DEFINITION OF TERMS

1. rn this Provisional Certificate of Approval:

a. "Corporation" means the Corporation of the United Counties of Leeds and Grenville;

b. "Director" means the one or more persons who from time to time are so designated for the purpose of Section 30 of the Environmental Protection Act;

c. "Landfill" means Parts of Lots 14 and 15, Concession IV, Township of Edwardsburgh;

d. "MOE" means the Ministry of the Environment;

c. 11 Landfill II means Parts of Lots 14 and 15, Concession IV, Township of Edwardsburgh;

d. 11 MOE 11 means the Ministry of the Environment; PROVISIONAL CERTIFICATE OF APPROVAL

e. "ODW0 11 means the Ontario Drinking Water Objectives;

f. "0 & M Manual" means the Operations and Maintenance Manual;

g. "PWQO" means the Provincial Water Quality Objectives;

h. "Regional Director" means the Director, the MOE Eastern Region;

i. "RUP" means the MOE' s Reasonable Use Policy (Guideline B-7, formerly 15-08);

j. "LLC 11 means a Landfill Liaison Committee; and

k. "This Certificate 11 means this Provisional Certificate of Approval No. A 420009 as amended from time to time, including all Schedules

attached to and forming part of this Certificate.

GENERAL

2. No operation shall be carried out at the Landfill after 180 days from this condition becoming enforceable unless this Certificate has been registered by the Corporation as an instrument in the appropriate Land Registry Office against title to the Landfill and a duplicate registered copy provided to the Director.

3. Requirements specified in this Certificate are minimum requirements and do not abrogate the need to take all reasonable steps to avoid violating the provisions of other applicable legislation, regulations, approvals, orders, etc.

4. The requirements of this Certificate are severable. If any requirements of this Certificate for any circumstance is held invalid, the application of such requirement to other circumstance and the remainder of this Certificate shall not be affected thereby.

5. Despite any other term or condition in this Certificate, waste disposal shall be limited to:

a. the 14. 0 ha land£ illing area as shown on Drawing 3, Item 2 of 11 A 11 Schedule , and

b. the approved final contours as shown on the same Drawing.

6. The Corporation shall allow MOE personnel, or a MOE authorized representative(s), upon presentation of credentials, to:

a. carry out any and all inspections authorized by the Environmental Protection Act, the Ontario Water Resources Act or the Pesticides Act, as amended from time to time, of any place to which this Certificate relates, and

without restricting the generality of the foregoing, to:

b. i. enter upon the premises or the location where the records required by the conditions of this Certificate are kept;

ii. have access to and copy, at any reasonable time, any records required by the condition of this Certificate;

iii. inspect at reasonable times any facilities, equipment (including monitoring and control equipment), practices or operations required by the conditions of this Certificate; and

iv. sample and monitor, at reasonable times, for the purposes of assuring compliance with the conditions of this Certificate.

7. Schedules A, B, C, D, E, F and Gare integral parts of these conditions.

PUBLIC INVOLVEMENT/COMPLAINTS

8. The Corporation shall establish the public complaints procedure upon issuance of this Certificate that includes:

a. designating specific Corporation staff to receive any complaints and, as soon as possible, to respond in writing indicating the proposed action to be undertaken;

b. posting the Landfill complaints telephone number at the Landfill entrance and providing a written notice explaining the complaints procedures to surrounding landowners located within approximately orie kilometre of the Landfill;

c. keeping an accurate record of the following Landfill related complaints information:

i. date and time of day that the complaint was received;

d. providing copies of complaint records to the LLC and receiving any proposed recommendations of the LLC; and

e. summarizing all complaints concerning the Landfill and the Corporation's responses/actions in the Annual Report mentioned in Condition 47.

9. Within six (6) months of the issuance of this Certificate, a LLC shall be formed to give residents the opportunity to:

a. make recommendations to the design of monitoring programs;

b. review monitoring data and results; and

c. recommend new mitigation measures and improvements to existing practices for control of off-site impacts, in areas such as traffic management, landfilling practices, and contingency measures.

This terms of reference, membership, and meeting protocols are to be established by the LLC. An annual LLC's report will be prepared and copies of all Committee reports and minutes will be made available to the public.

LANDFILL OPERATIONS

General

10. The Landfill shall be developed, operated and maintained by the Corporation in accordance with all of the plans and specifications in the documents listed in Schedule "A". Should there be discrepancies between the documents listed in Schedule "A" and the conditions in this Certificate, the conditions shall take precedence. Should there be discrepancies between the documents listed in Schedule "A", the document bearing the most recent date shall take precedence.

11. The Corporation shall operate the Landfill in accordance with an o & M Manual. The Corporation shall prepare the O & M Manual for the Landfill to address details of site operational issues such as:

a. day-to-day operations and staff responsibilities;

b. surface water management;

c. leachate collection system clean-out and maintenance schedule;

d. equipment maintenance and inspection;

e. stockpile management and use of daily and intermediate cover material;

f. condition of applied cover and vegetation;

g. odour, dust and litter control measures;

h. bird and non-bird vector control measures;

i. waste management control and record keeping procedures to ensure that only approved waste enters the site; and

j. operating instructions for management of any waste suspected to be hazardous which enters the Landfill.

Site Security and Operating Hours

12. The waste disposal operating hours of the Landfill shall be between 8:00 a.m. to 5:00 p.m., Monday to Friday, and between 8:00 a.m. to 12:30 p.m. on Saturdays. Equipment operation hours extend one hour beyond these limits. The Landfill is closed on Sundays and statutory holidays.

