G.S.K. 1. In exercise of the powers conferred by theproviso to article 309 of the Constitution, and in super-session of the Central Vigilance Commission (Senior PersonalAssistant and Personal Assistant) Recruitment Rules, 1972,the President hereby makes the following rules regulatingthe method of recruitment to the post* of Senior PersonalAssistant and Personal Assistant in the Central VigilanceCommission, namely :—-
1. Short title and commencement.—(1) Theie rules maybe called the Central Vigilance Commission (Senior PersonalAssistant and Personal Assistant) Recruitment Rules, 1976,
(2) They shall come into force on ihc date of theirpublication in the Official Gazette
2. AppHcation,—These rules shall apply to the posts asspecified in column 1 of the Schedule annexed hereto.
3. Number of posts, classification and scale of pay.—Thenumber of the said posts, their classification and the scalesof pay attached thereto, shall be as specified in columns 1to 4 of the said Schedule.
4. Method of recruitment, age limit and other qualifica-tions.—The method of recruitment, ajje limit, qualificationsand other matters relating to the said posts, shall be asspecified in columns 5 to 13 of the Schedule aforesaid.
5. Disqualification.—No potion—(a) who has entered into or contracted a marriage with
a person having a spouse living, or

(b) who, having a spouse Lying, has entered into orcontracted a marriage with any person,
shall bo eligible for appointment to the said post.
Provided that the Central Government may, if satisfied thatsuch marriage is permissible under the personal lawapplicable to such person and the other party to the marriageand there are other grounds for so doing, exempt any personfrom the operation of this rule.
6. Power to relax.—Where the Central Government is ofopinion that it is necessary or expedient so to do, it may, byorder, for reasons to be recorded in writing and in consultationwith the Onion Public Service Commission, relax any of th:provisions of these rules with respect to any class or categoryof persons.
7. Saving.—Nothing in these rules shall affect reservationsand other concessions required to be provided for the Sche-duled Castes, the Scheduled Tribes and other special categoriesof persons in accordance with the orders issued by the CentralGovernment from time to time in this regard.

ANNEXURE
THE DOWRY PROHIBITION (PUNJAB AMENDMENT)ACT, 1976 (PUNJAB ACT 26 OF 1976) AS EXTENDED
TO THE UNION TERRITORY OF CHANDIGARH
An Act to amend the Dowry Prohibition Act, 1961, In ItsApplication to the State of Punjab
Be it enacted by the Legislature of the State of Punjab inthe Twenty-seventh Year of the Republic of India as fol-lows :—
1. Short title.—This Act may be called the Dowry Prohi-bition (Punjab Amendment) Act, 1976.
2. Amendment of Section 3 of Central Act, 28 of 1961.—In Section 3 of the Dowry Prohibition Act, 1961, in itsapplication to the Union territory of Chandigarh (hereinafterreferred to as the principal Act), for the words "six months,or with fine which may extend to five thousand rupees" thewords "one year, and fine which may extend to five thousandrupees" shall be substituted.
3. Amendment of section 4 of Central Act 28 of 1961.—In section 4 of the principal Act,—
(a) for the words "six months, or with fine which mayextend to five thousand rupees", the words "oneyear, and fine which may extend to five thouiandrupees" shall be substituted; and
(b) the proviso shall be omitted.
4. Insertion of new sections 4-A and 4-B in Central Act28 of 1961.—After section 4 of the principal Act, the follow-ing sections shall be inserted, namely:—
"4-A. Bar of certain acts.—Any person who—
(i) displays any presents made at the time of suchmarriage in the form of cash, ornaments, clothesor other articles ; or
(il) takes jn a. marriage party more than twenty-flVepersons exclusive or minon and th» membersof the band; or
(iii) gives in the form of Sagun at the time of thaka,betrothal or marriage, anything the value of whichexceeds eleven rupees; or
(iv) gives to the parents or any other relation of aparty to the marriage anything on the occasionof 'milni' or any other ceremony performed inrelation to betrothal or marriage; or
(v) serves to the marriage party more than twoprincipal meals;
shall be punishable with imprisonment for a. term which mayextend to six months or with fine which may extend to fivethousand rupees or with both.
Explanation.—In this section the expression "principal meal"means lunch or dinner.
4-B. Penalty for depriving any party of rights and privile-ges of marriage.—Any party to the marriage who, after themarriage, deprives the other party of the rights and privilegesof marriage, or tortures or refuses to maintain the said otherparty, for non-payment of dowry, and any person who assist*such party in the commission of such offence, shallbe punishable with imprisonment for a term whichmay extend to one year, and fine which may extend fo flv«thousand rupees."
5. Substitution of section 7 of Central Act 28 of 1961.—For section 7 of the Principal Act, the following section shallbe substituted, namely :—
"7. Cognizance of offences.—Notwithstanding anythingcontained in the Code of Criminal Procedure, 1973—
(1) no court Inferior to that of a Judicial Magistrateof the first class shall try any offence under thitAct;
(2) no court shall take cognizance of any offenc*punishable under sections 3, 4 and 4-B exceptupon a complaint made within one year from thedate of the offence, by some penon aggrieved hythe offence;
Provided that—
(a) where such person Is under the age of eighteenyears, or Is an idiot or a lunatic, or is fromsickness or infirmity unable to make n com-plaint, or is a woman who, according to thelocal customs and manners, ought not to becompelled to appear in public, iome otherperson may, with the leave of the court, mak*a complaint on his or her behalf;
fb) where the person aggrieved by an offence isthe wife, complaint may be made on her behalfby her father, mother, brother, sister or by herfather's or mother's brother or sister; and
(3) every offence under section 4-A shall b«cognizable:
Provided that no police officer below the rank of aDeputy Superintendent of Police shall investigateany offence punishable under thfa Act or makeany arrest therefor."
6. Substitution of section 8 of Central Act 28 of 1961.—For section 8 of the Principal Act, the following section shallbe substituted, namely:—
"8. Offences to be bailable and non-compoundable.Every offence under this Act shall be bailable andnon-compoundable."
7. Insertion of new section 8-A in Central Act 28 ol1961.—After section 8 of the Principal Act, the followingsection shall be inserted, namely :—

