Minister for Interior (Mr. A. Rehman Malik): (a) At present thereare 71 Passport Offices functioning in the country. Detail thereof is given atAnnex-“A”.

(b) The province wise total number of passport offices established duringthe last four years is given at Annex-“B”.

Proposals regarding establishment of new Passport Offices in the followingareas is under consideration of the Government:

i. Dalbandinii. Upper Diriii. Bat Khelaiv. Chillasv. Chiniotvi. Okaravii. Renala Khurdviii. Bhalwal

Furthermore, PC-I for establishment of 84 new passport offices (Districtwise) has been submitted to Planning Commission for soliciting approval fromCDWP. The Department of Immigration and Passports has planned to establishthese offices during the period 2012–2015 subject to approval by PlanningCommission.

Will the Minister for Economic Affairs and Statistics be pleased tostate:

(a) whether it is a fact that a number of small and mediumenterprises of peach farm have been trained under therevitalization programme of USAID for the development of saidsector during the last four years till date; if so, the details of thesaid programme; and

(b) the steps taken by the government in this regard so far?

Minister for Economic Affairs and Statistics (Dr. Abdul HafeezSheikh): (a) Since October 2011, USAID has successfully trained/established449 peach farm small and medium enterprises (SMEs) in Swat through an offbudget project “Firms” with the grant assistance of US $ 0.6 million. US assistanceincludes training, infrastructure, supplies, technical support, tools and -certificatesfor peach farm SMEs of Swat.

(b) Government of Pakistan has encouraged donors to assist its effortsin bringing Malakand and Swat region to regain their economic activity. In thisregard US government has also concluded a grant program to revitalize the troutfarm and hospitality industry SMEs, such as hotels and guest houses in Swat,under its Malakand recovery effort.

39. *Mr. Jamshaid Ahmad Dasti:

Will the Minister for Finance, Revenue and Planning andDevelopment be pleased to state:

(a) the year-wise amount given to each province under the head ofGST and other taxes levied on petroleum products during thelast four years;

(b) whether any consultation has been made with provinces whileimposing GST and other taxes on petroleum products; if so, thedetails thereof; and

(c) whether the recommendations of the provinces have beenaccommodated in the said process during the said period; if so,the details thereof?

(a) whether it is a fact that reports of the National Commission forGovernment Reforms (NCGR) and the National GovernancePlan (NGP) approved by the Cabinet in December, 2009 have

43. *Mr. Wasim Akhter Sheikh:

Will the Minister for Finance, Revenue and Planning and Developmentbe pleased to state:

(a) the detail of those projects whose PC-I and PC-II have beencompleted during the period from 1-3-2008 till date;

(b) whether it is a fact that those projects are pending at present; ifso, the reasons thereof;

(c) the total amount of expenditures incurred on the completion ofPC-I and PC-II of the said projects ; and

(d) the steps being taken by the Planning Commission for making aplan for timely completion of projects and to avoid extraexpenditures being incurred on the preparation of PC-I andPC-II?

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): (a) PC-I and PC-II of the projects are prepared bythe sponsoring Ministries/ Divisions. Planning Commission process approval ofPC-I & PC-II on receipt from Ministries/ Divisions/ Provinces. During the saidperiod, 708 PC-I and PC-II of the projects were processed for consideration/approval by the CDWP. Out of this, 320 PC-I/PC-II were approved by theECNEC during the said period.

(b) At present 193 PC-I & PC-II of projects are pending under processfor approval of CDWP/ECNEC. Such pendency is natural as projects requiresome time for examination and completion of formalities including collecting requiredinformation from the sponsors and preparation of working papers for CDWP/summaries for the ECNEC before submitting the projects to the relevant forumfor consideration approval.

(c) PC-I and PC-II are prepared by Ministries/ Divisions/ Provinces.The record of expenditure incurred on preparation of PC-I/ PC-II is maintainedby them.

(d) Development strategy of Planning Commission is based on:–

– Projects nearing completion be fully protected.

– Development Peckages be protected.

– Contractual bindings with foreign donors be obliged.

– Only new approved projects falling in government’s priorities.– Projects of less developed areas be protected.

• Resultantly, over 96% funds have been allocated to ongoingprojects under federal PSDP 2012-13.

