    Auditor General-Elect DePasquale Promises To Audit DEP Water Protection Programs

    Eugene DePasquale, a member of the House and a former deputysecretary with the Department of Environmental Protection, was electedto the position of Auditor General Tuesday. During his campaign hepromised to use his office to monitor state agencies' efforts to protect

    Pennsylvania's natural resources.On his first day in office, DePasquale said he will order a review of thestates water protection programs in order to evaluate potential threatscaused by the Marcellus Shale drilling.

    In addition, DePasquale said he would---- Ensure DEP and DCNR maintains appropriate staffing levels toproperly regulate and monitor natural gas drilling activities.-- Ensure consistency among DEP regional offices in enforcement and permitting activitiesrelated to natural gas drilling activities.-- Ensure DEP is monitoring water quality (including groundwater and wells) for methane andchemicals used in hydrofracking.

    -- Ensure gas spill plans are compliant with state and federal law.-- Ensure DEP is monitoring safe and appropriate disposal of waste fluids used in hydrofrackingoperations. Specifically, urge the DEP to mandate that drilling companies stop using treatmentplans that are not equipped to remove certain contaminants from hydrofracking wastewater.-- Ensure impact fees are adequate to compensate Pennsylvania communities for impacts causedby natural gas drilling activities. The Auditor General will scrutinize how funds are beingallocated and recommend changes to Act 13, if necessary.-- Urge changes to Act 13 that will extend the liability of drilling companies. Per Act 13,driller liability ends one year after a well is capped. This amount of time may be insufficient todetermine if there have been public health problems or adverse effects to the environment as aresult of drilling activities.

    Just as coal is an extremely important natural resource in Pennsylvania and has hadtremendous impacts on our economy for hundreds of years, DePasquale said there are adverseeffects throughout the state as a result of coal mining.

    As stated by the U.S. Geology Survey, "Drainage from thousands of abandoned coalmines has contaminated more than 3,000 miles of streams and associated ground waters inPennsylvania and is the most extensive water-pollution problem affecting the four major riverbasins in Pennsylvania."

    Secretary Krancer said Rep. White misapprehended some important facts involved inthe testing program and said his characterization of comments made by a DEP employee in adeposition were untrue and inaccurate.

    The text of the letter follows--I am in receipt of your November 1st press release calling for an investigation into the

    Department of Environmental Protections (DEP) water quality testing procedures as they relateto Marcellus Shale natural gas drilling. I wanted to take the time to respond to you directly andpromptly as it appears that you have misapprehended some important facts.

    Your characterization of the testimony in the case currently handled by the Smith Butzlaw firm is untrue and inaccurate. Here are the facts:

    Contrary to your press release, Ms. Upadhyay, Technical Director of DEPs Bureau ofLaboratories, did not testify that DEP developed a special code in order to manipulate data. Thecode used to report tested parameters for an investigation of potential impact to a water supplyfrom oil and gas operations was first developed in 1991 and has been used consistently andsuccessfully for decades.

    Moreover, your press statement fails to appreciate how the DEP lab and field staff

    operate. There is a functional wall between our lab and our field staff. The lab accuratelygenerates data while the field staff reviews that data, along with other facts in the field, whenperforming an investigation into a water supply complaint. Mixing these functions togetherwould not only be redundant but would also be inappropriate protocol for any laboratory becauseit would put the laboratorys rigorous impartiality into question. The lab is not asked to weighinformation, but to report it.

    DEP can request a list of tests from its lab using Standard Analysis Code (SAC) such asSAC 942. SAC 942 tests for the following:-- pH --magnesium-- chloride -- iron-- alkalinity -- total dissolved solids-- calcium -- barium-- hardness -- sodium-- manganese -- potassium-- conductivity --strontium

    This suite of tests was developed in 1991 to identify constituent elements that wouldindicate contamination from a gas extraction operation. The DEPs Oil and Gas programpersonnel have determined the relevant parameters to detect contamination from oil and gasrelated activities. The analysis suites reflect this effort and were revised in 2010 (SAC 946) wellafter Marcellus unconventional drilling began.

    Professional staff, trained in evaluating water complaints, utilize the relevant data andinformation to inform their conclusions. Although other results are generated by the lab tests,such results would not contribute to answering the question at hand--determining whether thereis a connection between the gas well activities and the water supply.

    Your press release also omits that these parameters subject to investigation inPennsylvania are substantially similar to the ones used in other states such as, for example, NewYork, Ohio, Colorado and Wyoming.

    In this particular investigation, the levels of the additional parameters were extremelylow. None exceeded a primary or secondary Maximum Contaminant Level (MCL) fordrinking water. Silica, one of the additional parameters mentioned, is one of the most common

    To highlight the importance of ongoing maintenance of passive treatment system, here isthe first of what will be several case studies, this one in Armstrong County.

    O&M Effort At The Decade-Old NuMine-White Lake Passive Treatment System

    The Cowanshannock Creek Watershed Association (CCWA) recently received supportto rehabilitate theNuMine-White Lake Passive Treatment System in Cowanshannock Township,Armstrong County.

    Continuing the treatment effort at this site is important, as the passive system has enabledWhite Lake to sustain good quality water with a 6 to 7 pH that contains typically less than mg/L each of iron, manganese, and aluminum.

    The site has also historically been instrumental in providing knowledge about passivetreatment technology as federal and state agencies have not only conducted research but alsocontributed to the treatment effort at the site.

