of the pier was set and dressed to grade. The iron girders were placed in position between sub-piers Nos.4 and 5, Nos. 5 and 6, and Nos. 7 and 8, and the centerings were put in position. A portion of the concrete filling for the arches forming the superstructure, was placed in the spans between sub-piers Nos. 5 and b and Nos. 7 and 8.

The progress of the work has been much delayed by the slow delivery of the granite therefor.

Chambers Street Section. Painted section office.

Beach Street Section.

Repaved the approach to Pier, new 26, North river, with Belgian blocks. The cluster of protection piles at the north end of the bulkhead wall of Beach Street Section were

replaced. Taking up and relaying pavement between Hoboken and Morton streets, North river; resolu-

tion of Board, August 20, 1884. The work of taking up the pavement where the newly-made land had settled was continued by

bringing the filling up to grade, and by relaying about 700 square yards of the paving. The temporary cobble pavement along the bulkhead between Piers, new 41 and new 42, was

partly repaved, the work being now in progress; 11 silt basins were cleaned and 2 were placed.

West Twenty-third Street Section, North River.

The earth filling in rear of the wall between Piers, new 54 and new 55, was leveled and repaired.

The approach to Pier, new 55. North river, was patched with 4-inch plank. The approach to Pier, new 6o, North river, was raised for a length of about roo feet. Temporary backing-logs were replaced between Piers, new 56 and new 57.

IVest Thirty-first Street Section,Xorth River.

11,005 single loads of material on tickets, were received and deposited as filling-in of the rear wall, making a total of 13,062 loads received to date.

The automatic tide-gauges at Pier, new 43, and at West Fifty-seventh street Pier, North river, were put in working order.

Newly-filled land between West Fifty-fifth and West Fifty-eighth Streets, North River.

Some filling was placed south of West Fifty-fifth street, North river, by Mr. James Brooks, under order from the Board of Health.

Neiv&filled land between West Seventy-eighth Street and West Eightieth Street, North River.

RESOLUTION OF BOARD, JANUARY 30, 1884. 659 truck loads and 179 cart loads of stone chips were received free, and deposited as filling-in

rear of the crib bulkhead.

Plans for the Permanent Improvement of the Water front from Eighty-sixth street, East river, to One Hundred and Thirtieth Street, Harlem river.

71 borings were made by the borer " Woodcock," and the results were plotted for future use.

Floating Property.

The list of floating property of the Department remains the same as at the date of my last quarterly report. All the various pieces have been maintained in order, and ready for use, by such repairs and renewals as were found necessary, from time to time, and some extra repairs have been made to the hull of the derrick " City of New York."

Surveying Party.

The surveying party has given all the lines and levels necessary for the various work of the Department.

Two surveys have been made on the North river water-front and three on that of the East river, and plots of the same have been made for the records of the Department. 40,055 disc soundings have been taken by the surveying and sounding parties in t 70 slips, and 47 rod soundings in 2 slips ; of which 21,564 disc soundings in 81 slips and 38 rod soundings in 1 slip were on the North river, and 18,491 disc soundings in 89 slips and 9 rod soundings in I slip were on the East and Harlem rivers. All of these soundings were taken for general repairs, forsoundings before and after dredging, and for examinations.

These soundings have been reduced, plotted and placed on record.

Gansevoort Street Yard.

The old concrete platforms were removed and their site was leveled to allow of discharge of loads from vessels.

West Fifty-seventh Street Yard.

The repairs to the ironwork of the different sections and of floating property and general repairs, and the general issue of stores were made as required. Work on the centering for the arches for Pier " A," North river, was continued.

East Seventeenth Street Yard.

Two pieces of granite were issued to Pier " A," North river, and the yard was properly main-tained.

Abstract of Proceedings for the Week ending May 9, 1885.

WEDNESDAY, MAY 6, 1885.—REGULAR MEETING-I0 A. M.

Present—Commissioners Crimmins (President), Powers, and Beekman. At the hour of ten o'clock, Mr. E. G. Marsh, the representative of the Comptroller of the city,

being present and the meeting open to the public, the President, in the presence of the representa-tive of the Comptroller and such of the parties making proposals as were present, opened the esti-mate-box and publicly opened and read all the proposals or estimates which had been received in accordance with advertisements duly published in the CITY RECORD for the following works:

No. t. For the erection of foundation walls and granite coping required at the southerly part of Jeannette Park, located between South and Front streets and Coenties Slip, New York City.

