B. It is recommended that the Board of Education accept a donation from the East HillElementary School PTA in the amount of $259.85, and it is further recommended thatthe 2018-19 general fund budget be amended as follows to reflect said donations:

C. It is recommended that the Board of Education accept a donation for East HillElementary School from the Travelers Employee Giving Campaign in the amount of$240.00, and it is further recommended that the 2018-19 general fund budget beamended as follows to reflect said donation:

PERSONNEL/OPERATIONAL ACTION ITEMS

A. It is recommended that the following resolution be approved:

RESOLUTION TO APPROVE AND ACCEPT THE RESIGNATION OFSUPERINTENDENT OF SCHOOLS AND APPROVE THE SEPARATIONAGREEMENT BETWEEN THE DISTRICT AND THE SUPERINTENDENT (Dr.Christopher Brown)

Be it resolved, that the Board hereby approves and accepts the resignation of Dr.Christopher Brown from his employment as Superintendent of Schools, dated January22, 2019, to become effective January 23, 2019; and

Be it further resolved, that the Board accepts the Separation Agreement between theDistrict and Dr. Brown, and authorizes the Board President to execute the SeparationAgreement on behalf of the Board and file it with the District Clerk.

B. It is recommended that the following resolution be approved:

APPOINTMENT OF ACTING SUPERINTENDENT

WHEREAS, the Superintendent Dr. Christopher Brown has submitted and the Board of

andEducation has accepted his resignation as Superintendent, effective January 23, 2019;

WHEREAS, the Board is desirous of appointing a qualified person to serve as ActingSuperintendent to oversee and direct District operations; and

WHEREAS, the Board of Education, after due consideration, has determined that Dr.Jody Manning, currently serving as OCM BOCES District Superintendent, possesses thequalifications and experience to serve as the Acting Superintendent of the WestGenesee Central School District, to continue the orderly administration of the District'seducational and operational affairs and to undertake such duties and responsibilities onbehalf of the District; and

WHEREAS, Dr. Jody Manning, has agreed to additionally serve as the ActingSuperintendent for the District during such period without compensation.

B. Resolution continued:

NOW, THEREFORE BE IT RESOLVED, that this Board, pursuant to applicableprovisions of the New York State Education Law, hereby appoints Dr. Jody Manning asActing Superintendent of Schools of the West Genesee Central School District effectiveimmediately and continuing through June 30, 2019 unless further extended orterminated; and

BE IT FURTHER RESOLVED, that, as Acting Superintendent, Dr. Manning shallpossess all authority and responsibility to serve as Acting Superintendent of Schools ofthe West Genesee Central School District; and

BE IT FURTHER RESOLVED, that, in accordance with the applicable provisions of theEducation Law, the District shall defend, indemnify and hold harmless Dr. Manning fromany claims which may arise in connection with his services as Acting Superintendentduring such period.

C. It is recommended that the following resignation be approved:

D. It is recommended that the following appointments be approved:

E. It is recommended that the following change in hours for bus attendants be approvedeffective 1/24/19:

OPEN FORUM

President Herron began the second open forum by noting that the BOE must complete its due process investigation as required. She also noted the open forum guidelines. President Herron closed by indicating that while they definitely want to hear from all that want to speak, their ability to answer some questions may be legally limited at this time.

Steven Grome indicated that he felt that Mr. Brown is an embarrassment to the District and the atmosphere at West Genesee needs to be addressed.

OPEN FORUM continued:

Shawn Mitchell spoke of many inappropriate emails that he and other Board Members received. He noted that due process needs to be followed and that those involved are absolutely entitled to receive that. He concluded by stating this is the way it should be and any person with any life situation should hope that they would receive the same.

Martha Bugin stated that Dr. Brown currently has several other professions and questioned the time he had available to run the District.

John Mannion thanked the Board for their dedication. He noted that communication paths between stakeholders and the Board need to improve. He asked for more open dialogues to take place.

Karen Kelly indicated that it took too long for the Board to get information out. She found out from other sources prior to the Board getting word out to the community.

