In a preliminary post-election statement on June 9, 1999, the international observation delegation of the National Democratic Institute for International Affairs (NDI) and The Carter Center stated that a judgment about the entire election process must await the completion of all its steps and committed that NDI and The Carter Center would continue to monitor the process and issue subsequent reports. Accordingly, a post-election mission organized by NDI and The Carter Center issued a statement assessing the early stages of the tabulation and counting of votes on June 20. This report updates the findings of that mission on the tabulation of election results and other issues associated with the electoral process.

The findings of this report are based on meetings in Jakarta with members of the national electoral bodies including the KPU (Komisi Pemilihan Umum or National Election Commission) and the PPI (Panitia Pemilihan Indonesia or Indonesian Election Committee, which is responsible for the election preparations), members of the Election Oversight Committee (Panwas), political party leaders, representatives of the Indonesian media, and domestic monitoring organizations, held most recently and intensively from July 5 to July 12, 1999. the KPU not fulfill this important role, public confidence in the entire electoral process could be diminished.

In light of these concerns, the mission believes that it is important to assemble evidence that will assist a dispassionate and informed judgment on the outstanding issues. These issues should be dealt with and resolved in an open and transparent manner as soon as possible, and the institutions thus elected should move without delay to begin to tackle the practical problems facing Indonesia. Tabulation and Announcement of Election Results

The most important of these issues is the rapid completion of the tabulation and announcement of election results. The mission recognizes that a balance must be struck between the need for rapid tabulations and the time necessary to produce credible results. The credibility and acceptability of the results must take precedence over their absolute perfection. Unfortunately, the delays of the past several weeks do not appear always to have been motivated by a desire to increase the transparency and legitimacy of the process. Rather, much of the delay appears to result from dissatisfaction with the will of the Indonesian people as expressed through the ballot box on June 7. It is inappropriate for the assessment and approval of the results to be viewed as a bargaining chip by some smaller parties over their future role in the political process.

Fortunately, despite these problems, the delays do not appear to have been caused by nor have they created the opportunity for significant manipulation of the election results. As with the June 7 polling, there are undoubtedly some examples of localized manipulation of the counting and tabulation. Nonetheless, there are now several independent sources of data available as a basis for comparison with the official results currently being tabulated by the PPI. These sources draw on tabulations from various levels within the election administration, including from the TPS (polling station), PPS (village), PPK (subdistrict) and PPD I (province). The data from these sources are provided in detail in the tables in Technical Appendices 1 and 2. The mission would like to express its gratitude to Antara, the Rectors’ Forum and KIPP for providing some of this data.

Since these data originate in various levels of the election administration, any significant attempt to manipulate the tabulation as it has progressed up the hierarchy over the past five weeks should be apparent in these tables. Significantly, the results of these various unofficial tabulations do not provide any evidence to support allegations of widespread or significant fraud or tampering designed to benefit any particular party or parties. Nor has any such evidence been shown to the mission. If such evidence exists, it is clearly the responsibility of those who hold it to put it into the public domain immediately.

Suggestions have also been made to the mission that the official results tabulated by the PPI include numbers from “ghost” polling stations, which never existed in reality but which have been added to the tabulation. As the mission indicated in its first pre-election statement, the election administration unfortunately acted in a way that reduced transparency about the total number of

polling stations, and caused considerable confusion. However, the mission at this time does not have nor has it received evidence to support the view that an organized introduction of “ghost” stations took place. Detailed information regarding this issue is contained in Technical Appendix 3.

The mission has, in addition, observed the tabulation by the PPI of the vote from the 108 overseas polling stations. Despite occasional confusion, this has been handled effectively. The mission also notes that the overseas results tabulated by the PPI appear to match closely the results obtained from every station by election observers from the Fair Elections Committee for Indonesians Overseas (FECINO), the election monitoring organization organized by the Association of Indonesian Students for Strategic and International Studies (AISSIS) that has focused on the overseas balloting. More detailed information on these results is included in Technical Appendix 4.

