The charm of Old Phuket Town’s 18th century architecture has been inspiration to the artistically inclined for generations. It also proved a popular theme of improvisation for the designers of Wings, a new residential estate of single-bedroom pool villas near the west coast of Phuket.

When Phuket-based property developers the Two Villas Group integrated the old-town charm of Phuket Town into Wings pool villas, they instantly won the hearts of property buyers, who snapped up all but one of all the available homes in Phase I within three months of the project’s launch.

Two Villas Group Managing Director Khun Wirachai Pranveerapaibool said Wing’s overwhelming success was down to an ideal location near Laguna resort, aff ordability as a starter or holiday home, and most of all, a fresh architectural approach to a traditional theme.

Wings’ rapid sales success was also bolstered with a series of workshop tours of Old Phuket Town, jointly organised by Phuket Heritage Trails (www.phuketheritagetrails.com) and the Two Villas Group, which gave participants a deeper insight into the little-known historical nooks and crannies of Old Phuket Town and the inspiration behind the chic new home designs.

“We gave the architects and designers a free reign to create an exclusive community of contemporary single-story abodes inspired by the colonial architecture found around Old Phuket Town and the streets of sister towns in Penang and Malacca, Malaysia,” said Mr Wirachai.

“In fact, the principle exterior colour chosen for Wings homes was a stunning ocean blue, emulating the façade of one of the elegant colonial-era mansions in Penang, which has given Wings homes a uniquely fresh and vibrant character,” he said.

As with colonial architecture, the designers gave the modern Wings homes a classic touch of class while keeping things practical and making the most of the tropical climate, to off er stylish private pool villas at aff ordable prices.

“These are new homes with an old story. Just like traditional Paranakan houses, natural light is allowed to fi ll the rooms. The front entrance opens to a high-ceiling hall with an oriental backdrop, which leads to the spacious bedroom and en-suite bathroom,” said Two Villas Group Marketing Director Kanokpan Pranveerapaibool.

With many high-end features, including a private pool along an entire side of the home and a roof-top patio for under THB 6 million, Wings homes are very competitively priced when you compare what you would pay for a much smaller condominium unit, for example,” said Khun Kanokpan.

Wings is the 28 residential development by the Two Villas Group, which also off ers a complete range of integrated property services with Two Villas Holiday and Two Villas Ready, listing fully-furnished houses for sale in Phuket.

With all but one of the units sold in Wings Phase I, 14 more pool-villa units in Phase II are now on the market.

People Profi le

Simon James is the International Race Offi ce for, amongst others, this month's Six Senses Phuket Raceweek regatta. He sees huge potential for Phuket becoming a venue for professional sailing championships.

Simon James

Where were you born and what were you involved in before arriving on Phuket? I'm from Cardiff in Wales. I studied computer science but also drama and photography as I wanted to work for the BBC but, due to government cutbacks, never quite got there. I was interested in micro computers and set up the UK’s fi rst high-street outlet for home computers. Suppliers would arrive with a carload of computer games and by lunchtime all were sold. With the development of the Macintosh, I then worked with Apple Computers for 10 years.

When did you arrive on Phuket? In 1992, I took a three month sabbatical, which lasted three years, skippering yachts in the Caribbean and Mediterranean. During this time I got to know the team at Sunsail well. In 1995, they asked me to come to Phuket as a skipper to help set up the Royal Yachting Association (RYA) Sailing School and I ended up as their Asia Sales and Marketing Manager.

Why did you decide to stay on Phuket? South East Asia has some amazing sailing destinations, so is an ideal place to be based. There are many new Asian sailing events in places like Korea, Japan, Hong Kong and China.

So what does your job involve? I'm an International Race Offi cer for the International Sailing Federation (ISAF) based in the UK. I'm like a referee or the conductor of an orchestra. I do everything from small events to the Olympics. For example, in one month last year I did regattas in fi ve countries. I act as a consultant to create a template, if the event organisers require it, to run the regatta to the correct standards. Or I could advise on the types of boats, fi nd volunteers, run seminars and train on the water staff . Hopefully, as a result of this type of work, more local Thais and foreigners will get more experience at running their own regattas.

What about your management/leadership style? I think of each event almost like a start-up where we can create something unique. I try to build what I do around the people taking part, who often pay a lot of money to be there. They want value for money.

What satisfaction do you get from doing this job? Seeing new events develop. Since the Asian Boating Awards and the Asian Marine Boating Awards started I've been associated with at least one of the winning entries every year. This year, Six Senses Phuket Raceweek won the Best Asian Regatta 2011.

