RULES OF ADMISSION TO FIRST YEAR OF FOUR YEAR FULL TIME DEGREE COURSE IN

PHARMACY AND INSTITUTE INFORMATION FOR THE ACADEMIC YEAR 2010– 2011

The entrance examination for the selection to all Health Science Degree Courses, Engineering and Pharmacy degree courses in State of Maharashtra for the academic year 2010-2011 was conducted by the Competent Authority appointed by Government of Maharashtra on Thursday, 6th May 2010, at all the district headquarters in the State of Maharashtra. This brochure gives the rules and information regarding the distribution of seats under various heads i.e. Home University (HU), O utside Home University (OHU), Insti tute level se ats, Min ority s eats, Out side Maharashtra State (OMS) seats etc.; details of the Reservation and provision of seats, Fees concession offered to eligible candidates, details of the Centralized Admission Process (CAP), details of the Admission rounds, Institute wise Information, etc. These rules also incorporate the guidelines (Annexu re-II) for the rules of ad missions, whi ch are to be carried out by the Unaided institutes for Institute level seats and for the seats remaining vacant after the Centralized Admission Rounds.

1.2 Definitions:

1. ‘State Government’ means the Government of Maharashtra.

2. ‘Director’ means the Director of Technical Education, Maharashtra State.

3. "Application Form" means prescribed form filled up by the candidate online for admission

4. “Competent Authority” means the Authority headed by the D irector of Technical Education, Maharashtra State, sh all be the auth ority for Centralized Admissi on Process and directs the students as per their allotment through CAP to all colleges.

5. ‘Representative of the Competent Authority’ means an officer appointed to assist Competent A uthority f or smooth c onduct of Admission Process as per the directive s of the Competent Authority.

6. “Qualifying examination” means examination on the result of which a c andidate becomes eligible for admission i.e. HSC(12th standard) or equivalent examination

7. ‘College’ or ‘Institution’ means Pharmacy College or In stitution duly approved by the AICTE and Government of Maharashtra to impart Education in Pharmacy at the degree level.

8. ‘Government Pharmacy College’ means th e Pharmacy Colleg e run by the Government of Maharashtra.

9. ‘Government Aided Pharmacy College’ means Pharmacy College run by private management but which receives financial assistance from the Government of Maharashtra.

10. ‘University Managed Pharmacy C ollege’ means Pharm acy College run by a particular University.

11. ‘University Department’ mean s a d epartment of Universi ty which offer s four year degree course in Pharmacy.

12. ‘Autonomous Institute’ means the institute for which autonomy is granted by the Government of Maharashtra.

13. ‘Un-Aided Pharmacy Co llege’ means Pharmacy College runs by private management on self financing basis.

14. ‘Sanctioned Intake’ means the c ourse wise number of seat s sanctioned by the G overnment Resolution with reference to the AICTE’s approval.

15. ‘Inter se m erit’ means the order of merit as defi ned by Maharashtr a State Merit li st/Home University area merit list/ OMS Merit list as the case may be.

16. ‘Candidate’ means an applicant who is an Indian National and desires to seek admission to first year of four year Degree Course in Pharmacy in Maharashtra State by submitt ing the prescribed application form online for the year 2010-2011.

17. “Defence” mean s servic es establish ed under the Army Act 19 50/Airforce A ct 1950/Navy Act 1957.

18. “Persons of Indian Origin (PIO) ”: A Person having foreign ci tizenship (except Pakistan and Bangladesh) without “NRI ” statu s, wh o holds a F oreign Passp ort at the ti me of sendi ng application, consideration for admission and during the period of his/her study, and he/she or any

one/both of his/her paren ts or any one /both of his/her grand parents is (or was)/are (or were) citizen(s) of India by virtue of the pr ovisions of t he Con stitution of Indi a or Sec . 2(b) of Citizenship Act, 1955 (Act No. 57 of 1955).

19. ‘OMS candidate’ means Outside Maharashtra State candidate who is an Indian National.

20. ‘Foreign Nationals’ means Citizens of all countries oth er than India, who are not of Indian origin as defined under PIO.

21. ‘Foreign St udent’ means Foreign Stu dent in this context sh all be defined as the student who possesses a foreign passport.

22. ‘CAP Seats ’ These are the seats for which allotment/admission is carried out by the Compet ent Authority through CAP

23. ‘NRI’: Non Resident Indian as per the definition given in the sec tion 6 of the Income Tax Act 1961.

24. ‘NRI Candidate’ means a candidate who is a child/ward of the person who has the ‘NRI status’ as defined under section 6 of the Income Tax Act.

1.3 Role of Competent Authority in the process of Admission to First year of Pharmacy:-

a) The Competent Authority headed by the Director of Technical Education, Maharashtra State, shall be the authority for Central ized Admission Process and direct the students as per their allotment through CAP to all colleges.

b) Competent Authority shall be the sole authority to effect admission through CAP for Govt., Govt. Aided, Univer sity Departm ent, Univ ersity Manage d colleges, Insti tute of Chemical Technology (ICT), Mumbai.

c) Competent A uthority shall als o effec t admissions t o a c ertain number of seats in Unaided Pharmacy colleges, for which such institutions have given consent.

d) Competent A uthority sh all also deal with the representations received from the candidates pertaining to allotment and admissi ons in Go vt., Govt. Aided, University Managed coll eges, University Departments an d Unaided colleges whic h acts as Grievance Redressal Authority and Appellate Authority at State level.

e) To approve t he list of th e student s ad mitted to Fir st year, by all Unaided P harmacy c olleges submitted through the office of the Joi nt Director, Tech. Education of respective regional off ices in the State of Maharashtra.

f) All the decisions taken i n relation to Admission to First Year of Pharmacy course, by the Competent Authority shall be final and binding on all concerned.

1.4 Seats available for admission through Competent Authority

1.4.1 Seats available for admission through Centralized Admission Process (CAP): These are the seats for which admission is carried out by the Competent Authority through CAP. The details of such seats are as shown in the following table.

#CAP Seats = Sanctioned Intake – (Minority Seats + Institute level seats)*

The exac t distribution of sea ts available for allotment shall be notified on the website before submission of option f orms of Cen tralized Admissi on Process.

1.4.2 Seats available for Government of India Nominees:-

Provision of a specified n umber of seats i s made for the nomi nees from states and Union territories,

which lack the facility in Technical Education. The Ministry of Human Resource Devel opment (MHRD),

Government of India determines these seats every year. These seats are over and above the sanctioned

intake for the course in which admissions against these seats are provided.

The admission procedure for these seats is as under:-

The respective State selects the candidates for the seats earmarked for their state.

The Competent Authority of the respective State issues the course and college allotment

letter to the candidate.

Candidates along with course and col lege allotme nt letter reports t o the Directorate of

Technical E ducation, M aharashtra State, 3, Mahapalika Marg, Dhobi Talao, Near

Metro Cinema, Mum bai 400 001 f or scrutiny of original certificates and for collecting the

admission letter on or before 31st August of the current academic year.

No GOI Nominee candidate shal l report di rectly to the Institute. In case such

candidate reports dire ctly to the Institute, the Principal of the institute should not

admit such candidate and ask the candidate to approach above mentioned office.

These admissions are subject to the following conditions: -

Candidates nominated by the concern ed States shall be admitted only and only if they fulfill the

condition of eligibility. The candidates so admitt ed will have to obtain eligibility certificate from

the University in which admission is secured.

If the candidate does not fulfill the minimum eligibility criterion , he or she will not be considered

for admission even though he/she has been nominated as a GOI nominee.

The back ward class category GOI candidates n ominated from the respective States will get

relaxation in educational qualification for eligibility as in the case of Maharashtra state backward

class c ategory candidates. However G OI nominees belonging to backward cl ass category does

not get any exemption in tuition fee.

Candidates admitted und er this provi sion are no t allowed to change cou rse or c ollege in

subsequent years.

1.5 Seats available with other authorities:-

The seats as mentioned below are not covered under the CAP and the respe ctive institutions are th e

authority for admission s to these seats. The c andidates seeking admission under these seats shall

submit separate application/s to the concerned admission authority / authorities.

15% seats of the sanctioned intake capacity. 1/3rd of the 15% seats shall be reserved for children of Indian Workers in the Gulf Countries and 2/3rd of the 15% seats shall be reserved for the PIO/ Foreign Nationals etc.

The NRI can didates are eligible to apply for admissi on against the Institute level seats, onl y in Unaided

Private Pharmacy Colleges/Institutes subjected to the approv al f rom AICTE. The extent to which such

NRI candidates shall be admitted is limited to 5% of the sanctioned intake. * As per Gov ernment Resolution No. +Æ¶ÉèºÉ-2008/|É.Gò.133/2008/EòÉ-1 Ên. 04/07/2008 and its

amendments which may be published from time to time.

** As per th e orders of Hon’ble High C ourt of B ombay, these seats c an be filled by the insti tutes only

after the institute is c ertified b y the AICTE to the effect that the i nstitute has i nfrastructure

facilities for making the admissions ag ainst the over and above the sanctioned intake seats for F oreign

Nationals, Foreign Students, PIOs and children of Indian Workers in the Gulf Countries. In the event of

Non-availability of Foreign Nationals, Foreign Students, PIOs and children of Indian Work ers in the Gulf

Countries, these seats can not be filled from any other candidates.

*For the pur pose of deciding Home University of the candidate, jurisdiction of both the Shivaji &

Solapur University will be combined together and will be treated as a single University area viz. th e

Shivaji University. In effect, candidate passing qua lifying exam (std. XII) from Solapur distri ct will be

assigned Home Univer sity as Shivaji University. Also a candidate passing qualifying exam (std. XII)

from Satara/Kolhapur/Sangli district will be assigned Home University as Shivaji University. 1.7 Allocation of Seats 1.7.1 Types of Seats under CAP: - I) Maharashtra State Seats (MHT-CET-2010):

Home University seats (HU Seats):

Certain percentage of seats of every institute is reserved for Home University i.e. for the University under

the jurisdic tion of which that in stitute is situated. Hom e University seats ar e av ailable f or all otment

through CAP for the Maharashtr a candidates having their Home University status as that Un iversity. For

example, candidates having their home university as RTM Nagpur University will be eligible admission to

the Hom e University seats of those i nstitutes whi ch are located in the jurisdiction of RTM Nagpur

University.

