Justification for Proposed Amendments

2021 Regional Plan: TransNet Extension Ordinance requires consistency between Regional Plan and Ordinance (Section 5.B.)

TransNet Ten-Year Comprehensive Program Review: Ordinance requires evaluation to make revisions to the Expenditure Plan to improve performance (Section 17)

FY 2018 and FY 2021 TransNet Triennial Performance Audits: Ordinance requires the ITOC to conduct audits to improve efficiency and effectiveness of TransNet revenue expenditures

1) Expenditure Plan

Justification: Ordinance requires consistency with Regional Plan and Ten-Year Review recommended reevaluating whether remaining Ordinance projects are best mix for achieving TransNet goals

Change:

1) Update the Ordinance Expenditure Plan consistent with Ordinance requirement that allprojects to be funded with revenues made available under the Expenditure Plan must beconsistent with the Regional Plan

2) Expand to include bike, pedestrian, flexible fleets, and necessary ITS infrastructuretechnologies

2) Local Street and Road Program

Justification: Ordinance requires consistency with Regional Plan; Ten-Year Review and the FY 2018 TransNet Triennial Performance Audit recommend performance tracking to demonstrate outputs/outcomes and removing/changing 70/30 congestion relief/maintenance split

Change:

1) Remove 70/30 Congestion Relief/Maintenance split requirement

2) Develop new list of eligible capital, operations, and maintenance projects

3) Require performance reporting

3) Smart GrowthIncentive Program (SGIP)

Justification: Ordinance requires consistency with Regional Plan

Change:

Replace reference to Regional Comprehensive Plan with Regional Plan consistent with prior Board action (2015) to merge RCP with the 2050 RTP/SCS

4) Bicycle, Pedestrian and NeighborhoodSafety (BPNS) Program and Expenditure Plan

Justification: Ordinance requires consistency with Regional Plan which emphasizes safety and mobility, includes Complete Corridors which are a requirement for state funding programs, and accommodates bike, pedestrian, flexible fleet projects, and integrate technology so they can be managed.

Change:

1) Expand Major Corridor definition by amending Expenditure Plan to include bike,pedestrian, flexible fleets, and necessary ITS and communications technologies

2) Increase BPNS funding off-the-top percentage

5) Transit Operations (8.1%)

Justification: FY 2018 TransNet Triennial Performance Audit discusses potential long-term funding shortfalls for transit operations subprogram

Change:

1) Add language that 8.1% funds do not cover 100% of operations

2) Clarify that SANDAG, MTS, and NCTD are to work together tomatch funding

6) Transit Operator Eligibility

Justification: FY 2018 TransNet Triennial Performance Audit recommends revisiting transit operator eligibility requirements due to yearly exception requests and also recommends revisiting operator eligibility for annual increases tied to CPI; recent significant discussion at TC

Change:

1) Update transit operator eligibility requirements

7) Digital Communications Infrastructure

Justification: Ordinance requires consistency with Regional Plan; inclusion of Digital Communications Infrastructure into TransNet funded infrastructure projects including Major Corridors and Local Street and Road would help support implementation of the 2021 Regional Plan

Change:

1) Require all new or major reconstruction projects funded withTransNet to integrate digital communication infrastructure

8) Performance Framework

Justification: The FY 2018 TransNet Triennial Performance Audit recommended SANDAG establish a performance framework to better measure progress against goals; the Ten-Year Review identified the need to demonstrate accomplishments and performance outcomes, and Plan of Excellence considers improvement to data analysis, transparency, communication and to track TransNetaccomplishments

Change:

1) Require all recipients of TransNet funding to report on performance of fundedprojects for transparency and to measure against TransNet goals

9) ITOC membership, terms, selection process

Justification: FY 2021 TransNet Triennial Performance Audit recommended additional member expertise could assist with ITOC oversight role, service limits should be consistent for mid-term and full-term vacancies, conflict of interest policy could afford more clarity, and selection process could be moved outside of SANDAG Board to minimize perceived selection bias.

Changes proposed by ITOC:

1) Add new subject matter expert categories consistent with SANDAG priorities

2) Revise term limits so all members can serve up to 10 years (not just members filling mid-term vacancies)

3) Streamline selection process to maximize transparency

4) Update conflict of interest policy to clarify recusal process

(Pending review by outside independent legal counsel)
