1. Election of President

In accordance with the Report of the Returning Officer MrA R Shervani on 3 January 2012, Dr. Zafarul Islam Khanelected as the President of the AIMMM for terms of 2years ending on 31 December, 2013.

The candidates for the Presidential post were DrZafarul Islam Khan & Mr. Navaid Hamid.

Outgoing President Mr Syed Shahabuddin has handedover charge and Dr. Zafarul Islam Khan has taken chargeas President of the AIMMM with effect from 3 January2012.

2. Election of the MMA

The Returning Officer received 74 valid nominations for20 posts of members of the Markazi Majlis-e-Mushawarat(MMM). The following members have beenelected as Members of the Markazi Majli-e-Amla(MMA),having received the 20 highest votes.

An urgent meeting of the Markazi Majlis-e-Mushawaratwas held on Monday, 16 January, 2012 at 4.30 PM atthe Central Office of the Mushawarat, D-250, Abul FazalEnclave, Jamia Nagar, New Delhi-110025 to bid farewellto the outgoing President, Mr Syed Shahabuddin and towelcome the newly elected President, Dr Zafarul-IslamKhan, and to discuss some recent developments and towork out tentative future plans. A meeting of the Standing Committee washeld on 26 April 2012 to discuss some

internal matters like revision of the budget for 2012, initia-tion of a monthly lecture series on important milli, nation-al and international issues, to hold a press conferenceafter each MMM and MMA meeting, to rejuvenate state

units of AIMMM and toopen units in stateswhere AIMMM has nobranches, to completethe revision of theAIMMM constitution,to publish a goodbrochure and list ofmembers, start Urduand Hindi bulletins,open membership toIndian nationals livingabroad, open mem-bership to unrepre-sented sections andyounger capable indi-viduals. After the above infor-mal discussions, acondolence meetingfollowed in the memo-ry of Maulana Hakeem

Irfanul Husaini, Vice President of AIMMM, who died inKolkata on 16 April. He was also the current President ofthe AIMMM unit in West Bengal. The President initiated by describing Hakeem saheb'scontributions to the Muslim community in general and toMushawarat in particular. Maulana Jalaluddin Umari saidthat Hakeem Sahab was a truthful person and knew howto maintain good relations with others. His departure is aloss to all of us, he said.

Maulana Asghar Ali Imam Mahdi said that MaulanaHusaini believed in keeping good relations with all. JanabMuhammad Jaafar said that Maulana Husaini used toargue without hestation and used to win over others. Hewas much liked by all.

Janab Shabnam Subhani said Maulana Husaini's lifewas devoted fully for the millat. He was very popular inKolkata and had good relations with all. In this age ofscarcity of true leaders, a great vacuum has been createdby his departure. He added that it is a personal loss forhim that a person who was a well-wisher of all is no morewith us. Nawab Zafar Jung said that it is a matter of ill-fatefor the community that new leaders are not taking place ofthose who are departing. Janab Muhammad Sulaimansaid that he had a relationship of 25 years with MaulanaHusaini. AIMMM state unit in West Bengal was an idealunit because of the likes of Dr. Maqbool Ahmad andMaulana Husaini. His departure is a loss for both the mil-lat and Mushawarat.

Janab Ahmad Raheed Shervani recited the couplet ofFaiz Ahmad Faiz which says, "Aakhir-e shab ke hamsafar,Faiz, na jaane kiya huey" (Night is coming to an end, Faiz,and one knows not where the co-travellers have gone)and said that Hakeem Irfanul Husaini was the leader ofthe caravan. A person like him does not leave us in entire-ty - he leaves for us memories and unfinished jobs. It isour duty to finish those unfinished jobs.

The meeting ended with a prayer by Maulana Umari.

As discussed this morning in the Standing Committeemeeting and then with you personally after the meeting, Ihereby assign to you the organisational and fund-raisingresponsibilities as the General Secretary of AIMMM.

As you are aware, we all wish AIMMM to be moreactive, functional and visible, and for this I appreciate yourreadiness to visit AIMMM state units to activate them and

to possibly arrange for re-elections of units which are notactive. Also, please explore the possibility of holding state-level conferences to activate the units, to involve peoplewith their work and make them visible to the people and tothe authorities in the respective state. We also must try tostart new state units where there is no standing unit atpresent.

At the centre also, we intend to start a few new activi-ties like starting a Hindi and Urdu magazine and also todevelop the current English-language bulletin in order forit to have a mass appeal. AIMMM brochure and memberslist should also be published in a becoming and impres-sive manner. Also proposed is to hold a big national-levelconference in Delhi sometime in September or October.Obviously for all these activities we will need lots of funds.Therefore, I would like you to also concentrate on raisingfunds for AIMMM on a continuous basis so that these andother activities could take place without difficulty. At pres-ent I think we should try to raise for this year a sum of atleast Rs 20 lakh to meet the envisaged activities. It goeswithout saying that I will always be ready to offer you anypractical help possible to make AIMMM a vibrant organi-sation serving the millat.

New Delhi, 23 June 2012: All India Muslim Majlis-eMushawarat has decided to hold monthly lectures onimportant issues facing the Muslim community and coun-try. The lectures will be held at the Mushawarat centraloffice in Delhi after Maghrib of the last Friday of eachmonth.

The first lecture was delivered on 29 June 2012 bynoted social scientist Dr Javed Jamil on "Muslim Vision ofIndia: Destination & Roadmap". Dr Javed Jamil is theauthor of a document which pinpoints the areas of con-cern and concerted work in order to uplift the country andempower the Muslim community.

religious scholar and researcher - died in Delhi on 8February 2012; and Prof. Mughni Tabussam, prominentpoet, scholar, critic and author - died in Hyderabad on 15February 2012.

The meeting discussed the following issues:

Resignation: AW Saadatullah Khan, Editor, Islamic

Voice had said that due to his preoccupation he would notlike to continue. But this resignation was not accepted.

Earlier, Maulana Sirajul Hasan had expressed hisunwillingness to continue due to bad health. His resigna-tion was accepted.