Where do you live? I've been renting a house in Kathu for 10 years.

Why do you stay in Kathu? Kathu's central. There's easy access to Phuket Town and everywhere else.

What do you do besides work and sail? I cycle and enjoy photography. I also rent a place at Khanon, near Koh Samui, which is a great area for cycling. While travelling I also take a lot of photographs, many of which are used in travel brochures and publications like the Southeast Asia Pilot and the World Cruising Guide.

Why type of car do you drive? A 10-year-old Ford Mondeo that I've had for fi ve or six years.

Are you married with children? No, but my Thai partner Kae and I have been together for 11 years. Kae runs the administration side of the Phuket King’s Cup Regatta. She also helped run The Bay Regatta - Phuket, Phang Nga, Krabi this year.

What do you particularly like about Phuket? The defi ning thing is it's the best of boating worlds. You can always fi nd a deserted island where you're the only people there. Phuket has a good marine infrastructure and there are not many things you can't get done here.

What do you dislike about Phuket? Increased traffi c, although that's relative. One thing that spoils it is that there are not many restaurants and bars actually on the beach. There's always a road between them.

What are you favourite places? On a yacht going out of Ao Chalong Bay. I don’t spend a lot of time in Patong these days. I like the North Coast area.

What hobbies do you have? Computers and, as I mentioned before, photography. I set up websites within the sailing industry. I'd like to do a sailing podcast.

Do you support any charities? Most regattas in Thailand are non profi t making and linked to charitable projects.

Where do you see the future of Phuket sailing going? We're slowly earning a reputation around the world for our regattas. I think Thailand will eventually become a destination for professional championships. We're gradually getting the facilities and we have great hospitality. We're putting Phuket on the yachting map.

How do you go about achieving this objective? We should establish a Phuket template. For example the Ao Chalong Yacht Club has just established a sailing school to teach skills like navigation. People here need to get the right qualifi cations and we need to build infrastructure. Hopefully we can work with the local authorities to put in the infrastructure. We need to show the world that we have both the facilities and the expertise here in Phuket.

Feature Six Senses Phuket Raceweek 2011

With a record 37 confi rmed entries already in the bag by mid-June (compared to a total 38 entries in 2010), organisers and rights owners Image Asia Events Co., Ltd. are expecting to beat all previous entry levels. “We always get a rush of entries nearer the regatta, so the early signs are excellent for a strong fl eet this year,” said Image Asia’s MD, Grenville Fordham. Confi rmed entries include several fi rst-timers, led by David Ross’s brand new Ker 40 pure racing yacht, KukuKERchu, which will debut at Phuket Raceweek 2011.

Responding to the ‘Best Regatta’ win, Fordham commented: “Naturally, we’re delighted with the ‘Best Regatta’ accolade, which refl ects what our participants have been telling us for the past several years.”

On the sponsorship front, Phuket Raceweek has scored a fi rst in Thailand; Mount Gay Rum – the oldest brand of rum in the world and sponsor of 120 regattas worldwide – has chosen Six Senses Phuket Raceweek as the launch platform for the brand in Thailand. The launch will take place at the regatta’s opening party, with a Caribbean buff et and entertainment – and plenty of Mount Gay rum.

“We’re honoured to have been selected by Mount Gay Rum as the launch event of their celebrated brand in Thailand, and delighted to be the fi rst regatta in Southeast Asia to be able to off er participants the coveted Mount Gay ‘Red Cap’ – a symbol of the passion, spirit and identity that unite the seafaring family,” said Fordham.

Voted ‘Best Asian Regatta 2011’ at the annual Asia Boating Awards in Hong Kong, the eighth edition of Six Senses Phuket Raceweek, running from 20-24 July 2011 at Evason Phuket & Bon Island on Phuket’s southeast coast, looks like it’s in for a bumper year. Phuket Raceweek is only the second of Thailand’s six regattas to win the prestigious ‘Best Regatta’ award.

ALL SYSTEMS GO FOR

Kittipat Chaiyakul, Marketing Director for Remy Cointreau, Mount Gay’s parent company, added: "Since its origin, Mount Gay Rum has been intimately linked to the sailing world. We’re delighted to support Six Senses Phuket Raceweek for the fi rst time.”

On the water, this year’s event will count a couple of well-known ‘yachting personalities’, Dee Caff ari and Paul Larsen. In 2006 Dee became the fi rst woman to sail solo, non stop, around the world against the prevailing winds and currents and was awarded an MBE in recognition of her achievement.

