1.0 Instructions to Tenderers and Conditions of Tender

Introduction and Background 1.1 The tender documentation comprises the following:

This tender documentation is to be read in conjunction with any supporting documents, and any necessary allowances to achieve compliance with those documents must be included within the value submitted on the Form of Tender. IMPORTANT NOTE; this document is to be read in conjunction with Our Lady of Lourdes Catholic Multi Academy Trust’s, Tender Evaluation Procedure which has been provided in conjunction to the tender documentation.

Tender Programme 1.2 The anticipated tender programme is as follows:

Completion and Project Handover

When the successful contractor has been notified they shall provide a delivery programme to highlight commencement and completion of the works over the 4-week contract period. Should the contractor not agree with the time scales associated they must declare this on their delivery programme.

Obligations to Tenderer and Tender Pricing Documents

1.3 Tenderers must ensure that they are fully familiar with the nature and extent

of the obligations of the Instructions to Tenderers and Conditions of Tender, Tender and Pricing Document and be aware that the performance standards will be strictly enforced. The Tenderer will be deemed to have read, examined and accepted the Instructions to Tenderers, Tender and Pricing Document and the requirements contained therein prior to the submission of the Tender. It is the responsibility of Tenderers to obtain themselves, at their own expense, all information necessary for the preparation of their tender.

1.4 This Invitation to Tender is intended for the addressee only. If you intend using Sub-contractors to help fulfil the Contract, this must be clearly stated within your response.

Accuracy 1.6 You are advised to check the accuracy of your Tender prior to submission.

Form of Submission

1.7 Tenderers shall complete and return the items listed in Appendix D –

Documents to be returned. 1.8 The Form of Tender must be submitted duly signed. Any items for which you

are unable to offer a price should be identified. Any other revisions to the Tender may invalidate the tender submitted.

Expenses/ Losses 1.9 The Client will not be responsible for payment of costs, expenses or losses

which may be incurred by any Tenderer in the preparation and submission of their Tender, including site visits, attending pre or post contract presentations/ interviews or negotiations in connection therewith.

Format of Tender Submissions 1.10 All tenders are to be returned to the Client as detailed in section 1.34 of this

document. 1.11 The Client cannot undertake to give consideration to any tender submitted

otherwise, including telephone, email, and facsimile.

1.12 The closing time and date for receipt of tenders is 12:00 noon on 12th August 2020. Any tender submissions received after the closing date will be rejected. Suppliers must ensure that they leave adequate time prior to the closing date to submit their response.

1.13 Tenders not in accordance with these instructions will be rejected. 1.14 Tender responses will not be opened until after the closing date for receipt

of tenders has elapsed.

Unsuccessful Tenders 1.15 Notification of proposed award of contract will be given to all tenders during

which time, unsuccessful tenderers may request a de-brief from the Client in respect of their tender submission and evaluation itself.

Successful Tender 1.16 An authorised representative from the Client Company (or approved

representative) will notify the successful tenders.

Invitation to Tender Material 1.17 ITT material means information issued to the Tenderer by the Client or on its

behalf, or to which the Tenderer has been given access, for the purposes of this ITT. ITT material remains the property of the Client or other owners and is released solely for the purpose of tendering.

1.18 Return of ITT Material: In the event that a recipient of ITT Material decides not to participate in the submission of a tender, the ITT Material shall be returned to its place of issue without delay. If a tender is submitted to the Client, the ITT Material may be retained by the Tenderer until the result of the competition is known. In the event that the Tenderer’s bid is unsuccessful the ITT Material shall be returned to its place of issue without delay. This will not apply to written material as it is sent out electronically.