13. The Corporation shall not allow waste to be received for disposal at the Landfill except during operating hours when the Landfill is under the supervision of the Landfill attendants.

14. During non-operating hours, the Landfill entrance gate will be locked by the Corporation to secure against access by unauthorized persons.

Site Entry Requirements

15. The Corporation shall not allow the following wastes to be disposed of at the Landfill:

a. hazardous wastes as defined under Regulation 347;

b. industrial liquid or slurry wastes;

c. hazardous biomedical wastes; and

d. barrels, drums or other similar containers which have been contaminated by hazardous substances.

16. The Corporation shall use the weigh scale to be installed near the public drop-off area to monitor and record all incoming wastes.

17. The Corporation shall ensure that all vehicles entering the Landfill shall be identified by licence number on the weigh, scale billing notice.

Waste Cover Requirements

18. The Corporation shall ensure that waste is deposited in a manner that minimizes the area of exposed waste at the Landfill working face and shall be compacted before cover material is applied.

19. The Corporation shall ensure that at the end of each working day, and within two hours of the entrance gate closure, cover material is applied to the exposed waste. The minimum depth of this material shall be 15 cm. Alternate cover materials shall be applied subject to the Regional Director's approval.

20. The Corporation shall provide at the site a contingency supply of cover material equal to two working days worth to ensure that adequate cover is always available for application pursuant to Condition 19.

21. The Corporation shall ensure that in areas where landfilling is not to be carried out for the period of 180 days or more, at least 30 cm of clean earth cover will be applied over the wastes. If necessary, these areas may be hydroseeded during the earliest spring or fall planting season to stabilize the surface against erosion.

22. The Corporation shall ensure that in areas where landfilling has been completed to the approved final contours, a minimum 1.2 m thickness of clean earth cover will be placed over the compacted wastes. The lower 1.05 m will consist of previously excavated soil, and the top 0.15 m will consist of locally derived topsoil. These areas shall be hydroseeded during the earliest spring or fall planting season to provide protection against erosion.

Base Contours

23. The Corporation shall ensure that the extent of excavation shall be limited to that necessary to construct the base contours shown on Drawing 6 of It~m 2, Schedule "A".

Waste Burning

24. The Corporation shall ensure that there is no burning of waste at the Landfill.

Bird and Non-Bird Vector Control

25. Bird and non-bird vector control shall be undertaken by the Corporation in accordance with procedures outlined in Item 2, Schedule "A".

Litter Control

26. The Corporation shall implement all necessary measures to prevent off­site litter impact from landfilling operations. These measures shall include but not be limited to the following:

a. the use and maintenance of suitable portable litter control fences, snow fencing and the perimeter fence around the Landfill;

b. weekly site litter inspections and clean-up;

c. weekly litter inspection and clean-up of roads and ditches in the vicinity of the Landfill;

d. weekly litter inspection and clean-up of the portion of the waste haul route from County Road 22 to the Landfill; and

e. litter pick-up on adjacent properties, if required (subject to owner's permission).

Dust Control

27. In order to keep mud and dust from the Landfill to a minimum, the Corporation shall implement a dust control program. This program shall include, but not be limited to the following measures:

a. during dry periods when there are visible dust emissions, regular wetting of soil cover material prior to its spreading by bulldozers over the working face;

b. during dry periods wetting of the unpaved and paved roads and the use of dust suppressants;

c. installation of speed bumps near the site entrance;

d. reducing on-site vehicle and heavy equipment speeds by posting a maximum speed limit of 30 km/h;

e. paving the Landfill access road and site entrance area;

f. construction of the on-site and perimeter gravel roads;

g. covering of dust laden waste material as soon as possible; and

h. minimizing wind erosion by stabilizing inactive areas using vegetation.

Noise Control

28. Prior to commencing any work within the landfilling area, the Corporation shall construct a 7.5 m high berm along the southern site boundary to mitigate noise impacts. Berm location is shown Drawing 3 of Item 2, Schedule "A".

29. Noise from or related to the operation of the Landfill shall be kept to a minimum and, in any event, the Corporation shall comply with the noise level limits outlined in the MOE's February 1997 "Noise Guidelines for Landfill Sites" as contained in Schedule "B".

30. In order to investigate and, if necessary, to mitigate any noise related complaints, the Corporation shall follow the general complaint procedures as outlined in Condition 8 of this Certificate.

Odour Control

31. Odour control shall be undertaken by the Corporation in accordance with procedures outlined in Item 2, Schedule "A".

32. In order to investigate and, if necessary, to mitigate any odour related complains, the Corporation shall follow the general complaint procedures as outlined in Condition 8 of this Certificate. If sufficient complaints were received, an appropriate air quality program shall be implemented by the Corporation to determine the effectiveness of odour and/or dust control measures and rectify the problem.

