Dear Ms. Blackburn: The Shockey P3, LLC team is excited to have the opportunity to work with Montgomery County Public Schools. As an early and frequent proponent of PPEA, Shockey has already built a substantial list of satisfied public partners while working under PPEA, with ten projects successfully completed. Our vision as an innovative leader in PPEA procurement, combined with our knowledge of the local K12 market and our strong, cost-conscious team, makes Shockey a perfect choice for your project. You will note that our focus, during the conceptual phase of this procurement, has been upon designing and constructing extraordinarily economical facilities that provide functional educational spaces which encourage excellence. We have not proposed schemes, property trades, or financing arrangements that obscure the true cost of these facilities. While we have long-standing arrangements with financiers and developers (and, in fact, we have substantial developmental holdings of our own), our conversations with local citizens lead us to believe that these “add-ons” (if desired at all) are best addressed during the detailed-phase procurement. Indeed, our team has not seen a united desire for the private financing of these schools within the community. Instead, we have seen an overwhelming desire to find a way to design and build quality facilities quickly and in line with the academic calendar, while placing the least economic burden on the citizens of Montgomery County (and while being fair to the students in each educational strand). I hope that you will review our proposal with these thoughts in mind. Our team brings much more to the table than Shockey’s PPEA experience:

• Shockey is a long-standing Virginia firm, committed to the growth and success of Montgomery County. We have been in business continually since 1896.

• Shockey and its design partner, Crabtree Rohrbaugh & Associates (CRA), each

bring vast experience with K12 projects of similar size and scope.

Section 1 Qualifications and Experience

Management Approach Shockey P3, LLC will provide the oversight and project management required to successfully complete the projects, with each project being governed by its own CPM schedule. These schedules will take into account the required line-item completion dates as well as all design, planning and construction required to meet them. Preliminary schedules are included in Section 2 of our proposal, which can be found in Volume II. Management Team Shockey P3, LLC. – contractual entity, primary point of contact and team leader. On behalf of the team, Jeff Boehm will execute the comprehensive agreement. • Howard Shockey & Sons, Inc. (Shockey) - prime general contractor. Virginia Class A

services for the project. Individuals in this firm are licensed to practice architecture in Virginia.

• Draper Aden Associates - civil engineering services. Individuals in this firm are licensed to practice engineering in Virginia.

• CenterPoint Engineering - mechanical, electrical, and plumbing engineer. Individuals in this firm are licensed to practice in Virginia.

• Martin/Alexiou/Bryson, PC – transportation/traffic engineering subconsultant to DAA. Individuals in this firm are licensed to practice in Virginia.

• Williams Mullen, A Professional Corporation - legal services. Team members are licensed to practice law in Virginia.

Team Members Roles and Responsibilities and Anticipated Portion of Work Shockey P3, LLC will assign the design-build contracts for the projects to Howard Shockey & Sons, Inc. (the 78th-largest design-builder in the United States, according to ENR). Howard Shockey & Sons, Inc. will assign Bill Thomas and Steve Knight, both experienced design-build and high school project managers, to the project. These project managers will have full authority and control to complete the design-build projects. Shockey P3, LLC (through Howard Shockey & Sons, Inc.) will be the corporate point of contact for Montgomery County School Board (MCPS) personnel. Proven policies and procedures will be enforced throughout all phases of the MCPS contract to ensure consistent management in all segments of the program. Support services provided will include accounting, quality control, safety, program management, cost control, and contract administration. Howard Shockey & Sons has proven design-build procedures that have been refined over a period of 115 years, ensuring successful completion of a new Auburn High School and a new Blacksburg High School, as well as the design and renovation of the existing Auburn High School into a new Auburn Middle School.

Section 1 Qualifications and Experience

Shockey and Crabtree Rohrbaugh & Associates (CRA) are currently working together to design and build Clarke County’s new high school. CRA design manager, Joshua Bower, working in conjunction with Howard Shockey & Sons’ project managers and the design subconsultants will analyze the design task and enhance the preliminary design to achieve the most cost effective, technically sound approach for the project, using resources from our A/E subcontractors. CRA’s design manager will work closely with its project managers to ensure that all deliverables are provided on time and conform to the project requirements and to all quality assurance/quality control procedures. CRA is providing A/E design support for the MCPS contract and will include construction administration, conceptual design, detailed construction documents, and programming/budget support as requested by Shockey P3 and MCPS. CRA has professional architects registered in the Commonwealth of Virginia and is a well-known designer of K12 facilities. Draper Aden Associates (DAA) will be the civil engineer for the project. Draper Aden has an excellent working relationship with MCPS, with offices located in Blacksburg. Joshua Bower (CRA’s project manager) will work closely with CenterPoint Engineering to provide quality design and progressive solutions for the mechanical, electrical and plumbing systems needs. Williams Mullen will provide comprehensive legal services for the project. Williams Mullen has 300 attorneys and offices throughout Virginia, North Carolina, Washington, D.C. and London. Should MCPS desire to seek private funding of the projects (which we do not think is the case), Shockey P3, LLC maintains relationships with financiers of commercial properties throughout the Commonwealth of Virginia. These firms have the capital market experience to design creative, innovative, and flexible financial structures to meet the capital improvement needs for MCPS, while carefully working within the confines of MCPS’ existing debt curves.

b. Describe the experience of the firm or consortium of firms making the

proposal and the key principals involved in the proposed project including experience with projects of comparable size and complexity. Describe the length of time in business, business experience, public sector experience and other engagements of the firm or consortium of firms. Include the identity of any firms that will provide design, construction and completion guarantees and warranties and a description of such guarantees and warranties.

