Performance Work Statement (PWS)

Shop Level Environmental Training for the Tennessee Army National Guard (TNARNG)

Vision Statement

The contractor will provide twenty-four (24) 1/2-day (4 instructional hours) Shop Level Environmental Workshops. Each workshop will be based on the Tennessee Army National Guard (TNARNG) Hazardous Materials and Waste Management Plan (HMWMP) and best management practices (BMPs) for hazardous materials and wastes management. In addition, the workshops will conduct training on site-specific Spill Prevention Control and Countermeasures Plans (SPCC) and required associated oil-handling personnel training. The workshops will include classroom and hands-on instruction to implement TNARNG HMWMP, BMPs for hazardous materials and wastes, awareness training on the TNARNGs environmental policy and pest management policy, SMZ Zones and other limited use areas, endangered species awareness, and spill response procedures. The contractor will describe, demonstrate, and implement specific waste management and spill response procedures.

1 Introduction

This is a non-personnel services contract to provide Shop Level Environmental Workshops. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Mission

The following are the performance expectations for this contract:

• Physically inspect hazardous material storage lockers, racks, rooms and/or buildings.

• Evaluate hazardous material storage areas for compliance with regulations, SOPs and BMPs. Describe and explain requirements and any deficiencies.

• If applicable, physically inspect each waste accumulation area, including satellite accumulation points, for compliance with regulations, SOPs and BMPs.

• Physically conduct training on site-specific SPCC plans including notification procedures and spill cleanup procedures. This training must include an overview of the plan contents and use of wall placards.

• Conduct training for oil-handling personnel as required by the SPCC plan, including a physical spill drill exercise, each year. Training must meet all requirements of 40 CFR 112.7(f). Conduct awareness training on the TNARNGs Environmental Policy, SMZ policy and pest management policy including reporting procedures; Ensure site has an environmental policy poster on site and posted;

• Provide each student with a training manual and signed and dated certificate . • For each student who completes the 1/2-day Shop Level Environmental Workshop,

the Contractor will certify compliance, in writing, with RCRA hazardous waste generators training:

• RCRA hazardous waste generators training (40 CFR 262 .34(a)(1) , 262.34(d)(2) , and 265.16)

• OSHA Hazardous Waste Operations and Emergency Response (29 CFR 191 0.120(q)

• Army Regulation 200-1

Each training location will also receive two copies of the current DOT Emergency Response Guide each year that an updated book is released.

1.2 Background

The Tennessee Army National Guard (TNARNG), as an agent of the National Guard Bureau (NGB) is responsible for ensuring that its soldiers are appropriately trained to address the environmental aspects and impacts of their job responsibilities.

1.3 Scope The contractor shall provide a total of twenty-four (24) training classes consisting of four (4) hours (one half day) of instructional Shop Level Environmental Workshops at each location identified in this PWS. Training will be conducted between October 1st and May 31st for all option years of this contract. Each workshop will be based on the Tennessee Army National Guard (TNARNG) Hazardous Materials and Waste Management Plan (HMWMP) and best management practices (BMPs) for hazardous materials and wastes management. In addition, the workshops will conduct training on site-specific Spill Prevention Control and Countermeasures Plans (SPCC) and required associated oil-handling personnel training . 2 General Requirements

The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision , and other items and non-personal services necessary to perform Shop Level Environmental Workshops, (for up to 350 students total) as defined in this Performance Work Statement, except for those items specified as Government furnished property and services. The Contractor shall provide 48 DOT Emergency Response Guides (2 Guides per location times 24 location). The Contractor shall perform to the standards in this contract.

2.1 Non-Personal Services The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Procuring Contracting Officer (PCO) immediately.

2.2 Business Relations The contractor shall successfully integrate and coordinate all activity, with the on-site POCs, needed to execute the requirements . The contractor shall manage the timeliness , completeness, and quality of problem identification . The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel. 2.3 Contract Administration and Management The following subsections specify requirements for contract, management, and personnel administration.