The President informed the members that AIMMM'sfinances are in very bad shape; members are not payingtheir annual fees and the Circle of Friends of Mushawaratis shrinking. He informed the members that apart from thefunds needed to run the normal running of the office,around Rs 5 lakh are needed to complete the building andfinishing work on the first floor of our building which willlater provide a steady small income to run the office.

Gujarat: The President apprised the members thatthere is some movement for the revival of the AIMMM unitGujarat. In this respect, Janab Iqbal Mirza of Ahmeadbad,Maulana Matadar of Bharuch will be meeting on 4 Marchto consider ways to revive the Gujarat unit.

The President informed the members about the unnec-essary scare-mongering done by Christian groups overagitation in the Valley against the conversion drive byChurch activists who indulged in a vilification campaignagainst the officially recognised Mufti Azam of J&KMaulana Bashiruddin. NCM sent its vice chairman to theValley to report on the situation there but Christian groupsclaimed that it was joint team including Church represen-tatives. The President wrote to the NCM if this was true.The NCM replied that the NCM had not sent any "team" toKashmir, i.e., it was a one-member delegation comprisedof only its vice chairman.

He also informed the members that the AIMMM iscoordinating with Christian organisations active to securethe rights of Christian and Muslim Dalits who are deniedreservation vide the 1950 Presidential feat which hasbeen challenged in the Supreme Court of India by bothChristian and Muslim parties. AIMMM delegations havetaken part in meetings called by Churhc organisations inthis respect and our cooperation with them in this respectwill continue in staging dharnas and organising joint meet-ings. AIMMM member Dr Jawed participated in a dharnaheld by Church organisations against communal violenceat Rajghat on 27 Feb. 2012.

The meeting passed the budget for 2012-2013. Anobservation was made that the budget includes only nor-mal activities of the AIMMM. It should also include alloca-tions for extra-ordinary activities like conferences andconventions proposed to be held during the year.

The meeting deliberated on a number of milli, nationaland international issues and passed the following resolu-tions on 4.5% Reservation, Mishra Commission report,Gujarat, Jammu & Kashmir, Fresh attacks on Muslimyouth in the name of terrorism, Christians in J&K,Creeping saffronisation in M.P., Shia-Sunni riots,

Admission to private schools, India-Israel ties, NationalCommission for Minorities Educational Institutions, Syriaand Iran. (These resolutions are published below under

respective heads).

New Team in GujaratNew Delhi, 27 June 2012: The Gujarat state unit of the AllIndia Muslim Majlis-e Mushawarat held an extraordinarymeeting at Ahmedabad under the chairmanship of Prof.Juzer Bandukwala. The meeting unanimously elected thenew state functionaries of the AIMMM Gujarat as follows:Maulana Habibur Rahman Matadar, President; JanabIqbal Husain Shaikh, General Secretary; Janab AsifShaikh, Assistant Secretary, and Janab Abdur RazzaqShaikh as Treasurer. day’s murder of Qateel Siddiqui in Pune high security jail

issued on the occasion:

New Delhi, 9 June 2012: The cold-blooded murder of

Qateel Siddiqui in Pune's Yarvada high security jail yester-

day is yet another proof that the life of a Muslim is no

longer safe in India even behind the walls of a high secu-

rity jail.

This cold-blooded murder comes in quick succession

after a number of cases where security agencies’ high-

handedness in dealing with Muslim youth on flimsy

charges and mere suspicion gives away the game of the

administration's war against the Muslim community in the

name of fighting “terror”.

Only days ago two Kashmiri young students were kid-

napped by unknown security agencies at Aligarh and only

one of them was later released after the educational insti-

tution filed a habeas corpus case in Allahabad High Court.

It is now almost a month that Fasih Mahmood, an

Indian Muslim engineer, suddenly disappeared in Saudi

Arabia at the request of Indian authorities which are still

not clear about the charges against him.

Earlier Journalist Kazmi was arrested on unknown

charges and remains in custody while Hindutva terrorists

are getting bail and feeling confident enough to hold a

conference in Goa.

The murdered accused, Qateel Siddiqui, was a law-

abiding citizen of this country. Despite the passage of

seven months on his arrest, the agencies have not been

able to file a chargesheet against him, while he has been

consistently tortured in custody to force him to sign a fake

confession as it happens now in almost all such cases.

His murder has been arranged at the hands of a criminal

already incarcerated on murder charges. It seems the rea-

son is to use Qateel's fake confession in courts against

other accused since he will no longer be there to deny and

refute the forced confession attributed to him.

We hold the Maharashtra ATS chief Rakesh Maria, the

head of National Investigation Agency Sarat Chandra

Sinha and the Home Minister P. Chidambaram personally

responsible for this cold-blooded murder. We demand a

judicial enquiry by a sitting high court judge. We reject

with contempt the mere suspension of the jailor and a CID

enquiry. The jailor will be reinstated soon and the CID

enquiry will not go against their own ilk.

We appeal to the national and interna-

tional human rights organisations to take

notice of the situation in India where sec-

tions of the administration are fighting a war

against the country's largest religious

minority in the name of fighting “terror”,

while the security agencies themselves are

the biggest culprits and excel in fabrication

of cases and use torture to force the

accused to confess to crimes they never

committed. The aim is to demoralise the

Indian Muslim community and to slow down

its educational and social progress.

The meeting discussed the issue of terrorism and howthe Muslim community is being terrorised in the name ofcounter-terror activities of various agencies. There was aconsensus that a campaign is underway to retard the indi-vidual and collective progress of the Muslim community inthe name of fighting terrorism and the recent arrests are apart of this campaign. There was also a consensus thatthis issue cannot be tackled by ad hoc measures. Rather,an organised and long-term strategy is needed to face it.

It was agreed that a special fund should be establishedto fight legal cases, help victims, raise the issue and pub-lish documentation-based writings on the subject. It wasalso decided to establish a legal cell under AIMMM tokeep a constant eye on this issue, to take action whereneeded, and to work with the help of local lawyers. It wasalso decided to ask the Muslim community to protest inevery city and town against the injustices being perpetrat-ed in the name of "terrorism". The community should alsobe reminded to maintain good relations with the victims ofthis campaign and their families because mere arrest

does not make one guilty. It is a fact that about 98% ofpeople arrested under TADA and POTA have been foundinnocent and released. It is an insult to the united Ummahto forsake and shun a brother and his family in the time ofhis trial.