Site Inspection and Maintenance

33. The Corporation shall conduct weekly site inspections to ensure that all facilities and site works are maintained in a tidy condition and good working order. Such inspections will check for:

a. Conditions of roads (including signs, gates and fences):

i. surface condition (pavement or gravel);

ii. presence of litter;

iii. dust accumulation (on paved areas);

iv. sufficient moisture for dust control (on unpaved roads);

v. need for ploughing in winter; and

vi. traffic congestion and queuing.

b. Condition of drainage works (ditches, culverts, berm, ponds):

i. erosion;

ii. siltation; and

iii. clogging.

c. Condition of final cover:

i. erosion;

ii. settlement;

iii. ponding of run-off;

iv. development of cracks or fissures;

v. vegetation failure; and

vi. leachate seeps.

d. Condition of working area (including litter fences):

i. minimized working face size;

ii. presence of litter;

iii. sufficient daily cover applicat~on;

iv. efficiency of equipment;

v. sufficient moisture for dust control;

vi. development of cracks or fissures;

vii. presence of birds and vectors;

viii. condition of equipment (e.g., functioning mufflers); and

ix. traffic congestion and queuing.

e. Condition of scale, maintenance and administration buildings.

f. Condition of excavated areas and leachate collection system:

i. erosion of slopes;

ii. ponding of water;

iii. contact of contaminated run-off with other surface run-off; and

iv. exposure of or damage to the leachate collection system.

g. Condition of buffer area surrounding the site (also stockpiles):

i. condition of perimeter fencing;

ii. presence of litter;

iii. vegetation failure; and

iv. odour or dust.

Any necessary repair/remedial works will be performed at the earliest possible opportunity.

SURFACE WATER MANAGEMENT SYSTEM

34. Within the first year of operation following the date of this Certificate, the perimeter surface water management system consisting of ditches, berms and the surface water management pond shall be completed by the Corporation. It shall be constructed, operated and maintained by the Corporation in accordance with procedures outlined in Item 2, Schedule "A".

35. Site grading and contours shall be maintained by the Corporation such that all surface water run-off from the landfilling area is directed into the perimeter surface water management system.

LEACHATE COLLECTION SYSTEM

36. Prior to commencing landfilling operations the leachate collection system shall be in place. It shall be constructed, operated and maintained by the Corporation in accordance with procedures outlined in Item 2, Schedule "A".

37. The leachate collection system shall be inspected and maintained regularly by the Corporation throughout the contaminating lifespan of the Landfill:

a. during its operating life in accordance with a time table to be set out in the O & M Manual referred to in Condition 11; and

b. after site closure in accordance with a time table to be set out in the Closure Plan referred to in Condition 45.

CUT-OFF WALL

38. Prior to commencing landfilling operation the cut-off wall shall be constructed by the Corporation in accordance with,procedures outlined in Item 2, Schedule "A".

GROUNDWATER MONITORING

39. Groundwater monitoring shall be undertaken by the Corporation in accordance with Schedule "C".

LEACHATE MONITORING

40. Leachate monitoring shall be undertaken by the Corporation in accordance with Schedule "D".

SURFACE WATER MONITORING

41. surface water monitoring shall be undertaken by the Corporation in accordance with Schedule "E".

LANDFILL GAS MONITORING

42. Landfill gas monitoring shall be undertaken by the Corporation in accordance with Schedule "F".

BIOLOGICAL AND VEGETATION MONITORING

43. Biological and vegetation monitoring shall be undertaken by the Corporation in accordance with Schedule "G".

CLOSURE PLAN

44. One year before the Landfill is expected to stop receiving waste, as determined according to Condition 5, the Corporation shall develop and submit an updated Closure Plan. The Closure Plan shall be submitted for the Director's approval and outline post-closure maintenance and monitoring. The plan shall include, but not be limited to the following:

a. changes to the final contour plan that may have been previously identified in the annual reports or recommended in the development of the detailed closure plan;

b. fencing and access control;

c. details of any additional vegetative plantings planned;

d. the sequence and schedule for completion of final cover installation;

e. post-closure and end-use plans;

f. plans and schedules for the management and continued monitoring of surface water, ground water, leachate and landfill gas;

g. plans and schedules for the routine monitoring and maintenance of the final cover, ditches and surface water management pond; and

h. plans and schedules for the routine monitoring and maintenance of the leachate collection system.

45. The final cover over the entire area which was landfilled shall be completed by the Corporation within one full construction season following the date after the Landfill has stopped receiving waste. Formal notice shall be provided by the Corporation to the Director upon receipt of the final load of waste to the Landfill.

ANNUAL REPORT

46. The Corporation shall prepare and submit an annual report to the Regional Director by June 1st of the year following the calendar year covered by the report which shall include as a minimum, the following:

a. a summary of total annual quantities of waste received on a monthly basis at the site;

b. a drawing(s) of the Landfill indicating all groundwater, leachate, surface water, biological and vegetation, and gas monitoring locations;

c. tables outlining monitor locations, analytical parameters sampled, and frequency of sampling and measurements;

d. an analysis and interpretation of the surface water, groundwater, leachate, gas, biological and vegetation monitoring data; a review of the adequacy of the monitoring programs; conclusions based on interpretation of the monitoring data; and recommendations for any changes in monitoring programs that may be necessary;

e. an assessment of surface water quality with respect to the PWQO/Guidelines and trigger concentrations mentioned in Schedule "E";

f. an assessment of groundwater quality in relation to the RUP,ODWO and trigger concentrations mentioned in Schedule "C";

g. an assessment of landfill gas migration;

h. an assessment of the performance of the leachate collection system and cut-off wall;

i. an update of changes in operations, sequencing, equipment, or procedures made or produced at the Landfill, and any operating difficulties encountered;

j. drawings showing areas of fill, buffer areas, current Landfill contours, final Landfill contours, any recommended changes to the final contours, percentage of available space utilized, and an estimate of the remaining disposal capacity and Landfill site life;

k. a summary discussion of Landfill site daily and intermediate cover requirements and erosion protection;

1. a statement as to compliance with all conditions and with the inspection and reporting requirements of the conditions;

m. a summary of any complaints made regarding Landfill operation and the Corporation's response and action taken;

n. recommendations respecting any proposed changes in the operation of the Landfill; and

o. any report of the LLC to the Corporation.

