PROCEDURE FOR GRANT OF RECOGNITION CERTIFICATE TO GROUNDNUT PROCESSING UNITS FOR EXPORT OF GROUNDNUTS FOR HUMAN CONSUMPTION

To develop the export of peanuts from India to the EU countries for human consumption and for ensuring an appropriate standard in its exports, it has been decided to adopt the procedure outlined in this document for grant of processing unit recognition certificate. One of the objectives of this procedure is to encourage exporters of peanuts to come up to the international level of export standards. Expected benefits of this scheme include infrastructure development, encouragement to backward linkages, export of good quality produce, promotion of international recognition and publicity, encouraging adoption of internationally acceptable standards and practices, upgradation of standards for product quality and food safety, and creation of a healthy, competitive environment among exporters. 01 PROCEDURE FOR

APPLICATION FOR RECOGNITION

1.1 Applications for recognition of groundnut

processing unit for export of groundnuts for human consumption will be made to APEDA in Form-I.

1.2 The application should be accompanied with the groundnut processing unit infrastructure data in Form-II.

1.3 The application may be submitted either at APEDA, New Delhi or at any of its regional offices, which will forward the same to New Delhi.

1.4 The application should be accompanied by a fee of Rs. 10,000/- by way of demand draft in favour of APEDA.

1.5 Following other documents should be submitted along with the application:

a) Names and addresses of owners /

partners / directors / trustees etc. along with documentary evidence.

b) Copy of permission/licence from the local body to run the processing unit.

c) Copy of the lease agreement in case the

processing unit is being run on lease basis (if applicable).

d) Lay out of the premises. e) List of machinery and equipment

including transport vehicles. f) Copy of quality and maintenance manuals

and procedures, if any. g) Health record of workers. h) Record of training provided to workers

1.6 The application should be signed by the owner / partner / director / managing

trustee duly authorized for the purpose and a documentary evidence/power of attorney/copy of the resolution must accompany the application.

1.7 Applications for grant of recognition certification for groundnut processing unit may be made to APEDA on a voluntary basis.

PROCESSING UNIT RECOGNITION CERTIFICATE

2.1 Preliminary scrutiny of the application with

the help of checklists will be carried out by APEDA. In case the application is in order, APEDA will organize inspection of the unit by a recognition committee constituted by APEDA for this purpose.

2.2 The evaluation of the application and physical inspection will be carried out on first-come- first-served basis.

2.3 APEDA shall inform the processing unit/exporter one week in advance of the date of inspection so that by such time the unit should be ready with requisite records, as required for verification by the processing unit recognition committee.

2.4 The Recognition Committee shall furnish the inspection report with its recommendations to APEDA as per format given in Form-III within one week of the physical inspection.

2.5 Implementation of Good Agricultural Practices and product recall procedures by the suppliers and farmers is an added advantage.

3.1 In case the Recognition Committee is satisfied that the processing unit conforms to the requirements of the scheme, it will recommend to APEDA to issue the Recognition Certificate. The same shall be issued by APEDA in Form-IV. The certificate will bear a unique number allotted by APEDA.

3.2 The Groundnut Processing Unit Recognition Certificate may be prominently displayed in the unit.

3.3 Any change in the layout, design, capacity, documentation, title, etc., of the unit shall be got approved by APEDA within 60 days of such change.

3.4 The date of validity of the Recognition Certificate shall be specified on the certificate. In case, no specific date is mentioned, the certificate shall be deemed to be valid up to 31st December of the year succeeding the year in which it is issued.

3.5 The unit shall be re-inspected by the unit Recognition Committee for the purpose of renewal of the certificate. The re-inspection

shall be carried out before expiry of validity of the certificate.

In case, processing is carried out in a leased unit, the certificate shall be issued to the manufacturer / exporter who is the lessee and not to the owner of the unit. In case, lease agreement expires before the expiry of the recognition certificate, then validity of the certificate will be limited to the date of expiry of lease agreement. In case of extension of lease agreement, the certificate shall be renewed for such period as appropriate. Notwithstanding the fact that the certificate once issued shall continue to be in force till the date specified in the certificate, APEDA may institute surprise checks through its officers in order to ensure that the unit has maintained the standard required for issue of the recognition of certificate.

The processing unit shall also comply with such other instructions as may, from time to time, be issued by APEDA.

Issue of certificate may be refused or, if issued, may be cancelled or suspended: a) If the unit does not conform to the prescribed standards. b) If there are adverse reports from the financial institution/banks against any of the owners / directors/partners/trustees. c) In case of un-satisfactory arrangements for disposal of rejected, rotten, waste. d) In the absence of a valid licence from the local bodies.

In the overall interest of exports, from India, APEDA reserves the right, at any stage, to withdraw / cancel / suspend recognition given to a unit.

Refusal of application for certificate or its cancellation/suspension, as the case may be, shall be communicated to the applicant.

Appeal against refusal/cancellation or certificates may be submitted to Chairman, APEDA within 30 days of the receipt of such refusal / suspension / cancellation.

In case of cancellation of certificates, the original certificate of unit recognition shall accompany the appeal.

5.3 Chairman, APEDA will consider the application on merits and, if considered

necessary, order re-inspection of the unit during which time the anomalies pointed out by the Committee should be rectified.

5.4 If approved, a fresh certificate shall be issued on payment of a fee of Rs. 10,000. The

intervening period between the cancellation of the certificate and issue of fresh certificate shall be deemed to imply that the unit is not recognized during this period.

06 ISSUE OF DUPLICATE RECOGNITION CERTIFICATE IN CASE OF LOSS OR MULTILATION

In case of loss or mutilation of any certificate, a duplicate certificate may be issued on payment of Rs.2,000/-. The validity of the duplicate certificate shall be the same as that of the original.

CHECKLIST FOR CRITERIA GOVERNING GROUNDNUT PROCESSING UNIT RECOGNITION

Recognition of the groundnut processing unit owned by exporters / traders / co- operatives / State Government departments, etc. should be based on the following criteria : 1. Evaluation of the level of backward integration

Extent and stability of backward linkage / integration in the respective region where groundnut processing unit is proposed for recognition. The evaluation should be based on the relationship between the processor and the exporter.

2. Evaluation of level of pre and post harvest integrated training programmes attended by their farmers and the extent to which they have practiced the guidelines. 3. Evaluation of level of cleanliness of operation in the processing unit. 4. Evaluation of level of hygienic conditions of the work place (including toilets) and of the workers including maintenance of health records. 5. Evaluation of level of infrastructure facilities at the processing unit with respect to processing unit documentation maintenance. 6. Evaluation of facilities such as collection, selling, sorting grading, drying, fumigating, etc.

7. Evaluation of facilities such as intermediate packaging stations, wherever necessary.

8. Evaluation of facilities such as unloading of raw material, weigh- ment, docking platforms, palletization, etc. 9. Evaluation of arrangements for annual maintenance contracts for processing equipments.