No. 2. For the erection of granite steps, platforms, brick arches, iron beams, etc., required at the four octagonal bays and two entrances on Morningside Park, adjoining Momingside avenue, New York City.

Messrs. Barney, Johnson and others appeared in relation to the improvement of the Spuyten Duyvil Parkway.

Messrs. Huhn and Centre, a committee from the People's National Association, appeared, requesting that this Department provide conveniences for males and females at the bridge crossing the Harlem river at Third avenue.

Commissioner John D. Crimmins was re-elected President of this Board.

A vote of thanks was tendered to Commissioner Crimmins for his fair and impartial conduct during his occupancy of the office of President of this Board.

laws intended to meet the exigencies caused by the recent constitutional prohibition of the issue of bonds for local improvements and relative to the acquiring of lands required for various purposes and in relation to street openings. Ordered filed.

From the Counsel to the Corporation, in answer to a resolution of this Board asking for his opinion as to the powers and duties of this Department in the matter of the proposal of George F. Doak for furnishing gravel, in view of the suggestions of the Mayor and the Comptroller that there should be a re-advertisement, and stating that the responsibility of determining whether the best interests of the city require that the proposal in question should be accepted, or all proposals for the supply rejected and the contract re-advertised, rests, under the provisions of the law, upon this Board. Ordered filed.

From the Counsel to the Corporation, acknowledging the receipt of a communication from the Department, inclosing a copy of one from Miller & MacFarlane, attorneys for George F. Doak, requesting this Department to notify the Comptroller that it consents to the substitution of Charles Guide as one of the sureties on the proposal of George F. Doak for furnishing Roa Hook gravel, and stating that his opinion not having been asked in reference to the matter, he would await further request before advising. Ordered filed.

From the Secretary of the Civil Service Examining Board, submitting a list of eligible applicants for appointment as foreman of laborers. Ordered filed.

From Stewart L. Woodford, President of the New England Society of the City of New York, in relation to arranging for the unveiling ceremonies of the Pilgrim statue to be erected upon the Central Park. Referred to Commissioner Beekman.

From Daniel Burgess, architect, requesting permission to erect bay windows and piers of door-ways on houses Nos. 122, 124, 126, and 128 West Thirty-fifth street, the property of Mrs. A. M. Hegeman and Mrs. S. I. Palmer, each pier and window to project one foot beyond the house line. Granted.

From A. P. Spencer, calling attention to the need for detailing an additional officer at Washing-ton Square. Referred to Commissioner Beekman.

From the Architect, stating that he had prepared a design for a ladies' cottage, to be erected on the North Meadow, in Central Park, a portion of the cottage to be used by lawn-tennis players, at an estimated cost of $5,coo. Laid over.

From the Engineer of Construction : 1st. Reporting upon the condition of the bridges over the Harlem river, and under the jurisdic-

tion of this Department. On motion, the recommendations in said report were approved, and a copy of the report ordered

sent to the Superintendent of Parks, with instructions to carry out the work of repairs as recom-mended therein.

2d. Reporting upon the petition of Henry P. Sandford, Julia A. Bunting and others, for the construction of a sewer in One Hundred and Thirty-fifth street, between Willis avenue and Brown place, and recommending that a sewer be built in that street, from a point two hundred feet east of Willis avenue to Brook avenue, with a branch in Brown place, between One Hundred and Thirty-fifth and One Hundred and Thirty-sixth streets, as shown upon a sketch submitted by him.

On motion, the Engineer of Construction was directed to prepare and submit plans and specifi-cations for constructing a sewer in One Hundred and Thirty-fifth street, in the manner recommended by him.

From William C. Illig, Assistant, asking for an increase of salary. Ordered filed. From the Secretary of the Civil Service Examining Board, reporting S. B. Dowries as eligible

for promotion to the position of Assistant Engineer. The President presented a communication from Henry Kimball, asking for a renewal of his

permit to dispense food at the fountain-basin at Five Points Park. On motion, the President was authorized to continue such permission until July x next. The President presented a form of permit allowing the Suburban Rapid Transit Company to

open streets, etc., for the purpose of erecting their structures through the Twenty-third Ward, which was approved, and the President was authorized to sign the same.

The Board of Aldermen was requested to pass an ordinance authorizing this Department from time to time, during the year ending December 31, 1885, to purchase or contract for the purchase of gravel for use on the drives and walks of the Central Park and the Riverside drive, without puhlic letting.

The Gas Commission was requested to make arrangements for lighting Mount Morris by electric lights..