47. A copy of an annual report shall be submitted to the LLC.

1. SCOPE

This Publication establishes sound level limits for landfill operations affecting residential or other noise-sensitive areas. Three components of waste disposal operation are separately addressed in this guideline:

~ the actual landfill site;

~ facilities for reception, storage and mixing; and

~ off-site source vehicles.

is the sound level that is present in the environment, produced by noise sources other than the source under impact assessment. Highly intrusive short duration noise caused by sources such as an aircraft fly-over or a train pass-by is excluded from the determination of the background sound level;

"Construction Equipment"

means any equipment or device designed and intended for use in construction, or material handling including but not limited to, air compressors, pile drivers, pneumatic or hydraulic tools, bulldozers, tractors, excavators, trenchers, cranes, derricks, loaders, scrapers, pavers, generators, off-highway haulers or trucks, ditches, compactors and rollers, pumps, concrete mixers, graders, or other material handling equipment;

"Conveyance"

includes a vehicle and any other device employed to transport a person or persons or goods from place to place but does not include any such device or vehicle if operated only within the premises of a person;

"Point of Reception"

means any point on the premises of a person where sound or vibration originating from other than those premises is received. For the purpose of noise impact assessment of a proposed landfill operation, or an expansion to an existing landfill operation, the point of reception may be located within 30 m of a dwelling or a camping area on any of the following existing or zoned for future use premises: permanent or seasonal residences, hotel/motels, nursing/retirement homes, rental residence, hospitals, camp grounds, and noise sensitive buildings such as schools and places of worship.

Other technical terms used in this publication are defined in Reference [1] .

s. SOUND LEVEL LIMITS

(1) Landfill Site

(a) General Limits

The limits for sound levels due to the landfill site operation at a Point of Reception are 45dBA in any hour of the night, 7:00 PM - 7:00 AM, and 55 dBA in any hour of the day, 7:00 AM - 7:00 PM. These levels are expressed in terms of the One Hour Equivalent Sound Level (Leq).

The above limits are applicable under the following conditions:

~ the existing ambient noise climate is assumed to be rural, i.e. the daytime and nighttime environmental noise level is normally below the stated limitation. Should the environment be dominated by noise sources of man-made activity, such as industry, commerce or road transportation, which produce sound in excess of the above limits, the higher sound levels may be used as the limit, provided that the noise sources are not under consideration for noise abatement by the Municipality or the Ministry of the Environment.

~ landfill site operation involves only "construction equipment" or "conveyances", as defined in Section 3. In this case, the landfill site itself is not considered a stationary noise source, and will not be governed by the limitations set out in References [5] or [7] .

(b) Specific Limit - Impulsive Sounds

For impulsive sound from a pest control device employed in the operation of the landfill site, the sound level limit at a Point of Reception expressed in terms of the Logarithmic Mean Impulse Sound Level (LLM) is 70 dBAI.

(2) Facilities for Reception, Storage and Mixing

A landfill site utilizing equipment that does not fall under the definition of "construction equipment" or "conveyance", as defined in Section 3 is considered a stationary noise source. The applicable sound level limits are those established for the assessment of stationary sources of sound given in References [5] and [7].

6. OFF-SITE SOURCE VEHICLES

For a landfill site employing off-site source vehicles which constitute a predominant component of the background noise, an access rout shall be selected which will result in a minimum noise impact. The selection process shall be based on a detailed quantitative assessment of noise impact on individual receptors and the number of affected receptors along the alternative routes. The municipality and the affected residents must be clearly informed of any potential noise impact.

SCHEDULE "C"

This Schedule "C" forms part of Provisional Certificate of Approval No. A 420009. It describes groundwater monitoring program referred to in Condition 39.

1. OBJECTIVES

The objectives for the groundwater monitoring program are:

• to monitor groundwater quality in the overburden and bedrock aquifers;

• to identify and characterize movement of leachate-related contaminants in the overburden and bedrock aquifers within and at the site boundary;

• to evaluate the efficiency of the cut-off wall and the leachate collection system; and

• to determine the need for contingency implementation.

2 • MONITORING PLAN

The groundwater monitoring plan shall be carried out by the Corporation to address the stated objectives and will include the following:

2.1 Monitoring Locations

• Existing Monitors:

The existing groundwater monitors to be sampled are shown on Fig. C.1 of Item 4, Schedule "A" and listed in Table C.1.

• Additional Monitoring Wells:

To supplement the data collected from the existing groundwater monitoring wells, additional facilities will need to be constructed. Specifically, additional monitoring wells are proposed around the inside and outside perimeter of the cut­off wall.

Additional monitoring wells BH23, BH24, BH25, BH26 and BH27 will be installed in the Surficial Sand Unit between the perimeter cut-off wall and the landfilling area. These additional installations will allow evaluation of the cut-off wall performance in the immediate proximity of the landfilling area. The water table elevations around the landfilling area must be kept lower than those in the Shallow Aquifer outside the cut-off wall, and also lower than the hydraulic head in the Lower Aquifer to ensure groundwater inflow into the Landfill.

Proposed wells BH23 through BH27 will be installed after construction of the cut-off wall and prior to placement of any waste.

Additional monitoring wells BH17, BH18, BH19, BH20, BH21 and BH22 will need to be installed outside of the perimeter cut­off wall and screened in the Surficial Sand Unit, the Silt and Clay Unit and the Lower Aquifer. These wells will be used for both monitoring the direction of groundwater flow beneath the Landfill and for identifying any potential leachate impacts to the groundwater. These installations should be placed close to the perimeter cut-off wall so that any impacts to the groundwater beyond the wall can be detected as soon as possible. Early detection is critical to the implementation of effective mitigation strategies to prevent groundwater impacts from exceeding RUP criteria at the property boundary . . Porposed wells BHl 7, BH18, BH19. BH20 and BH21 will be installed prior to commencing the landfilling operations.

