(i) The Managing Directors of Public Sector Undertakings invariablyfail to hold the Annual General Meetings within the financial year.

(iii) In case a proxy is to be nominated for a delayed Annual GeneralMeeting not held within the financial year, the file shall berouted through the Chief Secretary and the Principal Srcretaryto the Chief Minister.

Now, therefore, it is declared under section 6 of the Land AcquisitionAct, (Svt.) 1990 that the aforementioned land is needed for public purpose.Further, the Collector, Land Acquisition (ACR), Udhampur is directedunder section 7 of the said Act, to take order for acquisition of the abovespecified land.

However, the Collector, Land Acquisition (ACR), Udhampur shall bepersonally responsible for proper title verification of all types of land involvedin the case, and in respect of all the interested parties/land owners/rightfulclaimants in accordance with the relevant laws/rules in force, whilemaking the final award in the case. CHAPTER I

1. Short title and commencement.––(i) These Rules may be calledthe Jammu and Kashmir Ministerial Staff of the Subordinate Courts(Recruitment and Conditions of Service) Rules, 2016.

(ii) These Rules shall come into force with effect from the date oftheir publication in the Government Gazette.

2. Definitions.––In the Rules unless the context otherwise

requires,––

(a) ‘Administrative Department’ for the purpose of these Rules

and all other Rules applicable to the ministerial officials means

the High Court of Jammu and Kashmir exercising its control

on ministerial staff through the Chief Justice ;

(b) ‘Chief Justice’ means the Chief Justice of the High Court of

Jammu and Kashmir ;

(c) ‘Competent Authority’ means the Chief Justice or such other

authority as may be prescribed by the regulations ;

(d) ‘Competitive Examination’ means the Examination in such

papers, such other practical tests like typing, stenography etc.

and such viva voce test or other tests prescribed by these

Rules or as may be prescribed by the Chief Justice from time

to time for different posts ;

(e) ‘Departmental Promotion Committee’ means a Committee set

up by the Competent Authority for purposes of preparing the

list of eligible persons for promotion to a category of posts

under these Rules ;

(f) ‘District Cadre’ means a cadre of the Department in the

District comprising all the posts shown in Schedule ‘A’ as

District Cadre posts ;

(g) ‘District Recruitment Board (Judicial)’ means the Board

constituted under these Rules or Regulations for the

appointment of a person borne on a District Cadre ;

(h) ‘Divisional Cadre’ means the cadre of the Department in the

Division comprising all posts shown in Schedule (A) as

Divisional cadre posts ;

(i) ‘Divisional Recruitment Board’ means the Board constitutedunder the Rules or Regulations for appointment of a person tothe post borne on the Divisional Cadre ;

(j) ‘Government’ means the Government of Jammu andKashmir ;

(k) ‘High Court’ means the High Court of Jammu and Kashmir.

(1) ‘Judge’ means the Judge of the High Court of Jammu andKashmir ;

(m) ‘Ministerial Officials’ means staff of every class and categoryworking in the Subordinate Courts of the State ;

(n) ‘Regulations’ means the Regulations as prescribed by the ChiefJustice under these Rules.

(o) ‘Service’ means the Jammu and Kashmir Ministerial Officialsof Subordinate Courts Service ;

(p) ‘State’ means the State of Jammu and Kashmir ;

(q) ‘State cadre’ means the cadre of the department in the Statecomprising all posts shown in Schedule ‘A’ as State cadreposts.

3. Interpretation.––If, at any time, there arises any doubt regardingthe application or interpretation of these rules, the same shall be decided bythe Chief Justice whose decision in the matter shall be final.

4. Delegation.––The High Court or the Chief Justice, as the casemay be, may, by a special or general order, delegate all or any of the powersand functions as conferred or enjoined under these rules, to any Judge oran officer of the High Court.