Shockey P3, LLC Shockey P3, LLC is the entity submitting this proposal, and will be the team leader for the consortium and primary point of contact for the School Board. Shockey P3, LLC and its member company, Howard Shockey & Sons, Inc., have successfully delivered 10 PPEA projects in Virginia (including numerous K12 school facilities). Howard Shockey & Sons, Inc. (HSS) A leader in the construction industry, with headquarters in Winchester for more than 115 years, Shockey provides design-build, general contracting, at-risk construction management, public-private partnership, agency construction management, preconstruction and turnkey development services. Shockey serves the Commonwealth of Virginia with considerable presence in the Shenandoah Valley and the New River Valley. Shockey maintains an excellent safety record, with an Experience Modification Rating for the past three years ranging from .79 to .88. Shockey’s well-established safety program and focus on accident prevention contribute toward maintaining a safe and healthy environment for all employees, project personnel and any members of the general public affected by its construction projects. Shockey’s record of performance is equally strong. The firm’s current projects range in size from $1 million to $80 million and the firm has a bonding limit of $300 million. Shockey has successfully completed, Skyline High School and East Warren County High School (PPEA), Tuscarora High School, East Rockingham County High School, John Handley High School Renovation and Addition, Western Virginia Regional Jail (PPEA), Roanoke Police Academy (PPEA),Community Center for City of Manassas Park (PPEA), Frederick County 12th Elementary School (PPEA), Winchester Parking Structure No. 4 (PPEA), Botetourt-Craig Public Safety Facility and Regional Jail, Northwestern Adult Detention Center – Pod 3 (PPEA), Northwestern Adult Detention Center – Community Corrections Center (PPEA), and Frederick County Public Safety Building (PPEA). In the past 10 years alone, Shockey has successfully completed the construction of 19 K12 facilities in Virginia. Shockey has been a leader in developing public-private partnerships in the Commonwealth. Shockey’s Vice President, Jeff Boehm, has been appointed to the Virginia Legislature’s PPEA Model Guidelines Task Force.

designed by its MCPS partner, Crabtree, Rohrbaugh & Associates. Clarke County’s new high school will include classrooms, science labs, business labs, art rooms, technology labs, an agriculture lab, an auditorium, a full library, a media center and a gymnasium with a collegiate basketball court.

Project No. 2 Project: Tuscarora High School Leesburg, VA Description: Shockey has a proven track

record for delivering K12 facilities, on-time and on-budget. Shockey recently completed the record-setting Tuscarora High School in Loudoun County – a 280,000 square foot facility completed in only 17 months.

Tuscarora High School is a two-story, 280,000 square-foot high school, located on a 135-acre site in Leesburg, VA. It combines structural steel and CMU with an EPDM roof system. The MEP system consisted of boilers, chillers, cooling tower and a four pipe heating and cooling system with roof top unit VAV boxes, various heat pumps and DDC control package. The school has tennis courts, a synthetic turf football field, soccer, baseball and softball fields and classroom space for 1,800 students.

This project received an Environmental Preservation Award by the Loudoun County Department of Building and Development for its environmental impact mitigation work, much of which is focused on Tuscarora Creek (which cuts across the site).

Project No. 3 Project: Greenwood Mill Elementary School (PPEA) Winchester, VA Description: The single-story, 100,465 square foot facility – located in the center of

residential neighborhoods – allows 750 students to learn in a cutting-edge environment.

The school includes K-5 classrooms, multi-purpose space, activities rooms, lab space and a 400-seat gymnasium. Frederick County’s Parks and Recreation Department utilizes space within the school, which sits on a 15.8 acre site.

Frederick County selected Shockey through the PPEA process. Shockey’s proposal was selected “because it offered the best value in consideration of the evaluation criteria”.

school consisting of structural steel, metal stud and brick veneer structure. East Warren County High School was based upon the redevelopment of an existing middle school -- transforming it into a new 203,755 SF high school, consisting of structural steel, metal stud and brick veneer structure.

Project No. 5 Project: John Handley High School Winchester, VA Description: Howard Shockey & Sons, Inc. was the construction manager for this