• During Current Fiscal Year emphasis is to complete 357 projectsby June, 2013 out of which 191 projects would be completedby December, 2012.

97. *Mr. Sajid Ahmed:

Minister for National Harmony: (a) (i) ETP Board has establishedSecurity Wing in the year 2009, wherein presently 531 permanent and 400 dailywages personnel have been deployed on all the religious/worship placed all overPakistan to keep up the internal security.

(ii) Installation of security system at Gurdwara Dera Sahib Lahore,Gurdwara Punja Sahib, Hassanabdal and Gurdwara Janam Asthan Nankana Sahibincluding CCTV cameras, luggage scanners, metal detectors, walk through gatesetc.

(iii) Installation of generators at Gurdwara Dera Sahib Lahore, GurdwaraPunja Sahib, Hassanabdal and Gurdwara Janam Asthan Nankana Sahib.

(iv) Close coordination with respective DCOs/DPOs to make fool proofsecurity arrangements for the shrines.

5. *Ms. Nighat Parveen Mir:

Will the Minister for Interior be pleased to state:

(a) the steps taken by the Government during the last two monthsto control target killing in the country alongwith the resultsachieved therefrom; and

(b) the location-wise number of incidents of target killings occurredin the country during the said period?

Minister for Interior (Mr. A. Rehman Malik): (a)

ICT

HALTING POINTS:

Within ICT, 29 Halting Points have been established from 1600 hours to2200 hours with break up of 12 in City Zone, 09 in Saddar Zone, 10 in I-AreaZone. At these halting points, 51 vehicles have been deployed.

Whereas, from 1359 hours to 0600 hours the number of halting pointshave been increased and rose to 126 number. At these halting points, 63 vehicleshave been deployed to keep in eye over suspicious persons/ vehicles to controlthe target killing.

PATROLLING:

The patrolling system within ICT have been revamped and 15 Falconsand 16 pairs of Eagle Motorcycle alongwith 06 Commandos vehicles have beendeployed which is working in three shifts for surveillance and to combat the targetkilling.

SURVEY OF RENTED HOUSES/ PLACES:

Besides this, time to time surveys of houses/ place given on rent are beingconducted at Police Station level to ascertain the types of keep an eye over theiractivities as well as to control the target killing.

SURVEYS OF MOSQUES / DEENI MADARIS:

Detailed surveys of Mosques situated within ICT have been carried out.There are 827 Mosques within ICT. Out of which, 460 from Brailvi, 285 Deobandi,36 Ahle Tashee, 34 Ahle Hadis & 12 Miscellaneous sects.

The survey of Deeni Madaras revealed that there are 280 Madaras situatedwithin ICT. Out of which 118 from Brailvi, 147 Deobandi, 05 Ahle Tashee, 08Ahle Hadis & 02 Miscellaneous Sects.

Survey of Mosques and Deeni Madaras on regular basis may help inprevention of target killing on sectarian basis.

ESTABLISHMENT OF NAKAS:

Total 60 Naka Bandi points i.e. City Zone 24, Saddar 18 Industrial Area14, Rural 04 have been established on various key points of ICT which arefunctioning round the clock. Proper Nakabandi of all exit and entry points ofIslamabad are also being held randomly alongwith other places at different venuesand times.

PUNJAB:

Activities of the following are being monitored closely to control the targetkilling in the Punjab province.

• Afghan Trained Boys (ATBs).• Returnees from Afghan Prisons (RAPs)/Guantanamo Bay.• Sectarian prisoners released from Jails.• Madaris involved in militancy.• Lal Masjid Elements (LMEs).• Firebrand speakers of different sectarian organizations.• Publication and distribution of hate material.

SINDH

LAW & ORDER SITUATION IN SINDH PROVINCE:

Overall law & order situation in Sindh is comparatively stable and peacefulexcept incidents of factional violence and random killings.

TARGET KILLING IN KARACHI:

Over view:

Ethnicity, Sectarianism and in fighting among various politico/ religiousgroups.

Organized criminal gangs and land grabbers under the umbrella ofpolitical parties.

KHYBER PAKHTUNKHWA:

i. Extra ordinary vigilance.

ii. Share of intelligence with other Law Enforcing Agencies.

iii. Effective Police Patrolling round the clock and establishment ofadditional checkpoints at conspicuous places of the District.

iv. Detection of most of the crimes & interrogation of suspects.

