2. Ihe tenderer shall have minimum annual turnover of Rs. 1 lakh oerannum in the last three preceding years. Copies of Balance Sheetprofit and loss AJc to be enclosed along with technical bid for thispurpose or any other document for the purpose.
3. The tenderer shall have valid number of Service tax registration.Wherever applicable)
4. The tenderer should not have been black listed by any Govt.departmenvPsU/Public Ltd. Co., etc. A certificate in this regard isto be given by the tenderer.
5. The tenderer should have a valid labour licence or licence forproviding Canteen services as applicable.
6. The Firms/Agencies should have minimum 1 year experience ofrunning a Hotel/Canteen/Catering Agency with sufficient manpowerin Bhopal and preferable providing Canteen Services to /Govt.Offices/Undertakings in Bhopal and other popular cities of India.

INSTRUCTIONS TO THE TENDERERS
1. The tenderers are required to submit two seDarate Bids i.e.Technical and Financial, as per the prescribed proforma given atAnnexure - A & B. The two bids should be submitted in twoseparate sealed envelopes superscribed "Technical Bid for Catering& Canteen services and 'Financial Bid for Catering & CanteenServices' Both sealed envelooes should be Dut in a one sealedenvelope superscribed "Tender for Canteen services".The Technical Bid should be accompanied by an Earnest MoneyDeposit (EMD) of Rs. 15,0001 (Rupees Fifteen thousand only) inthe form of Demand Draft from a commercial bank drawn in favourof "Principal, Kendriya Vidyalaya No. 1, Bhopal" payable at Bhopal.In the absence of EMD, the tender shall be rejected summarily.AII entries in the Tender form should be legible and filled clearly andoverwriting or cutting which is unavoidable shall be signed by theauthorized signatory with stamp. Tender incomplete in any form andconditional tenderers will be rejected out rightly.The Technical Bid shall be opened at 05.00 pm on 03.11.2016 inthe presence of the authorized representatives of the tenderers,who wish to be present at that time.

All the Technical Bid will be scrutinized, relevant documentschecked and the Tenderer whose Technical tenders are acceptedwill be informed about the date and time for opening the FinancialBids. In case the successful Tenderer declines the offer of Contract,for whatsoever reasons, his EMD will be forfeited.The successful tenderer will have to deoosit a Performance SecuritvDeposit of Rs. 15,000/- (Rupees Fifteen Thousand only) and threemonth rent of Canteen (whichever is applicable) by way of demanddraft from a Commercial Bank which will be valid up to a period of60 days beyond the expiry period of contract. The successfulTenderer shall have to deposit the Performance Security Depositand commence the work within 15 days of acceptance of tender.Otherwise the contract will be cancelled and EMD will be forfeited.The tenderer should physically inspect the site before filling andsubmifting the tender to get fully acquainted with the scope of workas no claim whatsoever will be entertained for any ignorance. Forthis purpose, they may contact Principal, Kendriya Vidyalaya No. 1,Bhopal on any working day up to the last day of submission oftender.

8. The successful bidder/contractor will be required to enter into anAgreemenvcontract as per the enclosed copy of the AgreemenUContract by the successful bidder of the offer of Vidyalaya. Thefailure, delay or evasion on the part of the successful biddrer to
cute the agreement / Contract within the period mentionedwill result in forfeiture of EMD. The failure delav or evasion
the part of the successful bidder / Contractor to commence theservices within the period menlioned above will result in terminationof the iontract and forfeiture of EMD.
9. The successful bidder/contractor will be reouired to commence theservices within 5 days from the date of execution of theAgreemenUContract. The failure, delay or evasion on the part of thesuccessful bidder/contractor to commence the services within theperiod mentioned above will also result in termination of the contractand forfeiture of the EMD.
Rates and Prices

agreement for providing Canteen services in Kendriya VidyalayaNo. 1, Bhopal shall be initially for a period of one year which can beextended further on yearly basis up to 01 year as a whole, if theservices are found to be satisfactory. However, in such case therates given by the tenderer in the Financial Bid and approved by theVidyalaya will be valid for next one year also.
5. The tenderer has no right to enhance the rate of any item on hisown and same may be decided by a committee constituted byVidyalaya.
Scope of Work
1. Providing tea/beverages/snacks etc. at canteen in KendriyaVidyalaya No. 1, Bhopal for students/staff members on theirdemand.
2. Providing tea/beverages/snacks/lunch/dinner (buffeUpacked) etc. inmeeting/Conferences/programmes/workshops/any other occasion inVidyalaya also (as and when required on demand). In such case,Vidyalaya informed in advance to the contractor for the said).
3. Providing tea./breakfasUsnacks/lunch/dinner etc. in the Vidyalayapremises as per the request of officers, teachers, staff of Vidyalaya.For this purpose, it is necessary that tenderer should employsufficient number of employees.
4. Proper upkeep of all furniture and equipment in the Canteen is theresponsibility of the tender.ei'

Vidyalaya. Other items of use will be arranged by the Contractorhimself /herself at his/her own responsibility. Supply of electricity incanteen will be insured by Vidyalaya but electricity charges has tobe paid by the contractor.
2. All the above items will be provided by the Vidyalaya to the tendererincluding space for Canteen in the Vidyalaya premises and kitchenin Shishak Sadan including water. However, servicing &maintenance of above items during the contract period will be doneby the Agency/firm. The agency has to ensure that these itemsshould be in running condition in all the times and shall handover allthese items orovided to him at the time of termination of contract inrunning condition. Failing which recovery shall be effected on thedeDosit amount.

