Since last September we have enjoyed a tour of the largest prison being built this side of the Missouri River. And, if you think meeting people is interesting, you missed meeting the most interesting superintendant of 4,000 hardened criminals you could ever meet. Standing at an abrupt five feet, Superintendant Cynthia Link is a remarkable young woman in a place of high power commanding over 1,000 officers and 4,000 inmates, many with life sentences. She is certainly “not your grandmother’s ASIS.” Or, perhaps you missed journalist and investigator, Ione Grillo, who interestingly is embedded in Mexico City, one of the narco terror capitals of the world. His global take on the situation was spellbinding, his pictures eye- opening, and his engagement exciting. And, if cybersecurity is your thing and not your grandmother’s, then the standing room only crowd for a broad brush stroke of mobile security in the workplace by Leeza Garber, an attorney specializing in all things tech, was the best attended seminar of SecureWorld in April. If you wanted HR blended with emergency planning for the security professional, then Ed Wurster, global consultant, gave an absolutely outstanding presentation on modern Human Resources. He tuned in and up our cognizance about many aspects of corporate security in the age of risk management. Do you think terrorism doesn’t exist at home? PECO/Exelon’s Michael Melvin presented great information on the protection of our critical infrastructure throughout the area during our meeting at the Broad Axe Tavern in Ambler – a great place with top-of- the-line presentation gear, great food and an easy location for all. If you think we meet and gather for all-male, “listen-‘til-you-sleep,” “boring,” “I knew that,” seminars – then you’ve been missing some great education, on-site learning experiences, and opportunities to meet the game-changers of tomorrow.

Since last September we have enjoyed a tour of the largest prison being built this side of the Missouri River. ASIS Council Corner Don Shellenberger, CPP, Council Liaison

Do you find it easier to talk about what you know than what you’re not as familiar with? Most of us do, which is why I think many of our GPC members would make great additions to one of the ASIS Councils. Many of the councils get frequent requests for someone to come and ”talk/present to” a specific ASIS Chapter, Agency, or Public-Private Organizations event. The topics requested include the entire spectrum within a Councils area of responsibility and purpose. Most of the requests are coordinated through the specific

Councils leadership structure and attempts are made to identify council members closest to the requester’s locale. They don’t ask you to volunteer to fly across the country although if you’re business opportunities present you with a similar logistical solution, there’s no reason why you can’t mix work and volunteer activities!

Still not ready to commit to Council volunteer leadership? Then why not start with volunteering to participate with a respective Council member on a panel as a Subject Matter Advocate?

Notice I didn’t use the ‘SME’ word, because many times I still think I have lots to learn, don’t we all? As a panel volunteer you can simply share your experiences, lessons learned, and help grow the professionalism within our GPC ranks! Our recent participation in the SecureWorld Event at the Valley Forge Hilton was a great success. Our Information Table brought our organization and, specifically the Greater Philadelphia Chapter, to the attention of many people in the Tech Community who were not even aware of the existence of ASIS International and our vision/mission.

Our Speakers were among the very

best appearing that day, with GPC-ASIS’s speaking venue packed to standing room only capacity for each session. We have attracted a few new members thanks to such efforts of Chairman Forstater. We enthusiastically welcome them and all they have to offer the members of our Chapter and ASIS International.

We are all continually working diligently to attract new professionals,

especially Bill Alton and Don Shellenberger who network and contact many prospective members through Social Media sources. Thus, we encourage all our members to talk-up our Chapter and ASIS generally among your friends in your individual fields of endeavor as well as anyone your professional intuition tells you could be a valuable asset to us and vice-versa.

Coming up will be a tour of Sunoco’s Central Monitoring Facility which establishes communication with over 1,500 sites nationally and will soon become one of the nation’s only totally virtualized, IP‑integrated audio, video,

and burglar alarm monitoring systems. We’re also trying to arrange a tour

with Independence National Historic Park. A Family Day. Bring your spouse, your kids, and your grandchildren. We’re going to have a blast! The date is pending the superintendent arranging a perfect day. Stay tuned.

A visit to the Delaware Valley Intelligence Center will cap off our special tours this year. It will be your opportunity to see the real-time crime center, the intelligence gathering center, and where the anti-terrorism task force takes its training.

Our Private Security Appreciation

Night is well-attended and takes place in November; coordinated by Committee Chair, Mark Wolfheimer. And December’s Holiday Party is one of the best that we hold at the Philadelphia Cricket Club, with arrangements and wonderful accommodations through Committee Chair, Bill Lutz.

So, come on out on June 21st for a summer solstice ($10 donation) and realign your stars with an ASIS telescope directed at your career, friendship, and education. It will be a night for Young Professionals, Military Liaison, and Women in Security, as well as programs.

“Stake Out” of Law Enforcement Offices

In U.S. v. Taketa, 923 F.2d 665 (1991), the warrantless video surveillance of a DEA office where a DEA agent and the state law enforcement officer who occupied the office were suspected of operating an illegal wiretap device was held to be in violation of the Fourth Amendment. The admission of this video evidence at the suspects' trial for illegal wiretapping was declared to be error requiring the reversal of the convictions. The court found that the officer had a reasonable expectation of privacy in his office and that the reasonableness standard applicable to investigations of work-related employee misconduct did not apply because, by the time the video surveillance was begun, the investigation had become a criminal matter. The court stated that the agent had had a subjective expectation that he would not be subject to surveillance in his colleague's office at any time, and particularly on the Sunday when the surveillance occurred.

General Surveillance

In Midland Steel Products Co. v. International Union, United Auto, etc. Local 486, 61 Ohio St 3d 121 (1991), the court admitted a video showing violations of a temporary restraining order in labor dispute under a "silent witness" theory (tape itself is witness that speaks for itself, requiring only reasonable foundation of custody and accuracy), where tape was made by industrial surveillance system installed to monitor factory gate, and where foundation for admission as silent witness was laid by security supervisor who described system and testified that he personally operated system during taping. In Pressley v State, 770 So. 2d 115 (Ala. Crim. App. 1999), the court held admissible a surveillance video of the pawnshop in which murders took place under "silent witness" theory, by calling police sergeant who searched crime scene for surveillance equipment and who had expertise in surveillance camera systems, as sergeant's testimony established that surveillance system was in proper working order and capable of

recording accurately what was happening in area it was focused on, and thus indicated that video recording was correct and authentic.

In Tolver v. State, 269 Ga 530 (1998), the court admitted a video from a store surveillance camera which recorded murder of store clerk where testimony was presented as to store's procedures regarding camera, state Bureau of Investigation agent who found tape, forensic photographer who repaired tape, and investigator who created copy of tape.

attorney who represents developers, owners, contractors, subcontractors, building material manufacturers, architects, and engineers in construction and building product-related matters, including claims, litigation, and contract formation/interpretation. Joe is also a licensed Architect, and in that prior capacity was a Project Architect for various institutional and private clients. He is a member of the State Bar of California, is licensed to practice in State and Federal Court, and is a member of the American Bar Association.
