    Signature of

    SCOPE OF WORK 

    The scope of work for the bidder under this project includes Design, Construction,

    erection, testing and commissioning of 1 !"D #TP based on #e$uential %atch

    &eactor Technolog' (#%&) including cost of all associated ci*il, mechanical,

    electrical and instrumentation items of work etc+ including miscellaneous worksassociated with plant on turnke' basis, with a defect liabilit' period of months

    after the date of commissioning . Trial run for / months+ #cope of work also

    includes . ! of plant for 'ears after trial run+

    The *arious components for which the bidder has to submit his technical proposal

    and price bid are gi*en in section below+ The bidder shall prepare his bid on the

     basis of technical specifications for Ci*il ork, 2lectrical . !echanical works+

    5.3 Component

    i) Design . Construction of complete s'stem including ci*il, electrical . mechanical

    works for all the units and all the ancillar' structures as per detailed technical

    specification++

    ii) Pro*iding and construction of 1 mld #TP based on #%& technolog'+ 3ncluding all

    interconnecting piping works, necessar' building works mentioned in la'out plan,

    all electrical . mechanical works+

    i*) peration . maintenance of 1 mld capacit' #TP, #ewage Pumping #tation all

    electro-mechanical e$uipment and allied works for 'ears+

    *) The contractor shall be responsible for taking electric connection as per re$uirement

    for which the re$uisite fee shall be paid b' the contractor itself and the same will bereimbursed afterwards b' !C4+ #imilarl', the electric bills shall be paid b'

    contractor and thereafter reimbursed b' !C4

    *i) The contractor shall be responsible for getting en*ironment clearance from

    Pollution control board for which the re$uisite fee shall be paid b' the contractor 

    and the same will be reimbursed afterwards b' !C4

    *ii) Pro*iding $ualified and e5perienced consultant e5clusi*el' to !C4 who will assist

    them for checking and appro*al of design and drawing and also for e5ecution of 

    work+ The scope of work of consultant shall be defined separatel' in this *olume+

    The contractor shall submit a panel of consultants after award of the job and !C4

    shall select appropriate consultant from the panel+ Pa'ment of consultants6 fees

    would be the responsibilit' of contractor, which shall be ma5imum up to 17 of 

     price $uoted for #TP+ 4owe*er, being a principal emplo'er, !C4 shall ha*e rightto ensure timel' pa'ment to consultant b' the contractor for which successful

     bidders shall submit proof of pa'ments to !C4 while raising the bill+

    The consultant shall ha*e e5perience of designing and detailed engineering of 

    minimum nos+ of sewage treatment plants up to minimum 8+0 !"D capacities in

    last 10 'ears+ 4e should also ha*e an e5perience of three 'ears in operation and

    maintenance of sewage treatment plant of 8+0 !"D or more in last 1 'ears+ 4e

    should ha*e the following technical personnel for the design 9 appro*al of the

    engineering9 drawing+

    ✓ Process engineer 9 2n*ironmental 2ngineer : The 2ngineer shall be post graduate inthe en*ironmental engineering with min+ 1 'ears of e5perience in the design of 

    sewage 9 water 9 waste water treatment plants+

    ✓ #tructural 2ngineer: The 2ngineer shall be post graduate in the structuralengineering with minimum 1 'ears of e5perience in the design of sewage 9 water 9

    waste water treatment plants+

    ✓ !echanical 2ngineer: The 2ngineer shall be post graduate in the mechanicalengineering with minimum 10 'ears of e5perience in the design of sewage 9 water 9

    waste water treatment plants+

    ✓ 2lectrical92lectronics9 instrumentation 2ngineer : The engineer shall be graduate inthe electrical 9 instrumentation engineering with minimum 10 'ears of e5perience

    in the design9 e5ecution of sewage 9 water 9 waste water treatment plants+

    ;n' other 3tems which ha*e not been specificall' mentioned in specifications but are

    necessar' for construction of the Plant as per good engineering practice, safet' norms and

    successful operation and guaranteed performance of the entire Plant shall be deemed to be

    included within #cope of ork and shall be pro*ided b' the Contractor without an' e5tra

    cost to the 2mplo'er+

    The %idders are ad*ised to *isit the #TP site before $uoting for the proposed #TP+ !C4 is

    reser*ed the right for ph'sical *erification for the credentials pro*ided b' the bidder if 

    re$uired+ 3n such case all the e5penses shall be borne b' the bidder+

    The abo*e works shall be completed within 1 months from the commencement date

    including / months trial run and including monsoon period and . ! for

    e$uipment supplied+

    Detailed structural drawings of all the structures+

    • ;ll &CC structures shall be in !- and designed as per latest rele*ant 3# Codes+