The Gas Commission was requested to inform this Department what action has been taken in conformity with a request made by this Board, June 22, 1881, for lighting Central Park below Seventy-ninth street by electric light ; also a request made September 17, 1884, for the lighting of the East Drive in Central Park by electric lights.

Commissioner Powers, from the Committee to whom was referred the subject of macadamizing streets in the Twenty-third and Twenty-fourth Wards during the present year, presented a report designating several streets and avenues which, in his judgment, should be macadamized, with an estimate of the cost of the same.

On motion, said report was accepted, and the work of macadamizing was ordered proceeded with.

Commissioner Beekman, to whom was referred the application of J. P. Ryan for a renewal of his license to sell refreshments on the Battery Park, made a verbal report, and recommended that said license be renewed for one year, upon the same terms and conditions as heretofore. Adopted.

Commissioner Powers, from the Committee to whom was referred the plans prepared by the Architect for a carriage-shed to be built at Claremont on Riverside Drive, made a verbal report, and moved that said plans be approved. Adopted.

On motion, Commissioner Beekman was requested to confer with the Board of Estimate and Apportionment as to the availability of the appropriation, Riverside Park improvement, to pay the expense of erecting carriage-sheds at Claremont, and report thereon to this Board.

The contract for erecting foundation walls and granite coping at the southerly part of Jeannette Park was awarded to John Donaldson, at $3,995, he being the lowest bidder.

The Topographical Engineer was directed to confer with the Engineer of Construction, and report to this Board whether, in their opinion, the grade of One Hundred and Fifty-sixth street, from College avenue to Railroad avenue, can be made to conform to the grade of Railroad avenue.

On motion, the subject of renewing the license of Joseph Scott, for Children's " Novelty " car-riages in the Central Park, was referred to Commissioner Beekman to report.

The President was authorized to purchase for the use of the laborers engaged in the regular maintenance work of the Parks, a suitable check overshirt or "jumper," and for the drivers a suit.. able hat, as uniform or distinguishing mark of the regular Departmental employees.

It was ordered that the work of planting and moving trees in Mount Morris Park be done under the direction of Commissioner Powers.

Commissioner Beekman was designated to conduct the trials of Parkkeepers until otherwise ordered by the Board.

The President was authorized to appoint a Keeper for duty on the bridge over Mott Haven, canal, at One Hundred and Thirty.eighth street.

Commissioner Powers was authorized to appoint a carpenter. In accordance with Regulation XXXV. of the Civil Service Regulations, James M. Shannon

was re-appointed to the position of Parkkeeper. The employment of twenty-four laborers and four double teams was authorized for work in the

Twenty-third and Twenty-fourth Wards. The employment of sixteen laborers for work on the parks, and four laborers for work on River-

side avenue, was authorized. The pay of double teams employed by this Department was fixed at $4.50 per day, to date

from the 6th inst. The pay of laborers on tar walks was fixed at $2 per day. The pay of the following-named persons was fixed at the rates set opposite their names respec-

tively : J. A. Briggs. Assistant Engineer, $x,800 per annum. B. R. Guyon, Assistant Engineer, $1,650 per annum. W. C. Illig, Assistant, $1,200 per annum. L. W. Spencer, Rodman, $2.50 per day. H. Morrissey, Axeman, $2.50 per day. Clarence Reton, Assistant Rodman, $2.50 per day. Myron Hume, Skilled Laborer, $3 per day. G. C. Hillman, Assistant, $3.50 per day. The following Parkkeepers were fined : Bernard R. Connolly, one day's pay. Edward Murray, one day's pay. William Duggan, two days' pay.

AQUEDUCT COMMISSION.

Minutes of Stated Meeting of the Aqueduct Commisszoners, held at their office, No. 209 Stezuort Building, Wednesday, ilfay 6, 1885, at 3 o'clock P.M.

Commissioners present-The Comptroller, Commissioner of Public Works, Commissioners James C. Spencer and C. C. Baldwin.

Also, Chief Engineer Church, Assistant Chief Engineer Fteley ; and Chief Engineer Birdsall and Consulting Engineer Adams of the Department of Public Works.

On motion of Commissioner Baldwin, Commissioner Spencer was elected Chairman. Chairman Spencer then declared the meeting open for public hearing, in relation to the pro-

posed modifications to be made upon that part of the line of the New Aqueduct between a point near Shaft No. 24, on the easterly side of the Harlem river, and a point near One Hundred and Thirty-fifth street and Convent avenue in the City of New York, as set forth in the public notice.

