Andersen Tate & Carr, P.C. submits this Letter of Intent on behalf of QuikTrip Corporation (the "Applicant") for the purpose of requesting the rezoning of an approximate 2.27 acre-tract (the "Property") located at Buford Highway and Brandsmart Way in Buford, Georgia. The tax parcel for the Property is R7146 027.
The Applicant is the current owner and operator of an existing QuikTrip convenience store and gas station on the Property. The Applicant is requesting to rezone the Property as there are currently two different zoning classifications on the Property: C-2 and RA200. The Applicant acquired additional land to the south of Laurel Drive several years ago and the purpose of this rezoning application is to have contiguous zoning for the site. The Applicant has previously submitted documentation with the County and the DOT regarding a request for the road abandonment of Laurel Drive. The Applicant is seeking to rezone the entire Property to the C-2 (General Business District) zoning classification of the Gwinnett County Unified Development Ordinance (the "UDO") to redevelop the Property and continue operations as a convenience store and gas station serving the community. A copy of the site plan is enclosed herein for your convenience.
The rezoning of this Property will allow for the redevelopment and construction of a new, high-quality QuikTrip location. The proposed QuikTrip store and redevelopment will consist of a single building totaling approximately 4,993 square feet (the current store is 4,255 square feet). The proposal calls for a total of nine gas pumps located under a single canopy. The redevelopment of this site also provides for a QT Kitchen, cafe and additional amenities to serve patrons and customers in the area.
QuikTrip has successfully operated as a convenience store in numerous locations thro .I e e nty, providing a safe and valuable service to the citizens of Gwinnett County and they look forward to continuing that same level of service at this location. The proposed

location is centrally located at the fully signalized intersection of Brandsmart Way and Buford Drive, and is surrounded by more intense commercial uses along Buford Drive. The site has access to both Brandsmart Way and a relocation of an existing right in/right out access directly to Buford Drive. The requested rezoning will provide ample parking and circulation, in compliance with Gwinnett County transportation requirements. The Property has access to a public water supply, public sanitary sewer, and convenient direct access to collector streets, major thoroughfares and state and interstate highways.
The Applicant is requesting several variances to be included as part of the conditions of the rezoning, which are also reflected on the enclosed site plan. Those variances include a wall sign greater than 60 square feet in area and maximum wall signage on a building. Specifically, the Applicant is requesting an allowance of a total of 161 square feet of wall signage (one sign at 121 square feet; and two signs at 20 square feet). Renderings of the proposed wall signs are included herein and referenced on the site plan. The Applicant is also requesting a monument sign to be placed within 5-feet of the Right-of-Way (approximately a one-foot setback). The proposed monument sign is approximately 61. 7 square feet and 8-feet tall. With regard to the canopy signage, the Applicant is requesting 14 square feet of sign area on both the North and South ends of the canopy, and 30 square feet of signage on the east side of the canopy with the letters not individually formed. Renderings of both the monument sign and the canopy sign are included herein and referenced on the site plan.
Pursuant to Section 220-30.E of the UDO, the redevelopment of the Property will require the Applicant to provide no more than 20 percent of parking areas in the front of the building and limit to no more than one double row of parking. The Applicant is requesting the parking location be modified as a condition of the zoning to allow for parking as reflected on the submitted site plan. The redevelopment of the Property provides for a total of 50 parking stalls along the front and sides of the Property. In addition, the Applicant is seeking a modification to the Architectural Design Standards as set forth in Appendix Section 1.0, 4.3.2A, regarding the Illuminated Bands on the canopy and building. Specifically, the Applicant requests that the standard QuikTrip red striping around the fuel canopy, building, and awnings be included as a condition of the zoning. This request is consistent with all QuikTrip stores constructed in Gwinnett County within the last ten years. Renderings of the illuminated Band are included herein and referenced on the site plan. The existing store on the Property currently has Illuminated Bands. This is not a feature that would be disruptive to the surrounding property owners. Finally, pursuant to Section 240-70.1 of the UDO, the Applicant is requesting the drive isles to be a maximum of 45-feet and the drive isles around fuel pumps to be 45-feet. As reflected on the site plan, the increased drive isle width will allow better circulation and connectivity within the development.
The proposed redevelopment of the Property is compatible with the policies set forth in the Gwinnett County 2040 Unified Plan (the "2040 Plan"). According to the 2040 Plan Future Development Map, the Property is located in the Regional Activity Center Character Area and the Mall of Georgia community. Theme 2 of the 2040 Plan provides that Regional Activity Centers are designations to institute a variety of redevelopment incentives and bonuses, including corner neig , -se ing stores to allow for convenience shopping and services in medium and high density residential areas. Moreover, the 2040 Plan provides that the Regional

