AMERICAN CONSERVATIVE UNION’S 2015 Ratings of New York

Dear Fellow Conservatives,

I am pleased to present the American Conservative Union Foundation’s ratings for the 2015 meeting of the New York State Legislature. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The New York legislators with the strongest scores voted most consistently with the ideals articulated in the US Constitution: limited and transparent government, individual rights, personal responsibility, and a healthy culture.

The 2014 election completed a political transformation that began in 2010 and resulted in voters of almost half the states, 23 in all, entrusting Republicans with the governorships as well as control of both chambers in the respective state, the biggest sweep since the first half of the 20th Century.

By examining all our State Ratings (which cover a wide variety of issues) we can see which states have best used their Republican majorities to apply conservative principles, how others have struggled, and in yet other states, how conservatives have stood up against liberal majorities. I know that this guide will provide you with the most comprehensive evaluative tool to learn how your legislators measure up.

ACU researched and selected a range of bills before the New York State Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of New York’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. S 1976 Tax Credits. This bill expands tax credit programs for donations to public education entities, school improvement organizations, local education funds and education scholarship organizations. ACU supports tax credit programs as a means to support these activities rather than through increased government spending and supported this bill. The Senate passed the bill on January 21, 2015 by a vote of 44-16.

2. S 3709 Property Tax Cap. This bill caps property tax increases in New York City at two percent annually or the Consumer Price Index, whichever is less. ACU supports reasonable tax restrictions for a city with the highest property taxes in the country and supported this bill. The Senate passed the bill on March 19, 2015 by a vote of 42-15.

3. S 2159 Legalizing Martial Arts. This bill legalizes mixed martial arts in New York and will have it regulated by the state athletic commission. ACU supports legalizing a sport that is legal in every state except New York and supported this bill. The Senate passed the bill on March 24, 2015 by a vote of 47-14.

4. S 5837 Firearm Regulation Reform. This bill makes some modest reforms to New York firearms laws, including increasing the notice and due process requirements for firearm owners and clarifying notification requirements for those who are entered into the mental health database. ACU supports the founders’ belief in the Second Amendment and supported this bill. The Senate passed the bill on June 8, 2015 by a vote of 35-26.

5. A 6258 Local Government Borrowing. This bill extends the borrowing authority of local governments to deal with the funding of state mandates. ACU opposes increasing the debt burden on local taxpayers for unfunded mandates, a practice that will lead to higher taxes when the solution is to reduce unfunded mandates and opposed this bill. The Senate passed the bill on June 11, 2015 by a vote of 61-0.

6. S 3438 Welfare Reform. This bill requires welfare recipients who do not have a high school diploma or equivalency to participate in good faith in an educational program that will lead to either. ACU supports reasonable requirements for welfare benefits and supported this bill. The Senate passed the bill on June 17, 2015 by a vote of 40-23.

7. S 4686 Hunting Trophy Ban. This bill bans the importation, possession, sale or transportation of the “Big Five African Species,” and includes hunting trophies. ACU opposes this ban on hunters bringing home their trophies from their legally sanctioned hunts as self-defeating, as the monies spent by the hunters is a critical component of wildlife conservation efforts in Africa and opposed this bill. The Senate passed the bill on June 17, 2015 by a vote of 33-30.

8. S 4505 Funding for Federal Terrorism Trials. This bill prohibits the expenditure of state, local or public authority funds to pay for federal trials of terrorists. ACU opposes burdening state taxpayers with the costs of these trials that the federal government choose to take place in New York and supported this bill. The Senate passed the bill on June 17, 2015 by a vote of 42-21.

9. S 6012 Omnibus Bill. This bill, dubbed “the big ugly” by lawmakers themselves, combines many small bills on disparate issues that should be voted on separately, including the extension of rent control, a bailout of the city of Yonkers and extending mayoral control over the New York City school system. ACU opposes rent control, a corrupt system that fixes some rents well-below the market price, driving up the price of other rents, and opposed this bill. The Senate passed the bill on June 25, 2015 by a vote of 47-12.

1. A 4311 Illegal Immigrant Benefits. This bill provides scholarships and state higher education financial aid to illegal immigrants. ACU opposes special benefits for illegal immigrants and opposed this bill. The Assembly passed the bill on February 26, 2015 by a vote of 87-45.

2. A 3870 Worker’s Compensation. This bill expands the definition of worker’s compensation to include paid family leave. ACU opposes this raid on the worker’s compensation fund which is supposed to provide for those who suffer job-related injuries and opposed this bill. The Assembly passed the bill on March 17, 2015 by a vote of 97-48.

