Subsequently 27-BC Residential Schools were allotted to MJPAPBCWREI Society on 02-07-2014 i.e., after reorganisation of AP State. In the ref. 5 th cited Govt. Of A.P. approved the service rules of MJPAPBCWREI Society and the same are communicated herewith to all the Principals of APR Schools and MJPAPBCWR Schools in the state along with option form. The Principals of APR Schools and MJPAPBCWR Schools in the state are instructed to communicate the Service Rules of MJPAPBCWREI Society to the employees working on regular basis in MJPAPBCWR School under the management of MJPAPBCWREI Society and APR Schools. Further, the Principals of APRE Institutions and MJPAPBCWRE Institutions are instructed to obtain the willingness/option of staff working in APRE Institutions and MJPAPBCWRE Institutions including Principals of APRS & MJPAPBCWRS in the prescribed format in quadruplicate (one copy with Principal concerned, one copy with individual duly acknowledged by the principal and two copies to APREIS office) duly observing the following guidelines:- EXERCISING OF OPTION:- 1. Regular Principals / PGTs / TGTs / PDs / PETs / ART Craft Music/SUPW/Librarians/Staff Nurses working in APR Schools and MJPAPBCWR Schools. 2. All Non-Teaching Staff working in APRDC/APRJCs/APR Schools/MJPAPBCWR Schools and O/o Secretary, APREI Society, Guntur. 3. CRTs/Guest faculty/Adhoc Teachers, Lecturers of APRDC and Jr.Lecturers of APRJCs need not exercise their option. 4. Employees those who are getting retired as on 30-09-2018 need not exercise their option. They are permitted to retire in parent society. 6. If required No. Of employees have not opted then staff will be allotted from

the junior most employees in the category. 7. In case any employee has not exercised their option decision will be taken

by the committee for allotting them to any society. 8. Regarding PGT/TGT Sanskrit those who have acquired post graduation in

Telugu and opted for MJPAPBCWREIS they will be allotted as per option exercised. For other Sanskrit teachers those who have not qualified to teach Telugu and willing to teach Telugu in MJPAPBCWREIS they will be allotted to that society on the acceptance of MJPAPBCWREI Society.

9. Employees on Long medical leave/any other long leave and working on deputation have to send their option through proper channel.

Further, the Principals of APRE Institutions and MJPAPBCWRE Institutions are hereby informed to consolidate the options in the enclosed proforma (in excel sheet only) and the same may sent through [email protected], and one hard copy along with option forms. The individual option forms of all the employees along with one copy of the abstract form of options exercised by the employee should be submitted to the district convener APREI School by 04-08-2018.

In this connection the Principals of APREIS & MJPAPBCWREIS are hereby instructed to serve the Service Rules of MJPAPBCWREIS in Go.Rt.No.68 BC Welfare (B) Dept; Dt.10-05-2018 (attached) to the staff duly obtaining acknowledgement.

The District conveners are informed to collect the option forms from the APR Schools/MJPAPBCWR schools in the district and send the same through special messenger to the Secretary, APREI Society, Guntur on 06-08-2018 without fail.

-.- O R D E R :-

In the reference 1st read above, Government have issued orders for the transfer of 45 BC Residential Schools from the administrative control of School Education Department to the Backward Classes Welfare Department with effect from the Academic year 2012-13. It was also ordered that a new Society shall be registered under the Andhra Pradesh Societies Registration Act, 2001 in the name and style of “Phule Rao AP BC Residential Educational Institutions Society” to manage the 45 BC Residential Schools transferred from the AP Residential Educational Institution Society with effect from the Academic Year 2012-13 and also the Secretary, AP Residential Educational Institution Society, Hyderabad was directed to hand over all the 45 BC Residential Schools to the Director, BC Welfare immediately along with the posts sanctioned by the Government from time to time.

2. In the reference 2nd read above, in partial modification of the above orders, Govt have issued orders that a new Society in the name and style of “”Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society” shall be registered with headquarters at Hyderabad under the Andhra Pradesh Societies Registration Act, 2001. It was also directed that the composition of the Board of Governors of the Society and also the Memorandum and the Articles of Association of the new Society has been communicated with a direction to the Director, Backward Classes Welfare, Hyderabad to take necessary action accordingly ..

