    Terms and ConditionsTEP Large Business Program

    Tucson Electric Power (TEP) is offering incentives under the Commercial Energy Solutions program to promote energy

    efficiency improvements. The program is funded by TEP customers and is approved by the Arizona Corporation

    Commission. KEMA implements this program for TEP.

    Please refer to the current Policies & Procedures document on tep.com for detailed information on Terms and Conditions.All projects are subject to the Policies & Procedures posted on the website on the date of application signature.

    TEP makes no representations and provides no express or implied warranty or guarantee with respect to design,manufacture, construction, safety performance or effectiveness of newly installed equipment or installation contractors,

    including any warranties of merchantability or fitness. Customers are responsible for disposing of equipment and

    materials according to local code requirements.

    EligibilityIncentives are available to TEP non-residential customers on Rates 13, 14 and 40. Energy efficient equipment purchased,contracted for or work conducted prior to July 3, 2008 is not eligible for an incentive. The energy savings from installed

    measures must occur on a meter with an eligible rate schedule. The measures included in this program are not designed to

    promote fuel-switching. Equipment must be purchased for existing facilities.

    Incentive CapsThe total incentive paid cannot exceed 75% of the incremental measure cost. Contractor labor costs can be considered inmeasure costs. Customer labor costs will not be considered.

    If the customer intends to apply for local, state or federal tax credits, the estimated amount of those credits must be

    disclosed on the application agreement form. The Arizona Corporation Commission Decision No. 70406 requires TEP to

    deduct the value of your tax incentive when calculating your maximum rebate. The incremental cost of the measure will

    be reduced by these anticipated credits prior to applying the 75% cap.

    Pre-NotificationAll participants are strongly encouraged to submit a Pre-Notification Application to reserve funds; de-lamping projects

    require Pre-Notification and pre-inspection. Forgoing the Pre-Notification step may result in a reduced incentive amount

    during the final application stage. Funds will be reserved for 120 days unless an applicant requests, and is granted an

    extension.

    Final ApplicationThe Final Application with all documentation should be submitted within 60 days of project completion. Project

    documentation includes copies of all itemized, paid invoices and receipts detailing the specific equipment purchased, the

    services provided, and other costs. Any applications submitted more than six months following completion will be

    deemed ineligible for payment.

    InspectionsThe program team reserves the right to inspect all projects to verify compliance with the program rules and verify the

    accuracy of project documentation. This may include pre-installation and/or post-installation inspections, detailed lightinglayout descriptions, metering, data collection, interviews, and utility bill data analyses. The customer must allow access to

    records and installation sites for a period of three years after receipt of incentive payment.

    Tax LiabilityIncentives are taxable. If incentives exceed $600 and you have indicated Other as your tax status, KEMA may reportyour incentive as income to you on IRS Form 1099.

    Incentive Application AgreementTEP Large Business Program

    As an eligible Tucson Electric Power (TEP) customer, I certify that I contracted for or purchased and installed the indicated energ

    efficiency measures after July 3, 2008 for use in my business facility and not for resale. I have attached documentation establishinproof of payment for the items installed according to this application. I agree to verification by the utility or their representatives o

    both sales transactions and equipment installation.

    I certify that the information on this application is true and correct, and that the Taxpayer ID Number is representative of the

    applicant and that TEP, UniSource Energy Corporation and KEMA are not responsible for any taxes that may be imposed on mybusiness as a result of receipt of this incentive. I understand that incentive payments assume related energy benefits over a period o5 years or for the life of the product, whichever is less.

    I agree that if: (1) I do not install the related product(s) identified in my application, or (2) I remove the related product(s) identifie

    in my application before a period of five years or the end of the product life, whichever is less; then I shall refund a prorated amou

    of incentive funds to TEP on the actual period of time in which the related product(s) were not installed and operating (or the full

    amount if the product was never installed). This is necessary to assure that the projects related energy benefits will be achieved.

    I understand that the program may be modified or terminated without prior notice. The program has a limited budget. Applications

    will be processed on a first-come, first-served basis until allocated funds are spent. I understand that the Final Application and all

    required documentation should be received by TEP within 60 days of project completion. All equipment must be purchased andinstalled prior to submitting the Final Application. I also understand that all materials removed must be disposed of properly and

    taken out of service.

    In no case will TEP pay more than 75% of the incremental measure costs. I will disclose below if I intend to apply for local, state

    federal tax credits and understand that the incremental measure cost will be reduced by these anticipated credits prior to applying t

    75% cap. I understand that TEP or its representatives have the right to ask for additional information. The TEP Commercial EnergSolutions program will make the final determination of incentive levels for this project.

    In return for the payment by TEP under the Commercial Energy Solutions program, I understand that any energy efficiency credit

    and all resultant associated environmental credits from the energy efficiency measures for which the rebate is paid, are assigned to

    TEP and/or UniSource Energy Corporation. I understand that my company may be recognized as a program participant in

    promotional materials; however, project details will not be released without prior consent. If I choose to opt-out of any recognition

    Submitting an Incentive ApplicationTEP Large Business Program

    Please review the project and measure requirements as detailed on the Incentive Application and Policies & Procedures

    documents posted on tep.com to verify that your project is eligible. Use the corresponding checklist to ensure your

    application is complete. Then:

    1. Submit the Pre-Notification Application (required for de-lamping). Check the box that says "Pre-Notification" atthe top of the application.

    Applications will be reviewed in the order received. Funds will not be reserved for the project until the team

    receives a complete application and determines that the project meets the program eligibility requirements as set

    forth in the Policies & Procedures.

    Program staff will send the applicant a letter acknowledging reservation of funds for eligible projects and the

    reservation expiration date. The program team reserves the right to contact the customer after 30 days to ensure

    that the project is moving forward and may cancel the commitment based on the customer's response. Funds that

    have been reserved are not transferable to other projects, facilities, and/or customers.

