Concern No. 32707 The body shop behind CP's house is venting paint fumes every day that have a lacquer/solvent odor. On a scale of 1 to 5, the odor can get to be a 5 at times.

Went to the Kandy shop. Met with the owner who explained he stopped painting in October in order to avoid the concerns from the neighbor. He has a second shop on Prospect Ave. where he takes the cars for painting. I viewed his operation and they only sand the cars at this location. There were no odors and no painting equipment on site.

No violations observed. No odors. Painting has been discontinued at this location.

Concern No. 33247 Concerned person complained that Mr. Dennis Trochazka burns stacks of 15 to 20 feet of wooden palettes usually at night at about 10 PM. Neighbors have complained to Mr. Trochazka several time but has not stopped burning. The Fire department was also informed but nothing has been done to stop Mr. Tochazka from burning.

Concern No. 33276 Anonymous caller alleged that there is a chemical odor at time like melting plastic sometimes like and sometimes both emanating from the Ford Plant in Claycomo near the Gracemor Christian Church and that at the given intersection there may be the smell for a week, then it will stop, and then randomly for a few days. She talked to someone at the plant that stated the odor is much worse in the plant but perhaps may call back with a better assessment of dates when the production (of the process that produces the odor) will occur. Alleged that when dog walking in the area, a mask has to be worn because the odor is that bad.

Concern No. 34143 Caller states that renovation of the old nursing home on the eastside of town is being conducted by a Mr. Gary Wilson. No asbestos inspection is alleged to have been conducted in the structure prior to the start of renovation. The caller states that the structure was sold to the new property owner about a month ago, and renovations began approximately 2-3 weeks ago. They elaborate that the structure is being converted into a restaurant / hotel.

Concern No. 34144 Travis Bradley is a contractor that is hauling building waste and demolition waste to his house and burning it, on his driveway or in the back yard. Burning events occurred on Feburary 17, 25, 27, March 3rd and 15th. The concerned party called the police on the February 17th event and the police called in the Belton Fire Department, and Mr. Bradley had to douse the fire with his garden hose.

Concered party had been in contact with Mr. Jim Brown, Belton Code Enforcement Unit who has surveyed the situation.His number is 816-331-4331, email: [email protected]

Mr. Bradley is reported to have hauled in dirt to cover up the burn marks in his yard and his driveway.

Concern No. 34149 EPA received a letter from Eddy Watkins, of Watkins Lithography. Mr. Watkins states that the facility across the street from them, Livestock Nutrition Center (200 W 11th Avenue, North Kansas City) is creating a green fugitive dust which is blowing across the street and covering Watkins Lithographic's parking lot and cars. EPA states that they are certified as a minor air source, but has not been inspected recently.

Concern No. 34166 In the twelve years since I brought my property on the bluffs above the Kaw River, the odor from this plant has grown increasingly worse. It’s particularly noticeable when crossing the Lewis & Clark viaduct, but when the wind is from the north/northeast the smell is so bad that I can not entertain outside. It’s embarrassing and inconvenient and the time to address the issue is long overdue.

Concern No. 34167 I am a resident here in Strawberry Hill and just wanted to share with you, directly, that the past few days have been atrocious in terms of air quality, thanks to the treatment plant(s) in the Bottoms. I have a foster child in the house and she think the neighborhood, literally, stinks, thanks to the treatment plant. We need you, or whoever is tasked with such determinations, to assign blame for this problem to one or both facilities, whoever the source of the problem might be. And we need the problem resolved.

If this was happening in a suburban community, I would bet this would be resolved over the course of weeks, not left unresolved for literally years. And I am very troubled that despite all of the supposed the talk, it seems like nothing has actually been done to resolve this problem, as the problems occur as regularly now as they ever have before.

Concern No. 34179 Todd Creek Wastewater Treatment Plant has extensive and unbearable smells coming from it. We are located SouthEast of the plant and can smell it up to half of a mile away. Our property is off of NW Walker road. We have not walked East of Walker road but would imagine the smell is traveling over that way as well. There are houses being built all over this area and at times this plant sends off unbearable smells. We are wanting to build on our property soon but noticed this smell when the wind is blowing in the right direction. Not sure if these smells are even safe for say kids to be playing outside. With the area becoming more populated it might be time for the city of Kansas City to consider solutions to this problem. It looks like this is not the first time this has been a concern either. I would refer the city to concern number 32183. The problem has been noticed since the fall of 2016.

Concern No. 34239 The West Bottoms plant(s) are putting off the now-usual odor, and it's been blowing into the neighborhood all day. You can imagine my concern at this point, especially since I'll be having family on my back porch for Easter dinner this weekend. I'd rather not have to explain that it's 2018 and the Kansas Cities still haven't figured out how to manage sewage.

I also cannot understand if a smell can be "resolved" once reported, why it isn't resolved as soon as the smell is detected. Like, aggressively neutralized as part of the normal course of business every day, rather than at the begging of residents.

