    The following notes are typical notes to tenderers reproduced from typical bills of quantities to show possible waysof describing such notes. Users must take special care that only notes relevant to the specific project are to beincluded and that descriptions should be adapted as necessary to suit the particular circumstances

    5 SIGNING OF TENDER

    The tender must be signed by the tenderer or by a representative of the tenderer being duly authorised todo so and the tenderer is to attach a company resolution if applicable

    6 COSTS INCURRED BY THE TENDERER

    The employer will not be responsible for or pay for expenses or losses which may be incurred by thetenderer in the preparation of the tender or in visiting the site

    7 ACCEPTANCE OF TENDER

    The employer is not bound to accept the lowest or any tender nor to give any reason for the rejection of anytender

    8 BLACK ECONOMIC EMPOWERMENT

    Tenderers must complete the questionnaire and hand it in with their tender

    9 OCCUPATIONAL HEALTH AND SAFETY ACT - CONTRACT AND SPECIFICATION

    Tenderers must carefully study the project specification and ensure that all of the obligations, requirementsand specifications are included in the tender sum

    10 INFORMATION TO BE PROVIDED BY TENDERERS

    Tenderers are to provide the following information/documentation together with the tender submission:

    - Priced bills of quantities and form of tender

    - Questionnaire: Black Economic Empowerment

    - Information required schedule

    - A tax clearance certificate stating that the tenderer#s taxes are not in arrears - this is also required foreach of the members of a joint venture in such case

    11 ESCALATION

    Two tenders are called for namely Alternative 1 and Alternative 2

    Alternative 1 - Subject to CPAP (Haylett) escalation

    Alternative 2 - Fixed price escalation

    12 ESCALATION AND COMPLETION DATES

    Two tenders are called for namely Alternative 1 and Alternative 2. Both alternatives to include for fixedprice escalation. The difference between Alternative 1 and 2 is the completion dates. The dates forAlternative 2 are annexed at the back of the tender form for Alternative 2

    3585 BUILDING AGREEMENT AND PRELIMINARIES

    3586 The JBCC Series 2000 Principal Building Agreement (March 2005 edition) prepared bythe Joint Building Contracts Committee shall be the applicable building agreement,amended as hereinafter described

    3587 The JBCC Series 2000 Preliminaries (May 2005 edition) prepared by the Joint BuildingContracts Committee for use with the said JBCC Principal Building Agreement shall bedeemed to be incorporated in these bills of quantities

    3588 Contractors are referred to the above mentioned documents for the full intent andmeaning of each clause thereof

    3589 These clauses are hereinafter referred to by clause number and heading only. Wherestandard clauses or alternatives are not entirely applicable to this contract suchmodifications, corrections or supplements as will apply are given under each relevantclause heading and such modifications, corrections or supplements shall takeprecedence notwithstanding anything contrary contained in the above mentioneddocuments

    3591 PREAMBLES FOR TRADES

    3592 The Model Preambles for Trades (1999 edition) as published by the Association ofSouth African Quantity Surveyors shall be deemed to be incorporated in these bills ofquantities and no claim arising from brevity of description of items fully described in thesaid Model Preambles will be entertained

    3593 Supplementary preambles are incorporated in these bills of quantities to satisfy therequirements of this project. Such supplementary preambles shall take precedenceover the provisions of the said Model Preambles

    3594 The contractor's prices for all items throughout these bills of quantities must takeaccount of and include for all of the obligations, requirements and specifications givenin the said Model Preambles and in any supplementary preambles