Seats for candidates belonging to Universities other than Home University (OHU seats):

Certain percentage of seats of every institute is re served for Other Universiti es i.e. for the Universiti es

other than the Home University under the jurisdiction of which th at institute i s located. Such seats are

called as O HU seats. Candidates c an opt for seat s of any oth er Universi ty (excluding his/her hom e

university) under this provision of O HU seats. F or example, candidates having their home university as

SGB Amravati University will not be eligible for the OHU seats of those institutes which are located in SGB

Amravati University. Cand idates h aving their home University other than SG B Amravati University ar e

eligible for these OHU seats of the SGB Amravati University.

Note :- Statutory reser vations f or candidates of backward class categories b elonging to

Maharashtra State only will be as per the rel evant rules and resolutions of th e G overnment of

Maharashtra will be applicable for admi ssions against the seats available in Home Univ ersity and Other

than Home University.

II) OMS Seats:

These seats are available for allotment through CAP for MHT-CET-2010 qualified eligible OMS candidates.

No reservation for candidates of backward class categories, Ladies, PH, Defence etc. is provided in these

seats i.e. all these seats are treated as belonging to the “General Category”.

1.8 Sanctioned intake for Pharmacy Course in various Institutes for the year 2010-11

Sanctioned intake for Pharmacy Course in various Institutes for the year 2010-2011 is mentioned

in the Institute information part of the brochure.

The AICTE shall commun icate to th e State Gove rnment the approved new institute/s, the

changes in the existing intake capacity of different courses and introduction of the new courses in

the existing institutes, before 15th June 2010.

Approvals to st art a new institut e/course a nd ch anges in th e in take c apacity of the existing

courses communicated after the 15th June 2010 will not b e considered for admission during the

academic year 2010-11. (As per the j udgement delivered on dated 22 nd August 2008 by Full

Bench of Hon. High Court of Bombay in W.P. No. 8847 of 2007 and other petitions)

Approvals to start a new institute and changes in t he intake capacity for the course in e xisting

institutes c ommunicated by AICTE af ter the printing of the i nformation b rochure shall be

displayed on the website http://www.dte.org.in/ph2010 and will not be separately notified in any

newspaper. This inf ormation will al so be made available at all the Regi onal offices of the

Directorate of Technical Education.

The fin al Institute Inf ormation di splayed on D TE web sit e will be tre ated as authentic for

admissions for the year 20 10-11. Candidates are in structed to refer the web site for the revised

and final Institute Information before filling the Option/Preference Form.

2.0 Eligibilit y Criteria: 2.1 Eligibility criteria for Maharashtra State C andidates and Outside

Maharashtra State Candidates for ad mission to first year of degree course in Pharmacy:

Candidate sh ould be an I ndian Nati onal and should have p assed the HSC (Std.XII) examination of

Maharashtra State B oard of Second ary and Higher Second ary E ducation or its equival ent examin ation

with subjects English, Physics, Chemistry and Biology/Mathematics AND Secured minimum 50% marks

i.e. not less than 150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of

The eligibility of the candidates passing the HSC (Std. XII) or its equivalent exam. from a

school/college/Examination Board situate outside India shall be furt her decided by the

University Authorities to which the candidat e is admitte d. Hence such candidates are

advised to get their el igibility ver ified b y the respective Univers ity Authorities b efore

seeking admission to the Pharmacy degree course in the State of Maharashtra.

The candidate belonging to this ty pe Stated in rule 2.2, i s not required to appear for the

MHT-CET 2010.

2.3 Eligibility criteria for Candidates who are sons/daughters of Defence Service Personnel:

In addition to the basic eligibility criterion menti oned in rule n o.2.1, candidates who have appeared &

obtained a n on zero scor e in the MHT-CET 2010 and sa tisfying any one of the following criterion s are

eligible to seek admission against seats for sons/daughters of Defence service personnel.

Candidate is a son/daughter of ex-service personnel who is domiciled in Maharashtra State (Type

Def-1).

Candidate i s a son/daughter of ac tive service personnel who i s domiciled in Mahar ashtra State

(Type Def-2).

Candidate is a son/daughter of active service personnel (Type Def-3) –

Who is transferred to Maharashtra State but is not domiciled in Maharashtra State

Who is not domiciled in Maharashtra State bu t his/her family is stati oned in Mahar ashtra

State under the provision of retention of fam ily accommodation at the last duty station on

the ground s of children’ s’ education , provided fu rther th at, such candidate sh ould have

appeared and passed the HSC (Std.XII) exam ination of M aharashtra St ate Board o f

Secondary and Higher Secondary Education or its equivalent examin ation from a

school/college situate in the State of Maharashtra.

Note: This provision is NOT availab le to the ch ildren of CIVILIA N ST AFF who is working/

who has worked in the Indian Defence Service.

2.4 Eligibility criteria for Candidates who are Physically Handicapped:

In addition to the basic qualification mentioned in rule no. 2.1, candidate who has appeared & obtained a

non zero score in the MHT-CET 2010 and suffering from any one of the following disability is eligible to

seek admission against seats for Physically Handicapped candidates [ Maharashtra State candidates

of Type A, B and D are only eligible to apply for admission against these seats]

2.5 Eligibility criteria of Candid ates wh o have passed/passing Diploma in Pharmacy and seeking admission to First Year of Pharmacy:

Diploma holders who hav e passed the Diploma cour se in Pharm acy with minimum of 50% marks and

medium of instruction as English from AICTE approved Polytechnics.

Note:

1. To resolve a tie i.e. more than one candidate securing equal aggregate marks in Final year of the

Diploma exam, following order of pref erence shall be adopted: marks in Mathematics at SSC ,

Grand Total at SSC.

2. Eligible Diploma candidates shall be considered for Admission against the Institute level seats in

Unaided Pri vate Institutes only . The details of the admission process for filling seats ar e

specified in Annexure-II.

3. Such Diploma candidates are not eligible to appear for the MHT-CET 2010.

General Notes:

1. In case the maximum marks in individual subject is other than 100, convert the marks out of 100

for individual subject but do not round off these marks. If the sum of the c onverted marks of

three individual subjects without rounding off works out to be a figure with fraction then fraction

up to two decimal places will only be considered Example: If a candidate obtains 101 marks out

of 200 in Ph ysics, 86 m arks out of 15 0 in Chemistr y and 40 Marks out of 10 0 in Mathem atics,

then the sum of marks obtained work s out to be 227 out of 450 marks. If it is converted out of

300, it works out to be 15 1.33. However if the ma rks in individual subjects are converted out of

100, then th e mark s are as 50 .5 in P hysics, 57 .3333 in Chemistry and 40 i n Mathemati cs. It

means the su m of c onverted marks of i ndividual subject is 147.83 33, which is 147.83 upto two

fraction. Hence the candidate is not eligible for admission under OPEN Category.

2. If letter gr ades are assigned inst ead of marks at SS C, HSC or i ts equivalen t examin ation the

candidate m ust ob tain th e certificate of conver sion of letter of grades into marks from the

4.0 Reservations

All the reserv ations given below shall be applicable to candidates belonging to Maharashtra State only

4.1 Reservation for Backward Class category Candidates:

The percentage of seats reserved for candidates of backward class categories belonging to Maharashtr a

State is as per the details in table given below. The percentages of reservation are the percentages of the

seats av ailable for Mahar ashtra candi dates, which are coming under the purview of the Competen t

Authority. These are the minimum percentages of reservation exclusive of the backward class candidates

securing allotment through General Merit by virtue of merit. B ackward class candidates shall claim th e

4.2 Reservation for sons/daughters of Defence service personnel:

Five (5) % seats of the total sanctioned intake for an institute, subject to a maximum of five (5) seats in

each institute coming under CAP shall be reserved for

Children of ex- service personnel who are domiciled in Maharashtra State (DEF-1).

Children of active service personnel who are domiciled in Maharashtra State (DEF-2).

Children of active service personnel (DEF-3) –

4.3 Reservation for Physically Handicapped Candidates:

As per the provisions in Clause 39 of Equal Opportunities, Protection of Rights and Full Parti cipation Act

1995, three (3) per cent seats of total sanctioned intake capacity of all the institutions coming under CAP

shall be reserved for physically handicapped candidates under the following categories:

visually impaired (blind) candidates (P1)

speech & hearing impaired (deaf & dumb) candidates, (P2)

Orthopedic disorders, learning disabilities, Dyslexia, Dyscalculia, Dysgraphica, Spastic (P3).

Allotment of the seats reserved for the Physica lly Handicapped candidates shall b e done on

the basis of a respective inter-se merit of such candidates. These seats are available in 70%

Home University area seats only for Maharashtra Type- A, B and D.

Note:

It should be noted that the physically handicapped candidates on admission to Pharmacy degree

course will n ot be given any exemptions or additional facilities i n the academic activities other

than those which may be provided by the respective Universities. Further it is specifically brought

to the notic e of Physic ally Handic apped candid ates that, they should submi t the certificates

strictly as per the Proforma– F/F-1.

4.4 Reservation for Female candidates:

As per the provisions in Govt. Resolution No.GEC-1000/ (123/2000)/ Tech. Edu.-1, dated 17th April, 2000,

30% se ats available f or MS-CAP sh all be res erved for fem ale candidates in all the cour ses of the

institutions coming under CAP. This reservation shall be applicab le for Gener al, SC, ST, D T/VJ (NT-A),

NT-B, NT-C, NT-D and OB C categories. Seats reserved for Femal e candidates are available under both

the 70% Home Universi ty seats and 30% Other than Home University seats coming under the CAP.

There shall be no reserv ation for Female candidat es under Def ence, Phy sically Handicapped and SBC

categories.

IMPORTANT: All such candidates wh o fail to sub stantiate claims made ( such as res ervation category,

PH, Defence etc.) with supporting necessary documents shall be converted to GENERAL category and/or

such applications will be r ejected as the case m ay be. Once such candidates are converted to GENERAL

category and they will h ave to fulfill the minimum eligibility criteria as set out for a GENERAL category

candidate.

5.0 Assignment of merit number:

5.1 Merit Number for Maharashtra Candidates:

Each eligible Maharashtra State Candidate (Rule 2.1) who has ap peared for MHT-CET 2010 and

obtained a non zero score in MHT-CET 2010 and submitted application form on or before the last

date prescribed for the submission of Application Form for Admi ssion to Ph armacy through CAP

will be assigned a provisional merit number.

