The Training/Education requested in this solicitation is for the use and operation of the systems and solutions which fit the scope of this RFP. It is not for stand-alone training services, nor for training services which do not fit the scope of this contract.

Is it possible get more information on the 20191 UPS, Electric Vehicles, Building Automation. To make sure we have the right product fit? I could not find this information. What do I need to do?

RFP 20191 is not a project-specific procurement; please submit your proposed product offering, descriptions, and pricing that fit within the scope of the RFP as per Section I.1 Scope for OGS review along with your proposal.

11 Do you know if this work involves any mission critical (data center) work or is most of this “general building” work?

RFP 20191 is not a project-specific solicitation. Both mission critical systems (e.g., UPS, Cooling Systems, etc.) and general building work (e.g., HVAC Systems, Electrical Distribution System, etc.) are acceptable to the extent they fit the scope of this solicitation. Authorized User’s needs determine what work is done under this contract.

12 We are starting to look into the process by which we may be a state contracted vendor to provide our public safety software (CAD, RMS, Mobile, JMS, etc.) via the state website. Please check the pictures and specifications below for reference.

13 We would like to submit a proposal, Lot 1, for this bid re: ‘biometric access control’ and ‘portals, turnstiles, etc’. Are there specs for the equipment that we could review so as to quote this accurately?

It appears that GPS Antennas fits the scope as Radio/Two-Way Communications Equipment/Systems (Radios, Repeaters, Antennas, Infrastructure, etc.), GEOGRAPHIC POSITIONING SYSTEMS, AERIAL IMAGING SYSTEMS, ETC., AND FLEET MANAGEMENT/VEHICLE TRACKING SYSTEMS. Please provide complete information in your proposal product description and usage.

15 Is there is a need for Security Guards/Watchman for solicitation number 20191?

No, Security Guards are not included in the scope of this solicitation.

17 We meet some of the items under page 6, section 1 ‘Scope of Services’ however we have an offering that goes far beyond the applications listed.

For software products would OGS be willing to consider including categories for: Space Management, Maintenance Management (Work Order control), Inspections Management, Utility Billing Systems, Reservations Management, Inventory Control for Central Stores, Capital Project Management, Real Estate Management, or other applications that make up a complete Integrated Workplace Management System (IWMS)?

It appears that Inventory Control for Central Stores may fit the scope of RFP 20191 as Inventory Management/Tracking System. Reservation Management may fit the scope of RFP 20191 as a Security Management System, and Utility Billing Systems may fit the scope of RFP 20191 as an Energy Management System. Please provide complete information in your proposal including product description and usage. The remaining software products do not appear to fit the scope of RFP 20191.

18 As part of my proposed offering, my firm is including professional architectural and engineering subcontractors and design services as part of a total solution. Is this allowable?

Yes, it is allowable to offer professional architectural and engineering services (including, but not limited to preparing/certifying/stamping of plans & specifications, code compliance, etc.) provided that:

A. These Services are offered/acquired as part of a total security and facility system and solution; and

B. Bidder/Contractor and its subcontractor(s) cannot act as the State of New York (or any authorized users’) technical representative; and

C. Bidder/Contractor and its subcontractor(s) cannot rely on the Spearin Doctrine. All design error costs shall be borne solely by Bidder/Contractor and its subcontractor(s)/partner(s); and

D. Only for contractors awarded either Lot 3 or Lot 5.

different categories including: Building Management Systems, Other Physical Security, Portals, Turnstiles, etc…. I just wanted to make sure that our proposal was correct so any guidance would be greatly appreciated.

22 On page 6, Section 1.1, It seems to me that the state is combining multiple contract vehicles/categories into one singular contract. Our company only specializes in a few of the mentioned categories under that solicitation. When we submit a bid for ‘Security and Facility Systems and Solutions’ are we submitting a bid for all categories listed or is there a way to differentiate which category we want to bid for?