    For instance, the first passive component, an aerobic wetland, was installed inabout 1988 by what is now the Natural Resources Conservation Service with some of theearly groundbreaking research efforts conducted by the former US Bureau of Mines.

    In 2002, the DEPs Bureau of Abandoned Mine Reclamation (BAMR) placed additionalcomponents online. Since that time, the CCWA has been overseeing the system performanceand hosting educational field trips at the site for students from the local high school.

    Based on available monitoring data, the AMD entering the expanded system typicallyhas a pH of 4 with 15 mg/L of aluminum and relatively low iron and manganese content. Afterabout a decade of changing this acidic drainage to net alkaline water containing only about 1 mg/L of aluminum, the limestone-only vertical flow pond became plugged by aluminum solids andother sediment.

    Anne Daymut of the Western PA Coalition for Abandoned Mine Reclamation andmember of the watershed association, requested support to rehabilitate the system through theO & M Technical Assistance Program made possible by grants from the DEP Growing GreenerProgram and the Foundation for Pennsylvania Watersheds and by volunteer efforts.

    Through these partnership efforts, in September 2012, the limestone aggregate waswashed to remove aluminum solids and other sediment, which was then captured in pumped-water filter bags or the existing sediment pond.

    In addition, a new upper level layer of underdrain pipes was re-installed to allow forfaster drainage during the monthly system inspection conducted by the CCWA. Pam Meade,John Bohonak, and others from the CCWA were onsite regularly to assist with the renovation.

    scale interventions.The design competition is part of a larger design initiative exploring how greenstormwater infrastructure can revitalize urban neighborhoods

    Green stormwater infrastructure is crucial to the implementation of Green City, CleanWaters, the City's innovative, sustainable 25-year plan to protect and enhance local waterwaysprimarily through the use of green stormwater infrastructure.

    The competition is open to professional designers. Competition teams must include atleast one licensed architect, one licensed landscape architect, and one licensed civil engineer.One of the required team members must practice in the Philadelphia region.

    While the competition sites have a Philly focus, the insights gained through the designcompetition will apply to other cities seeking to retrofit green stormwater infrastructure into an

    existing urban fabric.Design professionals from around the country are encouraged to participate!Nine finalists will be selected to present at an awards event at the Academy of Natural

    Sciences of Drexel University on March 7. A jury will select one winning design for each of thethree sites. The three winning competition teams will receive a cash prize of $10,000.

    A Competition Packet with the full details is available online.Penn State Extension: Pond, Lake Management Workshops Set For 2013

    Penn State Extension sponsored or assisted with nine pond and lake workshops throughoutPennsylvania in 2012 which were attended by 433 pond and lake owners or managersrepresenting over 1,300 acres of ponds and lakes.

    These workshops ranged from one to six hours in length covering topics on pond andlake assessment, control of aquatic plants, and management of fisheries and wildlife.

    Post workshop evaluations completed by 288 attendees found that 62 percent werepond/ lake owners and 38 percent were lake managers, consultants, or pesticide applicators. Allattendees indicated that they learned some new pond and lake management concepts at theirworkshop.

    A four-month follow up evaluation of workshop attendees found 87 percent had utilizedinformation they learned to take actions on their ponds and lakes including better managementof aquatic plants and algae (39 percent), testing pond/lake water quality (23 percent), installingbuffer strip around pond/lake (33 percent), used barley straw for algae control (13 percent) andadded fish habitat structures (10 percent).

    Some pond and lake management workshops are already planned for 2013 including:-- March 2: Lancaster;-- March 23: Ellwood City;-- April 13: Washington; and-- April 23: Johnsonburg;

    The Department of Environmental Protection Wednesday announced Francois Bitz, of Baden,Beaver County, will pay $137,000 in civil penalties as part of a consent order and agreement forviolating the Pennsylvania Clean Streams Law and the Dam Safety and Encroachments Act.

    Bitz will also pay cost-recovery and oversight costs to DEP and the Allegheny County

    Conservation District.From 2009 to 2010, Bitz excavated approximately two acres of wetlands and impactedapproximately 1,100 feet of stream while constructing a recreational pond on his property inMarshall Township, Allegheny County, without the necessary permits.

    Our regulations exists to protect the quality and vitality of our streams and wetlands,DEP Southwest Regional Director Susan Malone said. The departments permitting processallows for responsible development, but the regulations must be respected and enforced.

    DEP issued Bitz two compliance orders in July 2010 after inspections to the MarshallTownship property revealed he had excavated portions of a stream channel of an unnamedtributary to Big Sewickley Creek, which is classified as a trout stocked fishery.

    Bitz also disturbed significant portions of earth in the surrounding wetlands withoutdeveloping or implementing an erosion and sediment control plan. The compliance ordersoutlined Bitzs failure to comply with regulations that protect wetlands and mitigate erosionduring construction activity.

    As a condition of the consent order and agreement, Bits must submit a revised permitapplication for remediation and restoration of the impacted stream and wetlands. The agreementalso stipulates that the restoration must begin within two months and be completed within sixmonths of the issuance of the permit.Revisions Proposed For Use Of PNDI During DEP Permit Reviews

    The Department of Environmental Protectionpublished a notice inviting comments on proposedchanges the policy for using the PA Natural Diversity Inventory during permit reviews andevaluations in the November 10 PA Bulletin.

    The Department said it is revising its existing policy to clarify PNDI coordination withinthe permit review process. PNDI coordination will be conducted in a manner consistent with therequirements of the rules and regulations implemented by the Department.

    The Department and County Conservation District staff will follow this policy during thepermit application review process.