Merit of all el igible Maharashtra State candidates will be based on the MHT-CET 2010 score (out

of 200 marks) only; relativ e merit in case of a tie (i.e. equal m arks in MHT-C ET 2010) sh all be

resolved as per rule no. 5.1.1.

OMS candidates should note that, a separate merit list of all eligible OMS candidates (Rule 2.1)

shall be pre pared based on the MHT-CET 2010 score (out of 200 marks) onl y, relative merit in

case of a tie (i.e. equal marks in MHT-CET 2010) shall be resolved as per rule no. 5.1.1.

Note:

1. Merit list of Maharashtra State C andidates so prepared shall indicate a State level

General Merit No., State level Category Mer it no. (as applicab le), Home U niversity

General Merit No., Home University Category Merit no. (as applicable) etc.

2. Assignment of a Merit number does not indicate or ensure admission to any seat.

5.1.1 Relative merit in case of a tie:

In the case of candidates securing equal number of marks in MHT-CET-2010, their relative merit will be

fixed on the basis of the following order of preference:

(a) A candidate securing higher marks out of 100 in the subject of Mathematics in MHT-CET-2010.

(b) A candidate securing higher marks out of 50 in the subject of Physics in MHT-CET-2010.

(c) A candidate passing the SSC (Std. X) examination with higher aggregate marks.

(d) A candidate securing higher marks in the subject of Mathematics at SSC (Std. X) Examination.

(e) Birth Date of the candidate (Elder Candidate will be given preference)

Note: While converting the marks, if the converted marks work out to be a figure with fraction, fraction

up to two decimal places will only be considered.

5.2 Change of Marks due to verification:

If the marks i n the qualifying examination are modified due to ver ification and the same is duly certified

by the Maharashtra S tate Board of Se condary and Higher Sec ondary Educ ation or its equ ivalent, the

same shall be reported to the ARC Incharge immediately.

However the effect of th e change will b e taken into consideration only for the subsequent round/(s) of

admission. 6.0 Admissions of Foreign Nationals / Foreign Students / Persons of Indian

Origin /Children of Indian workers in the Gulf countries / Ward of NRI

6.1 Admissions in Government & Government – Aided Institutes:

Aspiring can didates fulfill ing the eligibility crit eria for Foreign National s/Foreign stud ents

/PIOs/Children of Indian workers in the Gulf countri es shall directly submit their applicati ons to

“The Joint Director, Te chnical Education, Regional Office, Osma npura, Auranga bad”

for admission to Govt. Institutes along with application processing fees of US $100 for admissions

to Govt Institutes, Govt Autonomous Institutes. University Managed Institutes & Departments.

The admis sion against the se supernumerary seats is permitted t o the institut es only after the

institute gets an approval from AICTE. Details of admission process are available on the website:

6.2 Admissions in Unaided Institutes:

For admi ssions to Unaided Institutes which ar e permitted to fill seats against For eign Nation als /

Foreign Students / Persons of Indian Origin /Children of Indian workers in th e Gulf countries, candidates

are required to contact to t he Principals / Directors of the respective Institutes (for list of such institutes, fees, documents required etc. refer www.dte.org.in/foreign_adm2010).

Note:

These admissions will be made strictly as pe r m erit on or bef ore th e c ommencement of

academic session for the first semester/year for the current academic year.

The admission against these supernumerary seats is permitted to the institutes only after the

institute gets an approval from AICTE.

If any seat s available for Foreign Natio nals / Fo reign Students / Persons of In dian Origin /

Children of Indian worker s in the Gulf countries remain vacan t due to non -availability of

eligible candidates for these seats, such vacant seats sh all be kept vacant. Under any

condition these seats shall not be offered to any other candidates.

1/3rd of the 15 % seats shall be reserved for children of Indian workers in the G ulf countries

and 2/3rd of the 15 % seats shall be reserved for the PIO/Foreign Nationals etc. however any

vacant seats out of 1/3 category sh all be re verted to the quota of 2/3 meant for PIO/FN.

6.3 Admissions of Chi ldren/Ward of NRI Candidates in Unaided Private

Institutes:

The eligible NRI candidates are eligible to apply for admi ssion again st the Institute

level seats , only in Unaided Private Pharmacy Colleges/Institutes who have got an approval

from AICTE to admit NRI candidates within the sanctioned intake.

For admissions to Unaided Private Institutes, candidate s ar e required to contac t the

Principals / Directors of the respective Institutes.

The extent to which suc h NRI candidat es shall be admitted is limited to 5% of the

sanctioned intake.

NRI candidates will b e required to p ay fees as decided by the Shiksh an S hulka Sami ti,

Mumbai.

These admissions will be made strictly as pe r m erit on or bef ore th e c ommencement of

academic session for the first semester/year for the current academic year. 7.0 Rules of Admission through Centralized Admission Process (CAP)

This section briefly explains the variou s stages and procedure adopted for the CAP. Candidates seekin g

admission to Pharmacy courses are r equired to a ppear for MHT-CET 2010 c onducted by th e respective

Competent Authority.

For the academic year 2010-11, Competent Authority shall conduct total Three (3) rounds of Centralized

Admission. T he CAP shall con sist of first t wo (2) rounds of Centralized A llotment wherein eligible

candidates (both Mah arashtra and OMS) will fill separate/fresh Online Op tion forms for each round .

Third round of CAP shall be conducted by way of counseling only for the eligible Mahar ashtra State

candidates.

Major Steps in the CET and Admission through CAP are summarized below:-

1. Fill in and Submit Application Form for MHT-CET 2010

2. Appear for the MHT-CET 2010 as per the schedule

3. Declaration of the result of MHT-CET 2010

4. Document Verification, Fill in the Online Application Form for Centralized Admission t o

Pharmacy i.e. CAP and Confirm it at the Application form Receipt Centers (ARCs) by eligible

MHT-CET 2010 qualified candidates

5. Display of Merit List of candidates wh o have c onfirmed the onl ine Application Form for

Centralized Admission to Pharmacy on website www.dte.org.in/ph2010.

6. Fill in and confirm the Online Option Form(s) for CAP Round(s) I/II (by candidates eligible

to participate in these CAP rounds) on the website www.dte.org.in/ph2010.

7. Display of Allotment(s) of respective CAP Round(s) I/II on the we bsite

www.dte.org.in/ph2010.

8. Reporting to respective Institutes as per allotment of CAP Round(s) I/II.

9. Conduction of CAP Round-III by counseling and Reporting to respective Institute.

Note:- A notification givi ng details such as schedu le, proced ure of Centralized Admission will be

displayed on the website and published in leading newspapers.

In order to participate in the CAP, the aspiring & eligible candidate is required to submit and confirm the

“Application Form for Centralized Admission to Pharmacy” as per schedule at the ARC.

The scheme of allotment through Multiple Rounds and Rules of Reporting presented below is designed to

prevent loss of academics and to make the CAP Rounds meaningful and effective rather than formal and

ineffective in view of th e previous experience of this Directorate as also the f acts and figu res available

with this Directorate as to the seats remaining vacant at the end of each Rou nd(s) and especially at th e

end of all th e Round(s) of such Cen tralized Allotm ent Proc ess. The r ounds are so de signed with t he

purpose that, maximum vacant seats are filled in, without creating further resultant vacancies on account

of shifting of students to whom already allotment has been made in earlier rounds of CAP.

This step is r equired to enable the colleges to star t the academic activity immediately to complete th e

term in time.

Eligible candidates: All the eligible Mah arashtra State candidates wh o h ave a v alid MHT-CET-2010

score and have been assigned Maharashtra State Merit number and whose name appear in the merit list

for respective CAP rounds prepared by the Competent Authority shall be considered for these Rounds.

Seats available: Refer 1.7.1

7.1.1 Direct Allotment-CAP Rounds I & II for Maharashtra State candidates

Allotment for Home University (HU) seats and other university c andidates (OHU) seats coming

under CAP will be carried out as per the logic explained in the rule 7.1.3.

For the CAP Round -I, Stage-I , Stag e II and Stag e-III of rule 7.1.3 shall b e executed. Seats

remaining vacant due to non-allotment and non -reporting will be availabl e for allotment in CAP

Round-II.

For the CAP Round-II, Stage-I to S tage-VII of rul e 7.1.3 shall be executed . Seats rem aining

vacant due to non-allotment and non-reporting will be available for allotment in CAP Round-III..

The seat tags i.e. Reserved cat egory, PH, DEF, HU, OHU, Ladies etc. shall be

maintained during allotment in CAP Round-I &II only.

The numb er of seats, type of seat tag et c. will b e made availa ble to the eligib le

candidates before filling of the option form for CAP rounds I and II.

7.1.2 Centralized Counseling-CAP Round III for Maharashtra State candidates

Third Round of Centralized admission Process will be conducted only for Maharashtra State

Candidates eligible to participate in this round.

The candidates are required to remain physically present for this round.

Seats remaining vacant at the end of Round II & seats remaining vacant fr om the OMS seats

shall be considered for this round.

All seats av ailable sh all be treated as GENERAL seats i.e. n o seat tag like Ladies, P H,

Reservation, HU, O HU etc will be applicable. A ll th e vac ant O MS Seats sh all be treated as

GENERAL seats.

Seats shall be allotted solely on the basis of inter-se merit of eligible MS candidates without any

reference whatsoever to the category of the c andidate(s) (open /reserved) or the category to

which the v acant seat b elongs (su ch as Home Univer sity, other than Home Univer sity,

Backward Class, Physically Handicapped etc)

General Notes:

Allotment for Home University seats and Other than Home University seats will be carried out as

per inter se merit of University area merit list and Maharashtra State merit list respectively of CAP

Round-I, II.

Seats will be allotted to candidates as per their inter se merit, as per the options filled and the

number of seats available at that point of time in the stage of CAP Round-I, II.

All candidates eligible for a particular stage of all otment will be consider ed for allotment f or a

seat in that stage, even if they have been allotted/not allotted a seat in the previous stage.

During the al lotment of any st age, the candidat e m ay get upward shift in th e allotment with

reference to the option s filled by the candidate according to availability of seats at that point of

time.

All reserved category candidates (including SBC in their original category) shall be considered for

allotment (whether they are allotted any seat in earlier stage or not) in all stages.

Due to upward shifts, the seats falli ng vacant shall be consi dered for allotment in fu rther

iterations of the same stage as per the provisions of that st age of allotment and as per inter se

merit.