3. A 6221 Codifying Abortion Law. This bill sets into New York State law the right to an abortion up to 24 weeks of pregnancy or for the health or safety of the mother. ACU believes abortion is a human tragedy, supports restrictions on the practice and educating patients and opposed this bill. The Assembly passed the bill on March 25, 2015 by a vote of 95-51.

4. A 3003 Taxpayer Funding of Abortions. This budget bill for 2015-16 includes taxpayer funding for abortions. ACU believes abortion is a human tragedy, supports restrictions on the practice and educating patients and opposed this bill. The Assembly passed the bill on March 30, 2015 by a vote of 139-9.

5. A 5612 Toy Regulation. This bill requires that toy manufacturers report the use of certain chemicals labeled as “toxic” by the government to a government agency and pay a $500 fee for using the chemicals. ACU opposes this overly broad bill that does not differentiate between added chemicals and those that are naturally occurring in safe toys and opposed this bill. The Assembly passed the bill on April 22, 2015 by a vote of 112-29.

6. A 6072 Renewable Energy Mandates. This bill requires the state to generate 50% of its energy from renewable sources by 2030, regardless of the cost. ACU believes that all forms of energy should compete within the free market and government should refrain from helping favored energy sources and opposed this bill. The Assembly passed the bill on April 22, 2015 by a vote of 99-41.

7. A 5844 Fluorescent Lightbulb Ban. This bill bans the sale of most fluorescent lamps and bulbs that contain mercury. ACU believes that people should have the right to choose the lightbulbs they want without interference from the government and opposed this bill. The Assembly passed the bill on April 22, 2015 by a vote of 134-6.

8. A 1574 Equal Pay Mandate. This bill sets up a new bureaucracy to enforce a standard of paying employees “equal pay for equal work” as defined by the government. However, union contract seniority systems are exempt from this mandate. ACU opposes these government mandates that interfere with the right of employees to negotiate their own contracts and opposed this bill. The Assembly passed the bill on April 27, 2015 by a vote of 104-41.

9. A 7257 Minimum Wage. This bill raises the minimum wage to $15 an hour in the New York City area and $12.50 an hour in the rest of the state by 2018, then raises it automatically each year by the rate of inflation without a vote of the legislature. ACU opposes these artificial wages that are detrimental to those who most need help finding employment such as students and inexperienced workers and opposed this bill. The Assembly passed the bill on May 4, 2015 by a vote of 97-43.

10. A 5062 Single Payer Health Care. This bill sets up a single-payer health care system that would put the government in charge of the entire health care system. ACU supports a free market system of health care and opposed this bill. The Assembly passed the bill on May 27, 2015 by a vote of 92-52.

11. A 6258 Local Government Borrowing. This bill extends the borrowing authority of local governments to deal with the funding of state mandates. ACU opposes increasing the debt burden on local taxpayers for unfunded mandates, a practice that will lead to higher taxes, when the solution is to reduce unfunded mandates and opposed this bill. The Assembly passed the bill on May 28, 2015 by a vote of 137-0.

12. S 1757 Powdered Alcohol. This bill bans the sale of powdered alcohol in New York State. ACU opposes bans on legal products that are primarily designed to reduce competition and opposed this bill. The Assembly passed the bill on June 11, 2015 by a vote of 139-4.

13. A 2990 Employment Regulations. This bill prohibits employers from inquiring about a criminal record until what is described as a “conditional offer of employment” is made. ACU opposes this interference in the free market and opposed this bill. The Assembly passed the bill on June 15, 2015 by a vote of 98-49.

14. A 53 Mandatory Storage of Firearms. This bill makes it illegal to possess a firearm in the home if the firearm is not under lock and key or stored in a safe, among other provisions. ACU supports our founders’ belief in the Second Amendment and opposed this bill. The Assembly passed the bill on June 16, 2015 by a vote of 81-66.

15. A 5955 E-Cigarettes. This bill puts the same restrictions on e-cigarettes as regular cigarettes and bans them from public places. ACU believes that both tobacco and e-cigarettes are a personal liberty issue, that government regulations on products are only appropriate when their use substantially impacts others and opposed this bill. The Assembly passed the bill on June 18, 2015 by a vote of 85-58.

16. S 4978 Bonding Authority Increase. This bill increases the New York State Housing Agency’s bonding authority by 18%, raising it to $21.8 billion. ACU opposes these major increases in the state’s debt that will eventually lead to tax increases and opposed this bill. The Assembly passed the bill on June 19, 2105 by a vote of 124-15.