The only change he noticed was they had large tote bags covered in tarps. Jack recycles the carbon. There are homes to the south side of the facility. He described it as a putrid/chemical smell.

Concern No. 34391 Caller stated that the person is burning leaves and other debris in his barrel in the front yard, and is doing it again without a burn permit. He has done this recently and frequently. I asked the caller if he has called the fire dept. and he told me he has not because we(DNR) could do more than the fire dept. The caller said that the smoke is so bad that he has to shut his windows so he doesn't get smoked out and he has breathing issues.

Concern No. 34206 Caller reports that the residents of the property at about 207 S Morris (actually 204 S Morris, house burned years ago) in Clark are burning waste and have no sewer since they moved out of the RV and into the garage.

Caller states that the woman digs up boards from the old house that are buried along the foundation and by the fence and willow tree and burns them on the weekend, then buries the ash. Also reports that there has been black smoke on the weekends that smells like rubber.

Caller also reports that there is a sewer smell from the site, so she knows they have no sewer connection. Caller believes that they are using a piece of electrical conduit as a fake sewer connection to fool the health inspector. Caller stated she hasn't gone over there herself to look, but can see from her house.

Caller stated that Eric from the Randolph County Health Department will be coming down to look at the property and has previously written them a note requiring cleanup.

Caller stated that she can't sell her house because of proximity to the messy property she is complaining about driving the value down.

Concern No. 34260 Caller reports that a salvage yard is polluting the area and letting trash blow everywhere. Reports that they work on cars and dump oil into drainways, they haul in trailer homes and smash them apart, letting insulation and paper blow everywhere in the neighborhood, they have people on site living without plumbing, and they burn trash every week. Caller says it looks like a mess and is polluting the neighborhood.

Concern No. 34284 Caller reports that someone was injured at the demolition site of the former Wal-Mart building in Chillicothe. The caller was concerned about the safety of the demolition and that the demolition contractor is not restricting access to the work area. The caller has made contact with OSHA, with Livingston County, and with the City of Chillicothe. Tammy with the City of Chillicothe recommended that the caller contact the Department on the issue.

Concern No. 34420 A letter was received at the Northeast Regional Office from Patricia Sommer with several concerns listed, including that the air at their property on the gravel road near Louisiana, MO is filled with dust. Because years ago there was a trash dump in the area that was used for dumping of dangerous chemicals, the complainant is concerned that there may be contaminants in the air they breathe. Other concerns were also expressed, including that the utility poles are leaning, the loose gravel makes their road dangerous to drive on, and the road is eroding. She would like a hard surface put on their gravel road.

No investigation conducted as what was alleged in the report was not a violation of the Fugitive dust rule. A referral was made to the Pike County Highway Department.

Concern No. 34570 Caller stated that railroad ties and scrap tires were being burned at a property near the school in South Gorin last night (04/04/18) around dusk and again today (04/05/2018). Caller stated that the smoke was thick and darkened the sky.

Scotland County Sheriffs department informed me that they were called to the same property on the night of April 04, 2018 to put out the fire and make contact with the property owner. The Sheriffs department took photos and will return to the property today to put out the fire again.

Upon return to the property the Sheriffs department stated that they were able to reach Mr. Bruce Parsons, property owner, and no further burning was noted, just thick smoke. Mr. Parsons informed the Sheriffs department that the fire was accidental from cutting off catalytic converters from salvaged vehicles. During the removal of the parts, sparks or residual heat may caused a fire at the property that was controlled on the night of April 4, 2018, with smoke lingering in the area. Mr. Parsons also informed the Sheriffs department that no salvaged vehicles were, or would be, rolled into a nearby pond.

An accidental burning of prohibited materials occurred at the facility on April 4, 2018. The burning materials were extinguished by the local Fire Department to prevent further burning / damage to the property. The facility has taken steps to address this burning incident in preparations for further open burning events as the property is being cleaned up. An unsatisfactory findings letter, with the need for a response, will be sent to the facility in response to the burning incident.

Concern No. 34571 On 4/4/18 at 7:55 p.m., the caller called the spill line to report an ongoing fire at a salvage yard in Gorin. The caller could not provide the address but said that Gorin is a small town and you can't miss it. The caller thought that the name of the business was Steel and Iron Co. The caller stated there was thick black smoke coming from the fire. The caller did not want to notify the local fire or police.EER (Sappington) contacted the Scotland County Sheriff (660) 465-2016 to report the incident and to request that they conduct a drive-by. The Sheriff's Dept had already received another complaint about the fire and were about to investigate anyway.Sappington later spoke with Deputy Jeremy Head (Badge #528) with Scotland Co. Sheriff who was on-scene. He stated that there was an ongoing fire at the salvage yard and that there was no one attending it. He saw railroad ties, tires, an old gas tank, poles, and other trash burning. He will document the fire and call the local fire dept to respond and extinguish. To obtain a copy of his report, call his office at the Scotland County Sheriff at (660) 465-2151.