It was also decided to prepare and publish a whitepaper on terrorism on behalf of the Muslim community andto release it in a big convention to be held at Delhi. It wasalso decide to shun the attitude followed until now and tobring these issues to the knowledge of internationalhuman rights organisations, UNO panels and other coun-tries interested in human rights issued. It was felt thatinternational pressure on the Indian government is neces-sary to force it to rethink the misdeeds of its agencies.

Acquittal of umpteen Muslimyouths across the country in recent months after spendingyears in jails on trumped up charges has proved the com-munal nature of our police and security agencies. SeniorSupreme Court advocate Prashant Bhushan bluntly saidon February 27, 2012 that police across the country were"communalised". He added that "It costs nothing for thepolice to fabricate evidence and file a false chargesheetagainst an innocent person. In virtually no case, and avast majority of cases the court does not take the nextstep of ordering the criminal prosecution, immediate sus-pension, dismissal and prosecution of that police officer,"he said adding that there is "a trend that police across thecountry systematically frame Muslims in terror investiga-tions when they can't find the culprits. In such cases, theypick up anyone around whom a credible story could bespun."

We believe that Muhammad Ahmad Kazmi is the latestvictim of this communal mindset unleashed on the Muslimcommunity in the name of fighting terror. His over twodecades' impeccable record as a fine journalist is an openbook. Not only writing for national and international publi-cations, he also worked for the Doordarshan and had aPIB press card for which security clearance is required.The very fact that his case was not handled by theNational Investigation Agency, which has been specifical-ly established to investigate such cases, shows the murkynature of this whole enterprise to malign the Muslim com-munity at the hands of Delhi Police Special Cell, a forcenotorious for fake encounters and for criminally implicat-ing even its own informers in concocted terror plots.

We believe that there is no evidence till date againstJournalist Kazmi who has been precisely framed at thebehest of Israel's notorious and criminal espionageagency Mossad which, according to press reports, provid-ed his name to the Indian authorities which on their ownhad nothing against him. The Special Police threatenedhim that unless he confessed, they will hand him over toMossad "who know how to extract confessions" - which isa criminal threat as no Indian authority can hand over an

Indian citizen to a foreign agency unless there is a courtorder for the same and unless an extradition treaty existswith the concerned foreign country. The court took cogni-sance of his complaint in this regard and forbade SpecialCell to allow any other agency to interrogate Kazmi. Nowhaving used all its dirty tricks including conflicting leaks tothe media, the Special Cell realised the futility of its tricksand ended his police remand before it was due to expire.

We had written to the Hon'ble Union Home Minister,Hon'ble Lt. Governor Delhi, Hon'ble Chairman of thePress Council of India as well as to the Delhi PoliceCommissioner seeking their urgent intervention in thiscase of clear implication and fabrication of the which theSpecial Cell has a long tainted record. Till date only thePolice Commissioner met our delegation, albeit after adelay of about two weeks. Failure of other functionaries ofthe State to meet a delegation of leading Muslim organi-sations till date only shows their arrogance, contempt forthe community and disdain for democracy and civil socie-ty.

We forcefully condemn the new campaign against theMuslim community in the name of fighting terror while thesame forces are more than cautious in touching saffronbrigade elements named in Malegaon and Ajmer blastschargesheets. We will continue to agitate in various waysalongwith other civil society groups on this issue, whichwe believe, is a new escalation in the war against thecommunity in the name of terror-fighting until justice isachieved. New Delhi, 21 March 2012: Leaders of some of India'sleading Muslim organisations met the Delhi PoliceCommissioner BK Gupta here today. The delegationapprised the Police Commissioner about the Muslim com-munity's apprehensions over the renewed harassment ofthe community in the name of the fight against terror.

Dr Zafarul-Islam Khan, President of the All IndiaMuslim Majlis-e Mushawarat, led the delegation. He toldthe Police Commissioner that Muslims are deeply painedand angered by the renewed arrests of Muslim youth,especially the arrest of the well-known journalist MrMuhammad Ahmad Kazmi. The delegation told the PoliceCommissioner that the long remand by the police, permis-sion to foreign agencies to interrogate Mr Kazmi and hisreported torture are matters of grave concern to the com-munity.

The delegation asked the Police Commissioner to reinin the Special Cell of Delhi Police which isnotorious for its illegal activities like tortureand fabrication of evidence. The delega-tion requested the Police Commissionerto stop the informal media briefings bypolice officers and reported by the mediaalmost every passing day since the arrestof Mr Kazmi. The delegation also told thePolice Commissioner that Muslim youthare being arrested on mere suspicion andwithout tangible proofs while saffron ter-rorists are roaming around and no onedares to touch them despite the fact thattheir names appear in official documentslike the Malegaon and Ajmer blastschargesheets.

The Police Commissioner denied thatMr Kazmi is being tortured or ill-treated inany way. He added that he is personallyfollowing the case and officers have been

clearly instructed not to torture Mr Kazmi or harm him inany way. He also said that foreign agencies have not beenallowed so far to interrogate Mr Kazmi which, he said, isnot easy because a lengthy procedure has to followed forpermitting access of foreign agencies to such persons.

The Police Commissioner assured the delegation thatno allegation will be made in the chargesheet which doesnot have ample proof and justification. Moreover, thePolice Commissioner said that the Delhi Police has nopermission to harass Muslims of Delhi and some police-men have been suspended when they were foundinvolved in such activity. He further said that most of whatthe media is saying is baseless and we deny it but, headded, media is very powerful in our country and it is noteasy to rein in the media. He suggested that victimsshould go to courts to seek redressal against baselessnews published by the media. The Police Commissionerassured the delegation that no injustice will be allowed totake place.

Mr BK GuptaDelhi Police Commissioner, DelhiRespected Sir,We thank you for kindly granting us time to discuss a veryburning and distressing development to the civil society,media fraternity and the Indian Muslim community, viz.,the arrest of a senior Urdu journalist and an importantmember of the Muslim community Mr Muhammad AhmadKazmi by Delhi Special Police on unproven and wild terrorcharges. Mr Kazmi is accused of "helping" a terrorist whilethat particular terrorist remains at large.