CHAPTER II

5. Constitution of J&K Ministerial Staff of Subordinate CourtsService.––“J&K Ministerial Staff of Subordinate Courts Service” shallcome into being from the date of coming into force of these Rules. Theservice shall consist of posts as shown in the Schedule ‘A’. Persons alreadyserving as Ministerial Staff at various levels and in different capacitiesprior to the coming into force of these rules shall form part of the service intheir respective classes and categories. The grades of all these posts shallbe the same as shown in Schedule ‘A’ subject to the change, modificationor addition or revision as may be approved and sanctioned by the Governmentfrom time to time on the recommendation of the Chief Justice or otherwise.

6. Strength and composition of the cadre.––The State, Divisionaland District Cadre of the Service shall consist of such number of permanentand temporary posts as stand sanctioned in the respective cadres on thedate of enforcement of these Rules and such number of posts as may besanctioned from time to time.

7. Appointment to the service.––(i) Appointment to the Serviceshall be made––

(a) by direct recruitment ;

(b) by promotion ; and

(c) partly by direct recruitment and partly by promotion.

(ii) In case suitable candidates are not available for appointment in amode prescribed in the Schedule, viz., by promotion or direct recruitment,the posts may be filled up by other mode or in such other manner as theChief Justice may from time to time prescribe.

8. Age for direct recruitment.––Age for direct recruitment in theservice shall be the same as is provided and is made applicable to the StateGovernment Service from time to time :

Provided that the age bar may be relaxed in general or individualcases for the reasons to be recorded in writing by the Chief Justice, if somespecial circumstances so warrant.

9. Probation.––Persons appointed whether by direct recruitment orby promotion, to any class or category in the service shall be on probationfor two years and their confirmation shall be subject to their clearingprobation period satisfactorily. The Chief Justice may extend the period ofprobation in respect of a person appointed for reasons to be recorded inwriting.

10. Qualifications for appointment.––(i) No person shall be eligiblefor appointment in the service, whether by direct recruitment or on promotion,unless he fulfills the requisite qualifications prescribed for such appointmentin the Schedule-‘B’ to these Rules :

Provided that while granting promotion to a higher post, officials whoare in service on the date these rules come into force shall be considerednotwithstanding their qualifications and due regard shall be given to theservice rendered by such employee. Chief Justice may grant relaxation inacademic qualification to an in-service candidate in such cases, if he isotherwise suitable for the post and his service record has remainedsatisfactory :

Provided that in exceptional cases, for reasons to be recorded inwriting, the Chief Justice may relax the qualification bar, either generally orin individual cases.

(ii) Only permanent residents of Jammu and Kashmir State shall beeligible for appointment in the service.

11. Reservations in appointments.––While making appointmentseither by direct recruitment or promotion, reservation shall be made inaccordance with the rules and orders issued from time to time for membersof the Scheduled Castes, Scheduled Tribes or any other category or classof permanent residents of the State for whom reservation may be madeunder orders of the Government subject to such modifications as are deemednecessary by the High Court. The Chief Justice may from time to time,either generally or with relation to any particular recruitment, issue guidelinesfor the purposes of making such reservation.

12. Procedure for appointment.––(i) The appointments of ministerialstaff of the Divisional Cadre and the District Cadre shall be made by theChief Justice and the District Judge of the District concerned respectively,as the case may be, in accordance with the procedure prescribed, thereforunder the, Regulations framed by the Chief Justice. The Regulationsinter alia, provide for the following :––

(a) Method of selection to a particular post ;

(b) The manner in which applications are to be invited fromprospective candidate ;

(c) The holding of written examination for preliminary scrutiny ofcandidates or selection, as the case may be ;

(d) The syllabus prescribed for such written examinations andmarks earmarked therefor ;

(e) Conduct of the viva voce, shorthand and the type test and themarks prescribed therefor ;

(f) The Constitution of Selection Committee either generalor in case of specified classes of selection/appointment, ifnecessary ;

(g) The number of candidates to be called for viva voce/shorthand/typing test based upon the result of written examination, withreference to the availability of posts in any particular class orcategory ;

(h) The preparation of select/waiting list/and the period for whichit may remain valid ; and

(i) Constitution of a District or Divisional Recruitment Board.