FATA:

In FATA special focus has been maintained and measures in shape ofdeployment of LEAs on all routes leading to and from the Agencies to ensure thattarget killing in the jurisdiction of respective Agencies is effectively controlled. Dueto the efforts of respective Political Administrations target killing in FATA has beenbrought down to the minimum. With exception to only one incident which happenedon 11-10-2012 in North Waziristan Agency in which 03 persons were killed andone injured.

BALOCHISTAN

SECURITY ENHANCEMENTS:

• Balochistan Police has strengthened all exit/ entry points at provincialand district level. Besides police check points (Nakas) were alsoestablished in and around the cities.

• CCTV Cameras have also been installed at key points within theprovincial Capital and all entry/ exit points of Quetta District.

• Security of the troubled spots has been enhanced in order to providesecurity to the settlers and Shia community.

• Traders belonging to Shia Community are being escorted from HazarGanji to Hazara Town and onward up to Marriabad Quetta.

• Zaireen of Shia Community traveling from Quetta to Iran are alsobeing escorted throughout the route by District Police and LeviesForce in the area of responsibility.

• Districts Police is conducting random checking through “BlockRaids”.

• Ban under section 144 CrPC was imposed by the government ofmotorbike pillion riding.

• Display of arms has also been prohibited under section 144 CrPC.

• Special Mobile Patrolling teams were constituted to perform dutiesin troubled areas.

• Proper surveillance of rented buildings / hotels/ sarais is being regularlycarried out by local Police and Special Branch Balochistan.

• Strict Watch on suspects/ illegal immigrants.

INTELLIGENCE SHARING

• Intelligence sharing with other stakeholders.

• Inter Provincial Intelligence Meetings / Conferences.

In the wake upsurge in violence, Karachi Police has undertaken thefollowing measures:

IMF

An amount of US $ 7,878 million received under the Stand-ByArrangement (SBA) and Emergency and National Disaster (ENDA) US $ 452million. The programme achieved desired targets during November 2008 toSeptember 2011 mentioned below:

I. Considerable improvement in current account balance from -$ 9,261million during 2008-09 to +214 million during 2010-11.

II. Increase in Foreign Exchange Reserves from $ 6,432 million during2008-09 to $18,247 million during 2010-11.

III. The Exchange Rate for the US Dollars remained stable most of thetime at around Rs.85 per dollar. The exchange rate was Rs.78.86per dollar at the beginning of program.

IV. The flow of foreign remittances which was $6,432 million at thebeginning of programme rose to $18,247 million by the end of June,2011.

V. Inflation tamed from 25% to 14%.

OTHER FINANCIAL INSTITUTIONS

In addition to the above loans, other Financial Institutions assisted inovercoming the budget deficits and funding the development projects whichcontributed in improving the economy as under:

I. The foreign assistance received from other financial institutions helpedin combating the natural disasters like floods and earthquake in therecent past. The relief and rehabilitation activities were carried outand reconstruction activities are being carried out.

II. It helped bridging the resource gap to carry out the major developmentprojects which generated a lot of economic activity and employmentin the economy. After operationalization, these projects arecontributing their share in the economy.

III. The economic assistance from the other financial institutions enabledthe country to invest in the social sector especially in the educationand health. Even more resources are required to be injected in thesocial sector to meet the targets and improve social service delivery.

IV. These financial institutions contributed in poverty alleviation.

(d) The total amount of interest to be paid on loans from other FinanciarInstitutions during 01-07-2012 to 30-06-2047 is projected to be US$3,200million. While total amount of interest to be paid to IMF is $58.19 million duringFY 2014—2027.

8. *Mrs. Nisar Tanveer:

Will the Minister for Finance, Revenue and Planning and Developmentbe pleased to state:

(a) the prescribed criteria to asses the claims of tax refunds andsubsequently make their payments to the applicants by the FBR;

(b) the month wise number of tax returns having been made by theFBR during the last four fiscal years;

(c) the year-wise number of claims rejected during the said periodalongwith the action taken against the responsibles; and

(d) whether it is a fact that the cases of tax returns have not beenfinalized timely during the last quarters of said period in orderto show higher figures of tax collection; if so, the steps beingtaken to make the affairs of FBR transparent?