3. In the reference 3rd read above, Government have issued instructions that as (P.T.O.)

“The staff working in 45 BC Residential Schools against the regular posts sanctioned by the Government, who are the regular employees of the Andhra Pradesh Residential Educational Institutions Society, shall be treated as on deputation to the Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society till the Service Rules of Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society are finalised by the Government.”

4. As per sub-rule (vii) of Rule 2 of the Rules and Regulations of the Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society (MJPAPBCWREI Society), the Society determining the conditions of the service of the Secretary, other Officers and employees of the Society with the prior approval of the State Government. 5. In accordance with the above orders, the Secretary, Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society , Hyderabad has submitted Service Rules of the employees of Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society Society after resolved by the Board of Governors of Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society. 6. In the reference 13 read above, the Secretary, Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society Society, Vijayawada has submitted Revised Service Regulations of Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society, Vijayawada for approval. 7. Government after careful examination of the entire matter, hereby approve the Service Regulations for Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society, Vijayawada Annexed to this order.

8.. The Secretary, Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society, Andhra Pradesh, Vijayawada shall take necessary action accordingly.

SERVICE REGULATIONS

In exercise of the powers conferred by the sub-rule(vii) of rule 2 of the Rules and Regulations of the Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society issued vide G.O.Ms.No.7, B.C. Welfare (B2) Department, Dated: 11.4.2012 and as per the Bye-laws registered by the Society, the Board of Governors of the said Society hereby make the following Service Regulations for determining the conditions of service of the Secretary, other officers and employees of the Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society Service.

1.Title

These Regulations may be called as the “Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Educational Institutions Society Service Regulations, 2018.”

These service regulations are deemed to have come into force on and from Eleventh April, 2012 i.e. the date on which Government have approved the formation of the Society.

2. CONSTITUTION:

The Society service shall consist of the following Classes and Categories of employees: -

3) METHOD OF APPOINTMENT

Appointment to the several Classes and Categories of the service shall be made as follows: -

II 1 Principal Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential Junior College

50% by promotion from Category 2 of Class II (Principals of MJPAPBCWR Schools) 50% by promotion from Category 3 of Class II (J.L. of MJPAPBCWR Colleges)

In a cycle of 10 points, point Nos.1,3,5,7 & 9shall be meant for promotion from the Category 2 of Class II and point Nos. 2,4,6,8 & 10 shall be meant for promotion in each category from Category-3 of Class-II within the unit of appointment.

2 Principal of Mahatma Jyothiba Phule Andhra Pradesh Backward Classes Welfare Residential School

30% by Direct Recruitment and 70% by promotion from Category 1 of Class-III. (PGTs).

In a cycle of 10 points, Point Nos. 1,3&7 shall be allotted Direct Recruitment and Point No. 2,4,5,6,8,9 & 10 shall be meant for promotion in each category from Category 1 of Class III.

3 Junior Lecturer

50% of the posts are reserved for Direct Recruitment and the remaining 50% of posts reserved for promotion from the Category of 1 of Class-III in each subject.

In a cycle of 10 points, Point Nos.1,3,5,7 & 9shall be meant for Direct Recruitment and Point Nos. 2,4,6,8 & 10 shall be meant for promotion in each category from category 1 of class III.

Junior Lecturer in Commerce: 100% Direct Recruitment, since no feeder Category is available.

Junior Lecturer in Economics: 50% of the posts are reserved for Direct Recruitment and the remaining 50% of posts for promotion.

Junior Lecturer in Civics: 50% of the posts reserved for Direct Recruitment and the remaining 50% of posts for promotion.

Junior Lecturer in Mathematics : 50% of the posts reserved for Direct Recruitment and the remaining 50% of posts for promotion.

Junior Lecturer in Physics : 50% of the posts reserved for Direct Recruitment and the remaining 50% of posts for promotion.

Junior Lecturer in Chemistry : 50% of the posts reserved for Direct Recruitment and the remaining 50% of posts for promotion.

Junior Lecturer in Botany : 50% of the posts reserved for Direct Recruitment and the remaining 50% of posts for promotion.

III 1 Post Graduate Teacher (PGT)

Direct Recruitment & Promotion from Category-3 of Class-III Trained Graduate Teachers (TGTs) in each subject. 50% of the posts will be allotted for Direct Recruitment & 50% for promotion except Hindi.

Post Graduate Teacher in English: 50% Direct Recruitment and 50% on promotion from TGT English

Post Graduate Teacher in Telugu: 50% Direct Recruitment and 50% on promotion from TGT Telugu.

