Minutes of the Open sessions of the North Carolina Medical Board Meeting held January 21-23, 2009. The January 21-23, 2009, meeting of the North Carolina Medical Board was held at the Board's Office, 1203 Front Street, Raleigh, NC 27609. The meeting was called to order at 10:00 a.m., Wednesday, January 21, 2009, by George L. Saunders, III, MD, President. Board members in attendance were: Janelle A. Rhyne, MD, Past President; Donald E. Jablonski, DO, President-Elect; Janice E. Huff, MD, Secretary/Treasurer; Ms. Pamela Blizzard; Thomas R. Hill, MD; Ms. Thelma Lennon; John B. Lewis, Jr., LLB; Peggy R. Robinson, PA-C; William A. Walker, MD; Paul S. Camnitz, MD and William W. Foster, MD. Also attending were R. David Henderson, Executive Director and Thom Mansfield, Board Attorney.

Presidential Remarks Dr. Saunders commenced the meeting by reading from Governor Easley’s Executive Order No. 1, the “ethics awareness and conflict of interest reminder.” No conflicts were reported.

Miscellaneous Announcements Dr. Jablonski reported on the AAOE meeting he attended. The Board approved a Communication Resolution to be presented to the FSMB for

consideration. The Board also approved two resolutions for Dr. James N. Thompson to be presented to the

FSMB for consideration.

Minute Approval Motion: A motion passed that the November 19, 2008 Board Minutes are approved as presented. Executive Director’s Announcements Mr. Henderson handed out a memo on the new procedure for interviews. Mr. Henderson acknowledged Mrs. Joy Cookes’ 25 year anniversary with the NCMB. Mr. Henderson reminded everyone of the dinner for Dr. Loomis on Thursday night. Mr. Henderson noted the dates for the NCMB retreat and the 150th Anniversary Celebration.

Dr. McGehee was charged based on action taken by the Kansas Board in which MD entered in a Consent Order regarding mental health problems and sexual misconduct.

1/23/2009 BOARD ACTION: Indefinite suspension Executive Committee Report The Executive Committee of the North Carolina Medical Board was called to order at 10:50 am, Wednesday January 21, 2009 at the offices of the Board. Members present were: George L. Saunders, MD, Chair; Janelle A. Rhyne, MD; Donald E. Jablonski, DO; Janice E. Huff, MD; and John B. Lewis, Jr. Also present were R. David Henderson (Executive Director), Hari Gupta (Director of Operations), and Peter T. Celentano, CPA (Comptroller). Financial Statements

Year end Audit Report - Koonce, Wooten & Haywood, CPA's: Mr. Chris Duffus, an audit partner with the firm Koonce, Wooten & Haywood, CPAs presented the financial statements for the fiscal year ended October 31, 2008. Mr. Duffus explained to the Committee that our statements are presented fairly and in accordance with generally accepted accounting principles. An unqualified opinion has been made on the report.

Dr. Saunders excused the staff to allow Mr. Duffus to speak directly to Committee about any concerns that arose while performing the audit or with the internal control structure. There were none.

Dr. Saunders made a motion to accept the audit report as presented. Dr. Jablonski seconded the motion and the motion was approved unanimously. Monthly Accounting November 2008: Mr. Celentano, CPA, presented the November 2008 compiled financial statements. November is the first month of fiscal year 2009. Dr. Jablonski made a motion to accept the financial statements as reported. Dr. Rhyne seconded the motion and the motion was approved unanimously. Old Business

Online Renewals: Mr. Henderson reminded the Committee the Board voted to move to a mandatory online renewal process in May 2009. After further discussion, Dr. Jablonski made a motion that effective May 1, 2009 the Board will only accept online renewals. Those who are unable or unwilling to renew online will have their license placed on inactive status. Dr. Rhyne seconded the motion and the motion was approved unanimously.