Nonetheless, there are issues that should not pass without investigation. First, in the Moluccas the total number of valid and invalid votes adds up to 109 percent of registered voters. This discrepancy requires explanation, and indeed the PPI has moved quickly to order the provincial electoral body (PPD I) to provide one. The mission has learned that on polling day instant registration was allowed in the Moluccas. This factor in and of itself may be enough to explain the discrepancy, but as of the release of this statement, the PPI had not yet received a full explanation. If in fact evidence is found for the existence of “ghost” polling stations, the stuffing of ballot boxes, or other forms of election fraud, then the KPU and Panwas must act quickly and effectively to address these problems, through the prosecution of the perpetrators and through possible repolling.

Second, in several provinces the PPI has discovered discrepancies in the verification section of its tabulation form, in which the total number of valid, invalid, spoiled and unused ballot papers is greater than the number of ballot papers received. These discrepancies have provided a further demonstration of the dangers associated with the numerous deficiencies in the control and security of ballot paper distribution previously identified by NDI. The PPI has correctly called for further explanations of these discrepancies, many of which may result from lack of training or lack of control of the emergency distributions of materials at the last minute. The KPU and the PPI should in the future establish procedures that ensure full control of ballot papers is maintained throughout the election administration. Election Violations - Political and Legal Responses

There are many reports of violations in the counting and tabulation process to add to those reported before and during polling. Domestic election monitoring organizations (EMOs) have prepared reports, and the Panwas at different levels have considered a substantial number of cases. In addition, the KPU has set up its own violation investigation committee, the Team of 11. The results of its deliberations are not yet public, and the timetable for its report is not yet available. It is therefore not yet clear how much more hard evidence will be added to the existing EMO and Panwas

documentation by the work of the Team of 11.

As NDI and The Carter Center indicated in earlier statements, a decision to repoll is a serious matter that can either increase or decrease confidence in election authorities, depending on the circumstances. Thus, a decision to repoll should be based on hard evidence of serious and extensive violations that affected the outcome of the elections. Unfortunately, the processing of complaints thus far has illustrated one of the serious weaknesses in the election legislation previously identified by NDI: the lack of precise definition of the powers of the Panwas and of the interrelationships among the various bodies with jurisdiction over election complaints. Specifically, the Supreme Court decree on the Panwas system is ambiguous regarding both the jurisdiction of various levels of the system and the legal authority of its decisions. In addition, Article 76 of the election law lacks clarity regarding the locus of responsibility and the procedures for making a decision about repolling, and provides an opening for local government officials to influence the process.

These issues have been particularly apparent in North Sulawesi, the only province in which repolling on any large scale was seriously considered. Although deeply divided on the issue, the PPD I there recently decided against repolling. This decision came in part because of the heavy-handed role played by the local government, which appears to have extended the deliberation process long enough that it eventually became impossible to conduct repolling within the legally mandated timeframe of 30 days after polling day. The North Sulawesi case is also a vivid illustration of some of the problems inherent in the current system of election administration and oversight, such as a lack of coordination and communication among election authorities and a lack of independent sources of sufficient funding for them.

Recounting has already occurred in many locations as the results have been processed. In light of the available data, the mission believes that further recounting can now only be justified where clear evidence that the existing count is inaccurate is placed in the public domain.

Indonesian authorities should vigorously investigate alleged violations and, where appropriate, prosecute those responsible. The priority now should be to ensure that serious violations for which sufficient documented evidence exists be brought before the appropriate court as soon as possible. While evidence of minor campaign violations may be the proper subject of police discretion, major violations – for example, attempted vote buying, prepunching of ballots, or tampering with election tabulations – are, if proven, serious criminal acts and should be prosecuted vigorously and in accordance with due process standards. Such acts are criminal whether or not they can be shown to have had any effect on the conduct or the results of the election. It would be very dangerous if precedents were established that enable people or parties to believe that the law can be violated with impunity during future elections.