Mr. John D. Crimmins was then heard on behalf of the Convent of the Sacred Heart, owning lands at and near the southern terminus of the proposed modifications, and, after receiving from the Commissioners explanation of the proposed mode of locating and constructing the New Aqueduct to that point, he stated that the owners of the above-named property had no objection to offer thereto, but that they were greatly interested in its mode of construction from that point southward, and desired full opportunity to be heard when that matter was to be determined by the Commissioners.

Mr. Edward Morrison, of No. 13 West 1 hirty-ninth street, the owner of Lots Nos. 15, 26 and 17, in Block 1076, north side of One Hundred and Forty-ninth street, under which the New Aque-duct will pass, was next heard, and explanations given him of the plan under consideration and mode of obtaining his compensation for the easement required for the construction of the Aqueduct.

No one else appearing, the public hearing was then adjourned until Wednesday next, at 3 o'clock p. NI., and the Secretary directed to give public notice thereof.

The regular order of business was then taken up, and the minutes of the stated meeting of the 29th ultimo were read and approved.

The Committee on Finance and Audit reported the examination and audit of bills included in Vouchers Nos. 704 to 716, which vouchers were, on motion of •Commissioner Spencer, approved and ordered to be certified to the Comptroller for payment.

The Committee on Construction presented a report, dated May 4, 1885, viz. : 1st. Concurring in the recommendation of the Chief Engineer, for the promotion of Robert E.

Morris from Transitman to Assistant Engineer, with compensation at the rate of $1,800 per annum ; and of George Endicott, from Chainman to Rodman, with compensation at the rate of $75 per month ; and the appointment of Charles Percy Brown, as laborer, at $2 per day.

On motion of Commissioner Spencer, the above-named recommensiations were approved by the Commissioners, and the promotions and appointment made, to date from the entrance of the parties upon the discharge of the duties to which they are now assigned.

Recommending that the Chief Engineer, with the approval of a majority of the Committee on Construction, be authorized to grant permits for the removal, by owners of property along the line of the New Aqueduct, of stone excavated from the shafts or tunnel of the Aqueduct, for use in build trig walls, foundations, and making other improvements upon adjacent property.

On motion of Commissioner Baldwin, this recommenda tion was approved by the Commissioners, and authority given to grant permits for the purposes above named.

A letter was received from the Mayor, inclosing a communication from the President of the Department of Public Parks, in relation to the proposed route of the New Aqueduct through Central Park, and the damage to be inflicted upon the Park grounds by the construction of the Aqueduct in the manner proposed by this Commission.

The communications were read, and President Crimmins being present, he was heard in relation to the changes proposed by him ; and upon motion of Commissioner Spencer, the matter was referred to the Committee on Construction for investigation and report.

The Secretary next presented a letter from Cyrus W. Field, Esq., dated May 2, 1885, requesting the appointment, by the Aqueduct Commissioners, of watchmen or policemen to protect private property along the line of the New Aqueduct from depredation by the laborers employed by the contractors.

The letter was read, and referred to the Counsel to the Corporation for his opinion as to the power of the Commissioners to make such appointments, and as to the liability of the City in such cases.

By direction of the Committees of Finance and Audit, and Construction, the Auditor then presented a schedule showing the name, kind and place of occupation, and rate of pay of all persons in the Engineering Department of the Commission on the 1st instant.

On motion of Commissioner Spencer, said schedule was referred to the Secretary, with direc-tions to have it revised to date of printing, and printed simultaneously with the rules and regulations now under consideration for the Engineering Department.

On motion of Commissioner Spencer, all matters of unfinished business were laid over for future consideration by the full Board ; and the Commissioners then adjourned.

EVERY OWNER OR PERSON IN ANY WAY interested in any real estate between the Harlem

river and the northern boundary of the City and County of New York, intended to be taken or entered upon and used and occupied for the purposes of the new Aqueduct ; also any owner or person interested in any real estate contiguous thereto, and which may be affected by the constructioL and maintenance of said aqueduct, or of any of the works connected therewith, is hereby required to present his claim to the Commissioners of Appraisal appointed for the purpose of appraising such lands and easements, or ascertaining such damages, at the offices of said Commissioners, Room 803, in the Mutual Life In-surance Building, No. 32 Nassau street, in the City of New York.