    • Proper earth$uake anal'sis of o*er ground structures should be carried out+ hile

    designing these structures under seismic condition due attention to be paid towards

    //+/7 o*er stressing of structural materials and 7 o*erestimation of net bearing

    capacit' of soil+

    • hile designing retaining walls effect of sub-soil water, possible surcharge and

    seismic effect of retained earth mass to be considered+

    • %earing capacit' of soil at the site of #TP is assumed about 10 @ 0 !T 9 #$m,

    howe*er the contractor shall get it tested and account for the same in *arious

    structural design+

    • The contractor shall make all arrangement for the water for construction purposes

    and shall get water tested at his own cost+

    • The contractor shall make own arrangements for power suppl' for construction

     purposes . for testing purposes howe*er department shall assist him for obtaining

    such Power connection+

    • During the trial run period of #TP, the bidder shall pro*ide all the re$uired man-

     power, consumables, repair and up-keep of ci*il, electrical, mechanical and

    instrumentation works within the #TP, and also 2lectricit' charges during Trial &un

     period shall be borne b' the contractor+

    • During the trial run period, the bidder shall install and operate a generator set of 

    ade$uate capacit' to cater to the minimum load of the #TP and the pumping station

    in case of power failures 9 load shedding+

    • The bidder 9 tenderer shall suppl' all e$uipment drawings, Technical specification9

    Catalogue of all electrical, mechanical and instrumentation works associated with

    #TP+

    • Carr'ing out . confirming the detailed topographical sur*e' along finali?ed

    Bra*it' main9&ising main alignment, and treatment plant site, and establishing

     bench marks at least two locations within the #TP site and one at s pumping station

    site+

    • The contractor will also pro*ide luminous painted warning 9 caution notice boards

    with flickering light arrangements, where the work is in progress+

    • The sub-soil water is likel' to be encounter during e5ca*ation at the #TP site+ The

    Contractor is ad*ised to carr' out its own in*estigations and gather information on

    the water table9subsoil conditions+ The suitable and appro*ed dewatering s'stem

    should be adopted for e5ecution of work+ >othing e5tra shall be paid on this

    account+

    • The sub-soil water pumped will be drained off to the proper disposal pointscontractor will ha*e to make arrangements to disposal off the pumped sub-soil

    water to satisfaction of 2ngineer in charge9!C4 and nothing e5tra for dewatering

    of sub-soil water drain etc+ will be paid+

    • 3f as result of e5ca*ation of trenches, the underground ser*ices such as water,

    mains, electric-poles, cables, telephone cables and sewer lines etc+, become e5posed

    and un-supported it will be the responsibilit' of the contractor to make suitable .

    necessar' arrangement for supporting and to keep them functional such

    arrangement will be done as per directions of the 2ngineer-in-Charge 9 !C4+ >o

     pa'ment for supporting such utilit' ser*ices will be made b' the !C4+ ;n'damage caused to the abo*e mentioned underground ser*ices due to negligence of 

    the contractor or otherwise shall be made good b' the contractor at his own cost+

    • The contractor shall ha*e to make his own arrangements for labour camp site and

    its hutments+ n completion of work, these shall be remo*ed b' the contractor,

    failing which the !C4 will arrange to dismantle the same at the risk and cost of 

    the contractor and the dismantled material will become the propert' of the !C4

    for which the contractor shall ha*e no legal claim+ The e5penditure so incurred

    will be reco*ered from the dues of the contractor+ The contractor shall also be

    responsible for keeping all h'gienic conditions in his labour camp 9 hutments as

    desired b' "ocal 4ealth ;uthorities+

    • The contractor shall take all precautions for the safet' of e5isting nearb'9adjoining