311,000 square-foot renovation and addition project. The project included the restoration and renovation of the original 1920’s building. The 11,000 SF John Handley High School (JHHS) consisted of approximately 230,000 SF of renovation and a 40,000 SF addition. As a state of the art educational facility, JHHS is equipped with fully functional science and geology labs, technologically advanced classrooms, and two full service cafeterias. The quality of the finishes at JHHS is on par with many higher education institutions. These included materials such as plaster walls and ceilings, three piece wood moldings, frameless glass, and custom milled windows and doors. Architecturally, Shockey fabricated and installed custom plaster moldings, barrel-vaulted ceilings, groin-vaulted ceilings and many other intricate architectural details (both of a modern and classical genre). Sustainability and environmental stewardship were important points in the development of JHHS. Although JHHS did not procure third party program evaluations, the project included conscious efforts toward active waste management, complete commissioning of all MEP systems, daylight harvesting, and other life cycle/ energy efficiency payback analyses during the course of design. JHHS remained occupied by 1,400 students and staff members during the course of the renovation and expansion. The Shockey team was responsible for direct planning with school staff to coordinate the success of the project with zero tolerance for risking the safety of the student body and staff. JHHS is an endowed institution and is also listed on the state historical register. During the course of the renovation, Shockey coordinated all design efforts through a process of approvals with a high school management staff, a city school board,

a board of directors for the trust that oversees the property, and a the Virginia historical review board. Of course, Shockey also had to communicate with the general public.

Crabtree, Rohrbaugh & Associates full design services for the new state-of-the-art Clarke County High School. The organizational strategy of the fl oor plan generates from a wide linear student commons or “main street”, infused with an abundance of natural daylight. The main street bisects the building fl oor plan organizing the major assembly areas of the building together and separating and zoning the educational classroom instruction areas for a dynamic and functional solution.

Crabtree, Rohrbaugh & Associates' recommendations to the Richmond Public Schools will provide solutions to current ADA and code related issues affecting current travel within the building.

Crabtree, Rohrbaugh & Associates assessed the existing building at Richmond Community High School. Richmond Area School Division's main purpose of the study was to make the high school buildings vertically and horizontally handicap accessible on all floor levels. Crabtree, Rohrbaugh & Associates has identified several important factors to consider in making a design solution recommendation which is most feasible for the existing conditions and project requirements. Crabtree, Rohrbaugh & Associates has explored alternative design solutions and will make recommendations based upon Richmond Community High Schools need for ADA accessibility.

Our design solutions will minimize adverse impacts on work schedule and cost control.

Crabtree, Rohrbaugh & Associates recommended an addition be designed to reflect the fine qualities of the existing traditionally styled buildings. The Patterson Avenue elevation includes modular brick work, window treatments and fenestration similar to both buildings. The rear elevation includes a modular brick finished stair tower and large glazed openings to allow a refreshing view of the outdoors as student move between the two buildings. Interior finishes, materials, mechanical and lighting systems will need to provide the qualities of desirable life cycle value, ease of maintenance, energy efficiency, ready availability and quick or easy installation.

•• We created an aesthetically pleasing new entrance vestibule which provided for a secure main entrance, while also being distinguishable from the outside as an architectural element and main entrance.

Crabtree, Rohrbaugh & Associates performed additions and renovations to the high school, creating a new entrance and student dining courtyard, and reorganizing and expanding administration and guidance offices. The existing library was a vertical, hard to supervise two-story space. The firm installed a floor structure and took classrooms from the first floor

DONEGAL HIGH SCHOOL

Crabtree, Rohrbaugh & Associates were charged with designing an extremely cost-effective high school. They accomplished this challenge while at the same time providing a building designed to stand the test of time both in appearance as well as function.

Crabtree, Rohrbaugh & Associates conducted a District Wide Facility Study for Donegal School District to evaluate conditions at several schools. At the conclusion of the study, it was proposed to build a new high school to replace the current building.

The New Donegal High School will be a state of the art facility that will address the program, educational and technology needs of the students of Donegal School District. The two story building will be home to approximately 1200 students and provide unique programs such as photography, visual communications and CADD and Engineering technology.

The new school will include a state of the art auditorium that is surrounded with band, music and choral rooms. The gymnasium is supported by an auxiliary gym and weight room. Also included is a media center which will provide small classroom instruction and conference and meeting rooms.

Donegal High School is projected to receive Green Globes 1 certification. This was achieved by increased roof and wall insulation, including high efficiency HVAC systems, windows and doors. All classrooms are daylighted and contain automated systems for lighting control.

Recognized for design excellence by American School and University Education Interiors Showcase, the new high school provided the school district with a state-of-the-art learning facility at the lowest cost per square foot of any school built in 2002.

The new Catasauqua High School houses 600 students, grades 9-12, and includes state-of-the-art classrooms, auditoriu m, compet ition gymnasium , auxiliary gymnasium, wrestling room and weight room. The design is based on radial geometry. The focal point of the school is the centered common space that houses the cafeteria, meeting area, and access to

auditorium and gymnasium. This space is a sky-lit two story open space with raised walkways on the perimeter. Catasauqua was the lowest cost school built in the state 2002 Pennsylvania Department of Education Record 30. The Dallas High School is the center of the community and is set to accommodate a variety of after hours community functions. In addition, the state of the art school will be environmentally responsible.

Dallas High School will be located on the existing 100 acre campus. It will hold 1200 students and will be designed for future expansion. A student commons shall be a key component of the design which will serve as a Community Area for the School both during and after school hours for public events.

The School is the center of the Community and as such must be designed to accommodate a variety of after hours community functions both within the facility and on site. Technology will be integrated throughout the facility to support the educational program. Classrooms shall be designed for a maximum of 25 students. The Midd-West High School was designed to meet U.S. Green Building Council LEED Gold rating to maximize the school district's long term capital investment while maintaining a cost effective budget and durable building materials.