Allotment ag ainst th e first available option in the order of opti ons filled is retained as final

allotment.

The allotment will be displayed on DTE website http://www.dte.org.in/ph2010. The allotment list

displayed will show only the provisional allotment offered to the candidates.

No personal communication/Allot ment letter s in this regard will b e issued to the

concerned candidates.

The logic f or the followin g stages will be impl emented using computer software f or the direct

allotment.

The candidates securing allotment will confirm the admissi on by reporting at the institute

mentioned in allotment along with the original certificates need ed for admission , by paying

necessary fees on or before the last date specified for the same. No personal communication

in this regard will be issued.

The admissi on will b e confirmed at the ‘Respe ctive Insti tute’ only after scrutiny of

documents and payment of fees as prescr ibed by the Shiksh an Shulka Sa miti,

Mumbai. (Please refer Annexure-I for details)

7.1.3 Logic for Allotment for CAP Rounds I & II:

The seats available for the implementation of this logic will includ e the Home University and OHU seats

coming under the purview of Competent Authority.

Stage I: For all the candidates

All the candidates (open/reserved/mal e/female) of all the categories sh all be considered for

allotment as per their inter se merit.

Backward class category c andidates shall be c onsidered for allotment in open category seat by

virtue of thei r merit or in their respec tive category of reservation if open category seats are not

available at their merit.

SBC category candidates shall be considered for allotment in Open category by virtue of their

merit or in their original category of reservation, if open seats are not available as per their merit

Physically h andicapped category c andidates sh all be consid ered for allotm ent for th e seats

reserved for them by virtu e of their merit or in open category as per their inter-se merit if the

seats reserved for physically handicapped candidates are not available at their merit.

Defence category candidates shall be considered for allotment for the seats reserved for them by

virtue of thei r merit or in open c ategory as p er th eir inter-se merit if the seats r eserved for

Defence category candidates are not available at their merit.

For the female candidates, the availability of seat shall be checked in the following order:

1. in the seats reserved for females in open category,

2. in the general seats in open category,

3. in the seats reserved for females in respective caste category as applicable,

4. in the general seats in their respective caste category as applicable.

Stage II: For all the Backward Class Category Candidates

On completion of stage-I, if any of th e backward class categories mentioned above, doe s not get the

required number of female candidates f or the percentage laid down, the seats so remaining vacant shall

be considered for allotment to male candidates belonging to the respective Backward Class category.

Stage III: For Special Backward Class category candidates

On completion of Stage-II , if any of the backward c lass categories mentioned above, does not get the

required number of candid ates for the percentages l aid down , the seats so remaining vac ant shall be

considered for allotm ent to all the candidates (mal e and f emale taken t ogether) of Speci al Backw ard

Class (SBC) category, as per their inter se merit, limited to the extent of two per cent seats of

Maharashtra State seats which are coming under the purview of Competent Authority for the course.

Stage –IV: For respective groups of Backward Class category candidates

All the Backward class category candidates will be considered for allotment in this stage in th e groups as

mentioned below.

Group 1: i) Scheduled Castes and Scheduled Castes converted to Buddhism (SC)

ii) Scheduled Tribes including those living outside the specified areas (ST)

Group 2: i) Vimukta Jatis/De- Notified Tribes (VJ/DT) NT(A)

ii) Nomadic Tribes 1 (NT-B)

Group 3: i) Nomadic Tribes 2 (NT-C)

ii) Nomadic Tribes 3 (NT-D)

iii) Other Backward Class (OBC)

On completion of Stage -III, the seats remaining va cant in the respective group of categori es as

mentioned above, shall be considered for allotment to the candidates of respective group as per the inter

se merit of the candidates.

Stage-V: For all Backward Class category candidates

The seats reserved for Backward clas s category candidates remaining vacant after completion of Stage -

IV, shall be consider ed for allotment to the candid ates of all th e reserved c ategories together, on the

basis of their inter se merit.

Stage –VI: For all Physically Handicapped candidates

The seats of physically handicapped remaining vacant after completion of Stage-V, shall b e considered

for allotment to the c andidates of the categ ory of physically h andicapped (P-1, P -2 and P-3 tak en

together), on the basis of their combined inter se merit.

Stage -VII: For all candidates (without any type of reservation)

The seats remaining vacant after completion of Stage -VI, shall be considered for allotment to all the

candidates (open/reserved/male/female) on the basis of their inter se merit.

7.2 Direct Allotment-CAP Rounds I & II for the OMS Candidates

These rounds will be carri ed out for OMS seats, wh ich are coming under the purview of the Competent

Authority for qualified OMS candidates who have applied for admission to degree course in Pharmacy.

Eligible candidates: All the eligible candidates wh o have a valid MHT-CET-2010 score and have been

assigned OMS Merit num ber/rank and whose n ame appear in the merit list for respective CAP rounds

prepared by the Competent Authority shall be considered for allotment in these Rounds.

Seats available: Seats available for these rounds are 15% of the seats of the sanctioned intake in Un-

aided Non -Minority Ph armacy Colleges and 15% of the CAP seats in Un Aided Minority Pharmacy

Colleges which are available with the competent authority for admission through CAP.

General notes:

Allotment for these seats will be carried out as per inter se merit of O MS merit list prepared

by the Competent Authority of State of Maharashtra.

There is no provision of reservation for Backward Class category candidates in OMS seats.

Seats will be allotted to c andidates as per their inter se merit, as per the options given in

preference form and the number of seats available at that point of time.

Allotment against t he first avail able Pr eference in t he order of choices ment ioned in the

Preference form is retained as final allotment.

The allotment lists will b e made available on D TE Website www.dte.org.in/ph2010. The

allotment will show allotment in respective allotment Rounds-I/II.

All OMS candidates are treated as GENERAL/OPEN candidates and are n ot eligible to cl aim

for any reservations or provisions.

7.3 Reporting of candidates of CAP Rounds :-

Principals/Directors of respective institutes are required to carefully scrutinize al l the required documents

submitted by the candid ates at the time of repor ting. Any discrepancy in the claims as type, category,

eligibility etc. made by the candidates and/or such claims which are not supported by relevant documents

should be im mediately br ought t o the notice of th e respe ctive Regional Offi ce of th e Dir ectorate of

Technical Education before confirming the admission of such candidates. Th e Principals/Directors of the

Institute shall be responsible for issues/litigation arising out of such admissions.

After the di splay of allotment of CA P Rou nds, candidates should report to th e respective

Institutes where they have been allotted a seat as per the n otified schedule of th e admi ssion

process.

Candidates shall report to the concerned institute with ALL original certif icates needed to

substantiate the claims made in the application regarding eligibility and reservation as specified in

Annexure- II.

If the candi date fails to report to the allotted institute within specified schedule i.e.

on or before the last date of reporting after each allotment round, then such a

candidate forfeits the claim on the allotted seat.

If a candidate fails to sub stantiate the claims made at the time of submitting necessary original

documents within the re porting time for CAP Rou nd, the candi date forfei ts the claim on the

allotted seat.

If a candidate is unable to produce original certi ficates at the time of his/ her admission on

account of a dmission alre ady secured to som e ot her instituti on, he or she shall produ ce a

certificate from the head of the in stitution where he/she has already taken admission indicating

that he/she has been admitted to a particular course in that institu tion on a par ticular date and

hence original certificates have been retained in that institution. The candidate shall produce the

attested copies of the certificates duly attested by the Head of the concern ed institution. Such

candidates shall be requi red to pay the fees immediately at t he time of admission and such

candidates shall be permitted to submit the required original certificates within 4 working

days after the date of payment of fees.

After scrutin y of original documen ts, the c andidate will hav e to pay prescribed full fees

immediately i n the form as prescribed by th e concerned institu te and confirm the admi ssion

offered. In the case of Government, Governme nt aided, University Managed institutes and

University Departments, c andidates are required to pay the tuition fees in the form of Deman d

draft in favour of the Principal /Registrar/Director as the case may be.

If candidate fails to p ay the prescribed full f ees wit hin the rep orting time f or CAP Round, the

candidate forfeits the claim on the allotted seat immediately.

If a candidate is off ered admission, hi s or her or iginal School / C ollege Leaving Certificate (after

qualifying examination) will be retained by the concerned Institute. This original School / College

Leaving cer tificate will not be return ed to any candidate once admitted to a c ourse at th e

institute unless the candid ate cancels his/her admission. All other certificates will be verified by

the Institute at the time of admission & returned to the candidate.

7.4 Additional Round(s): Counseling Round at Govt., Govt. Ai ded, University Manage d and U niversity Departme nts only: For all the Maharashtra State candidates on the basis of MHT-CET-2010 only

If any vacancies remain after the end of CAP Round-III, the respective Principal / Director of the

Institute / Department shall conduct additional round of admi ssion for all the Maharashtra State

candidates (open/reserved/male/female) of all the categories as per their inter se merit of MHT-

CET-2010 score.

7.5 Admissions to the Seats remaining vacant in Unaided institutions after CAP round-III:

(For eligible Maharashtra State candidates and Outside Maharashtra State candidates)

The Principal/Director of the un -aided institu tion has to carry out the ad missions for the

vacancies after the CAP Round-III as per the guide lines given in Annexure-II. 8.0 Fees and concessions in Govt., Govt. aided, University Managed

Pharmacy colleges, University Departments and Fees prescribed in Unaided Pharmacy Colleges

8.1 Fees prescribed:

As per the Govt. resolution No .TEM-2003/(249/03)/TE-1, dated 11t h September 2003, the tuition ,

development and other fees p er an num for Govt., Govt. ai ded, University Managed Colleges and

University Departments is as indicated below. However revision i n fees if any by the State Government

will be binding on the students who will be admitted in the year 2010-11.

For Open category candidates:

Tuition fee: Rs. 8000/-

For SC/ST/VJ/DT NT(A)/NT(B)/NT(C)/NT(D)/SBC/OBC category candidates : -

No tuition fee for admission (in any round) in Govt./Govt. Aided/University managed

Pharmacy colleges and University Departments.

For all the candidates :

Development fee Rs. 6000/-

The interim fee structur e for unaided Pharmacy college s approved by the Shikshan Shulka Samiti will be

made available on http://www.dte.org.in/ph2010. Unaided Pharmacy Colleges may have submitted their

proposals for revision in fees to Shiksh an Shulka Samiti. The revision in the fees if any, by the Shiksh an

Shulka Samiti will be binding on the students who will be admitted in the year 2010-11 and the students

taking admission in these institutes will have to pay the fees accordingly.