Roberta Herron indicated that the Board first heard of the situation the same way many others did, via social media. She noted that following consultation from legal counsel, the Board released a statement on its webpage on January 4, 2019. She indicated that, as with the most recent update, that first statement probably should have been sent out directly to the community also, but getting feedback from the Board’s legal counsel was top priority at that stage of the process.

Kathleen Guthrie wanted to better understand the independent investigation and the firm’s relationship with the District. The Board responded by indicating that the Ferrara Firm only represents the BOE, not individual employees of the District.

Erica Henson felt that Mr. Mitchell sounded defensive and asked about Dr. Brown’s credentials. It was noted that details of personnel matters would not be discussed.

Shawn Mitchell said that he would always defend his integrity when challenged. He noted that he too is an educator, District resident and taxpayer.

Kathy Ryan indicated that she had pieces of information that she was interested in sharing with the Board, but she found it very difficult to get in touch with Board Members. The Board indicated that their emails are all available. Mrs. Ryan indicated that she is not a fan of email and access should be easier.

Shawn Mitchell told all in attendance that if they have any credible legal evidence, they are welcome to reach out to the Ferrara Firm and provide that information.

Michele Gagne claimed that she felt the word anxiety surrounding the District is really more outrage and concern. She encouraged people to be more open with communication between staff and the Board.

Karen Kelly asked if the Board of Education appointed the Executive Principal. The Board indicated that they approve recommendations of the Superintendent. Dave Cirillo, Director of Staff Relations, indicated that the normal policies and procedures were followed when appointing the current Executive Principal.

Dan Burlingame asked if the Board has a plan at the conclusion of the investigation, as the damage has been done. President Herron indicated that the game plan can only be developed once the investigation is complete and we are confident that we have accurate facts.

Vince Mauro indicated that he was also concerned with the multiple job responsibilities the Superintendent held. He also asked if the final report will be public; what we are investigating; and if there was a relationship, did the Board consider that inappropriate. It was noted that the report would be bound by client/attorney privilege and would not be available to the public. President Herron noted that prior to this situation, the Superintendent has provided an exemplary work performance. She noted that every year annual goals are mutually agreed upon and he has always achieved the agreed upon goals.

Steve Grome asked about the District Code of Conduct and the Superintendent Code of Conduct. It was noted that the terms and conditions of the agreement with the Superintendent are all in his contract.

Lora Champlain asked about the Board’s responsibility of being stewards of the taxpayers. She noted that many more would speak out, but fear retribution in the future.

Shawn Mitchell spoke of his and the Board’s integrity. He noted that he is 100% fully here to look out for the District and students.

Neil Widrick noted that all of the Board Members are volunteers and hope that they would be supported. He acknowledged that they were elected to represent the community, however they must utilize due diligence in this process. He noted, while they are anxious to move quickly, it is important to come to the correct conclusion once all of the facts are gathered.

Dana Northrop asked for a link to the SeeThroughNY page with the Superintendent’s contract. The Board indicated that the link was available in the Board’s updated notice, found on the District’s website home page. Mr. Northrop also indicated that the Board may want to consider a social media policy.

Vince Mauro had a copy of the Superintendent’s contract available and read a portion of the contract to those in attendance.

Kathy Ryan gave suggestions on how the final conclusions of the investigation should be reported to the public.

Michael Iles asked if we could elaborate on the selection of the counsel completing the investigation. It was again noted that the Ferrara Firm is the counsel of the Board and only represents the Board, not the individual employees of the District.

Steve Grome asked about the cost of the investigation. It was noted that the total cost cannot be determined at this point.

Randy Hensen noted that it would be nice if it didn’t take a situation like this to get more people to the Board Meetings and that more people should come more often. He then asked a follow up question regarding Dr. Brown’s credentials. It was noted that Dr. Brown, as well as many other school district administrators, have the appropriate credentials to be a superintendent of a school district.

Margaret Bugin asked if the Board knew if Joe Shields, one of the Ferrara Firm’s counsel, was friends with Dr. Brown. The Board has no knowledge of said information.