It is a fact of life that as a result of a plethora of inci-dents and developments, especially during the last fewyears, there is a serious trust deficit vis-à-vis the Police inthe Muslim community. The Muslim community is painedto see that the at-random arrests of Muslim youth, whichstarted a few weeks ago, are continuing, and now thearrest of a person of Mr Kazmi's stature points to a seri-ous escalation where even senior members of the com-munity are not safe from arrest at the hands of the Policeon totally unproven and wild charges. Such behaviour onthe part of the Police and other agencies seriously dentstheir own credibility and is also injurious to the democrat-ic setup of the country.

Mr Muhammad Ahmad Kazmi is a senior and respect-

ed Urdu journalist of long standing who works and writesin the higher interests of the country. It seems that anyonewho speaks and writes against the rogue government ofIsrael will now be targeted by our security agencies whichare mesmerised by the Israelis who flout hundreds of UNresolutions to say the least. The strange presence of thedubious Israeli espionage outfit Mossad in our countryonly helps to multiply this menace. It is also very alarmingto know that "foreign" (most probably the notoriousMossad) agents have been allowed to interrogate MrKazmi though the remand is given only to the SpecialPolice. We are also pained that Mr Kazmi is being subject-ed to torture, denied sleep and proper food which is a vio-lation of his basic human rights.

We believe that there is no evidence till date againstJournalist Kazmi who has been precisely framed at thebehest of Israel's notorious and criminal espionageagency Mossad which, according to press reports, provid-ed his name to the Indian authorities which on their ownhad or have nothing against him. Now the Special Policeis threatening him that unless he confessed, they willhand him over to Mossad "who know how to extract con-fessions" - which is a criminal threat as no Indian authori-ty can hand over an Indian citizen to a foreign agencyunless there is a court order for the same as well as anextradition treaty exists with the concerned foreign coun-try.

We believe that the Indian security agencies havenothing to date to incriminate Journalist Kazmi and theyare busy fabricating a case and have been giving off therecord media briefings to build pressure on their victim.

It is our demand that the unheard of 20-days policeremand should be cancelled and bail should be granted toJournalist Kazmi who has been cooperating with thePolice in an exemplary way and there is no reason tobelieve that he will not do so in future. We have written to

the Hon'ble Union Home Minister, Hon'ble Lt. GovernorDelhi, Hon'ble Chairman of the Press Council of India aswell as to the Delhi Police Commissioner seeking theirurgent intervention in this case of clear implication andfabrication of the which the Delhi Special Police has a longtainted record. We also express our astonishment that thiscase is not being handled by the National InvestigationAgency which has been established especially to proveterror-related cases. We demand that the case must beurgently transferred to the NIA.

We will continue to agitate alongwith other civil societygroups on this issue, which we believe, is a new escala-tion in the war against the community in the name of ter-ror-fighting until justice is achieved. We will hold a dharnaat Jantar Mantar on 26 March to press our demands.

The cold-blooded murder of Qateel Siddiqui in Pune'sYarvada high security jail yesterday is yet another proofthat the life of a Muslim is no longer safe in India evenbehind the walls of a high security jail.

This cold-blooded murder comes in quick successionafter a number of cases where security agencies' high-handedness in dealing with Muslim youth on flimsycharges and mere suspicion gives away the game of theadministration's war against the Muslim community in thename of fighting "terror".

Only days ago two Kashmiri young students werekidnapped by unknown security agencies at Aligarh andonly one of them was later released after the educationalinstitution filed a habeas corpus case in Allahabad HighCourt.

It is now almost a month that Fasih Mahmood, anIndian Muslim engineer, suddenly disappeared in SaudiArabia at the request of Indian authorities which are stillnot clear about the charges against him.

Earlier Journalist Kazmi was arrested on unknowncharges and remains in custody while Hindutva terroristsare getting bail and feeling confident enough to hold aconference in Goa.

The murdered accused, Qateel Siddiqui, was a law-abiding citizen of this country. Despite the passage ofseven months on his arrest, the agencies have not beenable to file a chargesheet against him, while he has beenconsistently tortured in custody to force him to sign a fakeconfession as it happens now in almost all such cases.His murder has been arranged at the hands of a criminalalready incarcerated on murder charges. It seems the rea-son is to use Qateel's fake confession in courts againstother accused since he will no longer be there to deny andrefute the forced confession attributed to him.

We hold the Maharashtra ATS chief Rakesh Maria,the head of National Investigation Agency Sarat ChandraSinha and the Home Minister P. Chidambaram personallyresponsible for this cold-blooded murder. We demand ajudicial enquiry by a sitting high court judge. We rejectwith contempt the mere suspension of the jailor and a CIDenquiry. The jailor will be reinstated soon and the CIDenquiry will not go against their own ilk.

We appeal to the national and international humanrights organisations to take notice of the situation in Indiawhere sections of the administration are fighting a waragainst the country's largest religious minority in the nameof fighting "terror", while the security agencies themselvesare the biggest culprits and excel in fabrication of casesand use torture to force the accused to confess to crimesthey never committed. The aim is to demoralise the IndianMuslim community and to slow down its educational andsocial progress.

Respected Sir,An alarming news item has appeared in Inquilab, a lead-ing Urdu newspaper published from Delhi, in its 19 June2012 issue. The news item says that the Hindutva extrem-ist organisation Bajrang Dal, whose workers have been

responsible for a number of blasts and bomb-making inci-dents as well as umpteen criminal activities across thecountry, have just organised a 10-day-long arms trainingcamp inside a temple in the heart of the national capital.

According to the news item, leaders of VHP and otherextremist outfits delivered fiery speeches during the campabusing secular forces. VHP spokesman at this trainingcamp, Prakash Sharma, according to the report, said that"flourishing secular forces are a danger and that secularpolitics is responsible for destroying the country." A photo-copy of the said report is attached herewith.

According to our information, the said temple is LalitSaraswati temple* at Vasant Vihar. Moreover, according toour information, this is the second such arms trainingcamp being held in the national capital within the last fewmonths.