    main or lateral sewers and dewatering e$uipment shall be kept as a standb' in

    *iew the e5isting sewer lines+

    • The contractor will pro*ide a board indicating the name of work, name of 

    contractor, name of di*ision, cost of work, date of start, date of completion

    telephone number etc+, at site at his own cost and nothing will be paid b' the

    !C4 on this account+

    • ;ll the ci*il works under this contract shall be e5ecuted in conformit' of PD,

    CPD specifications, CP422 Buidelines and rele*ant9applicable %3# codes

    (latest re*isions), with up to date correction slips+• The contractor will be solel' responsible for an' mishaps, during the e5ecution

    of the work+ The contractor must get his labour insured before the start of work,

    for the entire period of completion of work+

    • The contractor shall not disturb9damage or pull down an' hedge, tree, building

    etc within the site or his area of operation without the written permission of the

    2ngineer-in-Charge here*er there is an' clash among the certain clauses of the

    conditions of contract, general conditions, special conditions and general notes 9

    rules and directions for the guidance of the contractor, etc+ the most stringent will

    go*ern for which the decision of the 2ngineer in Charge 9 !C4 shall be final .

    8 ELIGIBILI! CRIERI"#

    The contractor meeting following re$uirement will onl' be considered:

    (a) The bidder should ha*e successfull' completed and commissioned during past fi*e

    'ears i+e+ after 1st ;pril, 00A one #TP9#TP of minimum 8+0 !"D capacit'

    #e$uential %atch &eactor (#%&) Technolog' along with successful operation .

    maintenance of #TP for at least one 'ear as on date of receipt of Pre$ualification

    document+

     >ote :-

    Certificate issued b' Bo*t+ of 3ndia, #tate Bo*t+, nion Territor', Bo*t+

    ndertakings, ;utonomous %odies shall onl' be considered+

     Note :-

    i.  Experience certificate as referred above should include work order no. and 

    date, amount, date of start, actual date of completion, year of 

    commissioning, duration of O! with specific mention of successful O! 

     period of "#$. %idder may also provide details of various components of 

    "#$ completed by him. %idder shall also enclose copy of work order for 

    construction of "#$ and O! $art 

    ii.  Experience certificate submitted by firm as &oint-venture, shall not be

    considered 

    iii.  'or the purpose of O! experience for a minimum period of ( year,

    bidder may submit certificate for other "#$ of same criteria, which may

    not have been constructed or completed by him.

    iv.  'or the purpose of bid evaluation, if the owner)owner*s representatives feel 

    necessary to visit a specific or all such plants as mentioned above by the

    bidder, the bidder shall make necessary arrangements for the same. #he cost 

    of such visits shall be borne by the owner.

    Financia$ Criteria#%

    (b) The bidder should ha*e completed at least one similar nature work in last Three

    financial 'ears (including current 'ear, if opted b' the bidder) of *alue not less

    than 0 7 of the 2stimated Cost of the work (bid cost) updated to present price

    le*el

    The bidder is ad*ised to *isit and e5amine the #ite of orks and its surroundings

    and obtain for itself on its own responsibilit' all information that ma' be

    necessar' for preparing the bid and entering into a contract for the design-build

    and completion of the orks+ The bidder has to make his own assessment of the

    scope of work under this tender and no claims whatsoe*er shall be entertained

    for lack of understanding of the scope and 9 or implications arising out of it+ The

    costs of *isiting the #ite 9 testing if re$uired or an' other cost shall be at the

     bidderEs own e5pense+

    The bidder and an' of its personnel or agents will be granted permission b' the

    2mplo'er to enter upon its premises and lands for the purpose of such

    inspection, but onl' upon the e5press condition that the bidder, its personnel and

    agents, will release and indemnif' the 2mplo'er and its personnel and agents

    from and against all liabilit' in respect thereof and will be responsible for death

    or personal injur', loss of or damage to propert' and an' other loss, damage,

    costs and e5penses incurred as a result of the inspection+

    The 2mplo'er ma' conduct a site *isit concurrentl' with the pre-bid meeting, if

     possible+

    The bidder is e5pected to e5amine carefull' the contents of the %id document+

    Failure to compl' with the re$uirements of bid submission will be at the bidderEs

    own risk+

    The original cop' of the bid shall be t'ped or written in indelible ink, and shall