Dana Northrop asked again how much was being spent on the investigation. Paul Pelton indicated that there are various rates depending on which person at the firm was doing the work. When asked for the hourly rate again, Mr. Pelton estimated a rate of $235 an hour. (The next morning, January 17, 2019, the hourly rate was confirmed at $210 per hour)

Cathy Emery asked who decides what gets included in the Superintendent’s contract. It was noted that the contract is negotiated between the Board and the Superintendent.

Jackie Wisnewski asked who was in charge of the overall High School, should someone need to reach the High School at this time. It was announced that Tracy Klefbeck is currently the initial point of contact for matters that would typically go to the Executive Principal.

Gary McAfee noted that these events have held us all hostage. He noted that we have elected the BOE and we need to be patient and let the BOE do what they have to in a legal manner. While all are impatient and want details, some of which we may get and some which we may not, we need to let the Board see the process through and support them.

INSTRUCTION

CURRICULUM

Instruction for English Language Learners

The Board of Education recognizes its responsibility to ensure that students of foreign birth or ancestry, who are identified as English Language Learners (ELL), are provided with an appropriate bilingual education or English as a New Language (ENL) program.

The District has developed a comprehensive plan to meet the educational needs of ELLs. The plan will be kept on file in the District and submitted to the Commissioner of Education prior to the start of each school year. The plan includes:

1. The District's philosophy for the education of ELL students; 2. The District's administrative practices and procedures to screen, identify, and place ELLs in appropriate programs;

3. The District's plan to provide parents and other persons in parental relation with information about ENL programs available in the District and notices regarding program placement and the rights of parents or persons in parental relation in a language they best understand;

4. The District's system to annually measure and track the academic progress and English language proficiency of ELLs and use of data to drive instruction;

5. A description of the District's curricular and extracurricular services provided toELLs; 6. The District's administrative practices to annually evaluate ELLs; 7. The District's procedure to identify support services for ELLs; 8. The District's policies and procedures regarding ELLs who are students withdisabilities; 9. The District's procedures to exit ELLs including those students with inconsistent/interrupted formal education;

10. The District's services to support former ELLs.

The District, therefore, will ensure access of ELL students to an English as a New Language program, as well as other instructional and support services, including guidance programs. Moreover, they should have equal opportunity to participate in all school programs and extracurricular activities as non-ELL students.

Additionally, the District will provide professional development to all teachers, level III teaching assistants, and administrators that specifically addresses the needs of ELLs.

The Superintendent shall ensure that all data required by the Commissioner's Regulations is submitted to the State Education Department in a timely manner.

INSTRUCTION CURRICULUM

Instruction for English Language Learners

The District will ensure that English Language Learners (ELLs) receive an appropriate education consistent with state law and regulations, and that all ELLs have access to appropriate instructional and support services, including guidance programs, and equal opportunities to participate in all school programs and extracurricular activities.

Identification In accordance with Parts 117 and 154 of the Commissioner's regulations, the District will diagnostically screen every new entrant and reentrant with no available record of prior screening to determine whether the student is an ELL. The screening includes the administration of a home language questionnaire and, if necessary, an individual interview with the student in English and the home language. However, in no event will the District request or require, prior to enrollment or registration, any documentation and/or information regarding or tending to reveal the immigration status of a child, a child's parent(s), or the person(s) in parental relation.

The home language questionnaire and the individual interview will be administered by qualified personnel. "Qualified personnel" means:

1. A bilingual or English to speakers of other languages teacher, who possesses appropriate certification, who is fluent in the home language of the student and parent(s) or person(s) in parental relation, or who uses a qualified interpreter/translator of the language or mode of communication the student or parent or person in parental relation best understands; or

2. A teacher who possesses appropriate certification, and has been trained in cultural competency, language development and the needs of English language learners, and who is proficient in the home language of the student or parent(s) or person(s) in parental relation, or who uses a qualified interpreter/translator of the language or mode of communication the student or parent(s) or person(s) in parental relation best understands.

Identification Review Upon receipt of a written request, the District will initiate and carry out a review of the identification determination within the timeframes set forth in the Commissioner's regulations. The principal and the Superintendent or his/her designee will determine whether an ELL's designation should change based on consultation with the parent(s) or person(s) in parental relation and appropriate District personnel as well as the review of relevant documentation.