We have glad to know that your office has under-taken the preparation of a Report on our CulturalInstitutions. We are particularly interested in your perform-ance audit report on the Archaeological Survey of India.We are aware of the problems faced by the ASI and whichhave caused non-completion of several excavation proj-ects which it began since 1950 and the non-publication ofreports on excavations which were completed. The mostrecent instance is the Report on the excavation inAyodhya on the Ram Janmabhoomi -Babri Masjid Siteunder the order of the Allahabad High Court. The Reporthas not been placed in the public domain because it can-not stand scrutiny. The Archaeological Survey of India(ASI) takes the plea that the High Court had placed a baron its publication. But the Report was never examined bythe Special Bench of the Allahabad High Court. TheSpecial Bench passed its ordered in September 2010 andthere is no such bar, to the best of our knowledge. Werequest your special attention. We also request that the CAG Report should bring out theparticulars of all the non-completed excavation as well asunpublished reports of the completed projects of the ASIand the reason why the Annual issue of the IndianArcheology has been suspended for years.

Those who migrated during this period wereboth Muslim and Hindu by religion. ULFA has made itclear that in its view voting rights be denied to all irrespec-tive of religion. 4 April 2012Respected Sir,We are pleased to note that a compensation has beenordered by you for the ill-fated youth of Punjab who wereunlawfully killed during 1984-96 by the security forces dur-ing the unrest in Punjab. Though the compensation isbelated and meagre, yet it is at least an attempt by theState to accept the responsibility for crimes committed bypeople in uniform.

Similar crimes were/are committed in the state ofJammu & Kashmir where according to various estimates,close to ten thousand people, mostly youth, have disap-peared since the start of the militancy in late 1980s. TheState Human Rights Commission of Jammu and Kashmirreleased a report in July 2011 on unmarked graves in thenorth of Kashmir where 2943+ unidentified bodies wereverified in unidentified graves at 62 sites in 55 villages. Nodoubt, more such bodies will be found in other parts ofJ&K if a serious investigation is ordered.

It is high time the NHRC took initiative in this matter byordering a complete survey of Kashmir's official and unof-ficial jails, detention and interrogation centres and grave-yards to account for all the disappeared, most of whomare believed to have been killed and buried secretly.

The second logical step should be to order a propercompensation to the kin of all such persons who remain

Both the Union and state governments lacksincerity as they never bothered to implement the recom-mendations of the five working groups appointed by PrimeMinister Manmohan Singh. Even the recent report ofInterlocutors has not been made public so far. AIMMMdemands the urgent release of political prisoners, imple-mentation of the recommendations of the aforesaid fiveworking groups and restoration of Autonomy as recom-mended by Justice Saghir Ahmed. AIMMM also stressesthe immediate withdrawal of AFSPA from whole of Jammu& Kashmir and Manipur where it has been misused to thehilt and has created a climate of fear for ordinary peopleand impunity for the men in uniform who are free to violaterights and kill innocents at will. The thousands ofunnamed graves in Kashmir are a living testimony to thisnational disgrace. There is no point for AFPSA to remainin force in J&K where hardly 200 militants remain accord-ing to official sources.

Statement on the eve of state assemblies' elections New Delhi, 6 February 2012: President of AIMMM, Dr.Zafarul-Islam Khan, advised Muslim voters in a pressstatement to vote for secular and untainted candidatesand to try to defeat corrupt, criminal and communal candi-dates. Also the community has felt growing by disenchantedwith the post-election performance of secular parties and

their Muslim legislators. Today, therefore, the primaryinterest of the community is not only to raise its represen-tation in the legislature with at least some vocal, fearlessindependent legislators so that its legitimate aspirations &interests are voiced and pursued systemaically.

Since 2004, the JCMOE has been formulatingGuidelines for the Muslim Community for General andState Elections. Since 2009, it has suggested active par-ticipation of the Muslim electorate at the constituency levelin selecting candidates and/or parties to support with pri-mary objective of improving the quality and dependabilityof Muslim representation in national & state legislatures.

The JCMOE recalls with regret the oft-tested failure ofthe Muslim legislators to project the feelings and wishes ofthe community at the national or even state level. It is ofthe considered view that the reason behind the dissatis-factory performance of the Muslim legislators lies in thetheir personal & political loyalty to the parties they belongto and in their faithful support to the their political linewhich makes them disinclined even to raise its legitimateexpectation for equal participation in governance andsharing equal benefits of development at various levels.Indeed they remain silent even in situations of denial ofequality and justice.

The JCMOE has also concluded in the light of experi-ence that because of diverse factors, effective unity of theMuslim political groups on the eve of the election can notbe at the state or national level. It feels that Muslim votersat the constituency level can be united in favour of a com-mon candidate chosen through participation & consulta-tion of all who matter.

The JCMOE is convinced that both underrepresenta-tion and its quality are relevant. The secular parties do notfield proportionate number of acceptable Muslim candi-dates from winnable Muslim constituencies and alsobecause participation of Muslim voters in the election isoften less than average. Also, several secular parties con-test against each other apart from Muslim candidates ofmini parties, sometimes funded by vested interests, thusdividing the Muslim vote.

In view of the above, the JCMOE has revised theGuidelines in depth on the eve of the UP AssemblyElections for 2012 particularly because UP is the majorstate going to polls, has the biggest Muslim population ofall states with 18 % in the electorate, with decisive influ-ence in more than a quarter of the 403 constituencies andit has at least 35 % Muslims in 46 constituencies.

The JCMOE appeals to the Muslim electorate to buildon its electoral assets & take all possible steps.

General Guidelines for the Community To register all eligible voters and to vote massively, par-ticularly, women & youth, to raise their turnout above theaverage & thus increase their effective political weight inevery constituency.

To strive for Muslim unity at the constituency level, ris-ing above party affiliations or religious or sectarian consid-erations & chose a winnable candidate by common agree-ment who is reliable, capable & vocal and reputed to havea secular background.

To vote unitedly for the agreed candidate, as the mostacceptable candidate of the community.

mechanism of Selection of Common Candidates atConstituency levelMuslim electorate faces no dilemma when there is onlyone secular candidate of a secular party pitted againstone or more communal parties but when there are morethan one secular parties in the constituency, it must care-fully select one of them through wide consultations.