Over a 30 Year Life Span of the Building it is anticipated that the sustainable design components will save approximately $3,500,000 in utility costs. At the same time, the cost of construction for the facility is substantially lower than the current state average for school construction.

The building was designed to reduce average yearly energy consumption by 35.8% through the use increased building insulation, high performance windows and a water source heat pump mechanical system.

The unique butterfly roof was designed to maximize daylighting into the core of the facility while at the same time creating a unique identity for the facility. The use of acoustical clouds, perforated metal deck and sound absorbing materials throughout assembly spaces and large group instruction areas help to generate proper sound levels whether one is listening to an orchestra performance or eating in a active school cafeteria.

The site has been completely redeveloped to separate bus, vehicular and pedestrian traffic and encourage a campus site resulting in interaction between the districts three building on site.

Along with these principles of "green" design the Glass was used to maximize daylighting and views building's use of color, extremes in scale and throughout the building and blur the line between exposed structures, Midd-West High School fosters exterior and interior space while automated creativity, openness and connection throughout dimming systems, roof overhangs, light shelves, the school. MONTGOMERY COUNTY PUBLIC SCHOOLS, MONTGOMERY COUNTY, VIRGINIA Freezer Pad for Margaret Beeks Elementary School: Draper Aden Associates provided topographic survey, base map preparation and preparation of a building permit plan for the installation of a freezer and relocation of a dumpster on the south side of Margaret Beeks Elementary School.

TUCKAHOE ELEMENTARY SCHOOL ADDITION Henrico County, Virginia

Draper Aden Associates provided surveying, SUE, site planning and engineering and construction phase services for an approximately 7,600 SF, 6-classroom addition to the existing school. The one-level addition is situated to the south ofthe existing facility and will replace four temporary trailers. The project will also construct an I8-space parking lot plus 3 additional ADA spaces to bring the overall site into zoning compliance based upon total number of classrooms. Additionally, Draper Aden is currently providing feasibIlity studies for potential addition of restroom facilities within an existing modular unit, drainage studies for potential installation of storm sewer inlets and piping to remediate an existing drainage problem, and overall evaluation of the existing ball field to determine whether surface improvement or a more detailed reconstruction of the field is warranted.

COLLEGIATE SCHOOLS Richmond, Virginia

Master Planning: Draper Aden Associates provided assistance with site-related issues, with a special focus on drainage and wetlands issues, during master planning for this 20-acre private school serving kindergarten through high school.

Lower School Improvements: Draper Aden Associates prepared site plans and provided civil engineering services for renovation and additions to the lower school complex.

North Science Building: Draper Aden Associates prepared site plans, including utilities, grading and drainage designs, for a new 23 ,500 SF, two-story building with classrooms, wet and dry labs, offices and associated greenhouse.

South Science Building: Renovation of this building involved demolition of a portion of a 9,118 SF building and 12,000 SF of additional space, including a second story. Scope of services included utility improvements and additional storm drainage.

Flood Plain Analysis: Draper Aden Associates completed a flood plain analysis of Georges Branch and its tributaries as they travel through and near the Collegiate School property. The purpose of the study was to determine the water surface elevations generated by 2-year, 10-year, 50-year and 100-year storm events and to assess the impacts the water surface elevations would have on School property and adjacent properties.

Wetlands Permitting: Draper Aden Associates prepared a Nationwide 12 Wetlands Permit to enable a new sanitary sewer line to cross Georges Branch.

NORTH CROSS SCHOOL Roanoke, Virginia

Working with the project architect, Draper Aden Associates provided schematic level cost estimates; master plan update; and geotechnical evaluation for a new school. The scope of work also included a topographic survey of the North Cross School campus to provide location information for completion of an updated Master Plan incorporating expansions of the Middle School and Gymnasium Buildings for overall campus planning.

SAINT CHRISTOPHER'S SCHOOL Richmond, Virginia

Athletic Master Plan: Draper Aden Associates provided topographic and boundary surveying for the lower school in support of the development of an Athletic Master Plan.

Capital Improvements Study: Under an annual contract agreement as a sub consultant to the project architect, Draper Aden Associates provided site-related evaluations of the facilities needs and deficiencies for Goochland County Schools. Todd Stadium: Draper Aden Associates completed site planning and engineering services including site plan drawings for a locker room building addition to the City of Newport News athletic stadium. Our services included coordination of submittal and approval of site plan review by the City's Department of Engineering, Site and Subdivision Office.

The services provided by Draper Aden Associates under this contract required a high level of coordination in order to meet project timetables. School year schedules, activities, and operations dictated that work be completed in a timely manner, designs were fast-tracked, and construction schedules were abbreviated.

ANDREW LEWIS MIDDLE SCHOOL Salem, Virginia

As a sub consultant to the project architect, Draper Aden Associates prepared site and utility engineering plans for major renovation and new construction additions to a central City middle school facility. Our services included investigation of underground utilities, records search of City utility and architectural plans for school, grading studies for compliance with ADA regulations, review of construction logistics for access to school which remained in operation during construction activities.

