented by TRCA Restoration Services staff. There are no fisheries related concerns associated with this project.

PlantingsAll proposed plant species for which the developer is responsible will be native and non-invasive consistent with TRCA's planting guidelines.

Policy Guidelines:This application is in conformity with Section 4.1.1 - New Urban Development - of the Authority's Valley and Stream Corridor Management Program (VSCMP).

Proposal:The subject property is located at the south-west corner of Countryside Dr. and Bramalea Rd. in the City of Brampton. The commercial block (i.e. Block 218, 21T-02015B) forms part of the Sandringham-Wellington Secondary Plan Area 28, for which a Master Environmental Servicing Plan (MESP) has been completed. A tributary of the Humber River runs along the west lot line, and therefore, a portion of the subject lands are regulated by the TRCA. Through the approval of the Plan of Subdivision, a buffer block from the valley corridor was identified. Both the valley and buffer have been conveyed to the City of Brampton. The applicant is proposing to develop a 0.87 ha (2.15 ac) block that consists of one commercial building (i.e. Mac's Convenience store), a gas bar, one retail building, and associated parking. As part of the development, an outfall structure is being proposed that will convey stormwater flows from the development into the Humber River tributary. Proposal:The purpose of this application is to undertake works within a TRCA Regulated Area of the Don River Watershed in order to facilitate the repair of five erosion areas along the north and south banks of the East Don River and adjacent to the north limits of the 17th fairway of Ladies Golf Club of Toronto. The subject lands are located in Thornhill on the east side of Yonge Street, north of Centre Street. The once-stable channel banks along this portion of the East Don River have eroded over time as surficial vegetation has diminished. The proposed vegetated stone revetments aim to provide a long-term solution for the eroded banks. A portion of the proposed works are located within the Regulatory Floodplain associated with the East Don River, however, TRCA Water Resources staff have no concerns with the proposed repairs. Appropriate erosion and sediment controls (i.e. cofferdams and silt fencing) have been proposed to isolate the proposed works from the in-stream flows and keep the areas dry. These measures will be maintained throughout all phases of construction. Furthermore, the proposed restoration works have been designed to accommodate the existing wooded vegetation in the area and no tree removals are anticipated. As such, there are no ecological concerns anticipated with this project. In addition, there are no geotechnical-related concerns anticipated with this project.

Control of Flooding:A portion of the proposed works are located within the Regulatory Floodplain. However, TRCA Water Resources staff has confirmed that this proposal will not have any significant impacts to the storage and/or conveyance of flood waters.

Proposal:The purpose of this application is to undertake works within TRCA's Regulated Area of the Rouge River Watershed in order to permit the demolition of an existing single family dwelling and construct a new two-storey dwelling associated with a municipal building permit. The western portion of the subject property is traversed by a valleyland associated with a tributary of the Rouge River Watershed. The proposed dwelling will be located further from the top of bank associated with the valleyland feature than the existing dwelling and is now appropriately setback. As such, there are no geotechnical concerns anticipated with this application. In addition, there are no ecology or flooding concerns anticipated with this application.

Through the Draft Plan of Subdivision process for the area (19T-99V08 - Andridge Homes Limited), the limits of the valley corridor were delineated and an appropriate buffer was applied. We note that the proposed works are located outside of the valley and buffer area.

Based upon a site visit conducted by TRCA staff on September 6, 2013, the proposed works are located approximately 5 metres from the top-of-slope of a well vegetated valley wall which has a configuration of 3 horizontal : 1 vertical. All of the proposed works are located within an already disturbed area devoid of significant vegetation.

The subject property is partially within the Regional Storm Flood Plain and the Regional Storm Flood Elevation for the property is 164.29 metres above sea level (m.a.s.l.).

The proposed grading works are located 10 metres away from the flood plain and will create a more gentle, stable slope along one side of the terrace wall. The existing slope has an inclination of approximately 1.5 horizontal : 1 vertical and the proposed regrading works will create a 3 horizontal : 1 vertical slope. As part of redevelopment of the neighbouring property (7584-7616 Yonge Street - City of Vaughan Zoning By-law Amendment Z.05.011, Official Plan Amendment OP.05.004 and Site Plan Application DA.08.024), a flood study was prepared by MMM Group Limited dated December 2008 to address TRCA flooding concerns. Based upon the Flood Study, in the post-development condition, 14 Arnold Avenue would be located approximately 17 metres away from the post-development Regional Storm Flood Plain (flood elevation 172.90 m.a.s.l.). As such, 14 Arnold Avenue will in the future not be considered within the flood plain and will not be regulated by the TRCA under Ontario Regulation 166/06. However, as these flood alleviation works are still underway and have yet to be completed, the subject property remains partially within the flood plain.