Details of Concession in fees for Backwar d Class Category Candidates (b elonging to

Maharashtra State only) in Unaided Private Institutes is mentioned in Rule 8.6.3.

Note:

No additional fees other than the University Fees as specified by the respective University and Hostel

Fees in case of candidates opting for hostel accommodation shall be charged at institute level from the

candidates. 8.3 Fees for GoI nominees:

Government of India Nominee candidates shall pay the fees same as that of the fees of Govt.

institutes to respective institutes where they have secured the admission. 8.4 University fees:

Candidates shall be required to pay fees as prescribed by the concerned University from time to time. 8.5 Caution Money deposits:

Caution money deposits received from the students shall be refunded after successful completion of the

course or after canceling the admission . Unless there is any recovery, no deduction shall be made from

the cauti on money deposit. However , the amoun t of caution money deposit shall be transferred to

Students Aid Fund in case of Un-Aided c olleges and credited to Government in case of Government and

Government-Aided Colleg e, if c andidate does n ot apply for refu nd, within 3 complete financial years

after the student actually leaves the instituti on; or, within 3 complete financ ial years after the date of

successful completion of the course, whichever is earlier. 8.6 Concession in tuition and other fees:

All the schemes given below, regarding concession in tuition & other fees shall be available to candidates

belonging to Mahar ashtra State only subject to th e fulfillment of the eligibility criteria specified by

respective authorities offering such concession in fees from time to time. 8.6.1 E.B.C. Concession:

Candidates claiming concessions for Economically Backward Class (E.B.C.) shall produce a certificate from

the Execu tive Magistr ate to the effect th at t he candidate be longs to EBC cat egory at the time of

admission. They shall, on admission, also submit an application in the prescribed form for b eing granted

the concession of free education, to the appropri ate authorities through the c ollege to whi ch they are

admitted within one month from the actual date of joining of college or as may be required. The students

shall note that applications received after the due date may not be considered and in that case, they will

have to pay the necessary fees.

The concessions in tuition fee at t he time of admission will be given only for Government,

University Managed and Gove rnment-Aided Institutions .The sche me/mode o f concessio ns,

scheme of loan scholarship (if any) for eligible EBC candidates, in tuition & other fees in the

Un-Aided Institutions will be announced by the State Government.

8.6.2 Concession for sons and daughters of teachi ng and Non-teaching staff

of Primary, Secondary and higher secondary schools:

The candida tes claiming conce ssions fo r sons and d aughters of primary, sec ondary school and higher

secondary schools (Junior colleges) teachers or non-teaching staff shall produce at the time of admission,

(i) A declaration in a format as prescribed by the Govt.

(ii) A cer tificate from Head of school or college in support of the statement made in declar ation

duly endorsed by the Education Officer of the Area.

The candidate shall , on admission, also submit a n application in the prescrib ed form for being granted

the concession of free education, to the appropri ate authorities through the c ollege to whi ch they are

admitted within one month from the actual date of joining of college or as may be required. The students

shall note that applications received after the due date may not be considered and in that case, they will

have to pay the necessary fees.

The concessions in tuition fee at t he time of admission will be given only for Government,

University Managed and Government-Aided Institutions.

In case of Un -Aided colleges, such candidates will be required to pay the fees at the time of admissi on.

The fees paid by such candidates will be reimbursed by the respective colleges only after th e concession

(if any) is granted by the respective Authority.

8.6.3 Concession in fees for Backward Class Category Candidates (belonging to Maharashtra State only) in Unaided Private Institutes:

For SC/ST/VJ DT NT(A)/NT(B)/NT(C)/NT(D)/SBC /OBC category candidates

The schem e/mode of concessions, scheme o f loan scho larship (if any) for eli gible

SC/ST/VJ DT NT(A)/NT(B)/NT(C)/NT(D)/SBC /OBC category candidates, in tuiti on &

other fees in the Un-Aided Institutions will be announced by the State Government.

However, these candidates will get only that amoun t of waiver as notified in t he circulars issued by the

Social Justice and Tribal Welfare Departments from time to time, subj ect to f ulfillment of various norms

and conditions laid down by these Departments.

Note:-

Candidates claiming for the fee concession under reservation category shall produce the requisite

certificates as may be specified by the respective Social Justice and Tribal Welfare Departments.

Strict action will be taken by the State govt. against the institutes violating these norms. 8.7 Cancellation of Admission:

The c andidate sh ould h ave tak en admission by paying necessary tuition fee and sh ould h ave

submitted original certificates before he/she applies for cancellation. In case candidate fails to

submit any of the original docum ents within the allowed time limit, the admission

shall be treated as cancelled.

The candidate desirous of canceling ad mission shall apply for can cellation in the pro forma – O

only and should take the online receipt of the cancellation.

It is mand atory to th e P rincipal/Director of the In stitution t o cancel th e admission of the

candidate only through online system and issue the receipt of cancellation to the candidate. 8.8 Issue of College Leaving Certificate:

a) If during the course of studies, c andidate desires t o disc ontinue studi es for any rea son

whatsoever, he or she sh all be allowe d to do so and it shall be presumed that he or she has

cancelled admission at that stage. The Principal shall issue College Leaving Certificate and fees

shall be refunded as per the rules mentioned.

b) If the admission is cancelled on or befor e 20 days from the last date of reporting of each CAP

round, the original school or college leaving ce rtificate on the strength of which a c andidate

was admitted shall be returned.

c) If the admi ssion is cancelled after 20 days from the last date of r eporting after each round of

CAP, the leaving certificate from the instituti on where the can didate was finally admitted

should be i ssued. A tru e copy of th e or iginal school or college leaving certificate retain ed by

the institute may be i ssued, if requested by the c andidate, duly attested by t he Head of the

Institute.

8.9 Refund of Tuiti on, Development and Other fe es after cancellation o f admission secured th rough C AP roun ds-I/II/III, in Institute l evel roun d(s) and Ad ditional/Vacancy Roun d(s) of a dmissions in Gove rnment, Ai ded, University departments etc. and Unaided Institutes:

The candid ate who has been provisi onally admitte d may cancel admissi on by submitting an

application in duplicate, in the prescribed pro forma - O and may r equest for refund of fees. The

refund of fees as applic able shall be m ade in du e course. It i s made clear that such application

for cancell ation will be considered if and on ly if the admission is confirmed by paying the

prescribed tu ition fee and other f ees i n full and by submitting the original d ocuments. Refund

shall be made after deduction of the cancellation charges as shown below:

if the candid ate cancels the admission on thir d day after start of the a cademic session and the

seat is filled on/before th e cutoff d ate, then c ancellation amount will be, total fees/12 or Rs .

9.0 Actions to be take n in case of excess admissi ons and late uploading of

admitted candidates.

9.1 Excess admissions

Excess admissions over the sanctioned intake shall not be allowed under any circumstances.

In case any excess admission is reported/noted by the DTE, appropriate penal action will be

initiated against the Institution.

The Institution shall be liable to following punitive action from any one or more of the following

by the DTE.

surcharge amounting five times the total fees collected per student shall be levied

against each excess admission

seats equal to double the number of excess admissions shall be reduced from intake in

the subsequent academic year

Suspension of approval for supernumerary seats

No admission status in one/more courses

Withdrawal of approval for programme/course

Withdrawal of approval of the Institution

Institution shall be listed as defaulter and defaulter list shall be communicated to AICTE

and will be published on DTE website for the information of general public

9.2 Late uploading of Admitted candidates on DTE web site.

After the di splay of allotment list in each CAP Round, cand idates should report to the

“Respective Institutes” as per the notified schedule of the admi ssion process. (Refer

Annexure-I for procedure & rules of reporting of each Round of Centralized Admission)

Candidates shall report to the concerned institute with all original certificates needed to

substantiate the claims made in the application regarding eligibility and reservation.

After scru tiny of origin al documents at the concerned institute, the cand idate will have to pay

prescribed full fees immedi ately in the f orm as prescrib ed by t he concerned institute and

confirm the admission offered.

The Director/Principal of the respective Institute is required to carry out “Online Update” of

the confirmation/cancellation of the candidate’s admission on website through their Institute

login, at the time when the candidate is being admitted/cancelled at the Institute.

The system shall automatically generate letter of confirmation/cancellation of the admission

as an acknowledgement.

The in stitute is required to take a pri ntout of the acknowl edgement and then the status of

candidate will change to ‘Reported Candidate’.

If a candidate fails to substantiate the claims made at the time of submitting the application form

by submitting the necessary original documents and fails to pay the prescribed fees in full within

the repor ting time for C AP Round, the candidat e forfeits the claim on the allotted seat

immediately.

It is the resp onsibility of the Director/P rincipal of concerned institute to u pdate the status of the

reporting of the candidate. If the institute fails to update the status of repor ting in scheduled

time, then such unreported seat(s) will be filled in subsequent CAP rounds and the in stitute will

have to adjust these unreported candidate(s) against the institute level seats.

If the in stitute fail s to u pdate th e status of C ancellation of the candidate on th e date of

cancellation through “Online Update”, then strict action shall be taken ag ainst such institutes. I t

is mandatory to cancel th e admission through on line system only and issue t he printout of the

“Online Receipt of the Cancellation” to the candidate with due seal and signature of the authority

of the institute.

The CAP allotment list will be available to the in stitute through their Institute Login. The list can

be collected from Regional Offices also. The Institute should update the information of the

reported candidates, allotted under CAP “Online update” when a candidate is

reporting to the Institute.

Rounds of admission for Institute Level Seats and for t he seat s remaining vacant

after CAP should be carried out separately and it should be clearly displayed on the

Notice board of the institute

The Director/Principal of the institute has to also update the list of all admitted candidates on the

DTE website through their institute login clearly indicating the stage of their admission like CAP,

Against CAP vacancy, OMS, Institu te l evel/ Min ority seat s, J &K seat s, PIO, FN, FS, N RI etc.

within 5 days from the cut off date of the admission.

If the institute fails to update the reporting of the candidate through “ Online Update ”, t he

action shall be taken against the institute as per the GR dated 29.03.2008.

The Director/Principal of the institute is required to update the list of all admitted candidates of

10.0 Miscellaneous:

The medium of instruction for degree course in Pharmacy in all the Universities is

English.