"8-A. Institution of proceedings.—No prosecution shallbe Instituted against any person in respect of anyoffence committed under this Act without the pre-vious sanction of the District Magistrate or of suchofficer as the State Government may by special orgeneral order appoint in this behalf."
I. Amendment of section 9 of Central Act 28 of 1961.—Iniwction 9 of the principal Act,—
(i) In sub-section (1), after the word* "Central Govern-ment" the words "or the State Government" shallbe inserted;
(11) In sub-section (2), after the words "every rule made"the words "by the Central Government" shall beinserted; and

4. Disqualifications.—No person,—
(a) who has entered into or contracted a marriage witha person having a spouse living, or

shall be eligible for appointment to the said post:

DRAFT REGULATIONS
1. These regulation may be called the Indian Boiler (Amend-ment) Regulations, 1976.
2. In the Indian Boiler Regulations, 1950, (i) for regulation26S, ihe following shall be substituted, namely :—
"268. Hydraulic Tests at Makers Works-Drums andsimilar components of the Water Tube Boilers shallbe hydruulically lested on completion of manufactureat the makers' woiks in the presence of InspectingOfficer to 1-1/2 times the design pressure withoutindication of weakness, or defect. Alternately,this lest may be made on completion of erectional site. In case of diums and headers which lireto he fitted with tube-), the test may be made beforediilling lube holes but af'er the uttachment ofnozzles anJ similar filtiiigs. The lest pressure shallbe maintained for a sufficient period to permit com-plete examination by the Inspecting Authority. Tncase of drums of 'Composite' constructions, e.g.,
part n'vetted nnd part welded seams of seamless,forged drums shells with ends attached by fusionwelding, (he test pressure shall be the same as for thefusion welded drum.
Should the hydraulic test .eveal any defect in the weldedscum, it shall not be repaited unless agreed to bythe Inspecting Authority
On completion of agreed repairs to a drum which haspreviously been strees-rclievcd by heat treatmentfurther heat treatment, if required by the InspectingAu'.hurity, shall be done and the drums shall againbe subjected to the hydraulic test";
fii) in regulation 379, for clause (al, the following shallbe substituted, namely : —
(a) "Subject to the provisions of sub-regulation (e) ofregulation 381 eve.y boiler shall be hydraulicallytested after erection on site in the presence of theInspector to 1-1/4 times the design pressure,without indication of weakness or defect. Tf theprocess of manufacture has not permitted thehydraulic test of the component in the manufac-turers' plant, the test on completion shall in anycase be taken to 1-1/2 times the design pressure.The hydrosalic test pressure shall be maintainedfor a sufficient period to permit complete examina-tion by the Inspector".