The proposed dwelling is located over the footprint of the previously existing dwelling and is outside of the existing flood plain. When the flood alleviation works are completed on the neighbouring property, the home will be even further away from the flood plain. The proposed grading works are minor in nature and will have no impacts on the post-development flood plain.

All of the proposed works are located within an already disturbed area devoid of significant vegetation.

Proposal:The purpose is to conduct grading works associated with the construction of a number of outdoor sports fields within a Regulated Area of the Humber River watershed. The subject property is partially within the Rainbow Creek Valley Corridor (a tributary of the Main Humber River) and was formerly used as a landfill between 1978 and 1983. The proposed works do not involve the removal or re-grading of any existing waste material or existing fill material covering over the landfill. The work involves the addition of new fill material (top-soil); as such, the buried materials would not be exposed or disturbed as a result of these works.

All of the grading works are located over an already disturbed area devoid of any significant vegetation. No vegetation removals are required and the proposed sports fields are natural turf / sod.

Based upon a Geotechnical Report prepared by Soil Probe Ltd., dated November 6, 2012 and an Addendum dated January 21, 2013, TRCA staff are satisfied that the proposed grading works will not affect the stability of the existing slope and the existing slope is in a stable configuration.

Proposal:The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the removal of excess sediment to rehabilitate an online pond at 16791 Innis Lake Road, in the Town of Caledon. Currently, the pond accumulates sediment from the headwaters of Centreville Creek, a tributary of the Humber River Watershed. Over time, sediment has accumulated at the bottom of the pond and the functions have been compromised. The proposed maintenance works will remove approximately 1.6 metres (5 feet) of sediment from a portion of the pond in order to improve its functions. The proposed works will also involve the installation of an underwater earth/rock berm in order to increase the duration between future pond clean outs and the installation of a temporary 30 mm culvert to allow for continuous water flow through to the pond outlet structure and the watercourse. The work will occur in the dry and will not necessitate the removal of any vegetation on the banks of the pond. As such, no significant ecological impacts are anticipated. In addition, plantings are proposed with this application in order to provide a net ecological gain. In addition, there are no flooding or geotechnical related concerns anticipated with this project.

Control of Flooding:A portion of the proposed works are located within the Regional Floodplain. TRCA Water Resources staff has confirmed that this proposal will not have any significant impacts to the storage and/or conveyance of flood waters.

Pollution:Appropriate erosion and sediment controls have been proposed with this application, and will be maintained throughout all phases of construction.

Dynamic Beaches:Not applicable

The subject property contains a number of Provincially Significant Wetlands (PSW’s) which form a part of the Eaton Hall-Mary-Hackett Lakes Wetland Complex. The proposed works are located within the 120 metre Wetland Area of Interference of these wetlands.

The proposed works are partially located within an agricultural field and partially within a plantation area. Based upon a site visit conducted by TRCA staff on July 26, 2011 and a Natural Heritage Evaluation prepared by LGL Limited and a subsequent Addendum, TRCA Ecology staff are satisfied that the proposed works have been adequately setback from the wetlands (minimum 50 metres for the proposed septic system and approximately 70 metres for the new dwelling) and the plantation area does not represent a significant natural feature.

Native, non-invasive plantings consisting of trees and shrubs will be provided around the two nearest wetlands which will provide an enhanced ecological buffer area between the wetlands and the proposed residential uses.

Control of Flooding:The proposed works are not located within the Regional Storm Flood Plain. There will be no impacts on the storage or conveyance of flood waters.

Pollution:Sediment control fencing will be erected and maintained for the duration of construction to prevent the transport of sediment towards the wetlands and any other natural features.

The proposed crossings will facilitate the servicing and development of the Maidenstone residential subdivision, in Nobleton, Township of King.