For this purpose, the local community should from aConstituency Consultation Committee(CCC) consisting ofa representative cross section of distinguished local per-sonalities who have knowledge, experience and politicalunderstanding but are not associated with any politicalparty. This CCC should have Ulema, academics, retiredofficials, former legislators, youth leaders & social acti-vivists and representatives of eminent Muslim organiza-tions and institutions. The CCC formed by the consultationamong community leaders should elect a Chairman.

The Committee should interview all important candi-dates in the field or even arrange public debates amongthem and interaction with the Muslim voters in differentparts of the Constituency.

The Committee should take the following point in con-sideration in evaluating the quality of the candidatesi. Whether the candidate and/or his party has generallysupported Muslim causes in the past or supports theirmajor aspirations like reservation in the current election.ii. Whether the candidate and/or his party has taken up sit-uations of Muslim concern and distress in legislatures orwith the partyiii. Whether their social base and general support makesthem relatively more winnableiv. Whether they are known and generally acceptable tothe Muslim votersv. Whether they are acceptable to the non-Muslim votersvi. Whether the party has fielded adequate number ofMuslim candidates in the state, the names of the con-stituencies, their popularity & reputation in UP the propor-tionate claim of Muslims is 73 out of 403.

Communication of Selection to muslim ElectorateI. The CCC should request all Muslim organizations, insti-tutions and influential citizens particularly academicians &journalists to actively support full reservation as the firstpolitical objective. The CCC should issue written appeal tothe electors to emphasize Reservation as the master keyto Social Justice, Democratic Governance, InclusiveDevelopment and Empowerment and to work for the suc-cess of the common candidate by all means at their dis-posal.II. The CCC should request the Imams of local masjids &heads of local madarsas and other educational institutionsto support the common acceptable candidate.III. The CCC should brief mass media on the procedurefollowed in selecting the common agreed candidate andreason for selection.IV. The CCC should advise candidates to use all modernmedia for publicity like phone calls, e-mail, social network

CONClUSiONThe JCMOE expects that these Guidelines will serve thepurpose of uniting the Muslim voters at the Constituencylevel, ensure massive turnout & united voting for a com-mon candidates and electing a more dependable repre-sentative in the UP Assembly and request Muslim organi-zation and institution and known political activists to takethe initiative immediately to form the ConstituencyConsultation Committees.

In your issue of 10 may 2012 Shri Pyaralal Raghavanhas presented his counter view on Supreme's Court deci-sion to abolish Haj subsidy based on inaccurate argu-ments. Since 95 or 96, I have been in the forefront then inthe parliament, for abolition of Haj subsidy. The Haj sub-sidy is a recent phenomena and not a historic tradition. Itwas introduced only in the late70's after the abolition ofHaj sailings and the rise in the air fare due to high cost ofaviation petrol.

The argument that Haj subsidy should continue as theGovernment of India spends vast amounts of money onHindu pilgrimage. The argument confuses the cause withthe effect. Subsidy for Mansarover etc. has come as afterthought to Haj subsidy. Also Haj subsidy originally came toless than 50 crores. It has risen because of governmentorder to create air transport monopoly in favor of Air Indiain the 90's. The original idea was that Haj Carrier shouldbe chosen by international tender & the Haj pilgrim wasalways prepared to pay the competitive fare. Per capitacame originally to only a few thousands & the total cost ofabout 4o-50 crores. But Air India tried to make up its loss-es through subsidy. Also the increasing number of pilgrimsreached it to the present level of 650 crores.

It is inaccurate to say many Muslim benefit from illegalquotas. In fact, quota is determined by the government ofSaudi Arabia and is largely distributed by Haj Committeeamong applicants from various states in proportion toMuslim population in their states.

I request that the sooner the subsidy is abolished thebetter, provided there in a global tender for Haj transportby the Haj Committee, report to all airlines, eligible undercommon criteria and followed by negotiations with theshort-listed airlines, by a high powered committee, includ-ing government representative from Finance, ExternalAffairs & Civil Aviation. My dear Salman,As you are aware the Government have so far deniedinclusion of Christian and Muslim Dalit under the 1950Presidential Order which restricts its benefits to HinduDalits only, later followed by some Sikhs and neo-Buddhists. This exclusion has resulted in rising tensionbetween Christian & Muslims Dalits on one hand andHindu Dalits on the other. The Christian Dalit are beingaccused of falsely claiming to be Hindus in order to bene-fit from reservation in government jobs and admission. Itis alleged that some Dalit Christians are posing as Hindusto claiming jobs, land etc.

Organizations like the Vishwa Hindu Parishad in TamilNadu and Gujarat have also raised the question of viola-tion of the local laws in formal change of religion. Thisunrest is likely to extend. In all areas and localities wherethere is substantial competition between Hindu Dalits andChristian and Muslim Dalits.

The Central Government has been least concernedwith the problems as appears from delay in filingresponse to the PIL filed by Christian Dalits.

I would like to add that the Justice Ranganath MishraCommission had recommended that the clause in theOrder of 1950 which make reservation the exclusive priv-ilege of the Dalit who profess Hinduism should be deleted.

Indeed this order violates the policy of Secularism asall facilities for the uplift of the Dalits, on ground of profes-sional parity or descent should be available to all Dalits,irrespective of religion they profess.

I request you to discuss this situation with the Ministerof Social Welfare as well as, as in Ministry of MinorityAffairs & take up urgently the matter of amending the 1950Order in accordance with the recommendation ofCommission. With kind regards,

Thelocal Muslims may as in the tribal areas agitate againstthe outsiders to whom the Wakf Property is sold leased orgiven away for example, if Wakf land is made into a foot-ball ground or used for building an enterprise, the localMuslims should be able to launch an agitation. People likeyou should suggest how this can be organized & how thelevels work without fear of police and authorities whichsuppress the combined will of the community. You are aware that Waqf management in India has beenmostly going by default as recognized and documented bythe then Prime Minister Mrs Indira Gandhi through her let-ter of 1976 addressed to the chief ministers (reproducedin Sachar Committee). The 28 Waqf Boards of India suf-fer from a chronic maladministration because the CEOsare usually low level, incompetent and untrained officerswhom the rest of the state bureaucracy does not consideras one of them – not even a poor cousin. This is becauseMuslim officers (statutory requirement since 1954) ofrequired seniority are very rare to find and spare. This hasbeen reported by both Sachar Committee in 2006 and theJPC of Waqf in 2008 after years of all-India touring, obser-vation and consultation. The facts have been re-affirmedthrough the information received by Zakat Foundation ofIndia (ZFI) under RTI Act for the decade 2001-2011.