The responsibility for prosecuting these cases rests at all levels. It would be particularly important for the Supreme Court to set an example by hearing expeditiously and openly the cases

referred to and investigated by the national Panwas relating to abuse of Social Safety Net funds. It would be very damaging to public confidence in the transition process if the delays in hearing cases that are allegedly commonplace in the Indonesian judicial system are allowed to occur in election-related cases as well. Financial Accountability

Widespread concern remains regarding “money politics” during the election period in some areas, and some doubts have also been expressed about financial aspects of the activities both of some parties and of the KPU itself. The mission repeats its earlier view that the KPU should insist on the post-election audit of political party accounts required under the election law, and that appropriate penalties should be imposed on parties that refuse to cooperate. The mission also believes – especially following the publication of allegations of corruption in the KPU’s activities – that an early published audit of KPU spending, using the same standards as are used for the party audits, would be an important demonstration of openness and is necessary to restore public confidence. Subsequent Phases of the Electoral Process

Following the final acceptance of the election results, central party organizations will have the responsibility of choosing the candidates who will fill the 120 or so People’s Representative Assembly (DPR) seats won under “largest remainder” provisions. It will be a challenge for party organizations in the next few weeks to establish and explain internal rules for the allocation of candidates to largest remainder seats in a way that does not turn inevitable disappointment into active dissension. Further, as previously indicated by NDI, the complexity of Indonesia’s electoral system means that this process will not always appear logical. For example, it appears that PDI-P has won about 79 percent of the vote overall in Bali, and an overwhelming majority of the vote in all nine districts in the province. By proportional representation, the party will qualify for seven of the nine seats, with two other parties gaining one seat each. Thus, PDI-P leaders will be faced with two candidates who have “won” “first-past-the-post” district victories but will not be seated in the DPR.

The next stage of the electoral process is the election of provincial and functional representatives (constituencies based on professional, occupational, religious and ethnic identification) to the People’s Consultative Assembly (MPR), the 700-member body that will choose Indonesia’s next president. Provincial representatives are to be selected following the rules of each newly elected provincial assembly (DPRD I). An appropriate election system needs to be chosen for this purpose; these MPR members should probably be drawn from across the political spectrum within the province rather than chosen entirely by a locally dominant party or parties. In addition, a timetable for the DPRD I elections needs to be drawn up, and it might be desirable for all DPRD I’s to conduct their elections on the same day, in order to prevent a “snowball effect” in the overall makeup of the provincial representation on the MPR.

The KPU has now appointed a team of 15 members to consider the choice of functional groups to send representatives to the MPR. This will be a difficult and politically charged task. It will not be made easier by the view expressed in some quarters that those parties that failed to do well in the June 7 elections are “underrepresented” – an interpretation that does not fit with democratic concepts.

Finally, the mission notes and supports the decision of the KPU that it is not possible to hold acceptable elections in two districts of Aceh at this time. The huge task for the new government of trust- and confidence-building remains every bit as urgent as before, including the need for thorough investigation of human rights abuses over the last 10 years and the creation of security conditions under which refugees will freely choose to return home safely. It will not be acceptable if these issues are now allowed to be forgotten.

NDI and The Carter Center will continue to monitor developments of all aspects of the election process and will issue subsequent reports. Recommendations � The KPU should assess the final results tabulated by the PPI as soon as they are ready in light

of all evidence now available. The KPU should not allow this assessment to be affected by political bargaining.

� Major violations of the criminal law and criminal offenses under the election law should be

referred by the KPU and Panwas to the judicial system and prosecuted, and cases should be heard by the courts as soon as possible.

� The KPU should arrange the post-election audit of political party accounts required under the

election law, and press for appropriate penalties to be imposed on parties that refuse to cooperate.