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): (a) FBR has specifically developed a state of theart computerized Refund Processing System to deal with refund claims of SalesTax & Federal Excise. Each and every claim is being processed through the saidsystem. Claims can only be finalized after verification of each and every purchaseinvoice from the Central Data Depository on the basis of First-in-First-out.However, some specific details are given below.

Sales Tax /FED

The prescribed criteria have been mentioned in Refund Rules, 2006 issuedby the FBR, Islamabad. Step-wise procedure is as follow:

(i) The refund claimant shall file refund claim through RCPS on prescribedsoftware.

(ii) Documents as provided in Sales Tax Rules, 2006 shall be submittedalongwith refund claim.

(iii) Lawful and admissible refund is processed through STARR software.

(iv) The process of issuance of refund cheques is centralized on the basisof RPO issued by the RTOs and uploaded in STARR software issuedon the basis of RPO generated by the refund processing unit.

Income Tax

The process of issuance of refunds in the Income Tax is governed underthe provisions of circular No. 5 of 2003 (Annex-A).

(c) The year-wise number of claims rejected “Annexed-C”.

(d) In this regard it is clarified that such practice is not prevalent in theorganization.

(a) the mandate of Competitive Commission of Pakistan upon whichit was actually established;

(b) the steps taken against the different cartels, companies andassociations launched by the said commission since March, 2008till date alongwlth the achievements gained therefrom; and

(c) the impact of those steps on general public?

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): (a) The Competition Commission of Pakistan (CCP)was established under the Competition Act, 2010 to provide for free competitionin all spheres of economic activity, to enhance economic efficiency and to protectconsumers from anticompetitive behavior.

(b) CCP has taken significant enforcement actions and unveiled somesignificant cartels that have a far reaching impact in industries, like banking, cement,sugar, LPG, poultry, edible oil etc. It has also taken action against powerful lobbiesand vested interests that has earned CCP the reputation as a fair and independentgovernmental agency. It has also taken actions against various trade and professionalassociations such as Pakistan Banking Association, All Pakistan NewspaperSociety, All Pakistan Cement Manufacturers Association, Pakistan PoultryAssociation, Jute Mill Association, Pakistan Ship’s Agent Association, All PakistanSugar Mills Association, Institute of Chartered Accountant of Pakistan etc.

ACHIEVEMENTS GAINED FROM ACTIONS TAKEN:

• In the short span of 05 years, 58 decisions/orders were passed, 34enquiry reports and 416 show cause notices were issued. 14 search& inspections were carried out, 396 exemptions were processed.Various sectoral research/studies were carried out, and 13 policynotes and 311 merger NOCs were issued. Penalties amounting toRs. 8.542 billion were imposed on various undertakings andassociations. As a part of statutory mandate, CCP has been conductinginnumerable advocacy sessions with consumers’ protectionassociations, media and general public business entities.

In this process, CCP had achieved successes throughcompliances and commitments. In cases relating to the jute mill cartel,a sum of Rs. 23 million as a penalty has even been recovered anddeposited in the public exchequer.

• 100% compliance has been enforced in respect of prohibitingdeceptive marketing provision under Section 10 of the CompetitionAct, 2010.

• CCP became the first regulatory authority from South Asia has beenshort listed by Global Competition Review (GCR) for theenforcement award in the category “Agency of the year - Asia Pacific,Middle East and Africa for 2012”.

• Due to effective enforcement of competition law, the United NationsCommission on Trade and Development (UNCTAD) has accededto CCP’s voluntary request for ‘Peer Review’ which shall be financedby UNCTAD.

(c) IMPACT ON GENERAL PUBLIC:

Causing Deterrence, Creating Awareness Through Advocacy andBuilding a Culture of Compliance for Rectifying Anticompetitive Behavior:

• CCP’s actions have created deterrent impact on businesses.

• As a part of due process, various actions taken and the penaltyimposed have been challenged before the Courts and are pendingadjudication. The competition law enforcement activities have createda deterrent effect on both the public as well as private sectorundertakings found involved in abusing its power and CCP hasworked towards protecting the consumers from anti-competitivepractices - such as falling victim to collusive behavior, deceptivemarketing or abuse of dominant position.

• The Commission is striving to ensure competitive pricing, free interplayof market forces which consequently have promoted competitivenessand consumer welfare.

It also helps in building and improving theimage across Pakistan -thereby opening avenues for foreigninvestment.

