Since opening in June 2007, Emporium Hotel has always taken a noteworthy interest in social, environmental and conservation issues.

We believe strongly that as a responsible corporate citizen, we must adopt socially and environmentally sustainable practices relating to all aspects of our business.

Some initiatives that we have in place are:

• We ensure recycling is in place at your event and monitor the effectiveness. We

will collect all paper items at the end of your function and dispose of them correctly

• We ensure a waste management plan that addresses all types of waste

• We ensure all printing and photocopying is printed double sided where possible and printed on the minimal size

• We have installed plasma screens to display conference signage rather than paper

• Where possible, we use water jugs and glasses rather than plastic water bottles

• Our staff are trained and encouraged to turn off air conditioning and lighting when not in use

• We ensure all equipment is turned off at the switch when not in use

Conference Centre Terms and Conditions Booking confirmation

• Bookings will not be confirmed unless the requested deposits are received. If any of the applicable deposits are not received by the due date, Emporium Hotel reserves the right to release the function space without further notice to you.

• 50% deposit is required to secure your booking • Your contract and the terms and conditions must be signed to secure the booking

Conference Room Availability

• The Emporium Hotel reserves the right to allocate the most suitable room for your function. Should the unexpected happen, we retain the right to reallocate a comparable room to that originally chosen. In such exceptional circumstances, Emporium Hotel reserves the right to assign an alternative location of comparable space. Every effort will be made to inform you.

• Should final guest numbers increase or decrease significantly from those advised at the time of reservation, we may substitute a more appropriate function room choice. Every effort will be made to discuss this with you.

Changes to function meeting space & catering

• Please advise Emporium Hotel as soon as possible should you need to change your function room and/or catering requirements, the Conference & Events Manager will update the event order as appropriate. Charges will not apply for any changes to the function room and/or catering requirements where you notify Emporium Hotel of such requirements at least 45 days before the function is due to commence. Should you require any reduction to the function room or attendee numbers, within 45 days before the function is due to commence, the following slippage charges apply: Attendee reduction policy: Between 45 and 21 days: Should the agreed number of attendees drop below 50% a fee will be charged per cancelled guests of 20% of their estimated daily spend. Between 21 and 14 days: Should the agreed number of attendees drop a further 20% a fee will be charged per cancelled guest of 20% of their estimated daily spend. Below 14 days: Should the agreed number of attendees drop a further 10% a fee will be charged per cancelled guests of 20% of their estimated daily spend. Total event value reduction and room hire charges policy: Should the contracted value of the function fall by less than 20% room hire remains as per contract. Should the contracted value of the function decrease between 21% and 50%, a room hire fee of a room hire charge equal to 60% of rack room hire rate will be applied per day. Should the contracted value of the function decrease by more than 51%, a room hire fee of a room hire charge equal to 90% of rack room hire rate will be applied per day.

Cancellation • Emporium Hotel would share your disappointment if your booking were to be cancelled. The following fees

would be applicable. Please note any deposits paid by you towards payment of any cancellation fees. Notification of cancellation must be in writing. Time of cancellation Amount of cancellation fee

Between 14 & 7 days A cancellation fee equal to 75% of the contracted conference value will be incurred unless the space is subsequently resold at similar favourable terms

Within 6 days A cancellation fee equal to 100% of the contracted conference value will be incurred unless the space is subsequently resold at similar favourable terms

*Contracted conference value = (Estimated food & beverage spend X Estimated number of delegates) + Room Hire


Payment

• Unless otherwise negotiated, the organiser or contract signatory is responsible for all monies owed, with the balance of the payment required on the day of the function with cash or credit card*, or 5 working days prior to the function for bank cheque or bank transfer. In the instance where credit facilities have been established with Emporium Hotel Conference Centre, payment will be required within 7 working days of the conference.

Staff levy and surcharges • Due to increased labour costs on weekends there is a surcharge applicable of $5.00 per guest on Sundays

and Public Holidays. • Should your function extend 30 minutes or longer beyond the pre-arranged conclusion time, a labour

surcharge of $5.00 per guest per hour, or part thereof will apply. The guest number will be taken from the confirmed final numbers 2 days prior.