The proposed monitoring wells are summarized in Table C.1 and their locations are shown on Fig. C .1 of Item 4, Schedule "A".

2.2 Sampling Frequency

All monitors shall be sampled three times per year, in April, July and October.

2.3 Sample Analysis

2.4 Measuring Water Levels

3. TRIGGERS AND CONTINGENCIES

There are two potential pathways for contaminants to migrate from the Landfill in the groundwater. These pathways are as follows:

• Pathway 1 - Horizontal movement of contaminated groundwater through the Surficial Sand Unit (Shallow Aquifer), Silt & Sand Unit and the top of the Silt & Clay Unit where fractures or more permeable zones exist. Once in the surficial deposits, contaminants may impact surface waters and will move according to the localized flow system. Water level maps indicate that the direction of contaminant migration will be northeast in all hydrolithological units.

• Pathway 2 - Vertical movement of contaminated groundwater through the Silt & Clay Unit to the Lower Aquifer. Should contaminants reach this aquifer, then contaminant movement within the Lower Aquifer is expected to be laterally to the northeast and east of the landfilling area.

There are four possible failure scenarios leading to unacceptable groundwater impacts:

• premature failure of the leachate collection system (LCS);

• failure of the perimeter cut-off wall;

• failure of both the LCS and the perimeter cut-off wall; and

• different movement of contaminants than predicted with the current understanding of the hydrogeological regime.

The first three failure scenarios are applicable to Pathway 1 in which the movement of contaminated groundwater is horizontal and there are potential impacts on the Shallow Aquifer and surface water. The first and last failure scenarios are applicable to Pathway 2 in which the movement of contaminated groundwater is vertical (downwards) and there are potential impacts on the Lower Aquifer. For each of the failure scenarios associated with the two contaminant pathways, contingency measures have been identified.

The implementation of contingency measures is based on the monitoring of the performance of the engineered systems and~,the natural conditions, including:

• groundwater quality outside the cut-off wall and below the Landfill;

• groundwater levels on either side of the cut-off wall;

• leachate quality (to identify whether the Landfill of contaminants measured in groundwater);

is the source

• leachate levels in the LCS and in the waste; and

• leachate quantities removed from the LCS.

Potential failure scenarios, proposed contingency measures, trigger criteria, and the nature of investigations initiated by the trigger criteria are discussed below for the two contaminant pathways.

3.1 Pathway 1 Contingency

~ Premature Failure of the Leachate Collection System (LCS)

The LCS has a design service life of 30 years. When the LCS can no longer control leachate elevations within the waste and leachate mounding cannot be prevented, a perimeter drain system will be installed. The perimeter drain will be installed below the water table elevation in the Surficial Sand Unit so that the groundwater flow direction remains inwards, towards the Landfill.

If the LCS fails prematurely, leachate mounding will occur. If leachate mounding is not arrested, it may lead to a reversal groundwater flow direction. The flow direction may become outwards, away from the Landfill. The discharge of leachate to ground surface could occur.

The contingency measure for premature failure of the LCS is the early installation of the perimeter drain system. This will protect the Shallow Aquifer and surface water.

Investigations will be initiated if the leachate level measured in any riser pipe of the LCS exceeds one metre above the invert of the corresponding collection pipe. The investigation will consist of a detailed review of the LCS performance such as leachate levels in riser pipes over time, and of records of pipe inspections. If an isolated failure of a collection pipe or pipes is indicated, remedial action such as the cleaning or rehabilitation of individual collection pipes may be undertaken. If progressive deterioration of the collection system is indicated that is beyond repair or maintenance, then the implementation of contingency measures will be initiated.

~ Failure of Perimeter Cut-off Wall

Failure of the perimeter cut-off wall would cause an increase in groundwater flow towards the Landfill. Providing the LCS could handle the increased groundwater flow, impacts to the Shallow Aquifer should not occur but the volume of leachate to be managed would increase. A failure of the cut-off wall may, however, cause a failure of the LCS by overloading the system with groundwater flow. This would result in the first failure scenario in which the direction of groundwater movement is outward.

The contingency measure for failure of the cut-off wall will be to renovate the existing cut-off wall or install a new cut-off wall. The need to implement the contingency measure will be based on the degree of failure of the cut-off wall.

Investigation will be initiated if the difference in water level elevations in monitoring wells installed on either side of the cut-off wall decreases to 50% or less of the historical differences.

A number of proposed wells (BH23 to BH27) will be established on the landfill side of the cut-off wall and immediately outside of the cut-off wall (BH17 to BH22).

The investigation triggered will involve a detailed review of historical data and, probably, additional piezometer installations on either side of the cut-off wall in the vicinity of the suspected failure area for intensified water level monitoring. If failure of part or all of the wall is confirmed and if the increased flows to the LCS cannot be tolerated, then the contingency measure of renovation or replacement of the wall will be implemented.

Combined Failure of both LCS and Perimeter Cut-off Wall

A combined failure of the perimeter cut-off wall and the LCS would likely cause impacts to the Shallow Aquifer and, possibly, to surface water. Leachate levels in the Landfill would mound causing groundwater flow to be directed outward into the Shallow Aquifer and surface water.

The contingency measure for this failure scenario would be the construction of a groundwater interceptor trench downgradient of the Landfill or the re-establishment of a perimeter cut-off wall combined with a perimeter drain system.