12. *Sheikh Muhammad Tariq Rasheed:

Will the Minister for Finance, Revenue and Planning and Developmentbe pleased to state the steps being taken to take advantages to boostup/develop the economy of the country by the outward orientedeconomy of the Middle East countries, China and SAARC?

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): Outward orientation and likely benefits thereofdepends upon economic conditions in the host country, trade policies of bothcountries, mutually explored areas of cooperation, trade agreements,competitiveness of products and ability to generate exportable surplus accordingto the needs of the host country. Steps taken by the Government in this respectinclude:

i. The Strategic Framework for Trade 2009-12 was focused ondiversification of exports to unexplored areas and uses it for boostingeconomic growth in the country.

ii. Free Trade Agreements (FTA) with China and Sri Lanka paid thedividend as the share of exports to China quadrupled from 2.1% in2003-04 to 8.5% in 2011-12 and exports to Sri Lanka inched upfrom 0.7% to 1.2% in this period.

iii. Trade relations with India have improved in recent past and the exportsdestined to India have doubled its share from 0.7% in 2003-04 to1.4% in 2011-12. Recent efforts to further remove irritants may alsobenefit both countries.

iv. Exports have more than doubled between 2003-04 and 2011-12from $12 billion to $25 billion. The global environment was notconducive because of global financial crisis and European debt crisis.The share of exports destinations like US, UK, UAE and EUcountries fell drastically in this period. The government has providedaccess to non-traditional markets.

v. Currency Swap arrangements were finalized with China and Turkeyin 2011-12 to further ease of settlements between importers andexporters.

vi. The domestic supply constraints also played adverse role for the lastfour years. The government tried to address supply bottlenecks.

vii. The on-going tariff rationalization drive will also enhancecompetitiveness of local industries.

viii. Reforms envisaged in the Framework for Economic Growth (FEG)are aimed at enhancing productivity of resources and generateexportable surplus in the economy.

Minister for Interior (Mr. A. Rehman Malik): (a) ComputerizedNational Identity Card (CNIC) is issued only to the genuine citizen of Pakistan.NADRA has uniformly implemented clear and well-defined Business Rules/Policiesfor processing of CNICs. To avoid any fake processing, NADRA has takenfollowing measures to ensure validity, transparency and authenticity:

1. Physical Presence of the Applicant.—An applicant has to bephysically present at the time of processing at Data Acquisition Units(DAUs).

2. Documentary Requirements.—The applicant has to provide relevantdocumentary proofs at the time of processing, without which his/herapplication is not processed.

3. Capturing of Biometric & Textual Data.—At the time ofprocessing, all finger/thumb impressions and photograph of applicantis captured along with his/her textual information.

4. Submission of Attested Forms.—To further ensure authenticity,NADRA has made it mandatory to get the Forms attested by anauthorized attester including, gazetted officer, Members of LocalBodies, Lumbardars etc, who have gross roots in the public beforesubmission of the Form to NADRA Offices.

Fee for Applicants who have more than one CNIC.—Applicantswho have succeeded to obtain two or more CNICs prior toimplementation of Automated Finger Identification System (AFIS)and Facial System, have been levied a substantial fee for cancellationof their fake CNICs to avoid such illegal practices.

6. Check on staff.—NADRA Vigilant check has also been keptconstantly on staff involved in registration process. All RegionalDirector Generals hold proper Court of Inquiries and take strictdisciplinary action against employees, involved in manipulating/misusing the registration system as per existing rules / regulations ofNADRA.

Will the Minister for Finance, Revenue and Planning and Developmentbe pleased to state:

(a) whether there is any proposal under consideration of theGovernment to establish a new “Custom Border Force” tocontrol smuggling in the country;

In view of the fact that border protection is very importantactivity and effective enforcement is imperative, the induction of large number ofpersonnel for border protection is being given a serious consideration in the FederalBoard of Revenue. Minister for National Harmony: In the wake of 18th Constitutionalamendment and considering the present Geo Political circumstances in Pakistan,there is strong need for developing National Harmony amongst various Non-Muslim communities residing in Pakistan and contributing to the best of their abilitiesin socio-economic development of the country. Therefore after devolution ofMinistry of Minorities it was felt expedient to have a Ministry of National Harmonyat Federal level and the same was created.