ELEMENTARY AND MIDDLE SCHOOL SITE SEARCH Pulaski County, Virginia

The objective of this preliminary engineering report was to provide Pulaski County, the Pulaski County School Board, and other interested parties with an evaluation of the development potential of five identified sites for the construction of a new SOO-student elementary/middle school. This report aided the governing boards in their decision­making process by providing a tool for comparing the multiple sites as regards utility infrastructure improvements and site preparation costs required to bring each site to a development-ready status.

The report summarized the available site information Draper Aden Associates gathered for the properties evaluated, as well as our opinion of the various probable costs associated with utility infrastructure improvements and mass grading costs. Separate report sections addressed in detail the various scenarios for providing water and sewer services to the sites.

WILLIAM MONROE HIGH SCHOOL ADDITIONS Greene County, Virginia

Addition: Draper Aden Associates, as part of an architect and engineering design team, provided surveying and site engineering for a 16,000 SF addition. Site engineering included grading, utilities relocations and storm water management.

In coordination with the client's architect, Draper Aden Associates provided conceptual design through construction documents for a I3-acre redevelopment of an abandoned hotel site into a new mixed-use development of multi-family and commercial uses. The construction documents included site demolition, erosion and sediment control and grading, utility, and landscaping plans to the Town of Blacksburg standards. As a member of Shockey's successful PPEA team, Draper Aden Associates provided site/civil, surveying, building structural engineering and geotechnical review services for the City of Roanoke's new Police Training Academy located near the Roanoke Regional Airport. Virginia Tech, Blacksburg, Virginia In conjunction with the University Architect and Athletic Department, Draper Aden Associates prepared the master plan for development of Virginia Tech's new soccer stadium and practice field complex. Comprised of the area between McComas Hall, the Fieldhouse and Lane Stadium, our schematic planning provided for one main NCAA regulation playing field, with two additional practice fields. The master plan included the development of grandstands, concession building, and a gated entrance facility/restroom complex to serve the stadium.

Detailed engineering plans were developed in phases for the main field construction, utility extensions to serve the stadium, and the initial building phase to include the stadium entrance and restroom facility. The construction of the main field was highlighted by installation of an advanced turf drainage system developed by Carolina Green, which will keep the field in playing condition even under significant rainfall

ROUNDABOUT STUDY AND DeSIGN Virginia Tech, Blacksburg, Virginia

Draper Aden Associates conducted an evaluation of a campus intersection (Washington Street and West Campus Drive) for alternatives to signalization. A one-lane roundabout was determined to be a feasible alternative. Our scope of services included planning, surveying and intersection design. Sidewalks, bicycle lanes, and landscaping, and utility relocation were critical design features of the project. The Roundabout project won the 2007 TOB Neighborhood or Block Enhancement Award (for special efforts, i.e. building improvements, rejuvenated or new landscapes, etc.) made to enhance the appearance of a neighborhood or block.

M/AIB is a Raleigh, NC-based consulting firm specializing in transportation planning and traffic engineering. Building on its reputation for providing cost-effective, sustainable solutions, the firm has grown to nearly 30 persons in ten years. This exceptional depth and breadth of staff experience has earned M/AIB the opportunity to participate in a variety of important and innovative projects. The firm has undertaken more than 500 projects for clients ranging from state departments of transportation, municipalities, cities, towns, metropolitan planning organizations and transit authorities, to developers, architects, public and private school systems, and multiple universities and colleges.

M/AIB is very skilled in the areas of traffic impact analyses, traffic assessments, transportation management plans, roadway design, signal design, and access management for schools (both public and private). The staff understands the importance of anticipating demands on the transportation network and mitigates any negative operational impacts of proposed developments. Using industry standard analysis techniques, M/AIB can determine the micro and macro level effects of travel patterns and can therefore identify appropriate mitigations. Each project is unique and combines several individualized transportation challenges. This typically involve accessibility, internal circulation, traffic congestion, traffic impacts, signal warrants, signal design, pedestrian safety, parking, transit, bicycle movement, financing, local and regional transportation issues.

A few examples of recent and current school projects:

Human and Agricultural Biosciences Building (HABB) Precinct Parking Study Virginia Tech. Blacksburg. VA

The Life Sciences District, and in particular, the HABB Precinct located west of Duck Pond Drive, will experience significant growth in the next 10 years. Nearly one million square feet of new buildings are expected to be built on the present Litton Reaves and Duck Pond Road parking lots, demolishing approximately 3,000 spaces, while creating a demand for nearly 2,000 new spaces. Two new parking facilities, a I,OOO-space surface lot and a 2,400-space parking deck, will be built within the HABB Precinct to absorb the new parking demand. As a result of new master planned building construction, the majority of the current parking spaces in the major western campus parking lots are going to be demolished and rebuilt with structures with a significant number of additional parking spaces, resulting in changes to the amount, location, and type of permits issued over the next 10 years. More importantly, the spaces being removed are largely residential storage parking and the new parking spaces are primarily high turnover employee and commuter student parking spaces. M/AIB conducted a study that determined the multimodal {pedestrian, bicycle, transit, and

impacts to Duck Pond Drive and recommended multimodal engineering, management, and planning changes to facilitate efficient and safe mobility in the study area before, during and after build out of the new construction.

