STATEMENTReference number 10/00049/IPLWith reference to the refusal of permission to erect a dwellinghouse (in principal) at West Park, Braco, Dunblane,FK15 9LQ, I would like to request a review of this decision for the following reasons:-

Point (1)Policy 54 of the Strathearn Area Local Plan 2001

My father is a 62 year old fanner who was born at Garrick Farm which he currently rents from Ardoch FarmingCompany (Blackford Farms) and which my grandparents also rented and farmed from 1943 until their deaths in1984 and 1985.

With their rather premature deaths, my sister and I became very much involved in the tasks commonplace on aworking mixed livestock/arable farm and from such experience our love of rural life developed.

My father is now at an age where he would like to work less on the farm and eventually pass the heritable tenancyover to the next generation to continue farming within the family and in order for this to happen I would need tofurther my agricultural knowledge, assist and relieve my father from the farming duties on this livestock farm.

Living in close proximity is therefore essential and I believe that building a house beside my parents within theirprivately owned 2.3 hectare field, adjacent to the rented farm would be the obvious solution as the farmhouse atGarrick Farm is neither habitable nor for sale.

The farm carries around 50 beef cows and their offspring. Codes for the welfare of cattle recommend that stockshould be regularly inspected. Daily feeding is required during winter months, usually October to early May withparticularly demanding attention required during calving periods, generally in spring and autumn.Farm security and rural security in general, are a constant concern and also require a continuous presence.

I strongly feel that this falls within Policy 54 point (d) Operational Need in precisely the same way as was the casewhen my parents required the house which they built 25 years ago. With my grandparents occupying Garrickfarmhouse at that time my parents were granted permission to build their house at West Park, almost 30 years ago sothat they could continue farming at Garrick. Now, one generation on, with the farmhouse at Garrick, like many inthis particular area, in need of restoration or replacement, the need for another house arises again.

It should be noted that my father would gladly purchase the farm given the opportunity and has repeatedly asked todo so. however his request has never been successful. He has also registered an interest in purchasing the farmthrough the Right to Buy under terms of Part 2 of Agriculture (Scotland) Act 2003.

Small farms. as Garrick, are typical of those that have been lost to agriculture due to the trend toward larger unitsover recent decades. Meanwhile the need for such starter units has been the subject of considerable debate since thelack of new entrants to agriculture was highlighted at the beginning of the current administration at Holyrood in2007. Lack of appropriate housing to accommodate the next generation is a key element causing the drift fromfarming, particularly on rented farms where the provision of a new house can be complicated.

I enclose a copy of an ordinance survey map outlining the exact boundaries of Garrick Farm and my parents'privately owned land at West Park and believe there is a clear operational need for this proposed house to be built onmy parents' land.

Should further information be required with regards to the above please do not hesitate to contact my father, TomGray as tenant of Garrick Farm and owner of the proposed site at West Park.

Point (2)August 2009 Policy on Housing in the Countryside

I feel that my proposal complies with the following sections of the August 2009 Policy on Housing in theCountryside:

Sections 3.1 Existing Garden

The land at West Park consists of the following three distinct areas:-A flat fertile two-acre strip of land fit for cultivation to the south.A further undulating strip of land lies to the north. This runs with water in winter and is rough grazing insummer.A steep-sided rough grazing hill occupies the centre.

To create the site for my parents' house, a plateau was created on which to build the house by excavating into thehill and using the sub-soil/rock material removed from this in the construction of the driveway. Considerable effortswere made to ensure that the result was a non-intrusive building faced in natural random stone. The house ispositioned so that it is only visible from a short stretch of the unclassified road from which access is gained. In factdue to the nature of that particular stretch of road, the form and facing of the house and landscaping around it, thehouse is often unnoticed by many seeking to locate it.

Similar efforts would be made to ensure materials used and landscaping ensured an equally discreet development forthe new dwellinghouse should permission be granted.

The site where I propose to build could reasonably be termed as part of my parents' garden and would be formed bysimilarly excavating into the hill and using sub-soil/rock from this in creation of the additional section of drivewayto access the new house.

Currently, 2 pet Highland cows, kept as a tourist attraction alongside my parents' bed and breakfast, graze on theland around the house at West Park and would continue to do so.

Section 3.3 Economic Activity

As previously stated, my parents and I plan to maintain the tenancy of Garrick or until such time as it can bepurchased. Garrick is a working and productive livestock farm and we believe it can only be maintained as such if asecond house is available to accommodate myself, representing the next generation hoping to succeed in thebusiness.

I believe the maintenance of economic activity is the basis of this proposal as explained in Point (1).

Point (3)Policy 2 of the Strathearn Area Local Plan 2001

As explained in Point (2) above, excavation into the hill to leave a finished floor level one metre above the existinghouse would leave an embankment over one metre high to the west of the site, with planting thereon, as is the casearound existing house. This will all be set against a backdrop of conifer forest.

Built to a building line 9 metres behind that of the existing, the proposed house would be almost invisible behind theexisting house and therefore hardly visible from the Old Military Road, any other public vantage point and could notbe viewed from any neighbouring properties.

I believe that the proposed development would create an opportunity for a new generation to develop enterprise andenthusiasm based on the family farm at Garrick.

Refusal of this proposal would needlessly commit yet another family farm to become merged into a large impersonalenterprise.