Concern No. 34419 Caller reports that Dan Bush / Hannibal Crane Service is dumping demolition waste and sandblasting waste on the creek bank at Bear Creek near Orchard Avenue.

Caller also reported that Hannibal Crane Service is conducting sandblasting outside in the parking lot at their main site on New London Gravel Road about 3-4 times a month recently. They are immediately north of Hannibal Industrial Painting (same group of buildings)

These concerns were previously investigated under ACE # 23431 August 11, 2015 (SW dump). ACE# 32533 & 32534 August 28, 2017 (sandblasting and dumping sand)

A LOW was issued in 2015 for SW on ground. Informational letter was provided in 2017 for sandblasting and for sandblasting waste.

Concern No. 34470 My concern is that dumping and burning of construction material is violating the wildlife's environment, also that runoff from the burning is going to get into a creek just down from burn pile (about 200 yards). He has been burning construction material IE: sheetrock, treated wood from old trusses, carpet & carpet pads. Location of property is located in Taos, MO, 6012 Helias Dr, J.C. MO, 65101. DNR should know the location because he has been reported a number of times. PLEASE stop him.

It currently has been burning a bed or pallets??, a mattress and other construction material, I have seen shingles also being burned.

She said that they are not watering. They have a water truck, but have not used it this year. I explained that there is also a county or city street nearby to the transfer station and that dust from it was not regulated. She said that the entire area was covered in dust yesterday.

The facility has a scheduled routine for application of dust suppression, either water or chemical, and is following this schedule based on provided records. No fugitive dust was seen leaving the facility at the time of investigation. An increase in the application of dust suppression measures may be warranted by the facility if the levels of fugitive dust increase.

I drove to the Marston City park located near Pecan and DeLisle Street. I did not observe any burn areas in the park or in any road ditches in the area around the park. One residence bordering the park had a blackened area in the yard. Open burning of residential waste generated on-site is exempt from the State open burning regulation. I did not observe any burning at the time of my site visit.

I drove to the City Hall and spoke with Ms. Tracy Noble. She said that the City has not conducted any burning in road ditches or at the park.

No violations observed. No further action.

Concern No. 34220 City is burning down a house with asbestos.City condemned the house and pushed it down. Now burning the demo waste.

Concern Info

The structure involved was an old residence that had been used by the church to house the minister working there. The house was selected for demolition by The Pentecostals of Advance church at first and then because of demolition delays the house was condemned as unsafe and actually demolished by the City of Advance using a backhoe. Subsequently, Pastor Ferris had burned some demolition wastes that he thought were appropriate to open burn. These wastes included wood wastes and some trash from the demolition. Pastor Ferris had been told by the Mayor of Advance, the Honorable Carl Ritter, that open burning of the wastes would not be a problem. Pastor Ferris was highly cooperative at all times during the process.

A Letter of Warning was issued to Pastor Chad Ferris.

Concern No. 34227 A new concrete plant has opened in the Van Buren area. The business name is Tri County Ready Mix. I don't believe they are operating with any air or water permits.

Concern Info

The new ready mix concrete plant is a 100 cubic yards per hour capacity plant manufactured by Saint Marc Materials. There are two aggregate bins (one for sand and one for gravel), weigh belt system, conveyor, and truck loadout point. The plant is a dry batch plant that uses transit trucks to mix the ready mix concrete. There is a dust collector or fabric filter on the cement silo only. There is no fly ash silo. There is a propane storage tank of about 1,000 gallons size. There is a one million Btu per hour propane-fired boiler on site. There was a one thousand gallon diesel fuel tank in a metal containment also on site. There are sand and aggregate stockpiles on site. The site is about 15 acres in size located just south of State Route H off of Highway 21 east of Van Buren. The plant has one front end loader and six transit trucks. The new ready mix plant was in operation at the time of this investigation. I delivered various fact sheets and telephone numbers for the Missouri Department of Natural Resources Air Pollution Control Program and the Missouri Department of Natural Resources Southeast Regional Office.

Letter of Warning (LOW) was issued for failure to obtain an air construction permit prior to operating an air pollution source.

Concern No. 34464 The old black river restaurant and motel in the middle of town (lesterville) they are tearing off the upper part and have all the debri in huge piles around back and they are burning it this includes rotten lumber black tar paper insulation etc. That are being burnt in the middle of town . Shouldn't that be disposed more properly?