1. Short title and commencement :—(1) These rules maybe called Ihe Botanical Survey of India (Assistant Botanist(Cytology). Orchidologist, Assistant Economic Botanist andAssistant Pinnt Physiologist) Recruitment Rule, 1976.
(2) They shall come into force on the date of their publi-cation in the Official Gazette.

1, Shoit title and commencement.—(1) These rules maybe called the Delhi Uiban Art Commission (Accounts) Rules,1976.
(2) They shall come into force on the dale of their publi-cation in the Official Gazette.
2. Definitions,—In these rules, unless the context otherwiserequires,—
(a) 'Act1 means the Delhi Urban Art Commission Act,1973 (1 of 1974) ;
(b) 'Commission' means the Delhi Urbnn Art Commis-sion established under section 3 of the Act;
(c) 'Form' means a form appended to these rules ;
(d) 'Year' means the financial year commencing on the-1st of April and ending on the 31st day of Marchfollowing.
3. Maintenance of Cash Book,—(1) The Commission shallcause to be maintained a Cash Book in Form I and the sameshall be closed daily.
(2) An officer nominated by the Commission for that pur-pose shall lie responsible for the proper upkeep and mainte-nance of the Cash Book.
(3) The Cash Book shall be checked every day by anofficer nominated by the Commission for that purpose, whoshall record his signature with date in the Cash Book in tokenof the check made by him.
(4) All receipts of the Commission shall be duly acknow-ledged in machine-numbered forms approved by the Commis-sion and duly signed by the officer authorised in that behalf.
(5) All cheques received by the Commission shalf be sentpromptly to the bank for collection with a paying in slip

G.SJt 32,—In exercise of the powers conferred by theproviso to article 309 of the Constitution, the President herebymakes the following rules further to amend the Central Pub-lic Works Department (Subordinate Offices) Caretaker Re-cruitment (Revised) Rules, 1975, namely :—
1. (1) These rules may be called the Central Public WorksDepartment (Subordinate Offices) Caretaker (Re-vised) Recruitment (Amendment) Rules, 1976.
(2) They shall come into foicc from the date of theirpublication in the Official Gazette.
2. In the Schedule to the Central Public Works Department(Subordinate Offices) Caretaker Ttceruitment (Revised) Rules,1975,—
(i) for the entry in column 3, the following shall besubstituted, namely :—
"General Central Service Group 'C non-gazetted Non-Ministerial." ;
(ii) after (he entry in column 11, the following note shallbe inserted, namely :—
"Note.—Promotion to the post of Caretakei is to bemade on selection basis and not on the basis ofseniority-cum-fitness. All the eligible candidateshaving 5 years' service in the grade of AssistantCaretaker and Sanitary Inspector and 10 years-service in the grade of Work Assistant will togetherform a combined zone of consideration. Theirnames will be ai ranged in accordance with thedates from which they fulfilled the eligibility crite-rion. The Departmental Promotion Committee willconsider them on the basis of their confidentialreports and grade them in order of merit andpromotion will be made on the recommendationof the Departmental Promotion Committee.";
(iii) for the entry in column 12, the following shall besubstituted, namely :—
"Group *C Departmental Promotion Committee willcomprise of the following :—
(1) Chairman—Superintending Iingineor.
(2) Mcmbeis—Two Executive Engineers at Head-quarters."

