1. Southwark Council hereby GIVES NOTICE that it proposes to make the above-mentioned order under section 84 of the Road Traffic Regulation Act 19841, as amended.

2. The effect of the order would be to amend the London Borough of Southwark (20 m.p.h. Speed limit) (No. 1) Traffic Order 2014 so as to positively identify all roads, streets and parts of within the London Borough of Southwark in which the maximum speed limit of 20 miles per hour will apply, that is:-

Coming into force: 2016 The council of the London Borough of Southwark, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by section 84 of the Road Traffic Regulation Act 1984a, as amended, and of all other powers thereunto enabling, hereby make the following Order:

Citation and Commencement

1.1 This Order may be cited as the London Borough of Southwark (20 m.p.h. speed limit) (Amendment No. 1) Traffic Order 2016 and shall come into force on 2016.

Interpretation

2.1 In this order:-

“motor vehicle” has the same meaning as that given in section 136 of the Road Traffic Regulation Act 1984;

“speed limit” has the same meaning as that given in Schedule 1 to the Traffic Signs Regulations and General Directions 2016b; and

"the Order of 2014" means the London Borough of Southwark (20 m.p.h. speed limit) (No. 1) Traffic Order 2014c.

2.2 Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment.

2.3 Except as provided in Article 3.1 to this Order, any expression used in this Order which is also used in the Order of 2014 shall have the same meaning as in that Order.

Amendment of the Order of 2014

3.1 Without prejudice to the validity of anything done, or to any liability incurred in respect of any act or omission before the coming into force of this Order, the Order of 2014 shall have effect as though:-

(a) in Article 2.1 of that Order, for the definition of "speed limit" there were substituted the following text:-

"“speed limit” has the same meaning as that given in Schedule 1 to the Traffic Signs Regulations and General Directions 2016.";

(b) for Article 3.1 of that Order there were substituted the following text:-

"3.1 No person shall cause or permit any motor vehicle to proceed at a speed in excess of 20 miles per hour in any road, street or part thereof lying within the London Borough of Southwark specified in Schedule 1A to this Order.";

(c) in Schedule 1 to that Order, under the heading 'Boundary roads shared in part with the London Borough of Lambeth', the items "Hillingdon Street" and "Meadowcroft Road" were omitted; and

(d) there were added to that Order as Schedule 1A, the Schedule to this Order.

(i) to update the definition of "speed limit" to refer to that given in the Traffic Signs Regulations and General Directions 2016, and make a minor correction to Schedule 1 to that Order; and

(ii) to positively identify roads, streets and parts thereof within the London Borough of Southwark in which the 20 m.p.h. speed limit will apply.

Coming into force: 01 August 2014 The council of the London Borough of Southwark, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by section 84 of the Road Traffic Regulation Act 1984a, as amended, pursuant to arrangements made under section 19 of the Local Government Act 2000b, in accordance with regulation 7 of the Local Authorities (Arrangements for the Discharge of Functions) (England) Regulations 2000c with the council of the London Borough of Lambeth and the council of the London Borough of Lewisham in respect of Article 2.2 below, and of all other powers thereunto enabling, hereby make the following Order:

Citation and Commencement

1.1 This Order may be cited as the London Borough of Southwark (20 m.p.h. speed limit) (No. 1) Traffic Order 2014 and shall come into force on 01 August 2014.

Interpretation

2.1 In this order:-

“motor vehicle” has the same meaning as that given in section 136 of the Road Traffic Regulation Act 1984; and

“speed limit” has the same meaning as that given in regulation 5 of the Traffic Signs Regulations and General Directions 2002d.

20 m.p.h. speed limit

3.1 No person shall cause or permit any motor vehicle to proceed at a speed in excess of 20 miles per hour in any road, street or part thereof as lies within the London Borough of Southwark.

3.2 The speed limit referred to in Article 2.1 above shall also apply throughout the width of such boundary roads, streets or parts thereof shared with either the London Borough of Lambeth or the London Borough of Lewisham as are specified in Schedule 1 to this Order.

3.3 The speed limit referred to in Article 2.1 above shall not apply in such streets as are specified in Schedule 2 to this Order.