13. Discipline and conduct.––In regard to all matters governingthe discipline and conduct of the members of the service, including discipline,suspension, imposition of penalty, retirement on superannuation or otherwise,

including voluntary retirement, removal or dismissal from service or mattersrelated thereto, directly or indirectly, and not specifically prescribed in orprovided for by these rules, the correspondence rules applicable to theemployees of the State Government, including J&K Civil Services(Classification, Control and Appeal) Rules, 1956 shall be applicable :

Provided that where any of the power relating to these matters is tobe exercised by the Government under various rules, same shall, underthese rules, be exercised by the Chief Justice and power vested in theGovernment in this behalf shall deemed to have vested in the Chief Justice.

14. Residuary matters.––In regard to matters relating to leave,pension gratuity, medical reimbursement, compulsory and voluntaryretirements and such other matters for which no specific provisions havebeen made in these rules, the rules, regulations, order and policies, as areapplicable, from time to time, to employees in the State Government shallbe applicable to the members of the service :

Provided that where any of the power relating to these matters is tobe exercised by the Government under various rules, same shall, underthese rules, be exercised by the Chief Justice and power vested in theGovernment in this behalf shall deemed to have vested in the Chief Justice.

15. Transfers.––(i) Within district, transfers of Ministerial Staffmay be ordered by the District Judge of the District concerned.

(ii) Inter-District and Inter-Divisional transfers of Ministerial Staffmay be ordered by the Chief Justice :

Provided that the Chief Justice shall, also have the powers to effecttransfers within district in the interest of administration.

(iii) The Chief Justice may transfer, depute or induct an employee inthe High Court Service in the administrative exigency and on accordingconsideration to all eligible and similarly situated officials. The Chief Justicemay transfer by way of deputation a Ministerial Official to the High Court

Service in the administrative exigency and on according considerationto all eligible and similarly situated officials.

(iv) The Chief Justice may, from time to time issue directions/ordersregulating the policy of transfers of ministerial staff, including transfer byway of deputation.

16. Maintain of character rolls, their communication andrepresentation against adverse entries.––

(I) (a) An annual character roll shall be recorded and maintainedfor each member of the service ;

(b) Entries in the character roll of the members of the servicebelonging to the Divisional Cadre shall be recorded annuallyby, an officer appointed in this behalf by the Chief Justice ;

(c) Entries in the character rolls of the members belongings tothe District Cadre shall be recorded by the District Judgeconcerned ;

(d) In respect of members of the service, belonging to bothDivisional as well as the District Cadre, the PresidingOfficers of the Court, where such member is serving, shallsubmit his report/assessment annually along with characterroll-form prescribed for this purpose to the Officermentioned in sub-clause (b) above or the District Judgeconcerned mentioned in sub-clause (c) above and, whilerecording the annual character roll, both of them shallordinarily be guided by such report assessment of thePresiding Officer of the Court unless concerned Officer orthe District Judge, as the case may be, comes to a differentconclusion and disagrees with the report assessment of thePresiding Officer, for reasons to be recorded in writing.

(II) Adverse entries in the character roll shall be communicated tothe concerned member of the service.

(III) If any person is aggrieved by any entry(ies) recorded in hischaracter roll he may make a representation in writing to theauthority regarding such entry(ies) within 30 days from the dateof communication of such entry(ies). On receipt andconsideration of such representation such authority may disposeit of on its merits and pass appropriate orders.

(IV) Any person aggrieved by the passing of an order mentioned inclause (II) above, may prefer an appeal within 60 days from thedate of passing of such an order to the Chief Justice who onconsideration of such appeal, shall pass appropriate orders.

17. Crossing of efficiency bar.––No Member of MinisterialStaff shall be allowed to cross the efficiency bar prescribed in the scaleunless,––

(i) he possess the qualification, if any, prescribed for holding thescale ;

(ii) his character rolls for the last three years have beengood ; and

(iii) his work and conduct is certified to be good by the PresidingOfficer of the Court where he is working.