New Business

Time Limits on Information Gathered Pursuant to G.S. 90-5.2: Members of the Executive Committee discussed G.S. 90-5.2 that requires the Board to collect and “make available” to the public certain information regarding our licensees.

The Board has already decided to set time limits on how long malpractice payments will remain on the Web site (seven years). Also, the law states we may only collect misdemeanor convictions for the past ten years. Additionally, the Board needs to decide how long to post felony convictions, hospital actions, medical regulatory actions, and federal/state agency actions.

After discussion, Dr. Rhyne made a motion to post federal/state agency actions and hospital actions for seven years. Dr. Jablonski seconded the motion and the motion passed unanimously. Dr. Rhyne made a second motion to post all medical regulatory actions and felony convictions indefinitely. Dr. Jablonski seconded the motion and the motion passed unanimously.

Renewal Question #7: Question number seven on the renewal form asks whether a

malpractice claim was filed against the licensee since he/she last renewed. If the licensee answered “yes” staff would check to see if that licensee had an enforcement history that would warrant investigating the malpractice case. However, since adding this question approximately three years ago, staff has not opened a new enforcement case. Therefore, staff recommends that we remove this question from the renewal form. Dr. Rhyne made a motion to accept this recommendation. Dr. Jablonski seconded the motion and the motion passed unanimously.

Board Sponsored Communication Course: Dr. Saunders reviewed with the Committee

plans for the Board to possibly develop a communications course in North Carolina. FSMB Draft Report on Telemedicine Policy: Dr. Saunders reviewed a copy of an e-mail

from Lisa Robin, Senior VP, Member services, FSMB dated December 17, 2008 and a copy of a draft report on telemedicine policy. The Committee referred this matter to the full Board for discussion.

May 2008 – It was reported that the FSMB’s version dealt mostly with electronic medical records.

REVIEW OF POSITION STATEMENT:

Departure from or Closing of Medical Practices

Issue: Review Committee referred this issue to Policy Committee to determine if the current position statement should be amended to cover nurse practitioners physician assistants.

5/2008 – It was pointed out that not all physician extenders work in the same circumstances. Many physician extenders are at-will employees; others work in practice environments in which they are the owner and/or the sole practitioner. The statement should cover both extremes. It was suggested that the layout of the statement could be similar to the Physician Supervision position statement, which lists circumstances to be considered on a case by case basis. Additionally, it was stated that continuity of care for patients must be the ultimate concern.

BOARD CERTIFICATION DISTINCTION Issue: How North Carolina-licensed physicians may advertise their Board certification status to the general public?

• Mr. Brosius will attempt to develop language to add to the advertising and publicity position statement to be presented at this meeting for consideration.

5/2008 BOARD ACTION: Accept the proposed Position Statement with the following change. Do not delete the following sentence: “If patient photographs are used, they should be of the physician’s own patients and demonstrate realistic outcomes.” This Position Statement is to be published in the Forum for comments.

7/2008 BOARD ACTION: Submit the following proposed position statement with the amendment to the last sentence of the third paragraph. 9/17/2008: The Committee discussed the fact that the proposed changes to the current Position Statement would not be consistent with the information currently being provided on the Board’s website. Additionally, a representative from the Medical Society recommended that the position statement should include PAs and NPs. 9/2008 COMMITTEE RECOMMENDATION: (Walker/Lennon) Add the following language to the position statement “To avoid misleading the public, the Board strongly encourages that the use of the term “Board Certified” only be used in advertisements when it refers to certification derived from a specialty board recognized by the American Board of Medical Specialties or the American Osteopathic Association.”