The subject site is located on the west side of Highway 27 and south of King Road, while the proposed work site is located on Highway 27, south of Ellis Avenue. The first crossing is a culvert crossing over an existing conveyance channel which will allow pedestrian movement along Highway 27 (sidewalk). The swale for this sidewalk crossing is a wide, shallow channel. The second crossing is a sanitary sewer line installation and crosses beneath an existing channel in an agricultural field. Detailed design information on both crossings have been submitted by the applicant's consultants (Exp. Services Inc. and Cole Engineering) and has been found satisfactory by TRCA technical staff.

Control of Flooding:The proposed sidewalk crossing is larger than upstream culverts and will provide equal or greater flow capacity and drainage. The secondary crossing will be installed under the existing channel and will not impact flow regimes. Both crossings are not expected to negatively impact the storage and/or conveyance of flood waters.

Pollution:Erosion and sediment control measures including silt fencing will be installed prior to construction. These measures will be maintained for the duration of the works to ensure that sediment does not enter the watercourse, the natural system and onto adjacent downstream properties.

Dynamic Beaches:Not applicable.

Erosion:Erosion will be minimized through the implementation of the aforementioned erosion control measures.

Conservation of Land:There are no geotechnical/slope stability issues associated with the proposed works. Given the nature of the works and the close proximity of the work site to the watercourse, a Letter of Advice will be issued on behalf of Fisheries and Oceans Canada (DFO).

PlantingsNo significant vegetation will be removed from the proposed work site. However, a comprehensive planting plan will be implemented to ensure a net ecological benefit .

Proposal:The purpose is to allow development and the alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate driveway repairs and upgrades at 4700 King Road in the Township of King.

The rural residential property is located at the northwest corner of King Road and Concession 7, east of Nobleton. The eastern portion of the property is regulated by the TRCA, as a tributary of the East Humber River traverses the property in an north-south direction.

The owner conducted repairs and upgrades to the driveway on the property, which included paving over the gravel driveway, restoring fill around an existing culvert that had eroded during rain events and placing stones at both ends of the culvert up to the edge of the watercourse.

Works on the property were started without permit approval from the TRCA and a violation notice was issued by Enforcement Staff on issued May 14, 2013 (Violation No. V2724).

Fee:As the works were started prior to the issuance of a permit under Ontario Regulation 166/06, an additional administrative fee was charged on this application.

Control of Flooding:A significant portion of the driveway is located within the Regional Storm Floodplain; however, the upgrades and repairs were minor in nature and will have no impact on the storage or conveyance of floodwaters.

Pollution:There were no sediment or erosion control measures on the site during the works; however, there does not appear to have been any impacts to the adjacent natural features.

Dynamic Beaches:Not applicable.

Erosion:There are no geotechnical/slope stability issues associated with the driveway repairs and upgrades. In addition, the placement of stones at both ends of the culvert is intended to address erosion that had previously occurred on the site.

Proposal:The proposal involves the reconstruction of the Goreway Drive and Derry Road intersection, in the City of Mississauga. The reconstruction works will include providing additional storage capacity for turning vehicles, left and right-turn lanes and a 3.5 m wide multi-use trail . In addition to the proposed road works, an existing 300 mm diameter watermain will also be replaced.

Control of Flooding:The proposed project is not anticipated to impact flooding, conveyance or storage of floodwaters.

Proposal:This permit application is to allow for grading and servicing works associated with the final phase of a new residential subdivision located north of 19th Avenue, west of Bayview Avenue, within the Jefferson Forest Subdivision, in the Town of Richmond Hill. The Jefferson Forest Subdivision is being constructed in three phases. Phases one and two of this subdivision were constructed between approximately 2007 and 2012. TRCA permits were attained for these previous phases, and the stormwater management infrastructure required to service this subdivision was constructed. A small portion of the subdivision, comprised of approximately 11 new residential lots and the completion of Bush Ridges Avenue was not developed at that time, as a result of the planned phasing and servicing of the subdivision. Development of that phase is now scheduled to proceed, connecting to existing servicing. A portion of Phase three is Regulated by the TRCA, as it is located adjacent to a valley corridor associated with a Rouge River tributary, in which Provincially Significant Wetlands are located. The subject lands are separated from the valley corridor by another small residential subdivision, with which TRCA staff were involved, and a previous TRCA permit issued (C-130001).

Control of Flooding:The proposed works are located outside of the Regional Storm Floodplain. Accordingly, the works associated with this permit will not result in any adverse impacts to the storage or conveyance of flood waters.
