Terms & Conditions of Sale1. The giving or sending of an order for seedlings and plants constitutes an acceptance of the following
Terms and Conditions of Sale.
2. Seedling Count: While sufficient seed is sown per box to give an average seedling count as shown foreach variety, we do not guarantee the number of seedlings per box.
3. Every effort is made to ensure that only seedlings and plants of good quality are supplied but nowarranty is given, expressed or implied as to the description, freedom from pests, health orproductivity, and no responsibility can be accepted for loss of crop due to any cause. The risk in thegoods shall pass to the buyer or the buyers agent.
Occasionally due to circumstances beyond our control we may have to substitute the nearestequivalent of any variety not available at short notice.
4. Our liability to customers is limited in all cases to the value of the seedlings or plants sold at the dateof sale.
5. Execution of orders is made subject to seedling or plants being available from our own stock on thedate arranged for dispatch. Please sign for goods as damaged in transit.
6. Prices quoted are strictly nett. All goods are sold at prices current at time of print. We shall be entitledto alter the price of goods without prior notice in the event of any variation in the cost of us supplyingthe goods or any part thereof by reason of (a) any increase in the cost of goods required by us tocomplete the contract, (b) any increase in the royalty payable under the Plant Varieties and Seed Act1994 or any statutory modification or re-enactment thereof for the time being in force, (c) any othermatter beyond our control, including but not limited to, fuel prices, fluctuations in exchange rates orthe action of any government or any other authority anywhere in the world or any labour problems.
7. Any claim for non-delivery or damage to goods in transit must be made in writing to us within threedays of delivery date.
8. V.A.T. at the following rates should be added to all items. Vegetables and herbs - 0%; Plants - 13.5%;Delivery - 23%.
Payment: Cash with Order except on approved Accounts. All Accounts are due monthly and are considered overdue 30 daysafter the date of invoice.
PAYMENTS MAY BE MADE BY CASH, CHEQUE OR CREDIT CARD
* NEW CUSTOMERS: Credit accounts cannot normally be approved until two satisfactory trade referencesand bank details are provided.