NARROW THERAPEUTIC INDEX DRUG LIST Issue: Request from Astellas Pharma US that the North Carolina Medical Board recommend to the NC State Secretary of Human Resources that tacrolimus be added to the NC narrow therapeutic index drug list. The following people spoke in support of the request: Marty Lasak, Pharm. D, Astellas Pharma US; Matt Harris, Pharm. D, Duke Medical Center/Transplant Unit; David Work Executive Director Emeritus, NC Board of Pharmacy; and Erin Fisher, RN, liver transplant recipient. The following person spoke in opposition of the request: Arthur Straughn, Pharm. D, Director Drug Research Laboratory. 11/2008 COMMITTEE RECOMMENDATION: Policy Committee will report to the full Board and receive input from the Board of Pharmacy before making final determination regarding a recommendation to DHHS. 11/2008 BOARD ACTION: Dr. Sheppa will check with other Boards. CONTINUED COMPETENCE COMMITTEE REPORT

The Continued Competence Committee of the North Carolina Medical Board was called to order at 3:00 p.m., Thursday, January 22, 2009, at the office of the Medical Board. Members present were: Peggy Robinson, PA-C, Chair; William Walker, MD and Paul Camnitz, MD. Also attending were: Janelle Rhyne, MD; Michael Sheppa, MD, Medical Director; Christina Apperson, Legal Intern and Maureen Bedell, Recorder.

November Minutes Motion to approve the November minutes was approved.

OLD BUSINESS

I. Dr. Sheppa gave a Reentry Guidelines Update: Applicants, mentors, indemnity and reentry for the retired volunteer applicant. He explained how we have had two individuals go through the new process. The feedback was that the process is much easier with the three phase timeline and the structure for the mentor. Dr. Sheppa also explained how our legal department was working on a better process for indemnity of the mentor.

II. Dr. Sheppa updated the Committee on Core competencies and Board actions. The initial decision was to have Senior Staff summarize and enter in GL Suite. The concern that the Senior Staff noted was that not all Senior Staff can assign competency. Of the random cases that Dr. Sheppa and Dr. Kirby reviewed, they agreed to disagree on the results. They decided to stop their data collecting and wait for a more standardized way to collect the information. Senior staff has decided to bring this subject back up in the March meeting.

NEW BUSINESS

I. Dr. Rhyne discussed the Maintenance of Licensure: Evidence in Support of Periodic Assessment slide show written by Richard E. Hawkins, MD of the National Board of Medical Examiners.

II. Dr. Rhyne began the discussion regarding the Compilation of Maintenance of Licensure Information. It was noted that the FSMB has policy that was passed by the House of Delegates. Discussion was about implementation of MOL. Concerns expressed were cost, who will administer the exam and other issues. The committee is awaiting the FSMB’s final recommendations.

ALLIED HEALTH COMMITTEE REPORT Present: Peggy Robinson, PA-C, Chairperson, William Foster, MD, Thomas Hill, MD, Marcus Jimison, Lori King, CPCS, Quanta Williams, Barbara Gartside, Christina Apperson, Jeff Katz, Mike Borden. Open Session PA Rules. Subchapter 32S Catchline: Physician Assistant Regulations. M. Jimison discussed revisions. Board Action: Change 21 NCAC 32S.0202 Qualifications and Requirements for License regarding references from: “References cannot be from “immediate” family members to read: “References cannot be from “any family members”. Legal to check on new information/changes added since the last PA Rule revisions were distributed. PA & NP Identification Badges. Catchline: PA: 21 NCAC32S.0116 Identification Requirements. Physician Assistants are required to have physician assistant spelled out and not use the PA abbreviation on their ID badges. NP: 21 NCAC 32M.0111 Method of Identification. Currently the Nurse Practitioners Rule does not require that Nurse Practitioner to be spelled out. Request that the NP Rule be revised to spell out nurse practitioner and not use the NP abbreviation on their ID badges. Board Action: Do not revise NP Rule at this time. Accept PA Rule 21 NCAC 32S.0210 Identification Requirements revision as written which refers to G.S. 90-640 Identification badges required for both NPs and PAs. Disciplinary Actions taken since September 17, 2008

There were 0 actions reported by the Medical Board and 2 by the Board of Nursing since the last meeting.