Per Section I.1 Scope, “Bidders can submit proposals which include one category, multiple categories, all categories, listed below as components of Security & Facility Systems & Solutions. Resultant contract awards can include one category, multiple categories, all categories.”

23 This RFP includes as part of its scope, per the listing on p. 6 of the

RFP, Fleet Management/Vehicle Tracking Systems. OGS has also issued an RFC for the IT Umbrella planned procurement which also listed Fleet Management as an in-scope service. As a provider of fleet management solutions, we are very interested in making sure we have an opportunity to offer our solution under the correct state contract(s). Can you please advise if Fleet Management is intended to be offered under both agreements or just the contracts resulting from this procurement.

OGS cannot speak to the scope of the potential future umbrella contracts, but vehicle management/tracking systems and solutions fit the scope of RFP 20191 Security & Facility Systems & Solutions.

management systems and services. This RFP includes as part of its scope, per the listing on pp 6-7 of the RFP, a number of categories that encompass security and identity systems. It appears that the intent of the scope of this RFP is more related to physical security and ID card systems as opposed to more IT-related or logical security and identity solutions, but we want to make sure we understand that clearly. The types of security and identity solutions we offer includes but is not limited to:

Firewalls and Firewall Management Intrustion Detection Systems (IT security) Intrustion Prevention Systems (IT security) Penetration Testing Vulnerability Scanning Policy Development Risk Assessment Data Breach Response Identity Management Solutions Web content filtering Anti virus and anti spam Application Security Review

We thought these services would be encompassed by the planned IT Umbrella procurement.

We cannot speak to the scope of the potential future umbrella contract, however, based on our review these services generally do not appear to fit the scope of RFP 20191 Security & Facility Systems & Solutions. Some of these services may be offered as part of a total physical security and facility system and solution, but not as a stand-alone offering.

Command Center Dispatch and Monitoring Systems; Interoperability Systems; Public Safety Communications Systems; Radio Two-Way Communications Equipment (Radios, Repeaters, Antennas, Infrastructure, etc.); Security Dispatch Consoles. Currently these items are under Contract 19521.

Q1 - Since we currently are administrators (awarded under 19521) to this contract is it the intent of the State to replace this contract with the new RFP?

Q2 - If so will our current offerings be rolled over to this new contract when our contract expires in 2015?

Q3 - If not will we be required to submit all the required paper work for RFP 20191?

Q4 - What time frame will we have to submit the paperwork once our contract expires?

Q1 – Yes. Eventually, contracts awarded as a result of this RFP will replace 19521 (Radio Communications Equipment).

Q2 – No. For contracts awarded under 19521 (and others listed in RFP Section I.2), these contracts will be going away upon expiration. You must respond to this RFP in order to continue to have a new contract beyond 2015. Failure to respond to this current RFP will result in the contract expiration as of December 2015 (PS maintenance contracts through December 2016) with no extension/renewal options.

Q3 – Yes. Proposals should be submitted as if you were a new bidder.

Q4 –There is no renewal for 19521 (and others listed in RFP Section I.2). Bidders must respond to this RFP 20191 by the bid due date in order to continue to have a contract beyond 2015. Alternatively, bidders must wait for the possibility of another periodic recruitment, which is allowed, but not guaranteed.

26 I did not notice any parts for strictly design, or for design/built. How are these jobs designed? By whom?

RFP 20191 contains provisions for the installation of products/equipment that are part of a Total Security System and Solution and the design (design engineering) which is part of the Total Security System and Solution. These services may be performed by the contractor, or a combination of the contractor and subcontractor(s). Please be advised, RFP 20191 is not a project-specific RFP, but to establish NYS Centralized Contracts.

27 Do certain law enforcement equipment (in-car sirens, portable traffic spikes, mobile data computers, etc.) fit the scope of RFP 20191?

No, these do not fit the scope of RFP 20191.