ELLs with Disabilities Students who may be ELLs, and who have been identified as having a disability, will be referred to the Language Proficiency Team (LPT) to determine whether there is evidence that such students may have second language acquisition needs and whether such students must take the initial English language proficiency identification assessment. The recommendation of the LPT is subject to review by the school principal and the Superintendent or his/her

In the event such students are identified as ELLs, the Committee on Special Education (CSE) will determine, in accordance with the students' individualized education plan (IEP), whether the students will take the assessment with or without testing accommodations or an alternate assessment, as may be prescribed by the Commissioner.

For ELLs who are suspected of having a disability, but not yet identified as having a disability, the District will follow its existing CSE referral process, consistent with Commissioner's regulations.

Assurances Prior to the start of each school year, the District will submit to the Commissioner the following assurances, signed by the Superintendent or his/her designee, and in a form and by a date specified by the Commissioner:

1. ELLs have access to appropriate instructional and support services, including guidance programs;

2. Each ELL has equal opportunities to participate in all school programs and extracurricular activities as non-ELLs;

3. ELLs are offered bilingual education and/or English as a new language (ENL)programs; 4. The District provides the requisite number of bilingual education programs pursuant to Commissioner's regulations, or has received a one-year exemption, pursuant to Commissioner's regulations, and is actively recruiting staff for suchprograms;

5. Parent(s) or other person(s) in parental relation of ELLs receive orientation and notification about program types;

6. ELLs are given the requisite amount of ENL and home language instruction; 7. Teachers in the District's bilingual education and ENL programs are appropriately certified;

8. Teachers of ELLs receive the requisite amount of in-service professionaldevelopment; 9. The District will comply with the requirements of Commissioner's regulations and provisions of the Education Law governing programs for ELLstudents;

10. The programs for ELL students will be administered in accordance with applicable federal and state law and regulations and the District's comprehensiveplan.

ReportsThe District will annually submit to the Commissioner a data and information report in such form(s), and within such timeline(s), as prescribed by the Commissioner. The report must include the following:

1. A summary of the number of ELLs in the District, separated by grade level, home language, and by program type;

2. A report by building of the number of ELLs identified in the preceding school year, by grade level, home language, and instructional program;

3. A report by building of the number of ELLs, if any, who have not received either bilingual education or ENL instruction, and the reason such students did not receive such instruction as required by Commissioner's regulations;

4. A summary of the number of students with inconsistent/interrupted formal education, ELLs with disabilities, newcomer ELLs, developing ELLs, long-term ELLs, and former ELLs by grade level, home language, and instructionalprogram;

5. A summary of annual English language proficiency assessment, English language arts, and mathematics outcomes by subpopulation (students with inconsistent/interrupted formal education, ELLs with disabilities, newcomer ELLs, developing ELLs, long-term ELLs, and former ELLs) by grade level;

6. A summary of the number and qualifications of teachers and support personnel providing services to ELLs;

7. The expenditure of state, local, and federal funds in the prior year on programs and services for ELLs; and

8. A summary of all students for whom the District has made a request for extension of services.

ELL Instruction Bilingual Education Program The District will establish a sufficient number of bilingual education programs should the annual estimate of enrollment of ELLs indicate that twenty (20) or more ELLs with the same home language at the same grade level will be enrolled in the District. Such programs will be composed of:

1. A language arts instruction component, including home language arts and English language arts;

2. An ENL component; and 3. A bilingual content area instructional component.

English as a New Language Instruction In the event that the District does not offer a bilingual education program, or the parent(s) or person(s) in parental relation opts out of a bilingual education program, such student will be placed in an ENL program. Such program will be composed of:

1. A content area instructional component in English (including all core content, i.e., English language arts, math, science, or social studies) with home language supports and appropriate scaffolds; and

2. An English language development component (stand-alone and/or integratedENL).

The District reserves the right to contract with a Board of Cooperative Educational Services (BOCES) or another school district to provide bilingual education and/or ENL services and/or programs.

Parental Notification The District will distribute to the parent(s) or other person(s) in parental relation to ELL students, school-related information in English and the language or mode of communication they best understand.

