CALL TO ORDER

John T. Daniel, M.D., President of the Board of Medical Examiners of the State of North

Carolina, called the meeting to order at 7:30 p.m. , at the Raleigh Marriott, Raleigh, North

Carolina.

The Board members present at this meeting included: Nicholas Emanuel Stratas, M.D.,Secretary; Eben Alexander, Jr. , M.D.; Harold L. Godwin, Jr. , M.D., Hector Himel Henry, II,M.D.; John Wesley Nance, M.D.; F.M. Sinumons Patterson, Jr. , M.D.; and Mrs. Kathryn

Howell Willis.

Staff members present included: Bryant D. Paris, Jr. ; Donald R. Pittman; William H.Breeze, Jr. ; Robert J. Broyles; L. D. Beaver; Kathy Burke; and Betty Ann Preston.

HITE, Donald Blanding, M.D. - Greenville, SC

On January 25, 1990 the Board of Medical Examiners of the State of North Carolina held a

hearing on the Notice of Charges and Allegations against Dr. Hite dated November 29,1989. Dr. Hite was not present at this hearing.

At the conclusion of these proceedings, on January 27, 1990, the Board of MedicalExaminers unanimously adopted a motion made by Dr. Henry and seconded by Dr.Patterson that the Board revoke Dr. Hite's license to practice medicine in the State of North

Carolina.

PIGG, William Larry, M.D. - St. Marie, MT

On January 25, 1990 the Board of Medical Examiners of the State of North Carolina held a

hearing on the Notice of Charges and Allegations against Dr. Pigg dated November 29,1989. Dr. Pigg was not present at this hearing.

At the conclusion of these proceedings, on January 27, 1990, the Board of MedicalExaminers unanimously adopted a motion made by Dr. Henry and seconded by Dr.Patterson that the Board revoke Dr. Pigg's license to practice medicine in the State of NorthCarolina.

CULCLASURE, John Weeks, M.D. —Silver Spring, MD

On January 26, 1990, the Board adopted a motion made by Dr. Godwin and seconded by Dr.Stratas that Dr. Culclasure be granted a two-year temporary license, expiration date January

31, 1992.

On January 27, 1990, the Board adopted a motion made by Dr. Patterson and seconded byDr. Stratas that Dr. Shaftner be granted a one-year extension of his temporary license,expiration date January 31, 1991, and limited to his working no more than forty (40) hoursper week.

BEAVERS, Carl Michael, M.D. - Chapel Hill, NC

On January 27, 1990, the Board adopted a motion made by Dr. Alexander and seconded byDr. Nance (Dr. Stratas, Dr. Godwin and Dr. Patterson voted in opposition to this motion)that the Board grant an extension to Dr. Beavers' temporary license, expiration date August31, 1990.

On January 25, 1990, the Board adopted a motion made by Dr. Patterson and seconded byDr. Godwin (Dr. Henry voted in opposition to this motion) that the Board grant Dr. Tope atemporary license, expiration date May 31, 1990, limited to the practice of medicine at CapeFear Valley Medical Center.

THE INTERNAL MEDICINE CENTER

On January 25 1990 the Board of Medical Exatniners unanimously adopted a motion made

by Dr. Alexander and seconded by Dr. Patterson that the Board's original decision in this

matter stands and that the president of the corporation and his attorney be invited for an

infom&al interview as time permits. The Board also instructed Mr. Paris to review the

regulations regarding corporations.

SOUTHEAST INST1TUTE FOR VISION CARE, INC.

Qn January 25, 1990, the Board of Medical Examiners unanimously adopted a motion made

by Dr. Stratas and seconded by Dr. Patterson that the Board deny the use of this corporate

name.

ROSTER QUESTION

On January 25, 1990, the Board of Medical Examiners unanimously adopted a motion made

by Dr. Stratas and seconded by Dr. Patterson that the Board approve the inclusion of the

license number for each physician in the upcoming Roster of Registered Physicians.

CRIIVIINAL PENALTIES FOR SEXUAL EXPLOITATION OF PATIENTS

On January 25, 1990, Dr. Stratas commented that in many states it is a criminal offense for a

physician to have intercourse with patients. Mr. Weddington indicated that it would be a

help to the Board if there was a statute in North Carolina. It would make the Board's

regulatory function much easier and it would get a message across to the community.