29 Does this bid include Security Screening Equipment; i.e. X-Ray, Metal Detectors Hand and Walk-through, Explosive Detection and Narcotic Detection Systems?

31 Do Security Guard Services (including evacuation training, staffing, guard training, etc.) fit the scope of this RFP?

No, Security Guard Services do not fit the scope of RFP 20191.

32 We would like to concentrate on selling the state badge holders, and lanyards like neckless holders for access control cards and ID cards.

This appears to fall into the categories of ID CARD PRINTERS, READERS, CARDS, BADGES, ACCESSORIES and ID EQUIP. ELECTRONIC CARD ID SYSTEM. Please provide complete information in your proposal including product description and usage.

Security and Facility Systems and Solutions with one of our products. The product is a self-service visitor management solution designed to help public and private institutions maintain control and more effectively manage visitor activity. It is a user-friendly touch screen Kiosk that facilities can use to process visitors and perform a background check against a national compilation of state sex offender databases. The Kiosk features step-by-step visual instructions and audio cues to walk the visitor through the sign-in process. The process includes capturing a real-time photograph, scanning the visitors’ driver’s license, performs a background check against a proprietary national compilation of state sex offender databases, prints a visitor badge with a time stamp, and stores the visitor's information in a secure database. Would the State consider this product eligible for potential award under the categories listed under Section I, Scope on page 6 of the Request for Proposal Number 20191, Group 77201 - "Security and Facility Systems & Solutions"?

35 Do traffic cameras/traffic light cameras fit the scope of RFP 20191?

It appears these fit the Scope of the RFP in the Video and CCTV Systems and Surveillance. Please submit your proposed product offering, descriptions, and pricing that fit within the scope of the RFP as per Section I.1 Scope for OGS review along with your proposal.

36 My company manufactures technical furniture, security/dispatch consoles and desk, and video display mounts used in security and public safety applications. Can we respond to this RFP only addressing the products we offer as a subset to a total solution?

Yes, Bidders can bid any of the lots, Lot 1 is for product only. The requirement is that products be part of a security solution.

37 Are there any specific manufacturers that we should supply pricing on for this RFP?

No. The Bidder needs to determine what items to put forward as part of their business decision. All product lines must fit the scope of RFP 20191 as determined by OGS NYSPro to be awarded.

various LOTS (Digital Infrastructure, Analog Infrastructure, Digital Portables & Mobiles, Analog Portables & Mobiles, etc.) that we currently have in 19521. Will they just be grouped into one single LOT (you only have five to choose from)?

No, the Lots in this solicitation are not based on catalog offerings. Bidders should submit proposals using the Lots on Page 8, Section I.2 Estimated Quantities. The aforementioned items appear to fit the scope of this contract.

39 If awarded radio communications on Contract 20191, will our existing contract award 19521 be canceled?

Yes.

40 Can you provide clarification or definition of the differences between "Integration Only,” Lot 5 and "Installation Only,” Lot 4.

Lot 4: Installation Only generally refers to the physical work/labor (mainly on-site) often performed by the Trades, which includes, but is not limited to:

A. Running, pulling, and blowing of cable, fiber optics, low voltage, and line voltage (110V and greater) wiring for security systems, fire alarms, electrical distribution systems, etc.

B. Installing ductwork, piping, chillers, boilers, cooling units/towers, and other related article 8 work for HVAC/mechanical systems.

C. Installing sprinkler piping, chemical suppression systems, etc. D. Mounting of cameras, equipment, lighting, panels/panel-

boards, etc. E. Other public work which is necessary to obtain an entire

physical security or facility system and solution. F. Project Management.

Lot 5: Integration Only is defined by RFP 20191 as “Actions required to join an existing and new system into an integrated application or to connect various components of new applications into a centralized system:” Answer continued on next page…

Can you provide clarification or definition of the differences between "Integration Only,” Lot 5 and "Installation Only,” Lot 4.