No rounding of Marks will be done for deciding the eligibility of the candidate.

Admission of candidate who has be en admitted to any course at any college will be treated as

finally confirmed only on production of the Eligibility Certificate from the University to which the

college i s affiliated. Each of the candidate is advised to ensure b efore applying for

admission to the MHT-CET 2010 and the Pharma cy Course in a particular University

that he/she is eligib le for admission to the programme as per the relevant Eligibility

Rules of the University.

Physical fitness: Head of the inst itution at hi s or h er discretion may refer any candidate to the

appropriate medical au thority for ascertaining the physical fitness of the can didate to un dergo

the requirem ents of the course. The report of me dical auth ority shall be submitted to the

Regional Head of Technic al Educati on for furthe r necessary action. It is to be noted that

physically handicapped candidates ar e not provided with any additional facilities as far as the

academic activities pertaining to the course is concerned.

The Head of the college / institution shall have the right to satisfy himself about the conduct and

character of a candidate by verifying the antec edents of a c andidate through the appropri ate

police-authority, before admitting him / her to the college / institution.

If the Admission Authority or an institu tion a ffiliated to/recognized by/or which is auton omous

but is located in the area of jurisdiction of a Univer sity deliberately, willfully with an intenti on to

defraud, makes admissions in excess of sanction ed intake of the institute as specified in these

rules, except as provided for in these rules, the examination authority of the concerned university

shall not allow such candidates admitted in excess of the sanctioned intake capacity, to appear at

any of the r elevant examinations unl ess explicit ly permitted by the C ompetent Authority. The

Competent Authority may consider to grant such an approval as it may deem fit for the exc ess

admissions done.

Each of the candidates seeking admission to MHT-CET 2010 is required to give the undertaking in

profarma-I at the time of admission at the Institute.

Students belonging to Muslim/ Christian/ Buddhist/ Sikh/Parsi community can apply

for the ‘ Merit-cum- Means Based Scholarship Scheme’ of Government of India. The

11.0 Hostel accommod ation in Go vernment/Government aided and

University Departments etc. and in Unaided Institutes:

Accommodation in Hostel cannot be guaranteed to all the admitted candidates. Hostel fees payable etc.

should be ascertained by the students from the Prin cipal of the college to w hich they intend to tak e

admission. The candidates (both boy s and girls) are advised to verify personally whether the hostel

accommodation is available or not, by contacting Principals of colleges where they are intending to seek

admission. The Principal of the c olleges shall c onsider sympath etically on priority the applications of

physically handicapped candidates, sons and daughters of GoI nominees for Hostel accommodation.

12.0 Conduct and Discipline

Failure of the candidate in making full and correct Statements in the application form and/or

suppression of any information and/or submission of false documents shall lead to

disqualification of the candidate for MHT-CET 2010 or even at later date during the Admission

Process. Such a candidate will be debarred from the examination as well as the entire selection

process. Th erefore th e c andidate is required to make only such claim s which could be

substantiated by relevant original documents.

Adopting an y unfair means or engaging in ma lpractice in th e examin ation shall rend er a

candidate liable for punishment under, “Maharashtra Prevention of Malpractices Act, Universities,

Board and O ther Specified Examin ation Act, 1982” and disquali fy him/her for MHT-CET-2010

examination.

If any person(s) or officer(s) dealing with th e conduct of the MHT-CET-2010 are found engaged

in act(s) that would resul t in the leak age of question paper or at tempt to use or help in the use

of unfair means in this e xamination h e/she sha ll be liable to prosecution under Indian P enal

Code.

Any issu e not dealt her e-in above will be dealt wi th, when ari sing, fully an d finally by the

Competent Authority.

Notwithstanding anything contained i n these Rul es, if the G ovt. takes any policy decision

pertaining to First Year Pharmacy Degree admission, then the same shall be brought in to effect

at that point of time as per the directives from the Govt. from time to time.

Students while studying in any college, if found indulging in anti-national activities contrary to the

provisions of Acts and Laws enforced by Govern ment or in any activity contrary to rules of

discipline, will be liable to be expelled from the college without any notice by the Principal of the

college.

Condition of minimum attendance : The Students will not b e allowed to appear for the

examination if he/she do not attend minimum 75 per cent classes of theory, practical,

drawings, etc.

Action against ragging : Maharashtra Prohibitio n of Ragging Act 199 9 and its amendments which may be publis hed from time to time. The Act is in effect from 15th May, 1999 has the following provisions for Action against Ragging

a) Ragging within or outside of any educational institution is prohibited, b) Whosoever directly or indirectly commits, participat es in, abets, or propagates ragging within

or outside any educational institution shall, on conviction, be punished with imp risonment for a term up to 2 years and / or penalty, which may extend to ten thousand rupees.

c) Any student convicted of an offence of ragging shall be dismissed from the education al institution and such student shall n ot be admitted i n any oth er educational institution for a period of five years from the date of order of such dismissal.

d) Whenever any student or , as the ca se may be, the parent or guardian or a teacher of an educational i nstitution complaints, in writing, of ragging to the head of the educational institution, th e head of th e education al instit ution shall, withou t prejudice to the foregoing provisions, within seven days of the receipt of t he complaint, enquire int o the matte r mentioned in the compl aint and if, pri ma facie, it is found tru e, suspend the student who is accused of the offence, and shall, im mediately for ward the c omplaint to th e police stati on having jurisdi ction over the area in wh ich the educ ational institu tion is situated, for fur ther action. Where, on enquiry by the head of the educ ational institution, it i s found that there is no sub stance, prima faci e, in the c omplaint re ceived, he / she shall intim ate the fact, in writing, to th e complainant. The decision of the head of the educational institution shall be final.

e) If the Head of the educational institution fail s or neglects to act in the m anner specified in section “d” above when a complaint of ragging is made, such person shall be deemed to have abetted the offence and shall, on conviction, be punished as provided for in section “b” above.

Any Acts or its amendments which may b e pu blished fr om time to time or Judgments by

Hon. Courts of India will b e applicab le to Candidates and Institute s covered under these

rules of admission. All the institutes are hereb y instructed to strictly follow the recent

guidelines of AICTE in order to prevent ragging.

If any of the statement made in application form or any information supplied or any certificate(s)

submitted by the candidate in connection with his or her admission is later on at any time, found

to be false or incorrect, his or her admission will be cancelled, fees forfeited and he or she may

be expelled f rom the college by the Principal/Dire ctor. An appeal against the order of expulsion,

however, may be sent within 7 days to the Director of Technical Education, Maharashtra State,

Mumbai, wh ose deci sion i n such c ases will be final. Such candid ates ar e al so liable for penal

action as per the provisions in the law.

Legal jurisdiction:

All disputes pertaining to the conduct of examin ation and admi ssion shall fall within the jurisdiction of

Mumbai High Court, bench at Mumbai only. The Comp etent Authority shall be the legal person in whose

name the Government of Maharashtra may sue or may be sued . If any person(s) or offic er(s) dealing

with the c onduct of the MHT-CET-2010 found eng aged in act(s) that would result in th e leakag e of

question paper or attempt to use or help in the use of unfair means in this examination h e/she shall be

liable to prosecution under Indian Penal Code.

13.0 Transfer after one year for Institute

The candidate once admitted in first year or dire ctly to second year sh all not be eligible for

transfer to any other institution during the same academic year in which admission is taken.

Candidates who have taken admissi on under supernumerary seats are n ot eligible for transfer

during entire duration of the course.

There shall be no tran sfer of studen ts at any stage/any year from Un-Ai ded college to

Government or Aided c ollege in any case in accordance with the policy l aid down in G .R. of

Education and Employment Department No. TEM/ 3382/ 111836/ (190)/TE-1A, dated 21st May

1983. However, the can didate from Government institution m ay seek transfer to Un-Aided

institution.

The eligibility for tran sfer after first year - candid ates who have passed first year or both fir st

and second semester examination s in full or fa iled in one of the heads of passing from any

institution are eligible to get a transfer provided vacancies exist within the sanctioned intake.

The Principal shall be responsible for ascertaining the eligibility laid down by the concern ed

University for the cour se to which the candidate is being transferred. Vacancy position should

be displayed on the notice board of the Institute and is also to be informed to the office of the

Joint Director, Technical Education of that region. However the c andidate should have passed

in full or faile d in one of the heads of passing if seeking transfer within Univer sity and should

have fully passed for inter University Transfer.

The Regional Head of Technical Education shall accord approval to the eligible candidates who

apply in writing for tran sfer to the in stitutes within his jurisdicti on, along wit h no objec tion

certificate from the parent colleges, eligibility certificate from the concerned affiliating body and

no objecti on certificate showing vacancy position within the sanc tioned i ntake from the

Principal of the colleges in which transfer is sought by the candidates.

All transfers in Government, Aided and Un-Aided institutes shall be subject to the final approval

by the Director of Technical Education, Maharashtra State. All institutes shall submit the list of

the candidates who were allowed chang e of institute with the prior approval of Region al Head

of Technical Education.

In case of Government and Aided degree colleges: In case of transfer of candidates

aspiring for a change of college from Govt. and Aided colleges under the control of Directorate

of Tech nical Education, th e candidate passing the first year examinati on or both first and

second semester examin ations in full or faile d in one of the heads of pa ssing from a ny

Government or Aided coll ege shall apply in writing to the Principal of the college in

which he/she studied first year or second semester, who will then forward the

consolidated merit list of eligible candidates showing therein year/semester , full name of

candidate beginning with surname, total marks secured in first year or total of first and second

semester marks, out of, percentage up to two digits, division, names of Government or Aided

colleges and in order of preference t o which candi dates desire to seek tran sfer, reasons f or

transfer and remarks , al ong with vaca ncy positio n in his/her in stitution, to the Director of

Technical Ed ucation, Maharashtra State, so as to r each him at least sev en d ays bef ore the

commencement of the programme of effecting direct admission to second year. No application

without recommendation of the Princip al of colleg e shall be entertained by the Directorate. If

the result of the University is not declared befo re the process of transfer, candidates of th at

University wil l lose claim on tr ansfer. However th e candidate should hav e p assed in full or

failed in one of the head s of passing if seeking transfer within University and should have

fully passed for inter University Transfer.

14.0 Transfer after Second or Third year:

Inter University Transfers at third & fourth year levels are permitted subject to the production

of eligibility certificate fr om the resp ective Un iversity in which the candidate seek s transf er.