On January 25, 1990, a Task Force consisting of. Dr. Stratas, Mr. Paris and Mr. Breeze was

formed to review this matter and to report back to the Board at its March 1990 meeting.

Dr. Stratas: We need to be more visible. The public needs to know they have

access to us.

Dr. Henry:

Dr. Stratas:

The people need to know we are here to protect them, not the

doctors. Maybe we can get an information packet to the press.

I am asking Mr. Paris and Mr. Weddington to draft a letter to the

editor which would have the substance of what Hector just said

which we could mail out. We do need people to complain, etc.

On January 25, 1990, the Board of Medical Examiners'unanimously adopted a motion made

by Dr. Stratas and seconded by Dr. Godwin that the Board accept this report as information.

On January 25, 1990, the Board of Medical Examiners unanimously adopted a motion made

by Dr. Patterson and seconded by Dr. Henry that the Board adopt the following as a result of

the Administrative Rule Hearing held on December 1, 1989:

(1) "Practitioner" means any person authorized to issue prescriptions for

controlled substances or mind-altering chemicals.

(2) "Prescription" means an order for controlled substances or mind-altering

chemicals for a patient.

.0002 PRESCRIPTIONS(a) Written prescriptions for controlled substances or mind-altering chemicals

shall be written with ink or indelible pencil or typewritten and shall be

manually signed by the practitioner at the time of issuance.

(b) No prescription for controlled substances or mind-altering chemicals may be

issued for a patient in the absence of a documented physician-patient

relationship.

(c) No prescription for controlled substances or mind-altering chemicals may be

issued by a practitioner for himself.

REINSTATEMENT OF LICENSES SUSPENDED FOR FAILURE TO REGISTER

On January 25, 1990, the Board of Medical Examiners of the State of North Carolina

unanimously adopted a motion made by Dr. Alexander and seconded by Dr. Godwin that the

Board approve the reinstatement of the license suspended for failure to register of the

On January 27, 1990, the Board of Medical Examiners unanimously adopted a motion made

by Dr. Patterson and seconded by Dr. Stratas that this matter be referred to the Board of

Nursing.

On January 25, 1990, the Board of Medical Examiners unanhnously adopted a motion made

by Dr. Godwin and seconded by Dr. Alexander that the Mr. Paris correspond with the deans

of the medical schools informing them that any changes in a resident's status must be

reported as does a change in staff privileges of physicians.

On January 26, 1990, the Board of Medical Examiners unanimously adopted a motion made

by Dr. Patterson and seconded by Dr. Alexander that the Board deny the request from the

Board of Nursing to add Acylovir, Clindamycin, Minocycline and Amantadine to the

Approved FonTiulary used by Nurse Practitioners, Physician Assistants and Certified Nurse

Midwives.

VI. N.C. ACADEMY OF PHYSICIAN ASSISTANTS

Upon consideration of the NCAPA request for quarterly meetings with the PASubcorruiuttee Chairiiian and Board staff, the Board adopted a motion that Dr. Henry

and the staff will be happy to meet with representatives of the NCAPA as necessary to

discuss matters of mutual concern; however, the scheduling will be at the discretion ofthe Chairirian of the PA Subcomnuttee.

VII. PA RULE HEARING

The staff reported that the administrative hearing for the PA rules is scheduled forMonday, March 5, 1990, at 1:30 p.m, at the Real Estate Commission's hearing roomacross the hall from the Board's offices. Dr. Henry will serve as hearing officer.

The PA Subcommittee instructed the staff to begin working on proposed applicationchanges, specifically, wording changes in the background questions to be answered byPAs and primary physicians; and that these changes be reviewed by the Board'sattorney, Mike Weddington, before being presented to the Board for consideration.

Dr. Nance, the Board's Liaison Representative to the Office of Emergency MedicalServices, presented the ALS application report to the full Board.

by Dr. Nance and seconded by Dr. Godwin that the Board approve the 211 initial

applications and 131 recertification applications for Advanced Life Support personnelsubmitted by the Office of Emergency Medical Services. Mr. Breeze each of the cases identified so that Mr. Breeze can obtain the necessary records,

NC DEPARTMENT OF CORRECTIONS

On January 27, 1990, the Board reviewed the "standing orders protocol" used by theDepartment of Corrections for care rendered by nurses to inmates in the various prisonfangs. The nurses providing this care are not nurses who have been trained as nursepractitioners.