More recently, she competed in the 2008/9 Vendée Globe – a gruelling race around the world, non-stop and alone – crossing the fi nish line in 6th place out of an original fl eet of 30 competitors. In June of the same year, Dee and an all-female crew went on to smash the mono-hull speed record around Britain and Ireland. Dee will race on board the Andaman Cabriolet catamaran, Niña.

Paul Larsen has a history of sailing some of the wildest and fastest boats ever to grace the oceans and is project leader of the Vestas Sailrocket team, which is currently preparing in Namibia for an attempt at the ‘Outright World Speed Sailing Record’. Paul was a member of Pete Goss’s ill-fated Team Philips and his many achievements include a winning non-stop circumnavigation in the Oryx Quest and a double handed lap of Britain with Pete Goss on a 30 foot Seacart trimaran. Paul will be racing on the Andaman Cabriolet catamaran, Da Vinci.

World-renowned yachtswoman, Dee Caff ari will race on the Andaman Cabriolet Niña (above left), while Paul Larsen, currently in the middle of an attempt for the Outright World Speed Sailing Record, will skipper the Andaman Cabriolet Da Vinci (above right). Dee Caff ari is attending the regatta as Six Senses 'Sailing Ambassador'.

Back onshore, participants will be treated to the regatta’s hallmark 5-star buff et parties, free fl ow regatta bar, courtesy of Siam Winery & Mount Gay, and great entertainment – although this year with a diff erence. In response to feedback from previous years’ racers, two of the parties will start early and fi nish early. On these days, sailors will be welcomed ashore at the Evason regatta venue with a full free-fl ow bar from 3pm until 7pm, with a prizegiving at 5pm and buff et at 5.30pm. These two ‘easy’ nights off er a break for exhausted sailors between the Mount Gay Launch Party, the hugely popular Da Vinci off -site party after the fi rst day’s racing and the extravagant fi nal night party and series prizegiving.

An addition to the onshore fun and games this year comes from Co-sponsor, Franke. The Switzerland-based international kitchen equipment supplier, which also sponsors the Alinghi America’s Cup team, is celebrating 100 years in business with its regatta sponsorship and is staging a cooking competition (broadcast live on Phuket Radio 91.5FM) at Evason exclusively for those unsung heroes – the yacht charter cooks of Phuket. To fi nd out more about this competition with some fabulous prizes on off er, contact [email protected]. Entry deadline 10 July.

Perhaps of more direct interest to regatta participants, Co-sponsor QBE Insurance will liven up the skippers’ briefi ng with a 20,000 Baht contribution to someone’s regatta entry fee – no claim forms required!

Last but not least, there’s the ‘explosion’ of the skipper’s bag… “We’re in the process of calculating the value of the traditional bags this year and are confi dent that the value will exceed the cost of entry to the regatta!” said Fordham.

In addition to the mandatory Sailing Instructions, the Six Senses Phuket Raceweek 2011 skippers’ bag (actually three bags – a kitbag by Rodenstock, a document case by Nautica and a Quantum bag) will be packed with Rodenstock sunglasses, Nautica T-shirts and polo shirts, Gybe caps for every participant, the coveted Mount Gay red cap, a B&G cap, a Franke dry bag, top-of-the-line Nivea suncare products and beer coolers by Paul Poole and Andaman Cabriolet.

“Unfortunately, there won’t be a bottle of Mount Gay Rum in every bag,” said Fordham, adding, “but participants will be the fi rst in Thailand to be able to buy a bottle – and every purchase will be accompanied by a Mount Gay red cap (while stocks last).”

About Chef Laurent Valette :Even as a boy growing up in Lille, France, Laurent always wanted to be a chef. He studied at the Lille Gourmet Culinary School, from where, after three years, he graduated with distinction. During these early years, he travelled around France learning all the complexities and subtleties of French cuisine. He returned to Lille to work at The Huitriere – a Michelin rated restaurant. Next, bitten by wanderlust, Laurent decided to seek out new horizons. He travelled to Belgium where he had the opportunity to learn new culinary skills from the renowned chef, Pierre Yves Gosse at the Relais Chậteau de la Cense du Bois. Still keen to refi ne his skills and discover new gastronomic styles, he travelled to Italy, Spain and Morocco. There he decided to call a halt, and took a challenging position as executive chef in one of the most fashionable restaurants in Casablanca – The Trica. He stayed there for fi ve years.

Laurent has also had extensive experience in banqueting in France, and is very knowledgeable about charcuterie and butchery. In Italy he learned how to prepare fresh pasta and pizzas.

He loves to combine the traditional techniques of his French background with the Mediterranean infl uences he acquired on his travels.