    The bid shall contain no alterations, omissions or additions, e5cept those to

    7E9uipment7 means the apparatus, machiner', articles and things of all kinds to be

     pro*ided under the contract or intended to form or forming part of the permanent works+

    7Contractor8 ,ocument87 means the calculations, computer programs and other 

    software, drawings, manuals, models and other documents of the technical nature supplied

     b' the contractor under the contract as described in sub clause GContractors DocumentsH+

    7Specification87 means the specifications according to which the works are to be

    e5ecuted as referred to in the agreement documents and an' other specifications agreed

    thereon+

    Contract price6 means the sum $uoted in the tender subject to such additions thereto or 

    deduction there from as ma' be made under the pro*isions contained in the contract and

    as defined in Volume 3V of tender Document+

    *O+0L! REPORS

    !onthl' progress reports shall be prepared b' the Contractor and submitted to !C4 in

    si5 copies+ The first report shall co*er the period up to the end of the first calendar month

    following the commencement date+ &eports shall be submitted monthl' thereafter, each

    within 8 da's after the last da' of the month to which it relates+

    &eporting shall continue until the contractor has completed all work+

    2ach &eport shall include the issues desired b' the 2ngineer in Charge, which shall be an'

    of the following:

    • Charts (P2&T . CP!) 9 detailed descriptions of progress, including each

    stage of design Contractor6s Document, procurement, manufacturing,deli*er' to site of construction, direction, testing, commissioning and the

    trial operation

    • Photographs showing status of manufacture and of progress on the site

    • For the manufacture of each main item of e$uipment and materials, the

    name of the manufacturer, manufacture location, percentage progress, and

    the actual or e5pected dates of:

    • Commencement of manufacturing

    Comparisons of actual and planned progress, with the details of an' e*entsor circumstances which ma' jeopardi?e the completion in accordance with

    the contract, and the measures being (or to be) adopted to o*ercome dela's+

    • ;n' other issues deemed necessar' b' the 2ngineer in Charge

    *eeting

    !eetings shall be held in the office of !C4, with prior notice gi*en b' 2ngineer in

    Charge+ The proposed agenda for the meetings shall be e5changed at least 1 week in

    ad*ance+ 3t is re$uired that a decision-maker of the Contractor is present at the meetings so

    that binding decisions can be taken about outstanding issues+ Benerall', the following

    issues shall be discussed:

    ➢ Progress of the work, difficulties

    ➢ re*ision of time schedule

    ➢ Pa'ment issues

    ➢ Disputes

    ➢ Claims

    ➢ ;n' other issue deemed necessar' b' contractor or !C4

    3. 0E CO+R"COR 

    C>T&;CT&E# B2>2&;" %"3B;T3>#:

    The contractor shall design the complete s'stem of treatment plants including planning design and construction of all units, e5ecute and complete the works

    in accordance with the contract, and shall remed' an' defects in the works+

    The contractor shall conduct sur*e' . *erif' the le*els of the proposed

    s'stem(s)

    3n addition to the abo*e, the contractor is also re$uired to confirm the a*ailabilit'

    of the material re$uired for the contract in the time schedule gi*en herein

    after, so as to complete the job within the prescribed time+ >o time e5tension

    shall be pro*ided on this account+ 3f re$uired under such circumstances, the

    contract after prior appro*al of !C4 shall be allowed to use superior t'pe of 

    material so as to complete the job within the prescribed time+ >o additional

     pa'ments shall be made on account of use of superior $ualit' material, on this

    account+

    The Contractor shall pro*ide the e$uipment and ContractorEs Documents

    specified in the contract, and all ContractorEs personnel, goods, consumables

    and other things and ser*ices, whether of a temporaril' or permanent nature,

    re$uired in and for this design, e5ecution, completion and remed'ing of 

    defects including . ! period for 'ears+

    The works shall include an' work, which is necessar' to satisf' the !C4Es

    re$uirements, or is implied b' the contract, and all works, which (although

    not mentioned in the contract) are necessar' for the completion, or safe and

     proper operation of the works+

    The Contractor shall be responsible for the ade$uac', stabilit' and the safet' of all site operations, of all methods of construction and of all the works+