This generally refers to the technical implementation/configuration of a Total Security System and Solution, including, but not limited to:

A. Actions connecting previously installed equipment/components of a security system with newly installed components of a Security System to create/enhance a Total Security System and Solution.

B. Actions connecting different products/components in a newly installed system to create a Total Security System and Solution,

C. Programming of equipment/software/firmware, technical work, Network Engineering, etc. to enable a Total Security System and Solution, and

D. Security Consulting and Design Engineering which are part of a Total Security System and Solution.

Note: Contract holders awarded Lot 4 and/or Lot 5 only cannot provide any products/perform any maintenance on their contract. By requesting Lot 3, Bidders can offer products, installation, systems integration and maintenance.

41 Once we are approved for some regions within Lot 3, can additional regions be added as an auto add, or must we wait until the RFP is reissued to add regions?

No, regions can only be added during the RFP reissue.

42 If a Bidder is submitting a proposal for Lot 3, is it necessary to also include separate paperwork, e.g. pricelists, Appendix D forms, etc, for the other lots?

No, Bidders bidding Lot 3 (Product, Installation, Integration, and Maintenance) are not required to provide separate paperwork for the other Lots.

43 If we apply for Lot 3, do we need to apply for separate lots in addition?

No.

44 Could we be accepted for one or more parts of the Lot 3 but not all four parts (e.g. could we be accepted for installation but not maintenance)?

No, Bidders bidding Lot 3 (Product, Installation, Integration, and Maintenance) must be accepted for all four parts to be awarded a contract in this Lot. Bidders must be able to offer all four components of this Lot.

While your company has been in business for more than three years, since it has only been performing the work meeting the scope of this RFP for two years, it would not meet the criteria for contract award. RFP 20191 is a periodic recruitment and will be reissued yearly, or as specified by OGS. NYS welcomes your submitting a proposal when your company meets the requirements.

Question: In Section I.3.3 (Pages #14-15 of 115), it's noted that Fingerprint readers must be FBI-certified to Appendix "F". It's my understanding that this requirement is specific to 2-dimensional ink-and-paper latent finger prints, resembling prints left at crime scenes. New state of-the-art digital finger print readers that are not "FBI-certified" but are DEA-approved in accordance with US DOJ DEA regulations and meet the false match rate of 0.001 from an EPCS Biometric Certified lab are now available, with finger print readers that meet all capture requirements called out on page

The NYSCJEBTS requires FBI Certification. Even if a Bidder provides “newer” technology, this requirement must still be met. No, Bidders bidding Lot 1: Product Only are required to provide Mfr.’s Certificates for the product lines they do not manufacturer. Mfr.’s/Distributor’s Guarantees are only required for Lots 2 and 3, or a combination of Lot 1 and either Lots 4 & 5.

54 We are not distributors of equipment - do I still need a Manufacturer’s Guarantee?

Yes, Bidders bidding Lots 2 or 3, or a combination of Lot 1 and either Lots 4 & 5 and offering product lines they do not manufacturer must provide Manufacturer’s Guarantee(s)/Distributor’s Guarantee (Distributor to Bidder).

55 Does the Manufacturer’s Guarantee only apply to a project we sell off of State Contract.

Hard copy catalog and price lists, either in paper format or electronic format, must be available to all end users who either do not have web access or prefer the optional format.

69 It appears the State would allow an eligible NYS End-user to purchase refurbished equipment under a contract. However, presently our refurbished gear does not hold the same timeframe for warranty as a new product. In section II.3 C, it appears that the State would require the refurbished unit to also receive a warranty equal to a new item (ie 1-3 years from date of purchase depending on model). Yes, the 35% markup is used only for an example. Bidders need to determine their appropriate Percent markup for the Prevailing Wage Rates which, once established, cannot be increased for the life of contract.

Reseller (also referred to as Value Added Resellers/VARS) is an agent of a Lot 1 Product Only contractor who is authorized to accept purchase orders and receive payment by the contractor and OGS. The contractor is fully responsible for the actions of a reseller on contract. Under no circumstances can a reseller perform any services on any contract awarded under this RFP.