Now he’s the Executive Chef of all the kitchens of the Wine Connection Deli and Bistro group, where he’s created an original and tasty Mediterranean menu, which includes pizzas and pasta. The emphasis is on top quality ingredients and value for money – all served in a delightful bistro ambience. He feels very privileged to be able to use the resources of Wine Connection to access fresh imported cheese, cold cuts and Australian chilled meats. All those products are imported direct from the producers. This allows Laurent the opportunity to create new special menus on a monthly basis.

Feature: La Boucherie Kids Party

La Boucherie

A total of 50 kids from Childwatch Phuket headed to La Boucherie Grill and Steakhouse at Royal Phawadee Village, Patong Beach, for the La Boucherie Kids Party on Thursday May 12. Claude de Crissey (pictured top right) said that he and his team made this party especially for them with the purpose to bring joy and cheer to the orphanage residents during this school holiday season.

The party ran from 11:00am until 14:30pm and it was a real pleasure to watch these kids having so much fun, appreciating the small gifts and fun activities arranged for them. It was truly a humbling experience for the organiser of this event. Hearing the background stories of these kids brings tears to many people's eyes, but it’s amazing to see how they manage to smile and play like the happiest kids in the world.

Khun Zong and Khun Jit from Bozo Balloon lived up to the occasion with face painting, amazing balloon-making and games to entertain the kids. All the kids had a blast and enjoyed the Royal Phawadee Village Hotel's beautifully-shaped swimming pool as well as tasting the newly launched La Boucherie’s Kids Menu.

Many thanks go to all the organisers: La Boucherie Grill and Steakhouse team, Pluto Ice Cream Phuket, Phuket Francophone, IMAGE asia and Shop WINDOW on Lifestyle, Royal Phawadee Village and All 4 Diving Academy.

Soneva Gili is managed by Six Senses Resorts & Spas, who have developed and operate unique properties in the Maldives, Oman, Thailand, Vietnam, Spain and Jordan under the brand names Soneva by Six Senses. Helicam achieved the required images by using the new Autonomous (Pilotless Machine), a machine that uses onboard avionics /GPS navigation to actually fl y without a pilot. Sukko means "Beyond Happiness". My fi rst feeling when I stepped through the impressive gates of the Sukko spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, infl uenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, my mind was fi lled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to fl oat away past stresses and wish for luck and joy from that moment on.

A variety of 40 spa treatments – prepared by Sukko's certifi ed Thai Herbalist and based on ancient Thai medical theory – is off ered at Sukko, in packages lasting from 2 hours to 4 hours. Each package has a specifi c purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be.

I was pampered with the ‘All-Soother’ package, a 2 1/2 hour experience that left me feeling relaxed and refreshed. This four-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by a traditional Thai massage, the pressure applied gently but fi rmly. "Is this pressure okay? Too strong? How are you feeling?" my therapist asked me from time to time. “Mmm… perfect…” were the only responses that seemed to suit how I felt. My last step, which came all too soon, was the Thai Herb Purifying Facial Treatment, using creams and herbs that left my face feeling smooth and glowing – and even looked good enough to eat!

Sukko Spa’s restaurant, Suk Savoey Spa Cuisine, presents a unique concept: "Menu by Blood Types" and "Menu by Element". For those who want to exercise, the Suk Sanan Club provides a myriad of fi tness opportunities,

including ‘Rue Sri Dat Ton’ (the hermit self stretching), a traditional Thai exercise or, for something more strenuous, try ‘Muay Thai Chaiya’, a traditional and eff ective art of self-defense. Parents who come to Sukko to relax can leave their kids at Suk Zon Kid's Club, where they will enjoy with a variety of fun yet safe activities.

Sukko Spa, one of Phuket’s most luxurious spas, is located on Chaofa Road just 30 minutes from Phuket International Airport, 10 minutes from Phuket Town, 30 minutes from Kata or Karon Beach and 20 minutes from Patong Beach. It is creatively designed in a contemporary Thai style, set amongst 15 rai (6 acres) of luxuriously landscaped tropical forest.

Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specifi c herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices.

“I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls.

Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market.

What started, several years ago, as a modest enterprise has blossomed into a successful operation off ering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils.

“Our advantage is that we produce the freshest spa products and our stock is never kept longer than three months; using fresh spa products can be likened to eating fresh food rather than processed food.”

Lemongrass HouseTo visit this home of award-winning spa oils, creams, soaps and so many other exquisite products is a delight. The aromas are enchanting. At Lemongrass, you can enjoy a spa treatment to sample and choose from their huge range, then take home your choice to enjoy at your leisure. They even have a great range of kid’s spa products.