At the time of this investigation, the former Black River Family Restaurant and Motel had been gutted and was being renovated and repaired. Materials that had been removed were mostly piled in the rear of the building. I spoke with the on site contact Mr. Andres Urquidi, Kitchen Manager, for the new Mexican Restaurant that is planned at this location. Mr. Urquidi is living on site with his wife and is supervising a team of employees from Potosi who are working on the renovations. The building has a restaurant area down stairs and six motel rooms. The building sustained some water damage that necessitated repairs to the front of the building and the upstairs motel rooms, and restaurant were being renovated for the reopening. Mr. Urquidi stated that, while some of the wood wastes generated by the renovation had been open burned on site for disposal, it was planned that the rest of the materials including some masonry would be hauled of site to a landfill or transfer station for disposal. Mr. Urquidi explained that, since the masonry materials to be disposed of made the renovation waste material to heavy for a roll-off dumpster, a semi-tractor trailer would be used. Mr. Urquidi pointed out that the open burning pile was next to the small dumpster on site. Mr. Urquidi stated that the fiberglass insulation was in black trash bags because it had been blowing off the site. Mr. Urquidi stated that the building had been inspected as part of the purchase and recommended that I contact the owner, Mr. Chris Harbison, to find out about the asbestos building inspection, since Mr. Harbison was not on site. I telephoned Mr. Chris Harbison when I returned to the office and I explained the situation. At his request, I e-mailed Mr. Harbison the environmental information that I had given to Mr. Urquidi on site. Since Mr. Harbison was unable to locate an inspection report, he called Mr. Mark Bonney, a state-certified asbestos inspector doing business as Trutest Environmental Solutions, for an asbestos building inspection (after the renovation was well under way). Mr. Bonney located a debris pile containing a popcorn ceiling among the drywall and other debris piles in the rear of the building. The ceiling material contained 2.50% asbestos content when tested by SanAir Technologies Laboratory using point counting. The amount of popcorn ceiling material was less than 35 cubic feet and not regulated as a notifiable project amount under Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos.

A Letter of Warning (with return to compliance no response required) was issued to Mr. Chris Harbison for failure to inspect a business for the presence of asbestos prior to commencing a renovation project.

I have investigated this concern twice already this year. This is the third concern for 2018 on Mississippi Lime with an anonymous caller. I have visited the facility and have documented the numerous control measures that Mississippi Lime has in place. We are unaware of the exact location of the caller, but also acknowledge that Chem Lime is just north of Mississippi Lime along with a large quarry. The dust could potentially be coming from another business or county road traffic. I have asked our office to try and get a name and phone number for the next concerned party on Mississippi Lime. No further investigation on this concern by this investigator at this time.

Concern No. 33708 Goldman Fire Protection District Chief Mr. Curtis Peters stated they have responded to 8 open burning complaints at 7321 Deborah Lane in Hillsboro, MO since May 23, 2017.

The owner of the property, Mr. Steven Mitchel, continues to conduct open burning of household trash and copper wire insulation in 2-55 gallon drums.

The latest incident occurred on January 26, 2018. Chief Peters stated Mr. Steven Mitchel stated DMR told him he could burn at anytime of the day since he was out of the city limits.

Chief Peters offered to accompany DNR personnel during the investigation.

Concern Info

Goldman Fire Protection District Chief Mr. Curtis Peters accompanied me on this investigation.

Chief Peters and I arrived at 7321 Deborah Lane, Hillsboro, MO at 1030 hours on Tuesday March 20, 2018. No open burning was detected.

John Fredrick, the nephew of Mr. Mitchel, met us at the door and informed us that Mr. Mitchel was not available because he had been incarcerated on a non-related offense.

I provided copies and reviewed "Facts on Open Burning Under Missouri Regulations" and Open Burning Regulation St. Louis Metropolitan Area publications with Mr. Fredrick.

Specific attention was given to the restrictions associated with open burning yard waste in unincorporated areas, the ban on open burning household/domestic refuse within the St. Louis Metropolitan Area and that open burning other non-routine household waste including copper wire insulation was prohibited by Missouri Regulation 10 CSR 10-6.045.

Mr. Fredrick said he understood open burning household refuse and copper wire insulation was not permitted and that he would pass this information on to Mr. Michael.

Concern No. 33954 The caller report she ahs been noticing bad smell in the area (South Spring Street) for some time now. It looks like somebody is burning tire. The caller indicated that the smell is most likely coming from Precoat Metals located at 4301 South Spring in St. Louis 63116. It is the only manufacturing company in the area.

3/8/18, after 1:00pm a quick drive by of area and no odor was detected. 3/21/18, between 12:10 and 12:30 pm drove around area. There was heat wave observed from stack on south side of building. A very faint chemical odor was detected on the south side of the building. No odor other than there. 3/28/18 between 10:15 and 10:45am, no odor on the south side of the plant, this odor smelt of burning vegetation then chemical. 4/2/18 8:30 to 10:00 am, no detectable odor. Went into facility, met with Cheryl Rogers, General Manager, Kevin Zumbaum, Safety Manager and Anu Singh, P.E., Environmental Director. Records were provide which indicated that Operating Permit requirements were being met for a period of February 18, 2018 to April 4, 2018. There was a breakdown of the thermal oxidizer on 2/21/18. The operation was shut down within 20 minutes of problem. The problem was fixed within 2 hours of breakdown.