The trigger criteria associated with this combined failure scenario and the initiated investigations would be the same as for the individual failure scenarios described above.

3.2 Pathway 2 Contingency

~ Premature Failure of the Leachate Collection System (LCS)

A premature failure of the LCS will result in increased mounding of leachate in the waste sooner than anticipated. The increased mounding may result in downward groundwater flow. Contaminant transport modelling predicts that, if the LCS fails prematurely (i.e., before 30 years), concentration increases will not rise substantially and impacts would still be below that allowed by the Reasonable Use Guideline. This analysis is conservative in that concentrations are predicted 5 metres below the landfilling area when in reality there is significantly more silt and clay present above the Lower Aquifer. Furthermore, impacts to the Lower Aquifer may not be detectable because of a diluting effect that the Lower Aquifer would have on any contaminant entering the aquifer system.

Because compliance with the Reasonable Use Guideline is predicted for the Lower Aquifer under this failure scenario, a contingency measure to protect the Lower Aquifer is not required. However, confirmation of such a failure by investigations initiated by Pathway 1 trigger criteria may lead to the early installation of the perimeter drain, as discussed previously.

~ Different Movement of Contaminants Than Predicted

The prediction of contaminant movement is based on the current understanding of the hydrogeological regime, as developed by site investigations. The Silt & Clay Unit is expected to play a major role in the protection of the Lower Aquifer. Downward contaminant movement from the Landfill is affected by the hydraulic conductivity of this unit. Impact predictions by contaminant transport modelling are based on a hydraulic conductivity value of 5 x 10-0 cm/s for the Silt & Clay Unit determined from testing.

If the actual vertical hydraulic conductivity of the Silt &

Clay Unit is higher than anticipated, the impacts below the Landfill while the LCS is operating, would actually be less than predicted, as the upward groundwater flow velocity will be higher.

Higher than anticipated vertical hydraulic conductivity values will eventually result in higher impacts below the Landfill once the LCS has failed.

The Lower Aquifer's compliance locations are as follows: BH17a, BH18a, BH19a, BH20a, and BH22a. Trigger concentrations are given in Table C.3. Exceedances of any of trigger levels at any of compliance locations during two consecutive sampling rounds will initiate consideration for the necessary contingency measure implementation(s).

There are two possible contingency measures for this failure scenario. The preferred measure at this time is the installation of the perimeter drain at a lower elevation than would otherwise be the case. The elevation would be established to prevent or reduce a downward hydraulic gradient as opposed to preventing an outward hydraulic gradient. This would reduce the potential for impact on the Lower Aquifer. Alternatively, a purge well system could be installed in the Lower Aquifer, downgradient of the site. This contingency measure should not be implemented unless impacts are actually detected in the Lower Aquifer. Premature contingency pumping from the Lower Aquifer would increase the downward gradient.

3.3 Contingency Implementation

Prior to implementation, any contingency measure(s) shall be discussed with and approved by the Director.

4 . SUBSEQUENT MODIFICATIONS

If there is any future need to modify the groundwater monitoring plan and/or trigger mechanism, a formal application shall be made by the Corporation to the Regional Director requesting his/her approval of the necessary changes and these changes may not be made without such approval.

1 . OBJECTIVES

The objectives for the leachate monitoring program are:

• to evaluate leachate quality;

• to assess the leachate impact on surface water and groundwater quality;

• to evaluate efficiency of the leachate collection system and cut­off wall.

2 . MONITORING PLAN

The leachate monitoring plan shall be carried out by the Corporation to address the stated objectives and will include the following:

2.1 Stations

Leachate will be sampled from the leachate collection system:

• at each of three manholes to which the Landfill base drains; and

• at the leachate pumping station.

All stations are shown on a Drawing C.2 of Item 4, Schedule "A".

2.2 Sampling Frequency

Leachate stations referred to in 2.1 shall be sampled three times per year, in April, July and October.

2.3 Sample Analysis

• Samples collected in July shall be analyzed for parameters listed in Column 1 of Table C.2.

• Samples collected in April and October shall be analyzed for parameters listed in Column 2 of Table C.2.

2.4 Leachate Level and Head Measurements

• Leachate level shall be measured at each of the riser pipes of the leachate collection system and in leachate wells to be installed from the completed surface of the Landfill.

• Measurements of leachate head shall be conducted using nine pressure transducers installed at a depth of 0.5 min the Landfill base.

• Leachate level and head measurements shall be conducted three times per year, in April, July and October.

• Leachate level and head measurement locations are shown on Fig. C.2 of Item 4, Schedule "A".

2.5 Leachate Flow Measurements

Continuous leachate flow measurements shall be conducted at the leachate pumping station.

3 . TRIGGER AND CONTINGENCY

The leachate level trigger mechanism and the contingency plan are described in Section 3.1 of Schedule "C".

4. SUBSEQUENT MODIFICATIONS

If there is any future need to modify the leachate monitoring plan and/or trigger mechanism, a formal application shall be made by the Corporation to the Regional Director requesting his/her approval of the necessary changes and these changes may not be made without such approval.

2.4 Flow Measurements

Stream flow measurements shall be performed at stations Band F four times per year, in January, April, July and October simultaneously with sampling events.

TRIGGER AND CONTINGENCY

Station Bat the outlet of the surface water management pond will be the trigger location for surface water.

Any parameter of Table E.1 with the established PWQO will be used as a trigger parameter. The list of trigger parameters could be revised in the future subject to the Regional Director's approval.