Based on his years of experiences at some of the top spas in Southeast Asia, Bobby has developed a full line of healthy skin care products. For example, his hydrating face and body creams have 25 per cent aloe vera, white orchid and cucumber extracts. And he’s developed a revitalizing mineral muscle soak made from Andaman Sea salt crystals, blended with white orchid and chamomile extracts, to help draw out impurities and soothe and revive tense muscles.

“People are sensitive to diff erent scents at diff erent times of day. It’s a good idea to get a variety of essential oils and experiment with what smells and feels good to you,” he says. “Our aromatherapy massage and body oils can be either uplifting or calming to the spirit. They’re carefully balanced hand-blended oils created by adding pure essential oils to nourishing, vitamin E enriched, sweet almond and jojoba base oils.

Lemongrass has won many awards, including Condé Nast Hot List 2007, and has been featured in several top magazines, including Time Magazine’s “Best of Asia”. According to Time, “If you want to smell like no one else, try mixing a selection from the more than 90 natural scents at Lemongrass House.”

Lemongrass House is located in Cherngtalay, Surin Beach and Chalong, where you can buy their full range of spa products at modest prices, making perfect gifts for friends and family who can enjoy the aromatic scents of Asia in the privacy of their homes – no matter where in the world they live.

The Royal Spa and Health Club

In the heart of bustling Phuket Town lies a quiet haven of heavenly peace. With the continuous sounds of water, trickling, bubbling and steaming, and with the sweet fruity scents that fi ll the air, the being is enticed into a fl owing stillness of body and mind.

The Royal Spa and Health Club is a popular tropical day spa with both locals and visitors alike, which is managed by the Royal Spa Development and Management Company. With an excellent reputation in the spa development industry through its experience and attention to detail, the Royal Spa and Health Club off ers a distinctly personal experience.

Of the signature treatments, the Royal Stone Therapy is one that is particularly interesting. The Hot Stone massage technique, founded 5000 years ago, uses black volcanic stones, which are heated and placed on the body, producing a profound eff ect, stilling the mind and easing the body.

Unlike many of the high-end spa complexes on the island, which market themselves exclusively to tourists, the reasonable prices and relaxed but professional staff at the Royal Spa, means that many local Thais, as well as tourists, are beginning to use the spa. This has helped to erase the often stiff , and over-formal atmosphere at many of Phuket’s spa resorts, giving the Royal Spa an ambience of authentic relaxation and pleasure.

All the therapists working at the Royal Spa have been trained at the in-house 'Phuket Spa Academy', established in 2004, to provide a comprehensive spa training course. The curriculum and assessments provide a measurement of therapist expertise and knowledge within the Thai spa industry. Since then, the Royal Spa Development and Management Company have provided comprehensive and professional spa management, and development programs, for spa retreats throughout Thailand. Their aim is to provide a standard of service and expertise throughout the Thai spa industry, to ensure a high quality of service and standard of treatment, throughout Thailand. It truly off ers the ‘one stop services for Thai spa business’ and a quality of relaxed professionalism, rarely found in luxury spa resorts.

Right now The Royal Spa have 12 branches that are managed in resorts in Patong, Kata, Karon, Panwa, Ao Chalong and Phuket Town and you are welcome to experience our spas with us anytime. As a special for our 8th year anniversary, we off er 'BUY ONE GET ONE FREE' value.

TERMINATION OF EMPLOYMENT IN THAILAND

For a foreigner with a Thai entity or organisation doing business in the Kingdom of Thailand and therefore having employees in Thailand it is useful to understand the basic rules of termination of employments under Thai law, should over the years, a change of personnel be necessary. Equally, it is important that foreigners understand that laws in the Kingdom of Thailand protecting Thai nationals are to be adhered to by Thais, and foreigners alike, upholding the proper and due rights of Thai employees not in accordance with foreign principles, but Thai principles of employment. An employer wishing to terminate an employment contract will have to consider whether the subject employee is protected by the Thai labour law, whether termination would only be permitted with prior approval of the Labour Court and/or under certain situations whether any notifi cation to the labour protection authorities is required prior to termination. Employers should note that employees may seek advice and counsel directly from the Labour Offi ce to ascertain their rights, but also to ask for an offi cial to contact the employer should any infringement be suspected with a view to remedying such infringement. Employers may disagree with the interpretation of an offi cial but if they do, may fi nd themselves defending proceedings in the Labour Court, so should be very careful to ensure advice is sound and accurate, so even a Human Resource manager should feel in the event of doubt, that seeking legal counsel is appropriate.