18. Seniority.––(i) Seniority shall be determined and maintainedseparately for each category and post in the establishment ;

(ii) Separate seniority lists shall be maintained in the State, Divisionaland District Cadre in the High Court.

(iii) General principles of seniority and those specifically containedin the J&K Civil Services (Classification, Control and Appeal) Rules, 1956shall apply with respect to matters relating to seniority in the service.

19. Powers to dispense with the application of rules.––Notwithstanding anything contained in these rules, where the Chief Justiceis satisfied that the operation of any rule causes undue hardship in anyparticular case, he may by order, dispense with or relax the requirements ofthat rule, to such extent an subject to such conditions as he may consider

necessary for dealing with the case in a just and equitable manner ; providedthat the case is not dealt with in a manner less favourable to the concernedthan in accordance with the rules.

20. All matters of appointment, promotion, seniority, suspension, leaveand punishment of the ministerial staff of the Divisional Cadre shall bedecided by the competent authority.

21. (i) An appeal shall lie to the Chief Justice against any orderpassed by a District Judge relating to suspension, promotion, seniority orany punishment imposed by him. An appeal against the order of ChiefJustice regarding dismissal or removal shall lie to two Judges of the HighCourt to be nominated by the Chief Justice.

(ii) The aggrieved employee shall file the appeal before the CompetentAuthority within thirty days from the date of receipt of the order by him.

22. Suspension.––Any member of the service belonging to theDivisional or District Cadre may, for sufficient reasons and in accordancewith the principles laid down in the J&K Civil Services (Classification,Control and Appeal) Rules, 1956 be suspended by the District Judge of theDistrict concerned where he is serving at the relevant time. The suspension,however by the said District Judge of the members of the service belongingto the Divisional Cadre shall be subject to confirmation by the Chief Justice.

23. Repeal and saving.––(i) All rules, orders, notifications ordirections corresponding to or inconsistent with these rules and in forceimmediately before the commencement of these rules are hereby repealed.

(ii) Notwithstanding such repeal any order made or action taken underthe provisions of the rules repealed shall be deemed to have been made ortaken under the corresponding provisions of these rules.

An Act to amend the Jammu and Kashmir Panchayati Raj

Act, 1989.

In exercise of the powers vested under Proclamation No. P-1/

16 dated 9th January, 2016, the Governor is pleased to enact as

follows :––

1. Short title and commencement.––(1) This Act may be calledthe Jammu and Kashmir Panchayati Raj (Amendment) Act, 2016.

(2) It shall come into force from the date of its publication inthe Government Gazette.

2. Amendment in section 36, Act No. IX of 1989.––In section 36of the Jammu and Kashmir Panchayati Raj Act, 1989, in sub-section(1), after the existing proviso, the following proviso shall be added,namely :––

“Provided further that for purposes of holding general electionsunder the Act in the year 2016, the superintendence, directionand control of the preparation of electoral rolls for, and theconduct of, all elections under this Act shall continue to vest inthe Chief Electoral Officer of the State as heretofore”.

2. Definitions.––Unless the context otherwise requires,––

(i) “Chief Justice” means the Chief Justice of the High Court ofJammu and Kashmir ;

(ii) “Administrative Judge” means a Judge of the High Court ofJammu and Kashmir, in charge of the administration of a Districtor Districts ;

(iii) “Service” means the Jammu and Kashmir State JudicialService ;

(iv) “Member of the Service” means persons holding the followingposts including those who are on deputation or on otherduty :––

(a) Principal District and Sessions Judge ;

(b) Additional District and Sessions Judge/Additional DistrictJudge/Additional Sessions Judge ;

(c) Chief Judicial Magistrate/Civil Judge Senior Division/Subordinate Judge/Judge Small Causes/Special MobileMagistrate ;

(d) Civil Judge Junior Division/Munsiff /Judicial Magistrate1st Class/Additional Mobile Magistrate.