For parameters with background concentrations below the PWQO, trigger levels will be set at the corresponding PWQO. For parameters with background concentrations above the PWQO, trigger levels will be set at the corresponding background concentrations.

If the trigger concentration of any parameter is exceeded at Station B on two consecutive sampling events, an additional sample will be taken to confirm the analysis. If it is determined, based on a review of all of the surface water and groundwater quality data, that the exceedance is related to the Landfill, then contingency measures will be implemented. The nature of the contingency measures will depend on the cause of the problem. For example, if the exceedance results from leachate seeps through the cover, then the contingency measure will be the repair of the cover. If the source of the problem is discharge of contaminated groundwater to surface water, then the appropriate contingency measure for leachate control will be implemented.

CONTINGENCY IMPLEMENTATION

Prior to implementation, the appropriate contingency measure(s) shall be discussed with and approved by the Director.

SUBSEQUENT MODIFICATIONS

If there is any future need to modify the surface water monitoring plan and/or trigger mechanism, a formal application shall be made by the Corporation to the Regional Director requesting his/her approval of the necessary changes and these changes may not be made without such approval.

SCHEDULE "F"

This Schedule "F" forms part of Provisional Certificate of Approval No. A 420,009. It describes the landfill gas monitoring program referred to in Condition 42.

1. OBJECTIVES

The objectives for the landfill gas monitoring program are:

• to monitor combustible gas concentrations in the area outside the cut-off wall; and

• to monitor combustible gas concentration in on-site buildings.

2 . MONITORING PLAN

The landfill gas monitoring plan shall be carried out by the Corporation to address the stated objectives and shall include the following:

,, 2.1 Gas Monitors

Gas monitors to be sampled are shown on Drawing C.2 of Item 4, Schedule "A".

2.2 Sampling Frequency

Gas probes referred to in 2.1, shall be sampled semi-annually, in January and July, using a portable combustible gas detector.

2.3 Sample Analysis

The collected samples shall be analyzed for combustible gas concentration (field instrument calibrated to methane).

3. TRIGGERS AND CONTINGENCIES

The trigger level for soil gas concentrations measured from the soil gas monitors outside the cut-off wall will be 10% of the lower explosive limit (LEL). At this concentration level, further investigations will be performed to determine cause of exceedance and determine potential impacts to on and off site properties. For example, a possible cause for an exceedance could be a defect in the cut-off wall allowing the passage of landfill gas. At the 20% LEL level, any necessary remedial measures will be undertaken. In the case of the cut-off wall with a defect, repairs to the cut-off wall will be made, if needed.

Prior to implementation, the appropriate contingency measure(s) shall be discussed with and approved by the Director.

4. ADDITIONAL MONITORING

Landfill gas monitoring in on-site buildings shall be carried out by the Corporation in accordance with the procedures outlined in Item 2, Schedule "A".

5. SUBSEQUENT MODIFICATIONS

If there is any future need to modify the landfill gas monitoring plan, a formal application shall be made by the Corporation to the Regional Director requesting his/her approval of the necessary changes and these changes may not be made without such approval.

This Schedule "G" forms part of Provisional Certificate of Approval No. A 420009. It describes the biological and vegetation monitoring program referred to in Condition 43.

1. OBJECTIVES

The objectives for the biological and vegetation monitoring program are:

• to evaluate the Landfill impact on vegetation specimens and communities at the site;

• to evaluate the Landfill impact on breeding birds; and

• to evaluate the Landfill impact on benthic invertebrates and fish at and beyond the site boundary.

2 • MONITORING PLAN

The biological and vegetation monitoring plan shall be carried out by the Corporation to address the stated objectives and shall include the following:

2.1 Annual examination in September of selected vegetation specimens and communities at the site. Small plots of specific species, determined during the first examination, shall be physically examined for changes in the rate of growth, appearances, and general health. The first examination shall take place prior to construction of the Landfill.

2.2 Examination of breeding birds every three to five years, using cruise surveys and nest searching. The first examination shall take place prior to construction of the Landfill.

2.3 Sampling of the substrate for examination of benthic invertebrates twice a year in July and October at permanent monitoring stations. The proposed sampling locations are shown on Fig. C.3 of Item 4, Schedule "A". The first sampling shall take place prior to construction of the Landfill.

2.4 Electro-shocking sampling of fish once a year in July to determine species composition changes. The proposed sampling locations are shown on Fig. C.3 of Item 4, Schedule "A". The first sampling shall take place prior to construction of the Landfill.

The reasons for the imposition of these conditions are as follows:

1. The reason for Condition 1 is to provide definition of terms used in this Certificate.

2. The reason for Condition 2 is to ensure registration against title to the Landfill.

3. The reason for Condition 3 is to ensure that requirements specified in this Certificate are minimum requirements and do not abrogate the need to take all reasonable steps to avoid violating the provisions of other applicable legislation, regulations, approvals, orders, etc.

4. The reason for Condition 4 is to ensure that the requirements of this Certificate are severable. If any requirements of this Certificate for any circumstance is held invalid, the application of such requirement to other circumstance and the remainder of this Certificate shall not be affected thereby.

5. The reason for Condition 5 is to indicate the approved landfilling area and final contours.

6. The reason for Condition 6 is to provide an access to the Landfill for MOE personnel for inspecting and monitoring.

7. The reason for Condition 7 is to ensure that Schedules A, B, C, D, E, F and Gare integral parts of this Certificate.

8. The reason for Condition 8 is to ensure that the effective public complains procedure is in place.

9. The reason for Condition 9 is to ensure that within six months of the issuance of this Certificate, a LLC shall be formed.