Severance Pay.Every employer should consider that employees are entitled to severance pay unless their employment is terminated for “Cause” (an expression which means for ‘good reason’ – please also see below). The amount of the severance payment is subject to the time the employee has worked with the employer and is as follows:

For 120 consecutive days but less than one year; an amount not less than • 30 times the recent daily wages or not less than the wages for the work performed in the last 30 days (one month);continuously for at least one year but less than three years, an amount not • less than 90 times the recent daily wages or not less than the wages for the work performed in the last 90 days (three months); continuously for three years but less than six years , an amount not less than • 180 times the recent daily wages or not less than the wages for the work performed in the last 180 days (six months); continuously for six years but less than ten years, an amount not less than • 240 times the recent daily wages or not less than the wages for the work performed in the last 240 days (eight months); continuously for over ten years, an amount not less 300 times the most • recent daily wages or not less than the wages for the work performed in the last 300 days (ten months).

Payment in Lieu of Notice. In case the employment contract is for an unspecifi ed term, the employee is entitled to notice of termination, which must be given at least one full wage period in advance. If such a period is fi xed for duration longer than a calendar quarter, only three months advance notice must be given. The employer may immediately release the employee from employment by paying him his wages up to the period of the advance notice which would otherwise be required. Advance notice of termination or payment in lieu thereof is not, however, required in the event the employee (i) willfully disobeys or habitually neglects the lawful commands of the employer, (ii) absents himself from work,(iii) is guilty of gross misconduct or (iv) acts in any manner incompatible with the due and faithful discharge of his duty.If you are an employer and are not aware of this provision, and you don’t issue proper contracts to your staff , you are in danger of overlooking this right, and perhaps not handling a termination scenario appropriately, which could lead to more termination payments than is necessary.

Causes Exempting the Employer from the Obligation to make Regular Severance Payment:

An employer is not required to make severance pay to an employee whose • employment is terminated on any of the following grounds:

Voluntary resignation by the employee;• Dishonesty in the performance of his duties or intentionally committing a • criminal off ence against the employer; Intentionally causing loss to the employer; • Gross negligence resulting in severe loss to the employer; • Violation of the work rules or regulations or fair and lawful order when the • employer has already issued the employee with a prior written warning, except in a serious instance when the employer is not required to give a warning; Desertion of duties for a period of three consecutive works days without • reasonable cause; Imprisonment by reason of a fi nal judgment.• The fi rst head is the most important, as it may be that an employee, in • the circumstances of poor performance, seeks to provoke an employer to dismiss the employee to create a severance payment obligation. Therefore, employers should be wary of ensuring that their performance appraisals; warning procedures for infringements in the work place are properly maintained, so that should an employee become aware that their position is at risk, they may choose to resign appropriately to avoid further disciplinary proceedings. From an employee’s perspective, the employer should not abuse this process to force resignation.

Unfair Termination of EmploymentIn addition to the statutory severance pay, the employee may claim damages from the employer if termination is “unfair” to the employee. The Labour Court may, at its discretion, if it deems the termination is unfair, order the employer to reinstate the employee at the employee’s last wage rate. If, however, the employer and the employee are no longer able to work together, the Labour Court may fi x the amount of damages to be paid by the employer to the employee, taking into consideration the age of the employee, the duration of employment, the hardship resulting from termination, and the severance pay the employee is entitled to receive. To arrive at such a conclusion, the legal fees and expenses of one party proving the other wrong, may far outweigh the amount of settlement payment involved, so a clear cost-benefi t analysis of the worth of proving ‘who is right’ and ‘who is wrong’ should be carefully considered before embarking upon the path of legal recourse. Probably stating the obvious a bit, but the list of issues that passengers have with other passengers – and air crew (particularly those who talk loudly about the last exotic stay-over they have had and their love life) – is long and continues to grow.

However the most annoying issue for travellers is actually not on the aircraft.

TripAdvisor, the portal that collects feedback on travel, hotels, restaurants and so on, undertakes annual surveys to fi nd out what annoys – and pleases – travellers the most. The latest survey sprung one or two suprises.

The most annoying issue that TripAdvisor’s third survey found was, you guessed it: Fees. Checked baggage fees were the biggest naughty (46% of those surveyed), followed by 24% for seat selection fees and 18% for carry-on baggage fees.

Fifty six percent of travellers said they regularly carry on bags to avoid additional charges. An analysis of this trend would suggest that low cost carriers, in particular, are the main culprits as they seek to maximise profi ts through numerous add-ons to off set the lower basic fare. Of particular annoyance, through personal experience, is the habit of some airlines to include the extras in online check-in requiring customers to be fully alert to saying 'no' or face the fees being automatically charged.