    The Contractor shall pro*ide all facilities including con*e'ance re$uired for 

    *erification of sur*e' data, super*ision, $ualit' control tests, tests for 

    material, e$uipment and e$uipment(s), and9or all other facilities otherwise

    referred in the conditions of contract(s) and9or otherwise necessar' to

    complete the works with due super*ision of 2ngineer-in-charge+ The testing

    of material, $ualit' control tests, etc+ ma' be got done through go*ernment-

    recogni?ed labs after appro*al of 2ngineer-in- charge+

    The Contractor shall, whene*er re$uired b' the !C4, submit details of the

    arrangements and methods, which the contractor proposes to adopt for e5ecution of the works+ >o significant alteration to the arrangements and

    methods shall be made without this ha*ing pre*iousl' been notified to the

    !C4+

    The contractor shall also establish an acceptable and decent office premises for 

    the clientEs site office at the suitable location adjacent to the contractorEs site

    office nearb' with necessar' amenities as ma' be re$uired in running the site

    office+

    Contractor: Repreentati;e#

    The contractor shall appoint the ContractorEs &epresentati*e and shall gi*e them

    all authorit' necessar' to act on the contractorEs behalf under the contract+

    nless the ContractorEs &epresentati*e is named in the Contract, the Contractor 

    shall, prior to the Commencement Date, submit to the !C4 for consent the

    name and particulars of the person the Contractor proposes to appoint

    as ContractorEs

     &epresentati*e+ 3f consent is withheld or subse$uentl' re*oked, or if the appointed

     person fails to act as the ContractorEs &epresentati*e, the Contractor shall similarl'

    submit the name and particulars of another suitable person for such appointment+

    The Contractor shall not, without the prior consent of the !C4, re*oke the

    appointment of the ContractorEs &epresentati*e or appoint a replacement+

    The ContractorEs &epresentati*e shall, on behalf of the Contractor, recei*e instructions+

    The ContractorEs &epresentati*e ma' delegate an' powers, functions and

    authorit' to an' person, and ma' at an' time re*oke the delegation+ ;n'

    delegation or re*ocation shall not to take effect until the !C4 has recei*ed

     prior notice signed b' the ContractorEs &epresentati*e, naming the person

    and specif'ing the powers, functions and authorit' being delegated or 

    re*oked+

    hene*er ser*ices of contractor staff are found 9 noticed unsatisfactor' b' the

    !C4, the' shall be remo*ed 9 terminated b' the contractor immediatel' as

     per direction of 2ngineer in Charge+

    Setting Out#

    The contractor shall set out the works in relation to original points, lines and le*els of 

    reference specified in the contract+ The contractor shall be responsible for the correct

     positioning of all parts of the works, and shall rectif' an' error in the positions, le*els, the

    dimensions or alignment of the works+

    ure8#

    The contractor shall:

    (a) Take care for the safet' of all personEs entitled to be on the site,

    (b) Choose reasonable efforts to keep the site and work clear of unnecessar'

    obstruction so as to a*oid danger to these persons,

    (c) Pro*ide fencing, lighting, guarding and watching of the works until completion

    and its taking o*er b' the !C4 at end of . ! period+

    (d) Pro*ide an' temporar' works (including road wa's, foot wa's, guards and

    fences) which ma' be necessar', because of the e5ecution of works, for the use

    and protection of the public and of owners and occup' a ser*er adjacent land+

    ?ua$it= "urance#

    3n addition to the pro*isions of clause Beneral conditions of contract, the contractor shall

    institute a $ualit' assurance s'stem to demonstrate compliance with re$uirements of the

    contract+ The s'stem shall be in accordance with the details stated in the contract and the

    =ualit' ;ssurance Programme will be got appro*ed from the competent authorit'+ The

