•The use of Impact assessment in the work of Market Surveillance Authorities (MSA) could be a logical to:
EMC products domain is very large too large to be able to follow all EMC market penetration in detail and to act against
Therefore it is recommended to make proper choices and to set priorities

Risk assessment is a “discipline” that can help define decision problems more clearly
The method of Risk Assessment:
Is worked out and practiced by the Radiocommunications Agency
Agreed in ADCO/R&TTE and EMC/ADCO for EU cross border campaigns
Recommended for national Market surveillance activities
in The Netherlands

2. Define the probability that this risk will occur (‘Chance’)

Severity of consequence of violation (S)
• radio interference as a consequence of non-compliance with the regulations. This might be interference within or outside the radiofrequencies or interference on product.
• Financial/economic severity of non-compliance (has the offender derived an advantage from violation of the regulations?
• Any social impact of non-compliance (for example a sense of insecurity regarding confidentiality of communications)
• Physical and health/safety consequences of non-compliance (accidents due to interference in radio communications and electromagnetic radiation exposure)
• Non-compliance affecting the image of the MSA that have a surveillance role or are responsible for regulation, respectively (negative publicity, political risks etc.)

Probability of risk of violation (C)
A) Spontaneous compliance dimension
• refers to elements of social control or when the product has been well designed so that there are no incentives to violate the rules (cost effective or from a market behavior point of view).
B) The ‘enforcement dimension’
• appeals to the probability of violation after certain enforcement activities have been carried out. Here important elements like risk of detection or sanction and the severity of the sanction play arole in determining that probability

Conclusions
Impact assessment can be a good tool for determining an risk product for national activities and/or cross border MS campaign
.
A Pragmatic Impact Assessment is the Risk analyses
» Easy to use by experts in the field (enforcement en surveillance)
It has also the advantage that it yields an overview of all EMC products and possible activities and their effects on the equipment market and society.
This “risk assessment” method is recommended as a standard procedure to determine the regular national activities of each national organisation.