Nonetheless, this one most useful Sachar recommen-dation (to create a separate Waqf cadre) was thoughtless-ly rejected by the Union Ministry of Minority Affairs withoutany serious consideration thereof at any senior level. Thisis evident from the ZFI’s inspection of the Ministry’s filesas ordered by the Central Information Commission.

Ever since 1863 (when Religious Endowments Actwas issued), the Indian religious establishments andendowments are managed by persons of the relevantfaith. Consequently, in several states, Hindu temples andendowments are managed by very senior governmentofficers of Hindu faith specifically recruited year after yearby the state government by virtue of specific laws enact-ed for this purpose by state legislatures. Their remunera-tions are paid by the state government. A separate serv-ice cadre exists in Tamilnadu to manage Hindu templesaffairs.

On the other hand, untrained low level persons likeveterinary doctors, retired teachers etc. manage the statewaqf boards as CEOs. Rarely a government officer isappointed. Even if this happens, the “Waqf CEO” is suchan officer’s additional charge. The reason: in the bureau-

cracy, Muslims consist of 2.5% as against their nationalCensus population of 13.4%.

Muslims of India are hurt at this discrimination metedout to them. The All India Muslim Majlis-e-Mushawaratappeals to you to have a relook at this vital issue of massconcern to the Muslims of India. A survey by a Delhi NGO has shown that the intake ofMuslim children in the capital's top private schools thisyear hovered between nil and under one percent withsome rare exceptions. Perhaps a survey of other citiesacross the country will come up with similar results. Thisspeaks volumes about the discrimination faced by Muslimchildren in private schools. The AIMMM feels that just asthe access of neighbourhood and weaker section stu-dents has been ensured through government rules foradmission, minority students too should have a quota inthese schools proportionate to their ratio in the local pop-ulation. Moreover, the AIMMM urges the Muslim commu-nity to come forward to establish good schools as well asraise the standards of our existing schools so that wecould be spared of this continued humiliation and discrim-ination.

It is time for the centralinvestigative agencies to go into the origin and reality ofthis fire in S-6. My dear Chief Minister,The decision of your government to pay higher uniformsalaries to Imams than in most of the states apart fromhouse building grant on April 3, 2012 is no doubt is a his-toric decision. Naturally it has been hailed by the Imamsor by the so called All India Organisation of Imams, whichhas little credibility in Muslim Community. Apparently thiswas based on the unimplemented and, what is worse, anunimplement-able order of the Supreme Court to makethe State Wakf Board responsible for payment of salariesand emoluments to Imams and other functionaries ofMasjids.

The judgment can not be implemented not onlybecause no Wakf Board in India has the necessaryresources (except perhaps those in Delhi, Punjab andHaryana). The state governments generally do not evenpay the administration expenses of the Wakf Boards. TheWakf Boards under the Wakf Law does not administer ormanage the Masjids, Graveyards and other public Wakfs.The Wakfs are managed by their Motawallis who pay asmall annual contribution to Wakf Boards which superin-tendents their working. The Wakf Boards are not in a posi-tion to pay their own staffs far less the functionaries of theMasjids and other Wakf institutions.

Secondly, under the Shariat the surplus income of aWakf if any can be used only in accordance with the inten-tion of the Wakif; it cannot be transferred to any otherWakf which is in deficit. There is no law under whichincome from all Wakfs in the state can be pooled in theState Wakf Board ad used by it for common benefit oreven to pay for the legal proceedings to free other wakfswhich are under adverse or illegal occupation.

Coming to West Bengal it is estimated that state hasabout 30,000 Mosques, if the Imams are to be paid andother functionaries are to be paid the minimum of Rs20,000 per month. This will entail an expenditure of 7200

crores. I doubt if your government will give a grant to StateWakf Board to meet such a huge expenditure.

The order of the Supreme Court needs to be revisedbut for political reasons neither the Central Governmentnor any Muslim organisation has approached theSupreme Court to revisit this misconceived & erroneousjudgment on the basis of Muslim Law of Wakfs.

Your decision announced with great fanfare has raisedmisleading & false expectations. It is incumbent on yourgovernment and the State Wakf Board to clarify the posi-tion to the people & to the Imams. I am constrained to cau-tion you against resulting frustration, if this is not done.This is a matter of public interest. I am releasing this letterto the press. Arab Spring is still in the process

New Delhi: Ambassador Karamatullah K Ghori delivered a lecture here

on the ongoing Arab Spring at the central office of All India Muslim

Majlis-e Mushawrat on 11 Feb 2012. Mr Ghori is a former Pakistani

diplomat who served as ambassador in various countries and is

presently settled in Canada. He is now a regular columnist of interna-

tional journals including MG. His published works include collections of

poetry and novels. President of AIMMM, Dr. Zafarul Islam Khan, wel-

comed him and introduced the guest to the august gathering consist-

ing of AIMMM members and local intelligentsia. Mr Ghori shared his

opinion on various international issues related to the Muslim world,

particularly the Arab Spring. He said that the present upheaval is actu-

ally a struggle for freedom by the masses because whole of Arab

World had been in the clutches of dictators of various hues for long. He

added that the present political change in some countries will take time

before it settles down to normal condition and democracy is estab-

lished. As of now, Tunisia seems to be the only country where a little

bit of success has been achieved in this regard.