(v) “District Unit Head” means the Principal District Judge headingthe judicial administration of a District ;

(vi) “District Judge” means those Members of Service in the cadreof the District Judge (Super time Scale), the District Judge(Selection Grade) and the District Judge (Entry Level) ;

(vii) “Form” means a form appended to these guidelines ;

(viii) “Annual/Year” means the period of twelve months commencingfrom “the 1st day of January and ending by the 31st day ofDecember” of each calendar year.

3. Confidential Record.––(i) Annual Confidential Record (ACR)shall be prepared in Form-B in respect of every District Judge and inForm-C in respect of other Members of the Service.

(ii) The period for the purpose of recording Annual ConfidentialRecord shall be the year commencing from 1st day of January and endingby the 31st day of December :

Provided that in respect of a probationer, Confidential Record shallbe prepared for every period of four months of service till he/she is confirmedor his/her probation is declared on its satisfactory completion :

Provided further that in respect of Member of the Service, who hasworked for more than three months in more than one District in any year,separate Confidential Record for each such period shall be recorded.

(iii) Notwithstanding anything provided hereinabove at (i), a SpecialConfidential Record (SCR) shall be recorded by the Administrative Judgeor District Unit Head whenever called for by the High Court, in order toassess the suitability of any Member of the Service for confirmation orpromotion.

4. Furnishing of particulars by the Member.––(i) Every Memberof Service in the cadre of District Judge including those who are ondeputation to other departments or on other duty shall submit particulars inForm-A to the High Court before 28th/29th February of every year coveringinformation upto the 31st December of the preceding year.

(ii) Every Member of the Service other than the District Judgeincluding those who are on deputation to other departments or on otherduty shall submit a statement in Form ‘A’ so as to reach the District UnitHead concerned before 15th February of every year covering informationup to the 31st December of the preceding year.

5. Preparation and transmission of records in respect of Membersof the Service other than District Judges.––

(i) (a) The Annual Confidential Record of every Member ofService including those who are on deputation to otherdepartments or on other duty, shall be prepared by theDistrict Unit Head concerned in Form ‘C’. The AnnualConfidential Record, in Form ‘C’ along with particularsreceived in Form ‘A’ shall be submitted to the HighCourt before the end of February of every year ;

(b) The record shall thereafter be placed before theAdministrative Judge who shall record his opinion ;

(c) In case the Administrative Judge, who ceases to be a Judgeof the High Court, has not recorded his opinion before hisrelinquishment, his successor or the Judge nominated bythe Chief Justice shall record his opinion on the confidentialrecord ;

(d) If any adverse remarks are recorded by the District UnitHead and not dissented from by the Administrative Judgeor if any adverse remarks are recorded by the AdministrativeJudge, then the Confidential Record shall be placed beforethe Chief Justice who shall record his remarks.

(ii) (a) If a Member of Service has worked for more than threemonths in more than one District in a “Year”, all the DistrictUnit Heads concerned shall prepare and submit aConfidential Record in respect of such member for therespective period in the same manner as providedhereinabove at (i) ;

(b) When a Member of Service is transferred within threemonths, from one District to another, the District Unit Headof the District to which the member is transferred andworking as on 31st December of the “Year” shall prepare

the Confidential Record of the Member for the “Year” afterobtaining required particulars for respective period from theDistrict Unit Heads of the Districts from which he wastransferred ;

(iii) (a) Where a District Unit Head retires during a year, he shall,before relinquishing his Office, prepare and submitConfidential Records in respect of such Members of Servicewho have worked under his control for more than threemonths in that year in the same manner as providedhereinabove at (i).

(b) Where a Member of Service retires during the year, theDistrict Unit Head under whom he has worked for morethan three months, in that year, shall prepare and submit aConfidential Record in respect of that Member of Servicecovering such period in the same manner as providedhereinabove at (i).

6. Preparation of records in respect of District Judges includingthose on deputation or on other duty.––(i) In respect of a District Judge,the Administrative Judge shall record the Confidential Record in the samemanner and within the same time as provided hereinabove at 5, inForm ‘B’.