1.19 Intellectual Property Rights in ITT Material: The Intellectual Property in ITT

Material will belong to the Client or a third party. The ITT Material may only be used for the purpose of responding to this ITT and shall not be copied or disclosed to anyone other than employees of the Tenderer involved in the preparation of the tender, without the prior written approval of the Client. Client or the third-party owner may suffer damage for which compensation may be sought from a Tenderer, if the Tenderer discloses the ITT Material other than to employees involved in the tender preparation or uses the ITT Material other than for the purpose of tendering.

Consultants, Contractors, Sub-Contractors and Suppliers 1.20 It is the responsibility of Tenderers to provide proposed Sub-Contractors and

Suppliers where applicable for all the technical and commercial information necessary to allow those potential Sub-Contractors and Suppliers to provide their proposals to the Tenderer. Client will not answer to any direct approach from such potential Sub-Contractors and Suppliers for details of any particular Invitation to Tender.

1.21 Tenderers are required to submit with their tender a schedule of all proposed

Sub-Contractors, Suppliers and other Service Providers to be involved in the design delivery of the services.

Errors in Tenders 1.22 Tenderers will be given the opportunity to either stand by any genuine errors

in their pricing or withdraw from the tendering process.

Confidentiality 1.23 Tenderers are to note the following:

They must not communicate any figures or other information indicating tender prices to any third party before the time set for the return of Tenders. (The only exception to this requirement is for the obtaining of insurance quotations, such information to be given in strict confidence).

They must not obtain or try to obtain any information in connection with any other Tender before the time set for the return of Tenders.

They must not make or discuss any arrangement with any third party regarding whether or not they should tender, or about their, or any other party’s Tender.

They shall not, without any prior approval in writing, take, or authorise the taking of, any photographs of any project for use in publicity or advertising or publish alone, or in conjunction with others, any articles, photographs or other illustrations relating to any project or any part thereof, nor impart to any publication, journal, newspaper, film or any radio or television programme any information relating to any project.

Tenderers are required to submit a signed ‘Declaration’ as provided for return with their tender.

Tender Queries 1.24 During the tender period all queries should be made via Jarrad Edwards at

Make Consulting Limited email: [email protected] 1.25 All written tender queries will be endeavoured to be acknowledged within 3

working days.

Tender Information/ Revisions 1.26 At any time after the issue of the Invitation to tender, the Client reserves the

right to issue changes to Tender Information/ requirements. Tenderers, when preparing their submissions, must, as with the information generated by Tender Queries and Responses take these changes into account in drawing offer(s).

1.27 No alterations or qualifications to any of the tender documents shall be

made unless they have been agreed in writing by the Client. 1.28 The purpose of this Invitation to Tender is to elicit an unequivocal bona-fide

tender which is capable of acceptance for the purpose of appointing a contractor.

1.29 The Tenderers submission should not include any brochures or commercial

information.

Tender Acceptance 1.33 The Client does not bind itself to accept the lowest or any tender and may

refuse to consider any Tender which is incomplete or qualified in any way or not completed in strict accordance with the instructions contained within the invitation tender.

The Contract: JCT Minor Works Building Contract 2016 Edition. Requirement: Allow for the obligations, liabilities and services described.

MEASUREMENT Quantities stated within the specification item are for the guidance of the contractor

in pricing. However, the Contractor shall be aware that this is not a quantities based contract, and, as such he will be deemed to have visited the site to ascertain the full extent and nature of the various works described and indicated on the contract drawings.

No claims shall be considered which result from a lack of knowledge and discrepancy

from information reasonably obtained from on site investigations. All areas and measurements provided are provisional in nature and are subject to

remeasure at the appropriate rate.

GENERAL REQUIREMENTS The Contractor shall note that the items contained in the Works Schedule have been

described in reasonable detail, but the Contractor shall consider them in conjunction with the working drawings, details, manufacturer’s recommendations and the actual work on site, and shall allow in his prices for everything necessary for carrying out the works in the best manner whether specifically mentioned or not.

Where approximate quantities are stated, they are for guidance only and the

Contractor is advised to make his own assessment of the actual quantities required by visiting site prior to submitting a tender.

