• As an urban county, Harris County annually receives HUD entitlementfunding for the following programs:

• Community Development Block Grant (CDBG)

• Emergency Solutions Grants (ESG)

• HOME Investments Partnership Program (HOME)

• Current PY2020 amounts are based on PY2019 allocations from HUD. Theamount of funding available is subject to change.

• For the PY2020 RFP, Harris County cannot guarantee that the federalbudget for PY2020 will have the same amount or any funding for all threeprograms. Harris County also does not know how much HUD will allocateto us or when it will allocate PY2020 funding to entitlement jurisdictions.

Fair Housing• The Fair Housing Act of 1968, federal law governing housing discrimination

was passed and signed into law on April 11, 1968. HUD regulation requiresequal access to housing in all HUD funded programs. The Fair Housing Actprohibits the discrimination in the sale or rental of housing, the financingof housing or the provision of brokerage services against any personincluding the following protected classes:

• Race, Color, Religion, National Origin, Sex, Disability (mental and physical),Familial Status (presence of children under 18 in the home)

• As of 2012, the Fair Housing Act does not include sexual orientation andgender identity as protected classes, but equal access to housing in HUDprograms for lesbian, gay, bisexual, or transgender persons is covered by24 CFR Part 5, 200, 203, 236, 400, 570, 574, 882, 891, and 982.

Equal Access to Housing Final RuleThe Equal Access to Housing in HUD Programs Regardlessof Sexual Orientation or Gender Identity rule becameeffective March 5, 2012 through HUD's Office of FairHousing and Equal Opportunity (FHEO).

This rule applies to all McKinney-Vento-funded housingprograms, as well as to other housing assisted or insuredby HUD. The rule prohibits discrimination based on:

– person’s marital status, – sexual orientation, or – gender identity

Equal Access to Housing and Services Regardless of Gender Identity Final Rules

In addition to the final rule on Equal Access to Housing, HUDpublished a final rule in the Federal Register entitled “EqualAccess in Accordance with an Individual's Gender Identity inCommunity Planning and Development Programs”. This rule waspublished on September 21, 2016.

This rule ensures that each individual in accordance with theirgender identity will have equal access to housing and shelterprograms administered by HUD. This rule creates a newregulatory provision that requires those entities that arereceiving any HUD funding grant equal access to facilities,benefits, accommodations and services to individuals inaccordance with the individual's gender identity and in a mannerthat affords equal access to the individual's family.

Davis-Bacon and Related Acts (DBRA)

The Davis-Bacon Act is a federal law that requires any projects that receive $2,000 or more in federal dollars must pay the employees working on those projects according to the Department of Labor prevailing wage rates issued for that project.

Any contractor (general and subcontractor) who performs work on a project that is financed with federal dollars is subject to comply with DBRA.

Section 3Section 3 is a provision of the Housing and Urban Development (HUD) Actof 1968. The purpose of Section 3 is to ensure that employment and othereconomic opportunities generated by certain HUD financial assistanceshall be directed to low and very-low income persons to the greatestextent feasible.

Good faith efforts toward reaching Section 3 numeric goals are notoptional, and the requirements of Section 3 apply to subrecipients,contractors and subcontractors. Section 3 is triggered when HUD fundedconstruction and rehabilitation projects in excess of $100,000 create theneed for new employment, subcontracting, or training opportunities.

The Section 3 hiring goals require that contractors and subcontractorscommit to employ Section 3 Residents as 30% of the aggregate number offull-time new hires (see 24 CFR 135.30(b)(2)).

What is Leverage?“Leveraged” funds are simply a financial commitment toward the costs of a project from a source other than the granting organization. Leveraging can be achieved by a commitment from the sub-recipient or through various partnerships.

• Leveraged funds/resources must be identified, tracked and verifiable.

• Leverage funds may come from federal and nonfederal sources.

• May be in the form of cash, in-kind resources, or value of property if already acquired.

• Must be documented properly in the application and will be required for Pre-Application projects.