Such transfers are permitted subject to the provision of transfers in the concerned universities

by the office of Directorate of Technical Education, Mumbai.

Annexure I

Procedure for Centralized A dmission Process (CAP) for the acad emic year 2010-11: The procedure for CAP consists of following major stages:

1. Filling up of Online Application Form for CAP on website www.dte.org.in/ph2010

2. Confirmation of Online Application F orm for CAP & Documen t Verificati on at ARC by the

candidate in person for participation in the Centralized Admission Process.

3. Display of provisional Merit List on website www.dte.org.in /ph2010, indi cating State l evel

rank, Home University Rank, Category Rank, OMS Rank etc.

4. Filling up of Online Option Form on website www.dte.org.in/ph2010, for each of the CAP rounds

I/II by eligible candidates.

5. Confirmation of Online Option Form for each of the CAP rounds I/II by the eligible candidate in person at ARC only

6. Display of Provisional A llotment indicating allotment after each of the CAP rounds I/II on the

website www.dte.org.in/ph2010 and at the ARC

7. Reporting t o the instit ute as per allotment of the CAP ro unds I/II and confirmati on of

admission by the candidate

8. Conduction of CAP rou nd-III, i.e. admission round by coun seling at G overnment College of

Pharmacy, Aurangabad. NOTE:

OMS candidates who have appeared & passed MHT-CET 2010 are eligible to p articipate in

the CAP rou nds for O MS seats on th e basi s of score of MHT-CET 2010. Such OMS

candidates ar e permitted to fill Online Application F orm & Online Option Forms of CAP

rounds.

OMS candidate are also eligible to apply separately for the seats coming under the purview

of the Institute Authorities (Institute Level se ats/against CAP vacancies) to be filled by the

respective unaided institute at the institute level. For details read the information brochure

carefully.

The Centralized Allotment Process has following stages:

Stage I – Availability of the Information brochure:-

Information brochure along with in stitute information will be av ailable free of cost at al l the ARCs mentioned in Annexure- III for the aspiring Maharashtr a State (MS) candidates. MS candidates are required to carry their origin al score card of MHT-C ET 20 10 and receipt of submission of application form for issue of the Information brochure from the ARC.

All the information printed in the brochure and specimen application form will also be available on the website www.dte.org.in/ph2010 for browsing, downloading and printing.

Stage II – Online filling of CAP Application Form b y Maharashtra State candidates (on the basis of MHT-CET 2010 score) and OMS candidates (on the basis of MHT-CET 2010 score):

The aspiring candidate should read the brochure carefully.

Aspiring cand idates are r equired to submit their online applicati on forms through the web site

www.dte.org.in/ph2010 within the scheduled time.

Candidates will be able to fill in the Onli ne Application form through any computer connected to

Internet either from home/ cyber café or at any of the ARCs.

Candidates are required to enter his/her details as per the online Application Form.

The online software application hosted on the we b site will validate the inf ormation filled in by

the candidate and assign h is/her unique Application ID. Using thi s Application ID, candidate will

be able to login to the online admission system to update his/her information, check status of

processing of his/her application form, check position in the merit list, fill in online option form(s),

print Online Option Form, check the seat allotted in CAP rounds I/II and status of reporting etc.

The c andidate sh ould tak e the print out of hi s/her completed online applic ation f orm. I t will

display the li st of the documents required by th e candidate to substantiate the claims m ade in

the application form. The candidates must note the Application ID and Password on the sample

application form/on b ackside of m ark list, which will be required at the time of confirmation at

the ARC and also f or future reference to the inform ation filled in by the candidate on th e web

site.

The candidate can update the data himself/herself before confirmation of the application form

at any ARC through his/her login. Once the application is confirmed at ARC, the information can

not be changed/edited. Stage III – Confirmation of CAP Application Form IMPORTANT:

1. This is a MANDATORY step for all eligible Maharashtra State candidates and OMS candidates.

2. Online submi tted Applications will be considered v alid for fur ther processin g only after the

confirmation of the submission of Online Application Form at ARC.

3. If the candid ate d oes not confirm th e online filled applicati on form, then such online fi lled

application will be rejected and name of such candidate will not appear in the merit list(s)

prepared for the purpose of admission. Such candidates, wh ose name s do not appear i n the

merit list(s) will not be able to participate in entire Centralized admission process.

4. No documents in support of the claims made in the Application will be accepted at ARC after the

confirmation. Hence all candidates are instructed to keep necessary documents ready, before the

confirmation.

5. All such candidates who fail to sub stantiate cl aims made ( such as r eservation ca tegory, PH,

Defence etc.) with supp orting necessar y docume nts shall be converted to GENERAL category

and/or such application s will be rejected as the case m ay be. Once su ch candidates are

converted to GENERAL category and they will have to fulfill the m inimum eligibility criteria as set

out for a GENERAL candidate.

For MHT-CET 2010 qualified Maharashtra State and OMS Candidate

All the MS candidates who have filled the Online CA P Application Form should report to any ARC

in person along with printout of online filled application form, attested copies of the required

documents. The candidate should also carry the required original document s for

verification.

The ARC officer shall verify the information and required original documents and collect the du ly

signed application along with attested copies of the required documents.

The ARC officer shall c onfirm candidate’ s application through web and issue him/her the

Acknowledge-cum-Receipt letter, whic h will have the particulars of the candidate’s profile,

important instructions etc.

Note:-

DO NO T send printout of online ap plication for m by post/ courier to the ARC for

confirmation. Such applications will be summa rily rejected and n o communication will be

done.

Stage- IV: Display of provisional MS Merit list, OMS Merit list

Provisional Merit List of eligible Maharashtra candidates, OMS can didates will be displayed on

www.dte.org.in/ph2010 and at the ARCs as per the schedule.

For discrepancy in the provisional merit list, if any, get the corrections by lodging the grievance

at ARCs, where the candidate has confi rmed the application withi n the period specified in th e

schedule. No additional document to substant iate the claim made in app lication shall be

accepted.

Final merit li sts will be displayed on the www .dte.org.in/ph2010 and at A RCs as per th e

Schedule. NOTE:

The merit list gives relative position of the candidate and it d oes not guarantee admission

to any course.

General Instructions for filling online option form for CAP Round(s)

The candidate has t o login to the website www.dte.org.in/ph2010 through hi s/her application

ID and Password.

The candidate eligible for CAP Round I/II should fill the Online Option Form.

Every institute has b een allotted a 5-digit choice c ode, which i s given in the “ Annexure IV” of

the Information Brochure.

The Candid ate should select the choice codes with an order of prefere nce i.e. first,

second etc.

For exampl e, for CAP Round-I a candidate can fill mini mum 1 and maximum 20

options and so on.

Once the options are confirmed at ARC, no change in the options / preferences is allowed.

The status of Allotment wi ll be avail able on th e website only and no separate allotment letter

will be issued to the candidate. Stage-V: Filling of Online Option Form & Confirmation at ARC for CAP Round I:

Eligible Candidates:

The candidates who have submitted and confirme d online Appli cation form and whose names hav e

appeared in the Maharashtra Merit List and OMS Merit List of CAP round-I published by the Directorate of

Technical Education.

For Maharashtra State and OMS Candidates:

The eligible candidate should fill the Online Option Form of CAP Round-I

The Candidate should select the choice codes with a n order of p reference i.e.

first,second etc. Candidate is permitted to fil l minimum 1 and maximum 20 options

for CAP round-I.

The Candidate should go to the ARC in person for confirmation of Online Option Form along

with the Acknowledgement-cum-Receipt of the Online Application Form.

Candidate is required to p ay processing fees of CAP Round-I, Rs.100/- in ca sh at the ARC

and obtain a receipt for the same.

The ARC officer shall confirm the Option form and give the Receipt of the Option Form for CAP

Round I to the candidate indicating the preference wise options given by the candidate.

Stage-VI: Display of Provisional Al lotment of CAP Round I, Reporting to the institute and

confirmation of the admission

The provisional allotment through CAP Round I shall be display ed on www.dte.org.in/ph201 0,

at ARCs and also at the allotted institutes.

No separate allotment letter will be issued to candidates.

The candidate will report at the in stitute where the seat is all otted along with the necessary

documents as per the notified schedule and by paying the fees as prescribed by the respective

institute on the DTE web site www.dte.org.in/ph2010.

Candidates are required to submit the Acknowledgement-cum-receipt of the online Application

form to the Admission authority of the institute for the confirmation of the admission.

The respecti ve institute will update the confir mation of the candidate’s ad mission on DTE

website through their institute login within the schedule notified.

The re spective Institute will carry out “Online Update ” of the con firmation of the

candidate’s admission on DTE web site through their Institute login immediately when the

candidate is b eing admitted at the Institute. The system shall automatically generate an

acknowledgement. The in stitute sh all take a prin tout of the r eceipt and the n the statu s of

candidate will change to ‘ Reported Candidate’ . The Institu te will be able to view the daily

summary of the reported candidates along with fee and document details.

If the candidate fails to report to and confirm the admission at the Institute, on or before the

last date of reporting at the Institute then the candidate shall forfeit the claim on t he allotted

seat.

It is not permitted for a candidate to cancel his/her admission of CAP round I and apply/appear

for the subsequent round(s) of CAP.

Rules of Reporting of CAP Round I:

1. All candidates who have secured an allotment ou t of First Nine options will not be eligible for

participating in subsequ ent round(s) irrespec tive of whether the candidate confirm s the

admission or not. Hence such candid ates are adv ised to confirm the a dmission at the

respective Institute as per the allotm ent in the CAP Round-I. Such candidates will be disqualified

for participation in further Rounds of CAP.

2. Candidates (other than those covered in above stated rule no. 1)

who have secured an allotment which is not out of first Nine options i.e. it is between 10 to

20

and

who are satisfied with the allotment of CAP Round-I

and

who are no more interested in participating in subsequent round(s) of Centralized Admission

have to confi rm the admission by reporting at th e respective institute. Such candidates will not

be eligible to participate in subsequent round(s) of Centralized Admission. Such candidates will be

disqualified for further Rounds of CAP.

3. All such seats, on which th e candidates have confirmed the admission on or before the l ast date

of reporting of CAP Round-I, shall not be ava ilable for allotmen t in subsequent round(s) of

Centralized Admission.