3. The tenderer should use only branded/qualitative raw materials inpreparation of food items in the Canteen as per the followingmanner :-
Other terms & conditions of the Contract
1. Any officer authorized by Vidyalaya can any time inspect the qualityof raw materials used by the Agency. lf it is found that poor qualityor branded raw materials is not being used a penalty of Rs. 500/-(Rupees Five Hundred Only) per incident may be imposed on theAgency. In case it is found that the Agency intentionally using suchpoor quality raw materials again, action including termination ofcontract can be taken.
2. The V;dyalaya also reserves the right to ask the Agency to removeand replace any of the workers engaged by him to ensure qualityservice and the Agency shall have to replace workers concernedwithin a week from the date of such communication.The Agency shall provide equipment and appliances for foodpreparation, storage, and service of food. The arrangement ofcrockery, cutlery, glassware, Utensils and other service-ware

4. The ngency/servicp pro\d responsible for the security &safety of the Canteen & all the furniture, fixtures & equipmentsprovided in the Canteen. In case of any damage/loss occurred dueto negligence on the part of worker employed by the Agency. TheAgency will be liable for compensating the loss and decision ofPrincipal, Kendriya Vidyalaya No. 1, Bhopal regarding quantum ofloss will be final and binding.
lf the services provided by the Agency are found to beunsatisfactory, the contract is liable to be terminated with immediatenotice and the Agency shall forfeit the security deposiuportion of itas decided by the Principal, Kendriya Vidyalaya No. 1, Bhopal andhis decision shall be the final and binding.
The tenderer shall abide by the state labour and Government ofIndia (Ministry of Labour) rules and regulations and all otherstatutory Acts and regulations and rules relevant to this contractincluding works contract act, Minimum Wage Act, Provident fundAct, ESI etc.

The Agency shall not have tenancy rights and shall have to vacatethe place allotted to him immediately on expiry/ termination of thecontract or when requisitioned by Vidyalaya.In case, it is found that the kitchen area is not kept in clean andhygienic condition, suitable penalty as deemed fit by Vidyalaya willbe levied.The Agency shall hire workers after medical examination subject toLabouf laws. The Agency will withdraw any person who is not foundmedically fit for the job. A list if workers engaged by the Agency forthe work should be provided giving their names, addresses andother relevant details.The service provider shall ensure that use of water supplies by theVidyalaya is made judiciously and economically.All employees of the service provider shall be provided with properuniform, shoes, etc. by the service provider and shall ensure thatthey appear presentable.Each employee shall carry an lD Card, which is to be provided bythe Contractor.The service provider shall not assign or sublet this contract or anypart thereof to a third party.
The service provider shall display the rate list of eatables suppliedwith quantity/weights at the prominent visible places and shallcharge only such rates as mutually decided and displayed.The Vidyalaya reserves the right to direct Service Provider forintroduction of any additional items in the Canteen, the rates ofwhich will be decided mutually.The rates given by the Service Provider in the Financial Bid, forrunning of Canteen should include cost of manpower/additionalrequired for servicing the food items. No additional service chargeor any other cost will be given for this purpose.The Canteen will be used exclusively for the purpose of students,staff members etc. of KVS and no outsider should be allowed and ifany time it is found that the food items prepared in the Canteen wasserved to outsiders action of forfeiture of performance security alongwith termination of contract can be initiated.The bids will be evaluated on the basis of parameters given intechnical bids and the rates given in the financial bid. TheAgency/Service provider shall, except if and so for as the Contractprovides otherwise, indemnify the Vidyalaya against all losses andclaims in resoect ofa. death of or injury to any person orb. loss or damage to any property.