2. Since the creation of this Ministry, efforts are being made to bringharmony among different religious communities. Number of religious functions ofminorities have been arranged at official level, where religious leaders as well ascommunity from different religions like Christians, Hindus, Sikhs, Bahai’s andMuslims participated. The detail is as under:—

i. Interfaith Dewali, celebrated on 17th November, 2011 at PNCA,Islamabad, at official level.

ii. Interfaith Christmas-2011, celebrated on 24th December, 2011 atFatima Church, Islamabad, at official level, where the Prime Ministerof Pakistan was the chief guest.

iii. Interfaith Easter-2012 was celebrated on 11 th April, 2012, at officiallevel.

3. Number of community meetings on different issues of minorities wereheld to develop consensus of different religions. Similarly, the idea for establishmentof District Interfaith Harmony Committees was conveyed to the Provinces and inProvinces; these committees are working at district level, satisfactorily.

4. An International Interfaith Conference has been planned to be heldin the month of September, 2012. After the Conference a formal Policy on interfaithharmony will be framed.

5. The work on “Establishment of Hotline in Ministry of NationalHarmony” to redress the grievances of Minorities is underway. This Hotline wouldbe aimed on the following objectives:

a. An aggrieved person from a minority community may record hisgrievance on hotline and local administration will be contacted toresolve his issue, immediately.

7. An Interfaith meeting between the Adviser / Minister (Incharge) witha delegation of Canadian Parliamentarians was also held at Canadian HighCommission and were informed about the steps taken by this Ministry for thepromotion of interfaith harmony.

8. Minorities Day is celebrated on 11 th August each year. The purposeof this day is to recognize the services and contribution of minorities in the creationand nation building of Pakistan and is in accordance with the vision of our foundingfather.

9. Higher Education Commission, Islamabad and Federal / ProvincialDirectorate of Education have been contacted to introduce interfaith harmony asthe part of educational curricula in educational institutions.

(b) whether it is also a fact that the FBR has planned to start aproject for setting up a tracking system to track all containersgoing for trans-shipment to Afghanistan and Central Asiancountries during the year 2011;

(c) whether it is also a fact that the aforesaid project has beendelayed; if so, the reasons thereof; and

(d) the steps being taken to establish state of art tracking system tostop pilferage of billions of rupees on the said trade route?

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): (a) It is not correct to say that billion of rupees arebeing pilfered /evaded due to non-existence of a proper tracking system on traderoute to Afghanistan. Transit of goods to /from Afghanistan is allowed under therecently negotiated and finalized Afghanistan-Pakistan Transit Trade Agreement(APTTA), 2010. Through the said agreement a number of additional safeguardmeasures have been introduced to ensure en route integrity of transit consignments,and tracking of transit cargo is one of these measures.

(b) FBR has developed “Safe Transportation Environment Project” meantfor real time tracking of all types of bonded cargo (on which duty and taxes arenot paid at the Customs port of entry), including transit cargo, through use ofmodern technologies. The Tracking and Monitoring of Cargo Rules, 2012 havealso been notified in this regard by FBR, which provide for licensing of trackingcompanies for these purpose. So far one non-exclusive license has been grantedunder the said project, after undertaking requisite steps including advertising theproject, and technical and financial evaluation of interested firms, for transparentselection of the suitable firm(s).

(c) Pilot of the project was run in the first week of September, 2012,and feedback of the stakeholders is being reviewed alongwith concerns reportedregarding the licensing regime. The licensing rules have also been challenged beforethe Sindh High Court, Karachi, where the matter is still sub judice. The issues athand are expected to be resolved/decided before the end of this calendar year.

As soon as, the supply of Booklets is restored, the pending passports willbe cleared on top priority basis by arranging shifts round the clock and on closedholidays.

2. The recommendations of Establishment Division are under activeconsideration in the Finance Division, taking into account its implications on theexisting administrative structure, finances and its future impact on feeder posts forpromotion to Section Officer as one-time grant concept is alien to Rules/Law.