10. The reason for Condition 10 is to ensure that the Landfill shall be developed, operated, monitored and maintained by the Corporation in accordance with all of the plans and specifications in the documents listed in Schedule "A".

11. The reason for Condition 11 is to ensure that an O & M Manual is in place.

12. The reason for Condition 12 is to specify the Landfill operating hours.

13. The reason for Condition 13 is to ensure that no waste to be disposed of at the Landfill except during operating hours.

14. The reason for Condition 14 is to ensure that the Landfill entrance gate shall be locked during non-operating hours to secure against access by unauthorized persons.

15. The reason for Condition 15 is to specify wastes which shall not be disposed of at the Landfill.

16. The reason for Condition 16 is to ensure that the weigh scale shall be installed and used to monitor and record all incoming wastes.

17. The reason for Condition 17 is to ensure that all vehicles entering the Landfill shall be identified by licence number on the weigh scale billing notice.

18. The reason for Condition 18 is to ensure that waste deposited in a manner that minimizes the area of exposed waste at the Landfill working face and shall be compacted before cover material is applied.

19. The reason for Condition 19 is to ensure that at the end of each working day, and within two hours of the entrance gate closure, cover material is applied to the exposed waste.

20. The reason for Condition 20 is to ensure that a contingency supply of cover material is in place.

21. The reason for Condition 21 is to ensure that at least 30 cm of cover material will be applied in areas where landfilling is not to be carried out for the period of 180 days or more.

22. The reason for Condition 22 is to ensure that in areas where landfilling has been completed to the approved final contours, the final cover is installed.

23. The reason for Condition 23 is to ensure that excavation shall be limited to that necessary to construct the approved base contours.

24. The reason for Condition 24 is to ensure that there is no burning of waste at the Landfill.

25. The reason for Condition 25 is to ensure that adequate bird and non­bird vector control shall be undertaken at the Landfill.

26. The reason for Condition 26 is to ensure that all necessary measures shall be implemented to prevent off-site litter impact from landfilling operations.

27. The reason for Condition 27 is to ensure that a dust control program shall be implemented.

28. The reason for Condition 28 is to ensure that a 7.5 m high berm along the southern site boundary shall be constructed to mitigate noise impact.

29. The reason for Condition 29 is to ensure compliance of the Landfill with the noise level limits outlined in the MOE's February 1997 "Noise Guidelines for Landfill Sites".

30. The reason for Condition 30 is to ensure that the Corporation shall follow the general complaint procedures in order to investigate and, if necessary, to mitigate any noise related complaints.

31. The reason for Condition 31 is to ensure that odour control shall be undertaken by the Corporation in accordance with the approved procedures.

32. The reason for Condition 32 is to ensure that the Corporation shall follow the general complaint procedures in order to investigate and, if necessary, to mitigate any odour related complaints.

33. The reason for Condition 33 is to ensure that weekly site inspections shall be conducted by the Corporation.

34. The reason for Condition 34 is to ensure that within the first year of operation following the date of this Certificate, the perimeter surface water management system shall be completed by the Corporation.

35. The reason for Condition 35 is to ensure that site grading and contours shall be maintained by the Corporation such that all surface water run-off from the landfilling area is directed into the perimeter surface water management system.

36. The reason for Condition 36 is to ensure that the leachate collection system shall be in place prior to commencing landfilling operations.

37. The reason for Condition 37 is to ensure that the leachate collection system shall be inspected and maintained regularly by the Corporation.

38. The reason for Condition 38 is to ensure that the cut-off wall shall be constructed by the Corporation prior to commencing landfilling operations.

39. The reason for Condition 39 is to ensure that groundwater monitoring shall be undertaken by the Corporation in accordance with Schedule "C".

40. The reason for Condition 40 is to ensure that leachate monitoring shall be undertaken by the Corporation in accordance with Schedule "D".

41. The reason for Condition 41 is to ensure that surface water monitoring shall be undertaken by the Corporation in accordance with Schedule "E".

42. The reason for Condition 42 is to ensure that landfill gas monitoring shall be undertaken by the Corporation in accordance with Schedule "F".

43. The reason for Condition 43 is to ensure that biological and vegetation monitoring shall be undertaken by the Corporation in accordance with Schedule "G".

44. The reason for Condition 44 is to ensure that one year before the Landfill is expected to stop receiving waste, an updated Closure Plan shall be submitted for the Director's approval.

45. The reason for Condition 45 is to ensure that the final cover shall be completed by the Corporation within one full construction season following the date after the Landfill has stopped receiving waste.

46. The reason for Condition 46 is to ensure that the annual report shall be prepared and submitted to the Regional Director by the Corporation by June 1st of the year following the calendar year covered by the report.

47. The reason for Condition 47 is to ensure that a copy of an annual report shall be submitted to the LLC.

In accordance with Section 139 of the Environmental Protection Act, R. S. 0. 1990 c. E-19, you may by written notice served upon me and the Environmental Appeal Board within 15 days after receipt of this Notice, require a hearing by the Board. Section 142 of the Environmental Protection Act, as amended provides that the Notice requiring a hearing shall state:

1. The portions of the approval or each term or condition in the approval in respect of which the hearing is required, and;

2. The grounds on which you intend to rely at the hearing in relation to each portion appealed.

In addition to these legal requirements, the Notice should also include: 3. The name of the appellant; 4. The address of the appellant; . 5. The Certificate of Approval number; 6. The date of the Certificate of Approval; 7. The name of the Director; 8. The municipality within which the waste disposal site is located;