(ii) The Annual Confidential Record (ACR) in respect of DistrictJudges who are on deputation to other departments shall be prepared bythe Administrative Judge of the District in which they have been posted ondeputation and are working or by any other Judge nominated for the purposeby the Chief Justice, in Form ‘B’, in the same manner and within the sametime as provided hereinabove at 5.

(iii) Where an Administrative Judge of a District ceases to be a Judgeof the High Court during the “Year”, he shall before relinquishing his officeprepare the Annual Confidential Record (ACR) in respect of District Judgesor any Member of Service who are on deputation to other departments,

who have worked in that District for more than three months in that year, in

the same manner as provided hereinabove at 5 :

Provided that in case the Administrative Judge, who ceased to be a

Judge of the High Court, has not prepared the confidential records before

his relinquishment, his successor or the Judge nominated for the purpose by

the Chief Justice shall prepare the confidential record.

(iv) The Annual Confidential Record (ACR) prepared by the

Administrative Judge or any other Judge nominated by the Chief Justice,

under this rule, shall be placed before the Chief Justice, who shall record

his remarks.

7. Preparation of records in respect of District Judges and other

Members of Service on deputation to the High Court.––The Annual

Confidential Record (ACR) in respect of any Member of Service who is

on deputation to the High Court shall be prepared by the Chief Justice or

any other Judge nominated for the purpose by the Chief Justice, in

Form ‘B’.

If the Annual Confidential Record (ACR) of any Member of Service

who is on deputation to the High Court, prepared by a Judge nominated by

the Chief Justice, contains adverse remarks, then the Confidential Record

shall be placed before the Chief Justice who shall record his remarks.

8. Communication of entries in Annual Confidential Record.––

(i) All entries in Annual Confidential Record (ACR) or Special Confidential

Record (SCR), whether “Outstanding”, “Very Good”, “Good”, “Average”,

“Fair” or “Poor”, shall be communicated, by the Registrar General of High

Court or by any other Officer authorized in this behalf by the Chief Justice,

to the Member of the Service concerned within three months from the date

on which the Annual Confidential Record or the Special Confidential Record

is completed as the case may be, under due acknowledgement from the

Member of Service concerned.

(ii) The factum of communication of entries in Annual ConfidentialRecord (ACR) or Special Confidential Record (SCR) shall be recorded inthe Confidential Record.

9. Representation against adverse remarks.––(i) Every Memberof the Service, to whom the entries in Annual Confidential Record (ACR)or Special Confidential Record (SCR) are communicated, shall within sixweeks from the date of receipt of that communication by him/her, submithis/her representation, if any, against the entries he considers adverse, tothe High Court and the same shall be placed immediately thereafter beforethe Administrative Judge or the Judge nominated by the Chief Justice orthe Chief Justice, who had made or approved the adverse remarks, as thecase may be, who may pass such orders as he deems fit on considerationof such representation. The orders, passed by the Administrative Judge orthe Judge nominated by the Chief Justice, on such representation shall beplaced before the Chief Justice for final orders.

(ii) The decision taken on such representation shall be communicatedto the Member of the Service concerned.

(iii) No further representation on the decision of the High Court shallbe entertained.

10. Punishments.—The pendency of any disciplinary proceedingsshall not be recorded in the Annual Confidential Record in respect of anyMember of the Service. However, a copy of the final order in all disciplinaryproceedings where a penalty is imposed shall be included in the AnnualConfidential Record and necessary entry therefor shall be made by theRegistrar General of the High Court.

11. Register to watch the disposal of the record.—A register inForm-D shall be maintained by the Registrar General of the High Courtand the entries made thereon shall have authentication of the Joint Registrarconcerned.

12. Power to issue clarifications.—Whenever the Registryentertains a doubt in any individual case as to the authority competent torecord the ACR/SCR in respect of any Member of Service under

circumstances not covered in the above guidelines, then, the Chief Justicewould decide the same and the decision of the Chief Justice shall be final.The Chief Justice shall have the power to issue clarifications for the purposeof effective implementation of these guidelines.