Turner Street Development Traffic Impact Analysis Blacksburg. VA

MIAIB studied the traffic impacts of this mixed-use development, which includes over 150,000 square feet of office space, 40,000 square feet of retail space, and an SaO-space parking garage. Existing and short-term and long-term future traffic analyses were performed at twelve intersections surrounding the site. The MIAIB team also assisted with internal site circulation and determine mitigation measure to improve traffic flow as well as pedestrian safety through the area.

Traffic Engineering Services - Durham Public Schools Durham. North Carolina

Over the last eight years, Durham Public Schools (DPS) has contracted with MI AlB to provide traffic engineering services for several schools undergoing new construction and renovations for High School "A", Middle School "B", WG Pearson Elementary, Creekside Elementary, Hebron Elementary, and Jordan High School. The type of work performed for these schools has included Traffic Impact Analysis (TIA), traffic signal designs, transportation management plans, pavement marking plans, sidewalk designs, roadway designs, and driveway permits. These studies also consisted of a review of site layout, including close coordination with the NCDOT Municipal and School Transportation Assistance Unit (MSTA) to ensure proper internal stacking distances for vehicles and a safe environment for pedestrians. The traffic studies included a capacity analysis of local streets and intersections utilizing Synchro/Sim Traffic to determine any existing and future roadway deficiencies with the construction of the schools. Many of the adjacent intersections required new signals or signal upgrades including steel poles and mast arms, pedestrian heads and pedestals, and revisions to the signal timing and phasing. All of these projects involved close coordination between DPS, NCDOT, the City of Durham, and MIAIB. Several projects required Major and Transportation Special Use Permits due to the number of peak hour trips generated, thereby requiring expert witness testimony at public hearings regarding roadway improvements and safety, traffic congestion, noise, vibration and air quality impacts.

These three schools are all charter schools within the City of Durham. Turn lane improvements. a roundabout. and access modifications have been recommended to handle the three schools' traffic. A Transportation Management Plan (TMP) has been prepared for the Middle School and an additional TMP will be developed to accommodate the traffic for the three schools operating together.

Duke School Master Plan Durham. North Carolina

M/AIB participated ina Master Planning effort for Duke School. The project consisted of relocating the existing Lower School to the Upper School campus. Services provided also include a TIA for submittal to the City of Durham and NCDOT. Recommendations for the study included vehicle queuing lengths for student pick­up/drop-off lines for both schools. signalization of the main School driveway. and storage lengths for geometric roadway improvements .

M/ AlB provided traffic assistance to the Dare County Board of Education for several schools undergoing new construction and proposed renovations. Guarantees and Warranties

Section I Qualifications and Experience

The members of the project team have the necessary experience in performing guaranteed maximum price public-private partnerships, providing design services and placing quality construction to provide mutually satisfactory guarantees and warranties. The guarantees and warranties required for the project will be closely defined in the comprehensive agreement and will reflect the industry standards for design and construction.

Shockey P3, LLC's work shall generally extend through a one year guarantee/warranty period after final completion of construction for each phase of the work. Extended warranties can be discussed if desired by Montgomery County Public Schools.

Shockey's project manager will meet with Montgomery County Public Schools representatives to perform a walk-through of the building prior to end of the warranty period and to coordinate any necessary repairs.

As providers of professional services, the design team will not be constructing or installing parts of the projects; therefore, guarantees and warranties are not applicable to these services. All design will, however, be bound by the standard of care applicable to professional services rendered under the agreement. In providing such services, the design team will perform in a manner consistent with that degree of care and skill ordinarily exercised by members of the same profession currently practicing under similar circumstances at the same time and in the same or similar locality.

The scope of work included construction of a two-story addition (located in a downtown setting) that is primarily used as the bank's operations center. The project also included installation of a drive-up ATM and expansion of the drive-thru to five lanes.

John Handley High School Phase 3A and 3 B Winchester, VA

Howard Shockey & Sons, Inc. served as the construction manager for this 272,000 SF renovation and addition project. A major renovation project to a local landmark which opened in 1921, the school's mechanical, electrical, plumbing, ventilation and fire safety systems were improved. More than 40,000 SF of space was added. A student union was created, featuring a skylight above and walls formed by brick archways that had been hidden during previous renovations. The project also included renovations to ten foreign-language and five special-education classrooms, the music department and the kitchen and cafeteria. The physical education areas (which included the main and auxiliary gyms) were expanded and renovated during this phase.

The project included the restoration and renovation of the original 1920's building; the creation of additional classrooms and a student union dining area; the addition of a front administrative office, the completion of the second-floor addition, the renovation of the basement, the first floor and the addition of half of the 20,000 SF second floor. Also included were the locker rooms, coaches' offices, dressing rooms under the stages, and the transformation of the school's original gym into a two-level media center.

At the HRTPO, he was responsible for performing technical analyses and documenting study findings for public review and presenting results of transportation engineering and planning studies to a regional transportation technical committee and to City Council and County Board of Supervisor members. Traffic signal plans have been prepared to design three new traffic signals, to incorporate upgrades to existing traffic signals, and in many cases to temporarily modify the traffic signal operations during the construction of utilities in the intersections. Typical signal upgrades have included new signal phasing, controller equipment upgrades, addition of pedestrian and bicycle amenities (new crosswalks with signals and pushbuttons, bicycle detection loops, etc.), and the provision of decorative poles and mastarms.