86 Will the state allow the submission of our radio communications published price book and APC discount table instead of the use of Attachment 1 of the RFP?

No. You should include your published price book (if this is your MSRP list) and may include your discount table, however, you must complete Attachment 1.

87 My company offers customized large products/equipment (e.g. Chillers) which do not have an MSRP as each items is customized “per building.” The contract requires I provide a List/Price MSRP, Percent (%) Discount, and NYS Net Pricing. How do I address this?

All products offered must have a List Price/MSRP, percent discount, and NYS Net Price. Current contractors which offer similar products have developed a pricing mechanism which OGS has accepted to address this situation. They determine a “ceil” cost which is the most they would ever charge for the customized products. This becomes the NYS Net Price and is the most the contractor can charge for the customized products/equipment. They then create an MSRP and a corresponding percent discount to comply with the requirements of the contract. If awarded a contract, a contractor can always offer a lower price based on the customization required at time of purchase. Bidders who are potentially going to offer this equipment/products may use the currently approved established pricing for these or similar items listed on current approved contracts as a method of establishing their approved pricing structure and demonstrating reasonableness of price. OGS reserves the right to review and reject this proposed pricing. OGS cannot accept any product pricing pages that are not based on an MSRP or equivalent pricing (i.e., Commercially-Based List Price, etc.) Bidders must also demonstrate reasonableness of price for all products offered (reference Section 1.4 Method of Award).

100 I’ve reviewed the MWBE Goal Requirements. I’m in the process of trying to add subcontractors to meet these requirements. However, we are not sure we will have this ready by the bid opening date. How can we address this?

It is not mandatory to submit an MWBE Goal/Utilization Plan at the time of the bid submission, but upon request by OGS as specified in RFP Section III.26

If you are referring to the Workers’ Comp and Disability Insurance, Bidders must submit proof of Workers Comp and Disability Insurance with their bid proposal. However, proof of the Commercial General Liability, auto and professional liability insurance must be provided within 30 days of notice of award.

105 Pg. 73, Section VI, Bidder Proposal Checklist, Item 4a: In the written statements for Proof of Ability is it a description confirming sufficient resources, history of continued operation, etc., and the emergency contact person details or something more?

Written statement format is at the discretion of the Bidder, but Bidder’s response should contain all the required elements.

There’s no specific Vendor Letter referenced in the RFP. If you are referring to describing how you meet the mandatory requirements of this RFP, there is no specific format, however, you need to describe how you meet the mandatory minimum requirements of Section I.3.

111 I am a current contract holder which can do installations, training and support work in Lot 1 on the current NYS OGS Security Contract. We have several manufacturers that provide hardware equipment that are also capable of offering these services statewide on a SKU. HP now offers these same SKUs for installation, training and support/warranty services statewide on contract. Will we be able to offer these services statewide on the new Security Contract if provided by the same manufacturer that provides the hardware?

Firstly, to clarify, the contractor that submitted this question is awarded Lot 4 (only in Region 2) in addition to Lot 1, which therefore allows them to perform installation in Region 2 only. Maintenance and Systems integration cannot be performed under Lot 4, and no services can be performed under Lot 1. The services as a SKU referenced by the contractor can only be offered if the contractor is awarded the appropriate Lot (e.g., to offer maintenance, the contractor must be awarded either Lot 2 or Lot 3) and only in regions where the contractor is awarded these services. The contractor can offer these SKUs statewide ONLY if they are awarded a statewide contract which for the applicable Lots.

112 Pg. 71, Section VI, Item 4a: For the written statements, how detailed do they have to be and what kinds of proof need to be supplied other than stating that they do meet the requirements in terms of continued operation and can perform all the work?

This is correct. Any addendum issued for RFP 20191 must be completed, signed, and included in the Final Proposal.