Concern No. 34092 Midwest Service Group transfers asbestos waste from hundreds of jobsites at it's facility in St. Peters. Friable and non-friable waste is separated out at the facility and is allowed to site for weeks before it is a hauled to a landfill. This has been occurring for 10 years. (see attached concern letter)

Robin Ledford and I arrived at 560 Turner Blvd. at 12:00 pm and drove to the rear of the building through the parking lots. We observed four blue (Republic Services) 40-yd roll-offs at the far end of the lot; three were labeled with asbestos labels and all were shut and locked. There were also numerous closed and stacked storage containers, box trucks rented from Enterprise, Midwest Service Group (MSG0 trucks, Blanton Construction trailers and trucks, and an open top dumpster. There was no apparent waste on the ground or protruding from any container visible from our vehicle. We then proceeded tot eh front door, introduced ourselves, and asked Gail Kieffer ad her coworker if we could speak to Corey Elliott or another Project Manager about asbestos and solid waste handling procedures. None were available so Jeff Blanton discussed general procedures with us and agreed to take us to the parking log and allow us access to trailers, etc. We quickly confirmed that the open-top dumpster did not contain hazardous waste, it was used for metal items destined for recycling. One Enterprise truck had just returned from the field, it contained some equipment and 5 plastic asbestos bags, goose-necked, taped, leak-proof and with generator labels "Dick Ford". Through the plastic it was not possible to identify much suspect ACM, most of the waste appeared to be plastic and other waste. None of the bags appeared to be "adequately wet", however the project appeared to be less than regulated quantities. The Columbia Housing Authority containers are Asbestos Project #A7247-2017. The project has been on and off hold 22( amendments) times since beginning in January, 2017, and has not been completed yet. The notified landfill is the Jefferson City Landfill. I informed NERO (Steve Boone) that some of the waste was being sent to Roxana, and on my request MSG amended the project with the Roxana Landfill (they confirmed that the build of the project waste had been transferred to the Jefferson City Landfill per the original notification. I had numerous conversations with Mr. Elliott in order to confirm that the waste in the roll-offs was being manifested and disposed of as ACM, that it was all from small projects except for A7247, and that was late call-backs to remove ACM discovered or uncovered as the ongoing renovation proceeded.

Concern No. 34109 Concerned party prefers to remain anonymous; however, she has called numerous times and has spoken to the EPA and to Terry Ball (APCP Investigations, Jefferson City) and previously identified herself to them by phone and email.

Concern is about a wood-burning furnace located at Hermann Catering on State Highway H, southeast of the city limits of Hermann, in a semi-rural area. Daily, from approximately 3:30 to 5:00 pm, the resident and co-owner of the catering company feeds the fire. Due to the amount and opacity of the smoke it can enter nearby residences, obscure visibility on the highway, impact school buses and students, and make it difficult for residents to enjoy their yards. The smoke is described as "toxic" and the complainant states she experiences a headache, sore throat, and burning eyes.

SLRO has sent 3 investigators to the site as anonymous complaints; the complaint was not confirmed. Complainant is requesting that someone be there between 3:30 and 5:00 pm and notes that the driveway at the residence across the highway is a good vantage point for observations - DNR has permission to park at that location.

SLRO has explained to the complainant the limits of our authority as regards to the wood-burning furnace that is apparently used for heating the buildings and water for the business and residence. We would need confirmation that the fuel being used is not clean wood and is something disallowed by state regulations such as trade waste. Complainant states that there is trash pickup along the highway; however no catering waste is observed leaving the premises in a dumpster and there is no other obvious non-residential waste appearance.

I arrived at the location at 3:35pm on 3/21/2018 and as I was driving by noticed only wispy, white smoke being emitted from the stack of the furnace. I turned around, waited for 10 minutes, and drove by again, noting there was no change at 3:35pm. I turned around, waited 20 minutes, and returned at 4:05pm. At that time I saw copious amounts of brownish smoke so I pulled into the parking area of the catering business building and parked. Opacity was around 100% and the wind was blowing the smoke towards the rear of the residence and not across the road toward that house. Due to the lower elevation of the location where the wood burning furnace is sited, I could not see across the road when I was standing ant the furnace. The furnace could be seen from the road. I observed the smoke for about 1/2 hour, and although there were slight changes in wind direction it generally below towards the house or towards the rear of the house and down the valley. At 4:35 pm the smoke was again white and wispy. When I arrived I knocked on the floor at the catering building and rang the bell at the house; nobody answered. I looked around the area of the furnace and saw wood in the shed with a small bottle of charcoal lighter and 2 butane lighters, as well as 2 steel cans used for ashes (one was 1/2 full, appeared to be wood ashes). After the smoke died down I drove to the road and noticed that someone had arrived at the residence, so I parked in the driveway and rang the doorbell. A man answered, I introduced myself and I asked if he was Mr. Bruno "yes" and if Deborah Bruno was home "no". I explained the purpose of my visit and he immediately announced that the neighbor across the highway was always complaining about everything and that he only burned wood and that he wasn't doing anything illegal. I deflected, and asked if he would humor me and walk to the furnace with me, open the doors to it, and show me what was inside. He said I could do it myself, but I demurred and he agreed to it. He opened the ash box and the fire box. Only wood was inside, no flame was visible. Mr. Bruno explained that the furnace was controlled by the thermostat in the house and provided heat or hot water on demand to the house and/or catering building. We discussed the benefits of using dry wood, cleaning out the ash box, and avoiding creosote buildup. I gave him EPA documents "Wet Wood is a Waste" and "Burn Wise Tips", MoDNR Open Burning regulation, and Hardy H4 Furnace manufacturer's recommendations to reduce smoke, avoid creosote buildup, perform regular cleaning and maintenance, troubleshoot, etc. The furnace manufacture date was 1/2005 and it has been operating there since then.