1. For new school entrants designated as ELL, the parent(s) or person(s) in parental relation will be provided a high quality orientation session on the state standards, assessments, and school expectations, as well as the program goals and requirements for bilingual education and ENL programs. This orientation will take place prior to a student's enrollment in a program provided that a student will not be withheld from timely program placement if a parent or person in parental relation does not attend an orientation session. The orientation will also be

provided in the language or mode of communication that the student's parent(s) or person(s) in parental relation best understands. The District will maintain records of signed notices of parents and persons in parental relation that indicate program selection and orientation session agendas and sign-in sheets for such orientations. Such notices will be included in the student's cumulative record.

2. After the orientation, the parent(s) or person(s) in parental relation of a student designated as an ELL will be notified, in English and the language or mode of communication the parent or person in parental relation best understands, that, where available, bilingual education will be the default program. The notice will alsoindicate:

a. The goals and purpose of bilingual education and ENL programs available in the District;

b. The parent(s) or person(s) in parental relation may direct that his or her child be placed in an ENL program instead of a bilingual education program;

c. The student will receive all required core content in all programs offered, and the student's participation in a bilingual education or ENL program will not preclude the student from accessing extracurricular activities offered by theDistrict;

d. If a school within the District is not required to provide a bilingual education program, parent(s) or person(s) in parental relation have the option of transferring their child to a school within the District if such program isavailable at another school;

e. In a school where the number of eligible students required that a bilingual education program be provided, but the school has been granted an exemption, the notice will also explain how the school will offer to support home language and provide a summary of its plans for instituting a bilingual education program the following school year.

3. After the parent(s) or person(s) in parental relation receives notification, the District will provide the parent(s) or person(s) in parental relation ten (10) school days to sign and return a statement to the District indicating that they are either in agreement with the child being placed in a bilingual education program or directs the District to place the child in an ENL program. If the parent(s) or person(s) in parental relation does not return the signed notification form within ten (10) school days of receiving notice, the student will be placed in a bilingual education program if available in his/her school or in an ENL program if the school is not required to provide a bilingual educationprogram.

4. If a student is placed in an ENL program, either because the parent(s) or person(s) in parental relation requested such placement or because the parent(s) or person(s) in parental relation did not make a choice regarding placement, the parent(s) and person(s) in parental relation will be notified in a language or mode of communication they best understand, that they retain the right to transfer their child to a bilingual education program and that transportation will be provided in accordance with Education Law Section 3635 and District policy.

5. Appropriate District personnel will individually meet at least once a year with the parent(s) or person(s) in parental relation of ELLs, in addition to parent-teacher conferences, quarterly progress meetings, or other such scheduled meetings, to help them understand the goals of the program, their child's language development progress, their child's English language proficiency assessment results, and language development needs in all content areas. This meeting will include all schoolstaff

necessary to sufficiently inform the parent(s) or person(s) in parental relation about the child's language development in all content areas in English and in the child's home language in the case of students enrolled in a bilingual education program. This meeting will also be conducted with a qualified interpreter/translator in the language or mode of communication the parent(s) or person(s) in parental relation best understands.

Support ServicesThe District will provide appropriate support services for ELLs who fail to meet specified levels of performance on the annual English language proficiency assessment. Such services will take into consideration those factors specified in Commissioner's regulations and will be aligned with any intervention plans the District is already providing to all students.

Transitional Services For at least two (2) school years following the school year in which a student is exited from ELL status, such student will receive at least one half of one unit of study or its equivalent of integrated ENL or such other services that monitor and support their language development and academic progress, as approved by the Commissioner.

Professional DevelopmentThe District will provide professional development to all teachers, level III teaching assistants, and administrators, which specifically addresses the needs of ELLs in accordance with relevant provisions of the Commissioner's regulations. The following professional development is required for District personnel:

1. All teachers and administrators: A minimum of fifteen percent (15%) of the required professional development clock hours will be dedicated to language acquisition, including a focus on best practices for co-teaching strategies and integratinglanguage and content instruction for ELLs;

2. Level III teaching assistants: A minimum of fifteen percent (15%) of the required professional development clock hours will be dedicated to language acquisition and content instruction for ELLs; and

3. All bilingual and English to speakers of other languages (ESOL) certified teachers: A minimum of fifty percent (50%) of the required professional development clock hours will be dedicated to language acquisition in alignment with core content instruction, including a focus on best practices for co-teaching strategies and integrating language and content instruction for ELLs.