SANE Course Nursing Board has made a request to modify a SANE (sexual assault nurse examiner) course for out of state nurses who have completed a similar training in another state but now want to be certified in NC or nurses who have completed the training & need a refresher course. Pursuant to N.C.G.S. 90-171.38, the Nursing Board, in cooperation with the Medical Board, through the NP joint subcommittee, shall establish, revise, or repeal standards for any such program. MOTION: To support approval of the proposed SANE curriculum changes and to forward the recommendation to both Boards. Passed.

LICENSE COMMITTEE REPORT Don Jablonski, DO, Chairman, Pamela Blizzard, Janice Huff, MD, Joy Cooke, Michelle Allen, Mary Mazzetti, Kim Chapin, Scott Kirby, MD, Thom Mansfield, Patrick Balestrieri Recent changes to on-line application questions Catchline: Hari Gupta will provide an update on recent changes in the on-line application questions and profile pages. BOARD ACTION: Accept as information. Senior Staff Review Committee (SSRC) request Catchline: SSRC is requesting guidance on how applicants with “pending malpractice cases and no other concerns” should be handled. BOARD ACTION: Applicant’s with pending claim(s) that have applications that are otherwise satisfactory, be made aware that if the claim(s) results in a PLIP (professional liability insurance payment) that the Board will want to review all the material associated with the PLIP, including medical records. Therefore, the applicant should formally be advised to retain all medical records associated with a claim and expect to be asked to produce those records should a claim result in a PLIP. SSRC task for PLOCs Catchline: At the 11/2008 meeting the Board voted for the SSRC to develop a proposal for a process for “pre-approving PLOCs recommended by Board members as a result of file review or individual interview by developing a narrow list of “failure to disclose information” that are of moderate or less significance for the 1/2009 License Committee meeting. BOARD ACTION: Table matter until the language on the application and profile questions are formalized. Modification of 21 NCAC 32B .0314 – passing exam score Catchline: At the 11/2008 meeting the Board voted for staff to draft a modification to the rule that will address exception for ABMS and AOA certified physicians as well as the number of attempts allowed for passing each step of the USMLE examination – see book marked proposal. BOARD ACTION: Accept proposed rule modification. Staff was granted permission to implement modification of 21 NCAC 32B.0314 with regard elimination of the 7 year limitation for passing all 3 steps of USMLE Immigration status Catchline: In May 2008 the Board tasked staff to research how to accomplish proof of US citizenship or legal residence for foreign-born applicants as part of the license process. Staff believes this will not require a statutory or regulatory rule change; it can be implemented at

minimal cost by adding a question to the application. Based on current data less than 20% of applicants are foreign born. BOARD ACTION: Approve proposed screening process to add a question to the application, relying on the applicant to verify their legal residence status. Modification to Step #7 of the application Catchline: It has been suggested that Step #7 on the application be modified to include “termination”. The question currently reads: “Have you ever had an action taken against you by a health care institution? If so, list each occurrence. Actions include warnings, censures, discipline, admissions monitored, privileges limited, privileges suspended/revoked, remediation, probation, withdrawals/resignations of privileges, or denial of staff membership. Health care institutions include hospitals, health maintenance organizations, preferred provider organizations, any facility in which you trained, or any other provider organizations that issue credentials to physicians.” BOARD ACTION: Modify Step 7 to include the word “termination”. A motion passed to close the session pursuant to Section 143-318.11(a) of the North Carolina General Statutes to prevent the disclosure of information that is confidential pursuant to Sections 90-8, 90-14, 90-16, 90-21.22 of the North Carolina General Statutes and not considered a public record within the meaning of Chapter 132 of the General Statutes and/or to preserve attorney/client privilege.

Thirty licensure interviews were conducted. A written report was presented for the Board’s review. The Board adopted the Committee’s recommendation to approve the written report. The specifics of this report are not included because these actions are not public information.