No alterations or qualifications of any kind are to be made by the Contractor to this

Specification without written agreements of the Contract Administrator. Unless stated otherwise the contractor is to allow for the supply of all material

associated with the works. No works to be started without prior arrangement with the Contract Administrator

and agreement of the Programme of Works. No claims for loss of time and other charges will be entertained should the above procedure not be complied with.

Site inspection to be undertaken with the Contract Administrator within two working days of date of possession to agree extent of works to be exposed/removed prior to stripping.

Provide all necessary temporary protection to maintain the property in a secure and

weather tight condition throughout the duration of the works. Temporary security fencing must be provided for secure the works area and

compound, even for works being undertaken during holiday periods. No claims will be considered which result from lack of the awareness and knowledge of the site. Heras fencing panels shall be of 30 gauge only and a minimum of 2.0m high double clipped.

Unless otherwise stated all debris and redundant materials are to be carted from site

and disposed of in accordance with all current legislation regarding disposal of waste materials. Disposal of waste materials is to be conducted in accordance with the Contractors Site Waste Management Plan. All disturbed surfaces are to be made good prior to installation of new.

Report immediately to the Contract Administrator any suspected asbestos based

materials discovered during the works that have not been identified already, and work should stop immediately. Avoid disturbing such materials and agree with the Contract Administrator a safe method of removal/encapsulation. Work can only commence following written approval from the Contract Administrator.

If the material which the sample represents is to be stripped, removed or disturbed

in any way then arrangements must be made to comply with the Control of Asbestos Regulations 2012, and any other relevant legislation.

The Contractor shall ensure that all material and workmanship comply with

Regulation 7 of the Building Regulation 2010, relevant British and European Standards.

All staff are to be DBS checked and wearing company ID/Insignia at all times. DBS checks must be provided at least 7 days prior to commencement with a list of any convictions to the client.

Asbestos Based Materials

A School constructed in 2008 therefore it is anticipated no asbestos will be present. B Contractor should take care with all works and should any material be identified as

possible asbestos, report immediately to the Contract Administrator (CA) any suspected asbestos based materials discovered during the works that have not been identified already, and work should stop immediately. Avoid disturbing such materials and agree with CA a safe method of removal / encapsulation. Work can only commence following the written approval of the CA.

ENABLING WORKS Contractor is to allow for all enabling works so as to allow for the undertaking of the tanking. The contractor is responsible for managing the level of dust and provide, extraction and / or fresh air within the working area. The contractor must ensure the door between the dinning room and drama room is sealed preventing dust getting into this space. School lunches etc. cannot be interrupted. Core Sample Prior to commencing the work, and in the presence of the CA, undertake a core sample of the floor structure to provide details of the existing structure. Strip Out All strip out works including breaking out of concrete, finishes must be undertaken during either the school holiday or weekend working. For the purpose of the tender assume free access in the final week of the school holidays with an assumption that any other further strip out work will need to be over a weekend period. Remove and dispose all drylined wall including all associated items; head and base tracks, battens, insulation, skirting and the like. Full height of wall is to be stripped. Free access is required to the blockwork walls – isolate, disconnect and remove all services running behind the existing drylining. Retain on site all radiators for reinstallation. Remove and dispose the floor covering, screed and insulation. Remove all fixtures and fittings as required to undertake tanking works, and retain on site for reinstallation.

Please note, this is a tender drawing for the original construction, and all details are to be confirmed by core sample.

Walls Lafarge galvanised metal dry liner channel and bracket system to give 30mm void,

100mm gauge Visqueen dpm, finished with 1 layer of 12.5mm Lafarge dB Check board and 1 layer of 12.5mm Lafarge multi-check board and skim fixed to brackets. Void between metal studs to contain 25mm thickness of glasswool acoustic insulation slabs having a minimum density of 24kg/m3.