A positive, for airlines and airports at least, from the TripAdvisor survey was that 51% of travellers were comfortable with airport security. In fact 82% of travellers in the United States would opt for a full body scan over a full body pat down at the airport, a sign that customers will accept any initiative that speeds up the security process despite misgivings amongst some people about civil liberties.

Another interesting, positive trend for travellers was the increased use of smart phones for fl ight planning (26%). Twenty-one percent use the phone to research fl ights but a lowly 5% researched and booked through the phone. This percentage is bound to increase, however, as countries like Japan and South Korea lead the way on smart phone booking and boarding, using bar code technology and avoiding the use of paper coupons.

Annoying Things

Now for some more annoying things. This is just a selection, but there are bound to be many more.

Be careful using your table tray to avoid annoying the person in front.•

Turn off your personal light if not in use.•

Limit conversation so others around you cannot hear.•

No fl atulence, except in the toilet! Do so at your own risk in the cabin.•

Limit the size of your carry-on baggage. •

If in an aisle seat, try to be courteous to those wishing to get into the • aisle. On a long fl ight it's human nature to want to go to the toilet (especially after one too many complimentary drinks).

Keep the window blinds down if on a window seat and everyone else • wants to sleep.

If you have dentures refrain from soaking them in a clear plastic cup and • placing them on the tray table next door (rare, perhaps, but it obviously has happened).

Cut down on the favourite perfume or aftershave for the fl ight. There's • nowhere to escape the smells.

If you're tall and in economy class be careful about jabbing the seat of • the person in front. Violence can erupt.

Put the seat back in the upright position if not trying to sleep.•

Large family groups who congregate noisily in one place are a no-no.•

Don't ask a fellow traveller to move somewhere else "so I can sit with my • friend".

Children and their parents.

Children are a special case in fl ights. Noisy, crying, out of control children are one of the most annoying issues raised by travellers.

Here are some suggestions for parents:

You, yes the parents, need to get a grip on your responsibilities in fl ight and pay more attention to your child’s needs than the next drink or infl ight movie (hard to believe but neglect of a bawling kid is common).

Much more can be done by airports to help parents, who, after all, generally don’t want to upset other people and are normally embarrassed by childrens’ behaviour on board, even though the child, most of the time, cannot help crying or running around. It’s what children do.

Airports, for example, could invest in specifi c, secure children play areas to tire little Johnny and Jenny out before the fl ight. Some airports are working on this. If such an area is not available, the airport terminal itself can be a giant playground. Hide and seek around the chairs, for example. The big problem here is another danger of air travel with children: they get lost.

If you're travelling business class with children, some airlines, like Thai Airways International at Suvarnabhumi Airport, have play rooms where small children can safely play by themselves and be ready to sleep later.

Whatever the land or air facilities, travelling is an exciting experience for most people, especially those on holiday, but it is up to individuals to decide how enjoyable the journey will be for fellow-travellers.

Feature

If you're over 182cm [6ft], have small kids, are on an aisle seat, talk a lot, wear expensive perfume or after shave, take your teeth out to eat, carry on large baggage and are inclined to fl atulence then you are potentially in big trouble when you travel long distances on an aircraft.

Phuket Aquarium at Cape PanwaWhether you confi ne yourself to a walk along the beach or engage in swimming, snorkeling and scuba-diving, there’s no doubt that marine-related activities are one of the prime attractions for visitors to Phuket.

For those who are inclined to do their research in a more leisurely style, or who would like to know more about Phuket’s surrounding waters and its marine life, the Phuket Aquarium is the answer.

The aquarium, which is also a marine life research centre, is located right on the tip of Cape Panwa and is a 13-kilometre drive from Phuket City. There’s a local bus service to the aquarium, which leaves Ranong Road daily from 9am to 3pm, every hour.

Explore the islandThere are many companies which off er island tours and these are a convenient and inexpensive way of seeing more of your holiday destination. However, if you have the time, why not rent a motorcycle or car and do a little exploring on your own? Your hotel or tour guide will be able to give you a road map, but you can’t really get lost. This is an island, so if you keep going you’ll eventually get back where you started! Follow the winding coast roads and discover isolated beaches which you can have all to yourself. Head inland and visit small farming communities where people still live in much the same way as they have for hundreds of years.

Please remember that you must wear a crash helmet when riding a motorcycle. For those of you who are visiting from Europe or the United States, please also note that we drive on the left here!

Motorcycle rentals start at 150 baht per day and small jeeps are available from 1000 baht per day. If you rent for a week or longer, you may be able to negotiate a better rate.