    !C4s shall be entitled to audit an' aspect of the s'stem+

    Tenderer must *isit the work site and see for himself the site and ground conditions in all

    respects including a*ailabilit' of labour (skilled and unskilled), approaches, a*ailabilit' of 

    water, electricit', materials, and all other matters affecting the work before submitting the

    tender+

    wner will not, therefore, after acceptance of the tender, pa' an' e5tra charges for an'

    reason whatsoe*er in case Contractor find later on to ha*e misjudged the site and other 

    conditions+

    @n%ForeeenaA$e ,ifficu$tie#

    The contractor shall be deemed to ha*e obtained all necessar' information as to risk,

    contingencies and other circumstances that ma' influence or affect the works i+e

    (a)  b' signing the contract, the contractor accepts the total responsibilit' for ha*ing

    sustained all difficulties and costs of successfull' completing the works: and

    (b) the contract price shall not be adjusted to take account of an' unforeseen

    difficulties or costs+

    Rig Faci$itie8

    (a) The Contractor shall bear all costs and charges for special and9or temporar' rights

    of a', which he ma' re$uire, including those for access to the site+ The

    contractor shall also obtain, at risk and costs, an' additional facilities outside the

    site which he ma' re$uire further purposes of the works+

    1A4 Contractor shall make his own arrangement for ater suppl'9electricit' at his own

    cost and nothing e5tra shall be paid b' the !C4

    The contractor shall not interfere unnecessaril' or improperl' with:

    (a) the con*enience of the public, or 

    (b) in the access to and use and occupation of all roads, e5isting electric and other 

    land, irrespecti*e of whether the' are public or in the possession of the !C4

    or others+

    (c) with the e5isting amenities, whether natural of man made+ >o tree shall be

    felled without permission of the 2ngineer6s &epresentati*e and clearance of the

    site shall generall' be kept to the minimum necessar' for the works and

    temporar' works+

    Works to be kept clear of water:

    The Contractor shall keep the works well drained until the 2ngineer certifies that thewhole of the works is substantiall' complete and shall ensure that so far as is practicable,

    all work is carried out in the dr'+ 25ca*ated areas shall be kept well drained and free from

    standing water+

    The Contractor shall construct, operate and maintain all temporar' dams, water-courses

    and other works of all kinds including pumping and well-point dewatering that ma' be

    necessar' to e5clude water from the works while the' are in progress and till the' are

    handed o*er to the De*elopment ;uthorit'+ This refers mainl' to surface water that ma'

    enter into the e5ca*ated construction work+ >o separate pa'ment will be made for such

    Contractor's Undertaking

    The design, the Contractor6s Documents, the e5ecution and the completed works shall

    compl' with the rele*ant standards, building, construction and en*ironmental laws, law as

    applicable to the product being produced from the works, and other standards specified in

    Samp$e8#

    The contractor shall submit samples to the 2ngineer-3n-Charge at his cost, for their inspection prior to dispatch for re*iew in accordance with the procedure

    laid down in ContractorEs Documents described in rele*ant sub-clause+

    3nspection and testing of pumps, motors, bulk meters, *al*es, control panels

    etc+ shall be done in the factor' before dispatch of the material+

    The !C46s Personnel or authori?ed representati*e shall at all reasonable times:

    (a) ha*e full access to all parts of the site and to all places from which natural materials are

     being obtained, and

    (b) during production, an effecti*e and construction (at the site and, to the e5tent specified inthe contract, elsewhere), be entitled to e5amine, inspect, measure and test the materials

    and workmanship, and to take the progress of manufacture of e$uipment and production

    and manufacture of materials+

    2$uipment of similar kind to be used in the contract shall be of same make

    unless specificall' appro*ed b' the 2ngineer-in-Charge+ nless specific

    appro*al of the 2ngineer- in-Charge is obtained, all e$uipment of one kind,

    to be used in the project, shall be offered for inspection in one lot+ 3f such

    e$uipment are offered in different piece meal lots, the cost of inspection of 

    material in smaller lots will be reco*ered from the contractor, and the dela'

    caused to the project on this ground, shall solel' be attributed to the account

    of the contractor+

    The cost of samples including transportation6s as well as of the testing shall be

     borne b' the contractor for the followings:

    (a) The collection . suppl' of the samples and carr'ing out of such tests is pro*ided for or

    clearl' intended in the contract, will be carried out either at site of work or manufacturerEs

     place or at laboratories at a place appro*ed b' the 2ngineer in charge+

    (b) The collection . suppl' of the samples and the carr'ing out of such tests if not pro*ided

    for or clearl' intended in the contract but on testing, the material is found defecti*e and

    has to be rejected+

    e8ting(i) The Contractor shall pro*ide all apparatus, assistance, documents and other 

    information, electricit', e$uipment, fuel, consumables, estimates, labour, materials,

    and suitabl' $ualified and e5perienced staff in relation to suppl' of material and

    are necessar' to carr' out the specified test efficientl'+ The Contractor shall agree,

    with the !C49third part', the time and place for the specified testing of an'

    e$uipment, materials and other parts of the works+

    (ii) The !C4 ma', *ar' the location or details of specified test, or instruct the

    Contractor to carr' out additional tests+ 3f these *aried or additional tests show that

    the tested e$uipment, materials or other workmanship is not in accordance with the

    contract than cost of testing to carr' out in this *ariation shall be borne b' the

    contractor, notwithstanding other pro*isions of the contract+

    (iii) 2ngineer-3n-Charge (client) or its representati*e shall ha*e the right to inspect and 9

    #pecifications shall specif' what inspections and tests the Purchaser re$uires and

    appro*al with 23C specif'ing the stages of inspection as per manufacturer6s $ualit'

     plan and shall arrange to carr' out the inspection along with 23C or it6srepresentati*e at manufacturer6s works as per the appro*ed plan+ The 23C

    Purchaser shall notif' the Contractor in writing of the identif'ing of an'

    representati*es retained for these purposes+ ;ll the e5penses *i?+ lodging .

     boarding, transportation, all facilities as re$uired shall be borne b' the successful

    tenderer+

    (i*) The testing of materials and work where necessar' shall be carried out in

    accordance with the most recent standards or Tentati*e #tandard !ethods of %ureau

    of 3ndian #tandards institution current on the date fi5ed for opening of the tender+ 3f 

    no such standard e5ists for a particular test, the standard method as laid down b' the

    %ritish #tandard 3nstitution or b' ;merican ;ssociation of #tate 4ighwa' officials

    or the ;merican #ociet' or other suitable organi?ation for testing of materials, will be used at the discretion of the 2ngineer in charge+ 4e ma' also adopt an' other 

    suitable method at his discretion+

    (*) The Contractor shall promptl' forward dul' certified reports of the tests to the

    !CV4+ hen the specified test has been passed, the !C4 shall endorse the

    ContractorEs test certificate, or issue a certificate to him, to that effect+

    (*i) The contractor shall establish a small laborator' at site where routine testing of 

    materials of concrete, asphalt etc+ can be done to the e5tent feasible+ 4e shall

    indicate in his tender the scope of laborator' that he intends to establish on work 

    site+ The charges for the same shall be born b' the contractor+

    The testing of material during construction acti*ities on time to time basis shall also be

    carried out from the appro*ed laborator'9 Testing #tation as per the schedule decided b'

    The whole of the ork, including mobili?ation, reconnaissance, in*estigations, design,

    manufacturing, transportation, construction, installation . testing, commissioning, trial

    runs, and demobili?ation has to be completed within a period of A months calculated from

    the commencement date, which is 10 da's after the written order to commence the ork+

    The duration of the performance run, tests and trial run is included in the completion

     period, defined in Beneral Conditions of Contract++ The contractor shall submit a detailedtime schedule for all the acti*ities to be completed under the contract+ 3f re$uired this

    schedule shall be updated in each monthl' meeting+ 4owe*er, this time schedule shall not

     bear an' implications on the pro*isions of clause of Beneral Conditions of Contract+

    Comp$etion of WorD an> Fu$$= Commi88ioning

    (i) 3mmediatel' after the ph'sical completion, the work of testing and commissioning

    the entire s'stem on design conditions as per the procedure of test gi*en in Volume