(a) whether it is a fact that pension benefits are not being providedto those pensioners who have been retired during the periodfrom 1-1-2012 till date due to strike of the employees of AGPR;

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): (a) All the pension cases of the pensioners, whohave been retired during the period from 01-01-2012 to 31-08-2012, are beingdealt with and nothing has been held up due to strike in AGPR. Though, routinebusiness of pension section was disturbed due to strike in the month of July, 2012,but it has resumed its normal operations immediately since the strike was over.There is a routine pendency in the section in cases where banks/departments werealready intimated for want of necessary documents. The same will be finalized asand when the required documents are received from the quarters concerned.

34. Mr. Jamshaid Ahmad Dasti:

Will the Minister for Finance, Revenue and Planning and Developmentbe pleased to state:

(a) whether it is a fact that the AGPR has not fixed so far the salariesof upgraded/promoted Trained Graduate Teachers presentlyworking in BPS-16 under the Federal Directorate of Education,Islamabad; if so, the reasons thereof; and

(b) the steps being taken by the AGPR to fix the salaries of aforesaidteachers at an earliest?

(c) the details of cases of FBR being dealt by those qualified Lawyers/Advocates at present alongwith the total amount of fee paid tothem in each case during the year 2011-12 till date?

Minister for Finance, Revenue and Planning and Development(Dr. Abdul Hafeez Sheikh): (a) Advocates on the panel of FBR are placed bythe Law Division after scrutiny and-careful examination of credentials, qualificationand competence of such advocates. Thereafter the FBR keeping in view theexperience and knowledge of advocates about respective fiscal law i.e. IncomeTax, Customs, Federal Excise Duty and Sales Tax endorse their names to itsrelevant field offices which may be Collectorate of Customs are LTUs/RTOsdepending upon the special expertise of the advocate in the field of respectivefiscal laws. Further while assigning the court cases experienced and knowledge ofthe advocate for handling tax cases is always kept in view. Therefore, it is statedthat cases of FBR and its field formations are not entrusted to non-qualifiedadvocates rather their qualification and experience is judged first by Law Divisionand then FBR and its field formations also make sure about the competence andexperience in the respective fiscal law before assigning them cases.

(b) There are 358 advocates on the panel of advocates of BR and theirnames have been circulated to respective field formations for assigning them casesin the light of their experience and competence. List of advocates on the panel ofadvocates of FBR and its field formations is at Annexure-‘A’.

(c) Litigation issues in Federal Board of Revenue are quite different ascompared to other Ministries/Divisions of government. In the FBR offices, causeof action/litigation mostly arises because of the actions initiated by the field officersfor ensuring correct application of Customs Act 1969, Sales Tax Act 1990, FederalExcise Duty Act, 2005 and Income Tax Ordinance, 2001. When the interpretationof law and determination of duties/taxes made by the departmental officers is notacceptable to the taxpayers, they invoke the appeal or writ jurisdiction of courts.Thus litigation is a constant and perpetual phenomenon for determination, assessmentand collection of taxes and is handled by the respective officers and casesrepresented in the court through advocates on panel.

1. At present about 11000 appeals/petitions by or against the FederalBoard of Revenue are pending in different courts with their details as under:—

Supreme Court: 1406

High Court, Lahore: 6116

Sindh High Court: 2285

Peshawar High Court: 348

Balochistan High Court: 72

2. The appointment of advocates and fee to be paid to them by FBRand its field formations is governed by rule 27(A) of Rules of Business. Normalfee structure as prescribed by Law and Justice Division is as under:—

i. Supreme Court Rs.50000/- for 1st case and for additionalidentical each case Rs.10,000/- aggregate fee shall not exceedRs. 2,00,000/-.

ii. High Court Rs.30,000/- for 1st case and for additionalidentical each case Rs.4,000/- aggregate fee shall not exceedRs.1,00,000/-.

3. During the year 2011-12, in most of the cases, normal fee has beenpaid to the advocates according to the above stated fee structure issued by Law& Justice Division.

(i) FBR and its field offices engage advocate/advocates forrepresentation before the Courts on special fee only where issue/matter involved in litigation has large revenue impact and oppositeside is also being represented before the Court by some prominentand high profile advocate/advocates. Chairman, FBR is competentto sanction special fee to an advocate upto Rs.1 million and feebeyond this amount is approved by the Law Division.

(ii) List of advocates alongwith names of cases where special fee hasbeen paid is enclosed as annexure 'B'. For the remaining cases, feeat prescribed rates is paid.

(iii) Total fee paid by FBR and its field formations to advocates for theyear 2011-12 till date is as under:—
