MADRID PROTOCOL TEAM• PromotionoftheMadridProtocolsysteminSouthAmericancountries,
insupportofWIPO’sinitiativesandincoordinationwithotherIP
organisations:abreakthroughoccurredthisyearwiththeapprovalof
theProtocolbytheColombianSenate,meaningthatColombiawillsoon
becomethefirstSouthAmericancountrytojointheinternationaltrade
marksystem.
• BroadeningofTeammissiontopromotetheMadridSysteminany
countriesthatarestillnotmembers(theTeamwasformerlynamedthe
ProtocolinSouthAmericaTeam).PrioritiesincludetheAseancountries
andarepresentativeofCouncilworkingwiththeTeamjoinedaWIPO-
sponsoredmissiontoThailandandthePhilippinestodiscusslatest
developments.MARQUESisalsodiscussingjoiningamissiontoMalaysia
andIndonesialaterthisyear.
REGULATORY TEAM• Deliveryofaworkshoponbrandsandproductplacementrules
worldwideatthe2011AnnualConference:theTeamhasgathered
informationonproductplacementadvertisingrequirementsfromabroad
selectionofcountriesorterritories.Thepresentationwilladdressmany
typesofmediainwhichproductsmaybedisplayed,andwillprovidea
startingpointforthosewhodealwithplacementoftheircompany’sor
clients’goods.
• SubmissionofpositionpaperstotheEUCommission,aswellasthe
Australiangovernment,ontheproposedplainpackagingregulationsin
theseregions.Thesesubmissionsobjectedtothelossoftrademarkrights
thatplainpackagingwouldcauseandtheconflictsbetweentrade
markrightsunderexistinginternationaltreatiesandtheproposedplain
packagingregulations.
STUDY TASK FORCE TEAM• AssistingthepreparationofcommentsontheOHIMStrategicPlan,
inFebruary2011,broadlywelcomingtheproposalsand
highlightingtheneedfortransparency,efficiency,consistency
andcontinuingconsultation.
• Submissionofdetailedpoint-by-pointcommentsinresponsetotheMax
PlanckInstitutestudyonthetrademarksysteminEuropeand
attendanceatameetingofusersinBrussels.

European Union activitiesMARQUEShasbeencloselyengagedwithEuropeanCommission
IPpoliciesandhasregularlyprovidedresponsestoconsultations
launchedbytheCommissioninconnectionwithIPRprotection
andenforcementmatters,notablyontheEuropeanCommission’s
Reportontheenforcementofintellectualpropertyrightsand
theplannedreviewoftheTobaccoDirective,criticisingtheplan
tointroduceplainorgenericpackaging.Commentswerealso
addressedtotheAustralianGovernmentandMPsregardingthe
proposalthisyeartopassaplainpackagingbillinParliament.
MARQUESparticipatedintheRANDEuropesurveyrunonbehalfoftheEuropeanCommissionregardingastudyonamethodology
forcounterfeitingandpiracyinEurope,inMarchthisyear.Areview
oftheEuropeanCommission’sproposalforaRegulationentrusting
themanagementoftheObservatorytoOHIMandofanother
concerningcustomsenforcementofintellectualpropertyrights
isongoing.
MARQUESreceivedconfirmationofitsappointmentasamember
oftheObservatoryonCounterfeitingandPiracy.NextOctober,
MARQUESwillattendthemeetingoftheprivatesectormembersof
theObservatory,organisedbyDGMarkt,withaviewtoupdating
themembersonprogressoftheObservatorydraftRegulation,the