Post Graduate Teacher in Hindi: 100% Direct Recruitment

Post Graduate Teacher in Mathematics: 50% Direct Recruitment and 50% on promotion from TGT Mathematics

Post Graduate Teacher in Physical Science: 50% Direct Recruitment and 50% on promotion from TGT Science

Post Graduate Teacher in Bio-Science: 50% Direct Recruitment and 50% on promotion from TGT Science

Post Graduate Teacher in Social Studies: 50% Direct Recruitment and 50% on promotion from TGT Social Studies

In a cycle of 10 points, point No. 2,4,6,8, & 10shall be allotted for direct recruitment and point No. 1, 3, 5, 7 & 9 shall be meant for promotion in each category of PGT within the unit of appointment.

Note: Cycle:- 1-Promotion, 2-DR, 3-Promotion , 4-DR, 5-Promotion, 6-DR, 7-Promotion , 8- DR 9-Promotion & 10-DR.

7) SPECIAL REPRESENTATION: -

The Rule of Reservation of appointment (Rule 22 of General Rules in part 2 of Andhra Pradesh State and Sub-ordinate services Rule) shall apply to appointment to the services by direct recruitment as well by promotion and by transfer. Rule 22A of the A.P. State & Subordinate Service Rules, 1996 as amended from time to time shall be applied for direct recruitment.

8) APPOINTMENT IN THE INSTITUTIONS MEANT FOR GIRLS:

Women alone shall be appointed to the posts in any institution specially provided for them. At the time of recruitment the vacancies of teaching staff in the institutions meant for Girls shall be exclusively earmarked for women. However, for the purpose of transfer, if no suitable women candidate is available, male teaching staff above the age of 50 can be posted to the girls institutions.

9) AGE: -

The maximum and minimum age stipulations and maximum age concession as indicated in Rule-12 of A.P. State & Subordinate Service Rules, 1996 and as amended from time to time shall be followed.

10) QUALIFICATIONS: -

No person shall be eligible for appointment to the service in the Classes, Categories and posts specified in the column 3 of the Annexure to these Regulations by the method specified in the corresponding entries in column 4 thereof unless he/she possesses the qualifications specified in the corresponding entries in column 5 thereof.

11) Unless otherwise specified elsewhere in these rules, no person shall be eligible for appointment by transfer or promotion unless he/she is an approved probationer and has put in not less than (3) three years of service in the category from which such promotion or appointment by transfer is made.

12) PROBATION:

Every person appointed by direct recruitment to a Category in this service shall, from the date on which he joins duty be on probation for a total period of a 2 years on duty within a continuous period of 3 years, and for a total period of 1 year on duty within a continuous period of 2 years, if appointed by promotion or by transfer.

13) TRANSFERS & POSTINGS:

Every employee in Category II, III and IV is liable to be transferred within the unit of appointment by the appointing authority, as per the rules and conditions for transfer issued by Government from time to time.

14) Application of Government Rules:

Notwithstanding anything contained in these regulations , the Government shall have a general power of superintendence and control over the administration of the Society. Exercise of such power and control shall extend to giving general instructions and directions to carry out the policies of the Government, both Financial and Administrative and such instructions and directions are binding on the Society.”

Where any particular regulation is found deficient and insufficient or

unless otherwise specified elsewhere in these regulations, to meet the requirements and demands of any situation in the interpretation and application of these Regulations, the Andhra Pradesh State and Subordinate Service Rules 1996, The Andhra Pradesh Ministerial Service Rules 1998, the Andhra Pradesh General Subordinate Service Rules, the Andhra Pradesh Last Grade Service Rules 1992 the Andhra Pradesh Civil Services (Conduct) Rules, 1964, the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and the Andhra Pradesh Fundamental Rules and Andhra Pradesh Revised Pension Rules 1980 and other Government orders issued from time to time shall be applicable to all the categories of these Regulations. The age of superannuation of all the above categories shall be on par with the respective Government employees.

The Secretary, who is having overall administrative control over the

Society, may issue such instructions which are not inconsistent with the provisions of these rules as the Secretary may consider necessary to give effect to and carry out the purpose of the provisions of these Regulations or otherwise to secure effective control over employees to whom these Regulations apply and may also authorise any of his subordinates to do so, subject to such conditions and limitation, if any, as may be specified by him in his behalf.