4. The Merit lists for CAP Round II will be prepared from Merit lists of CAP Round I by excluding the

names of the candidates who have got allotment at option 1 through 9 in CAP Round I and also

excluding the names of the candidates mentioned in rule 2 above. Stage-VII: Filling up of online opt ion form & Confirmation of Online filled Option Form for CAP Round II

Eligible Candidates for CAP Round-II:

The candidates whose names have ap peared in the Ma harashtra Merit List an d OMS Merit List of CAP

round-I published by the Directorate of Technical Education excluding the candidates who have:

Secured an allotment in CAP Round-I, which was out of First Nine options

Secured an allotment in CAP Round -I which was between options 10 -20 and confirmed

admission by reporting to the respective institute

Secured an admission against allotment of CAP Round-I and cancelled admission subsequently.

For Maharashtra State and OMS Candidates

The Candidate should fill fresh online O ption form as per the schedule through their login on

the website, failing which the candidate shall not be considered eligible for the allotment.

CAP round-II.

Candidate is required to pay processing fees of CAP Round-II, Rs.100/- in c ash at the AR C

and obtain a receipt for the same.

The ARC officer shall confirm the Option form and give the confirmation report to the candidate

indicating the preference wise options given by the candidate.

Stage-VIII: Display of Provisional Allotment of CAP Round II, Reporting to the institute and

confirmation of the admission

The provisional allotment through CAP Round II shall be displayed on www.dte.org.in/ph2010,

at ARCs and also at the allotted institutes.

The candidate will report at the in stitute where the seat is all otted along with the necessary

documents as per the notified schedule and fees as prescribed by the r espective insti tute on

the DTE web site www.dte.org.in/ph2010.

Candidates are required to submit the Ac knowledgement-cum-Receipt of the online Application

Form to the Admission authority of the institute for the confirmation of the admission.

The respecti ve institute will update the confir mation of the candidate’s ad mission on DTE

website through their institute login as per the schedule notified.

The re spective Institute will carry out “Online Update” of the con firmation of the

candidate’s admission on DTE web site through their Institute login immediately when the

candidate is b eing admitted at the Institute. The system shall automatically generate an

acknowledgement. The in stitute sh all take a prin tout of the r eceipt and the n the statu s of

candidate will change to ‘Reported Candidate’ . The Institu te will be able to view the daily

summary of the reported candidates along with fee and document details.

If the candidate fails to report to and confirm the admission at the Institute, on or before the

last date of reporting at the Institute then the candidate shall forfeit claim on the allotted seat.

It is n ot permitted for a c andidate to ca ncel his/her admi ssion of CA P round II and

apply/appear for the subsequent round of centralized admission.

Rules of Reporting of CAP Round II:

1. All candidates who have secured an allotment to any o ne submitted options will not b e

eligible for participating in subsequ ent round(s) irrespective of whether the candidate confirms

the admission or not. He nce such can didates are advised to confirm the admission at the

respective In stitute as p er the allotment in the CAP Round-II. Such candidates will be

disqualified for the counselling Round of CAP.

2. All such seats, on which the candidates have confirmed the admissi on on or before the last

date of repor ting of CAP Round-II, shall not be available for allotment in subsequent round (s)

of Centralized Admission.

3. The Merit lists for CAP Round III will be prepared from Merit lists of CAP Round II by excluding

the names of the candidates who have got allotment in CAP Round II.

Stage-IX: CAP Round III- Counseling round of Admission

Eligible Candidates for CAP Round-III:

The candidates whose names have appeared in the Maharashtra Merit List of CAP round-II published by

the Directorate of Technical Education excluding the candidates who have:

Secured an allotment in CAP Round-II

AVAILABLE SEATS:

All MS & OMS se ats unde r purview of Compet ent Authority except the seats for which the

candidates have reported in Round-I, Round II.

All vacant seats of OMS quota will be merged to MS seat quota.

All vacant seats in resp ective categ ories such as Backw ard, PH, HU, O HU etc. will be

considered as State Level General seats.

There shall not be admission for OMS candidates in CAP Round III.

RULES OF REPORTING FOR CAP ROUND-III:

1. Eligible candidates must r eport in-person at the v enue of “Cen ter of Admiss ion” in order to

secure admission in this round of admission strictly as per the notified schedule. Candidate who

reports late will not be allowed to participate in this round.

2. Candidate i s required to p ay pr ocessing fees of CAP Round-III, Rs.100/- in cash at t he

Center of Admission and obtain a receipt for the same.

3. The candidate will report as per sched ule at the following Center of Admis sion along with

the necessary original documents and carry part payment of non-refundable fees of Rs.15000/-

4. Eligible Candidates who report to the A dmission Center will be offered admission to av ailable

seat as per the inter se merit of candidates.

5. Candidates who secure ad mission in th is round mu st confirm the admission on the sp ot b y

paying non-refundable fees of Rs.15000/- (in cash or DD) and producing necessary d ocuments

in original for verification.

6. The Center of Admission will update the c onfirmation of the candidate’s ad mission on DTE

website through the login immediately.

7. Candidate will have to rep ort later on to the re spective Institute f or paying bal ance fees (i .e.

Total fees as notified by the Shikshan Shulka Samiti less Rs. 15,000/- paid by the candidate at

Respective Institute) as per notified schedule. If the candidate fails to report to the Institute

and pay the balance fees on or before the last date of reporti ng at the Institute then the

candidate shall lose claim on the allotted seat as well on the Rs. 15000/- paid by the candidate

Guidelines for the Admission Process to be carried out by Unaided Colleges 1.0 Admissions to CAP allotees for the institute

Admission authority in the institute shall follow the procedure mentioned under rule 7.3 for Reporting of candidates.

4.0 General Notes:

The CAP allotment list will be available to the institute through their Institute Login. The list can be collected from Region al Offices al so. The Institute should update the i nformation of the reported candidates, allotted under CAP “Online update” when a candidate is reporting to the Institute.

Rounds of admission for Institute Level Seat s and for the seats remaining vacant after CAP should b e carried out separately and it s hould be clearly displayed on the Notice board of the institute

The Principal/Director of th e institute has to al so update the list of all admitted candidate s on the DTE website through their institute logi n clearly in dicating the stage of their admission like CAP, Against CAP vacancy, OMS, Institute level/ Minority seats, J&K seats, PIO, FN, FS, NRI etc. within 5 days from the cut off date of the admission. If the institute fails to update the reporting of the candidate through “Online Update ”, the action shall be taken against the institute as per the GR dated 29.03.2008 and its amendments which may be published from time to time.

Three copies of list are to be printed and to be submitted to the concerned Regional Off ice of Technical Ed ucation, duly signed by the Director /Principal / Head of the In stitute within 7 days from the cut off date.

The regi onal office of the Joint Dir ector of Technical Educ ation shall v erify the supporting documents and forward the list of admitted candidate to the Director, Technical Education along with the remarks of Joint Director for final approval.

The DTE and/or Prav esh Niyantran S amiti, Mumbai shall accord the final approval t o the list of admitted candidates. It is binding on all the Unive rsities to grant enrollment only to the students who are on approved list.

Important Note: All the institutes ar e required to complete th eir admission process on or before the

Magistrate/Dy.Collector of the concerned Taluka/District wherein the candidate ordinarily resides. In lieu

valid. The domicile certific ate of Mother of the c andidate should have been issued af ter her marriage,

such certificate issued before her marriage will not be valid. In case of mother’s domicile certificate, the

candidate shall submit an affidavit on Rs.100/- stamp paper, stating that the person in whose n ame the

domicile certificate is issued is the mother of the candidate.

No documents ar e needed at the time of filling up of online form for MHT-CET 2010. However no

change in the information once filled is permitted at a later date. Candidates are required to keep the d ocuments ready at the tim e of filling up of “Applicati on Form

for Admission”.

Cut off date for the eligibility and/or submission of claim(s):

The eligibility and/or submission of cl aim(s) of the candidate shall be determin ed and/or decided for all

purposes including for applicability of all these Rul es and Regulations by con sidering the last date of

submission of “Application form for Admission to Pharmacy” as the cut off date.

It is mad e abundantly clear that if a c andidate is found ineligible and/or fail s to produc e documents in

support of cl aim(s) on the last d ate o f submissi on of Application Form for Admission to Pharmacy, in

terms of these Rules and Regulations, and if such an ineligible candidate acquires the requisite eligibility

and/or produces documents after the aforesaid cut off date, such subsequent acquisition of eligibility will

not mak e an ineligible candidate eligi ble for an y purpose whatsoever, muc hless for the purpose of

admission. concerned educational institution, or as the case may be, discharged from the said employment forthwith and any other benefits enjoyed or deriv ed by virtue of such admission or appointment by such person as aforesaid shall be withdrawn forthwith. (2) Any amount paid to such person b y the Gov ernment or any other agency by way of scholarship, grant, allowance or other financial benefit sh all be recover ed fr om such per son as an ar rears of l and revenue. (3) Notwithstanding anything contained in any Act f or the time b eing in force, any Degree, Diploma or any other ed ucational qualification acquired by such person after securing admission in an y educational institution on the basis of a Caste Certificate which is subsequently proved to be false shall also stand cancelled, on cancellation of such Caste Certificate, by the Scrutiny Committee. (4) Notwith standing anyth ing contain ed in any law for the time being in force, a person shall b e disqualified for being a member of any statutory body if he has contested the election for local authority, Co-operative Society or any statutory body on the se at reserved for any of Scheduled Castes, Schedul ed Tribes, De-notified Tribes, (Vimukt jatis), Nomadic Tri bes, Other Backward Classes or Special Backward Category by procuring a f alse Caste Certificate as belonging to such Caste, Tr ibe or Class on such false Caste Certificate being c ancelled by th e Scrutiny C ommittee; and any benefi ts obtained by such person shall be recoverable as arrears of land revenue and the election of such person shall be deemed to have been terminated retrospectively. Para 12: (Offences under Act to be cognizable & non-bailable) Notwithstanding anything contained in the Code of Criminal Procedure; 1973 -- (a) offence punishable under section 11 shall be cognizable and non-bailable; (b) every offence punishable under this Act, shall be tried by any Magi strate of First Class in a summery way and provisions of sections 262except sub-section(2) to 265 both inclusive of this Code shall as for as possible may be applied to such trial. (2) No court shall take cognizance of an offence pu nishable under this section except with the previous sanction of the Government. Para 14: (Penalty for abatement) Whoever abets any offence punishable under this Act shall be punished with the punishment provided for in this Act for such offence.