He said that a democratic system thrives on established independ-

ent institutions rather than on individuals which helps create dictatorial

systems. Mr Ghori said that in whole of the Arab world, individuals are

glorified, and we do not see established institutions coming into picture

very soon. Till then, we can only wait and watch. He elaborately dis-

cussed the present situations of the Middle East politics and threw light

on the situation in Libya, Turkey, Iran, Egypt. He expressed his hope

for Pakistan to come out of its present political chaos. The audience

included Syed Shahabuddin, former president AIMMM, Nusrat Ali, gen-

eral secretary of Jamaate Islami Hind, Muhammad Jaafar, vice presi-

dent of JIH and Mohammad Ahmad, national secretary of JIH for polit-

ical affairs. A number of journalists also attended the lecture. (Nadim

We, are alarmed and deeply troubled by the continuingrepression of Palestinians in Jerusalem and by the delib-erate and systematic attempts to expel and reduce theChristian and Muslim Palestinian population of the city aspart of the policy called “Judaisation,” which is beingapplied to every part of historic Palestine.

This policy is inconsistent with all relevant UnitedNations resolutions on Jerusalem and contrary to themost basic principles of international law. Its purpose isplainly to ethnically cleanse Jerusalem of its non-Jewishpopulation and transform a once proud symbol of interna-tional tolerance and religious and cultural diversity into anexclusionary and racist enclave.

Jerusalem is our common universal heritage. It is thecentre of spirituality and ideological significance for all ofthe monotheistic religions, and a beacon of emancipationand hope for the downtrodden. This historic city is vener-ated across the world for enhancing the spiritual heritageof all humanity; it has been a symbol of unity and equali-ty, with a message of love, mercy and compassion.

However the entire world is now witnessing a threat tothe sovereignty, sanctity and inviolability of Jerusalem.The plan is not only to destroy the Muslim and Christianpresence, but also to change and dismantle the socialstructure of Jerusalem, obliterating its indigenous Arab

themselves to prevent this abomination, by mobilizingthemselves in every part of the world and representing allreligious, humanitarian, and cultural backgrounds in aglobal march to Jerusalem (GMJ) aimed at guarding theCity of Peace from becoming a wasteland of intolerance.We therefore lend our names to support the convergenceof people from all countries and continents of the world toJerusalem, and to the nearest points to which they areable to approach, both inside Palestine and at thePalestinian borders with Jordan, Egypt, Syria andLebanon, as well as in their own countries, in a peacefulmarch towards Jerusalem.

the large Indian Muslim community, are deeply painedand alarmed at the steadily growing Indo-Israeli relations.The latest episode comes in the shape of the visit of theHon'ble Minister of External Affairs to Israel during whichhe has talked of cooperation against "international terror-ism", raising Indo-Israeli trade to $ 15 billion from the cur-rent $ 5 billion, allowing Israel to open a consulate inBangalore, signing Extradition Treaty and announcing thatsoon a Free Trade Agreement too will be signed betweenthe two countries. Reports say that a number of otherIndian union ministers are in the wings to visit Israel.

We wish to say that while our External AffairsMinister seeks Israel's cooperation to fight terrorism,Israel has become the biggest symbol of terrorism in theworld. They have continuously executed countless terror-ist operations in all parts of the world including killingIranian, Iraqi and Egyptian scientists. Israel has beenresponsible for large-scale massacres in Sabra, Shatila,Jenin, Gaza, and many places of occupied Palestine.

We find it difficult to understand how India can askIsrael to cooperate in security while Israel is the fountain-head of terrorism in the Middle East? It is the Zionists whointroduced terrorism to the Middle East with acts like blow-ing up Jerusalem's King David Hotel which housed theBritish Government in Palestine (1946), murdering theBritish minister Lord Moyne in Cairo (1944) and the UNmediator Count Bernadotte in Jerusalem in 1948, orattacking American diplomatic offices in Egypt in 1954with a view to blame the Egyptians for the same. Today itis the cause of terrorism by occupying Palestinian landsand homes, turning the Palestinians into a nation ofrefugees and continuously nibbling away even at thesmall chunks left of Palestine and building illegal settle-ments there while treating its Palestinian residents ascaged animals and keeping the other part (Gaza Strip)under a most cruel siege since June 2007.

Today, Israel is the only illegitimate nuclear power inthe Middle East which stockpiles close to a thousandnuclear warheads and continuously refuses to sign NPT.This very entity had earlier destroyed the nuclear facilitiesof Iraq and Syria and now nags the western countries todestroy for it the Iranian nuclear facilities and militarypower despite the fact that Iran has signed NPT, allowsIAEA inspection of its nuclear facilities and reiterates offi-cially that it will not build a nuclear device.

Israel is even using Mahatma Gandhi's name tohoodwink us while the fact is that the proposed memorialwill be built on occupied and stolen land. This can neverbe a move to honour a great personality which was total-ly opposed to the idea of a Jewish homeland on Arab soil.

We very strongly object to the current overtures ofour government and say categorically that close ties withIsrael are not in India's best interests. Our security andvital secrets will not be safe if Israel becomes privy ofsame. We must shun racist Israel as we did opposeApartheid South Africa. Israel is the only country in theworld which has flouted hundreds of UN resolutions andyet talks of peace. We urge the Indian government to stoplip service to Palestine and revert to our age-old policy ofsupporting the just Palestinian cause which was so dear

The presence of over a thousand Burmese Muslimrefugees in utterly miserable conditions on Delhi streetsthese days has brought their plight to the knowledge ofthe people of India. They have come to our capital torequest the United Nations High Commission for

Refugees to grant them refugee status so that they arenot harassed and are eventually settled in some countrywilling to accept them. According to them, there arearound twenty five thousand Burmese Muslim refugees inIndia at present while there are greater numbers inBangladesh, Pakistan, Thailand, Malaysia and SaudiArabia etc.

The 1982 Burmese Citizenship Law unjustly deniesMyanmarese citizenship to the Muslim minority in NorthRakhine State, generally known as the Rohingyas, andasks them to prove that their ancestors lived in Burmaprior to 1823, which is an utterly unjust and arbitraryrequirement. They are now denied their basic rights inMayanmar, confined to live in their respective villages,have to pay bribes to Burmese officials for basic require-ments etc. This has led many of them to flee the countryover the years.

We request you to kindly impress upon theGovernmnet of Mayanmar, during your forthcoming visit toYangoon, and later through our Ministry of ExternalAffairs, to accept these refugees, restore their democraticand human rights including citizenship and allow them tolive in dignity with all the rights and freedoms enjoyed byother Mayanmarese citizens.