• Creekside Elementary Schoof, Durham, NC. Served as Project manager of designs for the Creekside Elementary School project. The designs included the traffic signal plans for a new traffic signal at the intersection of Farrington Road at Ephesus Church Road and the associated pavement marking plans. The traffic signal design included standard NCDOT traffic signal controller equipment and traffic signal heads supported by messenger cable and wood poles. The pavement marking plans were designed to accommodate the elementary school bus traffic and the proposed widening of Farrington Road and Ephesus Church Road in the vicinity of the Creekside Elementary.

Charles E. "Chuck" Wall is a partner in the Business Section at Williams Mullen in the Richmond office. His practice includes a concentration on public-private partnerships, and he has represented dozens of private entity teams in partnering proposals to state agencies, local governments, regional authorities and school boards across the Commonwealth. Mr. Wall has negotiated reSUlting Interim Agreements and Comprehensive Agreements for new schools, public safety facilities and correctional facilities under the Virginia Public-Private Education Facilities and Infrastructure Act of 2002, as well as new transportation facilities pursuant to the Virginia Public-Private Transportation Act.

Mr. Wall was appointed by the Virginia General Assembly to serve on the committee to revise the PPEA's Model Guidelines for public entities. He has lectured extensively on the PPEA and PPT A before legislative bodies, government officials, trade and professional associations, and other lawyers.

In addition to his privatization practice, Mr. Wall has significant experience in corporate and business matters. Ralph L. "Bill" Axselle, Jr. joined Williams Mullen's Richmond office in 1990. He is a partner in the Governmental Affairs Section and his practice concentrations include governmental affairs, public-private partnerships, administrative law, land use and public finance, which he practices before state and local governments. Mr. Axselle also gives business advice to a number of medium-sized and large corporations.

Mr. Axselle has been extensively involved in numerous proposals under the Virginia Public­Private Transportation Act and the Virginia Public-Private Education Facilities and Infrastructure Act of 2002. With respect to the PPEA, Mr. Axselle was instrumental in drafting the legislation, he served on a committee which reviewed the Model Guidelines, and he was consulted in the development of the Commonwealth of Virginia Procedures.

Mr. Axselle served in the Virginia House of Delegates from 1974 through 1990. A ranking member on a number of major committees, he also was Chairman of the Governor's Regulatory Reform Advisory Board (1982-1985) and the Governor's Commission on Efficiency in Government (1986-1988). William W. "Bill" Harrison, Jr. is a partner in the Business Section at Williams Mullen in the Virginia Beach office. He serves as co-chair of the firm's Public Finance Team, and he has extensive experience in the issuance of tax-exempt bonds and the use of public-private partnership structures. In addition, Mr. Harrison has been responsible for a variety of complex commercial real estate transactions, both as counsel to institutional lenders and developers.

Mr. Harrison's public finance practice involves his engagement as bond counsel and underwriter's counsel in connection with the issuance of appropriation supported debt and general obligation bonds for the financing of a myriad of public facilities such as higher education facilities, correctional facilities, police training academies and state-owned office buildings. He has also been engaged in connection with the advanced refunding of governmental obligations and private activity bonds.

Mr. Harrison has extensive experience with the Virginia Public-Private Education Facilities and Infrastructure Act of 2002. Section 2 Project Characteristics

e. Identify the projected positive social, economic and environmental impacts

of the project. The proposed facilities offer has a number of positive social, economic and

environmental impacts. The designs:

• Offer high-quality, energy-efficient structures designed to last, with reduced life-cycle costs.

• Accommodate and anticipate technological advances. • Create more productive and pleasant work environments for faculty, staff and

students. • Improve quality of life for county residents, thereby improving the county’s

economic development opportunities. • Accommodate the future educational needs of a growing county population. • Create local construction jobs involving local subcontractors during a deep

recession. • Reduce the amount of bus time and expenditure spent on student transport. • Eliminate the need for a dangerous intersection on Prices Fork Road. • Enable the local business community (including Virginia Tech) to retain professional

staff. f. Identify the proposed schedule for the work on the project, including the

estimated time for completion.

It is the intent of the team to have the schools ready for occupancy as noted in the preliminary project schedule which can be found in Volume II, Section 2, Item (f). The schedule, which has been deemed proprietary and confidential, is not subject to release under VFOIA.

g. Propose allocation risk and liability for work completed beyond the agreement’s completion date, and assurances for timely completion of the project.

Shockey is prepared to assume performance risks for design, construction and site development and is willing to provide guarantees for this risk. We are anxious to discuss, during negotiation of the Comprehensive Agreement, the extent of the shift of risk from public to private sector and our team is prepared to negotiate the allocation of such risk.

Section 2 Project Characteristics

h. State assumptions related to ownership, legal liability, law enforcement and

operation of the project and the existence of any restrictions on the School Board’s use of the project.

Ownership, management, and operation will remain the responsibility of Montgomery County Public Schools. Law enforcement responsibility will rest with the local police and sheriff departments.

i. Provide information relative to phased or partial openings of the proposed

project prior to completion of the entire work.