After thanking Mr. Bruno I went across the street, at his suggestion, to speak with the complainant. She and her husband welcomed me into their house and we discussed my observations. She was glad that someone had finally seen the amount of smoke and understood her complaint; however, she was still frustrated that there was nothing within our authority that I could do since the opacity restrictions do not apply to wood-burning furnaces and I did not observe any trash or other trade waste or disallowed materials being burned.

The subdivision is located at the intersection of Stuermann Road and Falcon crest Road (photo1). I met Mr. Soest, who is a construction worker at the Falcon Crest Subdivision. He told me the owner and manager of the site Mr. Larry Terbrock (314 581 2854). He was not present during my visit. I explained the nature of the complaint and Mr. Soest if they are open burning debris from job sites. He said they were doing that till last summer. In response to an open burning complaint, Wright City Fire Department was on site last summer and told them not to open burn any leftover construction material and, therefore, they stopped burning leftover construction materials.

He stated that they now have dumpster (photo 3) where construction debris are collected and hulled away offsite by On The GO company. I drove around the construction site and observed few active construction sites (photo 2). I did not see any open burning within the subdivision.

Concern No. 34154 The concerned party lives next to Big Creek Quarry and states that dust from the quarry is constantly getting onto her property. She calls the business owners on a daily basis to express her concerns, but doesn't believe that she should have to call everyday in order for the company to control its dust.

The day of the concern was cool and cloudy with some humidity. Due to forecasts of rain for the next several days, I drove to the property in the morning in order to observe incidents of fugitive dust prior to rainfall. I visited the property of the concerned party on Thursday March 22, 2018. I arrived at the property at 10:20am and viewed the entrance of Quarry Road before parking at the concerned party's house. Track marks extended past Quarry Road and onto Mette Road in front of the concerned party's house. I parked in the concerned party's driveway and walked up to the entrance of the house. Ms. Fluehr walked outside upon seeing me arrive and I introduced myself. Ms. Fluehr introduced herself and I started asking her questions regarding the roads surrounding her property. She stated that Mette Road was a county road, but that she believes her property extends to the other side of the road. I replied that, though the trucks were tracking dirt onto Mette Road, the county is most likely responsible for cleaning the road. I then inquired about Quarry Road. Ms. Fluehr stated that Quarry Road, the road to the east of the property, is owned by Big Creek Quarry and dust from the raod is often coming onto her property as the trucks drive by. As we talked, haul trucks were driving to and from Big Creek Quarry, using the haul road, with a frequency of approximately two trucks every five to ten minutes. Puffs of dust lifted slightly from the road and the trucks drove by on Quarry Road before settling own after a few seconds. Ms. Fluehr stated that some of the trucks do not cover their loads as they should, which exacerbates the dust

I called Mr. Slusser and asked for more information regarding the concern. Mr. Slusser stated that the people, living at the concern location were renters that moved in last summer. They didn't burn at any particular time and had previously burned a mattress. Mr. Sulsser called the Franklin County Sheriff's Office and the Deputy told the source of the concern to not burn any plastics. I replied to Mr. Slusser that burning trash is banned in Franklin County and asked him if he knew the name of the property owner and Mr. Slusser stated that the last name of the property owner was "Picarelli."

After the call, I contacted the Franklin County Assessor's Office (636-583-6348)and obtained the name and number of the property owners. I then called the Franklin County Sheriff's Office to inquire whether they have reports on the incident that the concerned party mentioned. A Deputy from the Office stated that there was no official report on record. I also checked with the local fire district, and asked if the address had any previous incidents, to which they replied they hadn't. I waited until a clear day to visit the property. I drove to the property on March 30, 2018, arrived around noon, and parked across from the concern location. I then walked up driveway, to the front door of the house, and rang the doorbell two more times and knocked once. No one answered. Next, I retreated to the road to see if I could see anything in the backyard from the road. one the left side of the house, I observed a rusted drum with plastic material appearing over the top of the side. The material appeared to be unburned. I took a photograph of the drum and then walked back to my car to drive back to St. Louis. As I was preparing to leave, Mr. Slusser approached the car and we discussed the concern. I asked whether the source of the concern had burned since we spoke last and he stated that they had not.