2. ELIGIBLE BIDDERS:
o The bidder should have the experience of completion of similar works, in any of theInstitutes/Autonomous Institutions/ Universitjes/Public Sector Undertakings of theGovernment of India or autonomous bodies of Government of India or Public SectorBanks or Local Bodies/Municipallties or in any reputed private bank.
3. QUALIFICATION OF THE BIDDERS :
o*Bidder must submit copies of all documents required, duly self-attested, along withtechnical bid ofthe tender.
o Bidder shallalso submit copy ofvaiid License issued from Food Controlling authority,M.P. Bhooal.
o Each Bidder is required to confirm and declare with his bjd that no agent, middlemanor any intermediary has been, or will be, engaged to provide any services, or any otheritem or work related to the award and peaformance of this contract. Thev will have tofurther confirm and declare that no agency commission or any payment which may beconstrued as an agency commission has been or will be paid and that the tender price
will not include any such amount. lf the Principal Kendrlya Vidyalaya No-1 Bhopalsubsequently finds to the contrary, the Vidyalaya reserves the right to declare theBidder as non-compliant and declare any contract if already awarded to the Bidder tobe nulland void.
o Canvassing or offer of an advantage or any other inducement by any peason with aview to influencing acceptance of a bid will be an offence under taws of lndia. Suchaction will result in the rejection of bid, in addition to other punitive measures.
4. COST OF BID :-o The bidder shall bear all costs associated with the preDaration and submission of his
bid and the Vidyalaya will in no case shall be responsible or liable for those costs,regardless ofthe conduct or outcome ofthe tender process.
5. VISIT TO VIDYAIAYA:
o The bidder is required to provide canteen services to this Vidyalaya and is advised tovisit and acquaint himself with the operational system. The costs of visiting shall beborne bv the bidder, otherwise it shall be deemed that the contractor has undertakena visit to the Vidyalaya and is aware of the operational conditions prior to thesubmission of the tender documents.
6. TENDER DOCUMENTS:

o The bidder is expected to examine all instructions, Forms, Terms and Conditions in theTender document. Fallure to furnish all information reouired bv the Tender documentorsubmission of a tender not Substantially responsive to the Tender document in
every respect will be at the bidde/s risk and may result in rejection of his bid.

7. CLARIFICATION OF TENDER DOCUMENT

All communications between the bidderand the Vidyalaya shall be carried out in writing.
o Except for any such written clarification by the Vidyalaya, which is expressly stated tobe an addendum to the tender document issued by this Vidyalaya, no written or onlcommunication, presentation or explanation by any other employee of the Vidyalayashall be taken to bind or fetter the lnstitute under the contract.
8. PREPARATION OF BIDSo The bidder shall, on or before the date given in the Notice Invitation to Tender for
running canteen Services, submit his/her bid in sealed envelopes clearly marked withthe name ofthe Tender.

Bhooal pavable at Bhopal and should be submitted along with Bidform as a demand draft of Rs. 500/- and kept with Form No. 1 (Technical Bid). lf formis obtained from the office then enclose a copy of Money Receipt obtained from theoffice.
o The contractor shall deposit 8id Security (Earnest Money Deposit) for an amount ofRs. 15,000/. (Rupees Fifteen Thousand only) in the form of an Account Payee
Demand Draft only from a scheduled or commercial bank, in favour of PRINCIPAL

11. Other lmportant Conditions
1. The Bidder shall submit his price bid/offer in Indian Rupees and payment under thiscontract will be made in lndian Rupees.
2. The contract may be valid initially for one year and the Vidyalaya reserves the right tocurtail or to extend the validity of contract on the same rates and terms andconditions for such period as may be agreed to.
3. Any Tender not accompanied by Bid Security and cost of form shall be summarilyrejected.

8. Bid Security shall be forfeited if the successful bidder refuses or neglects to executethe Contract or fails to furnish the required Performance Securitv within the omeframe specified by the Institute.

35. Bid security will be released to the unsuccessful bidders in due course aftercompletion of process of tendering and an award of contract to the successful bidder.
36. Within 15 days of receipt of the Letter of Acceptance, the successful Bidder shalldeposit a Performance Security in the Office of the Vidyalaya in the form of DD.
37. The Principal, Kendriya Vidyalaya No. 1, Bhopal reserves the right to terminate theprocess of bid. The decision of the Tender Committee of this Vidyalaya is final andcannot be challenged in any manner.
12. Other conditions for ContGct.
1. The Contractor/Agency is a person or corporate body whose Bid to carry out theservices has been accepted by the Employer.
2 AII risks of loss of or damage to physical property and of personal injury and deathwhich arise during and in consequence of the performance of the Contract are therespon sibility of the Contractor.
3 Safety - the Contractor shall be responsible for the safety of all activities on the site.
19. The contract may be terminated by giving three months notice by the contractor.However in case of exigency arising on account of the not providing services onsatisfactory manner, the employer can terminate the contract with immedjateeffect.
20. lf the Contract is terminated, the Contractor shall not stop service immediately, hehas to make the site safe and secure and leave the site as soon as it is reasonablypossible.
21, In the event oftermination bythe employer, the security Deposit ofthe contractorshall be forfeited and balance period of services contract shail be undertaken atthe risk and cost of the agenc, till the new contract will be executed.
32. In case of any dispute, the decision of Principal, Kendriya Vidyalaya No. 1 ,ghopal shall be final and binding to all and cannot be challenged in any manner.