Section 4 Project Benefit and Compatibility

a. Identify who will benefit from the project, how they will benefit and how the

project will benefit the overall community or region.

Shockey P3, LLC’s proposal for the construction of these schools will provide a lasting benefit for the residents of Montgomery County. The project will ensure that the community-at-large benefits from having a state-of-the-art school facilities. These facilities will provide a safe and efficient environment that is aesthetically-pleasing, cost-effective and will be built to withstand strenuous use. Further, Montgomery County Public Schools will benefit from its increased flexibility in selecting the design-build team. Under the PPEA, the county is able to consider more factors than afforded under the traditional procurement process. Hence, it is able to select a team of trusted experts with a track record of excellence. The result is that the county is able to contract with the best-qualified team to deliver quality facilities in a timely fashion, all in a cost-efficient manner. This will benefit the entire community.

b. Identify any anticipated public support or opposition, as well as any

anticipated government support or opposition, for the project.

Because of the significant benefits of this project to the children of Montgomery County, it is anticipated that there will be widespread public and government support. We anticipate that there will be a number of agencies and community groups with which our team will work during the evaluation of the proposal. Our goal is to have an open line of communication with them to earn their support. The Shockey P3, LLC team will take a proactive approach to public participation, working with county officials and other stakeholder groups to assure that they are well-informed and appreciative of the benefits of this project.

c. Explain the strategy and plans that will be carried out to involve and inform the general public, business community, and governmental agencies in areas affected by the project.

Our goal is to ensure that the general public is informed and comfortable with all

aspects of the proposal. In order to accomplish this, we intend to:

• Make executive summaries of our proposal available to the public. • Coordinate media outreach with the appropriate, County-designated officials. • Conduct public information sessions regarding the proposal.

While our team wants to encourage an active and open dialogue about the proposal, all of these efforts must be closely coordinated with the School Board.

In the event a segment of the community raises questions or concerns targeting the County or any aspect of the project, the Shockey P3, LLC team and Williams Mullen’s public affairs professionals will respond quickly by interfacing with the County and its officials to develop an appropriate strategy and then executing the agreed-upon plan to the extent the School Board deems appropriate. By implementing this proactive plan for community education and issue management, our team will give the School Board an important level of control over the overall process, and one more reason to have confidence in this new public-private partnership approach.

d. Describe the anticipated significant benefits to the community, region or

state, including anticipated benefits to the economic condition of the School Board and whether the project is critical to attracting or maintaining competitive industries and businesses to the public entity or the surrounding region.

Shockey P3, LLC’s highly experienced team’s proposal includes three schools for the citizens of Montgomery County. There are many significant benefits that will result from this project. Highlights include:

Section 4 Project Benefit and Compatibility

e. Describe compatibility with the local comprehensive plan, local

infrastructure development plans, the capital improvements budget or other governmental spending plan.

By selecting team members who routinely work with local building officials, our goal is to ensure that this proposal is ultimately in line with the desires of the School Board and the Board of Supervisors.

The current capital improvements budget and government spending plans do not

accommodate the construction of all three facilities at once. Political unity, interdepartmental cooperation, and appropriate voting will need to take place to approve funding. The need for these facilities has been noted by the School Board, and by the citizens of Montgomery County.

f. Provide a statement setting forth participation efforts that are intended to

be undertaken in connection with this project with regard to the following types of businesses: (i) minority-owned businesses; (ii) woman-owned businesses; and (iii) small businesses.

Shockey P3, LLC will take all necessary steps to assure that minority-owned and women-owned businesses are afforded contracting opportunities. Shockey maintains SWaM vendor lists in-house and searches for qualified firms through the Virginia Department of Minority Businesses. Searches yielding potentially qualified SWaM subcontractors are evaluated for participation.

As the project design is finalized, Shockey will solicit small businesses and businesses owned by women & minorities by means of announcements/postings in local newspapers, encouraging SWaM firms to participate. This type of “good faith” effort will be documented for reference. Qualified, competitive SWaM subcontractors will participate in this project.

Shockey will then complete all necessary forms (as required) including contacts, firm names, addresses, telephone numbers, dates and time of calls, faxes, affidavits and participation forms, and contract results.

As an example, Howard Shockey & Sons was awarded the contract to build the new Greater Richmond Transit Company’s (GRTC) bus operations and maintenance facility. The $35 million GRTC facility had mandated goals for both SWaM (12.6%) and DBE (7.4%). Shockey greatly exceeded both requirements contracting SWaM (17.3%) and DBE (14.9%) to the satisfaction of the owner. The project was completed on-time and on-budget.

Howard Shockey & Sons, Inc. is a member of (among other organizations) the Associated Builders and Contractors—a merit-shop organization promoting the use of the most responsive and responsible contractors available on any given project, regardless of the race, color, creed, gender or union status of the contractor’s ownership and/or trades people.

CONCLUSION Shockey P3, LLC has assembled a team of top professional firms and wholly-owned manufacturers to assist Montgomery County Public School in the design and construction of a two new high schools, and the renovation of an existing high school. The Shockey P3, LLC team has extraordinary experience in successfully completing projects of similar size and scope.