    3 I#cope of ork . Technical #pecificationsJ shall be taken up+ nce the entire

    s'stem has been successfull' tested and commissioned and trial run of three

    months as per the conditions of contract, the . ! period shall commence+ ;fter 

    successful completion of the trial run period of three month, and remo*al of all*isible defects to the satisfaction of 2ngineer-in-Charge, the work shall be treated

    as ICompletedJ+

    nless otherwise pro*ided in the contract, after the successful completion of the

    testing and three month trial run for the entire s'stem, the 2ngineer-in-charge shall

    issue a certificate of ICompletion of orkJ+ The date of Certificate notif'ing

    calamities+ During the defect liabilit' period the contract has to

    Constructional defect such as defects due to premature use of materials, works not

    disco*ered during inspection and testing, fault in design, manufacturing, erection and inconstruction shall be pointed out b' the 23C and shall ha*e to be rectified b' the

    contractor during this period+ The cost for repair material, spare arts, transport, repairs,

    tests and repair staff shall ha*e to be borne b' the contractor+ 3f the Contractor fails to

    rectif' the defect within a period of 1 da's after aforesaid notice, the 2ngineer in Charge

    ma' forfeit the securit' deposit or an amount thereof re$uired for the rectification through

    a third part' without prejudice to an' other right the !C4 ma' ha*e against the

    Contractor in respect of his failure to remed' such defects+

    3n the case of dela'ed ICompletion of orkJ not caused b' the Contractor, the defects

    liabilit' period shall be e5tended accordingl' but not more than three (/) 'ears after the

    total ph'sical completion of the entire ork, whiche*er is earlier+

    The submission of the as-built drawings for the e$uipment is the precondition for the final

     pa'ment+ The final drawings shall be submitted in one reproducible set and copies on

    linen bound in an album of an appro*ed si?e+ The contractor shall submit all the

    completion drawings and appro*ed design calculations on CD &! 9 DVD in two copies

    with proper director' structure+

    The contractor shall prepare, and keep up to date, a complete set of Kas builtK records of 

    the e5ecution of the works, showing the e5act as built locations, si?es and details of the

    works as e5ecuted+ The records shall be kept on the site and shall be used e5clusi*el' for the purpose of this sub clause+ Two copies shall be supplied to the !C4 before the

    commencement of the tests on completion+

    3n addition, the contractor shall carr'out the Videograph', still photographs prior to start

    of work, during construction period and up to completion of the work up to the

    satisfaction of 23C+ The prepared album of photograph9 *ideo cassette shall be submitted

    to 23C along with the ;s built drawings+

    The contractor shall suppl' to the !C4 as built drawings of the works, showing all works

    as e5ecuted, and submit them to the !C4 for re*iew under sub clause GContractors

    DocumentsH+ The Contractor shall obtain the consent of the !C4 as to their si?e, the

    references s'stem, and other rele*ant details+

    Prior to the issue of Completion of works certificate, the contractor shall pro*ide to the

    !C4 the specified numbers and t'pes of copies of the rele*ant as built drawings, in

    accordance with the !C46s re$uirements+ The Completion of works shall not be

    considered until the !C4 has recei*ed the ;s %uilt Drawings+

    The Contractor shall ensure that all his emplo'ee are full' con*ersant with the

    enforce the rule that an' emplo'ee committing a serious breach of such a

    The contractor shall be responsible for all liabilities under workman compensation act, as

    contractor or which is so serious as is likel' to result in death of such

    workman who meet with accident, the contractor shall within hours of 

    incidence, will intimate in writing to 2ngineer in charge of such incidence+The contractor shall indemnif' client, against all losses9damages sustained

     b' the client resulting directl' or indirectl' from his failure to gi*e such

    intimation to client including penalties9fines if an', pa'able b' client as a

    conse$uence of clientEs failure to gi*e notice under workmans compensation

    characteristics in conformit' with specifications maintain all e$uipment in good

    appro*ed b' client6s engineer in charge+

    c) ;ttend breakdown of ci*il, mechanical, electrical, piping and instrumentation

    works and maintain the plant and e$uipment through out the Contract Period+

    d) The operation and maintenance ser*ice pro*ided b' the Contractor for the period

    specified in the Contract shall ensure the continuous operation of the Plant and that

    the breakdown or deterioration in performance, under normal operating conditions,

    of an' items of Plant and e$uipment and component parts thereof is kept to a

    minimum+

    e$uipment maintenance, consumables, the t'pes and grades of lubricants to be

    f) !aintaining "ogbooks 9 &ecords of the work carried out to keep them in good

    working condition+ 4e shall obtain appro*al of the format of logbooks and records

    h) Carr' out regular sampling at fre$uenc' as mutuall' agreed with engineer in charge,