Signage

• No items are to be attached, pinned, nailed, screwed, stapled or glued to the wall, door or other surfaces of any area in the Emporium Hotel Conference Centre. Signage in the public areas are to be kept to a minimum and must be approved in advance by the Conference & Events Manager.

Menu Selection and Room Set Up

• Final details with regard to room set up, menu selection, beverage arrangements, AV requirements etc are

required 10 calendar days prior to your event date. These details which include the event start time and finish

time must be confirmed in writing. The hotel reserves the right to adjust any room set up to ensure Fire,

Health and Workplace Safety codes are not breached.

• Final number of guests to be catered and charged for must be advised 2 working days prior to the function. If

the numbers change after the due date penalties will apply.

Recording & Broadcasting • If you wish to make any recording and/or broadcast any part of the function you must obtain the prior written

consent of Emporium Hotel (which may be granted or withheld in Emporium Hotel’s absolute discretion) and all necessary consents of licenses from any third parties who have an interest in the conference recording or broadcasting. There are certain conditions as to the placement of equipment for recording or broadcasting and you must ensure that you and your employees, agents and contractors, comply with those conditions. Broadcasting includes radio and television and internet broadcast.

Damage to property or persons

• The hotel will take extreme care with any goods delivered to the hotel prior to our event. However we cannot accept liability for loss or damage and suggest that appropriate insurance cover be arranged. Please advise the Conference & Events Manager when items are being delivered prior to your conference and ensure they are clearly marked with the name of the conference and contact details. Deliveries to the hotel should be made no more than one day prior to the function and collected no more than one day after the function.

• You are responsible for any loss, damage and injury caused to the Emporium Hotel Conference Centre, to any property (including your property, property of third parties, any audio visual equipment or other equipment that is provided by other third party equipment suppliers) or to any person (whether occurring before, during or after the function) which is caused or contributed by you or by any of your employees, contractors, agents, guests or persons attending the conference. Any damage to the Emporium Hotel must be reported immediately to the Conference & Events Manager.

• As soon as reasonably practicable after the conclusion of the function, the Conference & Events Manager will inspect the function room and any property of the Emporium Hotel and report any damage or any property at the centre and a report of any damage to the centre or any property at the centre will be made available to you as soon as reasonably practicable after the report has been prepared. You are invited to inspect any damage identified in the report but you must do so as soon as reasonably practicable and prior to any use of the area where the damage occurred.

• No food or beverage of any kind is permitted to be brought into the Emporium Hotel for consumption at the conference by you or by any employee, agent, contractor, guest or any person attending the function, without the prior written consent of the Conference & Events Manager.

• You, your employees, agents, contractors and guests must not conduct any activities at the Emporium Hotel that may cause damage to property (including the Hotel), endanger the safety of persons (including those persons attending the function) or which may otherwise infringe the occupational, health and safety laws, regulations or rules.

• Failure to reduce the noise levels or to cease to engage in any other disturbing or disruptive activities, may result in Emporium Hotel cancelling the function in accordance with the terms and conditions.

Laws & regulations


• You must ensure that your own employees, agents, contractors or any persons attending your function do not commit any act that is in breach of any statutes, by-laws, orders, regulations, or other provisions having the force of law (including but not limited to Emporium Hotel’s liquor license and any fire regulations). You must ensure that you and your employees, agents, contractors, guests or persons attending your function follow the directions, procedures and security requirements as notified by Emporium Hotel from time to time.