On Monday, April 2, 2018 at 4:00pm, I spoke with Barbara Picarelli. I mentioned the trash burning concern and told her that trash burning is banned in Franklin County. I asked for the names and phone numbers of the renters, which she provided as Ms. Marisso Reno and Mr. Tim Harting. She stated that eh previous renter was Mr. Harting's younger brother and the brother had left a lot of junk on the property. Ms. Picarelli stated that she wouldn't have normally rented a property without removing the junk, but Mr. Harting stated he would remove it for her. She stated that she had no idea that he was burning the jink to remove it. I asked if they had a trash service and she replied that she mentioned acquiring a trash service when they first move din, but did not touch on the subject afterwards. I asked her if I could provide her number ot the complainant, in case there are future cases of burning, to which she agreed. After discussing the matter, we decided that I would call Mr. Harting regarding the concern and she wouldn't discuss it with them unless there are future/reoccurring violations. April 3, 2018 at 4:00pm, I spoke with Mr. Tim Harting, one of the renters. I told him that we received a concern regarding trash burning and informed him that trash burning is not allowed in Franklin County. He replied that the police visited the property and told him he could still burn paper. I told him that the regulation banning trash burning was a state regulation and that paper was included under the definition of "trash". He countered that he has lived in Franklin County all of his life and that he and many of his neighbors burn trash. Cole Hough: On 3-29-2018, I met with Jim Heitman at the burn site on Dameron Road. I arrived at 7:55am and saw the fire was still burning. I saw thick smoke blowing west across the RR tracks and Highway 79. The smoke had a chemical smell similar to burning plastic. I told Mr. Heitman that he had agreed multiple times to contact the Dept and meet at the burn site before the fire was lit. He said he must have gotten confused on the phone. I. Hough reminded Mr. Heitman that the previous week he told me the phone he was going to sort the burn pile again at the burn site, and burn untreated wood behind the dirt pile as the material was being sorted. I reminded him that he told me he wanted to stay for a while once they start burning to make sure I was okay with everything. Mr. Heitman responded that they had sorted unburnable material from the pile at the demolition site as best as they could and that the material they removed was on the trailer present at the burn site. He said he removed 13 tires from the burn pile before lighting it. He also said he took the few bags of household trash from the pole and put them in his home dumpster. As we viewed the burn pile, Mr. Heitman stated that a few years prior, he had demolished the old grain elevator in town, hauled the demotion waste to the farm, burned it, and buried the unburned material in the field adjacent to the burn pile from the Gladney Building. I asked Mr. Heitman when he lit the fire. He said he brought a copy of the burn permit to the fire department on Friday, March 23 and lit the fire that morning. I provided Mr. Heitman a copy of his burn permit with all of the conditions that he violated highlighted. I went over each condition and explained that he violated the following conditions:-2. Burned materials other that untreated wood such as tires, metal, siding, and plywood.-3. Did not completely extinguish the fire by 5 pm each of the 5 nights it had been burning.-5. caused a downwind nuisances by obstructing vision on the highway and RR tracks.-6. did not notify the fire department each day the fire burned.7. did not have a permit present or person on site supervision the burn when I arrived or when I saw the site on Saturday 3-24I told Mr. Heitman that the requirements from the solid waste program would most likely be satisfied once we received landfill tickets for the asbestos anddemolition waste separated from the pile. I told him that based on the inconsistencies from our conversations, the air program may pursue further enforcement action.

Concern No. 34327 Strong smell at Five Below store on north outer road coming from the city composting place. It's been stinking all week. Smelling up my car and cloths. Can you see what they are doing?

On 4/4/2018, 4/06/2018, and 4/12/2018, I visited the Earth Center Composting Facility of the City of St. Peters located at 100 Ecology Drive in response to the odor complaints received by this office on March 29, 2018 and on April 3, 2018.

The first day my visit took place from 11 AM to 2 PM . Wind was 12 MPH out of south. On the second day, I visited the area from 6:15 pm to 7:30 pm. Wind was 14 MPH out of south. On the third day, I visited the site from 12pm to 2 pm. During the times I was there, there was no odor detected by me.

The facility makes compost by mixing recycled yard waste and bio-solids from waste water treatment plant. The waste water treatment plant has two wastewater holding tanks approximately 200 yards north of the nearest stores (Five Bellow, Burlington Academy Sports) in the strip mall located between the Earth Center Composting Facility and North Outer road to 1-70. The press room (where the bio-solids is separated from liquid waste water) is approximately 500 yards away from the stores. The horizontal mound of compost also called windows which are turned five times within 15-days period (aerated) are located approximately 400 yards north of the plant.

I talked to Ms. Kristen Kubat (Five Below Store Manager) who told me that she notices very strong odor during the evening an early morning hours. I recommended to Mr. Sctneider to talk to the stores and work with them. Organizing facility tours to create awareness may help. Mr. Sctneider and I discussed the possibility of providing some kind of wind barriers including trees or walls as part of the an SOP.