Pre primed softwood skirting in size and profile to match existing within school. Floors - Insulation 75mm Kingspan TF70 Thermafloor Insulation. Floors – Screed Prior to laying screed, ensure substrate is dimensionally stable, clean dry, free from

any rising damp, without cracks, free from dust and loose, crumbling parts. It must present a degree of stability suitable for its use. The screed to be covered must be separated from all vertical elements by means of a band of flexible material with a thickness of ≈ 8 – 10 mm, along the entire height of the screed. The structural joints present in the substrate must be created accordingly also in the thickness of the screed.

Thank you for the opportunity to provide a specification and quotation for the specialist designed, installed and warranted waterproofing system for this property. We have included a brief proposed schedule of works together with a costing for the items of specialist work that Peter Cox will be pleased to undertake for you. We were provided with a zip file which contained the relevant drawings. Design Considerations BS 8102:2009 Code Of Practice For Protection of Below Ground Structures Against Water From the Ground provides guidance on Waterproofing Types and also grades the end environment. BS 8102:2009 Environment Grades

Having reviewed the drawings, we would suggest a Grade 3 environment for the below ground areas. To achieve the desired grade along with compliance with BS 8102 and insurance providers, a Dual waterproofing System will need to be installed.

These could consist of:- Type A Waterproofing: Barrier Protection (Tanking) Type B Waterproofing: Structurally Integral Protection (Waterproof Concrete) Type C Waterproofing: Drained Protection (Cavity Drain Membranes & Construction Drained Cavities) Proposed Specifications In this instance we would recommend a dual Type A (Crystalline membrane) and Type C (Cavity Drained Membrane) System. This gives maximum protection but also ensures the system is serviceable and maintainable which will ensure its integrity even after the guarantee period. Please note, a full specification and detailed drawings will be provided prior to commencement onsite I have provided a tender detail drawing to highlight the proposal. Type A Barrier Protection – Primary Leak Stopping

Strengthen horizontal and vertical joints/corners with a watertight, fast setting and slightly expanding repair mortar bottle fillet.

Apply 2 even coats of Crystallising mineral waterproof slurry primary waterproofing layer.

Pipes and penetrations will be sealed as per manufacturer’s instructions.

The specified works carry a 10 year guarantee.

In deciding on your preferred contractor to deal with the above, I would like to clarify that in addition to our 10 year guarantee; We carry Professional Indemnity insurance for design and Product Liability insurance for installation, so enabling an insurance backed guarantee to be issued at the end of the works if required at extra cost. Further to this, if the NHBC or a similar warranty provider is involved, I am CSSW qualified (the benchmark waterproofing qualification) to meet their criteria.

With the best guarantees on the market we are also a established member of the BSWA (British Structural waterproofing Association), PCA (Property Care Association) and all our services are administered under a third party accredited ISO 9001 Quality Management System.

FINISHING SPECIFICATIONS WORK TO BE COMPLETED BY THE CLIENT UNDER A SEPARATE CONTRACT Walls Provide and fix a free standing pre-formed metal/timber framework to support the plasterboard linings. Initially, fix 1200 gauge ‘Visqueen’ dpm to the metal framework using tape. Provide and fix Thermal plasterboards to the free-standing metal framework, apply scrim tape to the joints and skim using multi-coat finishing plaster. Floors A nominal 70mm sand and cement screed (allowing for studs) is to be applied directly to the 20mm membrane in accordance with BS 8204 to give a strong durable floor surface capable of withstanding extremely high loads. The screed is not a suitable wearing surface and should be covered or coated prior to heavy or frequent use. Please Note