The District may annually seek permission from the Commissioner for an exemption of the professional development requirements where there are fewer than thirty (30) ELLs enrolled or ELLs make up less than five percent (5%) of the District's total student population as of such date as established by the Commissioner.

Credential Options for Students with Disabilities

The District will provide students with disabilities appropriate opportunities to earn a diploma or other exiting commencement credential in accordance with Commissioner's regulations. During the student's annual review, the District will evaluate graduation opportunities and identify the means to achieve them. As part of this process, the District:

1. Will coordinate activities with guidance personnel and BOCES staff to ensure that students meet credit and sequence requirements and to consider them for vocational opportunities.

2. May modify instructional techniques and materials. Any modifications will be included on a student's Individual Education Plan (IEP) so that they can be implemented consistently throughout the student's program.

3. Will review special education instructional programs to ensure equivalency with the same courses taught in the general education program.

4. Will coordinate communication between special and general education staff so that all staff members understand required skills and competencies, and to establish equivalency of instruction in special education classes.

Graduation and transition plans will take into account the various pathways available to these students. For students with IEPs, the District will plan transition services for post-secondary life as early as possible, but no later than the school year in which the student turns age 15. The transition activities will be focused on improving both the student's academic and functional achievement. The plan will explore post-secondary opportunities and employment options and, if applicable, connection with adult service agencies that may provide the student with services after exiting school.

The District may award these diplomas or credentials, or both: 1. Local diploma: available to students with an IEP or a Section 504 accommodation plan that specifies a local diploma. Students must comply with credit requirements. The available assessments to earn a local diploma include:

a. Low-pass safety net option: students must achieve a score of 55 or higher on five required Regents exams.

b. Low-pass safety net and appeal: available to students who score 52-54 on up to two Regents exams, successfully appeal those scores, and meet other applicable conditions.

c. Compensatory safety net option: except for scores on ELA and math exams, students may use one Regents exam score of 65 or above to compensate for a Regents exam score of 45-54. Students must score at least 55 (or successfully appeal a score of 52-54) on both the ELA and a math exam.

d. Superintendent's determination: students who are unable to demonstrate their proficiency on standard state assessments because of one or moredisabilities

may be able to graduate upon the Superintendent's review and written certification of their eligibility. The Superintendent will make a determination after receiving a written request from an eligible student's parent or guardian. (Students with a Section 504 accommodation plan may not use this option.)

2. Career Development and Occupational Studies commencement credential (CDOS): any student who is not assessed using the New York State Alternate Assessment (NYSAA) may earn the CDOS commencement credential as a supplement to a Regents or local diploma or as his or her only exiting credential if the student attended school for at least 12 years, excluding kindergarten. The student must meet criteria specified by the State Education Department confirming that he or she has attained the standards-based knowledge, skills, and abilities necessary for entry-level employment.

3. Skills and Achievement (SA) commencement credential: students with severe disabilities who are assessed using the NYSAA may earn the SA commencement credential. They must attend school for at least 12 years, excluding kindergarten. The District must document the student's skills, strengths, and levels of independence in academic, career development, and foundation skills needed for post-secondarylife.

Graduation The District allows any student with a disability to participate in the graduation ceremony of his or her high school graduating class and all related graduation activities if the student:

1. Met the eligibility criteria for an SA or CDOS commencement credential; 2. Has not otherwise qualified to receive a Regents or local diploma;and 3. Has an IEP that prescribes special education, transition planning, transition services, or related services beyond the student's four academic years after entering highschool.

The Superintendent will consider any recommendation of the student's Committee on Special Education as well as the student's own expressed preference regarding participation; a student with a disability may decline to participate in any or all graduation-related activities. The District will provide annual written notice of this policy to applicable students and their parents or guardians.