2.3.1 Contract Management The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor shall maintain continuity between the support operations at the Tennessee Army National Guard and the contractor's corporate offices.

2.3.2 Contract Administration

The contractor shall establish processes and assign appropriate resources to effectively

administer the requirements . The contractor shall respond to Government requests for contractual actions in a timely fashion . The contractor shall have a single point of contact between the Government and Contractor personnel assigned to support contracts or task orders. The contractor shall assign work effort and maintain proper and accurate time keeping records of personnel assigned to work on the requirement.

2.3.3 Personnel Administration

2.4 Subcontract Management

The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor shall manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add

subcontractors to their team after notification to the Procuring Contracting Officer (PCO) or Contracting Officer Representative (COR). Cross teaming may or may not be permitted.

3 Performance Requirements The following section specifies the Performance Objectives and Performance Elements for the

contract.

3.0.1 The objective of this Performance Work Statement (PWS) is to provide a total of twenty­four (24) training classes consisting of four (4) hours (one half day) of instructional Shop Level Environmental Workshops at each location identified in this PWS. Training will be conducted between October 1st and May 31st. Each workshop will be based on the Tennessee Army National Guard (TNARNG) Hazardous Materials and Waste Management Plan (HMWMP) and best management practices (BMPs) for hazardous materials and wastes management. 3.0.2 The Contractor shall attend an on-site kick-off meeting, within 2 weeks of Notice to Proceed, with TNARNG representatives at the TNARNG JFHQ in Nashville, Tennessee. At this meeting , the Contractor shall be furnished with the most recent TNARNG Hazardous Materials and Waste Management Plan , Integrated Pest Management Plan, appropriate SPCC Plans, TNARNG Environmental Policy, SMZ policy, contacts and addresses for sites . The COR shall be responsible for copying documents in cases where the original cannot be distributed to the Contractor for use during the execution of this PWS. This information shall include the following :

STD: An electronic copy of meeting minutes shall be forwarded to the COR. In addition, documentation (email) acknowledging receipt of TNARNG Hazardous Materials and Waste Management Plan, Integrated Pest Management Plan, appropriate SPCC Plans, TNARNG Environmental Policy, SMZ policy, contacts and addresses for sites shall be forwarded to the COR.

Deliverables

A001 -An electronic copy of meeting minutes and documentation (email) acknowledging receipt of TNARNG Hazardous Materials and Waste Management Plan, Integrated Pest Management Plan, appropriate SPCC Plans, TNARNG Environmental Policy, SMZ policy, contacts and addresses for sites .

3.0.3 Contractor shall evaluate existing information, provided by the TNARNG, to ensure it meets the needs of the train ing and if it will contribute to the training .

Performance Standards

STD: Contractor shall evaluate existing information for the needs of the training . Existing information should be critically assessed in terms of what it may contribute to the train ing and to identify items that may be needed to enhance the training. Existing information should also be critically assessed in terms of its reliability.

3.0.4 The Contractor shall submit to the COR a review of the proposed project work plan .

3.0.5 The Contractor shall submit to the COR sign-in logs from training sessions, copies of certificates, and any notes and/or recommendations in regards to inventory, hazardous material storage area compliance or spill response recommendations. The Contractor shall also submit to each facility supervisor sign-in logs from training sessions, copies of certificates, and any notes and/or recommendations in regards to inventory, hazardous material storage area compliance or spill response recommendations.

Performance Standards

STD: The Contractor shall submit logs from training sessions, copies of certificates, and any notes and/or recommendations in regards to inventory, hazardous material storage area compliance or spill response recommendations.

AQL: 100%

A004 - sign-in logs from 24 training sessions, copies of certificates, and any notes and/or recommendations in regards to inventory, hazardous material storage area compliance or spill response recommendations for twenty four (24) training sessions.

4.1 Security and Safety

No classified information is involved in the performance of this contract. Contractor will perform the services for this contract lAW all applicable Federal Safety Regulations.

Contractor and all associated sub-contractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contract or Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-111) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