G.S.R. 36,—In exercise of the powcis conferred by section7 of the Indian Telegraph Act, 1885 (13 of 1885), the CentralGovernment hereby makes the following rules further toamend the Indian Telegraph Rules, 1951, namely:—
1. (1) These rules may be called the Indian Telegraph(Ninth Amendment) Rules, 1976.
(2) They shall come into force on the First January1977.
2. In the Indian Telegraph Rules, 1951 (hereinafter referredto as the said rules), rule 429 shall be re-numbercd ns sub-rule (1) of that rule, and afier sub-rule (1) as so rc-numbcred,the following sub-rules shall be inserted, namely:—
"(2) (a) Where the pcrmisinon under sub-rule (1) forthe transfer of the telephone relates to a transfer,other than any of the transfers referred to in thoproviso to sub-item (a) of item 3 in Section I ofrule 434, and such transfer is approved, permissionshall be granted only when the transferee pays thelump-sum payment specified in Section IV of thatrule in addition to the transfer fxe specified in Sec-tion I thereof.
(b) A telephone once transferred shall not be shifted toany other place, unless a period of two years haselapsed from the date of such transfer.
(3) Where a telephone to which the provisions of sub-rule (2) apply is shifted from one place to anothei. thetelephone shall not be transferred to another person, unlessa period of two years has elapsed from the date of suchshifting.
(4) The provisions of sub-rules (2) and (3) shall cease tooperate on and from such date as the Central Governmentmay be notification specify in this behalf".
3. In rule 434 of the said rules, in Section I relating tofees, in item 3, to sub-item (a), the following proviso shallbe added, namely :—
"Provided that the transfer fee for transfer of rt telephoneconnection shall be fifty rupees in any of tht follow-ing cases, namely :—<
(i) Transfer of a telephone in the personal n ime of;—
(a) a deceased subscriber, to his legal heir orsuccessor ;

(b) a subscriber, to his father, mother, wife, husband,son or daughter, as the case may be ;
(c) a subscriber, on account of any change in thename of the subscriber for any reason ;
(ii) transfer of an official telephone in Iho name of anofficer of the Government or of a local authorityor of a corporation owned or controlled by theGovernment or of an institution owned or con-trolled by the Government, on account of anychange in the authority hiring the telephone onbehalf of such officer.
Explanation.—In this clause, "Corporation owned or controlledby the Government" includes a society registeredunder any law relating to registration of societies,so owned or controlled, a corporation so ownedor controlled and established by or under a Central,Provincial or State Act, and a Government Com-pany as defined in Section 617 of the CompaniesAct, 1956 (1 of 1956);
(iii) transfer of a telephone in the name of a firm orcompany or of an institution or organization orassociation or any similar body, on account of anychange in the name or constitution or both of thesaid firm, company, institution, organization, asso-ciation or similar body".

C.S.R. 37.—In exercise of <he powers conferred by sub-section (1) of section 642, read with sub-section (1) ofsection 153B, of the Companies Act, 1956 (1 of 1956), theCentral Government hereby makes the following rules furtherto amend the Trustees (Declaration of Holdings of Sharesand Debentures) Rules, 1964, namely:—
1. (1) These rules may be called the Trustees (Declarationof Holdings of Shares and Debentures) (Amendment) Rules,1976.
(2) They shall come into force on the date of their publica-tion in the Official Gazetfe.
2. For rule 4 of the Trustees (Declaration of Holdings ofShares and Debentures) Rules 1964, (hereinafter referredto as the said rules), the following rule shall be substituted,namely:—
"4. Change in holdings and other particular.—A trusteeshall, in the event of any change in (he holdingsdeclared by him under rule 3 or of any change inthe particulars included in Form I, send a report topublic trustee in Fojrm 11 of such change withinthirty days from the date of such change .
3. In Form I of the said rules,—
(i) for paragraph 7, the following paragraph shull besubstituted, namely:—
"7. Name and address of company (ies) in whichshares or debentures are held by the trustce(s)."
(ii) after paragraph 10, the following paragraph shall beinserted, namely:—
"11. Date(s) on which such sharesi/dcbentures wereacquired by the trustcc(s)."
4. In Form II of the said rules,—(i) for the heading, the following heading shall bo sub-
stituted, namely:—"FORM OF REPORT TO THE PUBLIC TRUSTEE
IN THE EVENT OF ANY CHANGE IN THEHOT DING OR OTHER PARTICULARS DE-CLARED BY A TRUSTEE."
(ii) for paragraph 6, the following paragraph shall besubstituted, namely:-—
"6. Nalnie of change (in <hr rase of ch.inge in hol-dings, the number of shares of different classesin, or the debentures of the company(ies) heldby the trustee affected thereby together withthe paid-up and nominal value of each suchshare and the nominal value of each debentureshould be indicated)".