Insurance & indemnity

• As your caterers we take every possible care, however you indemnify Emporium Hotel, its related bodies corporate and their directors, officers, employees, contractors and or agents against: (a) Loss or damage to the Emporium Hotel or any property at the conference centre arising out of the use of

the function room, conference facilities and/or room accommodation by you or buy your employees, agents, contractors, guests or persons attending the conference;

(b) Claims by any person in respect of loss, injury or damage of any description arising out of the use of the Emporium Hotel Conference Centre, any property at the conference centre, conference facilities and/or room accommodation, by you, your employees, agents, contractors, guests or person attending the conference or the cancellation of part or all of the function, to the extent that such loss, damage, injury or death arises from any act or omission by you or those persons; or

(c) Breach of this agreement by you. Limitation and exclusion of liability To the extent permitted by applicable law:

(a) The liability of Emporium Hotel to you under or in connection withy this agreement in respect of your function, including any breach of this agreement by Emporium Hotel or any act or omission of the Emporium Hotel Conference Centre, will not exceed the contract value for the conference;

(b) Neither Emporium Hotel Conference Centre, its directors, officers, employees, agents or contractors will be liable to you for any indirect, consequential, incidental, punitive, or exemplary loss or damage including, without limitation, loss of opportunity, revenue, profit and goodwill or other economic loss; and

(c) Where legislation implies warranties or conditions, or imposes obligations or liability on Emporium Hotel in respect of this agreement that cannot be wholly or partly excluded, restricted or modified, the liability of Emporium Hotel will be limited, at its option to:

(d) (in case of goods) the replacement or repair of goods, the supply of equivalent goods, the payment of the cost of replacing the goods or having the goods repaired or of acquiring the equivalent goods; and

(e) (in the case of services) the supply of the services again or the payment of the cost of having the services supplied again.

Responsible service of alcohol

• In accordance with the liquor act, responsible service of alcohol will be practiced as Emporium Hotel Conference Centre. This requirement will be taken into consideration when determining client requests for beverages. Emporium Hotel is a licensed venue from 7am until midnight. Extensions to these hours are available on request, with 6 weeks notice being required for special permits. A fee is applicable. Requests for extension outside of the prescribed time frame of 6 weeks cannot be processed.

Smoking policy

• Emporium Hotel is a smoke free hotel & building. Guests and visitors are required to adhere to the Queensland Government Tobacco Laws. Please note that fines are applicable for persons in breach of the tobacco laws.

Entire Agreement

• Subject to amendments specified in subsequent Event Order(s), the Event Order and these Terms & Conditions will constitute the entire agreement of both parties and supersede all prior discussions, negotiations and agreements in relations to the function.

Storage of Items Left/ Freight and Delivery

• Signage, banners, boxes and remaining items from your function must be taken upon finalisation of your

function. A fee of $100/day will be charged for any remaining items.

• The client is responsible for his or her own transport, freight and arrangements and costs. The client is

responsible for the setup and dismantle of their own equipment and displays. Equipment access and delivery

through the hotel main foyer is prohibited without prior authorization from the hotel management.


Conference Accommodation Rates Rate Validity: This proposal is valid for a period of 14 days from date of issue. Deposit: A deposit equal to the first nights stay for the total number of rooms booked is required to confirm this group reservation. Final payment is required 14 days prior to arrival date Tax: Accommodation rates are quoted inclusive of GST. Check in / Check Out Times: Standard check in time is 2.00pm. Check out time is 11.00am. Accommodation Block Release Policy:

• At 30 days prior to the first nights stay our Reservations Manager will be in contact to review the room block • At 21 days prior to the first nights stay our Reservations Manager will be in contact for the final review of the

room block. At this time the hotel requires a firm indication or materialization of the room block. Based on this conversation the hotel reserves the right to release back rooms into hotel inventory for resale.

• If at 14 days prior all rooms have not been allocated the hotel will release back all non allocated rooms into hotel inventory. A rooming list and final payment will be required at this point in time.

• All requests for additional rooms are subject to availability. Entire Accommodation Block Cancellation:

• At 14 days or less: In the event of cancellation of all or part of the group received in writing less than 14 days prior to the contracted arrival date, full monies held are non refundable.

• No Shows: Rooms that fail to arrive without cancellation will incur a penalty equal to full accommodation charges for the entire confirmed stay.

All cancellations must be received in writing.