Activity Center character area is intended for areas that have intense commercial and office/employment activity, as well as some residential elements. The redevelopment of the Property is in keeping with the intent of the 2040 Plan as well as the other improvements and development in the area, such as The Exchange at Gwinnett. With the increase of development in immediate area and around the Mall of Georgia, the Property is uniquely situated to be at the center of the County's focal points for commercial and economic activity. Accordingly, the proposed redevelopment of the Property would complement the area while also providing neighborhood serving uses.
QuikTrip is the standard that all convenience stores and gas stations should be striving to achieve. They have built a brand with an unparalleled reputation for clean, well-lit stores, staffed by friendly and helpful employees. The Applicant is committed to redeveloping a quality convenience store to continue to serve Gwinnett County residents and visitors.

This letter is written on behalf of QuikTrip Corporation (the "Applicant"), in connection with the rezoning application for property located at 2900 Buford Drive, Buford, Georgia (the "Subject Property").
Constitutional Objections
The portions of the Gwinnett County Unified Development Ordinance, as amended, (the "UDO") which classify or may classify the Subject Property which is the subject of the rezoning application into any more or less intensive zoning classification, development and/or conditions other than as requested by the Applicant are, and would be, unconstitutional in that they would destroy the Applicant's property rights without first paying fair, adequate and just compensation for such rights, in violation of Article I, Section I, Paragraph II of the Constitution of the State of Georgia of 1983, the Due Process Clause of the Fourteenth Amendment to the Constitution of the United States.
The application of the UDO, as applied to the Subject Property, which restricts its use to the present zoning classification, is unconstitutional, illegal, null and void, constituting a taking of the Applicant's property in violation of the Just Compensation Clause of the Fifth Amendment and the Due Process Clause of the Fourteenth Amendment to the Constitution of the United States, Article I, Section I, Paragraphs I and II of the Constitution of the State of Georgia of 1983, and the Equal Protection Clause of the Fourteenth Amendment to the Constitution of the United States denying the Applicant any economically viable use of the Subject Property while not substantially advancing legitimate state interests. Under Lathrop v. Deal, the application of the UDO in a way that constitutes a taking shall be deemed a waiver of sovereign immunity. 1

The Subject Property is presently suitable for development under the C-2 classification as requested by the Applicant and is not economically suitable for development under its present RA-200 zoning classification of Gwinnett County. A denial of the requested rezoning would constitute an arbitrary and capricious act by the Gwinnett County Board of Commissioners without any rational basis therefore, constituting an abuse of discretion in violation of Article I, Section I, Paragraphs I and II of the Constitution of the State of Georgia of 1983 and the Due Process Clause of the Fourteenth Amendment to the Constitution of the United States.
A refusal by the Gwinnett County Board of Commissioners to rezone the Subject Property to C-2 zoning classification, with only such additional conditions as agreed to by the Applicant, so as to permit the only feasible economic use of the Subject Property, would be unconstitutional and discriminate in an arbitrary, capricious and unreasonable manner between the Applicant and owners of similarly situated property in violation of Article I, Section I, Paragraph II of the Constitution of the State of Georgia of 1983 and the Equal Protection Clause of the Fourteenth Amendment to the Constitution.
Any rezoning of the Subject Property to the C-2 classification, subject to conditions which are different from the requested conditions by which the Applicant may amend its application, to the extent such different conditions would have the effect of further restricting the Applicant's utilization of the Subject Property, would also constitute an arbitrary, capricious and discriminatory act in zoning the Subject Property to an unconstitutional classification and would likewise violate each of the provisions of the State and Federal Constitutions as set forth hereinabove.
Accordingly, the Applicant respectfully requests that the rezoning application submitted by the Applicant relative to the Subject Property be granted and that the Subject Property be rezoned to the zoning classification as shown on the respective application.