The costing has been provided subject to contract. This is a budget costing and is only intended as a guide price for you. It does not constitute a full survey/inspection report or infer that a full inspection has been undertaken hence it may not fully reflect all works required. We would welcome the opportunity to discuss these proposals further, where we can determine final construction details and phases. We would then provide a fixed price quotation for the installation and design to comply with BS 8102:2009. Unless specified otherwise, our budget costing does not include for any preparatory or other associated works which may be required. Our Assumptions To allow us to provide the above budget costing we made the following assumptions. We welcome the opportunity to discuss this further. There will inevitably be other issues and design considerations, but the above are the main ones based on the level of information supplied to date. The proposed Grade under BS 8102:2009 is suitable for your client. We are unaware of the water table for this particular site. However as per guidance in BS8102 we have assumed that a full head of water will come to bear at some point and have taken this into consideration when designing the waterproofing system. The pumping system has been designed to deal with a flow rate of 120 litres per minute entering the sump chamber with a 3.5m discharge head. The quotation(s) have been prepared on the assumption that the building programme will enable us to carry our work within 1 continuous visit by our team. Our charge for additional visits (due to measures beyond our control) per technician will be £350.00 + vat per ½ day visit or part thereof. Standing time beyond our control will be charged at £70.00/hr + VAT or part thereof per technician, this to be agreed with the client/site manager and entered into the standing time log and signed on site at each occurrence by the technician and client/site manager. Our report and quotation do not make any allowance for the application of planning, building regulations approval or any licenses/permits should they be required for water discharge, which is the responsibility of the client. Ground Gas protection has not been allowed for in our quotation unless explicitly stated otherwise.

QUALITY ASSURANCE

Included within our quotations is the assurance that at every step of the installation, checks will be undertaken by Peter Cox Ltd to ensure the system is installed correctly and a photographic log kept of each visit, snagging noted will be remedied without delay for further inspection.

There are to be a minimum of 1 site visit per week undertaken by either the local Surveyor, Branch Manager, Area Operations Manager, National Waterproofing Manager or National Commercial Manager

In addition to the above, additional unannounced inspections may be undertaken by the membrane manufacturers to ensure compliance with their installation guidelines; any snagging noted will be remedied without delay for further inspection.

We understand that you require a Type A tanking system rather than a Type C system, which we would recommend as a far better option in terms of risk. As at this stage with none of the areas 'opened up' to allow an inspection of the wall floor junction we do not know if there will be any movement between the floor slab and the blockwork walls.

We are assuming the existing floor slab is a reinforced concrete structure designed to BS EN1992 (Eurocode 2) and that it is of sufficient mass and quality to resist heads of water pressure as recommend by BS 8102:2009

Taking instructions from yourselves, please find below our specification and schedule of works for a Type A system.

1.0 WORKS BY OTHERS

1.01 Removal of all dry lined walls, services etc to allow free access to the blockwork walls and floor

1.02 Removal of the floor covering

1.03 Preparation of the floor slab, by grinding off the surface of the concrete floor slab to; - remove the adhesive used to fix the existing rubber flooring- to provide a good surface key for the tanking.The floor to be swept to remove all debris/dust etc and then a final vacuum to remove anytraces of dust on the surfaces, before we lay the tanking.

1.04 Once our final coats are applied an isocrete screed can be floated on top to provide the wearing surfaces and for the final rubber mat floor.

1.05 All stud walls can then be fitted on top of the screed.

1.06 Final rubberised cushion sheeting floor to be laid - see below

2.0 WORKS BY MIDLAND PRESERVATION

2.01 Provide a fillet between the wall and floor junction using Newton 203- RM around the perimeter of the hall. Provide 908 LiquaBond smooth coating to blockwork walls up to viable dpc level or approx 1200mm. Provide 912-RT tape to joint.

2.02 Cover wall with Newton 107F and extend onto floor.

2.03 Floor slab to have a primer coat of 903-P before applying Newton 107F to whole of floor area

204 A final vapour barrier on top of the 107F will have a coat of Newton 110 WATstop before the Isocrete floor screed is laid (by others).

To carry out all works as detailed above . we reserve the right to change some aspects of the above specification, if site conditions prove this is required.
