Many of us have friends, relativesand acquaintances who may be in fi-nancial difficulty and the thought offoreclosure is looming. The shortsale is one answer to foreclosure andis preferable to it because it lessensthe damaging impact of foreclosureon the surrounding community and itwon’t damage the distressed owner’scredit as much as foreclosure. If thehomeowner is still current with otherpayments, the short sale may lowerthe credit score by as little as 50points, where a foreclosure can lower the creditscore by 200 points or more and remain as publicrecord on the credit history for 7 years. Addition-ally, a short sale may be reported by the lender aspaid in full-paid as agreed, paid-settled, or paid-un-rated. A short sale is by definition a “situation where the
seller owes more money on the loan (and otherliens on the property) than the sale of the propertywill likely produce on the market, and is unable orunwilling to bring money to closing. In a short sale,the lender has not yet foreclosed on the property,which provides a window of opportunity for theowner to sell the property in order to at least par-tially satisfy the amount owed to the lender.” If a
short sale is the best option for thehomeowner, their real estate profes-sional must be thorough in qualifying theseller for a short sale. Not every owneris a short sale candidate and not everyowner can be saved from foreclosurebut many can be! The seller must beable to confirm valid hardship, deter-mine with lender if there is sufficient timeto complete a short sale, contract withappropriate tax, finance and legal pro-fessionals, determine the amount owedon the property, and must be coopera-
tive with the agent in completing short-sale docu-mentation and maintaining the property forshowings. Most hardships are caused by job loss,business failure, illnesses, divorce or death of aspouse and natural disasters. Although not a happy time for a seller, there are
possible options when hardships occur, and shortsales are one of several options. Please talk withyour real estate professional about these optionsand avoid foreclosure if possible. Many agentshave earned the “Short Sales and Foreclosure” cer-tification, SFR, and will be knowledgeable in thisarea.