SnorkellingCrystal clear waters, beautiful coral reefs and a prolifi c marine life; it’s an underwater paradise. Snorkelling can be done all-year-round, but the best time is between November and April, when there’s very little rain, and the sea is calm. Freedom Beach, Laem Sing Beach, Ao Sane Beach, Kata Beach, Kata Noi Beach, Paradise Beach and Tri Trang Beach all off er good snorkelling. Coral Island, Racha Island, Kai Island, Phi Phi Islands and the Similans, can each be visited in a day. For some you’ll need an early start, and a fast boat that’ll set you back about 1,500 baht for the round trip.

T his outstanding event occurs each year as part of the Phuket yacht racing calendar. Combined with the other yacht racing events, they all are putting Phuket on the map as a location for sailing, and after-

racing parties. Phuket International Hospital has been providing emergency response services for these sailing regattas for over seven years, and during those years they have responded to many incidents, and luckily, only a few accidents. The most serious accident occurred a few years ago, when two yachts collided, crushing a crew member resulting in many fractures and a complicated extrication from the yacht to shore. Whilst not related to the actual sailing, deaths have also occurred. But much more common are those incidents related to the parties, and their eff ects on partygoers.

Six Senses Phuket RaceweekHealth Matters

Paracetamol and other hangover cures are liberally dispensed on shore by the nursing staff prior to the morning’s races. It is not uncommon to have a lineup of weary and ‘ill’ sailors, seeking attention as a result of overindulging in the copious amounts of alcohol and festive activities of the previous evening. Sailing regattas in Phuket have a reputation for being fun, and it cannot be disputed that Phuket Raceweek has some of the best. Alcohol and sailing do not mix though, and for those who are still intoxicated, sailing is not advised.

Dehydration – and alcohol does dehydrate the body – is exacerbated when performing physical activity such as sailing in the balmy tropical weather conditions that Phuket off ers. As with all outdoor activities in Phuket, drinking copious amounts of non-alcoholic fl uids, and a daily sachet of 'oral rehydration salts', or ORS as it is commonly called, is recommended. If you are not urinating at least every three hours, you are not drinking enough fl uid.

Phuket’s sun is also fi erce, even with the cloud cover typical at this time of year. Sunburn is another common ailment treated by the nurses, and another ailment that with some preventative measures can be avoided. It is simple to apply some suntan lotion, wear appropriate clothing and a hat, but you would be surprised how many of those going sailing do not do this, and how many by the end of racing look bright red – and not because of overindulgence at the parties. It is worth noting that anecdotal evidence suggests that sailors have a higher incident of skin cancer, due to a long history of being exposed to the sun’s rays without coverage.

Whilst discussing burns, every experienced sailor has at some time had rope burns, most likely caused by inexperience or when the sheets or halyards have been ripped through hands causing considerable friction on the skin, thus the burns. Like any burn, water is the treatment of choice, in order to cool the burnt area and bring the skin’s temperature back to 37 degrees Celsius. Preventative measures such as wearing sailing gloves whilst racing is also advisable, particularly for the inexperienced sailor.

Most skippers also want their racing vessels to be light, and the diehard skipper will take all non essential items off his yacht in an eff ort to get more speed and a podium place. One essential piece of equipment that should not be removed is the First Aid Kit, but I am surprised how many yachts do not have one. Essential items such as bandages and dressings should be carried, as well as vinegar for treating jelly fi sh stings, and a fi rst aid manual which can act as a reference for treating various situations correctly.

Dramamine is a drug readily available in most Phuket pharmacies and is an ideal treatment for sea or motion sickness. When people become sea sick, they usually take some form of medication but in the case of Dramamine, it can take up to 2 hours for the body to absorb the drug and become eff ective when taken in tablet form. If you are prone to sea sickness, take Dramamine well before going out on the water, even consider taking a tablet the night before, and another the next day, to ensure that the therapeutic dose is reached and maintained. If you become sea sick, and need the Dramamine to work quickly, don’t swallow the tablet, but chew it and leave it in your mouth and under your tongue, as this allows your body to absorb the drug faster than through the digestive system.

In the inner ear, sea sickness aff ects the sense of balance and equilibrium, as well as the sense of spatial orientation. Dramamine eff ectively blocks the working of the inner ear, thus reducing motion sickness. Going below deck is not recommended, as sea sickness is improved if you focus continually on the horizon, thereby stabilising the brain on a fi xed location. If you must lie down, do it on your back, with your eyes closed, or better still, keep active, and try to keep your brain focused on other tasks.

Fair winds and following seas.