Should the lowest formal estimate be accepted by the Board of Public Charities and Correction, due notice of this tact will be given forthwith upon the receipt of the Comptroller's approval of the sureties. presented by the bidder as consenting to be bound for the faithful execution of this contract if awarded. Each estimate must be verified by the oath, in writing, of the party making the same, that the several matters therein stated are true, and must be accompanied by the consent, in writing, of two householders or freeholders in the City of New York, to the effect that if the contract is awarded to the person making the estimate, they will, upon its being so awarded. become bound as his sureties for its faithful performance ; and that if he shall refuse or neglect to execute the sams, they will pay to the Corpora-tion any difference between the sum to which he would be entitled upon its completion, and that which the Corpora-tion may be obliged to pay to the person to whom the con-tract shall be awarded at any subsequent letting ; the amount to be calculated upon the estimated amount of the work by which the bids are tested.

The consent last above mentioned must be accompanied by the oath or affirmation, in writing, of each of the per-sons signing the same. that he is a householder or free-holder in the City of New York, and is worth the amount of the security required for the completion of the con-tract, over and above all his debts of every nature, and over and above hi- liabilities as bail, surety, or otherwise, and that he has offered himself as surety in good faith, with the intention to execute the bond required by law.

No estimate will be considered unless accompanied by either a certified check upon one of the national banks of the City of New York, drawn to the order of the Comptroller, or money, to the amount of fiveer centum of the amount of the security required for the fa

pithful per-

formance of the contract. Such check or money must NOT be inclosed in the sealed envelope containing the esti-mate, but must be handed to the officer or clerk of the Department who has charge of the Estimate-box, and no estimate can be deposited in said box until such check or money has been examined by said officer or clerk and found to be correct. All such deposits, except that of the successful bidder, will be returned to the persons making the same within three days after the contract is awarded. If the successful bidder shall neglect or refuse, within five days after notice that the contract has been awarded to him, to execute the same, the amount of the deposit made by him shall be forfeited to and be retained by the City of New York as liquidated damages for such neglect or refusal ; but if he shall execute the contract within the time aforesaid, the amount of his deposit will be returned to him.

TERMS AND CONDITIONS OF SALE.

The highest bidders will be required to pay ten (so; per cent. of the purchase money and the auctioneer's fee on each lot immediately after the sale ; thirty (so) per cent. upon the delivery of the deeds, within thirty days from the date of sale ; and the balance, sixty (6o, per cent., of the purchase money, or any portion thereof, may remain, at the option of the purchaser, on bond and mortgage, for five years, with interest at the rate of six per centum per annum, payable semi-annually, the mortgages to contain the customary thirty days' interest and ninety days tax clauses.

The bond and mortgage may be paid off at any time within the term thereof on giving thirty days' notice to the Comptroller, or it may be paid by installments of not less than five hundred dollars, on any day when the in-terest is due, or on thirty days' notice. The bonds and mortgages will be prepared by the Counsel to the Cor-poration, and the sum of twelve dollars and fifty cents will be charged for drawing, acknowledging and recording each separate mortgage. Included in any mortgage, the whole mortgage must be paid off before any release cats be given by the corpora-tion, as a release of any part of the premises included in a mortgage to the corporation is forbidden by law.

The Comptroller may, at his option, resell any lot which may be struck off to the highest bidder if he fail to comply with the terms of sale, and the party who may fail to comply therewith will he held liable for any deficiency that may result from any such resale.

The Comptroller is authorized and empowered to make such conditions and provisions with respect to the removal of any and all of the buildings on the premises fronting on Third avenue, and for the erection of new buildings thereon as he may consider advisable and necessary in the interest of the

hitherto liable or recently serving who have become exempt. exempt. and all needed information will be given.

Those who have not answered as to their liability, or proved permanent exemption, will receive a "jury en-rollment notice," requiring them to appear before me this year. Whether liable or not, such notices must be answered (in person, if possible, and at this office only) under severe penalties. If exempt, the party must bring proof of exemption . if liable, he must also answer in person, giving full and correct name, residence, etc., etc. No attention paid to letters.

Persons " enrolled " as liable must serve when called or pay their fines. No mere excuse will be allowed or interference permitted. The fines if unpaid will be en-tered as judgments upon the property of the delinquents

All good citizens will aid the course of justice, and secure reliable and respectable juries, and equalize their duty by serving promptly when summoned, allowing their clerks or subordinates to serve, reporting to me any attempt at bribery or evasion, and suggesting names for enrollment. Persons between sixty and seventy years of age, summer absentees, persons temporarily ill, and United States and District Court jurors are not exempt.

Every man must attend to his own notice. It is a mis-demeanor to give any jury paper to another to answer. It is also punishable by fine or imprisonment to give or receive any present or bribe, directly or indirectly, in. relation to a jury service, or to withhold any paper or make any false statement, and every case will be fully prosecuted.