I called MR. Sctneider on 4/16/2018 from this office at 10 AM. He sated that the composting facility understands the holing tanks, the windows, and the press room are the 3 possible sources of odor. He told me that he talked to the store managers and invited them to visit the composting facility and also provided his phone number asking them to call him any time odor is detected. On 4/12/2018 store manager of Five Below called him to let him know she noticed odor. Based on the information he obtained from her, he traced the source of the odor to be the receiving bays connecting the sewer lines to the waste water holding tanks (each tank is 450,000 gallons capacity) located right behind the Five Below store. Mr. Sctneider stated that his office is now working to improve the current SOPto reduce odor from the hold tanks.

Concern No. 34296 The concerned party stated that his building ( former Sally's Bar) was intentionally burned by the fire department who was in on a conspiracy with Jefferson County Code Enforcement Section. I spoke with the concerned party on 03/30/18, before receiving the online concern about this same concern. The concerned party alleges that after the building was burned down, Jefferson County place a lien on his property so that they can take control of his now empty lot. I explained during the phone conversation that I inspected the demolition of the building on 2/22/2018 and cited both he contractor and the county for failure to notify prior to the demolition and failure to inspect for the presence of asbestos.

The Jefferson County General Services Department was issued a letter of warning for failure to inspect the building for asbestos and for failure to notify. The concerned party alleges that Jefferson County and the fire department conspired to get control of his property by intentionally burning his building and then demolishing the building. The have since placed a lien on his property.

Concern No. 34383 Windy Ridge Lane from State Hwy U in Warren County to a Harbison Walker Clay Pit was graded and new rock laid on April 9-10, 2018. Complainant lives at Hwy U and dust from Wood Bogler trucks "flying" down Windy Ridge Ln is "horrible". She stated that she complained to us last year and someone put "calcium" down and solved the problem. She asked us to investigate and have them to something about the dust.

On 4/12/18, after reviewing the previous complaint report (attached), determined who to call about reapplication of dust control: I then called MR. Brandon Buel of Harbison and Walker, the operator of clay mine operating at the end of Windy Ridge Land, and he didn't realize that they had graded and added gave to the road but said they were about ready anyway to order another treatment. Mr. Buel said he will order another calcium chloride application and will call me back with how soon that it could be done.

By 10:20 a.m. the same morning, Mr. Buel called back and said the road treatment has been ordered and it should be completed today or tomorrow or no later than next Monday, depending how soon the application truck can be up and running since it was going to be the first application he will do this year. I agreed this was acceptable and that I would call complainant back with the information.

On 4-12-18, informed Ms. Polston, the complainant, of what was planned to address the matter and she agreed this was acceptable. I asked her to let me know if the matter isn't satisfactorily addressed with the dust problem continuing, to which she agreed.

This is a similar concern to the two concerns received by this office on March 29, 2018 and April 3, 2018. In response to the concerns, I visited the site (100 Ecology Drive St. Peters, Mo 63376) on the 4th, 6th, and the 12th of April 2018.

Mr. Tim Myers, Director of Utilities Department called me yesterday. He told me that the City of St. Peters understands the concerns and is looking various ways including making the two waste water holding tanks identified on 4/12/2018 as the sources of the current odor concerns fully aerated.

The findings and actions taken is also documented in concern # 15761.

Concern No. 34199 I spoke with Betty Jackson and her daughter Tina Asher. Betty’s number is 417-679-2411. She said there was new ownership or management in the past couple years. She mentioned that they used to get obvious saw dust fibers but recently someone told her it would get better but she said it has just gotten finer. She mentioned, at times, it is difficult for them to be outside when the mill is running because it has caused breathing problems. Plus they always have to clean sawdust off their property and it has ruined equipment (pool pumps). She said she has been told by others that the sawmill doesn’t keep their property or equipment cleaned up well. She made it sound like the sawmill has added some new equipment or processes in the past couple years. They appear to have no permit. I am attaching the permit data viewer document that showed in the late 1990s an operating permit was not required at the time.

I mentioned that we had a regional office in Springfield and may have someone inspect the sawmill. I gave her my number and the regional office number. My suggestion is to have the SWRO follow up with Betty and also perform an inspection on the sawmill during their prime operating hours.I wonder if we should, upon inspecting the facility, be prepared to collect samples from Betty’s property for lab analysis and possibly the facility?I also want to mention that she said she is concerned that the industry is trying to move in a legislative manner to the Agricultural Department so that there will be potential exemptions from rules.

Concern No. 34202 RP is burning tires on their property. Burned at least three tires on Tuesday, 3/20. They called the Fire Dept but when they got there, the fire was only smoldering. They are also burning an assortment of trash again that releases a very thick black smoke.

The caller stated that he previously reported this RP and we investigated. See Concern #13945 from October 2017 and #14933 from January 2018 (located in N\Jasper\General\APCP). The caller stated that the previous property owner, Donald Poulson, passed away in early February. The caller provided the most recent contacts for the property below.