� The KPU should commission and publish an audit of its own spending using the same

standards as are used for the party audits. � In addition to other matters raised in the previous statements of the mission, the post-election

review of the law and regulations should clarify the procedures for mediating and resolving election disputes, the procedures for timely judicial hearing of any charges relating to alleged criminal offenses, and which body has final authority to order repolling.

Technical Appendix 1: Comparison of Tabulation Data These tables compare the following data: 1. The results tabulated by the PPI from July 6 to July 15 for all 27 provinces; 2. The results obtained by the correspondents of the Antara news agency directly from the PPD I tabulation in each province; 3. The final results (June 24) from the Joint Operations Media Centre (JOMC), compiled from data submitted directly from PPKs on Form DA5; 4. The final totals (July 10) of the results received by the KPU through its “Bank” system and tabulated on its website, originating from the PPS level on Form D4. These data are considerably more complete in Java and Bali than elsewhere, and is included only where the data received has reached 50 percent of the registered electorate; 5. The data collected by the Rectors' Forum Parallel Vote Tabulation (PVT) from sampling at the TPS level in Riau, the only province for which PVT data for all 48 parties is available; and 6. The tabulation from the PPS level assembled by KIPP in Jakarta.

For all of these sources, Total Votes columns are in boldface type when the data shown is 100 percent of returns.

The tables may be used to judge whether the same tabulation exists at all levels of the count. Consistent manipulation designed to favor a particular party or parties would show up in differences between the columns. No evidence of such manipulation appears to exist in these figures.

Technical Appendix 2: 15 parties chosen for Rectors’ Forum Parallel Vote Tabulation: Comparison of shares of 15 party vote: JOMC, PPI, PVT

This table is included to enable comparison of the data collected by the Rectors’ Forum PVT with the results tabulated by the JOMC and by the PPI. The PVT collected data from a random sample of approximately 300 polling stations in each province. The volume of data collected enabled the production of statistically significant projections in 23 of 27 provinces (all except Aceh, East Kalimantan, East Timor and Irian Jaya). These projections are accurate to plus or minus 1.5 percent at a 95 percent confidence level.

The PVT central analysis operation only collected data for 15 selected parties. It is accordingly not possible to make direct comparisons with the data in Technical Appendix 1. In this table, the total vote for the 15 selected parties is treated as 100 percent for each of the three sets of data and theh individual party votes scaled accordingly. The actual 15 party share of the vote in the PPI results is shown at the foot of the column.

Again, the table may be used to judge whether the same tabulation exists at all levels of the count. Consistent manipulation designed to favor a particular party or parties would show up in differences between the columns. No evidence of such manipulation appears to exist in these figures.

Technical Appendix 3: Analysis of Polling Stations

The KPU announced its intention that there should be 250,000 polling stations on May 4 and issued a list of numbers; this list omitted several districts entirely and was widely ignored. The KPU Secretariat continued to organize distribution and logistics on a figure of 321,142 polling stations based on planning of October 1998, and the figure of 320,000 was subsequently adopted by the KPU. The actual number of polling stations was determined in practice at a lower level of the election administration depending among other things on the number of registered voters and the available budget. Figures for each province were obtained from PPD I’s on or just before polling day. The KPU issued the first national polling station information that drew on real data on June 14. The final total of polling stations is shown on the PPI result tabulations.

Any attempt to introduce “ghost” polling stations would be likely to appear in significant increases in the final total of stations from previous numbers. Comparison of the third and fifth columns is probably the most important measure; the differences do not appear to be substantial and are in any event mostly decreases. The confusion generated by the earlier lack of transparency of the KPU Secretariat in the planning and organization of polling stations, which has led to the circulation of the differing numbers shown, caused problems in the distribution of polling materials and clearly contributed to allegations that “ghost” stations were introduced. Technical Appendix 4: Overseas Voting - Totals

This Appendix compares the overall totals of overseas votes recorded by the PPI for each party, and the corresponding totals from the records made by the Fair Elections Committee for Indonesians Overseas (FECINO) at overseas polling stations. The differences do not appear to be significant. ******