    2. Install equipment according to the terms and conditions described for the eligible measures. Ensure the measures

    meet all requirements detailed on the corresponding specification sheet and the Policies & Procedures.

    3. Submit the Final Application with all required documentation within 60 days of project completion. Project

    documentation includes copies of all itemized, paid invoices and receipts, which detail the specific equipment and

    purchases, the services provided and other costs. An updated copy of the Pre-Notification Application can be submittedwith Final Application selected at the top. Any applications submitted more than 6 months fol lowing completion will bedeemed ineligible for payment.

    The location or business name on the invoice must be consistent with the application information. The project

    invoice must provide sufficient detail to separate the cost of the prescriptive measures from the cost for other

    payment directly, the submitted invoices must include the full cost of the measures and not simply show the

    portion of the project cost that the TEP customer will pay.

    TEP and its representatives reserve the right to request additional supporting documentation as deemed necessaryto ensure measure eligibility and verify that the expected energy savings will occur. All project-specific customer

    information will be held in confidence. Requested information could include: HVAC sizing calculation,

    equipment purchase dates, installation dates, proof that the equipment is operational, manufacturer specifications,

    warranty information, and proof of customer co-payment.

    4. The final project documentation will be reviewed for eligibility and completeness. Incentives will be paid within 4

    to 6 weeks after the Final Application is approved.

    Applicants who submit incomplete applications will be notified of deficiencies, but will lose their place in the

    review process until all requested information is received. Incentives cannot be processed for payment until thecomplete application and all required documentation is received and approved. Final, complete applications must

    be submitted by November 30, to be paid in the same calendar year.

    HID Lighting SpecificationsTEP Large Business Program

    New T5HO / T8HO FixturesThis measure consists of replacing existing Metal Halide (MH) / High Pressure Sodium (HPS) fixtures with new fixtures

    with at least two high output lamps along with high output electronic ballasts.

    Existing MH/HPS fixtures with lamp wattages between 150 watts and 250 watts shall be replaced with either 2

    lamp four foot linear fixtures or 4 lamp two foot linear fixtures. Existing MH/HPS fixtures with lamp wattages equal to 250 watts and less than 400 watts shall be replaced with 3

    lamp linear fixtures.

    Existing MH/HPS fixtures with lamp wattages equal to 400 watts and less than 750 watts shall be replaced with 4

    lamp T5HO or 6 lamp T8HO linear fixtures.

    Existing MH/HPS fixtures with lamp wattages equal to 750 watts and less than 1,000 watts shall be replaced with

    6 lamp T5HO or two (2) 6 lamp T8HO linear fixtures.

    Existing MH/HPS fixtures with lamp wattages equal to or greater than 1,000 watts shall be replaced with two (2)

    4 lamp T5HO linear fixtures.

    All fixtures must have a reflector with a minimum of 90% reflectivity. Low Pressure Sodium (LPS) lamps are not eligible

    for this prescriptive incentive.

    Linear Fluorescent T8 or T5 Lamps with High Output Electronic Ballasts

    T5HO or T8HO lamps and electronic ballasts. The new full wattage F32/T8 and F54/T5 lamps must have a colorrendering index CRI 81 watts. The electronic ballast must be high frequency ( 20 kHz), UL listed, and warrantedagainst defects for 5 years. Ballasts must have a power factor (PF) 0.90. Ballasts for 4-foot lamps must have totalharmonic discharge (THD) 20% at full light output.

    Note: Replaced PCB ballasts and HID lamps must be disposed of properly. Documentation of disposal may be requestedby the program staff.

    Cooling SpecificationsTEP Large Business Program

    Sizing CalculationPursuant to the Arizona Corporation Commission (ACC) decision, applicants must supply documentation verifying that aproper sizing calculation has been done (including the actual calculations) for each piece of equipment.

    Water-and Air-Cooled Air ConditioningNew air conditioning units or heat pumps that meet or exceed the qualifying Integrated Part Load Value (IPLV) shown in

    the Cooling Incentive Worksheet Table are eligible for an incentive. These units can be air cooled or water cooled. Theycan be either split systems or single packaged units. Evaporative coolers and water source heat pumps do not qualifyunder this program, but may qualify under the Custom Incentive Program. All packaged and split system coolingequipment must meet Air-Conditioning and Refrigeration Institute (ARI) standards (210/240, 320 or 340/360), be ULlisted, and use a minimum ozone-depleting refrigerant (e.g., HCFC or HFC). A manufacturer's specification sheet

    indicating the system IPLV must accompany the application.

    Water-and Air-Cooled ChillersChillers that have a rated kW/ton for the Integrated Part Load Value (IPLV) conditions that is less than or equal to the

    qualifying efficiency shown in the Cooling Incentive Worksheet Table are eligible for an incentive. The chiller efficiencyrating must be based on ARI Standard 550-98 for IPLV conditions and not based on full-load conditions. The chillersmust meet ARI standards 550-98, be UL listed, and use a minimum ozone-depleting refrigerant (e.g., HCFC or HFC).The ARI net capacity value should be used to determine the chiller tons. A manufacturer specification/performance sheet

    with the rated kW/Ton-IPLV or COP-IPLV must accompany the application.

    Incentive Calculations for Air Conditioners and ChillersThe total incentive is determined by two componentsan equipment incentive and an efficiency incentive. Both theequipment and efficiency incentives are applied per ton of cooling installed. The equipment qualifies for an equipmentincentive if the qualifying efficiency is met for the equipment size category. In addition, the efficiency incentive is addedon a prorated basis if the equipment exceeds the minimum qualifying efficiency for the equipment size category.
